espite many unprecedented challenges that impacted not only our local economy but our community as a whole in 2020, the Pensacola Community Redevelopment Agency (CRA) has continued its work toward the vision for the City’s rede- district, which include the velopment areas, especially within the “Hashtag” Waterfront Connector, Bruce Beach Improvements, a Urban Core district.
The Urban Core comprises a 256-block, 1,308-acre area that encompasses the City south of Cervantes Street, bounded to the west by A Street and to the east by 17th Avenue. It accounts for about 8.7 percent of the City’s total land area. Since its establishment in 1984, the district has experienced exponential growth. The 2010 Community Redevelopment Plan serves as the guide for all projects undertaken by the CRA. In 2020 alone, the Urban Core district saw significant progress and growth, with a total of 28 projects that were either started, underway or have been completed, ranging from small-scale residential property improvements to largerscale public-private partnership ventures. A total of $5.5 million was invested by the CRA to support projects within the Urban Core with a permitted value of $11.5 million. “Over the years, the CRA has worked to update the 2010 Community Redevelopment Plan for the Urban Core district to ensure the plan meets the changing needs of the growing downtown area,” Pensacola CRA Administrator, Helen Gibson said. Some of the significant and most current projects identified in the 2010 Urban Core Pan include community policing, affordable housing, infill development, targeted residential rehabilitation assistance, commercial facade improvements and park and waterfront access initiatives. Although the Urban Core has experienced many positive changes over the years, the CRA continues to work on more projects to help remove neighborhood blight and prevent its return through a series of initiatives which foster a diverse, inclusive and economically sustainable downtown district.
The CRA’s Urban Core Plan identifies a multitude of strategic improvement projects aimed at preserving and enhancing the district’s neighborhoods, fostering a productive urban environment and maximizing public access to the waterfront. Major initiatives include waterfront accessibility projects, complete streets redevelopment, implementation of recently adopted urban design standards and affordable housing. More recently, a bond refinancing plan was set-forth and approved by the CRA and City Council in order to gain additional revenue to support some of the larger projects outlined in the CRA’s 2010 Community Redevelopment Plan, specifically within the City’s Urban Core. “What we did was refinance some of the outstanding bonds that we had for the downtown area,” CRA Administrator, Helen Gibson explained. “Because at this point, we had them for a while and we wanted to get a better interest rate. Once approved, we were able to not only get a better interest rate on what we already had, but it also allowed us to gain additional money because the new rates were so low.” The CRA used the additional revenue gained from the approved Series 2019 bond issue, to do several projects that were identified in the original 2010 plan that hadn’t yet been done, according to Gibson. “Having a downtown that’s focused on being walkable with the proper amenities here, I think has the ability to be an economic engine, not just for Escambia County, but really for all of Northwest Florida,” Pensacola Mayor, Grover Robinson said. The additional revenue gained from the Series 2019 bond issue, provided a total of $17.8 million to fund four catalytic projects within the City’s Urban Core
new day marina at the Community Maritime Park and the East Garden District-Jefferson Street Road Diet (sidewalk and streetscape). In 2019, the City quickly signed onto the project and hired landscape architecture and urban design firm SCAPE, as well as the engineering firms HDR and Dewberry, to help make the concept a reality. “Hashtag” Waterfront Connector
Continuous Waterfront Trail System The “Hashtag” Waterfront Connector is an important multiphased project that carries out a key component of the Continuous Waterfront Trail envisioned in the Urban Core Community Redevelopment Plan. This project was named for the “hashtag” shape drawn by the concerning streets, Main and Cedar Streets connecting east to west and intersecting with Palafox and Jefferson Streets connecting north and south. The first phase of the project focuses on improvements to Main Street between South Alcaniz Street to South Baylen Street, including adding pedestrian connections, bike lanes, landscaping and protected lanes for businesses to receive deliveries without impeding traffic. The next two phases, which haven’t yet been approved and funded, would focus on making improvements to Cedar Street, and then working on Palafox and Jefferson streets. The key project priorities are to create a walkable, bikeable and safe environment, connect people to the waterfront, acknowledge and celebrate historic significance and encourage infill development and retail along Main Street. The project is expected to begin construction at the beginning of 2022 and be completed by the end of 2023.
A Bright Future for Bruce Beach
Bruce Beach Park Improvement Project Another catalyst project scheduled to break ground this year within the City’s Urban Core is the Bruce Beach Park improvement project. Bruce Beach is an area that once played an important role in Pensacola’s maritime industry in the early 1900s and has been an integral part of the City’s history over the last century. In the 1950s, after the Pensacola Shipyard closed, Bruce Beach was one of the few recreational areas open to black residents under segregation making the area a beloved gathering place for members of the black community. Along with park amenities like picnic areas, nature trails, early learning, interactive play features and green space, SCAPE also called for ecological efforts like habitat restoration and new stormwater treatment features, as well as historic plaques and other markers denoting the area’s rich history and importance in the black community. The project design plans also include a grand entry plaza, cultural exhibits, kayaking facilities and more. Key project priorities are to connect people to the water, restore and enhance local ecology, mark and commemorate African American history and heritage at the site and to create a cultural and educational destination at the Bay’s edge. Coming to Community Maritime Park The development of the Community Maritime Park as a visitor attraction plays a significant role in the revitalization of the City’s Urban Core district. The third major catalytic project scheduled to take place within the City’s Urban Core this year as outlined in the Urban Core Redevelopment Plan, is the installation of a new day use marina at

the Community Maritime Park in downtown Pensacola. As rooted in the Urban Core Redevelopment Plan, the Community Maritime Park Day Use Marina project will provide waterfront access points for boasters, kayakers and water taxi services. The project ties into several other strategic components called for by the plan and conceptualized in recent public and private master planning initiatives, according to CRA Administrator Helen Gibson. East Garden District Streetscape
Jefferson Street Road Diet The fourth catalytic project scheduled to break ground this year within the City’s urban Core district will be the East Garden District Streetscape. This project constitutes an extension of the Jefferson Street Road Diet project called for by the Urban Core Redevelopment Plan to provide connectivity to the waterfront at its southernmost terminus, adjacent to the Plaza de Luna Park. East Garden District is a master-planned redevelopment project bordered to the west and east by Palafox and Tarragona Streets, and to the north and east by Chase Street. The name and vision for the project pays homage to a redevelopment plan dating back to 1764, developed by British military officer and civil engineer Elias Durnford, that featured residential and commercial development lots located from the south of Garden Street down to the waterfront. The sale of each lot included a companion garden lot located to the north of Garden Street down to the waterfront. The East Garden District project is located where a portion of the garden lots used to stand back in 1764.

PORTION OF DOWNTOWN PENSACOLA STREET TO BE RENAMED IN HONOR OF FRED LEVIN The Levin Papantonio Rafferty law firm will be allowed to rename a portion of Zaragoza Street in front of its downtown office in honor of its namesake Fred Levin. The Pensacola City Council approved the name change at its Thursday night meeting, but the move spurred an ordinance change for future requests to protect preservation districts. Fred Levin Way will span only one block of the street from Baylen to Palafox streets and impacts only one other business — a parking lot that provided written support to the name change. In a letter to the council, the law firm’s president, Mark Proctor, said Levin — who died of COVID-19 in January — is worthy of such a significant change with the extent of philanthropic work he did in the city. “We recognize that ours is no ordinary request, but we believe that based upon Fred’s dedication to our city over the many years, it would be a collective honor to remember a man who has given so much,” the letter reads. Levin became one of the nation’s best-known trial attorneys through a $13 billion settlement against the tobacco industry in Florida, and he donated more than $35 million to universities, nonprofit organizations and hospitals in his philanthropic work. Levin used $10 million of his fee in the tobacco case to donate to the University of Florida law school, which named the school after him. Though the request on behalf of Levin was approved easily, there was lengthy
discussion on how to address the issue of name change requests in the future. The council added street names to an existing ordinance that regulates the naming of city parks after people, tweaking some of the criteria to address some street-specific concerns. Of particular concern, especially from council member Teniadé Broughton, was preserving historical districts and avoiding confusion for drivers when lengthy streets change names multiple times. The council decided to require any future requests include a first and last name or significant initials, and that street name change requests cannot be made in preservation districts. Those districts are most commonly visible because their street signs are brown as opposed to the city’s standard green color, Broughton said. In the case of Fred Levin Way, the street sign where Zaragoza meets Baylen is green and the one where Zaragoza meets Palafox is brown, because Palafox Street is protected, so the law firm will be able to have only one sign at Baylen Street, though the street’s name will be officially changed. In the future, if a petitioner wants to propose a name change to honor a person or historical figure, there will be additional considerations such as gaining approval of at least 90% of the impacted residents or businesses on the street and getting input from entities such as police, fire and public works to settle any conflicts.

This is a residential drop-off program only; no commercial waste accepted. Simply drive up and materials will be unloaded for you – no need to get out of your vehicle. Participants of the Regional Roundup are requested to:

ESCAMBIA COUNTY OFFICIALLY REIMBURSED BY FEMA FOR SECOND-LARGEST HURRICANE SALLY DEBRIS REMOVAL PROJECT Escambia County has been reimbursed from the Federal Emergency Management Agency, totaling $13,715,504.13, for costs associated with the county’s second-largest contractor debris removal dating back to Nov. 1, 2020. Escambia County utilized contracted workers following Hurricane Sally’s arrival on Sept. 16, 2020 until April 30, 2021 to remove and dispose of 689,477 cubic yards of vegetative debris, 201,863 cubic yards of construction and demolition debris, 854 hazardous leaning trees, 8,283 hazardous hanging limbs and 1.85 tons of hazardous household waste debris from public rights of way. The debris posed a serious threat to public health and safety. Additional expenses included the monitoring and field supervisory oversight of collecting, removing and disposal of all debris. “Millions of dollars were spent on debris clean-up from Hurricane Sally,” said Escambia County Public Safety Director Eric Gilmore. “We are grateful for FEMA approving this reimbursement grant. This grant is critical for Public Safety as we continue to recover from Hurricane Sally and prepare for future disasters.” FEMA’s Public Assistance program is an essential source of funding for communities recovering from a federally declared disaster or emergency.

FEMA’s Public Assistance program provides grants to state, tribal and local governments, and certain private nonprofit organizations, including houses of worship, so communities can quickly respond to and recover from major disasters or emergencies. TALLAHASSEE — From political and legal trailblazers to longtime education and corrections leaders, here are 10 people who died in 2021 after leaving marks on Florida politics, government and the courts: — ANNE CAWTHON BOOTH: When Gov. Reubin Askew appointed Anne Cawthon Booth to the 1st District Court of Appeal in 1978, she became the state’s first woman appellate judge, according to the Tallahassee-based court. Booth, who died in June at age 87, served until 2005, including a stint from 1985 to 1987 as the first woman to preside as a chief judge of an appellate court. — ROBERTO CASAS: Born in Cuba in 1931, Roberto Casas was elected to the Florida House in 1982 and the Senate in 1988. Casas, a Republican who died this month at age 90, served in the Senate until 2000. Miami-Dade County GOP Chairman Rene Garcia said Casas was “someone who opened doors for Cubans and the children of exiles to run for office and make a difference in their communities.” — STEPHEN GRIMES: After former Florida Supreme Court Justice Stephen Grimes died at age 93 in September, current Chief Justice Charles Canady described him as a “man steeped in traditional ways.” But Grimes, while serving as chief justice in 1994, also authorized placing a Florida Supreme Court website on the fledgling internet. Grimes was a member of the Supreme Court from 1987 to 1997, after serving as an appellate judge. — ALCEE HASTINGS: The elections of Alcee Hastings, Carrie Meek and Corrine Brown to the U.S. House in 1992 were landmark events, as they became the state’s first Black members of Congress since Reconstruction. Hastings, a Democrat who died in April at age 84, was Florida’s longest-serving member of Congress at the time of his death, representing parts of Broward and Palm Beach counties. — JOSEPH HATCHETT: When Joseph Hatchett took the Florida Bar exam in 1959, he could not stay in the hotel where it was administered because of the Jim Crow system. But in 1975, Hatchett became the first Black justice on the Florida Supreme Court and was named
NEW TRIAL ORDERED IN DOUBLE MURDER NEWS SERVICE OF FLORIDA STAFF Despite pointing to the “horrible facts” of the crimes, a divided appeals court Wednesday ordered a new trial for a man convicted of killing two people in 2015 in Palm Beach County and robbing an elderly woman. A panel of the 4th District Court of Appeal said Zachary Penna should receive a new trial because a deputy did not give Penna his Miranda rights before asking questions. Penna was convicted of two counts of firstdegree murder, one count of robbery with a weapon and one count of false imprisonment with a weapon. He was accused of stabbing to death two men at the men’s home, robbing an elderly woman of her shirt and purse as she walked down a street and then forcing one of his co-workers into a stolen vehicle, according to Wednesday’s opinion. But Limbaugh, a Palm Beach resident who died at age 70, left a huge imprint on Florida and national politics with his love-him-or-hate-him style and the influence he had on conservative media. — CARRIE MEEK: Carrie Meek was a woman of firsts. After serving in the Florida House, Meek in 1982 became the first Black woman elected to the state Senate. In 1992, she and fellow Democrats Alcee Hastings and Corrine Brown became Florida’s first Black members of Congress since Reconstruction. Meek, who died in November at age 95, remained in the U.S. House for a decade, with her son Kendrick succeeding her. — RALPH TURLINGTON: During his nearly four decades in public office, Ralph Turlington held two of the mostpowerful jobs in state government. Turlington, who died in May at age 100, served as House speaker in the 1960s and later served more than a dozen years as state education commissioner, at the time an elected Cabinet position. While he did not run for another term in 1986, he helped lead a drive to approve the Florida Lottery. — LOUIE WAINWRIGHT: Louie Wainwright led Florida’s corrections system from 1962 to 1986, a tenure that is almost certain to never be matched. But nationally, Wainwright will go down in history because his name was attached to the U.S. Supreme Court’s landmark 1963 Gideon v. Wainwright decision, which established a right to attorneys for criminal defendants. Wainwright, a Lawtey native, died this month at age 98.

Judge Edward Artau agreed that the circuit judge erred in refusing to suppress the statements but concluded that the errors did not justify ordering a new trial. Artau wrote that the “defendant’s inadmissible statements were merely cumulative to the other properly admitted evidence at trial, making the trial court’s error harmless.” Penna, now 30, is an inmate at Blackwater River Correctional Facility, according to the state Department of Corrections website.

TALLAHASSEE — Nearly a decade after concerns emerged about “medically fragile” children being placed in nursing homes, a federal appeals court will not reconsider a decision that allowed the U.S. Department of Justice to pursue a lawsuit against Florida. The 11th U.S. Circuit Court of Appeals on Wednesday declined to hear the case as a full court. A threejudge panel in 2019 backed the Justice Department’s authority to pursue a lawsuit under the federal Americans with Disabilities Act, prompting the state to request a hearing by the full court — known as seeking an en banc hearing. The issue of care for medically fragile children, who have severe health conditions, drew attention in 2012 after a Justice Department investigation found Florida was unnecessarily institutionalizing children with disabilities in nursing homes. The department also said the state’s Medicaid program placed other children at risk of institutionalization. The Florida Agency for Health Care Administration, which runs much of the state’s Medicaid program, vehemently disputed the allegations. Attorneys for a group of children filed a federal lawsuit alleging, in part, that the state was violating the Americans with Disabilities Act by failing to provide services that would allow children with severe medical problems to stay in their homes and communities. The Department of Justice tried to negotiate an agreement with the state but wound up filing a lawsuit. A U.S. district judge in 2017 ruled against the group of plaintiffs because of changes Florida made in the Medicaid program and also said the Justice Department did not have standing to pursue the case. But the appeals-court panel in 2019 backed the Department of Justice’s ability to file lawsuits under what is known as Title II of the Americans with Disabilities Act. Wednesday’s decision to reject the request for a full-court hearing did not provide an explanation and did not detail how many judges on the Atlanta-
based court opposed or supported holding such a hearing. But Judge Kevin Newsom, in a dissent joined by Judge Elizabeth Branch, disputed that Congress had given the Justice Department authority under Title II of the disabilities law to file such a lawsuit against the state. In part, he said the lawsuit was not based on any alleged violations of contracts. “At the end of the day, there simply is no cause of action authorizing the government’s non-contract suit here,” Newsom wrote. “And we aren’t at liberty to conjure one, no matter how sympathetic the plaintiffs’ case.” Newsom also wrote that he fears the 2019 panel decision “comes at real cost to core principles of federalism.” “The upshot of the panel’s holding is that the attorney general can enforce Title II of the ADA by suing state governments,” the 25-page dissent said. “That’s a big deal.” But Judge Jill Pryor, who was part of the 2019 panel, wrote a lengthy opinion supporting Wednesday’s decision to not hold a full-court hearing. “Under the (dissent’s) interpretation, upon receiving a complaint that a non-federally-funded public entity has discriminated against a person with a disability, a federal agency pours resources into investigating the complaint and attempting to reach an informal settlement,” Pryor wrote. “But if that process ultimately proves unsuccessful, the federal government must give up — because it may not sue the public entity to enforce the law. Without any enforcement teeth, such a regulatory process would be utterly ineffectual.” Pryor also rejected Newsom’s arguments about federalism. “This argument rests entirely on the … assumption that Congress did not authorize the attorney general to sue states or state agencies for discrimination when the discrimination occurred in connection with a program or activity that did not receive federal funding,” Pryor wrote. “Because Congress did in fact authorize the attorney general to sue any public entity for discrimination in violation of Title II, there is no federalism problem here.”
UNIVERSITY SYSTEM EYES $800 MILLION FACILITIES PLAN The universities reported collectively NEWS SERVICE OF FLORIDA STAFF A report from the state university system suggests $800 million in facilities money that could be sought during the 2022 legislative session should be divvied up to cover roughly half of each school’s needs. The system’s Board of Governors last month proposed making the funding request amid a discussion about aging buildings. Only Florida Polytechnic University, the state’s most recently-built school, is not reporting a need for deferred maintenance projects. The board’s Facilities Committee will meet Jan. 5 to consider approval of the budget request. An agenda posted online Wednesday outlined a proposal to divide the money based on “each university’s prorated share, as per their stated need” reported by the schools in a Dec. 5 survey.
MARCH ARGUMENTS SLATED ON GUN SALES LAW NEWS SERVICE OF FLORIDA STAFF The 11th U.S. Circuit Court of Appeals will hear arguments during the week of March 21 in a challenge to a 2018 Florida law that prevents people under age 21 from buying guns. The court issued a notice Wednesday that said the arguments will be held in Miami, though it did not specify an exact date. The National Rifle Association filed the challenge after the Legislature and then-Gov. Rick Scott approved the law in response to the February 2018 mass
needing $1.68 billion for facility maintenance projects. The suggested plan would provide 48 percent of each school’s stated need. For example, Florida State University would receive $171.5 million and the University of Florida would receive $281.8 million. Schools that were built more recently would receive less money, like Florida Gulf Coast University at $2.7 million and the University of North Florida at $10.7 million. The document said that “upon receiving funding, each university can allocate resources to the projects they deem most critical and of greatest priority at that time.” The plan is targeted at making repairs to buildings that house classrooms, laboratories, offices, gymnasiums and campus support services. The 2022 session will start Jan. 11.
