L
ong before automobiles and airplanes, railways served as the beating heart of the Industrial Revolution, provided easier transportation of goods, safer travel for passengers and even led to the standardization of time zones. Here in West Florida, the Pensacola and Atlantic Railroad, chartered in 1881, connected Pensacola across the sparsely populated Panhandle through thickets of cypress swamps and pine forests.
Along the 160 miles of tracks, two train depots were built in Milton and Marianna, the largest two towns along the route. Located within the historic Milton depot, built in 1909 to replace the original 1882 building that was lost in a fire, lies the West Florida Railroad Museum that is dedicated to preserving the local history of railways throughout our region and educating future generations to come. The L&N Milton combination freight and passenger depot is one of the few depots in America that has not only been preserved but is also still located on its original working grounds. Guests can walk the museum complex exploring train memorabilia and still feel the rattling of a passing train beneath their feet as modernday trains pass the depot. The station was closed in 1973, purchased and partially restored by the Santa Rosa Historical Society. The West Florida Railroad Museum opened inside the depot in 1989, completing the restoration.
Train enthusiast and former pilot, George Wilson, has been volunteering and leading tours at the museum for more than 15 years. For him, the children running down the wooden depot corridors and marveling at the model trains are what keep him coming back. The museum offers public and private tours, class field trips and rental of its 1929 dining car for birthday parties and special events. In the winter, the museum also offers a Polar Express experience with hot chocolate and cookies inside the vintage dining car while volunteers dressed as conductors read from the book. “We want to preserve the history and we want to make this an educational experience, but we also want it to be fun for children, so they keep coming back and learning more,” Wilson said. “We’re a railroad museum, so that means we teach about railroads. But I also teach a lot more than that. I can show you history about architecture, transportation, commerce, math, war, communication and technology. I can

take you from the telegraph and morse code to the radio and telephone. This train station was the hub to the entire community. If you wanted to send a telegraph message or ship a package, you came here. There is so much history in these walls.” The museum complex features the original train depot, the Bridge Tender’s House with a miniature HO model railroad depicting 1950s-era Northwest Florida, a section shed that rail workers used to maintain the tracks, the Garden Railway with an outdoor G-scale train layout as well as several vintage railroad cars. The railroad cars exhibited on the property include the L&N Dining Car 2722, L&N caboose 1148, Frisco caboose 1102, L&N boxcar 18050, L&N flat car 21107 and the former L&N baggage-dormitory car 1652, which was used by the Atomic Energy Commission in the 1960s to haul nuclear material for atomic and hydrogen weapons. Housed within the depot walls are the original ticket counters, baggage room, waiting room and the Railway Express Agency, where museum guests can learn about telecommunications, train routes and the significant impact the railroad had on the local timber industry and population growth across the West Florida region. Historical remnants of the segregated South still remain such as the depot’s original triple entrances that were marked for men, women and “colored” before the Civil Rights Act. In the adjoining freight house, visitors can see train memorabilia like a coal burning steam engine, coffin cart, luggage scale and 100-year-old train car seats. Across from the depot, is the Bridge Tenders House, which once stood by the swing bridge in the middle of the old Escambia Bay trestle before it was replaced in 1989. The prior two houses were destroyed by hurricanes in 1906 and 1926,
claiming the lives of the bridge tender’s family in 1906 that tried to ride out the storm. Now it houses the miniature train diorama of 1950s-era Northwest Florida complete with the Milton depot and stretching all the way to the Pensacola depot that is now the lobby of the Pensacola Grand Hotel. Fellow train enthusiast and Club Treasurer Peggy Humbert first discovered the West Florida Railroad Museum in 2015 when she joined the Emerald Coast Garden Railway Club, located at the back of the property. Members of the club help maintain the tracks, pull weeds, trim plants and, in exchange, can bring their own trains to run on the track system. The garden G-scale train layout attracts children, families and train enthusiasts alike to marvel at the immaculately landscaped garden with small plants and detailed figurines. Children, ages 3 to 12, are also invited to take a ride on the gondola-style train cars which surround the entire garden. “We have about 35 members, and the trains are owned by the members. So, what you see running today in the garden could be totally different tomorrow or next week” Humbert explained. “In addition to having a fixed layout here that we operate every week, we take layouts to various national train shows. It gives exposure to the museum as well as the City of Milton, because we carry a display board that has some information about Milton and the museum.” When they aren’t giving tours or maintaining the Garden Railway, museum volunteers and staff are busy working on preservation, repairs and fundraising to continue sharing the legacy of this historic local landmark. “We have projects going on constantly,” Wilson explained. There is always something being repaired—be it the plumbing in the restroom or fixing shingles

that blew off the roof. It’s just like anybody else that owns a home. The problem we run into is that a lot of our materials are no longer manufactured. So, we have to come up with some sort of alternative to use. For example, when we replaced some of the wood siding on the exterior, we had to have blades made specifically to mill the lumber so it would match what was there, because they don’t make that kind of lumber anymore. The goal is to keep it authentic.” The West Florida Railroad Museum is currently undergoing one of its biggest restoration projects to raise $100,000 needed to restore the old rusted and corroded train cars and make some much-needed repairs to buildings on the property. By 2022, they hope to have both cabooses and passenger cars repainted to help them weather the sands of time. The museum recently brought in a welder to begin restoration work on the L&N Dining Car 2722, which they rent out for parties and special events. “Preserving this depot allows us to share the history and make it personal,” Humbert said. “There are so many things that happened in this area that people don’t have any idea about. If we don’t preserve those things, they can’t learn and understand why they happened. I think it’s not just the history, it’s our culture, and it’s what makes us who we are. It helps us understand how we became the people we are, and I think that’s an important facet of it.” Whether you’re a history buff, a train aficionado or you’re looking for a family-friendly outing for the holidays, the West Florida Railroad Museum has a little of something for everyone. CITY OF PENSACOLA COMPLETES ANNUAL RESIDENT SATISFACTION SURVEY The City of Pensacola has completed the 2021 Resident Satisfaction Survey, gathering valuable feedback from residents about areas of success with city services and identifying opportunities for improvement. A total of 1,520 residents completed the online survey, a nearly 21% increase from 2020. This is the third consecutive year the survey has seen an increase in responses, with 2020 survey participation increasing by 56% from 2019, and 2019 survey participation increasing by 55% from 2018. The survey was conducted by the University of West Florida Haas Center to assess resident satisfaction with a variety of city services and determine residents’ top priorities for the City of Pensacola. Data will be used by the city to identify budget priorities and areas for improvement to provide high quality services to residents. “These survey responses will help the City of Pensacola continue to enhance city services and better serve our residents, while working together to continue to improve our community,” Mayor Grover Robinson said. “I am glad to see
we have such engaged citizens who are willing to provide their feedback to the city to help us succeed. I’d like to thank every resident who took time to give feedback about what’s most important to them, along with the UWF Haas Center for their research.” Highlights from the survey results include:
• More than half of respondents are satisfied with the City of Pensacola’s handling of COVID-19. • 83% percent of participants found the Mayor’s Bulk Cleanup (Mayor’s Neighborhood Cleanup) efforts either moderately, very, or extremely effective. • Only 13% of respondents showed dissatisfaction with ease of obtaining information about City services. • When participants rated their satisfaction with the city’s economic development efforts over the last year, they were most satisfied with public access to waterfront, with 39% of respondents either satisfied or very satisfied.
FEMA WATERFRONT REPAIRS AT MARITIME PARK, SANDERS BEACH BEGINNING IN DECEMBER The City of Pensacola will begin repairs this month to waterfront areas of Community Maritime Park and Sanders Beach that were damaged during Hurricane Sally. These projects are the first of multiple Hurricane Sally repairs to be completed in the coming months as the city continues to work with FEMA to restore Pensacola’s waterfront. The waterfront areas of Community Maritime Park and Sanders Beach will be closed while repairs are completed. The anticipated project schedule is as follows: • Community Maritime Park: Repairs underway, with an estimated completion date of April 8, 2022. • Sanders Beach Piers and Boardwalk: Repairs will begin Dec. 6, with an estimated completion date of April 1, 2022. All remaining FEMA-funded projects related to Hurricane Sally damage in the City of Pensacola are expected to be completed by Summer 2022, except for Wayside Park. The public’s patience is appreciated as the city works through the FEMA process required to move forward with repairs to City of Pensacola parks, boardwalks, waterfront areas and other public amenities that were damaged by Hurricane Sally. Additional FEMA Project Status Updates (Subject to Change)
is underway. Due to material delays, the estimated completion has shifted to December 2021. • Commendencia Slip: Funding has been approved by FEMA. Estimated construction commencement in January 2022, with estimated project completion in June 2022. • Osceola Golf Course and Clubhouse: Design is underway. Estimated construction commencement in January 2022, with estimated project completion in summer 2022. • Plaza De Luna: Estimated construction commencement in January 2022, with estimated project completion in July 2022. • Wayside Park: Coordinating with FEMA on funding amount. FEMA funding approval TBD; construction to follow once funding is approved. In addition to the FEMA approval process, which is necessary for the City of Pensacola to receive federal funding for these projects, some of the construction timelines have been delayed by the nationwide shortage of lumber and material. Residents are encouraged to use the interactive Capital Improvement Projects Dashboard on the City of Pensacola website, which will be updated with the latest information about FEMA projects as well as other capital improvement projects throughout the city.

CITY OF PENSACOLA WAIVES PARKING FEES DOWNTOWN DEC. 1926 FOR CITY-OWNED STREET PARKING Fees for city-owned street parking in downtown Pensacola will be waived Dec. 19–26 during Parking Amnesty Week, allowing downtown visitors to shop, dine, and enjoy the holiday lights and attractions without paying for parking. The free parking applies only to cityowned on-street parking, identified by teal blue ‘PARKPensacola’ signage. The free parking excludes parking lots, garages and privately managed parking spaces. Parking Amnesty Week gives the City of Pensacola an opportunity to support local businesses by removing the cost to park, encouraging people to shop local during the holidays. “Parking is a self-funded public enterprise that isn’t paid by taxpayers but is paid only by those who use the service,” said Parking Manager Lissa Dees.
“Offering a free week of parking gives the city an opportunity to support small businesses downtown while giving a little something back to our community in the process.” Revenues generated from City of Pensacola parking fees stay in the community and are used to fund parking improvements such as lighting, safety features, landscaping and repairs. Free or 2-hour parking is available throughout downtown Pensacola, and cityowned parking is always free on Sunday. • Pensacola Fire Department received the highest customer service satisfaction rating of any city department, with 94% of respondents giving PFD’s customer service four or five star ratings. • Other departments that received high customer service ratings included Pensacola International Airport (86% four and five star ratings), Pensacola Energy (73% four and five star ratings), Sanitation Services (68% four and five star ratings), and Parks and Recreation (66% four and five star ratings). Areas for improvement identified by the survey include:
• Two net promoter score questions suggest there is still some work for the city to do in order to move more residents from a “passive” category to “promoters” of the city as a recommended place to live and as a “City of Excellence.” • Customer service and responsiveness ratings with some outward-facing departments
• Continued improvements related to neighborhood safety, traffic safety and infrastructure • Housing market affordability Community safety was identified as the top priority for residents, selected by 33% of respondents. “Getting input from our residents is the best way for us to continue improving and becoming a city of excellence, and I look forward to working with our leadership team to address the concerns raised in the survey,” Mayor Robinson said. “The City of Pensacola continues to attract new residents every day, and by working together, I am confident that we can maintain the highest quality of life for our residents and continue making our great city even better.” The online survey period began in April 2021 and ended in July 2021. SEMINOLES SUSPEND SPORTS BETTING AFTER COURT RULINGS DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE --- Gambling on sports is off the table in Florida, at least for now, after the Seminole Tribe suspended its online sports-betting operations Saturday morning. The tribe stopped accepting wagers on its Hard Rock SportsBook mobile app after an appeals court on Friday refused to put on hold a judge’s ruling that said a deal giving the tribe control over sports betting throughout the state violates federal law. The Seminoles “will temporarily suspend operations of its mobile app in Florida” due to Friday’s decision by a divided three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia, tribal spokesman Gary Bitner said in an email Saturday. “Account balances for all current players will be refunded as requested,” Bitner said. Bettors trying to use the Hard Rock app Saturday morning received a message saying the online sportsbook was discontinued until further notice. “Although we are temporarily suspending the acceptance of new bets and account deposits, we remain committed to building the best place for sports betting in Florida,” the message said. The app also said “all active bets for events starting before 11 a.m. ET on Dec. 4 will run and settle based on event outcome per normal.” All bets for events starting after 11 a.m. Saturday “will be voided and initial bet amounts returned to your app wallet,” it said. “Your funds are safe & secure. The app will remain active for easy withdrawals,” the message said, advising users to check social media for updates.
Sports betting was included in a 30-year deal, known as a compact, signed by Gov. Ron DeSantis and Seminole Tribe of Florida Chairman Marcellus Osceola, Jr. this spring and authorized by the Legislature in a May special session. The “hub-and-spoke” sports-betting plan in the compact was designed to allow gamblers throughout the state to place bets online, with the bets run through computer servers on tribal property. The compact says bets made anywhere in Florida “using a mobile app or other electronic device, shall be deemed to be exclusively conducted by the tribe.” Under the compact, the tribe pledged to pay at least $2.5 billion over the first five years to the state because of sports betting and other benefits, such as being able to offer craps and roulette at tribal casinos. The Seminoles have paid the state $75 million since October, according to court records. Owners of Magic City Casino in Miami-Dade County and Bonita Springs Poker Room in Southwest Florida challenged the compact in federal courts in Washington, D.C. and Tallahassee, alleging the sports-betting provision violates federal law and would have a “significant and potentially devastating” impact on their businesses. The Havenick family has owned the pari-mutuels for decades. U.S. District Judge Dabney Friedrich on Nov. 22 invalidated the compact in the Washington case, finding that U.S. Department of the Interior Secretary Deb Haaland, whose agency oversees tribal gambling, erred when she allowed the compact to go into effect this summer. Friedrich ruled that the deal violates the federal Indian Gaming Regulatory Act, or IGRA, which creates a framework for gambling activity on tribal lands. JUSTICES DENY FIRED FAU PROFESSOR WHO QUESTIONED SANDY HOOK JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE --- The U.S. Supreme Court on Monday declined to take up an appeal by a former Florida Atlantic University professor who contended he was fired in retaliation for blog posts questioning the 2012 massacre at Sandy Hook Elementary School in Connecticut. Justices, as is common, did not explain their reasons for declining to hear the case filed by James Tracy, who contended that the university violated his First Amendment rights. Tracy, who was fired in late 2015 from his tenured post in the university’s School of Communications and Multimedia Studies, took the case to the Supreme Court after losing in U.S. district court and at the 11th U.S. Circuit Court of Appeals. Tracy drew widespread attention for blog posts questioning whether the Sandy Hook massacre --- in which a gunman killed 20 children and six adults --- had occurred. In a petition asking the Supreme Court to take up the case, Tracy’s attorneys described the blog, which was not part of the university, as “notorious and widely criticized.” But Tracy’s attorneys took aim at a university conflict-of-interest policy that requires faculty members to disclose outside activities. The appeal alleged that the university used the policy “as purported justification to terminate” Tracy for not disclosing information about the blog. The petition, filed at the Supreme Court in July, contended that the policy was unconstitutionally vague, chilled speech and gave the university “unbridled discretion to engage in content-based viewpoint discrimination against employees.” “(The) vagueness of the policy is
particularly dangerous because it operates to inhibit the fundamental First Amendment freedom of public university employees to speak on issues of public concern and engage in other expressive conduct,” the petition said. “It is entirely unclear, for example, whether the policy applies to speech activity such as uncompensated personal blogging, social media posting, or even article and op-ed writing.” But in a brief f iled in October, attorneys for the university wrote that Tracy’s “blog speech was not a motivating factor in FAU’s decision to discharge him from employment.” The brief said Tracy was fired for “gross insubordination” after he refused to comply with reporting requirements that were part of a faculty collective bargaining agreement. “As both the district court and the Eleventh Circuit observed, Tracy is in this position for one reason: He obstinately refused, for reasons he has never cogently explained, to simply complete the required disclosure report,” the brief said. In rejecting Tracy’s arguments in November 2020, a three-judge panel of the Atlanta-based appeals court upheld a jury’s decision on the First Amendment issue and a district judge’s rulings against Tracy on other issues. “To establish that he was discharged in retaliation for protected speech, plaintiff had to prove, among other things, that his speech played a ‘substantial part’ in the university’s decision to terminate him,” the appeals-court opinion said. “The jury found that plaintiff had failed to do so, as it found that plaintiff ’s blog speech was not a motivating factor in the university’s decision. We conclude that there was more than sufficient evidence to support the jury’s verdict.”

The judge also rejected the Seminoles’ requests to intervene in the lawsuit, which was filed against Haaland and the Department of the Interior, and have it dismissed. The tribe, which until Saturday had continued to allow sports bettors in Florida to place wagers on its mobile app after Friedrich’s ruling, filed an emergency motion last week asking the District of Columbia appellate court to stay Friedrich’s ruling. But after a flurry of court filings this week, a panel of the court denied the Seminoles’ attempt to put Friedrich’s ruling on hold until their appeal is resolved. “Appellant has not satisfied the stringent requirements for a stay pending appeal,” the order by Judges Cornelia T.L. Pillard and Justin R. Walker said. The order said Judge Judith W. Rogers would have granted a stay. The appellate judges did not elaborate on their reasons, as is common in such decisions. Saturday’s statement on behalf of the Seminoles said the tribe “looks forward to working with the state of Florida and the U.S. Department of the Justice to aggressively defend the validity before the appeals court, which has yet to rule on the merits of the 2021 compact.”
GREYHOUND RACING BAN CASE APPEALED NEWS SERVICE OF FLORIDA STAFF The owner of a Pinellas County greyhound kennel has gone to an appeals court after a circuit judge dismissed a lawsuit stemming from a 2018 constitutional amendment that banned dog racing at Florida pari-mutuels. Attorneys for Christopher D’Arcy and D’Arcy Kennel, LLC have contended that the voterapproved ballot measure resulted in an unconstitutional “taking” of property. But Leon County Circuit Judge Angela Dempsey last month rejected the arguments, writing, in part, that the ballot measure only prohibited greyhound owners from using the dogs to race at Florida pari-mutuels. “Here, plaintiffs retain virtually every stick in the bundle of property rights --- they can still race their dogs, they can still sell their dogs, they can still keep them as pets, and they can even race them in wagered
GAS PRICES DROP AMID OMICRON VARIANT CONCERNS NEWS SERVICE OF FLORIDA STAFF Average gasoline prices in Florida dropped four cents during the past week and are expected to continue to fall because of concerns about how the omicron variant of the coronavirus could affect global fuel demand, according to the AAA auto club. The average price Sunday for a gallon of regular unleaded gas in the state was $3.30, down from $3.34 a week earlier. Prices are expected to decrease because of lower crude-oil costs, which are down more than 20 percent from the 2021 high about a month ago. U.S. Department of Justice lawyers said in a court document this week the government did not oppose the tribe’s emergency motion for a stay and that it had not decided whether to appeal Friedrich’s ruling. As the tribe pursues an appeal of Friedrich’s ruling, the pari-mutuel owners are appealing a decision by U.S. District Judge Allen Winsor, who dismissed the Florida-based lawsuit challenging the compact. Winsor in October said the pari-mutuels did not have legal standing to sue DeSantis and state Department of Business and Professional Regulation Secretary Julie Brown over the gambling agreement. The pari-mutuels last week filed a notice that they were taking the case to the Atlanta-based 11th U.S. Circuit Court of Appeals.
