HOW VIRTUAL THER APY IS CHANGING MENTAL HE ALTH C ARE

irtual therapy, or teletherapy, is changing the way that mental health practitioners deliver services to their patients. After many face-to-face services were abruptly forced to shut down due to COVID19, mental health providers continued to care for patients by making the switch to teletherapy, which is a form of care that is conducted by video chat or phone call. At a time of global crisis, ensuring the accessibility of mental health resources remains critical for both practitioners and patients.

Pensacola based Licensed Mental Health Counselor (LMCH) and owner of Laynie Gibson, LMHC made the switch to teletherapy during the height of the pandemic. “From the clinician side of things, I think we were all, myself included, a little freaked out by the idea of moving to teletherapy at the beginning of 2020,” she said. “So much of what we do relies not only on what people are saying but how they’re saying it as well,” she explained. For Gibson, body language can be an important diagnostic tool in face-to-face therapy and she said it took some adjusting to work without that tool in teletherapy sessions. “How people are moving, or sitting or holding themselves throughout a session is a major element for both practitioners and patients within the therapeutic process,” Gibson said. “I’ve adapted to the little

nuances of what it’s like waiting for someone to have an emotional response in a video space, including waiting out things like glitches and poor connections.” Since teletherapy can be accessed from a patient’s residence, some people may prefer the convenience and comfort of processing their mental health concerns at home. “I actually prefer online therapy because it’s a lot more convenient,” said Claire, a local teletherapy patient. For Claire, the flexibility of teletherapy is especially helpful because of how her depression affects her own executive function. “When I’m depressed, I can just get on my laptop without having to get up, get ready and drive somewhere,” Claire explained. “I was aware of online therapy before COVID, but I never actually tried it until it was a necessity.”

With the popularity of telehealth on the rise, those in need of a good therapist have plenty of options to choose from. For anyone seeking teletherapy, Psychology Today (psychologytoday.com) keeps an active directory of LMHC’s and mental health providers who are registered in each state. In Pensacola alone, there are approximately 100 teletherapy providers listed on the directory. The directory contains various filters to use when searching for more specific options, such as gender, insurance, age range and therapy style. Verywell Mind (verywellmind.com) has also compiled a ranked list of online companies that offer teletherapy services based on consumer reviews and survey results. If you or someone you know is suicidal or in emotional distress, call the National Suicide Prevention Lifeline at 1-800-273-8255 to speak with a crisis counselor 24 hours a day, seven days a week. The City of Pensacola and the Southern Youth Sports Association have partnered to expand programming for Escambia County youth through the new Rafferty Center, which will provide recreational and educational opportunities to hundreds of local youth. The Rafferty Center will be constructed alongside Legion Field and the Theophalis May Resource Center, funded primarily through a $1 million donation from Troy and Ashley Rafferty, along with other private donations. “Through generous private donations like this, the City of Pensacola will be able to expand our facility in ways we would not have been able to fund without the community support,” Mayor Grover Robinson said. “I am very grateful for the support of Commissioner Lumon May, Councilman Delarian Wiggins, Troy and Ashley Rafferty, and all of our private donors who are making this project possible. Together, we will be able to enhance the programming and services for our youth, providing even more opportunities for our children to build strong minds and bodies.” Additional private contributions to this project were made by Doug Baldwin, Jim and Shirley Cronley, the late Fred Levin, Mike Papantonio and other associates of Levin Papantonio Rafferty Law Firm. Thanks to a bill filed by Rep. Alex Andrade and supported by Rep. Michelle Salzman, Rep. Jayer William-

son, and Sen. Doug Broxson, the State of Florida has also committed at least $150,000 to the project. The Southern Youth Sports Association, or SYSA, is a grassroots nonprofit organization that provides educational, recreational, athletic and cultural opportunities to children in the Escambia County community. SYSA offers basketball, cheerleading, baseball, football, tutoring, after-school and GED programs, currently serving approximately 800 youth ages 4-17. “This will help us expand our capacity to help more children,” said Escambia County District 3 Commissioner Lumon May, who is also the co-founder and director of SYSA. “We need to enlarge our footprint, because we don’t have the capacity in terms of buildings to do the services that we want to do.” Mayor Robinson, Commissioner May, and other local leaders joined together to announce the expansion on Martin Luther King Jr. Day, which May said was fitting for a community project like this. “Dr. King always talked about the dream and the hope for tomorrow and hope for the future,” Commissioner May said. “Most of the children we work with are disenfranchised, and this partnership was launched to give them hope and opportunity for the future.” Commissioner May said SYSA will be working over the next 30-60 days to raise the remaining funds needed before moving the project forward. UWF RECEIVES $600K GIFT COMMITMENT FROM SANDY SANSING TO NAME NEW SPORTS MEDICINE CENTER The University of West Florida announces a gift commitment of more than $600,000 from Sandy Sansing to support the Sandy Sansing Need-Based Student-Athlete Scholarship and for the expansion of the Darrell Gooden Center to include a new Sports Medicine Center. With this gift, the new Sports Medicine Center will be named in his honor. “Sandy has been a great friend to the University and this gift will financially assist future students while moving our Sports Medicine Center forward,” said Dave Scott, UWF director of athletics. “Having this gift come from a community leader, a UWF graduate and former student-athlete is a great testament to his belief in and support of his alma mater.” Sansing, CEO of Sandy Sansing Automotive, was on UWF’s first men’s golf team, received the first golf scholarship at UWF and graduated in 1969 with a Bachelor of Arts degree in accounting. He is a member of the UWF Athletics Hall of Fame, is a UWF Football Founder and currently serves on the UWF Athletics Sword & Shield Council. “I hope this gift serves as a reminder

to all student-athletes that they can do great things and support their community,” Sansing said. The gift will support current and future student-athletes at UWF through need-based scholarships and by creating a new state-of-the-art Sandy Sansing Sports Medicine Center that will provide quality medical care for injured studentathletes. The Sandy Sansing Sports Medicine Center will include a partnership for treatment and care with the Andrews Institute for Orthopaedics & Sports Medicine. “In the area of scholarships, I truly realize and appreciate the value of education,” Sansing said. “I know that I have been unbelievably blessed and want to pass that same blessing on to others. Education opens doors and allows young people the opportunity to get good jobs. Protect Pipes: Cover pipes and allow outdoor faucets to slowly drip to prevent from freezing and breaking.

5. Practice Fire Safety: Use safe heating sources indoors. Do not use fuelburning devices such as grills; they release carbon monoxide, which is a deadly gas. Also, make sure to use space heaters according to their instructions and be attentive to open flames. JUDGE BLOCKS UF POLICY IN SCATHING DECISION DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — In a scathing ruling Friday, Chief U.S. District Judge Mark Walker blocked the University of Florida from enforcing a controversial conflictof-interest policy that gave school administrators discretion over allowing professors to serve as expert witnesses in litigation. Walker’s 74-page opinion, calling the policy “pernicious” and a violation of faculty members’ First Amendment rights, vilified University of Florida leaders and admonished their attorneys. Tenured political science professors Sharon Austin, Michael McDonald and Daniel Smith filed the lawsuit after university officials denied their requests to serve as witnesses for groups legally challenging a 2021 state elections law (SB 90) that would, in part, make it harder for Floridians to vote by mail. In denying the professors’ requests, university officials said that going against the executive branch of the state government was “adverse” to the school’s interests. The professors, who were joined by three other faculty members in the lawsuit, argued that the university’s conflict-of-interest policy unconstitutionally discriminates based on viewpoint and content and has a “chilling” effect. Amid a national spotlight on the policy, University of Florida Kent Fuchs ultimately allowed the professors to be paid as expert witnesses in the elections lawsuit and hastily assembled a task force to explore the conflict-of-interest issue and offer recommendations. Fuchs signed off on a revised policy stating there is a “strong presumption” that the university will approve faculty or staff requests to testify as expert witnesses. But Walker belittled the revamped

policy, which allows administrators to deny requests “when clear and convincing evidence establishes that such testimony would conflict with an important and particularized interest” of the university. “That the policy still reserves UF the right to prohibit testimony contrary to its interests provides more evidence that the ‘revised’ policy is nothing new. The policy does not explain what ‘an important and particularized interest of the university’ might be. Nor has UF disavowed its ‘old’ policy, or pronounced that it would not prohibit faculty from participating in litigation against the state moving forward. What remains is a dolled-up version of the same old conflict-of-interest policy used to deny plaintiffs’ previous requests to serve as expert witnesses,” the judge wrote. The policy embraced by Fuchs gives university officials too much discretion, Walker found. “In other words, what standards or criteria, if any, guide UF’s discretion when deciding what amounts to ‘an important and particularized interest of the university?’ Quite frankly, there are none,” he wrote. Walker’s order Friday granted the plaintiffs’ request for a preliminary injunction. “Defendants must take no steps to enforce its conflict-of-interests policy with respect to faculty and staff requests to engage as expert witnesses or provide legal consulting in litigation involving the state of Florida until otherwise ordered,” the order said. Walker introduced his lengthy ruling with a sketch of the recent “demise of academic freedom” in Hong Kong, noting that universities are stifling dissent to keep in step with repressive national security laws. “Some might say, ‘that’s China, it could

FLORIDA POSTS 4.4 PERCENT UNEMPLOYMENT RATE JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Florida’s jobless rate dipped to 4.4 percent in December as state officials pointed to “steady growth” in the employment picture. The Department of Economic Opportunity on Friday announced the December rate, down from 4.5 percent in November. The December rate represented 466,000 Floridians qualifying as jobless from a workforce now at 10.66 million. Gov. Ron DeSantis, during an appearance in Sarasota, touted the state’s economic conditions as the COVID-19 pandemic continues. “Because we have been a free state, because we have protected people’s rights to work and run businesses, we’ve really been in great shape,” DeSantis said. “When you look at the budget, we have had huge amounts of revenue coming in.” The new unemployment figures show the state had regained 92.1 percent of the 1.27 million jobs lost in the early stages of the pandemic from February 2020 through April 2020. The recapture rate stood at 91.2 percent in November and 86.6 percent in October. “What I would consider here is that we are seeing steady growth,” Adrienne Johnston, the Department of Economic Opportunity’s chief economist, told reporters in a conference call. “We saw fast gains early on. And now we’re going to continue to see steady increases in employment. So, this is more like the trend was prior to the pandemic. The leisure and hospitality fields, which took the biggest hit from the pandemic, posted the largest number of new jobs, 142,600, in the past year. Jobs tied to trade, transportation, and utilities added 91,300 jobs in 2021. Education and health services were up 51,900, financial activities added 30,400 and construction added 20,400. Across the state, the Miami-Fort Lauderdale-West Palm Beach metropolitan statistical area had the lowest jobless rate in December at 2.6 percent. The region was one of the hardest-hit by the pandemic. The next-lowest rate was in the Naples-Immokalee-Marco Island area at 2.7 percent, followed by the Crestview-Fort Walton Beach-Destin area at 2.9 percent. The tourism-heavy Orlando-Kissimmee-Sanford area was at 3.8 percent. The Jacksonville area stood at 3.2 percent in December. The Tampa-St. Petersburg-Clearwater and Panama City areas were at 3.3 percent. The Pensacola area was at 3.4 percent. The DeltonaDaytona Beach-Ormond Beach area was at 3.8 percent. The highest unemployment rates were found in The Villages, Sebring and Homosassa Springs metro areas, each at 4.7 percent. Ron DeSantis and the Republican-dominated Legislature, which funds the state university system. Walker noted, however, “there is no evidence … that any representative of Florida’s government has directed UF to take any of the actions it has taken in this case.” Walker rejected arguments by the university that the policy has not “chilled” the professors because they continued to work as experts before and after they were denied permission to participate in the elections lawsuit. “The problem with defendants’ backward-looking argument is that it confuses what has happened — which is not this lawsuit’s subject — and what will happen,” Walker wrote, noting that the university for years has encouraged the professors to serve as expert witnesses “even if plaintiffs took positions that would irritate Florida’s government.” To bolster their arguments, the plaintiffs pointed to comments made by UF Board of Trustees Chairman Morteza “Mori” Hosseini, who lashed out at unidentified professors during a board meeting in November. Hosseini accused faculty members of having “taken advantage of their positions” by using their university jobs “to improperly advocate personal political viewpoints to the exclusion of others. … Our legislators are not going to put up with the wasting of state money and resources, and neither is this board.”

Hosseini’s remarks “made plain that UF was beholden to the Florida Legislature,” Walker wrote in Friday’s order. “Considering everything that has happened between UF’s initial denials and this case, I credit plaintiffs’ evidence that they are self-censoring because of UF policy, and I find that their chilled speech stems from their reasonable fears that the policy will be enforced against them moving forward,” he wrote. The university has “drawn a line in the sand,” Walker chided, saying “the revised policy retains the very features that plaintiffs challenge and continues to chill plaintiffs’ speech just like the original policy before it got its facelift.” The university is reviewing Walker’s order and “will determine our next steps,” spokeswoman Hessy Fernandez said in an email. Walker, who received his undergraduate and law degrees from the Gainesville school, skewered attorneys representing Fuchs, UF Provost Joseph Glover and the university’s board of trustees, who are defendants in the lawsuit. During a hearing last month, defendants’ lawyer Christopher Bartolomucci told Walker he needed more time to answer questions about a 1968 U.S. Supreme Court decision in a First Amendment case, known as Pickering v. Board of Education, that dealt with a school employee’s termination. Defendants’ counsel “made the dubious assertion that he had no idea that this case implicated the Supreme Court’s test from Pickering and its progeny,” Walker wrote in a lengthy footnote accusing the defendants’ lawyer of “mischief.” “For the uninitiated, that is roughly equivalent to an attorney in an abortion case feigning surprise in response to a question about Roe v. Wade and its progeny,” the judge wrote.

FIU PRESIDENT RESIGNED AFTER CAUSING ‘DISCOMFORT’ FOR COLLEAGUE JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — Amid questions about his abrupt resignation, longtime Florida International University President Mark Rosenberg acknowledged Sunday that his exit came after he caused “discomfort for a valued colleague.” Rosenberg said in a message Friday that he was “stepping back so that I may give full attention to recurring personal health issues and to the deteriorating health of my wife, Rosalie.” In a statement Sunday, he provided more details about those health issues but indicated that the sudden resignation stemmed from other reasons. “Regrettably, these issues spilled over to my work and I caused discomfort for a valued colleague,” the statement said. “I unintentionally created emotional (not physical) entanglement. I apologize to you. I take full responsibility and regret my actions. “I took it upon myself to disclose through proper institutional channels to have others assess the circumstances. Then in consultation with the Chair of the Board of Trustees (FIU trustees Chairman Dean Colson), I realized that an immediate change would be healthy for all parties particularly given my evolving personal and family health requirements.” The statement did not provide more details about the discomfort that Rosenberg said he caused. Colson on Sunday sent a note to the university community that said Rosenberg’s statement “provides greater insight into his resignation on Friday. It also provides insight into why the Board did not believe Friday was the appropriate time to celebrate the many accom-

plishments of FIU the past 13 years. We are deeply saddened and disappointed by the events requiring his resignation.” Rosenberg had led the university since 2009 and previously served as chancellor of the state university system. The FIU trustees on Friday appointed Chief Financial Officer Kenneth Jessell, who also serves as the university’s senior vice president for finance and administration, as interim president. In his statement Sunday, Rosenberg, 72, called Jessell the “right person at this moment to help all of us sustain our forward movement and continue with the unprecedented success that marks our ascendance.” Rosenberg said in the statement that his wife of 47 years is a Type 1 diabetic who has been on insulin for 45 years, has advanced dementia and multiple sclerosis. “I have been her nightly caregiver for over a decade,” Rosenberg said in the statement. “But Rosalie’s condition entered a new stage in just the last few months, resulting in further cognitive debilitation. When I finally realized the impact that her condition had on my personal well-being in late October 2021, I sought professional mental health services and am still under a specialist’s care.” Rosenberg’s departure made FIU the fourth state university that is either searching for a permanent president or poised to launch a presidential search. The University of North Florida and the University of South Florida are being led by interim presidents and are in the process of seeking new leaders. Also, University of Florida president Kent Fuchs announced this month he will step down at the end of 2022.

TALLAHASSEE — After a U.S. Supreme Court ruling this month that backed the Biden administration, Florida has dropped its appeal in a legal fight against federal COVID-19 vaccination requirements for health-care workers. Attorney General Ashley Moody’s office filed a motion Friday to dismiss an appeal that was filed at the 11th U.S. Circuit Court of Appeals. That appeal came after a Pensacola-based district judge in November refused to block the vaccination requirements for workers at hospitals, nursing homes and other health-care providers. The motion cited a Jan. 13 ruling by the U.S. Supreme Court that upheld the vaccination requirements in cases from other parts of the country. The requirements, which apply to providers that take part in the Medicaid and Medicare programs, will start to take effect Thursday in Florida. At that point, workers will need to have received at least one dose of vaccine or have pending requests for exemptions. Workers will have an additional month to become fully vaccinated. Gov. Ron DeSantis’ administration has continued to oppose the requirements and vowed not to help carry them out. Agency for Health Care Administration Secretary Simone Marstiller said after the Supreme Court ruling that her agency will “not survey for compliance with the CMS (federal Centers for Medicare & Medicaid Services) vaccine mandate rule.” The Republican-controlled Legislature in November held a special session that included passing legislation to bar vaccination mandates for workers. But many Florida health-care providers appear to plan to comply with the federal requirements after the Supreme Court ruling. Facilities such as hospitals and nursing homes depend heavily on funding from the Medicare and Medicaid programs and don’t want to jeopardize the money. “Our members are obligated to comply with the CMS rule and they have been planning accordingly,” Nick Van Der Linden, a spokesman for LeadingAge Florida, a long-term care industry group, said in an email Monday. “The potential loss of Medicaid and Medicare funding for not following the federal law could be devastating to providers and ultimately displace Florida’s most frail elders.” Kristen Knapp, a spokeswoman for the Florida Health Care Association, the largest nursing-home group in the state,

A key concern has been that requiring vaccinations will exacerbate worker shortages. “As facilities brace for the January 27 deadline, there is a concern that the repercussions of the vaccine mandate among health care workers will be devastating to our long term care workforce,” Knapp said in the email. “The staffing shortages are at crisis levels and forcing our care centers to limit admissions, which threatens access to care for our state’s seniors.” As of Jan. 9, Knapp said the nursinghome staff vaccination rate was about 76 percent. Van Der Linden said Monday that 87 percent of staff at his members’ communities — which include nursing homes and other types of facilities — are fully vaccinated. “Because workforce is the biggest concern for most of our members, some providers had concerns initially that implementing a mandate could cause them to lose staff during a time when they were already grappling with significant shortages,” Van Der Linden said in the email. “However, we also had members that had mandates in place before it was a requirement and so far no provider has reported a major exodus of staff after requiring vaccination as a condition of employment.” Moody’s office filed the state’s lawsuit Nov. 17 in federal court in Pensacola seeking to block the vaccination rule, which the Biden administration issued earlier in November. The lawsuit contended that the Centers for Medicare & Medicaid Services overstepped its authority with the requirements and violated a law known as the Administrative Procedure Act. But U.S. District Judge M. Casey Rodgers rejected the state’s request for a preliminary injunction or a temporary restraining order against the requirements. As the case remained pending at the Atlanta-based appeals court, the Supreme Court backed the Biden administration in a 5-4 ruling.

TALLAHASSEE — With lawmakers preparing to craft a new state budget, economists estimated Friday that Florida will collect nearly $4 billion more in general-revenue taxes than had been expected over two years. The increased estimates come after federal stimulus money has helped fuel consumer spending and as the state’s economy has bounced back during the COVID-19 pandemic. But the economists warned of a slowing that could occur because of the end of stimulus money and anticipated interest-rate hikes that will affect the housing market. Nevertheless, the new estimates were good news for lawmakers, who will negotiate a budget in the coming weeks for the 2022-2023 fiscal year, which will start July 1. Senate President Wilton Simpson, R-Trilby, issued a statement Friday that alluded to priorities he outlined during the Jan. 11 opening of the legislative session, such as raising wages for low-paid state workers. “With additional revenues coming in and a substantial amount of reserves, our state remains in a lot better shape than we ever thought possible,” Simpson said. “We still have some challenges ahead — as I mentioned during my opening day comments — (and) raising the minimum wage for both state workers and those who contract to perform critical services is going to put a lot of recurring pressure on nearly every area of our budget, particularly in the health care and education silos.” General revenue, which is made up of such things as sales taxes, corporateincome taxes and documentary-stamp taxes, plays a critical role in funding education, health care and prisons. But the economists grappled Friday with estimates for the coming months and year because of issues involving the end of federal stimulus money and higher interest rates. Amy Baker, coordinator of the Legislature’s Office of Economic & Demographic Research, repeatedly urged caution. As an example, the state has seen influxes of documentary-stamp taxes, which are collected on real-estate transactions, as the housing market boomed. Baker warned that “huge overages” in documentary-stamp taxes will not continue as interest rates are expected to rise and dampen the housing market. “It’s not going to continue, and where do we feel comfortable balancing the risk?” she asked at one point. But Holger Ciupalo, who represents Gov. Ron DeSantis’ office on the panel, was more confident about revenues. He said, for example, he doesn’t expect big housing-related changes over the next two months. “I just don’t think that precipice is imminent,” he said.

(“Pace”) recently became aware that participant information for some of its Florida students was improperly accessed during a data incident which was discovered the week of December 13, 2021. The improper access appears to have arisen from an intrusion into certain infrastructure systems in January 2021. At this time, Pace has identified the following types of student information that were improperly accessed: full name, address/phone number, date of birth, Florida Department of Juvenile Justice identification numbers, enrollment data, behavioral health information and parent/ guardian names. Pace recommends that students and their parents take immediate steps to protect the students from any potential harm resulting from the data incident, such as actively monitoring accounts, Explanation of Benefits (EOBs), and credit bureau reports. Pace also recommends students register a fraud alert with the three major credit bureaus: Equifax (800-525-6285), Experian (888-397-3742), or TransUnion (800-680-7289). Parents may also wish to visit IdentityTheft.gov, “or browse recovery steps” and then select “Children’s personal information.” Pace has and continues to take prompt action to investigate the incident and improve its security, including engaging an outside cybersecurity firm, securing network and physical computer access, and assessing data protection and gateway security systems.
