UWF EARNS TOP SPOT IN BOARD OF GOVERNORS’ METRIC 1 THAT MEASURES SUCCESS OF GRADUATES ONE YEAR AFTER GRADUATION The University of West Florida is No. 1 in the Florida State University System for Metric 1 of the Florida Board of Governors’ 2021-22 performance-based funding model. More than 72% of UWF bachelor’s graduates are employed or furthering their education one year after graduation. This is the third consecutive year UWF leads the Florida State University System in this metric. “UWF’s performance reflects our steadfast commitment to prepare our students for high-wage jobs in our state and position them for lifelong success,” said UWF President Martha D. Saunders. “Our high marks in many key metrics are a testament to the dedicated work of our students, faculty and staff.” Metric 1 is based on the percentage of a graduating class of bachelor’s degree recipients who are enrolled or employed in the U.S, earning at least $30,000. Due to the COVID-19 pandemic, the cohort of students used in the data for the 2021-22 metrics faced an uncertain job market upon graduation. An important component of this success is that UWF continues to produce bachelor’s degree graduates in Board of Governors designated programs of strategic emphasis which include STEM, health, education, global and workforce gaps. “We have put a very intentional focus on these metrics by developing longterm strategies and our efforts are paying off,” said UWF Provost and Senior Vice President George Ellenberg. “These highlights show our commitment to providing our students with a quality education and ensuring their success at every step of their academic journey and entry into the dynamic work environment they encounter.”

Another key to success on Metric 1 is UWF’s Office of Career Development and Community Engagement which shifted events and services to virtual platforms to ensure students and alumni had access to quality career opportunities, services and preparation resources. During 2020-21, CDCE hosted seven career fairs and Argos Suit Up! virtually which connected students to greater employment opportunities and provided companies the benefit of recruiting without restraining travel budgets, staffing resources or other fiscal limitations. UWF’s CDCE has kept a hybrid model for services and career fairs. UWF also excelled in Metric 4, which measures the graduation rates of firsttime-in-college, four-year students. This metric calculates the percentage of FTIC students who started in the Summer and continued to the Fall or started in the Fall, were enrolled full-time in their first Fall semester and graduated from the same institution by the summer term of their fourth year. UWF improved by 11 percentage points from last year. This is the largest increase in percentage points from the previous year in the Florida State University System. Under the performance funding model, the Board of Governors scores each of Florida’s 12 public universities based on 11 metrics designed to incentivize university excellence and improvement. These metrics establish a minimum acceptable level of performance on issues such as graduation and retention rates. For more information about UWF’s ranking in the Board of Governors performance-based funding model, visit uwf.edu/bogmetrics.

JUSTICES REJECT STATE’S ARGUMENTS IN DNA DISPUTE JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — The Florida Supreme Court on Friday turned down an attempt by Attorney General Ashley Moody’s office to block DNA testing of evidence in a 1975 murder that sent a man to Death Row. The dispute was unusual, at least in part, because Moody’s office objected to an agreement that Orlando-area State Attorney Monique Worrell reached last year with lawyers for Death Row inmate Henry Sireci to allow the DNA testing. Moody’s office asked the Supreme Court to overturn a circuit judge’s order that approved the testing. But in a onepage decision Friday, justices unanimously said they declined to “vacate the trial court’s order and therefore affirm” it. Sireci, now 73, was sentenced to death in the 1975 murder of used-car dealer Howard Poteet, who suffered 55 stab wounds, according to court documents. Sireci, who has received legal assistance from a national organization, the Innocence Project, has maintained that he did not kill Poteet. He was sentenced to death in 1976. Worrell, the state attorney in Orange and Osceola counties, agreed in May 2021 to additional DNA testing in the case. A circuit judge authorized the testing, and Moody’s office said it found out about the decision in a newspaper story. After unsuccessfully seeking reconsideration of the circuit judge’s order, Moody’s office appealed to the Supreme Court. Lawyers in Moody’s office argued in a March brief that the state

FLORIDA TOPS 74,000 COVID-19 CASES LAST WEEK NEWS SERVICE OF FLORIDA STAFF Florida has topped 71,000 new COVID19 cases in each of the past five weeks, a report released Friday by the state Department of Health shows. It has exceeded 73,000 reported cases in each of the past four weeks — including totaling 74,481 cases during the week that started June 24 and ended Thursday. The state has seen significant increases in COVID-19 cases during the past two months as subvariants of the coronavirus

attorney could not enter the agreement without the support of the attorney general, whose lawyers play a key role in death-penalty appeals. “The circuit court’s order in this longfinal case violates Florida’s comprehensive statutory and rule-based scheme governing postconviction DNA testing, a scheme that balances the state and public’s interest in the finality of lawful convictions with the desire to safeguard the reliability of verdicts,” the brief said. “The state attorney could not unilaterally waive the requirements of that scheme: By statute, the attorney general serves as co-counsel in all capital collateral proceedings, and her express objection vitiated any purported agreement with appellee (Sireci).” But Sireci’s lawyers wrote in a brief that state attorneys have discretion to allow DNA testing in cases where inmates argue they are innocent. “Appellant (the state) apparently disagrees with the current state attorney’s decision to allow Mr. Sireci … to conduct one final round of DNA testing before the state carries out his execution,” the brief said. “But Florida law does not give the attorney general the right to obstruct this well-established exercise of official discretion.” Evidence that would be tested by a laboratory includes such things as hairs, a bloody denim jacket and towels, according to court documents. In 2010, Lawson Lamar, then the state attorney in Orange and Osceola counties, reached an agreement that allowed DNA testing in the case, but the results were inconclusive, court documents said.

have spread. For example, the Department of Health reported 26,533 cases during the week that started April 22. But the total has exceeded 60,000 cases every week since the week that started May 13. It had 71,704 cases during the week that started May 27; 74,389 cases during the week that started June 3; 74,299 cases during the week that started June 10; and 73,780 cases during the week that started June 17, according to the report. Also, the Department of Health data showed that, as of Thursday, a reported 75,891 Florida residents had died of COVID-19 since the pandemic started in 2020.

NURSING HOME OWNER TO PAY $1.75M IN VACCINE PROBE NEWS SERVICE OF FLORIDA STAFF The owner of a West Palm Beach nursing home will pay $1.75 million to settle claims that it improperly diverted doses of COVID-19 vaccine to members of its board of directors and donors. The settlement stemmed from a federal Centers for Disease Control and Prevention program, known as the Pharmacy Partnership for Long-Term Care Program, that was designed to vaccinate nursinghome residents and staff members as vaccines first became available in late 2020. MorseLife, which owns a nursing home and an assisted-living facility, was accused of vaccinating hundreds of people ineligible for the program. “This specific vaccination program was designed to protect some of the nation’s most vulnerable individuals at a critical time when the COVID-19 pandemic was devastating that population,” Principal Deputy Assistant Attorney General Brian M. Boynton, head of the Justice Department’s Civil Division, said in a prepared statement. The settlement

STATE SAYS BEN & JERRY’S CHANGE ‘STEP IN RIGHT DIRECTION’ NEWS SERVICE OF FLORIDA STAFF Gov. Ron DeSantis and state Chief Financial Officer Jimmy Patronis praised Ben & Jerry’s parent company for a decision that will allow sales of ice cream in Israel. But that doesn’t mean Florida will immediately return to investing or contracting with the parent company, Unilever, and its subsidiaries. Over the objection of Ben & Jerry’s, Unilever on Tuesday announced an agreement that will lead to Avi Zinger, an Israeli manufacturer and distributor of the brand, selling ice cream independently under the product’s Hebrew and Arabic names in Israel and the West Bank. DeSantis said in a Twitter post that the move by Unilever is “a step in the right direction,” but he remained “disappointed they took a year to stand against” a movement that

resolved allegations that MorseLife “invited and facilitated the vaccination of hundreds of ineligible persons at the clinic by characterizing them as ‘staff ’ and ‘volunteers,’ many of whom MorseLife targeted for donations,” a Justice Department news release said Thursday. MorseLife enrolled in the program and scheduled a vaccination clinic Dec. 31, 2020, for residents and staff members of the nursing home, the Joseph L. Morse Health Center. But the Justice Department news release said 567 of the 976 people vaccinated were ineligible for the program. Prosecutors alleged that donors were listed as “staff ” and that MorseLife’s fundraising arm was directed to invite donors and potential donors to the vaccination clinic. Also, the Justice Department alleged the board’s vice chairman and his brother were allowed to invite close to 300 ineligible people to get vaccinated. In January 2021, Gov. Ron DeSantis announced the state was investigating the nursing home after national reports about the vaccinations. The governor’s office and the state auditor general did not immediately respond to questions Friday about the investigation.

involves boycotting Israel, divesting and imposing sanctions. Last year, the State Board of Administration, which oversees Florida’s pension fund and other investments, advised Unilever it had been placed on Florida’s list of “Scrutinized Companies that Boycott Israel” after Ben & Jerry’s said “it is inconsistent with our values for Ben & Jerry’s ice cream to be sold in the Occupied Palestinian Territory.” State Board of Administration spokeswoman Emilie Oglesby said in an email Friday that “at this time, it does not appear that the status of Unilever remaining on the state’s ‘Scrutinized Companies that Boycott Israel List’ would change.” When the state board took action last year, Florida had about $139 million in holdings in Unilever and its subsidiaries. “As we continue to review and learn more about this development, we will analyze such in the context of our statutory directives and act accordingly,” Oglesby said in the email.

Need a Lawyer? It is always a good idea to check with a lawyer before you make an important decision—whether you are buying a house, making a business deal, or settling a dispute. A short talk with a lawyer often tells you all you need to know—how serious a problem is, how to handle it swiftly and how to make sure it is settled for good.

Get Answers to Legal Questions Such As... • Marriage, Divorce & Family Matters • Business Problems • Criminal Charges of Juvenile Hearings • Wills, Trusts & Property of Decreased Relatives • Tax Problems & Planning • Credit or Collection Problems

• Corporation & Partnership Matters • Real Estate Purchases, Sales or Disputes • Consumer Problems • Landlord/Tenant Relations • Injuries to Yourself or Family Members • Property Damage

• Workers’ Compensation • Job Discrimination or Employer/Employee Disputes • Patents, Trademarks or Copyrights • Wages & Benefits • Social Security Disability • Labor Law

With over 50 participating local attorneys experienced in many different areas of law, we can help you find an attorney to handle your case. Your call is free. When you meet with your lawyer, there will be a small fee of $40.00 for the first half-hour consultation. Fees for additional services after the first half-hour are arranged between you and your lawyer. We do not have attorneys who accept pro bono or contingency cases.
