A
ccording to studies commissioned by The Nature Conservancy, Florida is one of the most biodiverse states in the United States. We rank 7th with 4,368 known animal species and 6th for vascular plant diversity, with 3,038 species. Florida also ranks among the top f ive states in endemic species—animals and plants only found in our state. We have 269 species of animals that can only be found in Florida. With such a rich tapestry of flora and fauna, writers, photographers, artists and nature lovers have hiked, biked and explored the various regions of our state for years to uncover its unique and biodiverse areas. With his century-old camera, Clyde Butcher has been exploring and documenting the Everglades for more than three decades. The result is a stunning collection of large-format blackand-white photographs that depict untouched parts of the nation’s largest subtropical wilderness. The rugged and remote beauty of the Everglades is captured in these works which span
over thirty years of foraging into dense swampland. Delicate ecosystems, rare botanical specimens, and sweeping landscapes bring the wonder of this mysterious part of our country to light. This summer, the Pensacola Museum of Art will be featuring Butcher’s captivating photographs in the exhibition, America’s Everglades: Through the Lens of Clyde Butcher. The scale, extraordinary clarity and tonal range set his photographs apart as exceptional works of art, earning him recognition as the foremost landscape photographer in America today. These powerful black and white images are portraits of the eternal bond between man and nature that is the soul of the Everglades. From the deepest cypress strands of the sawgrass prairies, coastal waters, and languid estuaries, to pinpoint still-
lives of rare species, Clyde reveals its ecosystems in magnificent detail. He makes an unquestionable case for why we should care about its future. “This exhibition highlights Butcher’s artistic eye as well as his deep and long-held commitment to conservation,” says Anna Wall, Chief Curator at the Pensacola Museum of Art. “While the ideologies and beliefs of Florida citizens may be vast and wide-ranging, the natural environment of our state is something we can share and appreciate together.” Butcher’s work challenges viewers to explore the heritage we share in the natural world and to work together to protect it. Through his photography, Butcher hopes to educate the public by bringing environmental issues to the forefront of public consciousness. On Friday, June 10, the Pensacola Museum of Art will be hosting an Opening Reception for all of their summer exhibitions including the Butcher show. Also on view, Taking a Line for a Walk: 100 Years of Drawing and Printmaking, highlights the diverse
materials, techniques and subject-matter artists have explored through drawing and printmaking over the last century. Additionally Goods of Desires: Cindy Leung, features mixedmedia ceramic sculptures that utilize Chinese exports to address the complex relationship between consumerism, colonization and cultural hybridity. On September 16th, Butcher will be present for an Artist Talk & Closing Reception at 6 p.m. at
the PMA in which he will discuss his work, take questions from audience members and share his passion for Florida conservation. This event is free and open to the public. America’s Everglades: Through the Lens of Clyde Butcher will be on view at the Pensacola Museum of Art from June 10 to September 18, 2022. ESCAMBIA COUNTY ENCOURAGES RESIDENTS TO PRACTICE HOT WEATHER SAFETY With a Heat Advisory in effect and high temperatures in the forecast, Escambia County Emergency Management would like to remind residents to exercise caution and take steps to stay safe in the heat this summer. According to the U.S. National Weather Service of Mobile, heat index values of 110 degrees and 112 degrees are expected for the Pensacola area today and Saturday, June 18. High temperatures are expected to continue through Sunday and into next week. Heat is one of the leading weatherrelated killers in the United States, resulting in hundreds of fatalities each year. Heat can be very taxing on the body. Follow these heat safety tips from U.S. National Weather Service:
• Slow down. Strenuous activities should be reduced, eliminated, or rescheduled to the coolest time of the day. Individuals at risk should stay in the coolest available place, not necessarily indoors. • Dress for summer. Lightweight, light-colored clothing reflects heat and sunlight, and helps your body maintain normal temperatures. • Foods (like proteins) that increase metabolic heat production also increase water loss. • Drink plenty of water or non-alcoholic fluids. Your body needs water to keep cool. Drink plenty of fluids even if you don’t feel thirsty. • Do not drink alcoholic beverages.
• Spend more time in air-conditioned places. Air conditioning in homes and other buildings markedly reduces danger from the heat. If you cannot afford an air conditioner, spending some time each day (during hot weather) in an air-conditioned environment affords some protection. • Don’t get too much sun. Sunburn makes the job of heat dissipation that much more difficult. Everyone can be vulnerable to heat, but some more so than others. Hot Vehicle Safety
• It is NEVER safe to leave a child, person with disabilities or pet locked in a car. • If you have a toddler in your household, lock your cars, even in your own driveway. Kids play in cars or wander outside and get into a car and can die in as little as 10 minutes. A reported 23 children died in hot cars in 2021. • If you see a child alone in a locked car, get them out immediately and call 911. A child in distress due to heat should be removed from the vehicle as quickly as possible and rapidly cooled. FLORIDA FOREST SERVICE DISPLAYS “TREES” EXHIBIT AT WEST FLORIDA PUBLIC LIBRARIES West Florida Public Libraries is hosting an art exhibit organized by the Florida Forest Service to celebrate the inherent value of trees and their many benefits to society and the natural world. “Trees” is an exhibit of paintings, sketches and photography created by University of West Florida art students and the Florida Forest Service’s Escambia County Forester, Cathy Hardin. The exhibit is open through July at the Pensacola Branch of West Florida Public Libraries, located at 239 N. Spring St. Hardin and Dale Castelucci, an adjunct instructor in the art department at UWF hatched the idea of a trees show. Amy Horosky with West Florida Public Libraries is an avid tree lover and enthusiastically embraced the idea getting the needed approvals to host the show. Castelucci found student artists to participate. “Trees have value over and above what meets the eye,” Hardin said. “Many people appreciate trees for their shade,
beauty, or lumber; but may not realize many of the other benefits. These benefits include reducing stormwater runoff, habitat enhancement, products made from all parts of the tree and so much more. Trees often impact people in deep ways and with their natural beauty, trees readily lend themselves to creative endeavors. This exhibit highlights how trees improve our lives and the impact they have on society and the natural world.” The Florida Forest Service, a division of the Florida Department of Agriculture and Consumer Services, manages more than 1 million acres of state forests and provides forest management assistance on more than 17 million acres of private and community forests. The Florida Forest Service is also responsible for protecting homes, forestland and natural resources from the devastating effects wildfire on more than 26 million acres. A jury in Escambia County Circuit Court awarded $802,000.00 in damages to a 52 year-old man who was left permanently disabled after being hit by a 36,000pound garbage truck managed by the Escambia County Utilities Authority (ECUA). The client’s vehicle was hit from behind by an ECUA garbage truck. The clients’ car was totaled as well as causing significant physical trauma and injury to the client’s back. The wreck occurred when the ECUA driver operated his vehicle in a careless/negligent manner, causing the utility truck to slam into the client’s Ford Explorer; the impact caused considerable damage to all vehicles involved. Zarzaur Law, P.A. brought suit on behalf of the client, arguing that ECUA’s negligent driver was the cause of his injuries. At the time of the trial, ECUA refused to offer anything more than $30,000.00, arguing that all of the client’s injuries were pre-existing and unrelated to the crash. Zarzaur Law, P.A. knew that the client had never experienced back pain before the wreck, and emphasized that fact to the jury. Counsel for ECUA argued that the injured party was “exaggerating” and paid an expert $11,000.00 to come into court and suggest that fact. The jury heard evidence and testimony about how the wreck had impacted the client, learned about the medical treatment the client received, and about the

long lasting and permanent effects of his injuries. The day prior to the verdict, lawyers at Zarzaur Law asked ECUA counsel if they were interested in a settlement in the range of $75,000 to $99,000. ECUA counsel rejected any suggestion for continuing settlement discussions. The jury, after hearing the evidence and after considering all of the defenses from ECUA and its lawyer, ruled in the plaintiff ’s favor and awarded Zarzaur Law’s client $802,000. The $802,000.00 verdict included damages for past medical treatment, future medical treatment, pain and suffering in the past, and pain and suffering in the future. ECUA claims they will appeal. “There is nothing like a jury putting an obstinate defendant in their place,” said Attorney Joe Zarzaur. “Every time a local jury holds a careless driver responsible, they make our community safer by deterring others from driving carelessly. PARKS AND RECREATION TO HOST GULF COAST RECREATION CLASSIC JUNE 20-25 Escambia County Parks and Recreation is thrilled to announce the start of the Gulf Coast Recreation Classic at John R. Jones Ballpark, 555 E. Nine Mile Road. The games begin Monday, June 20 and last until Saturday, June 25. Game times are 5:30 p.m. and 7:15 p.m. each night. 53 recreation-based all-star teams will participate in the Gulf Coast Recreation Classic, including teams from Escambia County, City of Pensacola, City of Gulf Breeze and Santa Rosa County. Teams consist of youth baseball players ages 7-15. The tournament is open to the public at no charge. All spectators are welcome to come support the recreation all-stars. Escambia County teams include players from Northwest
Escambia Baseball, Brent Baseball Youth Sports Association, NEP Baseball and Molino Recreation Association. “We felt there was a void in the area for local recreation-based all-star teams and wanted to give them a place to play this summer,” said Parks and Recreation Director Michael Rhodes. “We are proud to host this many teams in the tournament this year. This is our first time hosting and it’s a big task for our department to manage, but our team has stepped up to the plate. DOZENS OF LAWMAKERS GET TICKET BACK TO TALLAHASSEE JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE --- More than threedozen Florida lawmakers, including incoming Senate President Kathleen Passidomo, appeared headed back to Tallahassee without opposition as a deadline passed Friday for qualifying for the November elections. Meanwhile, all 28 congressional districts will have contested races, according to the Florida Division of Elections. The Division of Elections had not posted a finalized list of candidates on its website as of 7 p.m., after the noon qualifying deadline. But numerous state lawmakers, mostly Republicans, appeared on the fast track to return to their current seats or as House members running unopposed for Senate seats. “This is an important day because we now know who will be on our primary election ballot,” Hillsborough County Supervisor of Elections Craig Latimer said in a news release that noted more than 160 people are expected to appear on the ballot in his county, from candidates for the U.S. Senate to special taxing districts. Republicans are expected to retain their majorities in the state House and Senate this fall, based on factors such as registered-voter numbers, 2020 voting patterns and a lack of challengers in many races. Republican House members who appeared headed toward getting re-elected without opposition were Patt Maney of Shalimar, Jason Shoaf of Port St. Joe, Chuck Brannan of Macclenny, Wyman Duggan of Jacksonville, Cyndi Stevenson of Saint Johns, Joe Hard-
ing of Ocala, Stan McClain of Ocala, Tyler Sirois of Merritt Island, Thad Altman of Indialantic, Sam Killebrew of Winter Haven, Melony Bell of Bartow, Will Robinson of Bradenton, James Buchanan of Osprey, Michael Grant of Port Charlotte, Spencer Roach of North Fort Myers, Mike Giallombardo of Cape Coral, Bob Rommel of Naples, Lauren Melo of Naples, Kaylee Tuck of Sebring, Tom Fabricio of Miami Gardens, David Borrero of Sweetwater, Alex Rizo of Hialeah and Daniel Perez of Miami. Democrats who appeared assured of remaining in the House were Dianne Hart of Tampa, Christine Hunschofsky of Parkland, Michael Gottlieb of Davie, Felicia Robinson of Miami Gardens and Kevin Chambliss of Homestead. With all Senate seats up for election this year because of the once-a-decade redistricting process, likely winners without opposition included Passidomo of Naples; Sen. Jennifer Bradley, R-Fleming Island; Senate Majority Leader Debbie Mayfield, R-Indialantic; Sen. Danny Burgess, R-Zephyrhills; Sen. Gayle Harrell, R-Stuart; Sen. Anna Maria Rodriguez, R-Doral; and Sen. Jason Pizzo, D-North Miami Beach. Also, House Republicans Erin Grall of Vero Beach and Bryan Avila of Miami Springs had not drawn opposition as they run for Senate seats. Some Senate races will be fiercely contested this year, including races that emerged in recent days. For example, former Florida State University and NFL football player Corey Simon, a Republican, will take on Sen. Loranne Ausley, D-Tallahassee, in North Florida’s Senate District 3.
In Hillsborough County’s District 14, Sen. Janet Cruz, D-Tampa, will face the winner of a Republican primary involving Jay Collins, a Green Beret veteran backed by Gov. Ron DeSantis, and Shawn Harrison, a former House member who has been supported by Senate GOP leaders. DeSantis this week also backed Lee County Republican Chairman Jonathan Martin to replace Sen. Ray Rodrigues, R-Estero, who will not run for another term in Senate District 33. Martin appeared likely to only face a write-in opponent. One of the more interesting races in the Aug. 23 primaries will feature Senate Minority Leader Lauren Book, D-Plantation, going against former Broward County Mayor Barbara Sharief in Senate District 35. In statewide races, DeSantis will not face a primary opponent, while U.S. Rep. Charlie Crist and Agriculture Commissioner Nikki Fried will vie in the Democratic gubernatorial primary. Meanwhile, state Chief Financial Officer Jimmy Patronis and former Democratic House member Adam Hattersley of Hillsborough County will square off in November. Also, Attorney General Ashley Moody awaits the winner of a three-way Democratic primary involving: Aramis Ayala, a former state attorney in Orange and Osceola counties; Jim Lewis, a Fort Lauderdale criminal defense lawyer; and Daniel Uhlfelder, a Northwest Florida lawyer who drew national attention for dressing as the Grim Reaper as he criticized DeSantis’ handling of the coronavirus pandemic.
Along with the race for governor, the other highest-profile race in the state is for a U.S. Senate seat held by Republican Marco Rubio. U.S. Rep. Val Demings is heavily favored to win a Democratic primary to face Rubio. Among notable clashes for U.S. House seats, the race in Congressional District 2 features U.S. Rep. Neal Dunn, a Panama City Republican, and U.S. Rep. Al Lawson, a Tallahassee Democrat. Lawson opted to run in District 2 after his current District 5 was redrawn in the redistricting process. The Democratic primary to replace Demings in Central Florida’s Congressional District 10 includes state Sen. Randolph Bracy of Ocoee, former U.S. Rep. Alan Grayson and former U.S. Rep. Corrine Brown, who lost re-election in 2016 after facing criminal charges. The contest in Central Florida’s Congressional District 7 is wide open after bluedog Democrat Stephanie Murphy decided not to seek re-election. Four Democrats and eight Republicans are seeking the seat. In a crowded field in Congressional District 15, headliners include former Florida Secretary of State Laurel Lee, state Sen. Kelli Stargel, R-Lakeland, and state Rep. Jackie Toledo, R-Tampa. Meanwhile, in Miami-Dade County, state Sen. Annette Taddeo, D-Miami, is hoping to unseat freshman U.S. Rep. Maria Elvira Salazar, R-Fla., in Congressional District 27. Taddeo would have to first defeat Miami City Commissioner Ken Russell in the Democratic primary.

TALLAHASSEE --- Gov. Ron DeSantis said Monday he expects to act quickly on the remaining bills from the 2022 regular legislative session. With the state’s new fiscal year ready to start July 1, DeSantis had 52 bills remaining on his desk from 280 that were approved by lawmakers during the regular session and two subsequent special sessions. The Legislature sent the final batch of bills to DeSantis on Friday. DeSantis can sign, veto or allow bills to become law without his signature. Asked Monday about one of the remaining bills, a controversial measure that would change alimony laws (SB 1796), DeSantis did not say whether he would approve the proposal. He only said he expects to sign or veto all the remaining measures, possibly this week. “We’re going through our process. A lot of bills that get turned out, you know, they get dumped on my desk and I’ve got to look to see on all of them, we do our due diligence,” DeSantis said while at the Pig Bar-B-Q in Callahan. “We research them. We try to make the best decisions that we can, you know, for the people of the state of Florida. So, that process is ongoing. I think we’ve gotten through probably 80 (percent) to 90 percent of the bills already.” Former Gov. Rick Scott twice vetoed proposed alimony overhauls. This year’s bill would make a series of changes, including revising the process for modification of alimony when people who have been paying seek to retire. Ex-spouses who pay would have to give one year’s notice indicating they intend to retire and could stop payments upon retirement, except under certain circumstances. The bill also would do away with permanent alimony and set maximum durations of payments. Spouses who have been married for less than three years would not be eligible for alimony and those who have been married 20 years or longer would be eligible to receive payments for up to 75 percent of the
length of the marriage. Another part of the bill would require judges to begin with a “presumption” that children should split their time equally between parents. Critics argued that parts of the proposal, such as the changes dealing with retirement, could impoverish ex-spouses who have been homemakers and are dependent on alimony payments. But Marc Johnson, chairman of the group Florida Family Fairness, which supports the bill, issued a statement Friday that said it is “time to modernize Florida’s family court laws, by making the process more equitable and predictable for all parties while reducing the cost of litigation.” Agriculture Commissioner Nikki Fried, a Democratic candidate for governor, declined to address the alimony bill Monday. But she said DeSantis should veto a separate pending measure that could open the door to businesses filing lawsuits against cities and counties. “It is important that local governments have the ability to do what is right for their communities. Fried told reporters at the Capitol. “If the people don’t like the legislation, the ordinances they pass, then they vote them out of office. But for state government to come in and override those decisions and create this opportunity for businesses to sue, is the most egregious overstep of home rule that I have seen.” Before the bill passed in March, House sponsor Lawrence McClure, R-Dover, said it would cause local governments to “pause” before they enact ordinances that would hurt businesses. The bill (SB 620) would allow businesses to sue cities and counties if ordinances cause at least 15 percent losses of profits. It would apply to businesses that have been in operation for at least three years and allow them to file lawsuits seeking lost profits for seven years or the number of years the businesses have been in operation, whichever is less. The regular legislative session ended in March, though lawmakers each year gradually send bills to DeSantis for his consideration.
TALLAHASSEE — Attorneys for the state and online-industry groups plan to go to the U.S. Supreme Court in a battle about a 2021 Florida law that would crack down on social-media giants such as Facebook and Twitter, according to new court filings. The filings effectively seek to put proceedings on hold in a federal district court and the 11th U.S. Circuit Court of Appeals while the case goes to the Supreme Court. The state plans to file a petition urging the Supreme Court to take up the case, and the online-industry groups NetChoice and the Computer & Communications Industry Association plan to file a cross-petition seeking Supreme Court review, according to a joint motion filed Friday at the Atlantabased appeals court. “First, this case plainly presents important questions that warrant Supreme Court review,” the motion said. “Under review in this case is a ‘first-of-its-kind law’ that regulates social media platforms. Whether and to what extent states may regulate social media platforms is an issue of profound importance.” The new filings came after a threejudge panel of the appeals court on May 23 upheld most of a preliminary injunction that U.S. District Judge Robert Hinkle issued last year blocking the law. Hinkle and the appellate panel ruled that the law violated First Amendment rights. The law, approved by the Republicancontrolled Legislature and Gov. Ron DeSantis, targeted companies such as Facebook and Twitter over decisions to remove politicians and other users from the social-media platforms. DeSantis made a priority of the issue after Twitter and Facebook blocked former President Donald Trump from their platforms after Trump supporters stormed the U.S. Capitol on Jan. 6, 2021. The law, in part, sought to prevent the platforms from banning political candidates from their sites and to require companies to publish --- and apply
consistently --- standards about issues such as banning users or blocking their content. Companies could face penalties for violating restrictions in the law. For example, companies that remove political candidates from platforms could face fines of $250,000 a day for statewide candidates and $25,000 a day for other candidates. NetChoice and the Computer & Communications Industry Association challenged the law, and Hinkle in June 2021 issued a preliminary injunction, calling the law “riddled with imprecision and ambiguity.” That led the state to take the case to the appeals court. As the Florida case has played out, courts also have grappled with the constitutionality of a similar Texas law. A U.S. district judge issued a preliminary injunction last year against the Texas law. But a divided panel of the 5th U.S. Circuit Court of Appeals in April issued a stay of that preliminary injunction — a move that would have allowed the Texas law to take effect. NetChoice and the Computer & Communications Industry Association quickly asked the U.S. Supreme Court to vacate the stay, and the justices agreed in a 5-4 decision May 31. While that decision at least temporarily prevented the Texas law from taking effect, it did not resolve the underlying constitutional issues. The attorneys for Florida and the industry groups cited the Texas case in the motion filed Friday at the 11th Circuit. “The Florida law has been subject to a preliminary injunction since before its effective date. The Supreme Court recently acted to preserve the status quo and prevent the Texas law from going into effect pending Supreme Court review,” the motion said. “The (Florida) parties agree that maintaining the status quo (in district court and the 11th Circuit) while they seek clarity on whether and to what extent a state may regulate social media platforms would conserve resources and is appropriate under the circumstances.”
