STREETS OPEN FOR THE

RETURN OF CICLOVÍA

W

arm weather, blooming flowers and outdoor activities all mark spring’s arrival in Pensacola. It’s that time of year when we can finally shed those extra layers of clothing and enjoy weather more typical of Florida. Thankfully, there is an event where Pensacolians can gather and celebrate the spring “Ciclovía creates a fun, safe with a bout of outdoor fun—Ciclovía.

Ciclovía Pensacola will return to downtown Pensacola on March 26 from 10 am to 3 pm. On this day, the streets of downtown Pensacola will close down to be opened up; that is, all motorized traffic will be closed along Palafox and Main Street for people to roam the open streets on their wheels of choice. Ciclovía, which translates to “open streets,” started out as an activist movement in Bogotá, Colombia in 1974. Activists were concerned with the effects of Bogotá’s over industrialization on people’s health. Since then, Ciclovía has transformed into a regular outdoor extravaganza recurring every Sunday in Colombia. Ciclovía is now an international event adopted by more than 400 cities worldwide. The weekly ciclovías in Bogotá attract approximately two million people—around 30 percent of Bogotá’s entire population. What began as an activist movement, has grown to become a weekly event that promotes healthy

living, social interaction and tactical urbanism. On March 26, the public is invited to come out and embrace the clean air and car-free streets for Ciclovía 2022 in downtown Pensacola. Individuals are iinvited to cruise the downtown streets on non-motorized vehicles— bikes, skateboards, roller blades, scooters, unicycles—even Heelys if you still happen to have a pair laying around from 2008. If wheels aren’t your speed, join the party and run, skip or dance around. Streets will be closed to vehicles on Palafox from Garden Street to Plaza de Luna and Bayfront and Main Street from Wharf Avenue to Clubbs Street. A full map of the event’s course is available on the Ciclovía Pensacola website. “The downtown street grid is the perfect place for bike riding, walking and enjoying outdoor exercise that benefits our minds and bodies. That’s especially true when those streets are closed to motorized vehicles,” Ciclovía Pensacola Chairman Rand Hicks said.

This year’s event will feature active pursuits such as hatha yoga, ecstatic dancing, stepping and more. Multiple vendors and food booths will also be on-site for the event. Children’s activities will be hosted in locations along Main Street down to the Seville Square area.

Attendees can stop by restaurants, retail shops, museums and art galleries. According to research conducted by the University of West Florida and Visit Pensacola, 57 percent of Ciclovía participants either discovered a new store or restaurant by attending the event and according to Majority Opinion Research, Ciclovía has a $1 million dollar impact on our area.

The benefits of Ciclovía, however, go beyond the economic factor by improving Pensacola’s overall health and social environment. It’s easy to see how Ciclovía promotes

healthy living. Evidence from past Pensacola Ciclovías suggests that it’s fun enough to attract a crowd and make an impact. In March 2019, an estimated 15,000 people crowded downtown streets for Ciclovía. This year’s event marks the fifth year of Ciclovía being hosted in Pensacola. Event organizers look forward to bringing back Ciclovía for 2022 after having to cancel the event in 2020 and 2021 due to the COVID-19 pandemic. Attendance at Ciclovía has grown each year since the inaugural event was held in 2017, Hicks explained. “People really enjoy this event. They love downtown, they love being outside in the spring and they love meeting and engaging with their neighbors. They want more ciclovías, and we are delighted to provide this annual celebration. AIF STATEMENT ON FLORIDA HOUSE PASSING DATA PRIVACY LEGISLATION

ESCAMBIA COUNTY’S MOBILE COMMAND CENTER DEPLOYS TO BAY COUNTY

The Associated Industries of Florida (AIF) today released the following statement attributed to its President and CEO Brewster Bevis regarding the Florida House of Representatives passing House Bill 9 related to Consumer Data Privacy. “As responsible Florida companies, protecting consumers’ data is of the utmost importance to AIF and our members. We support putting regulatory safeguards in place to prevent bad actors from trading in the misuse of consumer data. However, House Bill 9, as passed by the Florida House today, also targets legitimate businesses who responsibly use consumer data to the benefit of those consumers. This will result in substantial compliance, operational, and potential private litigation costs – up to $21 billion according to a Florida TaxWatch analysis – for Florida businesses. “This would put a significant financial burden on businesses who are already grappling with the ongoing challenges of COVID-19, the implementation of an increase in minimum wage, a broken supply chain, hyperinflation, rising gas prices and a staffing shortage crisis. As a 1,000-acre wildfire affects Bay County, Escambia County sends the mobile command unit, “THOR,” to provide assistance during the firefighting effort. “Escambia County is always ready to assist other counties whenever we are called upon,” said Public Safety Director Eric Gilmore. THOR is a very large mobile command post offering 1,000 square feet of interior working space. It is equipped with a 44-kilowatt generator with 72 hours of fuel onboard. LEGISLATURE BACKS EXPANDING SECRECY AROUND EXECUTIONS DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE --- The Florida Senate on Monday passed a measure that would more broadly cloak information about people and businesses involved with state executions and the drugs used for lethal injection, positioning the proposal for action by Gov. Ron DeSantis. Current law includes a public-records exemption to shield information about people such as executioners and the prescribers of drugs for lethal injections. The proposal would broaden that to cover people or entities involved in any step in the execution process. The bill (HB 873) also would obscure the identities of anyone involved in “administering, compounding, dispensing, distributing, maintaining, manufacturing, ordering, preparing, prescribing, providing, purchasing or supplying drugs, chemicals, supplies or equipment” needed to carry out executions. Department of Corrections officials contend the additional secrecy is needed so they can continue executing Death Row inmates by lethal injection, as drug manufacturers and distributors refuse to allow their pharmaceuticals to be used in putting people to death. The bill, which passed the House last week, would ensure that the corrections department “will be able to obtain the drugs necessary to carry out executions in the future,” Senate sponsor Doug Broxson, R-Gulf Breeze, said before the Senate passed the measure in a 28-10 vote

SENATE SIGNS OFF ON CONTRIBUTION LIMIT NEWS SERVICE OF FLORIDA STAFF Less than a year after a federal judge struck down a similar measure, the Florida Senate on Monday approved a campaign-finance measure designed to make it more difficult for groups to place proposed constitutional amendments on the ballot. The bill (HB 921), in part, would place a $3,000 limit on contributions from out-of-state donors to political committees trying to collect enough petition signatures to move forward with citizens’ initiatives. During debate on the measure Monday, Sen. Jeff Brandes, R-St. Petersburg, said the proposal is unconstitutional because it would limit speech. “We should not limit people’s ability to speak, period,” he said. But Sen. Ray Rodrigues, R-Estero, argued the bill targets “billionaires who have contributed literally tens of millions of dollars to influence” states’ constitutions. Florida is one of 18 states that allow citizens’ initiatives to make constitutional changes. “And we need to make sure it’s actually citizens,” Rodrigues said. The Senate approved the measure in a 22-16 vote, sending it back to the House. In July, U.S. District Judge Allen Winsor

Monday. The bill required a super-majority vote to pass because it includes a public records exemption. Six Democrats – Loranne Ausley, D-Tallahassee; Janet Cruz, D-Tampa; Tina Polsky, D-Boca Raton; Linda Stewart, D-Orlando; Victor Torres, D-Orlando; and Darryl Rouson, D-St. Petersburg – joined almost all Republicans in supporting the measure. Sen. Jeff Brandes, R-St. Petersburg, was the only Republican who opposed the bill. Brandes, who is in his final year in the Senate and has crusaded for criminal justice changes, argued that information about the death penalty in Florida, which has one of the nation’s broadest open records laws, should be open to the public. “If there’s one place, one place where the state should be transparent in everything that it does, it’s the process of putting somebody to death,” Brandes argued before Monday’s vote. “We should provide transparency in the drugs that we use, the cocktail that we use, how we purchased those drugs, the distributor that we got them from, so that everybody understands everything that we can about the process by which Florida uses to exercise the highest penalty that we have. This bill puts that in the shadows.” If the state has a difficult time purchasing the drugs used for executions, “that’s part of the process,” Brandes continued. “We should not have to lie to the manufacturers. We should not have to hide from the distributors. We should not have to do some backroom drug deal in order to get the drugs necessary to execute somebody

struck down a similar law that would have capped contributions at $3,000 during the signature-gathering phase. The 2021 law applied to contributions from in-state and out-of-state donors. Winsor found the law unconstitutionally restricted political speech. “First, contributions to political committees that advocate for ballot initiatives are ‘beyond question a very significant form of political expression,’” Winsor wrote, partially quoting from legal precedent. Winsor also rejected the state’s argument, echoed by Rodrigues on Monday, that the cap should be upheld because it would only restrict contributions during the signature-gathering phase of ballotinitiative campaigns. The cap would not apply after committees have submitted enough petition signatures to get on the ballot. “It is unclear … why this would matter for First Amendment purposes,” wrote Winsor, who was appointed by former President Donald Trump, adding that nothing in previous court decisions about campaign contribution limits “suggested that states could restrict speech and expression surrounding ballot initiatives so long as the restriction covered only part of the initiative process.” Supporters of this year’s bill have tried to draw a distinction because the proposed limit would only apply to out-of-state donors.

In 2006, Florida Gov. Jeb Bush put a temporary hold on executions in the wake of the botched death by lethal injection of Angel Diaz, who took more than 30 minutes to die after being injected with the drug cocktail then used by corrections officials. Proponents of the bill Monday argued that the state could have to resume the use of the electric chair if it is unable to purchase the drugs used in the three-drug lethal injection cocktail. “The fact is that if you vote against this bill, you’re insisting on DOC (Department of Corrections) using a method that we went away from … and I don’t want to see that happen. I want to see us do something that’s right, humane,” Broxson said. But some critics of the bill say it’s unlikely the state will return to using the electric chair. Amid difficulty obtaining drugs used in lethal injections, some states have switched their execution methods, while a growing number have done away with the death penalty altogether. Florida changed its lethal injection protocol in 2017, after the Department of Corrections ran out of the sedative midazolam hydrochloride, ran low on potassium chloride – the final drug in the triple-drug cocktail – and began stockpiling three new drugs.

DESANTIS SIGNS STRAWBERRY SHORTCAKE BILL NEWS SERVICE OF FLORIDA STAFF Strawberry shortcake became Florida’s official state dessert Monday as Gov. Ron DeSantis held a bill-signing ceremony at the Florida Strawberry Festival in Plant City. Lawmakers gave final approval Friday to a bill (SB 1006) on the strawberry shortcake designation. “A lot of people don’t appreciate just how significant Florida is in terms of strawberries,” DeSantis said. “Plant City and the surrounding areas are home to over 10,000 acres of strawberries, and they make up 75 percent of the winter strawberry crop in the entire United States. ... We have a history with citrus and oranges, it’s great. But this is a

RESIDENTIAL PICKETING BAN GOES TO GOVERNOR NEWS SERVICE OF FLORIDA STAFF Florida lawmakers Monday gave final approval to a bill that could curb picketing and protests outside people’s homes. The Senate voted 28-3 to pass the bill (HB 1571), which was approved last week by the House in a 76-41 vote. It is ready to go to Gov. Ron DeSantis. The

“Historically, once FDC’s (Florida Department of Corrections’) source of protocol drugs is publicly known, the department is no longer able to purchase drugs from that source, leading to a potential inability to obtain drugs used in lethal injection and therefore an inability to carry out its statutory mandate,” an agency analysis of the bill said. Pete Mills, an assistant public defender in the 10th Judicial Circuit who is chairman of the Florida Public Defender Association’s death penalty steering committee, told the News Service the additional public-record exemption isn’t necessary. “If Florida wants to execute people, the state of Florida should be honest and upfront about how it’s going to happen. If there is no way to do it that is not cruel and unusual, then we shouldn’t have a death penalty,” he said. “Hiding information won’t make the punishment or process better. Hiding information will make things worse.” The legislation is “wrong headed,” First Amendment Foundation president Pamela Marsh said in a phone interview Monday. “The maturity level of the student is not ready to accept the conversation on the topic, as far as instruction,” Diaz said. Other parts of the bill are aimed at preventing school districts from adopting policies that would prohibit school employees from notifying parents about students’ “mental, emotional, or physical health” or well-being. Schools also would be prohibited from withholding information about changes to students’ services. The bill would make an exception for instances where “a reasonably prudent person would believe that disclosure would result in abuse, abandonment, or neglect” of students. Parents would be able to sue school districts for violations of the bill. The proposal also includes an alternative process to resolve such disputes, which would involve administrative hearings before special magistrates. Sen. Tina Polsky, D-Boca Raton, slammed the part of the bill about lawsuits. “Why are we constantly using the threat of a lawsuit to try to get the kind of behavior that we’re looking for?” Polsky said. “What you will get are frivolous lawsuits.” Senate Republicans rejected nearly a dozen proposed amendments, most of which were proposed by Democrats. TALLAHASSEE — The Florida Senate is on the brink of passing an education measure that would prohibit instruction about sexual orientation and gender identity in early grades, as protesters flocked to the Capitol to decry what critics have labeled the “don’t say gay” bill. The Republican-controlled Senate on Monday rejected a series of amendments proposed by Democrats and positioned the bill (HB 1557) for a vote as soon as Tuesday. The House voted 69-47 last month to pass the bill, meaning that it will go to Gov. Ron DeSantis if it is approved by the Senate without changes. Supporters of the proposal, which has the title “Parental Rights in Education,” argued that it is geared toward ensuring that curriculum is age-appropriate for young students and that parents have increased control over their children’s education. The measure would prohibit classroom instruction on sexual orientation or gender identity in kindergarten through third-grade. For older students, the bill would bar such instruction that is “not age-appropriate or developmentally appropriate” as determined by state academic standards. “We don’t want the social engineering of trying to guide children in a direction, which is very tempting when you are responsible for their growth and development,” Senate bill sponsor Dennis Baxley, R-Ocala, told The News Service of Florida on Monday. The Senate voted 28-9 to pass the bill (HB 1239), which was approved Friday by the House in an 80-31 vote. It is ready to go to Gov. Ron DeSantis. The debate has centered on changes involving certified nursing assistants, who provide much of the hands-on care to nursing-home residents. The bill’s opponents, including the state’s long-term care ombudsman, the senioradvocacy group AARP and the Service Employees International Union, which represents nursing-home workers, have contended that it would lead to reduced care for residents, potentially leading to harm. But Senate sponsor Ben Albritton, R-Wauchula, said he did not think it would endanger residents “If I really, really believed that this was going to injure a resident, my name would not be on this bill,” Albritton said Friday as the Senate took up the measure. Anna Eskamani, D-Orlando, said certified nursing assistants have been “underpaid and overworked for years” and that the changes wouldn’t help solve workforce issues. “That’s not going to attract more people to the field,” Eskamani said. “I don’t think it makes good economic sense.” Meanwhile, Rep. Carlos Guillermo Smith, D-Orlando, said the changes “will result in real harm.” But supporters said the bill would give more flexibility for nursing homes to meet the needs of residents, while also helping address the staffing shortages. “I want to empower our elderly with the highest possible quality of life,” House sponsor Lauren Melo, R-Naples, said.
