Narrative I responded to 1500 SW 8th Street (Home Depot) in reference to a theft in progress. On arrival I spoke with (Manager) Bryan, Pamela who stated that as she driving to the rear of the store she saw a white box van bearing Fl tag (X493NM) parked behind the store without permission. Bryan then saw Romero, Adalberto standing outside the van utilizing a pallet jack attempting to remove and load cardboard bails. Bryan stated that she asked Romero if she could help him, due to the fact that only one company is allowed to remove pallets and bails from this location. Bryan stated that she did not recognize (Continued on next page)

(Continued from page 1) Romero or the van as an employee of the that company, nor did she believe Romero had permission to be at this location. Romero responded to her by saying "I don't speak English." Bryan then called her assistant manager, Gordon, Todd who then call BBPD. Gordon then met with Bryan outside, and both told Romero that the police have been called. Bryan stated that Romero immediately threw the pallet jack inside the opened roll down door located to the rear of the vehicle. Then Romero hurriedly walked to the driver side door got in the van and left the area driving at a high rate of speed. En route to this location dispatched (Continued on next page)

Narrative

(Continued from page 2) advised the last known direction of travel was northbound and the Fl tag of . Sgt Wessendorf observed the vehicle matching the description traveling northbound on SW 8th Street making no attempt to stop at the traffic control device located at SW 8th Street and Ocean Dr. SW 1st Ave and continuing northbound through the traffic control device located at SW 8th Street and SW 1st Ave, again making no attempt to stop. Sgt Wessendorf initiated a traffic stop at Boynton Beach Blvd. and SW 8th Street and detained Romero. I transported Bryan to the location of the traffic stop where she positively identified Romero as the person she spoke to in back of the store and the white van he was driving. Inside the van were two cardboard bails (unidentified owner) and a pallet jack tipped over on it side. Inside the van were business cards labeled Ralphy & LLerana Paletts Inc. with the slogan "we buy and sell pallets." Bryan stated that Romero has never worked for Home depot, at this location, and does not have permission to remove pallet or bails which are valued between $70-$90 each. at the time of this incident there were (17) bails and numerous pallets at this location which Romeros van could have accommodated. Romero was arrested (handcuffed d/l) and transported to BBPD where he was processed and read (Miranda) in the Spanish language. Post Miranda Romero stated that he was at the Home depot looking for card board and pallets. Based on my investigation I find probable cause to charge Romero with (1) count of grand theft (attempted) pursuant to F.S.S. 812.014(1) Romero was then TOTPBCJ. Romero was given two citations for the traffic infractions observed by Sgt Wessendorf, 4791-GQC9,4790-GQC-8
