Narrative On Sunday, May 27, 2018 at approximately 0016hrs, I responded to the 400 block of E. Gateway Blvd in reference to a Traffic Stop conducted by Officer Montoute and Officer Cardenas. Let it be noted that this incident occurred within the City of Boynton Beach, Palm Beach County, Florida. (Continued from page 1) the right side of his patrol vehicle for an unknown reason. While investigating, he made contact with the driver/sole occupant W/M Hernandez Sanchez, Deny (11/05/72), who was yelling unintelligible verbiage out of the lowered, driverˇs window. Let it be noted that officers were on the left shoulder of a single lane roadway. While attempting to gather officerˇs attention, Hernandez Sanchez placed his vehicle in reverse and began to drive backwards at a slow pace. While doing so, the vehicles that were stopped behind Hernandez Sanchez began to depress their horns in fear that Hernandez Sanchez was going to cause a crash. Hernandez Sanchez then placed his vehicle in park, exited it and approached officers; leaving his vehicle running, unattended in the middle of the roadway; impeding the flow of traffic. While ordering Hernandez Sanchez to move his vehicle, Officer Montoute detected the odor of an unknown alcoholic beverage emitted from Hernandez Sanchezˇs breath; which intensified as he spoke. Hernandez Sanchezˇs eyes were blood shot glassy and his speech with thick and slurred. Due to Hernandez Sanchez appearance, officers moved Hernandez Sanchezˇs vehicle out of the roadway and contacted me to assist with the investigation. See Officer Montouteˇs supplement for further. I then made contact with Hernandez Sanchez, who was sitting on the curb of the roadway. While obtaining the reason for Hernandez Sanchezˇs behavior, Hernandez Sanchez advised that he was coming from a residence near Palmetto Rd and Lyons Rd (Boca Raton) and was en route to his residence of 6 months on the east side of Boca Raton. Hernandez Sanchez advised that somewhere in his travels he got lost and upon seeing Officer Montoute and Officer Cardenasˇ police lights he was asking for directions. Further investigation revealed that Hernandez Sanchezˇs does not possess a driverˇs license. Upon questioning if he had a driverˇs license, Hernandez Sanchez admitted to not possessing one and admitted to knowing that he is not supposed to be operating a motor vehicle. While speaking with Hernandez Sanchez I detected the odor of an unknown alcoholic beverage emitting from his breath, which intensified as he spoke. Hernandez Sanchezˇs eyes were bloodshot/ glassy and his speech was thick, slurred and dry; all observations that Officer Montoute described to me. I asked Hernandez Sanchez if he any type of alcoholic beverage to drink tonight, which he stated yes. Hernandez Sanchez advised that he had a Modelo Beer in morning. When I asked him what time in the morning, he asked approximately 5 hours prior to the traffic stop. Hernandez Sanchez was unstable on his feet and swayed while I was speaking with him. Due to the fact that Hernandez Sanchezˇs primary language was Spanish, Officer Cardenas assisted me with translations. At this point of my (Continued on next page)

(Continued from page 2) investigation I requested Hernandez Sanchez to submit to a Series of Roadside Sobriety Task, which he agreed. Prior to starting I asked Hernandez Sanchez if he had any disabilities and/or injuries I should be aware of, which he stated no. See the following: During the pen exercise Hernandez Sanchez had a difficult time following the stimulus with only his eyes. Hernandez Sanchez swayed back and back during the exercise. WAT:The following task was explained and demonstrated to Hernandez Sanchez, which he advised that he understood. During the instructional stage, Hernandez Sanchez had a difficult time balancing on the line and while doing so Hernandez Sanchez swayed side to side. During the walking stage, on the first attempt, Hernandez Sanchez took 9 steps forward. Missing heel to toe between steps # 1-2, 2-3, 3-4. At the end of the 9 steps, Hernandez Sanchez stopped and advised that he forget the instructions. I re-demonstrated the task to Hernandez Sanchez, which he advised that he understood again. On the 9 steps forward Hernandez Sanchez missed heel to toe between steps 2-3 and stepped off the line to his left on step number 3. Hernandez Sanchez completed an improper turn. OLS:The following task was explained and demonstrated to Hernandez Sanchez, which he advised that he understood. During the instructional stage, Hernandez Sanchez swayed side to side. During the balancing stage, Hernandez Sanchez raised his right foot, counted to 15 then dropped his foot; not completing the task. Hernandez Sanchez swayed while completing the task. FTN:The following task was explained and demonstrated to Hernandez Sanchez, which he advised that he understood. During the instructional stage, Hernandez Sanchez swayed side to side. During the exercise stage, Hernandez Sanchez failed to keep his eyes close. Hernandez Sanchez failed to return his arm back to his side after every command. Hernandez Sanchez missed the tip of his nose of the first LEFT command. Hernandez Sanchez utilized the wrong hand on the third RIGHT command. ROMBERG:The following task was explained and demonstrated to Hernandez Sanchez, which he advised that he understood. During the instructional stage, Hernandez Sanchez swayed side to side. (Continued from page 3) to 51. Hernandez Sanchez did not display any further clues. Based on the above facts, Hernandez Sanchez was placed into custody under suspicion of DUI. Hernandez Sanchez was placed into handcuff (D/L and Spaced) and placed in the back seat of my patrol vehicle (#4734). I then transported Hernandez Sanchez to the Boynton Beach Police Department so that I could continue my investigation. We arrived at BBPD at 0059hrs, started my 20 minutes observation at 0100hrs and completed at 0120hrs. Upon completion I requested Hernandez Sanchez to provide a sample of his breath to determine the alcohol content, which he agreed to. The proper way to provide a breath sample was explained to Hernandez Sanchez, which he stated that he understood. Hernandez Sanchez provided a sample of .186 at 0129hrs and .198 at 0132hrs. Miranda Warnings were then read to Hernandez Sanchez, which he stated that he understood. Upon asking Hernandez Sanchez if he wanted to completed the Q &A, he refused and advised that he wants to be departed back to his country. Based on the above facts Iˇve established Probable Cause to arrest Hernandez Sanchez with 1M count of DUI pursuant with F.S.S. 316.193.1 and Operating a Motor Vehicle with No Driverˇs License pursuant with F.S.S. 322.03.1. Hernandez Sanchez was processed and later TOT to PBCJ. While completing the tow inventory, Officer Montoute located an empty12oz Modelo Beer bottle and an opened 12oz half full, cold to the touch Modelo Beer can on the passenger front floorboard of Hernandez Sanchezˇs vehicle. Photos of the alcoholic located in Hernandez Sanchezˇs vehicle and a copy of the SFST/BAT video were later entered into the Boynton Beach Police Evidence Department. Incident was captured via BWC as well. Hernandez Sanchezˇs vehicle was removed from scene by Beckˇs Towing. Hernandez Sanchez was cited for his traffic infractions. Nothing Further.
