On the above date and time I responded to 106 NE 4th Ave Boynton Beach, FL in reference to a Robbery by Sudden Snatching that had just occurred at Cash-A-Check 138 West Boynton Beach Boulevard. BBPD Dispatch advised a w/m in a peach shirt, later identified as Brooks Moore, had snatched money from the victim's hand while inside the business and had fled on foot, running towards Seacrest Boulevard. Upon my arrival K-9 Sohn, victim w/m Brian Mulvaney, and witness b/m Talton McQuitter advised they had seen the suspect run into the yard of the residence at 106 NE 4th Ave Boynton Beach, FL. I entered through the rear (south side) of the fenced back yard, where I observed K-9 Sohn and Det. Villari lawfully ordering Moore to crawl out from underneath the house, at which time he was taken into custody by Det. Villari. A show-up was then conducted with Mulvaney in which he positively identified Moore as the person who snatched his money. I then asked Moore if he had weapons or anything in his pockets that could injure Officers, at which time he said he had a "rig" in his pocket, which is known to me from my training and experience as a syringe used for injecting heroin . Moore advised he was unsure which pocked the "rig" was in or if the cap was on the syringe. I patted down Moore's front right pocket which was empty, yielding negative results for the syringe. I then patted down Moore's front left pocket, where I could feel a skinny long object resembling a syringe, in the bottom of the pocket. As I attempted to safely retrieve the syringe, there was a paper and currency I had to remove before I could reach the syringe. At that time I observed (3) $20 bills and a paper. At this time an Officer on scene advised me a $100 bill and (3) $20 bills had been stolen from the victim, at which time Moore uttered the $100 bill was in his hand and he threw it when he was crawling out from under the residence. Moments later, Ofc. Eichorst located the $100 bill in the location where Moore crawled out from under the residence and was detained. I then was able to safely retrieve the syringe (which was uncapped, bent, and appeared to have been used) from Moore's front left pocket. Myself and Ofc. Lampe then interviewed the victim Mulvaney, who gave a sworn recorded statement. Mulvaney advised he was holding $160 cash (consisting of (1) $100 bill and (3) $20 dollar bills), in his right hand while he was waited in line at the Cash-ACheck store. Mulvaney advised he observed Moore "standing around" when Moore suddenly ran at him, snatched the money and a paper out of his right hand, then fled on foot in a northeast direction. Mulvaney gave chase to Moore, where he observed Moore take off and discard the peach, shirt while cutting through the parking lot of First Baptist Church of Boynton Beach 301 N. Seacrest Boulevard. Mulvaney then observed Moore run eastbound across Seacrest Boulevard and into the yard of the residence. Mulvaney advised he wished to prosecute criminally and testify in court.

Myself and Ofc. Lampe then interviewed witness McQuitter who advised he observed Mulvaney chasing Moore through the Church parking lot. McQuitter observed Moore take off and discard his peach shirt. At some point McQuitter retrieved the peach shirt and gave it to Officers for evidence. Ofc. Lampe then interviewed Cash-A-Check employee b/f Tawandia Hughes who advised she observed a w/m known to her as "Brooks" snatch the money from the victim's hand then flee the store on foot. Hughes advised she knows the male as "Brooks" because lately he has been a regular customer. Moore was taken to BBPD for interviewing and processing . Post Miranda, Moore advised he was "not going to lay out" the events for Police and requested a lawyer, at which time the interview was terminated. Due to the above facts, I find Probable Cause to charge Brooks Moore with Robbery by Sudden Snatching per F.S.S. 812.131(1)(a) and Possession of Paraphernalia per F.S.S. 893.147(1). Moore was processed at BBPD Booking and TOT PBCJ.
