Scott County Board Proceedings BOARD OF COMMISSIONERS COUNTY OF SCOTT AUGUST 7, 2012 (1) The Board of Commissioners, in and for the County of Scott, Minnesota, met in the Courthouse Board Room in the City of Shakopee, Minnesota, and convened at 9:02 a.m., with the following members present: Commissioner Wolf, presiding, Commissioner Wagner, Commissioner Menden, Commissioner Marschall, and Commissioner Ulrich. (2) On a motion by Commissioner Ulrich, seconded by Commissioner Menden, the Minutes of July 24, 2012 were approved. (3) Recognition of Interested Citizens: A. Thom Boncher, Jordan, questioned why none of the Commissioners attended the informational meeting hosted by the Minnesota Pollution Control Agency which was held in the County Board Room on August 2 to discuss air quality standards for the Great Plains Sand mining operation. Commissioners Wolf, Ulrich,and Menden explained why they were unable to attend the meeting. Commissioners Wagner and Menden apologized for not attending. B. Lloyd Erbaugh, Prior Lake, commented on recent community celebrations. He also spoke of the virtues of women in sports, the workforce, civic organizations and in the home. Mr. Erbaughurged all citizens to vote in the primary election on August 14. C. Molly Dose, Shakopee, stated she was disheartened and disappointed by the action taken by the Board at the July 24 County Board meeting. Ms. Dose stated she hopes other residents are angered by the behavior of the Board and pay attention to the Board’s actions. Ms. Dose thanked those Commissioners who spoke against this action. (4) Consent Agenda: On a motion by Commissioner Wagner, seconded by Commissioner Ulrich, the following actions were approved unanimously. All resolutions are available in the office of the County Administrator and are made a part of this record by reference. A. Approve the application for a Charitable Gambling Permit and waive the 30 day waiting period for the Jordan Fire Department Relief Association for an event to be held at Ridges at Sand Creek in Sand Creek Township on August 11, 2012. B. Approve the Renewal Application for Optional Liquor Sales until 2:00 a.m. for Doherty’s Tavern in Spring Lake Township. C. Adopt Resolution No. 2012135; Authorizing Entering Into a Partnership Agreement With the Scott County Community Development Agency for the Sharing of Resources Through a Scott County Association for Leadership and Efficiency First Stop Shop. D. Approve the annual Purchase of Service Agreement with MidAmerica Festivals Corporation for security provided by Scott County through the Sheriff’s Office during the Renaissance Festival. E. Approve an Amendment to the Service Agreement with Kingsway Ministries, LLC effective July 1, 2012 through June 30, 2014 to allow Kingsway Ministries, LLC to provide chore services, homemaker services, transportation, and respite services. F. Approve Amendments to Service Agreements with My Brother’s Keeper effective July 1, 2012 through June 30, 2014 and July 1, 2011 through June 30, 2013 to allow My Brothers’ Keeper to provide personal support services and independent living skills services. G. Adopt Resolution No. 2012134; Requesting the Classification of Twelve Tax-Forfeited Parcels of Land in Scott County (PID #040320110; #041050170; #200670620; #220710910; #254320310; #254420430; #261570500; #263740020; #263930660; #263930670; #269200352; and #274010550.) H. Adopt the Scott County Solid Waste Management Master Plan. I. Adopt Amendment 2 to the Scott Watershed Management Organization Comprehensive WaterResources Management Plan. J. Adopt Resolution No. 2012131; Certifying Final Approved Appraisal of Value for a Certain Land Acquisition and Authorizing
Acquisition by Expedited (“Quick Take”) Eminent Domain Proceedings Associated With the Reconstruction of County Highway 17 From County Highway 16 to Approximately 800’ South of County Highway 78 in the City of Shakopee. K. Adopt Resolution No. 2012132; Authorizing Amendment No. 1 to the Agreement With Bolton & Menk, Inc. for Phase 3 of the County Highway 12 Reconstruction Project in Spring Lake Township. L. Adopt Resolution No. 2012-133; Approving a Joint Powers Agreement Between the City of Prior Lake and the County for Right-of-Way Acquisition Associated With Phase 3 of the County Highway 12 Project. M. Adopt Resolution No. 2012136; Authorizing Staff to Enter Into a Cooperative Agreement With the City of Shakopee for Cost Participation on a Trail Connection Project on the West Side of County Highway 18 North of County Highway 16 in the City of Shakopee. N. Adopt Resolution No. 2012130; Authorizing Entering Into an Agreement With MSpace for Audio System Upgrades. O. Approve the record of disbursements and approve claims made to Scott County for the period of July 1, 2012 through July 31, 2012 in the sum of $7,002,174.48. P. Separation from employment for Amber Berndt, Unclassified Library Aide, Community Services Division, effective 08/10/12. Separation from employment for Deonna Banks, PT (99% FTE) Driver, Community Services Division, effective 08/01/12. Separation from employment for Barbara Novotny, PT (88% FTE) DT&H Vocational Assistant, Health and Human Services Division, effective 07/26/12. Separation from employment for Ilya Tereshko, FT Temporary Unclassified Corrections Officer, Sheriff’s Office, effective 06/13/12. Separation from employment for Rebekah Tucker, Student (25% FTE) Unclassified Library Aide, Community Services Division, effective 08/05/12. FT Probationary employment for Bernice Butler, Management Analyst, Health and Human Services Division, effective 08/27/12. FT Temporary employment for Diana Tyree, Unclassified Office Assistant, Health and Human Services Division, effective 07/30/12. Intermittent (2% FTE) employment for Michael Finch, Unclassified Driver, Community Services Division, effective 08/01/12. Intermittent (2% FTE) employment for Donte Bailey, Unclassified Driver, Community Services Division, effective 07/31/12. Intermittent (2% FTE) employment for Dean Culver, Unclassified Driver, Community Services Division, effective 07/25/12. The recognition of the following individuals as volunteers which will enable them to be covered for liability insurance purposes in accordance with the insurance contracts currently in force with Scott County: Additions: Athennas Michelle Garcia; MaryjanePenney. Deletions: Edwin Themig; Lela Themig; Mary Waldeck; James Waldeck; Carly Brown; Maryanne Potter; Margaret Robertson; and Wanda Widen. (5) Develop Strong Public Partnerships: A. Commissioner Marschall moved, seconded by Commissioner Ulrich to appoint Commissioners Menden and Wolf to the 2012 Primary Election Canvassing Board. The motion carried unanimously. B. Commissioner Menden moved, seconded by Commissioner Ulrich to approve the CodeRED System for Scott County from Emergency Communications Network to provide high–speed notification to Scott County Citizens. The motion carried unanimously. (6) Provide a Supportive Organizational Culture: Chair Wolf recessed the meeting at 9:45 a.m. to conduct a closed Board meeting to evaluate the 2011-2012 performance of County Administrator Gary Shelton. Chair Wolf reconvened the meeting at 11:40 a.m. On a motion by Commissioner Marschall, seconded by Commissioner Ulrich the meeting adjourned at 11:45 a.m. Thomas J. Wolf, Chair Gary L.
