THE CITY COUNCIL OF THE CITY OF BELLE PLAINE DOES ORDAIN: Section 1. Section 601.06 Repair of Sidewalks and Alleys of the City Code is hereby amended as follows: Subd. 1. Sidewalk Repair by Owner. The owner of any property within the City abutting a public sidewalk may provide for repair of the sidewalk. Upon issuance of a sidewalk repair permit, repairs shall be made in accordance with the standard specifications approved by the Council and on file in the office of the City Administrator. Subd. 2. Inspections; Notice. Subd. 3. Repair by City. Upon receipt of a notice regarding repair of a sidewalk, the record owner shall be afforded ten (10) days to apply for a sidewalk repair permit. If no application for a sidewalk repair permit is made, or if the notice relates to repair of an alley, the Superintendent of Public Works or other designated official shall report the facts to the Council and the Council may by resolution order repair of the sidewalk or alley by day labor or by contract in accordance with law. The Superintendent of Public Works shall keep a record of the total cost of the repair attributable for each lot or parcel of property and report the information to the City Administrator who shall cause the expense to be assessed against the property. It’s also possible that representatives from the police department will be there to provide licensing services for dogs. *Unanimously approved a charitable gambling premises permit for the German Days Committee at Andy’s Bar and Grill downtown. That official action came after the council on Feb. 4 voted to direct staff to “prepare” a resolution to approve the committee’s request for the permit. According to the application, the charitable gambling proceeds will be used as follows: –$1,000 to Austin Overline to help cover expenses associated with his medical condition. – Fifty percent of the finds will go to town festivals, most notably St. Patrick’s Day and German Days, including queen scholarships, etc. – The rest of the proceeds will go to donations to Belle Plaine schools, Dollars for Scholars and occasional lawful purpose donations when needs arise. *Unanimously authorized the advertisement of bids for the city’s 2013 seal coat project, for which $85,000 has been budgeted. A map highlighting the streets that are proposed to be seal coated this year is available at city hall. *Unanimously approved a resolution authorizing a new home building incentive program similar to the one initiated in 2012. The city’s HRA (Housing and Redevelopment Authority) recently met and reviewed the proposed incentives that include the waiving of building permit and plan review fees for certain new home construction in 2013. The waived fees will apply to the following: (1) The new single-family homes shall be constructed in existing, platted subdivisions. (2) The subject homes shall be owner-occupied, or be owneroccupied when sold by the builder. (3) After closing on the sale of an existing spec home, in which the building permit and plan reviews fees were waived, the contractor may have the same fees waived for subsequent single-family homes, contingent upon the builder not having more than two unsold spec homes. (4) The maximum number of single-family homes allowed under this program is 10. *Unanimously approved the preliminary plat for Valley Business Park Second Addition south of Highway 169, which includes the public works facility site. The plan includes a future driveway from County Road 7 to public works, which is currently accessed from Diversified Drive. Fencing around the facility is also planned. The concept plan for this proposal was approved in December. The final plat will be addressed in March. *Voted 4-0 (Pingalore abstaining) to award the bid for graphic design and printing services to Lime Valley of Mankato. The other bid finalist was Curtis 1000 of Mankato (Michael Pingalore and Dave Brieter). Lime Valley will perform
graphic design and printing services as part of the city’s new economic development marketing plan. The cost is not to exceed $10,000. The city was recently awarded a $15,000 grant from the Scott County Community Development Agency to be used on economic development and marketing activities. This grant will be used to pay for the graphic design and printing services that were awarded to Lime Valley. *Unanimously approved a change to the city ordinance pertaining to criminal history background checks for city employees. The city had already used background checks in the past but Police Chief Tom Stolee reported that the current ordinance does not meet what will be heightened requirements in the near future, and that amended one will. *Unanimously approved the
renewal of joint power agreements between the city and Belle Plaine School District. The agreements annually (sometimes biannually) identify the use and responsibility of ball fields and other public facilities that are jointly used by the city and district. *As a way of promoting economic development, Mayor Mike Pingalore plans to acknowledge local businesses on a regular basis at council meetings. Last Tuesday night, the featured business was ATA Karate of Belle Plaine. Pingalore presented five youth, two adults and karate instructor Karl Knight with Belle Plaine logo pins for their recent accomplishments in martial arts. The next regular meeting of the Belle Plaine City Council is scheduled for 6 p.m. Monday, March 4 in the City Hall building at 218 North Meridian Street downtown.
