City of Belle Plaine Legal Notices CITY OF BELLE PLAINE ORDINANCE NO. 13-01 AMENDING CHAPTER 1 OF THE CITY CODE (OPERATIONS AND ADMINISTRATION), SECTION 104.04 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BELLE PLAINE THAT THE CITY CODE BE AMENDED AS FOLLOWS: Section 1. Section 104.04 of the City Code is hereby amended as follows (deletions shown as strikeouts/additions shown as bold and underline): COUNCIL COMPOSITION, TERMS, VACANCIES, OATH. The Council shall be composed of a Mayor and four (4) members of the Council. The Mayor and Council members shall be elected at large. The Mayor and each Council member shall serve until a successor is elected and qualifies. The terms of Council members shall be staggered so that two (2) members are elected during each election period. The Mayor shall be elected for a term of two years and members of the Council shall be elected for a term of four years. Term of office shall begin on January 1. A vacancy shall be filled by Council appointment until an election is held as provided in State Statutes 412.018 to 412.02. In case of a tie vote in the Council, the Mayor shall make the appointment. If the vacancy occurs before the first day to file affidavits of candidacy for the next regular City election and more than two years remain in the unexpired term, a special election shall be held at the next regular City election and the appointed person shall serve until the qualification of a successor elected at a special election to fill the unexpired portion of the term. If the vacancy occurs on or after the first day to file affidavits of candidacy for the regular City election or when less than two years remain in the unexpired term, there shall be no special election to fill the vacancy and the appointed person shall serve until the qualification of a successor elected at a regular City election. Elected and appointed members, before beginning the duties described herein, shall take an oath relating to the faithful discharge of duties. Section 2. This ordinance shall be effective upon adoption and publication in accordance with applicable law. Adopted this 7th day of January, 2013. Green Isle Council Eyes Plan for Disaster Communications
If a storm roared through Green Isle, eliminating cellular and landline communications between the small eastern Sibley County city and emergency responders, the ability to communicate vital information across the region would almost immediately overwhelm the systems citizens and emergency responders use to communicate throughout the region. In its first meeting of 2013 Jan. 8, the Green Isle City Council moved toward fixing that potential problem. The council gave a preliminary unanimous OK to Green Isle resident Don Burgess’s plan to put a low-voltage ham radio repeater on the city’s water tower 135 feet off the ground. A member of the Sibley County Skywarn Team, a group of trained weather spotters, Burgess is seeking a twoyear agreement with a five-year renewal. The repeater is an antenna that transmits ham radio communications throughout the region. Ham radio signals operate at a different level than the 800-megahertz signal police, firefighters and paramedics use, Burgess said. “You’d be doing a great service to the citizens of Green Isle and Sibley County,” he said. City Attorney Ross Arneson is further researching the issue and drafting a liability waiver and agreement for Burgess to sign. Donations from the Green Isle Lions and the Southern Minnesota SMART Radio Club are helping to fund the equipment for the repeater. The city council preliminarily agreed the city would pay for the electricity. Burgess expects it will cost about the same amount as operating the light in the park-
ing lot at Irish Yard. If a storm knocks out electricity to the area, solar-powered backup batteries will keep the repeater working, Burgess said. Because there are no repeaters nearby, Green Isle and the area are in a communications “black hole,” Burgess said. He said a repeater at Green Isle would serve Sibley, western Carver, northern Nicollet, northern Le Sueur and western Scott counties. It would dramatically enhance the signal from the area to Mankato and repeaters in the western suburbs. He said the need for a repeater in eastern Sibley County came to light in the summer of 2010 when many tornados and frequent severe weather plagued the region and state. Burgess recalled a baseball tournament at Irish Yard where severe weather sent fans scurrying for cover in the Green Isle Community Center.
New Councilors Take Oath, Organize
The first order of business at the Jan. 8 meeting was swearing in the new city council, led by Mayor Dale ZumBerge, the longest serving member of the council. Voters elected ZumBerge after Randal Bruegger opted against re-election. Councilors Mark Wentzlaff, Brian Oelfke, Todd Burg and Shawn Harms were also sworn-in. They were individually assigned committee posts that included the city’s economic development authority (EDA) and park board. absence. ZumBerge wants the EDA to take an active role in marketing the undeveloped residential lots the state recently took via foreclosure. The city will set the price for the lots. Wentzlaff and Oelfke are ZumBerge’s appointees to the EDA. Once sold, he said, the city could reapply the assessments for city infrastructure to the lots. In other action at the Jan. 8 meeting, the Green Isle City Council: n Paid bills totaling $187,662.40. n Approved Fahey Sales Auctioneers and Appraisers schedule of auctions in the city’s industrial park for 2013. The company will pay the city a $1,000 fee for each auction it conducts. n Approved the city’s 2013 schedule of fees for service. It is the same as the 2012 schedule. ZumBerge said the city should crack down on unlicensed dogs and residents with past-due utilities bills. n Directed City Attorney Ross Arneson to draft a proposed city sump pump ordinance. The proposed ordinance is intended to prevent people from depositing storm water into the city’s sanitary sewer system. n Heard a report that Green Isle Community School will pay for repairs to a refrigerator and re-keying of locks in the school building the city owns. n Heard an update on the former Eustis Building the city recently demolished. The council tabled deciding how long the city will extend assessing the $21,450 cost of the demolition and interest rate it will charge until its Jan. 22 meeting.
