CITY OF BELLE PLAINE ORDINANCE 15-06 AMENDING THE CITY CODE BY AMENDING SECTIONS 403.05 USE OF BOW AND ARROW THE CITY COUNCIL OF THE CITY OF BELLE PLAINE DOES ORDAIN: Section 1. Section 403.05, USE OF BOW AND ARROW, is hereby amended as follows: It shall be unlawful for any person to shoot a bow and arrow except for the following: A. In the physical education program in a school supervised by a member of its faculty, a communitywide supervised class. B. An event specifically authorized by the Council. C. At a bow and arrow range authorized by the Council. D. On private property located north of the Union Pacific Railroad property subject to the following conditions: a. Allowed only during the hunting season for bow and arrow, as authorized by State of Minnesota. b. All other regulations established by the Minnesota Department of Natural Resources regarding hours, limits, zones, and so forth, shall be adhered to except that no shooting or discharge of any bow or arrow shall be within five hundred (500) feet of any residential or commercial structure, public street, roadways, sidewalk, or trail. c. Written permission shall be granted by the property owner. d. Obtain a permit on application forms made available from the Belle Plaine Police Department. e. Establish signage stating “No Trespassing – Private Property” at reasonable intervals and all points of entry and exit. f. Hunters attempting to recover wounded game must inform the landowner prior to entering land. g. Any constructed tree stand shall be at least five (5) above ground level. Section 2. Chapter 1, Section 108, Fees, Subd. 1, Fee Schedule, is amended as follows: Bow and Arrow Hunting Permit – Annual Fee - $25.00 Section 3. LEGAL NOTICE OF PUBLIC HEARING The Scott County Community Development Agency (CDA) Board of Commissioners has set a public hearing for 4:00 p.m. on September 8, 2015, at the Office of the Agency, 323 S. Apply for Antlerless Deer Permit by Sept. 10 Firearms and muzzleloader hunters who want to harvest antlerless deer throughout much of Minnesota this hunting season are reminded they must purchase their license and apply for an antlerless permit by Thursday, Sept. 10, the Minnesota Department of Natural Resources said. Antlerless deer permits are issued by lottery in designated permit areas. Some areas that have not been in the lottery classification in recent years are in that classification this year, primarily as a result of new deer population goals. “Hunters should review the hunting and trapping regulation book now,” said Leslie McInenly, big game program leader with the DNR. “The lottery applies to over half of the state permit areas this year, and it’s important to start planning for the season.” Hunters who want to participate in special firearm deer hunts also need to apply for permits that are issued by lottery, and the application deadline is Sept. 10. Third Annual Bull Riding Event Sept. 11 & 12 The Sibley County Fair Board has announced that it will hold the third annual ProAuto NYA Bull Riding Event at the Sibley County Fairgrounds in Arlington on Friday and Saturday, Sept. 11 and 12. Proceeds will benefit Jared Allen’s Homes for Wounded Warriors. Friday’s bull riding will kick off at 7 p.m. Mutton Bustin’ for the kids will take place during intermission, along with the raffle drawing and live auction Friday and Saturday nights. Saturday’s festivities will feature a tailgate party from 3-6 p.m., which will include a me-

chanical bull, dunk tank, live radio broadcast, vendors and more. Saturday’s bull riding will begin at 6 p.m. After the competition concludes, the band Rusted Revolver will play. Some of the best cowboys and bucking bulls in the United States will be competing, including some Professional Bull Riding (PBR) bulls. Tribe Appoints Conservation Officers to Enforce Game Laws The Shakopee Mdewakanton Sioux Community (SMSC) has signed a joint powers agreement with Scott County, Shakopee and Prior Lake relating to the Mdewakanton Conservation and Enforcement Agency, which will enforce conservation laws on SMSC lands. The agreement follows a joint powers agreement signed in July with the Minnesota Department of Natural Resources. The SMSC’s three conservation officers are licensed by the Minnesota Board of Peace Officers Standards and Training. “The joint powers agreements with the State of Minnesota and our neighboring governments advance the SMSC’s mission to protect our natural resources and enable us to support local law enforcement agencies when they need assistance,” said SMSC Chairman Charlie Vig. “Our conservation officers represent a mutually beneficial addition to law enforcement on tribal lands.” Through the joint powers

agreements, the SMSC’s conservation officers are licensed and recognized by the State of Minnesota. Similar to state conservation officers, their main role is to educate people about conservation laws and cite violators. They are authorized to cite SMSC members and members of the general public for hunting and fishing violations on SMSC fee and trust land, such as trespassing on nonhunting lands, baiting deer and violating possession limits. To hunt on SMSC lands, a person must hold a license issued by the Mdewakanton Conservation and Enforcement Agency. The conservation officers’ work is independent from criminal law enforcement, which will continue to be performed by the Scott County Sheriff’s Department and the Prior Lake and Shakopee police departments. The agreement signed authorizes the SMSC’s conservation officers to respond in a support role when local law enforcement agencies need assistance

with emergency situations such as domestic complaints or vehicle accidents. The conservation officers will generally not perform typical law enforcement duties such as making arrests or issuing speeding tickets. Each year, the tribe voluntarily contributes a total of $770,000 to the Shakopee Police Department, Prior Lake Police Department and Scott County Sheriff’s Department for law enforcement and other services on the reservation, and these contributions will continue. The SMSC has more than 60 agreements with local governments related to shared priorities, including law enforcement and public safety. “The Mdewakanton Conservation and Enforcement Agency is a welcome partner in our community. Conservation law enforcement is important, and these officers will also be called upon when we need extra or more urgent response in our service area,” said Shakopee Police Chief Jeff Tate.

Le Sueur OKs City Bow-and-Arrow Hunting Ordinance After making sure the city council, and not the police chief, will decide where people can hunt within Le Sueur’s city limits using a bow-and-arrow, the city council recently approved an ordinance governing the hunting. The new ordinance governs, among other things, sections of the city – generally the north side of Le Sueur along the Minnesota River – where people can hunt with a bow and arrow. It applies to landowners and people with landowner permission. They may not hunt within 500 feet of a structure or 200 feet of a driveway, the Le Sueur News-

Herald recently reported. Police Chief Bruce Kelly recognizes there are likely parts of the city that are likely overpopulated with wild animals. The original draft indicated the police chief would be allowed to designate the areas where bow-and-arrow hunting could occur.
