THE CITY COUNCIL OF THE CITY OF BELLE PLAINE DOES ORDAIN: THE CITY CODE BE AMENDED AS FOLLOWS: Section 1. Section 1104.10,YARD SPACE ENCROACHMENTS. Certain projections may be permitted into front, rear or side yard line. Section 2. Section 1105.10, B-2 HIGHWAY COMMERCIAL DISTRICT, Subd. 4, CONDITIONAL USES, is hereby amended as follows: (13). Any use permitted in this District that exceeds twenty thousand (20,000) square feet of gross floor area. Section 3. Section 1105.11, B-3 CENTRAL BUSINESS DISTRICT, SUBD. 4, CONDITIONAL USES, is hereby amended as follows: (5). Residential uses as an accessory use; located above the street level, or behind the main street entrance commercial space, where the location is incidental to the conduct of the primary use of such main building. The following will be repealed: (8), Other uses determined by the Planning Commission and City Council to be of the same general character…..and found not to be detrimental to existing uses and to the general public health, safety and welfare. Section 4. Section 1107.02, FENCES, Subd. 4, CONSTRUCTION AND MAINTENANCE, is hereby amended as follows: (6.) A fence may be located within the rear yard and side yard to a maximum height of six (6) feet up to the point where it is parallel with the front edge of the building. Fences located within the front yard or side-street yard to the right-of-way shall have no more than 50-percent opacity and not exceed four (4) feet in height as measured from grade. Section 5. Section 1107.14, SUBD.1, FIRE PITS, is hereby amended as follows: 1. FIRE PITS. Free-standing or in-ground fire pits shall comply with the following: A. Shall not exceed a diameter of three (3) feet; B. Materials burned shall consist of wood, coal, charcoal or brush only; C. Shall not be located within twenty-five (25) feet of combustible walls, roofs, or other combustible material; building openings; or property lines, and shall be in accordance with the Minnesota State Uniform Fire Code, as amended.
