It’s Up to Us to STAY INFORMED
The Boerne Master Plan Update is back on track now with a different consulting team. Halff Associates was the runner-up firm during the original consultant selection process last summer. They will take all of the information gathered from the public forums and focus group meetings held so far and continue the public input process. The steering committee, comprised of local citizens, will also be valuable as we move this project forward. So stay tuned for more chances to get your voice heard and create the future vision for our community. As you’ve probably heard, the city council received a report recently from the City Hall project advisory committee. This citizens group, let by Jeff Haberstroh, was charged with evaluating the appropriateness of the size of the structure and the anticipated cost based on current construction costs for similar facilities throughout Texas. Other members of the committee include: Christina Bergmann, Ben Adam, Bruce Baker, Bob Vollmer, Lance Pettigrew, Robert Thornton and Tommy Mathews. Their final analysis reveals that the proposed square footage and the estimated construction costs are consistent with those for similar “built to last” structures in other cities. In fact, the committee even went so far as to say we might be too conservative. The report does highlight the ability to expand the structure down the road if needed. Remember, this new city hall building is expected to last a good one hundred years, just as the current building has. In my last column I attempted to clarify the impact that the April petition has on the financing piece of this important capital project. The petition requires an election if, and only if, the City Council were to approve certificates of obligation to finance the project. The council has reviewed other funding options available, and with advice from our bond counsel and based on the current bond market, we have directed staff to pursue issuing tax notes to fund the project. This item will be on the August 8th City Council agenda. Proceeding in this manner will avoid the cost of an election and keep the overall project cost in the range that we have been anticipating all along since current tax note interest rates are one and a half to two percent lower than for certificates of obligation. I can’t stress enough how much we value citizen input as well as the time and effort the citizen volunteers on both the 2016 City Hall Ad Hoc Committee and the 2017 City Hall Advisory Committee spent to help us get this project moving again. In other news, CT 17 Herff Land, LP, the owner/developer of the 17 Herff Road mixed-use project in Boerne, has submitted an application for rezoning a portion of the Herff Road parcel from MU-1 (mixed-use neighborhood district) to R-4 (multi-family residential district). The current zoning of MU-1 for the entire 26.654 acres was approved by the City Council May 9, 2017. The request for rezoning will be on the agenda for the August 7th Planning and Zoning Commission meeting and a public hearing will be held prior to any action. As you may recall, the city council approved annexation of this property last January. The next step was to zone the property based on staff recommendation and approval by the Planning and Zoning Commission. The property owner now has the right to request a rezoning of the property; therefore, the owner is requesting a rezoning for about fourteen acres to R-4 (multi-family residential district) while leaving the remaining acres as currently zoned MU-1. The city’s draft proposed budget for 2018 is now available for public review on the city website. Every year the staff and city council review the current operations, costs for services, and the public demands for service - especially for public safety and utilities. Most people don’t realize that a one cent property tax rate increase will only yield about $157,000 in revenue and that’s barely enough to fund and equip one new police officer and one new fire-
fighter to keep up with our growing population. This proposed budget does not include a rate increase again this year – as a matter of fact, we have not seen a property tax rate increase since 2012. We are always looking for efficiencies and innovative ways of doing business; our city team works diligently to avoid the need to raise taxes. You may have heard me say this out loud already - Texas cities are under attack! Our state legislators are working through this special session in Austin, but they do not seem to hear our concerns about the potential loss of local control. We elect local leaders to work for the betterment of our communities, because we live here and we all want our town to thrive in a way that maintains, or improves, our overall quality of life. But our area state representatives are pushing for law changes that amount to “one size fits all” for the entire state. State Representative Kyle Biedermann addressed our city council a few weeks ago and shared his thoughts and intentions on some of the key items the Texas legislature will be considering – these are in direct conflict with the ideas that your local elected officials believe are best for Boerne. Check it out for yourself by listening to the video of his July 11 presentation, also available on the City of Boerne website. If you have particular concerns, I encourage you to contact your state representative and express your thoughts. Despite our best efforts to get messages out in a variety of ways, including social media, I sometimes hear from people who say they didn’t hear about this or that, or they didn’t know the City of Boerne was doing this or that. We live in a thriving community here in the hill country and our city staff makes every effort, short of knocking on doors, to get messages out and provide factual information. So I am asking: Do you check our city’s website? Have you liked our city’s Facebook pages; did you sign up to get the city’s monthly e-newsletter? The information is out there so I encourage you to reach for it rather than rely on rumors or partial details.

Are Your Lines Open?

Whether your tax filings are completed in the spring or you typically extend, it’s important to keep an open line of communication with your accountant, as well as your other advisors, throughout the year. Often times, we see folks navigate through the legalities of a specific transaction but fail to take into the consideration the tax consequences of those transactions, which could end up costing thousands if not hundreds of thousands of dollars. The following are a few examples of transactions to discuss with your accountant before proceeding: What Entity Type is Right for You? When considering what entity type is right for you, it’s important to consider what the purpose of the entity will be. Are you using it to hold real estate? Are you planning to use it to transfer wealth during estate planning? Or, are you just looking for some liability protection in case something goes wrong on a job? There are many factors to consider and consulting your accountant, in addition to an attorney, is important to avoid unwanted tax consequences. Are You Thinking of Making a Gift? Whether you are gifting to a loved one or a charitable cause you care about, consulting your tax advisor is an important step. If you are gifting to a loved one in an amount over the annual gift exclusion ($14,000 per person in 2017), you need to file a gift tax return. If one is not filed, the statute of limitations remains open until the reporting requirements are met. Also, gifting can take other forms besides cash such as purchasing a vehicle for someone, forgiving a loan, or transferring ownership interest in a company, to name a few.

If you are gifting to a charitable organization, various considerations need to be explored. Depending on the type of gift, an appraisal may be needed, or it may be more beneficial to you to gift the property directly rather than sell it and donate the proceeds. Are You Purchasing or Selling a Business? If you were to purchase a business, structuring the deal strategically can have a major impact on your current and future tax situation. Likewise, if you are selling your business, the terms under which the deal is negotiated will have a direct effect on your tax liability not only in the year of sale, but possibly into future years. Do You Need an Estate Plan? Do you have an estate plan in place? Do you need one? If you have been thinking about your future and the future of your estate, planning earlier rather than later is always preferable. As the tax law is constantly changing, discussing your plan with your accountant on an ongoing basis is an important part of mitigating potential problems in the future. How Can I Improve My Cash Flow? Should I Take Out a Loan? Are My Books Correct? Many times business owners are contemplating these types of questions, but don’t know where to turn for help. Business owners tend to be experts in their line of business but not always experts in the financial aspects. Financial statements, cash flows, human resources, and the like can be daunting for some. Having a review or audit performed could prove beneficial to ensure your financial statements are
correct. Also, consulting with your advisors can be a great way to make better, more informed management decisions. Are You Planning on Renting Out a Room or Vacation Home? As this is becoming more and more popular, it’s important to consider the tax consequences. For instance, you can rent out all or a part of your home for up to 14 days per year and the rental income is tax-free. However, if you have a vacation home that is rented most of the year, but you use it personally for more than the greater of (1) 14 days or (2) 10% of the total rental days, some of your expenses may be limited and deferred into future years. Also, unless you qualify for a short-term rental classification, any losses incurred may be limited by the Passive Activity Loss rules. And the List Goes On…. Many items like these can have a significant impact on the amount of tax you pay come filing time and it’s important to have advisors you trust available when you need them. HISTORY OF THE DUCK Owners, Keith and Chandra Moore, did not enter the restaurant business in the conventional way. While living in Houston, Chandra practiced law for 14 years and Keith worked for a Swiss instrumentation manufacturer. “My company relocated us to Geneva, Switzerland, where I was the vice president of sales and marketing,” says Keith. “Our biggest market was the brewing industry, so my job included traveling and drinking beers from all over the world, attending international brewing conferences, and visiting breweries worldwide,” he adds. The Moores lived in Switzerland for 5½ years. After Keith’s company was sold, they returned to Texas in 1999, settling in Boerne to raise their three sons. Soon, though, the Moores realized that something was lacking in Boerne that represented a business opportunity. “Keith really missed the beers that he had in England, Europe and elsewhere,” says Chandra. “He noticed there wasn’t a wide selection of beers available here, and he thought a brewery would be a really interesting entrepreneurial opportunity.’
So, in 2001, the Moores decided to open their own brewpub. After they purchased and remodeled the present building, once a private residence, they developed their unique brewery and restaurant concept. They filled their menu with cuisines from different cultures encountered on their travels, including several of their own special recipes. With some luck, Keith found a brew pub in Minnesota that was going out of business. He purchased all their brewing equipment, a beautiful copperclad 10-barrel system built in Hungary, and installed everything in the detached building behind the restaurant. In addition to strong German heritage in Boerne, the Moores called their establishment a Brewhaus because of their time spent in Germany and in tribute to the importance of brewing in the German culture. As for the Dodging Duck name . . . “It seemed like a perfect name,” says Chandra, “as we watched the ducks try to cross River Road in traffic. Of course, Dodging Duck also reminds us of British pubs and their whimsical names.” The Dodging Duck Brewhaus and Restaurant opened in August 2002. BBM

It seems that there are two types of people in this world, those who love pickles and those who don’t. However, those of the latter persuasion have obviously never tasted a Fickle Pickle! “Even people who don’t like pickles love our pickles,” said owner of Fickle Pickles, Lisa Obriotti. Fickle Pickles’ perfect combination of sweet, crunchy and spicy has kept people coming back for more for over 35 years! Started in 1981 by Billie A. Shaw, aka The Pickle Lady, Fickle Pickles have not only been a local favorite for all of these years, but are shipped all over the world. Obriotti, aka The Pickle Lady’s Daughter, tells of how her mother’s famous pickles came to be, “My mother was always a very good cook. She was self-taught and her trick was that she learned to season things well. She had made the pickles for just our family for years before she ever sold one jar of them.” Shaw had an antique store in San Antonio for about 15 years

and eventually moved the business to Boerne. “The business was initially on the north side of town where there wasn’t a lot of foot traffic and the business was a bit slow. My mother began putting her homemade pickles out at the store to drive business. Eventually customers began asking to buy them. She literally built this business one jar at a time,” said Obriotti. Shaw eventually moved her business to Main Street, Boerne and settled in their current location where Carousel Antiques and Pickles has been for almost 28 years. According to Lisa, “We are one of the oldest businesses on Main Street.” Located at 118 S. Main, Fickle Pickles takes full advantage of the abundant foot traffic offered by downtown Boerne by luring customers in with their free pickle samples. According to Obriotti, “We have all kinds of people who come into our store. There are the kids who stop in for a sample on their way home from school, continued on page 18

locals, out-of-towners, and even a few famous faces.” Yes, that’s right, Fickle Pickles have quite the following. “George W. Bush stopped in when he was running for Governor and bought some pickles for himself, as well as his parents. Other notable customers have included Pierce Brosnan and Cheryl Tiegs,” said Lisa. “We have been written up in Southern Living, Texas Highways, Texas Monthly and various newspapers. In 2007, we were even on the Martha Stuart Show in New York!” Obriotti, along with her husband Jake, took over the business in 2000 when Mrs. Shaw retired. It was then that Lisa became known as “The Pickle Lady’s Daughter” and the Obriottis quickly began making and shipping Fickle Pickles all over the world. A second location of Fickle Pickles was opened in Gruene, Texas in 2001, and their third store, which is their online store, does very well. “Ever since my mother started the business we have shipped our pickles, but with the addition of the online store we have really seen a boost in sales,” added Lisa. Fickle Pickles are still handmade right here in Boerne and true to the original recipe. There is also a crew that cans the pickles. According to Lisa, “We have customers that started buying pickles from my mother all those years ago and they tell us that the pickles still taste just the same!”
The product selection is pretty straight forward. Fickle Pickles come in Original and Extra Spicy and the jars are available in four sizes – 8 ounce, 16 ounce, 26 ounce and 32 ounce. You can also buy just a bottle of their Marinade, a 16 ounce bottle of Fickle Pickle Juice which is delicious to use on all types of meat. “Our Extra Spicy pickles are marked with a simple red “X” on top of the jar, there is no difference in the labels. We like to do it this way because it shows that they are truly handmade,” said Obriotti. Fickle Pickles will celebrate 36 years in business this October and the Obriottis can’t believe how fast the time has flown. “We feel like a part of Boerne having been here all this time. Our pickles draw people to Boerne from all over and we try to do business with high standards so to shed a nice light on our town. Customer service is always our main focus. We have made so many friends and connections over all of these years. It is important to us to be engaged in the community, so we do our best to support the local schools and nonprofits as well,” added Lisa. Lisa finished by saying, “My husband and I are merely carrying on the legacy of my mother. We have worked hard and built the business through the years and know that if she were alive today, she would be pleased with where Fickle Pickles is at this point in time.” BBM

Bandera Electric Cooperative will be holding the annual 5K/10K Cowboy Capital Stampede Saturday, October 28 at the Bandera City Park. The race is held each year to raise money to support charitable organizations that operate within in the BEC service territory. All 501c(3) nonprofits in the service territory are encouraged to apply. Organizations that wish to apply should describe a current project, and how the funds will aid them in completing their project. Imagine a school year where your kid's schedule, backpack, homework, and takehome paperwork is organized. Imagine a home where your kids participate in the organization of their own lives. I am Adrianne Carnes. I am a Personal Organizer because I believe that organizing is an empowered lifestyle that produces clarity and order, which brings feelings of calm and peace. My company is “The Organized Me,” and I want to help people live an empowered life through organization. Before you think to yourself "My kid doesn’t have the attention span to organize? Or I have too many kids to be organized. Or I am too busy to manage a to-do list. Or I inherited this way of living," think this instead. Everything is a possibility. Life is full of possibility. Possibility becomes reality through opportunities. The Organized Me offers you the opportunity to de-clutter your life so that you can feel calmer and more peaceful. In this series “Back to School Organization”, I will describe, step-by-step, how you can free yourself from the stress that comes with piles of paperwork, lost homework and the sticky airhead at the bottom of your kid’s backpack. PART 1: TIME MANAGEMENT Because time management is such an integral part of being organized and produc-

tive, I want to start the series with this topic. Maximizing your time is not only about being prompt, it is about prioritizing the things on your to-do list, thinking about the route for your errands and showing up on time to your appointments. DAILY PLANNING FOR THE ADULTS: A well planned schedule begins with considering more than just your appointments. Of course, your time is managed on a daily, weekly, monthly, quarterly and yearly basis. Yet the time in each day deserves thoughtful consideration. In this article, I will address daily planning. In order to plan your schedule thoroughly each day, you’ll need to consider: • Your tasks / to-do list • Errands, which I often write on a sticky note and stick to my daily plan • Appointments • Self-Care • Time with family and friends I like to look ahead at tomorrow’s calendar each night before I go to sleep. I look for scheduled appointments or deadlines. I think about when I need to wake up and what I will wear the next day. I leave the rest of the planning until first thing in the morning. In the morning, after a shower and a latte, I sit down at my kitchen table with my planner. 1) I write down the tasks I want to accomplish each day. I combine my personal tasks

and work tasks on the same day plan. This is easy for me to do because I own a small business, but you might consider writing down only your personal tasks and saving your work tasks until you get to your office. 2) I write down the errands I need to run. For example, I will write down “pick up dry cleaning” or “go to the grocery store.” I often write my errands on a sticky note so that I can pull it out of my planner and stick it to my dash board. This way, when I’m singing along with my daughter and Taylor Swift, I have a reminder about where I am headed and don’t miss the turn. 3) I write down when and how I will care for myself. For example, you might write down “go to the gym.” I usually write down something like “Meditate at lunch or read a book for 30 minutes today”. 4) I also consider what my family will need from me. For example, driving to a lesson or helping with homework or cooking dinner. 5) I also like to keep a space in my daily plan to write down ideas or future projects. For example, when I’m driving to the grocery store and I have a brilliant idea about offering an organizational class for kids, I write this down in my “Ideas / Future Projects” section of my daily plan. 6) Finally, I write individual shopping lists on a 4x6 sticky pad (one for each store) so that
I can move it from day to day if I don’t make it to the store on the original day I had planned. Writing my shopping list on a 4x6 sticky note also makes it easy for me to grab off my planner and carry throughout the store. When I have all of these things written down, I have a plan for my day. I realize that each plan requires flexibility and something might change, but I have a strategy for navigating my time. You and I know how overwhelming it can be to have a long list of things to do and obligations with deadlines. I want to teach our kids to manage their time and help them not feel so overwhelmed. DAY PLANNING FOR THE KIDS: I recommend that each child has an individual Command Center at home in a location that makes sense. Our is in our kitchen, because we spend a lot of time in there at the beginning and end of the day. It needs to be accessible, attractive and personal. I created ours from a multi purpose bin that I bought at The Container Store. My daughter painted her name on it, added horse stickers and made it her own. The Command Center needs to include the following: • A calendar. I clipped the calendar to the front of the bin so that it is visible all of the time. I suggest a monthly view because it’s fairly simple to understand and not too over whelming. I created a 12 page, monthly view, calendar based on the BISD calendar with holidays and early release days. (You can purchase and download this calendar from my website). It’s simple and personal. My daughter doesn’t have to share with her brother, and she has complete ownership of her time. This also allows her the opportunity to count down the days until the next holiday, without needed my involvement. • A clip board with their daily to-do list. While us adults don’t always need to write down reminders about brushing our teeth and cleaning up the kitchen, it is helpful for the kids to have these daily routines written down. • A file folder for time sensitive paperwork that comes up from school. For example, when the paper comes home for picture day, the date will get written on the calendar and the order form will go into the file folder until the day it needs to return to school. Or when your child receives a birthday party invitation, the date goes on the calendar and the invitation goes into this file folder until the day of the celebration. Each day before bed, I recommend your children look at their calendar for any upcoming events. This will help them determine what to wear the next day, if they need to pack anything

The Learning Lab is designed to have fun with school supplies and to learn about keeping organized during the school year. • We will personalize school supplies: a Pencil box, a personal pouch, and spiral notebooks. • We will learn how to organize your: schedule, backpack, take home papers and homework. How Can You Leave the Legacy You Desire?

You may not see it in the greeting card section of your local drugstore, but August is “What Will Be Your Legacy Month.” So it’s a good time to think about the type of legacy you’d like to leave. Of course, “legacy” can mean many things. In the broadest sense, your legacy is how you will be remembered by your loved ones, friends and the communities to which you belong. On a practical level, establishing your legacy means providing your family and the charitable organizations you support with the resources you’d like them to have. And that means you may need to take the following actions: create your plans, communicate your wishes and review and update your documents. Let’s take a quick look at all these steps: CREATE YOUR PLANS. You will want to work with

your legal professional, and possibly your tax and financial professionals, too, to draft the plans needed to fulfill your legacy wishes. These plans may include drafting a will, living trust, health care directive, power of attorney and other documents. Ideally, you want these plans to do more than just convey where you want your money to go – you want to impart, to the next generation, a sense of the effort that went into building the wealth they receive. Without such an appreciation, your heirs may be less than rigorous in retaining the tangible legacies you’ve left them. COMMUNICATE YOUR WISHES. It’s important to communicate your legacy-related wishes to your family members as early as possible. By doing so, you can hopefully avoid unpleasant surprises and hurt feelings when it’s time for your estate to be settled – and you’ll
also let people know what tasks, if any, they need to perform. For example, if you’re choosing a family member to be the executor of your estate, or if you’re giving someone power of attorney over your financial or health-related matters, they should be prepared. UPDATE YOUR DOCUMENTS. During your life, you may well experience any number of changes – new marriage, new children, opening a family business, and so on. You need to make sure your legal documents and financial accounts reflect these changes. For example, if you’ve remarried, you may want to change the beneficiary designations on your IRA, 401(k) and other retirement accounts – if left untouched, these designations may even supersede the instructions left in your will. And the directions in life chosen by your grown children may also dictate changes in your will or living trust. In any case, it’s a good idea to review all your legacy-related documents periodically, and update them as needed. In addition to taking the above steps, you also need to protect the financial resources that go into your legacy. So, when you retire and begin taking funds from your IRA, 401(k) and other retirement accounts, make sure your withdrawal rate is sufficient for your living expenses, but not so high that it eventually jeopardizes the amounts you planned to leave to your family or to your preferred charities. A financial professional can help you determine the withdrawal rate appropriate for your situation. With careful planning, and by making the right moves, you can create the type of legacy you desire – one that can benefit your loved ones far into the future. Foreign buyers scooped up over 284,000 Texas homes last year

Nationwide, the number of foreign buyers in the home market has surged to a record high in the last year, and Texas is one of their favorite destinations. International buyers snapped up 284,455 U.S. properties—a 32 percent hike from 2016, according to the National Association of Realtors. More than 34,000 of these purchases were in Texas. Although foreigners purchased properties nationwide, five states accounted for 54 percent of total residential property purchases: Florida (22 percent), Texas (12 percent), California (12 percent), New Jersey (4 percent), and Arizona (4 percent). "[Realtors and others] are doing a lot of business with foreign buyers," said Real Estate Center Chief Economist Dr. Jim Gaines. "Texas represents a very nice opportunity for them. We've been the fastest growing state in the
country for years." The greatest volume of Texas' foreign home buys— about 40 percent—came from Mexican and Latin American purchasers. Asian buyers were a close second with 39 percent of the offshore acquisitions. "The Chinese are very entrepreneurial, and Texas is a very entrepreneurial state," said Gaines. "We have a lot of Asians relocating to Texas." Buyers from China spent the most on U.S. housing— some $31.7 billion. The largest share of their 40,572 purchases—37 percent—were in California. Texas was their second favorite U.S. home market, accounting for 11 percent of their deals. Canadian buyers spent $19 billion on U.S. homes, followed by buyers from the United Kingdom ($9.5 billion), Mexico ($9.3 billion), and India ($7.8 billion).BBM
