city ordinance

DRIVE NOW, TALK OR TEXT LATER BOERNE BANS USE OF ELECTRONIC DEVICES WHILE DRIVING

B

Beginning January 1 it will be illegal to use a portable electronic device while driving a vehicle in Boerne. In an effort to protect public health, safety, and welfare, the Boerne City Council recently approved an ordinance making driving and using a portable electronic device, anywhere in Boerne, a citable offense. While not considered a moving a violation, a person convicted of this offense could receive a fine of $200. Portable Electronic Device is defined as: a hand-held mobile telephone, personal digital assistant, MP3 or other hand-held music player, electronic reading device, laptop computer, pager, broadband personal communication device, global positioning or navigation system, electronic game device, or portable computing device. Essentially an operator of a motor vehicle may not use a portable electronic device while the vehicle is in motion. The following activities while holding or touching a device are prohibited: • dialing or deactivating a phone call; • speaking in or listening to a conversation; • viewing, taking, or transmitting electronic images; • composing, sending, viewing, accessing, browsing, retrieving, or saving email messages, text messages, or other electronic data; • entering or changing information in a global positioning or navigation system or any software or application designed for navigation; • accessing or viewing an internet website or computer application; or • playing a game.

6

B oerne B usiness M onthly | January 2016

A portable electronic device may be used if it is in a hands-free mode of operation; if used for obtaining emergency assistance to report a crime, traffic accident, medical emergency, or serious traffic hazard, or to prevent a crime about to be committed; or is due to the reasonable belief that a person's life or safety is in immediate danger. Don’t make the mistake of thinking it’s okay to use a device while stopped at a traffic light. The ordinance requires a vehicle to be at a complete stop, meaning the operator has completely ceased movement of the vehicle in a lawful manner and location. A complete stop does not include being temporarily stopped in a lane of traffic due to a traffic control device, conditions on the roadway, or traffic congestion. This ordinance does not apply to citizen’s band radio devices, two-way radio communication in a commercial vehicle, or to persons engaged in Amateur Radio Emergency Service (ARES) activities or Radio Amateur Civil Emergency Service (RACES) activities. Only warning citations will be issued during January so the City and police officers have time to educate the public and signage gets installed. City officials are asking that you share this information with your family, friends, coworkers, and neighbors. Enforcement begins February 1. BBM

Back in Boerne by popular demand, TAO will return to the Boerne Champion Stage with their exciting new show, “Seventeen Samurai.” “Since their Boerne debut in 2012, there have been more requests to bring back this troupe than any other artists,” states Greg Talford, Artistic Chair. Talford continues, “The explosive Taiko drumming and innovative choreography, combined with contemporary costumes and athleticism, will surely set the stage on fire once more!” Showtime for this event will be on Thursday, February 25th.

JENNINGS ANDERSON FORD’S “FILL THE FORD WITH FOOD” SUCCESS

D

During the months of November and December Jennings Anderson Ford held their annual “Fill the Ford with Food” drive to help out deserving local families. Jennings Anderson Ford partnered up with Hill Country Daily Bread Ministries and Hill Country Family Services to donate food and diapers to local families in need. This year Jennings Anderson Ford exceeded their goals and received so many donations that they were able to fill FOUR Ford Trucks. Jennings Anderson Ford received 10 times the amount of donations then they did last year! They received 5,185 pounds in food donations and 200 pounds in diaper donations, which

is a major necessity for some of these families. Jennings Anderson Ford collected in their store, but they also went out into the community for the annual Dickens on Main event. Employees at Jennings Anderson Ford were also able to get cash donations from patrons in the community to help buy the diapers to donate to these needy families. Jennings Anderson Ford hopes that these donations help out families in the Boerne community and allow them to have a Merry Christmas and a Happy New Year. Thank you to all of the customers that donated to Jennings Anderson Ford to help make this a success! BBM boernebusinessmonthly.com

MEETING CLIENT GOALS BY EMPLOYING UNIQUE ‘TEAM APPROACH’

T

by Joseph Lilli

They call singer Wayne Newton Mr. Entertainment and Mr. Las Vegas. At one point in the 1980s, he was the highest paid entertainer in the world. But nearly a decade later in 1992, Newton went bankrupt. Amazingly, he had $20 million in debt. Unfortunately, according to a MetLife survey, there are many Americans today like Wayne Newton who live like there is no tomorrow. They hardly think about – let alone plan – for their financial future.

16

B oerne B usiness M onthly | January 2016

Matt Nelson, a registered financial advisor with Lawing Financial in Boerne, calls it a “crisis.” He points to a sobering statistic issued by the National Institute on Retirement Security: Only 1 out of 5 working households has more than one times their annual salary saved.1 “In my opinion, this is largely due to procrastination,” Nelson declares. “No matter where someone is in their stage of life, they seem to come up with excuses as to why

they don’t have enough money to save for retirement. I also think some of it is due to fear and not knowing what to invest in.” Still another reason for failing to take action is the overwhelming amount of financial information available today. It simply overwhelms the average consumer, leaving him confused as to what to do and where to invest.

DON’T LET YOUR MONEY RUN OUT

With people living longer today, they need to make sure their money doesn’t run out before they die. Nelson says people need to plan today so that won’t happen. One example to demonstrate the need to diversify is of an elderly widow. She and her late husband had invested in CDs when they were paying a decent rate, but since then, CD interest rates had plummeted. In a case like this, alternative investments and putting some of the funds into an asset allocation model, such as one managed by the firm’s Investment Advisor Committee (IAC), may be able to diversify the portfolio. Nelson helps people seeking guidance by spending time truly listening to their wants, needs, and goals. He doesn’t just look at what they’ve accumulated, but also looks at their asset types, their current tax situation, and what their tax situation will look like when they start taking distributions from their various assets in retirement. “I think too many advisors just focus on the accumulation phase and don’t look at what the client’s situation will look like when they start taking distributions. So after the initial assessment, our team develops specific recommendations and a game plan using a holistic approach,” he says.

A TEAM APPROACH

Lawing Financial operates differently than most major investment firms. It offers its clients a ‘team approach’ structure, holistic planning, and institutional-like products many other firms cannot provide. Nelson explains how this benefits his clients . . . “More than 80% of our clients work with more than one advisor.2 This gives

clients an extra degree of expertise and service they deserve. It’s what we call the Power of the Team approach. “This Team approach also includes our 11-member IAC, led by our Chartered Financial Analyst. This committee makes most of the investment decisions. This frees me and other advisors to spend more time servicing our clients,” he adds. This committee reviews all of the asset allocation models on managed accounts monthly, and makes adjustments if needed. Clients with managed accounts sign an agreement to receive these managed services. Another difference between Lawing Financial and other investment firms lies in the type of investments offered. “Our client’s accounts look more institutional-like because we utilize alternative investments that are non-correlated to stocks and bonds. This provides an additional layer of diversification for our client’s portfolios.” “Our competition, on the other hand, may be limited to just stocks, bonds and mutual funds. Our clients really like these alternatives because historically they have paid decent yields. It’s kind of like hitting singles and doubles all day long,” he says. continued on page 18

TWO SERVICE DIVISIONS

Nelson’s office has two financial service divisions. Lawing Financial provides wealth management and protection for both individuals and companies (like what they provided the widow), while its Qualified Plan Advisors (QPA) provides retirement plans for companies. QPA services more than 350 company-sponsored retirement plans (401(k)s, Profit Sharing Plans, etc.) protecting fiduciaries today and improving employees futures tomorrow. When companies need help with their retirement plans, Nelson and his team complete an initial assessment and benchmarking of their current retirement plan. They analyze the fee structure, service and education plan currently in place. Then they show the companies where they can improve their retirement plan and show them ways to mitigate their fiduciary risk by hiring an ERISA 3(38) investment manager, such as QPA. “We have three ERISA attorneys to provide fiduciary support and face-to-face, ‘boots-on-the-ground’ service to participants in the retirement plans. This means they aren’t forced to a website for education or advice,” he remarks.

ADVISOR ADVANTAGE

While anyone can call themselves a Financial Planner, not everyone is a Registered Representative and Investment Advisor Representative (IAR). As an IAR, Nelson is required to conduct business as a fiduciary to his clients putting their needs and interests first. In addition, he carries an AIF (Accredited Investment Fiduciary) designation, certifying he possesses additional fiduciary expertise and meets higher standards of excellence. With more than 21 years in the investment business, 16 years with Lawing Financial, Nelson is a firm believer of putting his clients first and the rest will take care of itself. “That is what I have done from day one. I feel truly blessed to have served great clients, whose referrals have enabled me to grow my business exponentially over the years. And because of these great clients, I have received numerous industry and firm awards throughout my career3,” he says. Lawing Financial in Boerne, located at 616 E. Blanco, Suite 300B, is part of a large firm with more than 90 advisors, 40 staff and nine offices throughout the Midwest and Southwest. They cater to clients seeking sound diversification beyond the typical portfolio of stocks, bonds and mutual funds, and aid companies needing company-sponsored retirement plans. When asked why the firm opened an office in Boerne and not San Antonio, Nelson explains that Boerne’s demographics aligned perfectly with the type of clients they seek. Besides, they already had a handful of Boerne clients before the office opened. “Boerne is a great community for our firm to serve and be actively involved in. I’m in the Leadership Boerne Class of 2016, and going through this program has given me an even greater appreciation of the community. “Besides, for me personally, I’m not a big city type of guy. So this community fits me perfectly,” he says. BBM

WILL YOUR OFFICE BE ORGANIZED IN 2016?

A

by Esmi Gonzalez

A New Year is upon us and once again we tell ourselves we will strive and work hard for more organization in our lives; at home and at the office. But come early February that motivation is slim to none. The key to getting motivated and staying on course is by making a written plan with goals and challenging deadlines. Focus on what is important to you, your job and a successful year. Something to remember and always keep in mind, organizing systems are not a once and done all. You will be tweaking your list with the changes that come along during the year. It’s ongoing, maybe you get a promotion and your responsibilities change, maybe you move offices, maybe you finish a large project and the list goes on. There are endless tips to getting organized at the office, but I feel these 5 basic suggestions will help cut paper clutter and save you time which in return makes you more productive:

1.. IMPORTANT NOTES

First, write down a list of what is not working for you, what is working for you, what you wished you had accomplished last year, goals, budgets, creative ideas for business growth, etc.

2. AN ONGOING PROJECT LIST

Prioritize your list with the help of your “Important Notes”. List what is the most immediate to you or your team, maybe its by deadline or budget. Continue to keep this list updated accordingly.

3. DIFFERENTIATING WORK STATIONS

Designate areas in your office for certain projects and jobs. Not only will you know where everything is for every project you are working on but it will save you time. Time spent looking for the supplies and files for each project. Make another area for resources and references this includes file cabinets and drawers, a closet or cabinet for office supplies and a bookshelf for research materials. Your desk of course for daily tasks.

4. ORGANIZE YOUR DESK DRAWERS

These drawers should hold what you use on a regular basis; daily weekly or monthly. This keeps you from having to walk across the room for a file or general office supplies.

You will be able to put your hands on a file when a colleague calls asking for information. Keep “like items” together in same drawer such as, writing pads, notepads, sticky notes and stationary. Drawer dividers help keep small office supplies nice and neat and easier to locate.

5. FILE WEEKLY

This task alone will save you lots of time. You’ll know exactly where to find a file when you need it. No more digging around for several minutes looking for a file or having to reprint a document you cannot put your hands on. Find a slow time of the week to get this done, once you are caught up this task will only take you a few minutes to accomplish and a week long of satisfaction knowing where everything is located. Organizing your office can be a big job and overwhelming, break this down into small jobs. Set a deadline but make it realistic and challenging. As mentioned earlier, organizing is ongoing, keeping up with it will no doubt increase your productivity. BBM

I enjoy helping people and seeing the end result, an organized space and a happily satisfied less stressed client! I am the principal of Sort It Out, Professional Organizing Solutions. Some of our services include organizing any room in the home, downsizing, merging of two households, preparing a home for the real estate market and so much more. Serving San Antonio, Boerne and New Braunfels. Organization is a big part of life editing and I’d like help you sort it out! | prepare WHAT FED'S RATE INCREASE MEANS FOR HOMEBUYERS

T

The Federal Reserve increased the federal funds rate by a quarter percentage point, its first move since lowering the rate to zero in December 2008. The last time the Fed increased the rate was in January 2006. What does this mean for those looking to buy or refinance a house? "Rates on adjustable-rate mortgages will react quickly to any rise in the fed funds rates," writes MSN's Janna Herron. "That’s because the rates on ARMs typically are tied to the prime rate or LIBOR, both of which closely track the Fed rate. "But rates on the most common mortgage — the 30-year fixed — will rise gradually. That rate follows the yield on the ten-year Treasury note, which usually moves in the same direction as the fed funds rate, but not in lockstep. The same goes for the 15-year fixed home loan, a popular refinance choice." Real Estate Center Chief Economist Dr. Jim Gaines said consistent rate hikes over time by the Fed could eventually price some buyers out of the market. The subsequent reduced demand could slow home price growth. Information courtesy of MSN and Real Estate Center Online News

Be Prepared for WINTER STORMS

W

by Abby Berry, NRECA

When winter temperatures drop and storms hit, it can be challenging to stay safe and warm. Winter storm severity varies depending on where you live, but nearly all Americans are affected by extreme winter storms at some point. Bandera Electric Cooperative cares about your safety, and we want you to be prepared. Heavy snow and ice can lead to downed power lines, leaving co-op members without power. During extremely low temperatures, this can be dangerous. During a power outage, our crews will continue to work as quickly and safely as possible to restore power, but there are a few things you can do to prepare yourself. • Stay warm – Plan to use a safe alternate heating source, such as a fireplace or wood-burning stove during a power outage. These are great options to keep you and your loved ones warm, but exercise caution when using, and never leave the heating source unattended. If you are using gasoline-, propane- or natural gas-burning devices to stay warm, never use them indoors. Remember that fuel- and wood-burning sources of heat should always be properly ventilated. Always read the manufacturer’s directions before using. • Stay fed – The CDC recommends having several days’ supply of food that does not need to be cooked handy. Crackers, cereal, canned goods and bread are good options. Five gallons of water per person should also be available in the event of an extended power outage. • Stay safe – When an outage occurs, it usually means power lines are down. It is best not to travel during winter storms, but if you must, bring a survival kit along, and do not travel alone. If you encounter downed lines, always assume they are live. Stay as far away from the downed lines as possible, and report the situation to our dispatchers by calling (855)423-2669. Winter weather can be unpredictable and dangerous, and planning ahead can often be the difference between life and death. Bandera EC is ready for what Mother Nature has in store, and we want you to be ready, too. For more winter safety tips, visit BanderaElectric.com. BBM
