This July issue marks the beginning of Boerne Business Monthly’s ninth year! Wow! It’s hard to believe that it’s been that long. It literally seems like only yesterday we were putting out our very first issue. It’s been a fun nine years and I love that I get to share the great things that are going on in Boerne with our readers. This issue’s cover feature is one that I am really excited about. Local businessman, Bill Bird, is doing a great job of helping to preserve Boerne’s historic heritage. Turn to page 16 to read more about some of his recent projects. GVTC GOLF CLASSIC NETS CLOSE TO $150,000 FOR CHARITABLE GIVING

T

The 2016 GVTC Charitable Golf Classic beat dollars raised, compared to any of its previous tournaments, by a good drive. The 11th annual event, which benefits The GVTC Foundation, generated $148,449, which surpasses last year’s record amount by almost 10 percent. Golfers from around the country participated in the event, held at the Resort at La Cantera, on May 2, 2016. Many of them are vendor partners with GVTC, who support the tournament because of the positive impact the Foundation has in the community. “Our golf classic fundraiser would not reach success we now experience without the support of our partners. Several have been with us since our first tournament,” Ritchie Sorrells, GVTC president & CEO, said. “I thank them for their commitment and look forward to continuing our partnership to help this excellent cause.” The tournament is the main fundraiser for The GVTC Foundation, which uses the dollars to support qualifying nonprofits in GVTC’s service area, fund scholarships and contribute to its endowment fund. Approximately 92 cents received by the Foundation goes back to giving or the endowment. In 2015, the Foundation contributed over $300,000 to more than 80 local charitable organizations. The Golf Classic is organized entirely by GVTC employees, who volunteer their time to plan and host the event. “Many thanks go to our GVTC team members who worked so hard to make this year’s tournament the best

HELPING A LOCAL TEEN HEAR

Boerne nonprofit & area restaurant partner to raise money for hearing aids

M

May was declared national Better Hearing Month. In hopes to help raise awareness about hearing loss and funds for a child in need to receive a pair of hearing aids, well-known barbecue joint Smokey Mo’s BBQ partnered with Aid the Silent, a Boerne-based nonprofit organization which serves deaf and hard-of-hearing children and teens nationwide, to raise $6,500 to help one local teen hear. Having started in May and continuing every Tuesday, the area restaurant contributed 10% of its daily sales to help raise funds for a local Boerne teen until the full $6,500 was raised to pay for her hearing aids. In addition, monies collected throughout donation buckets placed throughout Smokey Mo’s San Antonio, Spring Branch and Boerne locations helped Aid the Silent reach its goal to offer resources to others, like her, in need. Aid the Silent is dedicated to equip deaf children/teens with the necessary tools and resources to find personal success by providing hearing aids, assistive hearing devices, speech therapy, American Sign Language lessons, or by attending youth events and camps through Deaf Young Life, a nondenominational Christian ministry that reaches out to teenagers to present the Gospel that is deaf/HOH accessible with live captioning and interpreters.BBM

Is Your Financial Advisor a Fiduciary?

W

When letting a financial advisor guide you through the complicated world of investments and financial planning, you would think that person has your best interests in mind. Unfortunately, that’s not always the case. In the financial services industry, there are potential conflicts of interest that can influence the advice you receive. The term “financial advisor” is used very often and most people assume that all advisors, whether they are stock brokers, insurance salespersons, or any other type of individual providing financial advice, are the same. A recent study showed that over 1/3 of Americans don’t have an understanding of what a financial advisor actually does. Therefore, there are plenty of consumers that don’t know why they have the investments they do, how the advisor is being compensated, if the investment is appropriate, or if there are any conflicts of interest. Currently, stock brokers, insurance salespersons and any advisors operating under the “suitability standard” are merely required to ensure an investment is suitable for a client at the time of the investment. This is different from recommending investments based on a client’s goals and objectives. Even more importantly, this standard does not require disclosure of conflicts of interest. For example, an insurance salesperson can recommend an investment simply based on the compensation they receive from its sale compared to another similar investment. This should never be the basis for a recommendation of an investment. It should always be about a client’s goals and objectives, not the advisor’s. The “suitability standard” contrasts with the “fiduciary standard” wherein the advisor must avoid conflicts of interest and operate with full transparency. Many advisors have always operated as fiduciaries. In fact, Registered Investment Advisors have always been required to be a fiduciary. According to a recent article published by CNBC, studies and surveys regularly show that the vast majority of American investors don't know what a fiduciary is, let alone if their advisor is one. Recently, the Department of Labor (DOL) proposed a new rule called the fiduciary rule. According to Merriam Webster, a fiduciary is

by Karl Eggerss defined as one often in a position of authority who obligates himself or herself to act on behalf of another (as in managing money or property) and assumes a duty to act in good faith and with care, candor, and loyalty in fulfilling the obligation: one (as an agent) having a fiduciary duty to another. In April 2017, all financial advisors will have to act in a fiduciary manner and truly put their client’s needs before their own on all retirement accounts. Why only retirement accounts? The rule is limited to retirement accounts because those are the only accounts that the DOL has jurisdiction over. This means that all other accounts such as brokerage accounts, trust accounts, joint accounts, college savings accounts, etc. would unfortunately not apply. The fiduciary rule seems to most like a no brainer and long overdue. So, who would oppose something that is clearly great for investors? Much of the financial industry is opposing this new rule, including many insurance companies and associations. In fact, they lobbied against it and Congress repealed the new law. But, President Obama vetoed it almost immediately. After the veto, many of those opposed to the law are now suing, including: U.S. Chamber of Commerce, the National Association of Fixed Annuities, the American Council of Life Insurers, the Indexed Annuity Leadership Council & Market Synergy Group, Inc., the Financial Services Institute, the Financial Services Roundtable, the Insured Retirement Institute, and the Securities Industry and Financial Markets Association (SIFMA). This list may grow larger in the months to come. Among those who are suing, some have stated in their lawsuits that the 1,000-plus page rule needs to be repealed because: o It gives the right for consumers to sue agents. o It makes it impossible for them to serve low-income individuals or small businesses. o Independent insurance agents will be forced to exit the market. o Enormous compliance costs It’s interesting that many of their objections are about their profits, not yours. Having an advisor that’s a fiduciary doesn't guarantee better results, but it does guarantee unbiased advice. Don’t be afraid to ask your advisor if he or she is a fiduciary. Also, ask if the advisor is fee-only or fee-based in their compensation. Fee-only advisers will be fiduciaries. A fee-based advisor offers advisory accounts as well as brokerage accounts and is a dual registrant. So while he or she may put on the advisor hat one day, the next day he or she might put on the brokerage or insurance agent hat in order to sell some limited partnerships or annuities, in which they are compensated upfront with a large commission. Remember, the most important thing you should be asking your financial advisor is, “Are you a fiduciary?” As a Registered Investment Advisor, Eggerss Capital Management is a fiduciary and has always been. REI AWARDS CIBOLO NATURE CENTER AND FARM $10K STEWARDSHIP GRANT

REI San Antonio recently awarded the Cibolo Nature Center & Farm (CNC&F) with a $10K Stewardship Grant which was awarded to select nonprofits that care for the outdoor places its customers use and love. The grant will support National Trails Workday held at the nature center on June 4 in conjunction with the American Hiking Society’s National Trails Day and monthly Second Saturday Volunteer Workday Series throughout the remainder of 2016. “Since our opening in 2012, REI San Antonio has supported CNC&F and is proud to partner with the nature center for a fourth year to connect people with nature and active lifestyles,” said Jeanette M. Honermann, San Antonio Market Coordinator, Outdoor Programs & Outreach. CNC&F has been grateful to partner with REI annually to connect people with nature and active lifestyles. It is through the generosity of CNC&F’s donors and volunteers that they are able to make a special haven for wildlife and outdoor enthusiasts accessible to the public for free. REI’s partnership in promoting volunteer workdays and maintaining the land and more than three miles of trails assists the nature center greatly in its mission. The National Trails Day on June 4 and the Second Saturday Workdays will assist with the land management of the non-profit CNC&F by mulching trails to prevent erosion and planting beds to enhance drought tolerance; collect trash along creeks and trail; prune trees and cut back undergrowth on trails for Creek trail maintenance; maintain and control the Malta star-thistle, an invasive species, at Herff Farm; selectively

Over the last 14 years, botulinum toxin A, brand names, Botox, Dysport, and Xeomin, have made thousands upon thousands world wide appear, younger and refreshed by smoothing out lines of facial expressions. Throughout this article “botox” is used to mean botulinum toxin A. Botulinum toxin is commonly called botox, as in Texas, all facial tissue is Kleenex, and all soda pop is Coke. Yes, of course, wrinkles can come with aging, but do they have to? We are a culture that values the look of youth and personal appearance. There is no right or wrong to it, it just is. There have been several psychological studies that found that attractive people are thought to be smarter, have more leadership skills, more social skills, etc. There are obviously payoffs to having a more pleasing physical appearance. Given the choice would you rather be pretty or handsome or ugly? Many of the aging stars seem to have really maintained their looks, and no doubt they have been employing many of the dermatologist and medspa’s methods, including botox. It’s no wonder that the popularity of botox treatment has taken off over the 14 years since introduction to the American market and approval by the FDA. There was a time when coloring your hair was something you didn’t want anyone else to know about. At the risk of dating myself, there was a very successful advertising campaign for Nice and Easy Home hair coloring, that had the tagline, “only your hairdresser knows for sure” meaning the dyed hair looked natural. Botox is the new “secret” weapon that many are using to improve their appearance. Botulinum toxin is a protein, yes, it is a poison, and one of the most powerful toxins known. It was never used for chemical warfare, but it is a neuromuscular blocker. The doses used for aesthetic

by Dr. Lily Engles treatments as well as medical treatment are miniscule, and safe used properly. Botulinum toxin is made by the bacteria, Clostridium botulinum. In larger amounts the toxin causes the illness Botulism, which comes from eating improperly preserved food. This is a major reason why we have been cautioned to throw away any canned food that the can is open or has expanded. Botox treats a variety of conditions in which muscles are overactive, or spasm such as cerebral palsy, uncontrolled twisting of the neck or spine, and blepharospasm (an uncontrolled closing of the eye. It doesn’t sound that bad unless you need to drive, or something else when you can’t just have your eyes close on you). A Canadian opthalmologist, Dr Jean Carruthers, working on treatment for blepharospasm, using botox, noticed how it also stopped the frown contraction, as well as, the eyelid spasm. The use of botox for cosmetic/aesthetic purposes was discovered. Selectively, and temporarily, Botox is a neurotransmitter blocker. It stops the muscle from responding to the signal from the brain through the nerves to contract. This is how botox works to decrease the lines that can become permanent wrinkles. Most notably and commonly, patients want to have their frown lines ironed out. Many people unconsciously frown while they are concentrating or are out in bright sunlight, as well as frowning from displeasure and anger. As time passes, that expression, and the lines it produces can become etched into the skin as wrinkles that don’t go away even though the muscles are relaxed. If the face can’t make the frown, will it still make the wrinkle? No! This is the magic, totally based in science, of botox: less wrinkling, and the face appears more youthful and more attractive. Additionally, the facial expression


muscles are muscles. If you use them often, they maintain their strength and bulk. Just like if you had strong biceps, then broke your arm and had to wear a cast for two months, you would notice that those biceps had atrophied from not being used. Is it permanent? No, using the muscles starts building them back up again. One theory of how it helps to decrease facial wrinkles is that by blocking the transmission of the order to “frown,” the brain and the body are being retrained not to make that expression by creating a negative feedback loop.

Botox treatment is best in the upper face, the muscle complex that makes a frown, the forehead muscle that causes horizontal forehead lines, and the muscle that goes around the eyes that causes crow’s feet over time. It can also be used to help correct a downturned mouth, a gummy smile, or a peach pit chin. It can also do a “botox brow lift” to increase that space between your eyelashes and the eyebrow. Patients worry that they will appear frozen or unnatural. This won’t happen in the hands of a well-trained injector. Botox treatment is all about knowing anatomy and the effects of the opposing muscle groups of the face. Sadly, the effects of botox are temporary. Typically, muscle movement returns in three to four months, although there are some patients that have six months effect. Some wonder if having botox treatments will be noticeable to their spouse. Often, there’s no word of recognition that anything is different from the spouse. Perhaps, it’s like dying your hair just one shade darker or lighter, if you went Ronald McDonald red, everyone would notice. I have a number of patients who choose not to tell their spouse. Talk with Bill Bird for just minutes about his passion for real estate in Boerne and one perception quickly emerges: he wants to preserve the town’s historic heritage. “I really think we have an obligation to preserve our heritage and our story through historic properties. I just think it’s the right thing to do. It’s good for me. It’s good for the community. And it’s good for the people who visit Boerne,” he says with deep conviction. Growing out of his appreciation for Boerne’s historic properties, Bird believes they all possess a soul, a certain undeniable feel. In his mind, they are more than just old structures. They absorb some sense of the people who have dwelled in them and of all that has happened there. He sees them as being rich in spirit and character because of the wealth of personalities and experiences associated with them. Of course, being an astute businessman, he also sees them as sound real estate investments. After all, he notes, “They’re not making any more Main

Street Boerne. There are only so many properties there.” So Bird has assumed what he says is a huge obligation and responsibility to do something fantastic with them. To date, Bird has purchased several historic properties and is, indeed, orchestrating their “fantastic” renovation or makeover. They include Ye Kendall Inn, Carstanjen Mansion (known recently as El Chaparral or La Mansion), and the Cypress Grill building on Main Street. He’s also transformed what was formerly the Crescent Quarters Inn above the Cypress Grill. It is now called The William, an upscale inn. And, he’s bringing in a 5-star restaurant to the Kendall Inn called Peggy’s on the Green. For his efforts and leadership within the community, Bird is a trendsetter. He says he wants to be part of raising Boerne’s economic tide and processing

more dollars through the local economy – the reason he’s bringing in Boerne’s first 5-star restaurant and creating a luxurious Four Seasons type experience with the opening of The William. “I think it started when my partner and I brought a Mercedes Benz store to Boerne and to Kendall County. Mercedes Benz, a 5-star restaurant and luxury hotel are just the beginning of more to come,” he exclaims. How It All Began How Bird got to where he is today is a case study in determination. When looking Ye Kendall Inn for a job in 1984, he went to a Dodge dealership in San Antonio and got accepted into their training program. “But after one week in the training program they let me go and said I’d never make it in the car business,” he recalls with a slight laugh in his voice. Undaunted, he combed the want ads and saw that Lincoln Mercury in downtown San Antonio was looking for

a Used Car salesman. They declined to hire him because he lacked experience. “I asked how I could get experience and was directed to the New Car manager. They said he would hire anybody.” Bird did get the job. After selling new cars for a few continued on page 18

years he was promoted to the Finance Department. In 1988, he left Main Lincoln Mercury and went to work for a BMW dealership. Over the next 15 years, he ascended the executive ladder rapidly. He served as the dealership’s Finance Director, Used Car Manager, General Sales Manager, Operations Manager, and General Manager, before ultimately buying shares in the limited partnership and becoming an owner/operator. In 2003, Bird sold his shares back to his partners. The next year, he formed a partnership with his current partner, Ron Heller, and in 2005 opened Mercedes Benz of Boerne. Other dealerships followed, including Mercedes Benz of Medford, Oregon, as well as Mercedes Benz, Audi, Jaguar/Land Rover, and Acura dealerships in San Juan, Texas. But Bird’s love of real estate and the compelling allure of Boerne and its rich historic heritage led him to buy and restore several properties in Boerne’s historic district. “I have a passion for real estate and it began when I started taking real estate classes in the early 1980s at San Antonio College. I’ve always enjoyed it. I buy and sell a lot of real estate,” he confides.

Historic Transformations Let’s take a quick glimpse of what Bird, the visionary and trendsetter, has accomplished with the historic properties he’s purchased . . . Ye Kendall Inn The first thing Bird did was to meet the needs of his employee partners. He installed a new facility for them housing washers, dryers, storage, and a maintenance workshop. He also upgraded the front façade and exterior of the inn located at 128 W. Blanco Road in the Boerne Town Square and directed a gorgeous makeover of the lobby including the addition of art work from local artists provided by Texas Treasures of Fine Art Gallery. In the fall of 2016, he plans to renovate the rooms to give them more of an 1859 or turn-of-the-century feel. Meanwhile, he is replacing the former Limestone Grille with a 5-star restaurant and bar called Peggy’s on the Green. Owned by renowned Chef Mark Bohanan, with Bird acting as its landlord, the restaurant will include an outdoor venue on Cibolo Creek. It’s expected to open this summer. Carstanjen Mansion (El Chaparral or La Mansion) Located at 705 South Main, La Mansion has undergone a thorough renovation and is now called Augusta & Co. Bird, who admits to being oddly attracted to the building, says he’s always loved it. He was especially pleased with what was revealed The William during renovation. “It was a huge, huge win when we started to renovate the exterior stucco on the building and discovered there were limestone walls beneath it. We removed every square inch of stucco off the limestone and exposed it,” he says. “This building wasn’t cheap and obviously my restoration wasn’t inexpensive either, but it was worth it when I uncovered that limestone.” Augusta & Co., labeled a “lifestyle” store through its owner Tina Cappello, offers shoppers an upscale shopping experience. “There aren’t many places in Boerne where you can come in and have a glass of wine, look at quality furniture, buy a blouse, and get your hair done all at the same time,” Bird says. Augusta & Co. fits Bird’s business model of bringing higher-end businesses to Boerne, and at a price point that benefits the town’s economy. He believes that by redefining his products and offering residents and visitors alike with a unique, upscale shopping experience (like Augusta & Co., for instance), he can eliminate his competition.

BOERNE’S AWARD WINNING CITY FINANCES UPGRADED

A

As a result of recent meetings with two of the nation’s major financial rating agencies, Moody’s Investors Service and Fitch Ratings, the city of Boerne’s outstanding general obligation debt has been upgraded by both agencies. Moody’s upgraded the City’s outstanding general obligation debt to Aa2 from Aa3. Fitch upgraded the City’s rating on outstanding general obligation bonds to AA from AA-. These ratings upgrades will result in significant savings for the city’s budget since $19.9 million in bonds were recently refinanced with an outstanding interest rate of 2.56%. The City will save approximately $3.7M over the remaining life of the bonds. According to the Moody’s Investors Service report, “The City of Boerne’s outstanding general obligation debt is upgraded to ‘Aa2’ from ‘Aa3’. The upgrade to ‘Aa2’ reflects the city’s strong financial position, consistent tax base growth benefiting from its proximity to San Antonio, which currently has a ‘Aaa/stable rating’, and its average socioeconomic profile.” The report cites the city’s healthy reserve position maintained through conservative budgeting and strong performance as a credit strength. In the report from Fitch Ratings, “The City’s rating on outstanding GO (general obligation) bonds was upgraded to ‘AA’ from ‘AA-‘. The rating upgrade to ‘AA’ reflects the city’s strong financial performance and conservative budget practices which maintain financial flexibility while addressing growth-related needs.” Part of the process involves preparation of a very comprehensive package of financial records along with responses to questions submitted by the rating agency representatives regarding specific community initiatives and financial performance. “These ratings are significant because they will help us secure better interest rates and save money as we proceed with refinancing our outstanding debt,” said city manager Ron Bowman. “This is a very big deal for our Boerne residents and utility customers. We are considering this a very positive sign reflecting our ongoing efforts to manage the publics’ dollars and provide services that

Read This First Before You

CRACK YOUR OWN NECK

We all know the person who loves to twist and pop the joints in their body, otherwise known as self manipulation. Whether its twisting your neck or turning your torso until it releases with a loud pop, many people find this as a way of getting relief. The popping and crunching sound may be creepy to some and satisfying to others. There are countless videos on YouTube showing people cranking their necks, almost inhuman like. It seems like it's a competition on who can make the loudest and creepiest sounds to get the most “likes''. IF I'M GETTING RELIEF, WHATS THE BIG DEAL WITH TWISTING MY NECK? I have been told multiple times from people who twist and pop their own neck, that this is how they get relief. The relief does not last long and if it does, they are hooked on the feeling. This habit can also create issues that were not there before. Take a look at this x-ray of a person who constantly self manipulated their lower back. It doesn't t take severe trauma to change the spine, small and quick repeated forces in the spine can do the job. Their back felt tight, sore and they could only drive 15 minutes before it bothered them. The neck happens to be the least stable part in your spine. The lower back is the most stable, but it's still no match after years of getting twisted and torqued. WHAT'S HAPPENING HERE? Loose ligaments = poor stability:

Just like a rubber band being constantly stretched, ligaments can weaken over time. There is a name for this phenomenon and its called “creep''. Disc bulges/protrusions are just as susceptible to damage. A shearing force through twisting could create more disc issues and weaken it further. The Golden Gate Bridge has suspension cables made of steel that hold it upright and level. If these cables were stretched and weakened over time, what would happen to the road and structure? Structure: Joints move past their normal physiologic range of motion when forced out of it. Forcefully manipulating your spine causes the brain to think this input is normal. The brain interprets these new movements and learns the patterns which is called “plasticity.” Moving the incorrect vertebra can have serious effects to the spine and it's optimal alignment. Loud Noises: When you move a joint fast from point A to B, there is a loud sound that can be heard. Our joints have tiny gas bubbles in them that make this noise when released. This event is rather harmless and can make people cringe or smile. IS THERE A BETTER WAY? Self manipulation can start as way of getting relief. The concerning issue with going down this road is that it makes someone dependent on it. If you or someone you know find your self needing to pop, twist or crack your neck, it could mean that your spine may not be functioning at its best. When choosing a Chiropractor, make sure that the examination process includes objective measurements to the spine. The quick, feel good, temporary rush of a general manipulation is not something we focus on in our office. If that sounds good to you then I encourage you to find what you are looking for. hat is the main motivation to purchase a work of art? Is it an instantaneous connection that the viewer experiences when their eyes meet the canvas, or its investment potential? According to Artsy writer Alexander Forbes, “the vast majority of collectors (72%) say their purchases are passion-led and investment-informed, while only 6% said they’re buying art purely as an investment.” Apparently, the emotional factor of connection is still a paramount element that inspires even the most discriminating art collector to purchase. One of the strongest yearnings one can have is for reconnecting with feelings that remembering the past can give us. Paintings can remind us of gentler times by encapsulating a moment and allowing one to relive a cherished scene from days gone by.

“One of the great things about my paintings,” McCall says, “Is that I can take people back to a memory, to a place, to a nostalgic moment in their life. I often hear, ‘Oh, that looks like Grandpa’s place,’ or ‘That looks like where I went hunting with my buddies.’” By capturing these feelings in his paintings, McCall is able to channel one of the main impetuses that motivate people to purchase art: a sentimental bond. There is a unifying presence of rust on the steel shingles of the shed, the blades of the windmill and the water tower, all structures independent and with their own purpose and use. The rust acts a visual reminder of what the elements’ toll is upon metal throughout the seasons. Each structure has witnessed the passing generations that have built and utilized them. Covering the well-worn structures in a patina, the rust suggests the sepia tone that time infuses into vintage photographs. There is certain stillness, a frozen moment in time, that creates a lens into the past that is central to the mood and theme, emphasized by the stoical position and stance of these weary structures, stubborn in their tenacity in this sun-drenched environ.
