WWhether you’re seeking to manage your own assets, control how your assets are distributed after your death, or plan for incapacity, trusts can help you accomplish your estate planning goals. Their power is in their versatility—many types of trusts exist, each designed for a specific purpose. Although trust law is complex and establishing a trust requires the services of an experienced attorney, understanding the basics isn’t hard.
A trust is a legal entity that holds assets for the benefit of another. Basically, it’s like a container that holds money or property for somebody else.
There are three parties in a trust arrangement:
The grantor (also called a settlor or trustor): This is the person who creates and funds the trust.
The beneficiary: This is the person or people who receive benefits from the trust, such as income or the right to use a home and have what is called an equitable title to trust property.
The trustee: This is the person or peo-
ple who hold legal title to trust property, administer the trust, and have a duty to act in the best interest of the beneficiary. You create a trust by executing a legal document called a trust agreement. The trust agreement names the beneficiary and trustee. It also contains instructions about what benefits the beneficiary will receive, what the trustee’s duties are, and when the trust will end, among other things.
You can put almost any kind of asset into a trust, including cash, stocks, bonds, insurance policies, real estate, and artwork. The assets you choose to put in a trust will depend
largely on your goals. For example, if you want the trust to generate income, you could put incomeproducing assets, such as bonds, in your trust. If you want your trust to create a fund that can be used to pay any estate taxes due after your death or to provide for your family when you die, you might fund the trust with a life insurance policy.
A trust can:
• Help reduce estate taxes;
• Shield assets from potential creditors;
• Avoid the expense and delay of probate*;
•Preserve assets for your children until they are grown, in case you should die while they are still minors;
• Create a pool of investments that can be managed by professional money managers;
• Set up a fund for your own support in the event of incapacity;
• Shift part of your income tax burden to beneficiaries in lower tax brackets; and
• Provide benefits for charity.
*Note: Probate is the courtsupervised process of settling
a deceased person’s estate. Probate can be a complicated process and often takes six to eighteen months to complete.
However, trusts also have potential disadvantages. First, there are costs associated with setting up and maintaining a trust. These may include trustee fees, professional fees, and filing fees. It’s also important to know that, depending on the type of trust you choose, you may give up some control over the assets in the trust. Also, maintaining the trust and complying with recording and notice requirements can take considerable time. Lastly, income generated by trust assets and not distributed to trust beneficiaries may be taxed at a higher income tax rate than your individual rate.
There are many types of trusts, the most basic being revocable and irrevocable. The type of trust you should use will depend on what you’re trying to accomplish.
Living (Revocable) Trust
A living trust is a trust that you create while you’re alive. A living trust: Avoids probate. Unlike property that passes

to heirs by your will, property that passes by a living trust is not subject to probate, avoiding the delay of property transfers to your heirs and keeping matters private.
Maintains control. You can change the beneficiary, the trustee, and any of the trust terms as you wish. You can also move property in or out of the trust, or even end the trust and get your property back at any time.

Protects against incapacity. If, because of an illness or injury, you can no longer handle your financial affairs, a successor trustee can step in and manage the trust property for you while you get better. In the absence of a living trust or other arrangement, your family may have to ask the court to appoint a guardian to manage your property.
A living trust can also continue after your death. You can direct the trustee to hold trust property until the beneficiary reaches a certain age or gets married, for instance.
Despite these benefits, living trusts have some drawbacks. Property in a living trust is generally not protected from creditors, and you cannot avoid estate taxes using a living trust.
Unlike a revocable trust, you can’t easily change or revoke an irrevocable trust. Also, for this type of trust, you usually cannot change beneficiaries or change the terms. Irrevocable trusts are frequently used to help reduce potential estate taxes. The transfer may be subject to gift tax at the time when property is transferred into the trust, but the property, plus any future appreciation, is usually removed from your gross estate. Additionally, property transferred through an irrevocable trust will avoid probate and may be protected from future creditors.

FFor Mague, or Margarita Salas, owner of Mague’s Cafe, the success of the restaurant is a dream come true – with a lot of hard work, dedication and sacrifice along the way. Mague came from Durango, Mexico when she was just a child and has been cooking for as long as she can remember. According to her children, Mague “loves to cook for everyone and anytime. She enjoys making people feel as though they are eating in her personal kitchen, having a home cooked meal.” It was this passion for cooking that lead her to open the doors to her first restaurant in San Antonio in 1984. “It was a very small establishment with only six tables.
When I went to go get my business cards printed up, the lady designed the cards with the logo of the Mexican dancers. I loved it so much that the logo has remained the same for many years,” said Mague. It wasn’t until five years later when Mague’s daughter, Claudia, went for a drive and fell in love with the town of Boerne. They decided it was the perfect place for their new restaurant… and the rest is history.
Once Mague’s Cafe moved to Boerne, the restaurant had more space and room to grow! “We were very nervous about moving the restaurant to Boerne all those years ago. We honestly had no idea what to expect,”
said Mague. As it turns out they had nothing to be nervous about it all. “Our first day we had people lined up outside before we even opened the door!” And after all these years, the crowd is still there. It is not uncommon on Saturday and Sunday mornings, or with the busy weekday lunch crowd, to see customers sitting and standing on the restaurant’s front porch, waiting for a table and those delightful homemade Mexican dishes, a pile of breakfast tacos and of course, a big ol’ glass of their sweet tea.
Now 40 years later, Mague’s dream has turned into something she shares with her children and grandchildren who help her run continued on page 22
the family business. Daughters, Claudia, Carina, and Brenda, son Pablo, as well as some of their children, work tirelessly to serve up their Mexican food that so many have come to crave. “It is great to get to work together as a family. We all have our niches, the things we are good at, and we complement each other’s abilities to make the restaurant thrive.” And even though the restaurant is a family affair, there’s no question as to who the boss is! They will all unanimously agree that Mague has the final say on everything! “Mom always has the last word!” added Claudia. “She knows that she can count on her family for anything that needs to get done! We are a very close family that is always there for one another.”
Mague’s Cafe definitely has its fair share of “regulars,” many of which eat at the restaurant multiple times a week and some even multiple times a day. “At this point we have many customers who have eaten here their whole lives and are now bringing in their kids and grandkids,” added Brenda. “It is so fun to see the families grow and to get to be a part of their lives and their hometown experience. That our food can be part of their memories of growing up and liv-
ing here in Boerne is a big deal for us.” In fact, Mague’s even has customers who will buy tacos and freeze them to send to their kids who are off at college or have moved away for a little taste of home.
Mague and her family all agree that the restaurant is not just a business, but a huge part of their lives. “For us girls, working at the restaurant has been our first and only job. We’re always on call and it’s a lot of hard work, but it’s worth it. We have three generations working in the family business. It is something that we are really proud to be a part of and to be able to build together.”

Not everyone comes from money, but there are decisions you can make today to set up future generations for long-term success. One of the easiest ways for the average person to do this is through real estate. Buying a home not only creates a stable living environment for your family, but it also builds wealth that can be enjoyed for generations to come.
Generational wealth is created by transferring your assets to other family members. These assets—whether they’re real estate, savings accounts, life insurance, retirement accounts, or money made in the stock market—can be passed down from one generation to the next. The most common example is a parent willing their assets to their children. This then gives the children a leg up financially, allowing them to combine this wealth with what they had already established on their own. It can create a snowball effect as the cumulative assets continue to roll to the next family member in line.
You can save money or be prudent about paying off debt, but these acts alone won’t typically yield significant wealth that can be passed on. A solid saving and investing strategy can add some more money to the pot, of course. But many people find that buying a home is the easiest and best way to create generational wealth. That’s because the equity in your home will continue to rise as you pay down the principal of your loan and as the market value of your home increases at the same time.
On average, you can expect a 4% increase in the value of your home every year*—although that’s not always the case. The New York Times notes that existing home prices increased by 45% between December 2019 and June 2022, due to the COVID-19 pandemic. Of course, home values do fluctuate, meaning that there is always the potential for a house to lose some value. Even with those blips, however, homeowners tend to create wealth over time. And if you’re buying a home with the goal of creating generational wealth, then you’re likely viewing the purchase as a long-term investment.
Now, establishing a financial legacy may mean playing the long game, but it doesn’t mean you have to buy a home and just sit on it until you can pass it onto your children. That is one approach, but it’s not the only one.
Many people piggyback off an initial home investment. They may sell the home for a profit and then purchase a larger home. Or they may choose to improve, upgrade, or expand their home to increase its value. This can be done through a home equity loan, a cash-out refinance, or a home equity line of credit (HELOC).
These same tools can also be used to purchase an additional home, whether that’s a second home, a vacation home, or an investment property that provides an additional stream of income.
All of these strategies are possible thanks to that first home purchase. Now imagine what you can do with the equity in your home after it’s been building up for 10, 20, or 30 years. That’s
why homeownership is often at the crux of any conversation about how to create wealth.
There are other benefits to building home equity, too. You can use that home equity loan, cash-out refinance, or HELOC for other purposes. This might be paying off debt, saving for retirement, or taking a bite out of a student loan.
If the home you own appreciates by about 4% every year, then so too does the cost to buy a home for your kids. Not only do they have to save money, improve their credit score and financial literacy, and worry about interest rates, but many will also face the prospect of being priced out of the homes they want.
Buying a home for the purpose of passing down wealth gives you a few options:
• Your children can live in the home as they save money for their own real estate purchase—a bonus for you if you’re hoping to have your kids nearby!
• You can give the home to your children when you’re ready to downsize, or you can will it to them in your estate planning.
• You can use your home equity to help them with a down payment on a new home, thereby easing some of the burden associated with buying a home.
We’ve talked about what a home may mean to the next generation (and the one beyond that), but what does it mean for you? It means security, stability, and predictability. If you lock in a 30-year, fixed-rate mortgage, then your monthly payment will never change. This is a big deal as homes appreciate and the cost of rent continues to climb.
Knowing what your monthly housing expenses will be frees up your cash for a variety of other uses. Sponsored by the Genealogical Society of Kendall County (GSKC), The First Families of Kendall County project began in 1999. The purpose of this project is to recognize the living descendants of persons instrumental in founding and settling of the area encompassed by present day Kendall County, Texas and to preserve the history of their families and the county.
To date, 586 applications have been approved for 318 different individuals. One hundred seventy (170) Founders and one hundred four (104) Early Settlers have been documented and recognized. They represent one hundred thirty-five (135) different families in Kendall County. There are two hundred sixty-two (262) volumes of First Families notebooks on the shelves at the Family History Place.
Here we will share with you some of the stories of those First Families who settled this beautiful area of the Texas hill country. We hope you enjoy!
Tby James HurstThe Texas State Penitentiary in Huntsville is the oldest state prison in Texas. Robert Perkinson, author of Texas Tough: The Rise of America’s Prison Empire, wrote that the unit was Texas’ “…first public work of any importance.” The prison’s first inmates arrived on October 2, 1849, and Kendall County Founder, William Greenbury Sansom, was prisoner number 1, the first person incarcerated. Convicted of cattle rustling, he was sentenced to three years of hard labor and transported from La Grange to Huntsville.
William G. Sansom was the son of William Greenbury Calhoun Sansom and Delphia Clay. Born in Morgan County, Georgia, on June 3, 1811, the family moved to Dallas County, Alabama, in 1820. Here, on May 1, 1833, he married Mary Short, daughter of John Major Short and Dicey Stinson. John Short and his younger brother, Michael, came to Texas in 1835 and volunteered with Sam Houston. John later requested and received a passport from the Republic of Texas, which permitted him to travel to Alabama to bring his family back to Texas. The Short Ranch was established on John Short’s 640-acre headright in Fayette County, not far from La Grange. The Sansoms loaded their wagon and came to Texas during the winter of 1838-39, initially settling in Washington

County. Five years later, the family moved to Fayette County, and it was here that William mustered into the US Army and served during the Mexican War.
Service records show that William served in two companies during his enlistment: Callahan’s Company, Texas Mounted Cavalry Volunteers, and Green’s Company, First Texas Mounted Rifles. On September 6, 1846, he was discharged in Camargo, Mexico, over 1,100 miles from his home in Fayette County.
Shortly after returning home, on February 17, 1847, William’s fatherin-law, John Short, passed away intestate. His son, William Short, asked the probate court to appoint him administrator of the estate along with his brother-inlaw, William Sansom. At the March term of the Probate Court, Dr. M. Barrier and Thomas Cox asked the court to appoint them as administrators of the estate. The men stated that “on the 16th of February 1847, the said John Short had made a will and appointed them executors.” John Blackburn made an affidavit that he witnessed said will be signed by the decedent. The will left the headright land to Mary Sansom and provided for her sister Elizabeth and her youngest brother Alphonso. It did not mention William Short. The Judge of the Probate Court appointed George W. Breeding as the administrator of the estate. The District Court annulled the will, and all the children except William participated in the inheritance. Court battles contesting the will
lasted through the Civil War and Reconstruction.
William Short was involved in a large criminal gang whose territory ran from the Rio Grande to Missouri. Their illegal activities involved stealing livestock, horses, counterfeiting money, and land certificates, stealing, and reselling slaves, stealing guns, and murder. He and his brother Thomas attempted to involve their brother-in-law William Sansom in their activities. Sansom was arrested by the Fayette County Association, a group of ranchers organized to protect their property, who turned him over to the sheriff. He was confined to the local jail, and just before going to trial, he wrote a confession. In his confession, William Sansom related that as early as the Summer of 1847, he was aware of William Short and others stealing cattle and selling them to a man named Hewitt. He described a vast network of criminal activity that he and others were aware of, but the only crime he acknowledged was taking and killing two hogs with the help of William Short and his brother Thomas. He said he was told he would be killed if he divulged anything about the gang.
He was convicted of cattle rustling and sentenced to three years of hard labor, but his sentence was commuted. He received a pardon from Governor P. H. Bell and was released on September 14, 1850. William Short was hanged for his crimes and his brother, Thomas, was prisoner number 3 on the Huntsville Penitentiary roster. Family stories say that Thomas was acquitted because of his youth, but penitentiary records show he was imprisoned on November 24, 1849, and released on November 1, 1850. He and William Sansom both appear as inmates on the 1850 Census for Walker County. Meanwhile, Mary Sansom is living on their farm in Fayette County with her children, John, age 17, Mary, age 14, Dicy Ann, age 12, James, age 11, and Robert, age 1. Two children had died by 1850, Henry Leonard and Delphia Ann. Francis Marion is not on the census but would have been 6 in 1850. The Fayette County Census was enumerated on September 6, 1850, a week prior to William Sansom’s release from prison.
In her book, Kendalia, a History of the Settlement, Donna Jonas tells us that Captain John William Sansom moved to Texas with his parents in 1838 and to Curry’s Creek in 1850. From this, we conclude that as soon as he got home from Huntsville, William Sansom loaded up his

family and moved to Comal County. The Sansoms remained in Curry’s Creek for the next 33 years. While his son gained fame as a Texas Ranger, William also served as a Texas Ranger during the Indian Wars. He was in Callaghan’s Co., Texas Mounted Cavalry Volunteers. Family stories tell us that he also served during the Civil War, but there are no records supporting this story. It is possible that, like many Union Sympathizers, he served in a local home guard, but on the 1867 voter registration list, he declared that he had never served the Rebs voluntarily and that he was a Union Man. William and Mary had three more children after they moved to Curry’s Creek: Thomas Jefferson (b 1852), George Larkin (b 1855), and Ann Agnes Keziah (b 1858).
William G. Sansom later lived in Uvalde, Texas. When Mary died June 12, 1888, she was buried in the Uvalde Cemetery, so it is reasonable to assume Uvalde is where they moved when they left Curry’s Creek in 1883. In 1900, William Sansom was living in Uvalde next door to his son, Captain John. On August 15, 1903, William died in Hondo, Medina County, some 40 miles from Uvalde. He was buried beside his wife in the Uvalde Cemetery.

TThe Boerne Independent School District held its fourth-annual Incubator Pitch Night at Boerne-Champion High School. Students from both Boerne and Champion High School pitched their businesses to judges from the business community. A total of $20,000 in seed money was won by the students.
Thin Ice took first place and was awarded $9,000. Made up of Daniela Trevino, Kate Deykin, Tre Hudspeth, and Gus Addington, Thin Ice is a peel and stick portable ice pack.
Fold-A-Flop, the team of students Hadley Shields, Preston LePage, Kaylie Thomas, and Kenny Pulkinen, placed second and earned $5,000. Their product is foldable, portable flip flops.
The third-place winners, MELD, won $3,00, with the team of George Galiopoulos, Emily Carr, Ryan
Cutsinger, and Korbin Soens. They created magnetic phone cases with attachments to carry accessories such as airpods, and keys.
Conservisink earned $2,000 for their home water conservation and collection products. The team was made up of Kenzie Mazzu, Fielder Scott, Reese Shaffer, and Brinley Collins.
The team of Club Scrub won $1,000 for creating a golf club cleaning brush. This was created by Ethan Munn, Evan Munn, Wesley Dulin, and Quinn Young.
The Fan Favorite award went to Hygenie, with Barrett Bouslog, Jack Taylor, Nicole Hernanez, and Sophie Nelson. They were awarded $1,000.
The Incubator class had generous donations and sponsors, as well as mentors from the local business community.

BThe Boerne ISD Board of Trustees approved new elementary school attendance boundaries at their regular monthly meeting on Monday, April 15, 2024. The new boundaries create an attendance zone for Viola Wilson Elementary and provide enrollment relief for Fabra Elementary, Kendall Elementary, and Van Raub Elementary.
The board approved Option A with adjustments. Rising 5th graders and their siblings will have the option to “grandfather” for one year, allowing them the option to stay enrolled at their current campuses. Families who opt to “grandfather” students are responsible for providing their own transportation.
