September is here! School is officially back in session and summer is winding down quickly. The temperatures have already begun to cool a bit and we will welcome the first day of fall on September 22nd. My how this year is flying by! With school starting back up we thought it would be a perfect time to feature Learning Foundations, a great local resource for helping students with learning challenges and other special needs. When asked what the Kendall County Abstract Company does, owner Mike Lang has a succinct answer. “We provide peace of mind.” Peace of mind? “Real estate purchases are usually very large and for most people buying a home is THE largest financial transaction they will ever encounter,” Lang declares. “Most property transactions go smoothly, but about 25 percent have problems we have to fix. That’s why the abstracting process is crucial for sound transactions. The last thing a property owner wants is to be notified

that someone is asserting that they have rights in his or her property.” He explains that without a complete and accurate history on record, the property owner is vulnerable to unexpected issues, such as taxes owed, unknown heirs, or mistaken property boundaries. Because of such potential situations, his company offers title insurance to protect the insured from potential losses related to such issues. “We look back at the history of the property and find everything that we can that affects the property that’s

filed in the public records. We then provide these findings to the prospective buyer and the owner in the form of a Title Commitment,” he says. Once the buyer and seller agree on issues that can affect the property and the seller has clear title to the property, they issue title insurance for that property. Title insurance protects the buyer against losses due to claims against the property that could surface later from issues that were not in the public records. Lang likens title insurance to a warranty on a used car. Before the dealer puts a used car on his lot with a warranty, he has his auto mechanic carefully inspect and repair any issues that could cause the buyer to bring back the car for repairs. “Having to take a car in for repairs is inconvenient, but with real estate, you usually have to go to court to settle disputes over property rights and that goes beyond inconvenient. We try to make sure that never happens to one of our clients,” Lang remarks. IMPORTANCE OF TITLE INSURANCE Despite Kendall County Abstract Company’s exceptional diligence, however, unknown problems can sometimes surface when clients don’t tell them everything or

issues arise that are not filed of record. He recalls the instance when a mother with two children was in the office for a closing involving the death of her spouse who had died without a will. The mother had provided an Heirship Affidavit that had been signed by neighbors who had known her for several years since she moved into the house she was selling. The closer, looking at the Affidavit, asked her, “Are these your only two children?” When the mother replied, “Yes,” her son blurted out, “What about Tommy?” The mother then admitted she had another son who was born out of wedlock and had been adopted at birth by another family long before she moved to Texas. Since Tommy was a child of the mother and, in the given situation, had heirship rights, he could surface years later and claim an interest in the property. There was also the time a lady and her husband sold a home, but six months later a gentleman came in wanting to know why he had received a payoff on his mortgage. He was told that he and his wife had sold the property. He said, ‘No, I didn’t.’ It appears the lady had brought in an imposter with fake identification to pose as her husband. She was tracked down in New Orleans and brought her back to Texas where she was tried for fraud. Meanwhile, since the unsuspecting purchaser of the home that the couple sold was not the rightful owner, the title insurance paid the value of the home. VAST RECORDS DATABASE One thing that distinguishes Kendall County Abstract Company from most title companies is its “plant,” that is, the database of Kendall County public records. The Texas Department of Insurance requires a title or abstract company to have a plant that goes back 25 years from the date of its application. Companies with records going back 25 years have what’s called a “Thin Plant.” The Kendall County Abstract Company, founded 100 years ago, has what’s called a “Sovereign Plant.” Its records database goes back to 1856 when Kendall County was continued on page 10

Lang notes that this vast wealth of records proves its worth when dealing with rural property transactions. “We sometimes deal with issues on properties that have been owned by families over several generations and that go back to the turn of the century or earlier. Our records enable us to go back to when those families acquired the property and resolve those issues. “Title companies with a Thin Plant can’t go back that far. In fact, most title companies have no plant in their actual office and are really just closing offices. Their plant is in some other location. That’s one advantage we have over most title companies,” he says. and you have to get title insurance from one company and then have your closing performed at another. You get to pay twice! The model adopted by the Texas Department of Insurance (TDI) since the 1870s has been that title agents are required to handle the money as well. This role used to be fairly simple. The buyer brought in a Cashier’s Check and everyone was paid from those funds. “Thanks to our advances in electronics and the popular use of electronic media for money movement and communications, title companies now have to be much more diligent in the handling of their customers’ funds. within your business, you will have to include a small amount of income in your W-2, based on the value of the lease. Both options allow taxpayers to expense all costs of maintaining the vehicle: repairs, insurance, gas, etc.

DETERMINING THE DEDUCTION: Standard or Actual Expenses

You can generally calculate the amount of your deductible car expense by using one of two methods: the standard mileage rate method or the actual expense method. If you qualify to use both methods, you may want to figure your deduction both ways to see which one gives you a larger deduction. Keep in mind the cost of commuting is not deductible nor is it included in the calculation of business miles. The standard mileage rate method uses a simple formula of business miles multiplied by the standard rate to arrive at the deduction. All of the costs associated with owning and operating the vehicle are factored into the rate. The standard mileage rate was 57.5 cents per mile for 2015 and 54 cents per mile for 2016. To use the actual expense method, you must determine what it actually costs to operate the car, including gas, oil, repairs, tires, insurance, registration fees, licenses, and depreciation (or lease payments) attributable to the portion of the business miles driven.

DEPRECIATION

The largest actual expense of a purchased vehicle is depreciation. The calculation is complex and riddled with limitations, but your tax advisor can help you navigate the labyrinth. Depreciation is generally an allocation of the costs over a prescribed number of years. Most vehicles will be depreciated over five years according to current IRS guidelines. Although some vehicles may qualify for additional expensing in the first year of purchase, some up to 100% of the cost of the vehicle! Depreciation limitations are categorized into five categories – passenger vehicles, light trucks, heavy trucks, qualified nonpersonal use vehicles, and SUVs. Regardless of how much your passenger vehicle or light truck costs, the maximum expense is $11,460 for 2015. Heavy trucks and qualified non-personal use vehicles are not subject to depreciation limitations but must meet specific criteria (based on weight, length of truck bed, attachments, and other factors) to qualify. The maximum 2015 expense for an SUV is $25,000 in the first year. With the $25,000 limit, it is entirely possible to expense an SUV in the first year of purchase. The business use percentages will apply to the total depreciation deduction. The first step in determining how to treat your vehicle purchase is to estimate how much you will use your vehicle in your business. After that, the questions regarding whether it should be a personal or company vehicle, whether it should be purchased or leased and how to determine your deduction should be discussed with your tax advisor. LeArning FoundAtions of Boerne Helps Children with LeArning ChAllenges And Other Needs

Since it was founded in 1969 by Fran Tarkenton, former NFL quarterback for the Minnesota Vikings, Learning Foundations has thousands of wonderful, heartwarming stories of helping children successfully overcome dyslexia, ADHD and other learning or attention challenges. One such story involves a 9-year-old adopted boy named Nathan.* When Nathan was in third grade he struggled with math. Concerned, his parents sought help from Learning Foundations in Boerne. Their Director of Assessment evaluated Nathan and discovered his difficulty with math wasn’t simply a learning issue. There were underlying problems due to the boy’s lack of cognitive and neural development. As part of the initial consultation process, the parents mentioned that they had adopted Nathan from Russia. Like many adopted children, he hadn’t received much stimulus early on in the orphanage. The lack of stimulus stunted his full development, leading to behavioral and coordination challenges. For instance, if another child confronted him in any way, he either broke down or resorted to punching the child. At home, he often wet the bed. To enable him to gain control of his behavior and emotions, Learning Foundations trainers worked with Nathan one-on-one using music therapy and a customized cognitive training program that focused on body control, body and behavioral awareness, and mindfulness.

Five months after starting the program, his mother reported Nathan no longer had behavioral problems at school and no longer wet the bed. She reported that he had gone to camp the previous summer, but they often received calls from the camp saying Nathan was either fighting or suffering meltdowns. The next summer, however, his behavior was exemplary. Meanwhile, his grades and motivation in school improved considerably. He was no longer having difficulty with math. Rafael Scarnati, Executive Director of Learning Foundations of San Antonio and Boerne, says that when parents seek help for a specific academic problem, they often find other underlying issues that actually cause the problem. These issues usually deal more with the child’s cognitive and neural development, as opposed to a lack of intelligence or just being lazy.

Boerne LocAtion

Prior to April 2015, families had to travel to Learning Foundations in San Antonio. To accommodate the large number of students coming from Boerne, Scarnati opened a Center last April at 215 West Bandera Road in Boerne. When parents bring their child to the Boerne facility, Center Director Ruth Heller begins with a

free consultation. She’ll assess the parents’ concerns about the child so that she understands what needs to be evaluated. “From there, Ruth will recommend an initial evaluation for the student. This can be anything from a dyslexia evaluation, where we try to determine if a student’s reading and spelling challenges are actually caused by dyslexia, to a more general test of cognitive skills, such as memory, attention, logic and reasoning, and other processing skills,” Scarnati says. “We also host a free, no-obligation parent seminar on Monday nights at our San Antonio location (2817 Thousand Oaks). It starts at 6:30 p.m. and runs to about 8 p.m.” After a short presentation, parents can ask questions and are given an opportunity to schedule an evaluation. “After the evaluation, we look at the test results and compare that to the parents’ objectives for their child. We use that information to customize a specific training protocol for the child,” Scarnati adds. All training by Learning Foundations is individualized to the child and includes oneon-one training. The amount of time a child spends at the Center (anywhere from four months to two or three years) and the kinds of exercises the student does depends on what the child needs. No matter what specific exercises they are working on, it is always delivered in a fun and friendly environment designed to make the child feel successful. The Boerne facility is open year-round

for families and throughout the day to accommodate both home-schooled students as well as students who attend local schools. Summer programs are also available.

Music TherApy ProgrAm

One of the new programs Learning Foundation now offers is music therapy called The Listening Program. “This is a specialized selection of classical music and nature sounds that are recorded and digitally enhanced to heighten certain frequencies of sound that will stimulate the brain to either gain more focus or to relax and sleep better, or decrease general anxiety,” notes Scarnati. “A lot of times we’ll pair up music therapy with one of our different programs. It accelerates the progress realized with our regular programs.” Children listen to the musical selections at home with specialized headphones. The music selections are tailored to each child’s needs. “We put together a musical selection that allows students to be calmer, sleep better, be more focused, or increase their language ability. This is something that’s widely used here in the U.S. and in other countries,” Scarnati adds.

The Real Estate Center’s latest Monthly Review of the Texas Economy shows Texas gained 176,600 nonagricultural jobs from July 2015 to July 2016, an annual growth rate of 1.5 percent. That's lower than the nation’s growth rate of 1.7 percent, according to the report written by Center Research Economist Dr. Ali Anari. The nongovernment sector added 136,100 jobs in July, an annual growth rate of 1.4 percent compared with 1.9 percent for the nation’s private sector. Texas’ seasonally adjusted unemployment rate last month was 4.6 percent, up from 4.4 percent in July 2015. The nation’s rate decreased from 5.3 to 4.9 percent. All Texas industries except mining and logging, manufacturing, information, and the transportation, warehousing, and utilities industries had more jobs. Leisure and hospitality ranked first in job creation followed by education and health services, financial activities, trade, and the government sector. All Texas metro areas except Odessa, Midland, Texarkana, and Wichita Falls had more jobs. College Station-Bryan ranked first in job creation followed by Austin-Round Rock, Dallas-Plano-Irving, Laredo, El Paso, and Brownsville-Harlingen. The state’s actual unemployment rate was 5.1 percent. Amarillo and Austin-Round Rock had the lowest unemployment rate, followed by DallasPlano-Irving, Lubbock, College Station-Bryan, San Antonio-New Braunfels, and Sherman-Denison. Pinched nerves are no joke. I have heard the pain being described as tingling to feeling an achy burn running along the nerve. However, simply having these symptoms does not mean that you have this condition. It is important to distinguish what’s happening as to avoid serious damage to the delicate nerves and tissue that surrounds them. HOW ARE NERVES “PINCHED”? Typical Offenders Nerves can be pinched or compressed a number of ways. Impingement from bone spurs, rigid tendons and overactive muscles can push the nerve on the vertebra. These can take time to develop and are not the most common way nerves are compressed. Disc herniations take the cake when it comes to the cause of a pinched nerve. It is estimated that 60% of people walking around have some sort of disc bulge and don’t even know it! Chemical Burns Tearing of the disc can create an inflammatory response. Your body’s immune system sends cells to quickly clean up the bad tissue and put in the good cells. This chemical warfare is the body’s way of healing. Unfortunately, these reactions can create lots of pressure in the area and damage the nerves in the process. Delicate Nerve Tissue Fat surrounds the nerve to insulate the electrical impulses from the brain. These guys are extremely sensitive to tension and compression, even the weight of a dime can cause nerve obstruction. Since brain and spinal cord or so sensitive, they are encased in bone to protect them. Being surrounded by bone that is structurally stressed can create bone spurs or cause bones to shift out of their typical alignment. Disc Anatomy Since most people walking around have some sort of disc bulge, they only become problematic when the disc tears and the gel leaks out. This is the traditional way pinched nerves come about.

WHEN SHOULD I BE CONCERNED? Nerves are extremely sensitive; the weight of a dime can obstruct electrical and chemical functions of the nerve. Numbness, tingling and muscle weakness could be a sign that things are severe and require immediate attention. Depending on the individual, it could require at least a surgical consultation if there is muscle weakness or loss of bowel/bladder function. Addressing Pinched Nerves Thankfully, compressed nerves can respond very well to conservative treatment. Physical therapy, steroid shots and decompression modalities can all help alleviate symptoms. Another important aspect of dealing with pinched nerves is to address the underlying structural issues. Normal Structure One of the functions of our spine is to evenly disperse the constant forces that bombard us every second. Even small shifts in the spine can create an unbalanced frame, which can lead to many Secondary Conditions. Spinal discs are 90% water, so restoring the spine to it’s natural form can help the disc material be dispersed more evenly which can reduce bulging and compression on nerves. A simple way of looking at this is biting an ice cream sandwich on a hot Texas day. The ice cream bulges out the backside due to the wedging pressure on the other end. Are We at the Beginning of a Bull Market?

While stocks certainly aren’t cheap (at least U.S. stocks), the market continues to push higher. And yet, everyone we talk to thinks the market is destined to drop, especially around the election. We recently put our thinking caps on to remember another time that was similar in terms of the stock market and sentiment. The Great Depression caused ripples and reverberations for decades after it ended, both economically and psychologically, for good reason. It caused generations of people to avoid stocks for the rest of their lives. Yet, the stock market eventually recovered. But, the fear of “what if it happens again” or better yet “it’s only a matter of time before it hap-

by Karl Eggerss pens again” continued. Thus, as the stock market climbed in the years following the Great Depression, it did so with great skepticism on the part of investors. In the investing world and perhaps life in general, the most recent events in our life are the most prominent. Taking a long-term view of the market is hard to do especially when your lifestyle and your savings are at risk. In March 2000, everyone was getting wealthy by purchasing all types of stocks, especially internet stocks. That month, the market peaked and the subsequent drop of over 50% for various stock indices devastated many families. Just a few years later, it happened again when the Great Recession pulled down major stock indices another 50%+. Two bear markets of over 50% in just a few years has caused some permanent psychological damage on the part of investors. Combine that with interest rates near 0% and it’s been a challenging time for risk averse folks. The stock market has recovered, just as it did in the years following the Great Depression. And yet, it’s once again doing so based on great skepticism. The Great Sir John Templeton once said “Bull markets are born on pessimism, grow on skepticism, mature on optimism, and die on euphoria.” If you were to truly ask yourself

how to describe today’s market, would you call it optimistic? Euphoric? I would say it’s in between pessimism and at the very least, skepticism. While the volatility index (VIX) is low, sentiment surveys and my conversations with dozens of people every week suggest a concern about the markets, which means there are many that don’t believe in the rally and furthermore, have a lot of cash on the sidelines or invested outside of the stock market. That’s bullish for the market and potentially higher prices could be yet to come The chart below shows prices of the S&P 500 from 1949-1956 compared to prices of the S&P 500 from May 2011-present. Earlier this year, the S&P 500 fell below its 200-day moving average, which caused long-term investors to get concerned about the potential for a bear market. The drop in early 2016 looked as if the market was slowly rolling over. This was a very similar pattern to the one experienced in 19521953. In fact, interest rates during that time were even lower than they are today. In 1953, the feeling was “here we go again” and “I'm not losing money this time.” But, the market didn’t go back down. Instead, it doubled over the next 3 years. While we’re not predicting the Dow Jones to go over 37,000 in the next 3 years, we are pointing out a time when rates were low, a crash was still in the memory banks of investors and the market appeared to be rolling over into a bear market. But, the market did what many didn’t think was possible. If you are already diversified and have a reasonable allocation to the stock market, we are not suggesting to mortgage the house to buy stocks. But, this is food for thought for those who remain skeptical and under-allocated to the stock market. The stock market has a history of being cruel to both those who fall in love with it and those who hate it. We are always a proponent of using multiple strategies to provide investors with income, downside protection, non-correlation, and growth through stocks.
