Strand residents have raised concerns about the old police station in Wesley Street, alleging that vagrants live in the building and are involved in criminal activities.

The old police station in Strand, which has stood empty for almost seven years, is dilapidated and neglected.

Strand residents have raised concerns about the old police station in Wesley Street, claiming that it is inhabited by vagrants on a regular basis. Substance abuse and other illegal behaviour are also linked to these vagrants. However, Getruida Hendricks, manager at the Oasis Assessment Centre for Homeless People, says they have field workers in the area who can confirm that no-one is currently living in the building, and that the “illegal behaviour” can instead be linked to prostitution in the area, which the field workers have witnessed. According to Ward 83 councillor Dave Venter, the old police station was allocated to a

beneficiary in a land claim. “Several years ago we were informed by the Department of Public Works that the land claim was successful and that the property would be transferred into the name of the beneficiary. To date and to my knowledge this process was never completed.” Thami Mchunu, director of media relations for the Department of Public Works, responded that the department is not familiar with the beneficiaries of any regional land claims, as this information is kept by the Regional Land Claims Commissioner, under the Department of Rural Development and Land Reform. “As this Department is not dealing directly with the transfer of the property, we are unable to give information on when the transfer will be complete. We can, however, divulge that this property must go through a process of alienation by the State to the claimant, which includes several lengthy and tedious steps such

as having the application approved by the State Land Disposal Committee for disposal as well as following the matter through the State Attorney’s Office for transfer.” Venter says that in an effort to resolve the matter, he has requested the City of Cape Town to declare the old police station an unsafe building. They have also begun the process of declaring an intergovernmental dispute regarding this matter. He also claims the Department of Public Works has done nothing to secure the house, but according to the Mchunu, the department has appointed 24-hour security. Hendricks confirms this, saying that her field workers are aware of two security guards that patrol the premises and do not allow anyone to sleep inside the building. Wayne Stammer, manager of the Somerset West shelter, says that there are few options for vagrants in the Helderberg. “We’re the only

night shelter in the area, and there is nowhere else to go. We only have room for 54 people, and we’re completely full. We have a waiting list of people.” Hendricks says there are over 50 homeless people in Strand alone, with more than 100 others throughout the Helderberg. This does not include those staying at the night shelter. She personally would love to take over the old police station, as the current centre only has room for seven or eight people at a time. And there would be no increase in crime, as the centre runs on strict rules and regulations. “Most of the homeless people here aren’t criminals; they’re just down on their luck,” Stammer says. Strand police spokesperson, Constable Mbulelo Mafuna, says no reports of crime have emanated from the old police station in the last year.

FIELA’S OFF TO INDIA: Sir Lowry’s Pass resident Fiela Opperman, who is travelling to India for a children’s outreach programme made possible by the Helderberg Church, would like to thank the many people who have helped her raise funds for the trip. “Last year I held a high tea, and all the ladies in the community came and helped me to raise funds. I really want to thank them. Sy dansdrome word waar Macassar se Kirvan Fortuin (21) het einde verlede jaar sy graad as ’n dansonderwyser aan die Universiteit van Kaapstad se School of Dance ontvang. Kirvan is sedert 2002 ’n lid van die Cape Whalers Field Band, toe hy in gr. 6 by Macassar Primêre Skool was. Sonder enige formele dansopleiding het hy hom in 2010 by die School of Dance aangesluit. Kirvan se studies en verblyf is

deur die Field Band Foundation (FBF) geborg. Belinda Jackson van FBF sê: “Die FBF is uitermate trots op dié prestasie en op een van hulle mees getroue lede.” Kirvan beoog om van Augustus af sy dansstudies voort te sit aan die Codarts University of the Arts in Rotterdam, Nederland. Hy is tans op toer deur dié land saam met ’n bekende dansgeselskap, Express Dance Company.

Three years in prison for R100 bribe NICOLE MCCAIN A 39-year-old Ethiopian was sentenced to three years imprisonment after he was found guilty of attempting to bribe a Lwandle police officer with R100. Ethiopian national Abey Dalkso, who lives in Lwandle, was stopped at a roadblock on Hlathi Drive in Asanda Village on 11 October 2011. He was asked for his licence by a police officer and when unable to produce it, was issued a fine, says Lwandle police spokesperson, Constable Mthokozisi Gama. Dalkso offered the police officer R100 in an attempt to avoid the fine. The officer arrested him, and Dalkso was charged with bribing a police officer. After a number of appearances in the Strand Magistrate’s Court, he was sentenced to imprisonment on 6 February.

Percival Wagenstroom, deputy director for the Somerset West cluster of the Department of Justice, said upon enquiry that sentencing of common law bribery is at the discretion of the magistrate. If the bribery is criminal, the sentence is applied according to the Magistrates Court Act. The magistrate will often look at the interests of the community, personal circumstances of the accused and nature and gravity of the offence. Sonja Labuschagne of Ettiene Barnard Attorneys in Somerset West says, “In terms of the Prevention and Combating of Corrupt Activities Act 12 of 2004 the penalties for bribery to be imposed by a regional court, is a fine or imprisonment for a period not exceeding 18 years or, in the case of a sentence to be imposed by a magistrate’s court, a fine or imprisonment for a period not exceeding five years.” She says that the Act also allows for a fine

to be issued, to the value of five times the amount used during the bribery. The clerk of the court confirmed that in this case there was no option of a fine or suspended sentence. Labuschagne says that, personally, she knows of only one other case in which the suspect was convicted of bribery after offering a bribe of R1 000. “The accused pleaded guilty andwassentencedtoafineofR5 000plusthree years’ imprisonment suspended for five years. The R1 000 bribe was also forfeited to the state.”

Back with his family A man who had been living on the street was reunited with his family at the Oasis Assessment Centre for Homeless People in Gordon’s Bay on Thursday (21 February). Leonard Esua was living on the street in Somerset West, says Gertruida Hendricks, manager at the centre, and was admitted to Helderberg Hospital three months ago with serious injuries. The hospital was unable to track down any of his relatives, and referred Esua to Oasis af-

ter his treatment. There he received additional care. “Leonard came to Oasis unable to say a word, and improved as the weeks went by,” says Hendricks. “One of the field workers recognised him and we started searching the Internet and calling to find his family. A day later his wife came to collect him here at the assessment centre. He is now reunited with his family, safe and sound.” Esua has returned to Mitchells Plain to his family.

Should guns be privately owned? NICOLE MCCAIN After the shooting of model Reeva Steenkamp in the Pretoria home of her boyfriend, Oscar Pistorius, the Gazette asked readers if they felt guns should be kept in South African residences.

“Sometimes it is a good idea to keep a gun, in case someone tries to break into your house,” says Leeroy Marthinus of Macassar. “But you should keep it in a safe place that only you know about to prevent any accidents.”

Strand’s Simukai Homera says that while it is a good idea to keep a gun in your home for self-defence, appropriate safety measures must be taken.“You must make sure your gun doesn’t fall into the wrong hands, and it must always be kept in a safe place. You must also know how to use the firearm as well as safety precautions like the golden rule of using a gun: When in doubt, do not fire.”

Strand se Leonie Kellerman sê sy dink mense moet ’n vuurwapen in hul huis hou. “Dis vir jou eie veiligheid. Deesdae is jy nêrens veilig nie. Jy kan die vuurwapen dalk in ’n kluis sit om meer veilig te wees, maar dalk word die kluis gesteel.”

Cindy Malan, of Strand, says that the home is no place for a gun. “It’s not safe. If someone is going to break in, you can’t prevent it. And they could even use your gun against you. Guns shouldn’t be in the home. It’s just too late to shoot first and ask questions later.”

WORKSHOP AGAINST VIOLENCE: In an attempt to target gang violence amongst the youth, the Lwandle police organised a workshop with pupils of Simanyene High School. Representatives of the police, Rape Crisis, Patch, the Department of Social Development and other organisations addressed the pupils. Building on another’s plot With the high cost of purchasing or renting a house, many people are now turning to building granny flats or other structures on the properties of members of their family. The Legal Aid Board provides some advice on setting up hassle-free agreements. Arrangements are mostly in place to deal with payments in respect of water and electricity charges. These arrangements usually work well as long as the relationship between the parties is amicable. The problems arise when the parties have arguments or when the original owners of the property pass away. It is for this reason that, before building commences on the property of another, all parties involved must be aware of the legal implications of their actions. Erecting a building on the land of another, even with the owner’s consent, has the effect that the building becomes one with the land. Thus the owner of the land owns the building too. But what happens to the money invested in erecting the building? The erection of a granny flat or other structure usually has the effect of improving the land and increasing the value of the property. This means the owner of the land can now sell the property at a higher price than previously. Generally speaking, the person who

erected a building on the land of another with such other person’s consent is entitled to claim either the actual amount spent on the building or the amount by which the value of the landowner’s property has been enhanced. To avoid problems at a later stage, the landowner may register the right of use of the person who erected the dwelling. This registration takes place at the Registrar of Deeds. This means that the occupier is protected in his use of the building in the event of the landlord selling the property or in the event of another person inheriting the property. Bear in mind, though, that this right of use extends only to the occupier during his or her lifetime. When the occupier dies, he may not bequeath this right to a third party. This is an important consideration since it could leave his children and/or spouse without accommodation. It is therefore necessary to seek legal advice from an attorney when buildings are to be erected on the land of another. City of Light vier 1 jaar Die City of Light Projek, ’n niewinsgewende gemeenskapsgedrewe projek, het op 12 Februarie hul eerste verjaarsdag gevier. By hierdie geleentheid het lede van die projek meer as 500 geskenkpakkies en vrugtepakkies aan kinders oorhandig in Beverley Hills, Dark City, Erijaville en Morkel Cottage. Die vieringe het gepaard gegaan met die projek se Kinders in Plek-program wat streef daarna om kinders vaardighede te leer om hulself te beskerm, te handhaaf en hul potensiaal te help ontwikkel. Andrew Arnolds, leier van die projek, sê kinders het gedans op Jesus-liedjies. “Dit was wonderlik om te sien dat kinders hul geniet en dans, huppel en saamsing. “Die verjaardagliedjie is deur kinders van Morkel Cottage en Erijaville gesing, tot groot vermaak van die gemeenskap,” vertel Arnolds.

Die geleentheid is ook gebruik om die gemeenskappe toe te spreek oor probleme wat kinders raak. “Daar is grootliks klem gelê op die beveiliging van ons kinders en die gemeenskap is bewus gemaak om ’n meer veilige hawe vir ons kinders te skep. Straat-tuin bewaarheid droom NICOLE MCCAIN ’n Vrou van Macassar het twee weke gelede die droom wat sy en haar man al jare lank koester bewaarheid. Maar ongelukkig eers ná sy dood. Elizabeth Pieterse het ’n tuin langs haar huis, en voor die Good Hope-crèche in Kabeljoustraat waar die hele gemeenskap dit kan sien, aangeplant. “Ons het lankal gesê ons wou ’n tuin maak,” sê 76-jarige Elizabeth van haar en haar man, Karel Pieterse, se gesamentlike visie vir iets wat hulle met die gemeenskap kon deel. Karel het vir 16 jaar vir die parke-departement van die Kaapse munisipaliteit gewerk en het ’n diepgewortelde liefde vir plante gehad. “Hy het elke jaar vir my rose op Valentynsdag gebring,” sê Elizabeth, wat in 1966 met haar man getrou het. Zandvliet celebration It’s time to dust off your running shoes and celebrate Zandvliet Secondary School’s 25 birthday. Kleuters bring Valentynsvreugde na Sencit Resthaven Inwoners van die Sencit Resthaven-tehuis in die Strand is op Valentynsdag bederf. Die inwoners is besoek deur die leerlinge van die St John’s-kleuterskool en Cinnamon Square Spar se personeel, wat seker gemaak het dit was ’n spesiale dag vir almal. Spar het pragtige kolwyntjies en oliebolle gemaak vir die geleentheid, en die Spar se personeel het ook opgetree en Bybelverse voorgelees. Die St John’s-leerlinge het met hul oulike sang die Sencit-inwoners vermaak.

The Vergezicht pupils held a competition on Friday (15 February) to create decorative cupcakes, but each entrant had to create two – one for themselves, and one for Heidi Naude of Halli Trust to deliver to less fortunate children at Emfundisweni.

Heroes honoured Over 20 organisations and individuals were acknowledged by the City of Cape Town for their contribution to the community on Thursday (21 February) with Civic Awards. Subcouncil 08 chairman, Stuart Pringle, said, “Today we honour men, women, and organisations who represent the very finest of the community. People who voluntarily give of themselves to serve the people. These are the real heroes in our community. We recognise them today and we honour them with the awarding of Civic Award certificates.” Civic Honours have been awarded annually for over 50

years and are conferred to acknowledge individuals, organisations and military units that have distinguished themselves through extraordinary acts of service or outstanding contributions to their community and the city. Awards were given to The Nomzamo Community Trust, the Red Cross Ladies, the Somerset West Community Policing Forum, Helderberg Crime Watch, The University of the Third Age, Helderberg Hospice, Friends of the Helderberg Nature Reserve and the South African National Civic Organisation (Sanco). Various individuals were also honoured.

Tips for teens on how to stay safe . . . wherever they are

South African teenagers are not unlike their peers anywhere else in the world – their lives revolve around their family, school and social life.

Streetwise teens know that they do not have to leave home for their safety to be at risk. Even the relative comfort of their social circle can bring them face to face with situations where their judgement can be severely tested. “Many of these tips come from teenagers who know that staying safe can be easy and will empower them to take control of situations that could be challenging,” says Rob Dale, managing director of ADT Security Western Cape. Social media and the Internet can be deceiving Online interaction has made communication fast, fun and easy but it also provides cover for predatory individuals on the look-out for naïve teenagers. ) Never include personal information in social media forums, blogs or websites. ) Online friends are better kept online. Socialise safely when you’re out on the town It is easy to lose track of time when socialising with friends, but the following common sense tips will ensure you have a good time and get home safely. ) Go out in a group and stay in your group. Do not go elsewhere with strangers you meet. ) Tell your parents where you will be and keep to an agreed curfew for coming home. ) Don’t accept drinks from strangers and stay sober. ) Make sure that you have a safe ride home with a designated driver at the end of the evening. ) Keep your cellphone on at all times and call home if you find yourself in an uncomfortable situation. Staying safe while home alone ) Know how your home’s alarm system works and memorise passcodes. ) If your parents are away overnight, have the number of a neighbour or relative on hand in case of an emergency. ) Never leave younger siblings home alone, even for a short time. ) Always remember to set the alarm if you are the last one to leave home.

) If you are home alone and the alarm is disarmed, make sure that security gates and outside doors are locked. “Most of these tips only require a bit of common sense and won’t curb your sense of freedom or personal style,” says Vian de Bod, a 15-year-old from Cape Town. Hocker fun at Rusthof NICOLE MCCAIN Very few people may have heard of a sport called hocker, not to be confused with hockey, but at the Rusthof school for pupils with special educational needs, the sport is a popular way to help children with physical disabilities hone their motor skills. The game is played primarily by children with cerebral palsy, says occupational therapist at the school, Elmarie Smythe. The court is arranged with 16 circles and two goals. Eight players from each team stand in each of the circles and a goalkeeper guards the goal. The aim is, without leaving the circle, to pass the ball to the shooter who will attempt to score. The ball is passed using sticks resembling croquet clubs, and no hands feet or legs are allowed to touch the ball, explains coach Lorraine Adolph. “The game is very popular at schools for children with special needs,” says Smythe. “The schools compete against each other during the winter season, playing matches every week.” The sport is a great way for children with physical disabilities to develop. “It gives them exercise and many of the children don’t get a chance to participate in other sports. Hocker teaches them competitiveness and allows them to socialise with their team mates and

It builds self esteem and develops balance, coordination and muscle strength.” The Rusthof school doesn’t have enough children with cerebral palsy to make up a team, but Smythe says the school encourages children with other disabilities, such as Down’s syndrome, to make up the nine-member team. Although the school has been offering hocker as a sport for almost a decade, Smythe says it is still developing as a regional and national sport.

The aim of Hocker is to pass the ball, without leaving the circle, to the shooter, who will attempt to score.
