As we ease into a new year, a wellestablished new normal with vaccines rolling out across the globe, we find ourselves in a unique position on the world stage. Economic indicators are positive, and we are cautiously optimistic as government pandemic incentives flitter away. It is important to continue this positive trajectory so the MTA continue to advocate for automotive businesses through a quagmire of government developments.

The MTAA submitted the industry’s concerns and, although there is industry support for extending warranty coverage, there are concerns over the exclusive dealing conditions with the ACCC remaining on watch.

One such development was the exclusion of Motor Mechanic (General), Motorcycle Mechanic, Diesel Mechanic, Panel Beater, Automotive Electrician, and Motor Vehicle Parts and Accessories Fitter (General) from the Designated Area Migration Agreements (DAMA). Given these trades are still on the National Skills Needs List, and several members are in great need of qualified technicians, the MTA has held a roundtable discussion with the Department for Innovation and Skills to help build a business case to have all automotive trades reinstated in the DAMA.

A significant increase in business email compromise (BEC) scams along with advancements in the way victims are approached has prompted a warning from the Australian Cyber Security Centre. This is an issue experienced across the globe and the FBI in the United States released helpful tips for businesses. It is important to stay vigilant and make your staff aware of this activity so that your business does not fall victim.

Given the rollercoaster that was 2020, this is a great win for our NT members. Another win at the end of 2020 goes to all of our MTA members that are celebrating their 25 and 50 year membership. Our association is only as strong as our members and we are fortunate to have such wonderful longstanding members at the MTA. As one such longstanding member, I am proud of the work we are doing on behalf of the automotive industry and encourage all MTA members to voice your issues and reach out for support from the MTA. We start the new year with an additional pandemic emergency tool kit including flexibility and insight. With this are also several opportunities still available through government funding aimed to revive the economy. We continue to push towards a better future for automotive businesses and are continuing to pursue opportunities that developed in 2020. We have continued to work with the government since the release of the Economic and Finance Committee Report on the Motor Vehicle Insurance and Repair Industry (the Report). With findings that recognise the difficulties faced by collision repairers in the face of insurers, and recommendations for improvements that benefit the industry and public, the inquiry is a first step toward positive change. It is vital to the viability of quality collision repairs and safety of our roads to keep making our voices heard and pave a way to make the recommendations a reality. The MTA continues to make the most of this opportunity to work with the South Australian government and maintain momentum towards positive change within our industry and community. A large topic of conversation for both workers and employers is the IR Reform and changes to casual employment. Definition changes to casual workers may have a

substantial impact on employers with casual employees. Part time employment changes may have a positive impact on your business and may relate to your assessment of casual employees. In addition, greater penalties are proposed for underpayment claims. It is important to be aware of these changes and review your employees’ circumstances in relation to their employment. Contact the MTA if you need support through this process. Additional government support is still available for employers to take on an apprentice. With the reduction of the automotive industry skills shortage a key goal, we have ensured that these incentives are passed on to employers when hosting an MTA apprentice. Now is an opportune time to take on an apprentice and take advantage of the additional benefits of choosing to work with an MTA Group Training Organisation (GTO) apprentice. The MTA’s Registered Training Organisation (RTO) lives and breathes apprentice training. The MTA RTO’s Certificate I in Automotive Vocational Preparation (AUR10116) provides a practical gateway into our industry as part of the automotive pathways program in Bordertown. The MTA works with several schools across the state to support the delivery of quality Certificate I and II programs,

fostering a positive introduction to the automotive trade for the next generation of technicians. The Northern Territory government approached the MTA regarding the delivery of a hybrid electric vehicle program in the Northern Territory. The need for quality training in hybrid electric and battery electric vehicles as more vehicles enter the market is evident. With a well-established training program through the MTA RTO in South Australia which is attended by technicians across the country, we are in negotiations with the Northern Territory government on how this might be delivered in the Northern Territory. This is a positive development given that electric vehicle training was a need highlighted in the MTA’s submission to the Northern Territory government in the lead up to the 2020-21 Budget. Another MTA submission request with a positive outcome revealed in the NT 2020-21 budget was the allocation of funds towards apprenticeships and traineeships. There are several other requests within the pre-budget submission to government that the MTA will continue to advocate for on behalf of the automotive industry. GH GARAGE New MTA member GH Garage was formed in one of the most difficult business years in living memory – 2020 – yet it has gone from strength to strength. The Prospect-based dealership specialises in secondhand premium brands – such as Porsche, Lamborghini, Mercedes, Lotus, BMW and Jaguar – which range in price from $30,000 to $650,000. Two points of difference are the company’s marketing on Chinese social platform WeChat and the use of both English and Mandarin on its website. The company also maintains a strong presence on Facebook, Instagram and Carsales. GH Garage is owned by Charles Deluca and his business partner Dyson Song - an accountant and avid sportscar race driver who can be seen racing his Radical at the Bend. GH Garage employs 10 people at its Main North Road showroom.

CONTINUING THE FIGHT AGAINST DISAPPOINTING DAMA DECISION The MTA is continuing to fight against the exclusion of six motor trade occupations from South Australia’s two Designated Area Migration Agreements (DAMAs). The Federal Government introduced DAMAs to try to encourage migration into regional areas, which captures the entirety of South Australia including Adelaide, where there are serious skills shortages. The loss of Motor Mechanic (General), Motorcycle Mechanic, Diesel Mechanic, Panel Beater, Automotive Electrician, and Motor Vehicle Parts and Accessories Fitter (General) classifications is difficult to understand, as they are still on the National Skills Needs List. “We constantly hear that it is very hard for members to attract and maintain good quality skilled technicians,” said Kaes Cillessen, the MTA’s Industry and Government Engagement Manager. “Motor mechanics, diesel motor mechanics and panel beaters form a large proportion of the industry, so it is a big deal.” “We have been lobbying the government to have this decision changed at the next review in April 2021.” Kaes sits on South Australia’s Migration Advisory Council and has used the forum to voice the MTA’s disappointment “and the fact that members feel very let down”. “Many members have been advertising for skilled staff for so long without success that they have just given up,” he said. “In the past, skilled migration satisfied this need. “The MTA has a balanced view on the matter because we wear two hats. On one hand, we are a major employer of a local workforce, and we recognise the value of employing locals. But highly technical commercially specialised

workers are needed and demand is outstripping supply.” When the two DAMAs were first announced in 2019, Minister for Innovation and Skills, David Pisoni, said they would breathe new life into SA, particularly in the regions, by enabling employers to grow their businesses by finding the skilled workers they need. “Whilst Skilling South Australia will equip local workers with the skills they need for the jobs of the future, in the short-term certain sectors and regions of the state are experiencing skills shortages which are holding back economic growth, exports and employment,” he said at the time. “The DAMAs are designed to address these existing skills shortages.”

Kincraig Motors 

THE PALLANT FAMILY’S AUTOMOTIVE LEGACY

Kincraig Motors has been a long and highly successful family affair in the South East of South Australia.

He became general manager in 1971 and took ownership of the company in 1974.

Reg Pallant, currently at the helm, inherited the business from his father Bert, who was well known as ‘The Chief.’

In the days when Bert led the company it was an agent for Ford and then Holden when the brand was first introduced in Australia in the late 1940s. At this point Kincraig became one of two Holden dealers in Naracoorte.

Bert became a mechanic in the early 1920s when the reliability of vehicles was “questionable”. In 1924 he joined what was then the Kincraig Motor Garage, working for joint owners Frank Holmes and Malcom Beaton. In 1932, the Pallant family purchased the business, beginning what is now an automotive legacy.

Reg said Naracoorte, a rural town of approximately 4,000 people, was too small for two Holden dealers. So the company had to get creative with its services. “We sold and rented farm equipment and motorcycles,” he said. It was only after the other Holden dealer closed its doors that Kincraig Motors refocused on cars, specifically selling and renting Holden vehicles. Fast forward to 2017 and many people were saddened when it was announced Holden cars would no longer be manufactured in Australia. On 17 February 2021, General Motors confirmed the retirement of the Holden brand after 72 years. “I’ve always been in cars, of course,” said Reg. “It came as a shock.

Much like his father, Reg started at Kincraig Motors as an apprentice motor mechanic at the tender age of 15.

Motors offers. The company has the RAA contract for Naracoorte, shifts shipping containers and has moved into the trucking space, which is a focus for Bruce. “We disposed of our used cars and put shipping containers where the cars were,” said Reg. “We sell shipping containers to customers all over the South East and western Victoria.” As for the Motor Trade Association? Reg calls it, “a leading light in knowledge”. “When I need to know something, I look to the MTA as being the provider of that knowledge,” he said. Reg said he wasn’t prepared to walk away, and accessed his superannuation to keep the company afloat.

“You need some sort of organisation above you, and the MTA has been very supportive.”

This can-do attitude boded well for the predicament that would befall many businesses when the COVID-19 pandemic struck. Whilst Reg noted that COVID-19 did not reach Naracoorte, the closure of the nearby Victorian border meant Kincraig Motors’ Victorian customer base could no longer access the company’s services. This resulted in a loss of business of almost 40%.

As of 2021, Kincraig Motors will have been around for over a century and it doesn’t sound like the Pallant family will bequeath the custodianship anytime soon.

Reg and his son Bruce, who also joined Kincraig Motors at a young age, continued to persevere against the odds, with the reopening of the border bringing some respite. Car servicing is now just one of the many services Kincraig

FRANK AGOSTINO - THE CONSUMMATE BUSINESSMAN MTA President Frank Agostino is regarded as one of South Australia’s most successful businessmen. As the Managing Director of the Agostino Group, he presides over a range of businesses including automotive/convenience, food and boutique agricultural production. The Agostino Group had its beginnings when Frank bought into a Chrysler franchise in Elizabeth. This grew to encompass one Hyundai and four Mitsubishi dealerships, becoming the largest and most successful Mitsubishi dealership group in South Australia. He remained a new car dealer for 29

years and contributed to the industry as President - Chrysler Services Motor Group, Chairman - Mitsubishi National Dealer Council and was President of the Mitsubishi Triple Diamond Marketing Group. Today the Agostino Group comprises: • A MPM petrol retailer with associated convenience stores and car wash operations located throughout metropolitan and regional SA • S ubway made-to-order sandwiches outlets • C arl’s Jr restaurants in South Australia and the Northern Territory as franchise owner • P endleton Estate – award-winning olives, olive oil and a range of other products. Frank Agostino served the automotive industry with distinction as MTA president from 2005 to 2008 and has again held this position, now

named Chairman, since 2014. Some of his recent contributions have been to oversee the Association’s change of governance in 2019/2020, and to lobby on behalf of the sector during the COVID-19 lockdowns. Frank remains well known for his iconic advertising in the 1980s with the catchcry of: “If we don’t give you a fair deal, I’ll shave off my mo”. Less well known is his service to the community, including the Salvation Army, St Hilarion Aged Care, Northern Communities Hospital, Northern Communities Health Foundation, Anglicare, Olive Growers Australia, the Manufacturing Industry Skills Council and Pembroke School. Frank brings unparalleled business acumen and a strong growth focus to everything he turns his hand to, and the automotive industry is indebted for his contribution.

NEVILLE GIBB - 50 YEARS OF EXEMPLARY SERVICE Gibb & Sons has been an MTA member since 1970. MTA Past, President and Dealer Principal at Gibb & Sons Mitsubishi in the Mid North, Neville Gibb began his impressive involvement with the MTA from 1980 in his then father’s business. Shortly after, in 1989, Neville was elected as the Upper North Zone Chair. He was first elected to the MTA Board in 1997 as the Upper North Zone Representative. He became Vice President from July 2008 to July 2011 and served with distinction as President from July 2011 to July 2014. His passion for the automotive industry is of the highest order, giving considerable time and input into the governance and direction of a range of organisations.

From his home town in Jamestown, Neville has also served on the Boards of the MTAA, AMIF and MTAA House during a tumultuous period of renewal and revitalisation. He has made a valuable contribution in these national roles and continues today as Chairman of MTAA. Some of his achievements include: • T he revitalisation of MTAA to reassert itself as the nation’s peak automotive body • C onsiderable achievements in public policy and regulations including advocating changes to franchising, consumer law and competition • O pening the first ever automotive summit, that attracted 147 automotive leaders, key politicians and stakeholders that significantly contributed to the Senate inquiry into the automotive industry. The Gibb Family has been serving the

motoring needs of the people in the Mid North of South Australia since the 1940s. Bert and Helen Gibb started their business in Jamestown in 1970, with sons Daryl, Neville and Ian joining during the 1970s and 1980s. Neville was awarded MTA Life Membership in 2018 and continues to serve on the MTA Board.

INDUSTRY CONCERNS AS 10 YEAR CONDITIONAL WARRANTY APPROVED MITSUBISHI’S “EXCLUSIVE DEALING NOTIFICATION” TO PROCEED Mitsubishi is offering a 10 year or 200,000 km extended warranty. The warranty is conditional on the vehicle being serviced only by authorised Mitsubishi dealers and service centres. The Australian Competition and Consumer Commission (ACCC) noted that Mitsubishi’s standard five-year warranty will still apply and does not limit consumers to any particular service provider. “The ACCC carefully considered a variety of factors in its decision, including a large number of submissions from independent mechanics, aftermarket parts suppliers, members of the public and associations,” ACCC Commissioner Stephen Ridgeway said. “While a number of consumers will no doubt value a longer warranty, we recognise the concerns that the requirement to use Mitsubishi dealers and service centres may have an impact on independent mechanics’ ability to provide competition.” “The ACCC has allowed this notification to stand based on current information. There is no basis at present to conclude that the notified conduct has the purpose, effect or likely effect of substantially lessening competition.” However, importantly the ACCC is able to revoke the notification at a later date if the relevant circumstances and available information change. “We recognise the importance of competition provided by independent mechanics. If, as this warranty arrangement is implemented, the evidence shows that it is materially harming competition, and we consider at that point that the public benefit does not outweigh the public detriment, we are able to move to revoke the notification,” Mr Ridgeway said.

INDUSTRY CONCERNS The MTAA submitted industry concerns on behalf of all State and Territory Motor Trades Associations and Chambers of Commerce. The MTAA submission said the industry “generally supports” Mitsubishi’s extension of warranty coverage but does not support the inclusion of exclusive dealing conditions. It said this was likely to substantially lessen competition and would not result in a public benefit that would outweigh the likely public detriment. MTAA raised concerns about: • a lack of transparency on the terms and conditions of the 10 year offer • restriction of consumer choice • substantial lessening of competition over time The MTAA stated concern of “a lack of transparency and clarity on the terms and conditions for Mitsubishi Dealers on the processes and requirements to ensure fair, reasonable, and equitable reimbursement and/or compensation for warranty service repairs undertaken on behalf of the manufacturer over a longer period.” “MTAA remains concerned about a long-standing issue that forms part of the recognised power imbalance between car manufacturers and their distributors/importers and their dealer networks. “This issue is the failure of some car manufacturers and their distributors/importers to provide fair, reasonable and equitable warranty claim reimbursement or compensation to their dealers in the performance of warranty repairs.”

REPAIR INDUSTRY UPDATE The MTA is continuing to lobby the State Government to accept and act on the recommendations from the Economic and Finance Committee Report on the Motor Vehicle Insurance and Repair Industry (the Report). The Economic and Finance Committee Inquiry investigated the effectiveness of the voluntary MVIRI Motor Vehicle Insurance and Repair Industry Code of Conduct (the Code) for South Australia. Following the Report the MTA (including the Chair and Deputy Chair of the MTA’s Body Repair Specialists Division (BRD), Dario Tonon and Jeff Williams ) has met with the Attorney-General (Hon. Vickie Chapman MP), the Chair of the Economics and Finance committee (Matt Cowdrey MP) and the Commissioner for Consumer and Business Services (Dini Soulio) to establish a way forward for the recommendations to be implemented. We’ve also had several meetings with the Small Business Commissioner, John Chapman to collaborate on how and where it could be made possible in South Australian Legislation. A key recommendation of the Inquiry was to mandate the Code in South Australia. The Code regulates the relationship between repairers and insurers and aims for fairer outcomes for consumers. Another of the recommendations includes binding mediation and penalties for breaches and would ensure that a mandated code would be followed. The only other jurisdiction that has the Code mandated is New South Wales, but there are no penalties for breaches. Introducing penalties for breaches would make South Australia a national leader and would mean that the industry would be accountable to the highest standards in Australia for collision repairs. The Inquiry recognised that the voluntary national Code is not achieving the original goal in South Australia and the MTA is lobbying for the recommendations to be accepted in full. The MTA is working to maintain momentum with the State Government to achieve these goals on behalf of industry and take the opportunity to improve the Code

even further with suggestions on implementing timelines for supplementary repairs, and strong recommendations on the areas of the Code that are challenged most frequently, including changes to repairers’ estimates and authority to repair. It is the MTA’s objective for South Australia to be the leading state for managing issues in the crash repair industry for the benefit not just of repairers, but importantly the motoring public. The establishment of the Inquiry has been a great achievement for the Body Repair Division because of the high level of detail, evidence and information presented during the Inquiry. The committee showed a high level of understanding of the depth of the issues raised by the collision repair industry. Speaking at the time the MTA appeared at the South Australian Economic and Finance Committee public hearing, MTA CEO, Paul Unerkov said: “We asked the Committee to implement policy and to protect fairness and business confidence in South Australia by mandating and tightening the Motor Vehicle Insurance and Repair Industry (MVIRI) Code of Conduct as well as protecting consumers from the possible decline of choice, quality and safety of repairs. “We view this Inquiry as the first major step towards creating a fair and functional relationship between insurers and collision repairers, whilst appropriately protecting consumers.” We look forward to the further opportunities this Inquiry provides not just from the South Australian Inquiry, but as a precedent in future inquiries into the collision repair industry. It is important to continue to report any issues with the Code not being followed, or where the policyholder believes they are not receiving their entitlements, to the MTA so that the MTA can continue to lobby on your behalf.

UNDERSTANDING IMPENDING NEW IR LAWS The Federal Industrial Relations Minister, Christian Porter, has introduced legislation that will have a significant impact on employers when it is passed. In particular, MTA members need to be fully aware of impending industrial relations reforms that govern the employment of casual workers.

casual loading you may pay to an employee can be offset against any leave entitlement. That means if you do get your classification wrong, and assign a person as a casual when they are not, you can offset that casual loading against leave entitlements. That means an employer does not end up making double payments.

DEFINITION CHANGES

Thirdly, the legislation introduces “casual conversion” for every casual. This is where, subject to certain criteria, a casual that has regular and systematic employment for six to 12 months depending on the sector, has a right to convert to a permanent role.

There is now a risk that you could pay the higher rate for casuals, but then be required to pay leave entitlements as well.

On the other hand, there is much more protection for employers who have offered the conversion, and it has been refused, to be clear that the person remains a casual.

While the draft legislation provides greater flexibility and certainty for employers, there are a range of compliance issues that must be understood and double checked.

For the first time, the proposed legislation would introduce a statutory definition of “casual”. This relates to whether or not, when a person was first employed, the offer of employment was made on the basis of no advanced commitment of continuing work, or any great pattern of work. The second impact of the legislation is to ensure that a

PART TIME EMPLOYMENT CHANGES In terms of employing casuals, a stumbling block for many businesses has been part time employment under the Vehicle Repair Services and Retail Award. One of the key stumbling blocks has been where someone is part time and is employed for, say, 20 hours a week. Then for a few weeks, you need them to work 25 hours. Currently,

those, but while they are at the lower end, the legislation imposes higher penalties, even for accidental errors.

The new legislation has introduced the flexibility to allow, by agreement, a part time employee to work additional hours at their normal rate of pay.

However, if it’s dishonest and systemic, criminal penalties will apply.

This overcomes one of the big stumbling blocks for most businesses in putting people on permanent part time, rather than casual. They didn’t have that flexibility for employees to work some extra hours if needed. The MTA believes that is a big change for our members.

COMPLIANCE CHANGES The one other big change that impacts members is related to compliance. There will be far higher penalties for underpayment claims under the new legislation. There are also criminal penalties being introduced for dishonest and systemic wage underpayments, what is colloquially called wage theft. This relates to planned and systemic underpayments, as opposed to an understandable error, which we know can happen and would generally be dealt with simply by rectifying the underpayment. You can still be penalised for

NEXT STEPS FOR EMPLOYERS Presuming the legislation passes more or less in its current format, MTA members should review their current employees in terms of whether they are appropriately classified as permanent full time, permanent part time, or casuals, and whether that could be altered under the changes. They should also assess the casual conversion provision for their employees and make sure it complies. It would also be timely to undertake a payroll audit, either internally or using the MTA. It is critical to ensure that people are correctly classified, and are being paid the correct rate, with the correct penalties, loadings and leave entitlement. AVOIDING BUSINESS EMAIL COMPROMISE SCAMS The Australian Cyber Security Centre is warning of “a significant increase” in the threat level from business email compromise (BEC) scams. Over 4,250 BEC scams were reported in 2019-20, amounting to the theft of over $142 million. “BEC scams occur when a hacker gains access to a business’ email accounts, or ‘spoof’ a business’s email so their emails appear to come from the company,” according to Scamwatch.

“Scammers intercept legitimate invoices and change the details to include fraudulent payment information...” “The hacker then sends emails to customers claiming that the business’s banking details have changed and

that future invoices should be paid to a new account. These emails look legitimate as they come from one of a business’s official email accounts. Payments then start to flow into the hacker’s account. “In other variations of the scam, the hacker will send an email internally to a business’s accounts team, pretending to be the CEO, asking for funds to be urgently transferred to an off-shore account. Hackers can also request salary or rental payments be directed to a new account.”

REAL LIFE EXAMPLES The ABC highlighted a sting  that cost one construction company $51,000, which it thought was paying to a contractor. Criminals use a wide range of techniques in their search for a weak link. While these include email, instant message, SMS and social media tactics, they also employ old fashioned methods to supplement the scam. “Scammers intercept legitimate invoices and change the details to include fraudulent payment information,” ACCC Deputy Chair Mick Keogh said. “Another technique used by scammers is to impersonate

INDUSTRY NEWS the CEO of a company and request staff transfer funds to them for a variety of reasons, such as to purchase gift cards as a surprise for other staff,” said Mr Keough. As an extension of this deception, fake callers to a company’s finance department will sometimes use a recording of a crying baby in the background to add pressure to finance staff who are looking at an email requesting that bank details be changed. The caller cites the fake email (which they sent, because they have hacked the company’s email accounts). They claim to be a harassed personal assistant working from home with a crying baby and urgently need their boss’ bank account details changed so that he can be paid while he is overseas. (The scammers know the boss is overseas because he has posted it on social media.) The finance staffer takes pity on the caller and breaks security rules. The money is then sent to the criminal’s bank account, which they quickly drain of funds and then close. Scamwatch  reports that “billing was the most commonly reported type of scam which includes business email compromise scams”.

SIGNIFICANT INCREASE Head of the Australian Cyber Security Centre, Ms Abigail Bradshaw, said there has been a significant increase in the use of BEC scams by cybercriminals. “This type of fraud has been used to hoodwink many Australians and Australian businesses, out of often very large sums of money,” she said. “This advisory will help you to identify scams, prevent email accounts from being compromised, and prevent damage to your business’s reputation.” The Protecting Against Business Email Compromise publication, and other cyber security information and advice, is available at cyber.gov.au . You can report cybercrime by going to cyber.gov.au  and ReportCyber, providing a single online portal for individuals and businesses on behalf of federal, state and territory law enforcement agencies.

HOW TO PROTECT YOURSELF • T raining staff about correct procedures is a critical defence against scammers. Most cyber hacks and breaches are caused by humans, not technology. • A lways be wary of any change in bank details. Contact the supplier directly using a second, reliable mode of communication such as a known phone number to verify any request to change bank details. • C onsider a multi-person approval process for transactions over a certain dollar threshold with processes in place to ensure the business billing you is the one you normally deal with.

• P revent your IT systems from being compromised. Keep your IT security up-to-date by regularly patching your systems and running antivirus software, and have a good firewall to protect your data.

“This advisory will help you to identify scams, prevent email accounts from being compromised, and prevent damage to your business reputation.” The following tips are provided by the FBI (recognising that these scams are often global operations): • B e careful with what information you share online or on social media. By openly sharing things like pet names, schools you attended, links to family members, and your birthday, you can give a scammer all the information they need to guess your password or answer your security questions. • D on’t click on anything in an unsolicited email or text message asking you to update or verify account information. Look up the company’s phone number on your own (don’t use the one a potential scammer is providing), and call the company to ask if the request is legitimate. • C arefully examine the email address, URL, and spelling used in any correspondence. Scammers use slight differences to trick your eye and gain your trust. • B e careful what you download. Never open an email attachment from someone you don't know, and be wary of email attachments forwarded to you. • S et up two-factor (or multi-factor) authentication on any account that allows it, and never disable it. • V erify payment and purchase requests in person if possible or by calling the person to make sure it is legitimate. You should verify any change in account number or payment procedures with the person making the request. • B e especially wary if the requestor is pressing you to act quickly. A MARRIAGE MADE IN THE WORKSHOP It wasn’t quite a marriage made in heaven, but Leigh and Rachel McKay have made a success of their nuptials through working together as mechanics. And how they originally met was serendipitous, as Rachel applied and won a job as a mechanic where Leigh had just handed in his notice to go overseas. On his return from his holiday, Leigh started Nightcliff Service Centre and in time convinced Rachel to join him and they eventually rebranded to L R Automotive NT in 2019. “Our business name incorporated the initials of our first names, but when we had a business opportunity with Land Rover, we knew we had to move to bigger premises, and change to ‘Darwin Land Rover’,” Leigh said. “Originally, we were working out of a small area next to a service station, which was built before Cyclone Tracy hit, in 1975. “We were fortunate, as it all started when I bought a Land Rover County for $1000. Consequently, Land Rover owners were asking us to fix theirs, so it was a niche market and it has just grown from there.” In February last year Leigh and Rachel were asked by the Land Rover manufacturer to become Darwin’s authorised repair and spare parts supplier, which ‘blew the couple away’. With the reputation the couple had developed, mainly through customer satisfaction and word of mouth, it

made them an ideal target for Land Rover – it was a rare opportunity, as most international brand companies don’t usually go into partnership with independent businesses. “Yes, those types of opportunities are unheard of. We were looking at changing the company name because of our relocation to Winnellie, and as it was a condition of the franchise agreement, it wasn’t a problem. “For us it was about closing one business and opening another, which offered so many more opportunities. “Our customers are a good bunch, and loyal. We have worked hard from when we started the business, with honesty the backbone of the trust we have won with customers and has helped us get to where we are now.” There have been so many great stories from their ‘adventures’ on the job for the McKays, including helping people who have been stuck in the Simpson Desert and the Kimberley Ranges. They also have been bogged once or twice themselves, so have ‘hands on’ experience. Both have family influences on their path to becoming mechanics. Leigh’s dad, Ian, was a fitter and turner, while his grandfather, Jack, did his mechanic apprenticeship in Snowtown, SA in the 1950s. As for Rachel, her grandfather, Peter Mohi, was a diesel fitter and truck driver, but she points to her brother Simon’s influence through his interest in tinkering with cars when she was young – he’s now a wind-turbine technician, while Rachel ended up as the car mechanic!

The South Australian automotive industry has shown tremendous resilience, flexibility and adaptability in dealing with the COVID-19 pandemic. The Marshall Government has also put its shoulder to the wheel with a massive $4 billion economic stimulus package delivering cash grants and payroll tax relief to local businesses to help support hundreds of thousands of jobs. We understand providing opportunities for jobseekers to begin careers as part of a skilled workforce is a critical part of ensuring our economy remains strong. The Marshall Liberal Government is driving a skills-based recovery with a number of targeted financial supports available to train and maintain a skilled workforce. For example, businesses who take on an apprentice or trainee may be eligible for the Equipped for Growth incentive, which provides up to $5,000 to assist with recruitment, onboarding and supervision costs. If you have not received Equipped for Growth funding you may be eligible for Equipped for Work, which provides up to $1,000. An Employer Bonus Payment of $3,000 will be paid to eligible employers for the first 1,000 school enrolled students who successfully complete their South Australian Certificate of Education (SACE) as well as their apprenticeship. And for businesses in rural or regional South Australia, they can access allowances for travel and accommodation associated with hiring an apprentice or trainee. financial support and services from the State Government thanks to a new mobile phone app launched last month. The free to download SA Business Hub app provides a simple and easy way for businesses to find out what’s on offer from the South Australian Government as well as the Australian Government. South Australia’s economy has weathered the COVID-19 storm remarkably well. Latest national labour force data shows there are now more South Australians in full time jobs than before COVID-19 hit – the only mainland state to achieve such a feat. South Australia’s unemployment rate is the equal second lowest of all the states at 6.4 per cent - the state’s highest ranking in a decade – in CommSec’s State of the States economic report. A sense of normality is returning in recent months with restrictions easing. However, we cannot be complacent. It’s critical we continue to heed the advice from SA Health to ensure customers are using the COVID-Safe check in and maintaining a clean environment. The State and Federal governments have contributed $2.6 million to a COVID-19 Clean training toolkit for staff, which minimises the risk of spreading COVID-19 and instils confidence in the community. This low-fee training covers a range of basic skills, including hand hygiene practices, effective surface cleaning, use of personal protective equipment (PPE) and disposal of contaminated waste. Industry SuperFund MTAA Super has named fifteen auto and related industries workers as recipients of the MTAA Super Scholarship, a sub-fund of the Australian Communities Foundation. The scholarships — worth up to $5,000 and funded through personal donations from the MTAA Super Board members and the CEO — are designed to help individuals in the automotive and related industries pursue further education and training. With over $50,000 awarded to fifteen recipients across Australia, the fund will support studies in business, technology, innovation, communication, and more. For South Australian David Wylie — whose career has spanned 15 years mostly as an after-sales manager — the scholarship is a chance to gain qualifications to press for higher positions in the industry. “I want to do my Master of Business Administration at the Australian Institute of Business,” said Wylie. “I’ve been in after-sales my whole career, and once you’ve done it, you need to find new ways to do things. With an MBA, I can learn different facets in different areas. So instead of it being this is the automotive way and that’s the way it’s done, it’s about learning from something outside the industry.” After spending six months laid off in 2020 due to COVID-19 cutbacks, Wylie said the scholarship was a huge leg-up after a stressful year. “You go six months living on Centrelink when you’re used to living on a real wage, and it’s hard. I decided to do this MBA but quickly realised it was a very expensive exercise for a guy that was unemployed when he signed up for it. So, to have that support and get that scholarship to put straight towards my education is just fantastic.” Now back working in after-sales, Wylie has big plans for the future. “The general plan is to work my way up into a general manager position and then go into a dealer principal one day.” MTAA Super board member Geoff Lowe said that the calibre of applications for the scholarships was exceedingly high.

However, the selection process also highlighted the challenges many auto workers currently face. “Like many industries, Australia’s automotive has been seriously impacted by the pandemic and now the recession. Many auto workers have had their working hours reduced or lost access to important training opportunities. This adds a lot of pressure to businesses, workers, and their families.” “That’s why opportunities such as the MTAA Super Scholarships are so important,” Lowe said. “If we can support individual workers to upskill and find new career pathways in the industry, then we can help support the industry as a whole.” Lowe said former Victorian Premier and current MTAA Super Chairman John Brumby was the brains behind the scholarship program. “John has always been very keen for MTAA Super to actively support and promote the auto industry and its workers — both within the super system and outside of it.” “Very early in the pandemic, he raised the issue of the potential impacts COVID-19 might have in terms of hardship,” Lowe said. “The purpose of the scholarship was to make a small sacrifice that would help support people in our industry for whom study or learning opportunities might be impacted.” Lowe hopes the MTAA Super Scholarships will help individuals take further steps along their automotive career pathway. “I hope the recipients genuinely grab hold of this opportunity. Whether they’re using it to help with their studies or adding additional skills, there are many, many pathways in this industry. That’s why it plays a multifaceted role in the Australian economy for hundreds of thousands of people daily.”

TAKING ACTION AGAINST UNLICENSED SELLERS

DINI SOULIO, COMMISSIONER FOR CONSUMER AND BUSINESS SERVICES Advertisements for private vehicle sales are regularly monitored by Consumer and Business Services (CBS) to check whether any individuals are operating as a dealer but without holding a licence. While compliance is generally very good in South Australia, CBS takes action where unlicensed selling is detected. You must hold a licence in SA if you carry on the business of a secondhand vehicle dealer. Under the legislation, you may be considered to be a dealer if: • Y ou buy, offer to buy, sell or offer to sell four or more vehicles during a 12-month period; or • Y ou and a close associate (e.g. your spouse, partner, brother or sister) buy, offer to buy, sell or offer to sell six or more vehicles during a 12-month period. In assessing complaints made to CBS, investigations are made to determine whether there are lawful reasons for the numbers of vehicles listed above to be bought or sold.

An unlicensed seller from Para Hills was investigated for advertising and selling six vehicles during a six-month period. The vehicles were priced between $5,100 and $19,999 and were promoted on the seller’s Facebook page. He had previously been licensed as a second-hand vehicle dealer, but that licence had expired almost four years prior to the alleged offences. Following the investigation, the unlicensed seller provided a written assurance to the Commissioner for Consumer Affairs that he will not operate as a second-hand vehicle dealer unless he is licensed. He swiftly applied for a licence, met the criteria and was granted a licence just a few days after providing the assurance. This means that anyone who purchases a vehicle from him as a licensed dealer will now have important protections where required by law – e.g. guaranteed vehicle ownership, consumer guarantees, warranty and a two-day cooling off period. Assurances provided to the

Commissioner for Consumer Affairs are published on the CBS website. Each assurance specifically states the alleged conduct of the individual or company. Failing to comply with an assurance is an offence, and CBS may seek to prosecute. Other enforcement tools available to CBS for dealing with potential breaches include: formal warning letter; public warning; disciplinary action; or prosecution. The action taken will depend on a range of factors such as the nature and extent of the activity, and potential or actual detriment suffered by consumers. CBS will continue to monitor vehicle advertisements posted online, in newspapers and social media and also welcomes reports from licensed dealers or members of the public of suspected activity around unlicensed selling. VEHICLE INSPECTIONS: A POLITICAL ISSUE

With just over a year until the 2022 state election, the MTA is pushing to get vehicle inspections at change of ownership “on the radar” of both major political parties.

“This needs to change. It must be a higher political priority and the MTA is calling for better visibility of how many deaths have roadworthiness as an attributable factor.

“We believe the state government appreciates the argument for vehicle inspections at change of ownership, but the Minister has advised that it is not a priority for the State Government at this point in time,” said MTA Industry and Government Engagement Manager, Kaes Cillessen.

“At the moment, the data is simply not published.

“What parent wouldn’t want the assurance of a roadworthiness certificate when purchasing their child their first used car?”

He said there are not just road safety benefits, but also consumer protection.

For example, vehicle inspections at change of ownership is good for the general public. “When they buy a vehicle, they can be sure that certain quality checkpoints such as brakes, tyres and seatbelts are met and they are not buying an unsafe vehicle.”
