Baby boomers and millennials have been the main drivers in the rental and for-sale housing markets in recent years, which isn’t surprising considering those aged 20-29 have grown by 4.7 million, while those ranging from 55 to 64 years old increased by 10.2 million over the past decade alone. Another reason these groups are leading the industry is because, as noted in a recent report by John Burns Real Estate Consulting, both share a desire for a carefree, convenient, urban lifestyle that has spurred a trend in the development of ‘surban’ locations throughout the Chicago area. Surban locations are defined as suburban downtowns, either new or redeveloped, with elements of urban living combined with suburban affordability. These surban locations share common elements, such as proximity to transportation, as well as walkability to entertainment and recreation. While a number of residential developments targeting both millennials and baby boomers are gaining Victory at Verrado’s The Entertainer plan as modeled in the Desert Prairie elevation offers 2,284 square feet of living space designed for active adults and offers options such as an alternate master bedroom layout, casita or large walk-in shower at master bath. There are four important trends that will effect building materials companies in 2016. You need to be aware of these in order to maximize your growth and reduce the risk of falling behind.

3. Your Website is Probably Costing You Sales 1. The Big Keep Getting Bigger Every day we see where the largest companies are not only growing organically, but they are also growing through mergers and acquisitions. The biggest builders, dealers, big boxes, distributors and even architectural firms are getting larger. Bigger means they have more leverage, information, and sophistication. Your salespeople are more likely to be dealing with a whip-smart young MBA than an old school person who came up through the ranks. You need to be hiring and training the level of sales people who can hold their own with this different type of customer who doesn’t care how things have always been done. You also need to be investing in equipping your sales people with the best data available. 2. More Niche Opportunities As your customers get more specialized, you need to stay aware of these changes and what they mean to your products. While we used to think of Green as a niche, there are now many more segments, and they are growing every day. Your customers are specializing in markets like design/ build, panelized, modular, entry level, high end, super green, aging in place, multifamily, rental, tiny houses, remodel, repair, new construction and more. You need to evaluate your products in terms of their benefits to each of these areas and focus where you provide the most benefit. When you focus this way, you are providing more value, so cost is less important, enabling you to raise your prices. Too many companies simply focus on the

Most building materials websites are designed based on what you think the customer needs or how you want to present your product. If this is your approach, you are at risk of losing sales to competitors with more customer friendly websites. Your customers see no difference between the websites they visit for personal needs and business needs. While the design is important, what the customer is really looking for is functionality. Think of the best consumer websites and ask yourself if your
Is your site the best in your category for new and existing customers and influencers? If not, you need to get it fixed this year. Start by having an outside person interview your website audiences in person watch them use your website and others. This simple step will tell you what you need to do to have a much better website. In addition to your website, you probably need to shift more of your marketing dollars online. Find out about and be better than your competitors at marketing automation, SEO, content marketing, lead nurturing, inbound marketing, blogs, and all things online. 4. Invest More in Customer Service When I ask customers to name their top three suppliers, the ones they can’t imagine leaving even for a better price, they all can immediately name them. They tell me there are two reasons why. The first is that they feel “No One Cares More About Their Success Than These Companies.” The second reason is the that these companies have better customer service than their other suppliers. Not just better in their category but they are the top three of all the hundreds of companies the customer deals with. They have never told me they are a best supplier because of their product or their price; it’s always about service. Your product or price may get you in the door, but your service is what keeps you there. Just like your website, excellent customer
service should be defined by your customer and not by you. It should be measured by actual customer interviews and not a simple survey. Based on my interviews with people like builders, contractors and architects, they see customer service as a combination of internal customer service, the sales rep, and your website. You should be prepared to meet their needs based on their preferences. You also need to allow them to tell you what they need or want from customer service. One of my clients, who is known for excellent customer service sells to dealers. They know and accommodate how the dealer wants to communicate. They reach them by phone, email or even text, based on the dealers preference. If an order looks incorrect, they contact the dealer. They let the dealer know when the shipment leaves, confirm whether it is complete or not and give them an
estimated arrival time. They then check with the dealer that the shipment arrived and that it is correct.

Stop looking at customer service as an expense and look at it as an investment.
Most companies have an incorrect view of what good customer service means and they think they are better than they really are. When dealing with you, your customers should feel like they are staying at the Four Seasons Hotel. One final customer service recommendation, make the boss earn his pay. Every month the CEO or President should call at least ten random customers and ask, “How are we doing.” These should not just be the biggest or their fishing buddy or the ones you are about to lose; they should be totally random. Two things happen, the customer feels valued and, more importantly, the CEO hears directly from the marketplace. Too often the CEO

Positive housing market momentum carried into February with home sales and median prices experiencing solid year-over-year gains, even amid lower inventory levels, according to the Illinois Association of REALTORS®. Statewide home sales (including single-family homes and condominiums) in February 2016 totaled 8,528 homes sold, up 5.7 percent from 8,066 in February 2015. The statewide median price in February was $160,000 up 7.8 percent from February 2015 when the median price was $148,375. Statewide median prices have notched year-over-year increases for the last 42 months. The median is a typical market price where half the homes sold for more and half sold for less. “Illinois continues to see sustained growth in sales and median prices, indicating the market is poised for a strong rollout for the spring selling season,” said Mike Drews, GRI, president of the Illinois Association of REALTORS® and broker-associate with Charles B. Doss & Co. in Aurora. “All signs point to sellers seeing intense interest from buyers who are competing in a market where there are fewer properties from which to choose.” The time it took to sell a home in February averaged 81 days, down from 90 days a year ago. Available housing inventory totaled 56,563 homes for sale, an 11.3 percent decline from February 2015 when there were 63,791 homes on the market. The monthly average commitment rate for a 30-year, fixed-rate mortgage was 3.66 percent in February 2016, down from 3.87 percent during the previous month, according to the Federal Home Loan Mortgage Corp. In February 2015 it averaged 3.68 percent. In the nine-county Chicago Primary Metropolitan Statistical Area (PMSA), home sales (single family and condominiums) in February 2016 totaled 6,095 homes sold, up 6.1 percent from February 2015 sales of 5,744 homes. The median price in February 2016 was $187,500 in the Chicago PMSA, up 7.1 percent from $175,000 in February 2015. “The housing market in Illinois continues to record comfortable increases in both sales and prices,” said Geoffrey J.D. Hewings, director of the Regional Economics Applications Laboratory (REAL) at the University of Illinois. “Particularly important has been the consistent decrease in the

percentage of sales accounted for by foreclosed properties in Chicago. The influence of foreclosed properties on aggregate prices seems to be diminishing while the foreclosure inventory remains at levels above those during the pre-recession period.” According to the data, fifty-nine (59) Illinois counties reported sales gains for February 2016 over previous-year numbers, including St. Clair County, up 23 percent with 182 units sold; Champaign County, up 21.9 percent with 128 units sold; Will County, up 12.6 percent with 598 units sold; and Cook County, up 3.6 percent with 3,384 units sold. Fifty (50) counties showed year-over-year median price increases including Winnebago County, up 18.3 percent to $84,000; McHenry County, up 18.2 percent to $175,000; and Peoria County, up 9.7 percent to $96,500. The city of Chicago saw a 2.1 percent year-over-year home sales increase in February 2016 with 1,528 sales, up from 1,497 in February 2015. The median price of a home in the city of Chicago in February 2016 was $238,000, up 12.3 percent compared to February 2015 when it was $212,000. “Now is the time to sell your home if you’ve been thinking about doing that,” said Dan Wagner, president of the Chicago Association of REALTORS® and senior vice president for government relations for The Inland Real Estate Group. “Compared to last year, the median sales price for all closed sales is up about 12 percent and there is a faster turnaround time between when a home is listed and when it sells.” Sales and price information is generated by Multiple Listing Service closed sales reported by 28 participating Illinois REALTOR® local boards and associations including Midwest Real Estate Data LLC data as of March 7, 2016 for the period Feb. 1 through Feb. 29, 2016. Home Builder still liable for Implied Warranty of Habitability to Subsequent Purchaser and resulting damages By Corey B. Stern, Chitkowski Law Offices In May, 2015, the Appellate Court ruled that the Implied Warranty of Habitability applied to Subsequent Purchasers, despite the fact that the Home Builder and Original Purchaser had explicitly waived this Implied Warranty and the Subsequent Purchaser bought the Property “As-Is”. In this recent case, the Subsequent Purchaser made a viable claim against the Home Builder for breach of the Implied Warranty of Habitability. By law, in the construction or significant additions/remodeling of every home, the Home Builder or Remodeler warrants that the house is livable and is free from latent defects. However, a Home Builder or Remodeler can have the Purchaser waive the Implied Warranty of Habitability if done properly, and thereby, limit the Contractor’s liability and monetary exposure.
The Purchaser can make a claim for Implied Warranty of Habitability against a Home Builder if it proves that: 1) there is a latent defect in the house; 2) the latent defect interferes with the intended use of the house; and 3) the latent defect were noticeable within a reasonable time after the house was purchased.
The Implied Warranty of Habitability applies to developers, general contractors, subcontractors and materialmen. The Implied Warranty of Habitability provides that the home is free from latent defects, structurally sound and without substantial defects. A latent defect is one that could not be discovered from an inspection that exercised ordinary and reasonable care. A claim for Implied Warranty of Habitability must be brought by the homeowner within four (4) years after the homeowner discovers the latent defect or within ten (10) years from the date the work was performed.
For a Home Builder to have an enforceable Waiver of Implied Warranty of Habitability with the Purchaser, the Waiver must be: 1) more noticeable than other contract provisions; 2) the waiver must inform the Purchaser of the consequences of the waiver; and 3) the Purchaser must specifically sign off on the waiver contractual provision. Instead, the Home Builder should offer a 1 year warranty that defines the Parties obligations on remediation and notice.

The Court held that the Waiver of the Implied Warranty of Habitability contract provision between the Home Builder and Original Purchaser was not enforceable against the Subsequent Purchaser. Additionally, the Court held that the “As-Is” contract provision between the Original Purchaser and the Subsequent Purchaser did not waive the Implied Warranty of Habitability.
According to the Court’s reasoning, since the Subsequent Purchaser did not have knowledge
and agree to the waiver of the Implied Warranty of Habitability, the Subsequent Purchaser could not be bound by that waiver. One possible way to put the Subsequent Purchaser on notice of the Original Purchaser’s waiver of the Implied Warranty of Habitability is to record the contractual provision with the County’s Recorder’s office or to require the Original Purchaser to provide in a contract to provide an assignment of the waiver. Depending upon the manner in which the recording of the contractual provision is performed and the Subsequent Purchaser obtains the property, the Subsequent Purchaser may have sufficient notice of the Waiver of Implied Warranty of Habitability. At the very least, recording the contractual provision may provide a position which could be leveraged into a settlement, if the subsequent purchaser ever asserts a claim. 2015 Illinois Energy Conservation Code Effective January 1, 2016 Get ready, the new Illinois Energy Conservation Code has been approved and the effective date is January 1, 2016. Unlike the 2009 and 2012 code which, combined, raised the cost of construction in Illinois by an average of $16,000 per unit, HBAI welcomes the 2015 code as it brings new options to builders and minimizes construction cost increases. For the first time since 2009, NAHB helped stop the regulatory binge at the International Code Council, while HBAI did the same with the Illinois Department of Commerce and Economic Opportunity (IDCEO). With two members now sitting on the Illinois Energy Code Advisory Council (IECAC), HBAI defeated all attempts by IDCEO to stay with the 2012 code. Later in the year and leading all the way up to late November, HBAI also checked state regulators from erasing and delaying sensible changes in the 2015 code. Even after final approval of the code by the Joint Committee on Administrative Rules (JCAR), a final ditch effort was made in late November by IDCEO officials and consultants to delay enactment of the code for six months, and reverse a new option to use the Home Energy Rating System (HERS) rating system. But all of that was turned back by builders, code officials, engineers, and architects serving on the IECAC. NAHB advised HBAI early this year to embrace the new code as long as certain changes in the code were incorporated. Don Surrena, Program Manager for the Energy Efficiency Construction Department at NAHB, drew a road map for HBAI that was successfully used by our appointees to the IECAC; Jason Huelsman and Allen Drewes. Important Compliance Changes Include: The Energy Rating Index (ERI) has been added as a third option for compliance. RESNET and the ICC now offer a HERS Index Video to explain how it works. IDCEO opposed this vehemently and refuses to include this in their state funded instruction seminars for builders and code officials.

Please note that there are over 70 changes made by the ICC from the 2012 to the 2015 code. That’s a lot, but still a far cry from the 240 changes made from the 2009 to the 2012 code. HBAI would like to thank the members of the IECAC who worked long and hard over the past several months to create a new code that is a great improvement over the previous code. Failure to do so could result in a civil action against a builder by the home owner resulting in fines and payment to upgrade to the standards set forth at the time of construction. Insulation from the top of the basement wall down to 10 feet below grade or to within six inches of the basement floor, whichever is less with an R-Value of 10/13 minimum; 2. Insulation from top of the basement down to 4 feet below grade when the basement wall R-Value is at least 15/19. IDCEO opposed the second option on the belief that most home builders would find this method too complicated to construct.
