News - Brighton - More revelations from municipal lawyers at Templeman Menninga were revealed at the Brighton Council meeting on Monday night. At their last meeting, on September 16, council received letters from the law firm refuting claims by Mayor Mark Walas, who claimed he received no documents in 2011 during an effort to fire CAO Gayle Frost. “We have correspondence from Templeman Menninga, providing further information in regard to advice that was provided to Mayor Walas,” said Deputymayor Craig Kerr, after Walas excused himself from that portion of the meeting, citing violations of the municipal Code of Conduct. Councillor Mary Tadman also declared a pecuniary interest in the discussion.
“I do not wish to debate it at this time,” she replied, when asked about the general nature of the conflict. Councillor John Martinello was absent from the meeting. That left Kerr and Councillors Tom Rittwage, Emily Rowley and Mike Vandertoorn around the table. “I don’t want to oversimplify this, but we’re in a sticky situation here,” said Rittwage. “There are only four of us here and no matter what we say or do, we will be vilified and pilloried by certain people in the community.” “These are missing pieces to the puzzle,” said Vandertoorn. “But there is other correspondence that might be a totally separate issue … outside the one we thought we were dealing with.” One, from lawyer Maureen Houston to Walas at his home e-mail address, advised, “David DeMille, a partner in our municipal law group, did provide,
at Gayle [Frost]’s request, an opinion on the tree cutting issue.” “I guess I don’t understand why the mayor was sending e-mail about the trees that were cut down adjacent to his property [on Lakeview Heights],” said Rittwage. “Something’s not right.” As the legal billing situation has unfolded, Kerr contends the action to terminate Frost’s employment started the day after an illegal tree cutting incident was brought to council’s attention when 14 trees, some upwards of 50 years old and all reportedly healthy, were felled at the north end of Pinnacle Street, a municipal right-of-way. Notably, the tree removal now provides a panoramic view of the lake, most especially at an empty lot at the east end of Lakeview Heights. Walas denies any involvement in the act. “It appears to me [the mayor] has gone to the municipal lawyers about

something that doesn’t necessarily matter to the taxpayers of the community,” said Rittwage. “I think it’s important for folks to realize the mayor has told us, in this room, the trees had nothing to do with the CAO. Now, it seems to have tied in a little bit.” The correspondence will be forwarded to the integrity commissioner as part of an ongoing investigation. Earlier in the meeting, council approved an amended motion in an effort to stop unauthorized legal bills. “In order to ensure transparency and accountability to Brighton taxpayers and all members of council, it is recommended that, starting immediately, no member of council incur any legal fees on behalf of the municipality unless it has been specifically approved by a resolution of council,” it reads.
