Thanks to all who attended last month’s meeting. We had quite a turn out for our Annual “Fair Claims Settlement Practices Act” Certification presentation given by attorney Mark Berry of Mayall Hurley Knutsen Smith & Green. We appreciate Mr. Berry taking time out of his busy schedule to present this seminar to our association. It, as always, was full of important and current information, in which we should all be well versed. Thank you, again, Mark for providing our association with this yearly recertification seminar. This month, we have a new and exciting presentation. We welcome this month’s guest speaker, Rudy Degger, of Rudy Degger & Associates. Mr. Degger will give his presentation on “Auto vs Pedestrian Impacts”. Mr. Degger is a retired police Sergeant of the Contra Costa County Sheriff’s Department. He has been in law enforcement since the mid 70’s. He specializes in traffic accident investigations and reconstruction. Mr. Degger has handled over 1300 traffic crashes with more than 2000 reconstruction crashes. He has testified as an expert in cases that involve civil litigation, insurance claims, and criminal prosecution for State and Federal
Courts in California and Nevada . He has taught traffic crash reconstruction courses at various colleges throughout California since 1987. This presentation is one you won’t want to miss. Mark Berry, of the Law Offices Mayall, Hurley, Knutsen, Smith & Green, was the guest Speaker at the March 21st Luncheon Meeting for the Mid Valley Claims Association. It was his eleventh year presenting the yearly Recertification Class on the “Fair Claims Settlement Practices Act” regulations. All claims people must recertify themselves annually that they have read and understand the requirements of the California Insurance Code Sections 2695.1 through 2594.14, relative to Code Section 790.03(h) Mr. Berry gave a very thorough presentation on the regulations. He was able to highlight many of the potential pitfalls claims people often run into, while focusing such things as important time lines that must be met, and properly informing claimants/insureds of their rights and ability to contact CDI directly. Mark said “always follow your company guidelines and treat the claims as if they were your own”. He clearly demonstrated his expertise in this field. Founder of Degger & Associates, Rudy Degger, ACTAR has been investigating traffic accidents since 1978. He has qualified as an expert regarding traffic accident reconstruction in twenty-one different California Counties. His expertise includes the reconstruction of auto-pedestrian, bicycle, motorcycle, speed-from-crush, commercial vehicle, and low-speed impact collisions. Mr. Degger is accredited by ACTAR and is the owner of Rudy Degger & Associates, Inc., which specializes in the reconstruction of traffic accidents. He is a retired police sergeant from a San Francisco Bay Area police department. He is an adjunct faculty member at Los Medanos College, Sacramento City College, and formerly, the University of California at Riverside, teaching all levels of accident investigation and accident reconstruction at those institutions. In addition, Mr. Degger has been a guest lecturer and has taught accident reconstruction at various police departments, professional organizations, insurance companies, municipal bus and transit districts and law firms. National Asbestos Awareness Week is an annual event to warn and educate people about the dangers of exposure to asbestos containing building materials, and the prevalence of asbestos related diseases, such as mesothelioma. As we all know, asbestos is still being mined, imported, and used despite being confirmed as a human carcinogen. 55 countries have banned asbestos, but the United States has not. Asbestos fibers can be nearly 700 times smaller than human hair. They are odorless, tasteless, indestructible fibers that can remain suspended in the air. Asbestos fibers can be inhaled easily and are difficult for the lungs to expel. Abatement is defined as the procedures to control fiber release from asbestos containing materials, typically during removal. Abatement includes removal, encapsulation, enclosure, demolition and renovation activities related to asbestos. The California Health and Safety Code 25915 requires all building owners in the State of California to provide written notification to employees, tenants and contractors of the presence and location of asbestos containing construction materials within their buildings. Asbestos containing construction materials are defined as any materials with an asbestos content of greater than one tenth of one percent (>0.1%). Under the U.S. EPA National Emission Standard for Hazardous Air Pollutants (NESHAP) regulation, no visible emissions are allowed during building demolition or renovation activities, which involve regulated asbestos containing materials. For this reason all buildings must be surveyed for asbestos containing materials prior to demolition or renovation. The EPA, and or local Air Quality Management District must be notified prior to any building demolition even if no asbestos containing material is present. NESHAP requires removal of all asbestos containing materials which have or will become friable prior to any demolition or renovation activities. California and Nevada Laws require that specially licensed asbestos abatement contractors perform work with asbestos containing materials. Additionally, Federal OSHA, California OSHA and Nevada OSHA require employers to implement specific work practices which protect workers from airborne asbestos exposure.
