EASEMENTS IN MONTANA By Corinne Garcia

Enjoying the great outdoors—the views, the trails, the skiing, the rivers, the wildlife—is what draws many people to Montana, whether they are full-time or part-time residents. And judging by the numbers, for many landowners, keeping the land in-tact for future generations is a priority. Montana land trusts and public agencies hold over 1,000 conservation easements that conserve over 2.1 million acres, and those numbers are likely to increase over the coming years. In February of 2015, a charities bill was passed that is now moving through the senate. If adopted, it will make it easier for more landowners to use conservation easement benefits by making the tax incentives more usable for those in lower income brackets. “Conservation easements can create very large tax deductions, and unless you’re a very high income earner, you can’t use it up in current law and carry forward,” explains Jay Erickson, a Managing Director 4

of the Montana Land Reliance (MLR), an organization that has been instrumental in crafting and introducing the new bill. “New legislation has no added deductions, but it let’s you use the deduction over more time.”

What is a Conservation Easement? One great example of the power of preservation is the Jack Creek Preserve. Located between Big Sky’s Moonlight Basin area and Ennis, there are approximately 25 conservation easements protecting 30,000 acres of open space. These landowners either negotiated their own easements or bought into existing ones, and either way, once the land is preserved through a formal easement it exists like that into perpetuity. It means that instead of subdividing the land that they purchased, these landowners have chosen to protect their acreage as open space. A conservation easement is a voluntary and legally binding agreement limiting certain types of development and uses on a property.


There are some common misconceptions about the end result; some think that they would be relinquishing control over their land or that the public would have access to their land, and both are myths. “It’s a restriction on subdivisions and building on properties, but it’s not to be mistaken for a restriction on use of properties,” Erickson explains. “You can build agricultural structures, residences, or housing based on your family needs, so it’s a negotiated agreement that works for both parties.” These negotiations require serious thought and consideration, as once conservation easements are put into place, Erickson explains, they are very difficult to reverse, but easy to enhance. Once a conservation easement is donated, landowners receive a federal income tax deduction. And with the new tax incentive structure, there will be more incentive for more landowners to preserve their land. The five year deduction period would be extended to a 15 year period, and the amount of the deduction would be increased from 30 to 50 percent of adjusted gross income.

“A lot of people in Montana see the benefit in land conservation and the value in open space and wildlife habitat,” Erickson says. “This will make it more achievable for more people instead of just for high income earners.”

Big Sky Conservation Easements Supported entirely by private donation, MLR helps draft and negotiate conservation easements with private landowners. With three offices in Montana, this preeminent land conservation organization has preserved close to one million acres of open space in Montana, and works frequently with landowners in the Big Sky area. Currently, MLR is working with two adjacent properties on the southwest fork of the Gallatin River. They also work closely with Yellowstone Club landowners and handled almost all of the conservation easements in Jack Creek Preserve area. “These new laws will allow more people to use conservation easements, thus it allows for more open space in our future,” Erickson says.
