Who Really Owns YOUR Credit Card Miles & Points? Part 2 BY getpeyd.com In our last column, we mentioned that a rabbi who had sued Northwest claiming their forfeiture of his mileage account and elite status was illegal, lost his case due to the decision of the supreme court that since airlines were protected by federal law from being sued, his lawsuit claiming the airlines were in violation of good faith business practices could not go forward. We mentioned at the time, the court hadn’t decided whether the rabbi’s claim was valid or not, and that it wouldn’t take long for someone else to raise this same issue, perhaps instead focusing on the point programs offered by the credit card companies who weren’t governed by the airline regulation law. What we couldn’t foresee was that an elected official with increased authority and power would be the one who decided to further pursue this matter. Originally from the Bronx, Congressman Alan Grayson, a Democrat hailing from Florida’s 9th congressional district, which includes Orlando, has contacted the Office of the Inspector General of the Department of Transportation to launch an investigation into the airlines practice of constantly changing the value of mileage programs and making free tickets tougher to come by and award
seats harder to reserve. He claims these practices are deceptive and unfair and has demanded an inquiry. What makes this inquiry by Congressman Grayson very interesting is that he has exorcised his authority as a lawmaker to bypass the courts and contacted the federal authority which regulates the airline industry and was the governing body that initially created the airline deregulation law that protects the airlines from being sued. In an interview with CreditCards. com, Congressman Grayson focuses on the fact that the inspector general has the authority to regulate functions of the airline industry, not just the actual flying of passengers and that overall based on his observations the mileage practices in question are “deceptive” and thus under the purview of the inspector general to review and regulate. In his claim that these practices are deceptive, he cites a number of practices that he has experienced (as many of us have experienced as well) including: 7KH HYHU FKDQJLQJ DQG constant devaluation of the miles and points including changes without appropriate notice. 7KH ODFN RI DYDLODELOLW\ DW WKH

various award levels. 7KH IDFW WKDW LQ VRPH instances you can search for almost a year in advance and not find mileage seats available for seats the airlines claim is available when they advertise their mileage programs. Although our idea for solving this issue was to put the banks/credit card companies under increased scrutiny and not the airlines, Congressman Grayson has rightly focused his inquiry on the airlines themselves as he correctly states the banks have paid literally billions of dollars to partner with airlines to promote their frequent flier programs to credit card holders to they can gain additional consumers, and the airline’s policies are the reason why the point programs and of course, the airline miles, are constantly being devalued beyond the customer’s control. The actual text of the letter of inquiry sent by the inspector general on September 11th of this year is short, but fascinating: From: Matthew Hampton Assistant Inspector General for Aviation Audits To: General Counsel For more than 30 years, major airlines have offered frequent flyer programs to encourage travel on

their respective airlines and secure customer loyalty. In addition to earning awards by flying, participants can earn awards for free travel by using certain credit cards and purchasing VHUYLFHV IURP QRQ DLUOLQH SDUWQHUV such as hotels and rental car agencies. Currently, there are an estimated 647 million members enrolled in various frequent flyer programs worldwide, with 306 million members enrolled in U.S. airline programs. The Department of Transportation (DOT) does not have regulations directly related to the terms of airline frequent flyer program contracts. These are matters of individual airline policy. However, DOT does require that airlines disclose their frequent flyer program rules. DOT also provides guidance to airlines for disclosing costs they may assess UHODWHG WR ERRNLQJV RI IUHTXHQW IO\HU award travel.* Failure to adhere to DOT’s guidance could constitute an unfair and deceptive practice in which

enforcement actions can be pursued against the airlines. In July 2014, Representative Alan Grayson requested that we examine airlines’ frequent flyer program practices. In particular, Representative Grayson expressed concerns about the lack of transparency for consumers when airlines change their frequent
flyer program terms and conditions. Accordingly, our audit objective will be to assess DOT oversight of airlines’ compliance with frequent flyer program disclosure requirements. We plan to begin our audit later this month and will contact your audit liaison to schedule an entrance conference. We will conduct our

work at DOT Headquarters and selected airlines (to be determined). *Under DOT guidance, any government fees or taxes or mandatory carrier charges, such as processing fees the consumer PXVW SD\ LQ IUHTXHQW IO\HU DZDUG programs, must be shown on the airlines’ Web sites is clear evidence at this point that there is misleading and deceptive activity on the part of the airlines. We remind our readers that Congressman Grayson’s focus is on the mileage programs themselves; the lack of advance notice and devaluation specifically, and not on the issues we raised in our last column where the airlines restrict the usage of miles and points to the cardholder, and frown upon the sale and usage of these programs by an individuals who haven’t earned the miles and points directly. However, as we stated last week, we believe quite strongly that the frequent flier and point programs are unfair, in violation of good faith business practices and ultimately need to be reformed. And now, a federal official feels the same, and this inquiry has the ability to completely change the landscape of the rewards programs offered by the airlines and open them to additional scrutiny. Arthritis and Stages of Subluxation Hello Everyone, Have you ever heard of the word Subluxation? That is when a vertebra moves out of place and presses on the nerve. This causes pain and that is the primary reason people come into my office: to get out of pain. What I basically do when you come in to see me is to gently remove the pressure of the bone out of place so it does not press on the nerve and cause inflammation. What causes Subluxation? Usually some form of trauma in the form of a fall, car accident or repetitive motion such as sitting at the desk or computer all day in the wrong position. Many times I have to ask a few times to determine if you ever had a car accident. People feel that a “slight” car accident doesn’t count. Studies have shown that even a small fender bender with the car traveling at a speed of 8 mph can cause long term whiplash injury!
Most people have had some form of car accident some time in their lives. Latest reports show that more than 2 million people are injured each year in the US from car accidents!. This can lead to long term disability! What happens is that when one has a trauma of any sort, the ligaments are weakened and spinal vertebrae misalign to protect the brain and nervous system from more serious trauma or concussion. If these vertebra are not realign right away, then the spine is set up to go into a process of: Subluxation Degeneration There are four stages to the degenerative advancements of the spine: 1. The spine merely misaligns. 2. The normal spinal curves begin to change. That’s where you get problems such as scoliosis and hunchback. Muscles go into a state of chronic spasm

and one starts to experience chronic pain. (Neck, low back, headache etc.) 3. Discs start to become thin and arthritis begins to set in. 4. Discs have already degenerated and arthritis becomes more severe. At this stage it is usually too late to affect any major healing improvement. One notices an inability to turn ones neck and in more severe cases we see people so bent over that they cannot even look forward. They are forced to look at the ground as they walk. A
bout two years ago, the Orthodox Union launched a campaign against excessive alcohol consumption in the Jewish community, paying special attention to substance abuse within our community at large and within our adolescent population in particular. We undertook this campaign after meeting with pulpit rabbis and day school principals from the greater New <RUN DUHD ZKR LGHQWLÂżHG DOFRKRO DQG substance abuse as a major problem among our teenagers. In response, the OU developed a multifaceted strategy, under the rubric â&#x20AC;&#x153;Safe Homes, Safe Shuls, Safe Schools.â&#x20AC;? Our call for the elimination of â&#x20AC;&#x153;Kiddush clubsâ&#x20AC;? â&#x20AC;&#x201C; which has met with great success â&#x20AC;&#x201C; was just the ÂżUVW VWHS LQ WKLV FDPSDLJQ One challenge we face as frum Jews is the upcoming holiday of Purim, which has been characterized in past years by excessive drinking, resulting in disgraceful behavior, unsafe practices, and even real tragedy. But, because Purim has been traditionally associated with the drinking of wine â&#x20AC;&#x201C; indeed, drinking on Purim has a halachic basis in a Talmudic source â&#x20AC;&#x201C; our call for zero tolerance of drinking on Purim among teenagers, and for sincere moderation

of drinking on Purim among adults, has met the objection, â&#x20AC;&#x153;But itâ&#x20AC;&#x2122;s a mitzvah!â&#x20AC;? The fundamental rationale of our opposition to alcohol consumption by teenagers on Purim is the fact that drinking often leads, especially among youngsters, to serious medical consequences. It is instructive that among the strong supporters of our campaign have been members of Hatzoloh, the rescue and ambulance corps, who report that Purim does not go by without incidents of toxic reactions to alcohol requiring emergency treatment, driving accidents, and sometimes even deaths. These considerations of health and pikuach nefesh (the saving of lives) easily transcend whatever mitzvah might be involved in drinking on Purim. Secondly, and very important, is the fact that it is against the law for an adult to knowingly provide alcohol to individuals who are underage. While there may be exceptions when wine is served for ceremonial purposes, exception clearly assumes that no more than a symbolic quantity is ingested. Teachers or rebbeim who supply minors with wine or liquor on Purim are in violation of the law of the land.

any teenagers are struggling ZLWK WKH FRQĂ&#x20AC;LFW EHWZHHQ what it means to be a frum teenager versus what it means to be an American teen. In American culture, the purpose of drinking alcohol is to have a good time, be wild, uninhibited, cool. Someone who isnâ&#x20AC;&#x2122;t interested in these things is considered to be a loser. The teenage years are supposed to be the time for H[SHULPHQWV QHZ H[SHULHQFHV WR ÂżQG oneself and to rebel. Teen drinking is considered acceptable as part of the overall framework of the secular culture. 2Q WKH Ă&#x20AC;LS VLGH LV WKH YLHZ WKDW alcohol is evil and that itâ&#x20AC;&#x2122;s sinful to drink. America has historical roots in temperance movements and Prohibition, when a constitutional amendment banned alcohol from 1920-1933. The Torah attitude toward drinking is completely opposed to either of these cultural extremes. The Torah attributes the greatest sanctity with wine. It is considered a means to lift the soul and bring one closer to Hashem. Wine is supposed to be used in moderation. We are supposed to enjoy the pleasures of
this world and elevate them. Dr. Abraham J. Twersky has said that in our post-Holocaust era, â&#x20AC;&#x153;we have forgotten how to drink as Jews.â&#x20AC;? He compares our time to the time after the Flood, when Noach planted a vineyard and proceeded to get drunk. â&#x20AC;&#x153;We have crossed over the thin line of knowing how to drink,â&#x20AC;? contends Dr. Fish, a clinical psychologist and addiction authority. â&#x20AC;&#x153;Kiddush has degenerated into kiddush clubs at mussaf. Adults, with their children and teens closely watching, have started drinking in the goyishe way. Âł+RZ GR ZH IXOÂżOO WKH PLW]YDK on Purim? The purpose of drinking on Purim is to break out of our narrow view of reality and to be able to glimpse that which is normally concealed. By drinking wine in the correct way, we can bring out the deeper parts of ourselves, remove some of the constrictions we normally feel, and remove our masks. Through our drinking we can feel closer to Hashem.â&#x20AC;? Unfortunately, Purim has degenerated into a substitute â&#x20AC;&#x153;New Yearâ&#x20AC;&#x2122;s Eveâ&#x20AC;? (lehavdil). Rabbi Dr. Tzvi Hersh Weinreb, continued from page 50 While no one wants to seem prudish or to advocate total prohibition of alcohol, for those sectors of our population in which the call for moderation is likely to be ignored, I believe that zero tolerance is the only alternative. Adolescents, as well as adults with alcoholic tendencies, cannot be relied upon to effectively practice moderation; we therefore are calling for total abstinence on Purim among those populations. It is instructive to study the sources in halachah for drinking on Purim and to recognize that, although the Talmud clearly states it is an obligation on Purim to the extent that “one cannot distinguish between ‘cursed be Haman’ and ‘blessed be Mordechai,’” it is not clear that the Talmud means to become intoxicated; rather, it may be understood as “getting a buzz.” One of my personal favorite works on the spiritual underpinnings of halachic practice is Yesod Veshoresh Ha’avodah, The Foundation and Root of Worship, by Rabbi Alexander Ziskind of Grodnow. He writes that one must realize that the Talmud suggests only “livesumei,” and does not use the term “lehishtaker,” which would mean to “become drunk.” The former term means to drink just enough that one’s heart is lightened and one can truly indulge in the spiritual celebration of the theme of the day of Purim. Rabbi Ziskind goes on to say that, because the Jewish people are often so burdened with sadness that it is impossible for them to achieve the mood of thanksgiving and joy required
on Purim, a little bit of wine to ease their worry is advised, but certainly not more. One need only consult the Mishnah Berurah, the standard twentieth century commentary on the Shulchan Aruch, authored by the Chafetz Chaim. With reference to Purim, the Chafetz Chaim quotes the medieval commentator, the Meiri, who forbids drunkenness, as well as the nineteenth century halachic authority, the Chayei Adam, who rules that if the drinking in any way diminishes one’s ability to perform the mitzvos with proper intent during prayer and Birkas HaMazon, it is better not to drink. The OU’s National Conference of Synagogue Youth (NCSY) has met the challenge of alcohol abuse head on. This is after noticing a marked increase in recent years in the number of young people who try to sneak in liquor to one of its events. NCSY has a zero tolerance for alcohol at all events, including Purim, and urges that even Kiddush be recited on grape juice and not wine. Possession of alcohol at an NCSY event is grounds for immediate expulsion. My own personal concern for this issue traces back to occurrences I witnessed myself when I lived in Baltimore, where the excessive consumption of alcohol on Purim resulted in a fatality in one case and in serious illness in others. My concern was again triggered by an incident at an NCSY Shabbaton, at which, despite stringent controls and warnings, a teenager was able to smuggle in alcohol and drank enough to require emergency

treatment at a hospital. Today’s concerns are nothing new. One of my wife’s ancestors, the nineteenth century chassidic sage, Rabbi Yechezkel of Kuzamir, was also troubled about improper conduct on Purim. He would note that the common blessings we give each other at this season of the year are “a freiliche (joyous) Purim and a kosher Pesach.” He pointed out that of course our Purim will be joyous, and of course our Passover will be kosher, given the scrupulous ways in which we observe our customs. It is more important, he said, that we bless each other with a “kosher Purim and a joyous Pesach.” On Passover we tend to be so strict that we lose sight of the need for joy, and on Purim we tend to be so frivolous that we ignore the need to act in a kosher and proper fashion. I pray that the entire Jewish community will pursue this goal in every way possible, so that this Purim will be not only joyous but also kosher, and that the spirit of the day will be kept spiritually and not “spirit-fully.” Rabbi Weinreb is Executive Vice President of the Orthodox Union, former rav of Shomrei Emunah in Baltimore, and a clinical psychologist. Recently, I was in a high-end jewelry store, getting a battery watch changed. The door clanged open and in walked two women, clutching a small velvet bag. They spilled out the contents onto the counter, watching as the jeweler examined each piece in turn and weighed it carefully. To me, jewelry has always had a value disproportionate to what itâ&#x20AC;&#x2122;s worth. Each bracelet tells a storyâ&#x20AC;&#x201D;it reminds me of a precious person or a memorable occasion. Why were these women willing to part with pieces of their heart, I wondered. â&#x20AC;&#x153;Iâ&#x20AC;&#x2122;ve been waiting forever for a new sheitel,â&#x20AC;? one of them answered me. â&#x20AC;&#x153;This is the only way I can afford it.â&#x20AC;?
The price of gold has never been so high. Thatâ&#x20AC;&#x2122;s part of the reason why, walk past any jewelry store and youâ&#x20AC;&#x2122;ll see the sign emblazoned: We Buy Gold! But who buys gold, and, more importantly, who sells gold? The manâ&#x20AC;&#x2122;s sympathetic conscience obliged him to turn a blind eye, allowing Paul to steal freshly baked bread from his store twice a week. The ritual continued for a year. Sometimes the determined young VFDYHQJHU PDQDJHG WR ÂżQG SRWDWR SHHOV or other small provisions of vegetables and was always faithful to rush his smuggled goods back to his hungry family behind the fence. Eventually, Paul became so comfortable in his excursions that
he inadvertently lowered his guard and came face to face with disaster. They arrived at their destination: an old schoolhouse that had been converted into a transitory evaluation and detainment center, the Durkankslager. He was taken downstairs to the

Separated by brick and mortar, barbed wire and guns, and the merciless cruelty of the human heart, father and son looked upon each other for the last time. Fish Recipes For Adar )ORXQGHU D OD 0HGLWHUUDQHDQ Flounder a la MediterraneanThis healthy simple baked flounder dish simulates the taste of the Mediterranean. Serve flounder with a flavorful white wine sauce starring plum tomatoes, chopped olives and onions, chick peas, and your favorite seasonings. A delicious healthy choice any time, it’s also an impressive main dish for entertaining guests. Alternatively, substitute with sole, cod, tilapia or salmon fillet. Enjoy with mashed potatoes and a simple green vegetable salad. 4-6 slices flounder fillets 5 Roma (plum) tomatoes 2 Tbs extra virgin olive oil 1 tsp lemon juice 1 medium onion chopped 2 cloves garlic, chopped ¼ cup white wine ½ cup kalamata olives, pitted and chopped 1 cooked cup chick peas 6 leaves fresh basil, chopped Salt and Pepper to taste Preheat oven to 425 degrees F (220 degrees C).
Cook chick peas according to package directions or use from a can. Chop tomatoes, and set aside. Heat olive oil in a skillet over medium heat and sauté onion until tender. Stir in garlic and seasonings. Stir in tomatoes and cook until tender, about 10 minutes. Mix in wine, olives, chick peas and ½ the basil. Reduce heat allow to cook about 15 minutes. While sauce is cooking, place flounder in a shallow oiled baking dish. .Drizzle with 1 teaspoon oil and 1 teaspoon lemon juice. Roll up the fillets and place in a pan. Broil in the oven 10 minutes per side, until fish is easily flaked with a fork To serve cover with the sauce, and top with remaining basil leaves. Surround with chick peas Bake 5 minutes in the oven until all ingredients are heated through. Serve with mashed potatoes. Preparation 20 minutes Serves 4-6

Frying in the beer batter will yield a wonderful crust and moist tender fish. It is great for the occasional indulgence. The batter can also be used to coat onion rings or assorted vegetables like cauliflower, broccoli or sweet potatoes. The secret of itâ&#x20AC;&#x2DC;s success is the smooth batter and frying at high temperature. 6 tilapia fillet 2 cups flour +some for dredging the fish 1 tsp baking powder 1 tsp salt 2 eggs, slightly beaten 2 cups beer or seltzer ½ cup salad oil Oil for deep frying

Lemon wedges Pat fish dry and coat fish with flour set aside. In a large bowl, combine 2 cups flour, baking powder, salt, eggs, beer (or seltzer) and 1/2 cup oil beat well until smooth. Dip fish into batter, allowing excess to drip into bowl. Fry in deep pot allowing oil to heat to 375 degree oil until golden brown on both sides. Remove from pan. Drain on paper towels. Garnish with lemon wedges, serve with deep fried French fries and a tossed salad. Prep time 20 minutes Serves 6

It can be beautifully presented in a large tray accompanied by a side dish of herbed rice and julienned vegetables 1 large white fish, red snapper or other favorite fish. Ask your fish monger to suggest the best one for this dish. 2 Tbs olive oil 1 lemon cut in slices 1 Tbs sesame seeds 1 inch (2 1/2 cm) piece ginger, peeled, cut into wafer- thin strips 1 red bell pepper, cut into thin strips 1 zucchini cut julienne style 1 medium carrot cut julienne 1 chili pepper thinly sliced 1/3 cup (80ml) soy sauce 2Tbs vinegar ½ cup white wine 2 shallots (spring onions), sliced diagonally, to garnish 2 cups steamed rice, to serve
Have your fish monger clean, scale and cut fish in half lengthwise, while leaving it whole. Insert lemon slices into the belly of the fish. Brush a roasting pan with 1 tablespoon of the oil and place fish in the pan. Brush the flesh with remaining oil, season with salt and pepper, and sprinkle with the sesame seeds. Bake for 30 minutes or until the fish is cooked through (the flesh will flake away easily when tested with a fork). Meanwhile, in a frying pan place the ginger, chili, soy, vinegar and 2 tablespoons of water and the julienned vegetables. Cook over low heat until the vegetable have started to soften. Place the fish on a large platter and pour the dressing over top. Garnish with shallots and surround with rice. Bring platter to the table and serve individual portions accordingly, taking care to remove the spine with any bones of fish as you serve. Preparation 30 minutes Serves 6-8 depending on size of fish.

It can easily be on the table in 30 minutes. It strongly resembles the Mediterranean method of cooking. Bell peppers, olives, and tomatoes give a burst of flavor to otherwise bland cod fish. Event though we present this recipe with bland cod any firm whitefish (such as white fish, halibut and grouper) may be substituted for the cod. Adapt the recipe size to suit your needs. 4 cod fish filets (about 4 ounces each) 1 red and 1 yellow bell pepper cored, seeded, and sliced into 1/2-inch strips 1 medium sweet onion, halved and sliced into 1/2inch strips 5 whole cloves of garlic, peeled and chopped 1 Tbs extra-virgin olive oil

Place cod fillets in a baking dish. Set aside. Spray a nonstick skillet with cooking spray. Sauté the onion and garlic over medium heat for about 5 minutes. Add tomatoes, olives, lemon juice, seasonings, salt and pepper to taste. Simmer for 5 minutes, stirring occasionally. Spoon sauce over cod and bake for 10 minutes longer. Garnish with parsley and lemon wedges. Preparation 10 minutes Serves 4

In Dr. Fish’s extensive experience with substance abuse in the frum world, he has seen innumerable cases where the DEXVHU¶V ¿UVW H[SHULHQFH SUHFHGLQJ his decline was drinking on Purim or watching his father or older brother drink on Purim. How do we protect our teens? What is the best approach? Dr. Fish believes it isn’t realistic to forbid teenage sons from drinking any alcohol on Purim. The peer pressure is too strong. If the parent says not to drink anything on Purim, then once the teen has disobeyed his parents there will be no way to provide constraints for him on monitoring how much he drinks. He recommends holding a discussion with your teen before Purim on how much he is permitted to drink. Giving permission for regulated drinking takes away some of the power of the forbidden feeling of drinking. He recommends that parents give their teens a balanced message. For teens who have never experienced a drinking problem, guidelines can be given on how much the parent permits them to drink on Purim. (Teens who have had a problem with drinking should not drink at all.) For young teens, Dr. Fish suggests slightly more wine than they would normally drink on Shabbos. For boys 15 and over, some can handle two shots of liquor, which will make them tipsy but not drunk. It’s preferable for them to drink wine than hard drinks.
And they should never mix drinks. Prepare for Purim with your son ahead of time. Ask him what he perceives to be a realistic boundary for himself and then work out an agreement with him. Setting boundaries is part of the path to maturity. Anticipate the peer pressure he may experience to overdrink. Girls may also need guidelines as they are sometimes also at risk for unhealthy drinking behavior. “The parent’s behavior has bearing on the teen’s practices,” Dr. Fish contends. “If drinking is of prime importance to the father, what can one expect from the son? Parents need to be role models for consistently displaying maturity by being able to set boundaries and stick to them. They need to be able to show their kids that it is possible to have simcha
