The National Center for Assisted Living (NCAL), as your national Association, is at the forefront of emerging national policy impacting financing and operations for assisted living. LaShuan Bethea, the executive director for NCAL, will present on federal legislation impacting home- and community-based services; opportunities for quality recognition and population health led by the team at NCAL and the American Health Care Association; and workforce recruitment and retention initiatives at the national level. LaShuan Bethea is the executive director of the National Center for Assisted Living (NCAL)—the assisted living voice of the American Health Care Association (AHCA). She joined NCAL from Genesis HealthCare where she served in various leadership roles from 2007–2021. Ms. Bethea, a registered nurse and attorney, has a depth of long-term care

experience. She began at Genesis HealthCare in February 2007 and quickly advanced to the director of regulatory and program development before being promoted in 2015 to vice president of legislative affairs. She assumed a dual role as vice president of reimbursement in 2020 and was appointed to chair of the Diversity, Equity, and Inclusion Committee in June 2020. Ms. Bethea received her law degree from Widener University School of Law, Harrisburg, PA. She earned a master’s degree in education from American Intercontinental University and a Bachelor of Science in nursing from the University of Phoenix.

His expertise in the areas of diversity/equity/inclusion, leadership, and strategy has been honed while serving as an executive for some of the worlds most renowned companies. Most importantly, Daniel's approach reflects actual, relevant experience and provides proven solutions, rather than theory. The combination of practical experience coupled with his masterful management of the microphone produces the perfect mix of entertainment and insight for audiences across the globe. Daniel is one of the country’s most prominent voices from the millennial generation.

10:15 AM IMPROVING JOB QUALITY FOR DIRECT CARE WORKERS Direct care workers are essential to the health and quality of life of older adults and people with disabilities in various long-term care settings. Yet, their jobs are too often characterized by poor job quality, driving many of them out of this field and making it more difficult for employers to recruit and retain these workers. This session will explore PHI’s five pillars of job quality in direct care, which include 29 concrete strategies. It will also describe how a few long-term care providers around the country have designed job quality interventions to strengthen these jobs and how direct care workers in residential care settings are faring nationwide. Robert Espinoza is the vice president of policy at PHI, where he oversees its national advocacy,

research, and public education division on the direct care workforce, including its strategic direction and federal advocacy. In 2020, he was selected for the first-ever CARE 100 list of the most innovative people working to re-imagine how we care in America today and as one of Next Avenue’s 2020 Influencers in Aging. Robert is a nationally-recognized expert and frequent speaker on aging, long-term care, workforce, and equity issues. For more than 20 years, he has spearheaded high-profile advocacy campaigns and written landmark reports on aging and long-term care, LGBTQ rights, racial justice, and immigration, among other topics. Robert received his MPA from New York University, his BA in English and BS in journalism from the University of Colorado at Boulder, and a graduate of the Rockwood Leadership Institute.

1-A: SERENITY, COURAGE, AND WISDOM: BUILDING YOUR TEAM IN CHALLENGING TIMES

These are tough times for recruiting and retaining the talent we need to provide services. The labor market is tight and complex, and the transition to an endemic stage of COVID-19 poses a host of further challenges. This session will present strategies and practical skills based on three concepts—serenity, courage, and wisdom. Session participants will learn how to reflect on the current situation with clarity and without panic, using data and information to guide decisions. Participants will gain techniques and insights to foster and improve job quality and build inclusive and respectful workplace cultures. 1-B: COGNITIVE ASSESSMENTS IN ASSISTED LIVING

Resident cognitive assessments are required under Minnesota Statutes 144G. In this session, understand the rationale behind the requirement and explore validated tools that staff can use for assessment. 1-C: NAVIGATING THE MINNESOTA FOOD CODE

As recent assisted living surveys indicate, there is a knowledge gap by some assisted living providers on the Minnesota Food Code. The key to a food-safe establishment is understanding the rules in the code. In this session, explore resources to understand rules, learn the kitchen survey process, and find out how to prepare for a survey. Through interactive learning, the audience will uncover common food safety misconceptions and leave the session with the knowledge and tools for creating a clean, food-safe, and compliant facility. 2-A: ASSISTED LIVING CONTRACT TERMINATION AND NON-RENEWAL STRATEGIES

This session will educate participants on the new requirements under Minnesota Statutes 144G for involuntary contract terminations and nonrenewal of contracts. Attorneys Rob Rodè and Rebecca Coffin will review facility requirements starting with the pre-termination notice through relocation planning and possible appeals of the termination. They will also discuss options and strategies for the non-renewal of the assisted living contract. Examples of non-payment and threatening behavioral issues will be addressed in this context. 2-B: STRATEGIES FOR CHALLENGING BEHAVIORS

Challenging behaviors can have a significant impact on an assisted living facility, affecting not only the resident with the behaviors but also staff and other residents. Challenging behaviors, if uncontrolled, can lead to termination of services. In this session, learn some causes of challenging behaviors and effective strategies to minimize occurrences, practical responses when behaviors happen, and tips for staff.

In keeping with the recommendations from the Centers for Disease Control & Prevention (CDC), we are instituting the following COVID-19 protocols for this Assisted Living Summit: 1

All attendees, speakers, and vendors must be fully vaccinated and attest to their vaccination status when registering—including uploading vaccination documentation or have an approved exemption*. To be considered fully vaccinated, you must be two weeks past your second dose in a two-dose series (Pfizer or Moderna) or two weeks past a singledose vaccine (J&J/Janssen).

At the time of the conference, masks may be required for all attendees based on community transmission levels in Hennepin County—so be prepared by bringing a mask with you.

All attendees must stay home if they feel ill. According to the CDC, people with COVID-19 have had a wide range of symptoms reported—ranging from mild symptoms to severe illness. Symptoms may appear 2-14 days after exposure to the virus. Anyone can have mild to severe symptoms.

If you begin to feel ill while at the summit or find out during the summit you had been in close contact with someone who recently tested positive: • Immediately leave the conference center if you feel COVID-19 symptoms. • Get tested for COVID-19 ASAP and report any positive result to known contacts.

After our event, to err on the side of caution, we strongly encourage all attendees to get tested 2-3 days after the summit, whether or not they have any COVID-19 symptoms.

2-C: LESSONS FROM COVID-19 IN THE AL SETTING—A PHYSICIAN PERSPECTIVE

This session will describe lessons learned from the speaker’s experience of leading a group of facility-based clinicians through the COVID-19 pandemic. From a medical provider’s point of view, Dr. Turbes will discuss what COVID-related challenges facilities handled well using systems they already had in place; and what areas showed gaps and opportunities to be better prepared for future infectious outbreaks and other emergencies. Topics will include infection prevention and preparedness, facility relationships with clinicians, and strategies for responding to medical concerns in facilities with different models and levels of care. Minnesota’s new assisted living licensure (ALL) requires compliance with new emergency preparedness requirements for your assisted living or assisted living with dementia care. While the ALL 144G statutes include a basic set of emergency preparedness requirements, the ALL rules include a substantial number of new emergency preparedness requirements. This session will provide an overview of what ALL facilities will need to do for compliant emergency preparedness programs. Also, hear what survey results are telling us.

This session addresses the legal considerations related to admission and re-admission practices. Under the new assisted living law, it is much harder to end a resident’s housing and services. As a result, it is even more critical for providers to define themselves and the services they offer in an effort to bring the most appropriate residents into their settings. Providers need to learn the art of saying “no” to prospective residents and how to manage situations where an existing resident’s needs exceed a provider’s service capacity. Learn the elements you can impact and support for those living with dementia and their family members. SURVEY PREPARATION AND SUCCESS: HOW ARE WE DOING SO FAR UNDER THE NEW LAW? Doug Beardsley, Vice President of Member Services, Care Providers of Minnesota

Care Providers of Minnesota’s resident regulatory expert, Doug Beardsley, will highlight the types of licensing orders being issued by the Minnesota Department of Health (MDH) under the new assisted living regulations. He will provide resources to identify potential behaviors or systems that might increase the probability of receiving a licensing order during a complaint survey or standard survey, and suggestions to avoid those citations.

CEUS The Assisted Living Summit is accredited by the Minnesota Board of Executives for Long-Term Services and Supports (BELTSS) for licensed assisted living directors, nursing home administrators, and health services executives. The summit is designed to meet the Minnesota Board of Nursing criteria for contact hours. The Board of Nursing does not pre-approve continuing education.

The cut-off date for the room block is April 19, 2022.
