I recently received a letter from the Fair Housing Council of Oregon regarding my suspect actions. I denied a Latino family's application based on their rental and credit history. Fair Housing stated that they were concerned that this family was "denied the opportunity to rent from me based on their race and familial status." The letter went on to "demand the non-discriminatory reason" they were denied. They also added "we demand that you allow them to apply to housing opportunities where they meet the required rental and screening criteria". Fair Housing is the Law. We should all be aware that anyone who is renting properties can be accused of discrimination at any time. The accusations can be based on facts (as someone else perceives them), or they can even be based on an impression, or feeling. What can YOU do to protect yourself from a Fair Housing complaint? # 1 - Don't Discriminate. Don't treat anyone different. Offer applications to anyone who inquires. Use Written Screening Guidelines. Form # 45. The fact is, it doesn't matter if the applicant is GREEN and comes from the planet Mars. They might look different, speak with an accent, or even have three eyes - but if they meet your screening guidelines they will probably be great tenants. Rent to them. # 2 - Be Honest. If you deny an application, tell the applicant why. This is not the time to be coy. The applicant has a right to know why you denied the application. I know sometimes this is uncomfortable and some rental owners would like the applicant to just go away. But, this is a business and you need to just get over it. Use form # 43 Application Denial. If the applicant calls you, answer the questions. Your application was denied because...... And remember you MUST mail them a copy of # 43 if you collected a screening fee.

# 3 - Keep Records. This should be tattooed on your wrist. Judge Judy has a favorite saying, "Show me where it's written down." I love her, in my next life - I want to be her! Basically, if it's not written down, it didn't happen. Every time you have contact with an applicant or tenant, you should be jotting down what was discussed and any action you took. Don't depend on your memory, and I can guarantee if there is a dispute, the other person will remember it differently than you do.

Be aware and operate your business legally. Treat all applicants the same. Use written screening guidelines to help keep you on track, and to show applicants what you are looking for in a tenant. Don't expect that your good intentions are enough to prove that you aren't discriminating. Prove what you do with written documents. Start today!

Ask Kenny! Question:

My unit is ready for inspection and move-in on the 15th of the month but the housing inspector can't inspect the unit until the 25th....what do I do? Can I still start the tenant's rent and move them in or do I have to wait? I don't want to lose 10 days of rent!

Answer:

If you find that the inspection timing is too far out to accommodate the expected move in date, then it may be worth it to contact a supervisor at Housing Works and ask for an expedited inspection. Housing Works may not make any housing assistance payments for days prior to the inspection passing. An owner may opt to move a voucher tenant in prior to the unit passing inspection but the tenant Please do not ask them for help would be responsible for the full rent payment during this time. Once the unit filling out forms or other advice passes inspection, the landlord will most likely need to revise any lease agreement about tenant/landlord matters. so that the contract dates coincide with the HAP contract dates (which cannot begin prior to the inspection pass date). Do You Appreciate Your Tenants? As property managers, we're all aware of the multitude of issues that frequently arise with unreliable tenants. Late rental payments, disturbing the peace, illegal activity, and a general disregard for the property are all problems that typically arise in the property management industry. Many times, we're so focused on dealing with the problems prevalent in the property management industry that we overlook the tenants that always pay on time; the tenants that take good care of their property, the tenants that are considerate of their neighbors. How do we make sure that those tenants are happy? That they feel appreciated? That they know that we want them to remain tenants as long as possible? Chances are those good tenants are feeling unappreciated right now; which means that they will have no reason to stay at your property if a better opportunity opens elsewhere. It's so important to remember that a rental agreement is between two separate parties, and just like any of us, our tenants like to know that they're appreciated. Here are just a few ways to show your tenants that they are appreciated: 

Be sure to take their concerns seriously. If your tenant calls to complain about loud music at midnight, or unauthorized vehicles in their parking spot, take prompt action and make sure that you advise them of both the action and the outcome; don't make them complain more than once about the same issue.

Fulfill the promises that you make. If you promise a tenant a new dishwasher or new carpeting, be sure to fulfill that promise. Don't make them ask you about it. Just schedule a time and do it.

Respond promptly to any and all maintenance requests. If a tenant is responsible and takes good care of the property, they shouldn't have to wait three months to have their stove repaired.

Bend the rules - just a little. Should you wave a late fee - due to a mix-up with the post office for a reliable tenant that is never late with their rent? While opinions vary, remember that a good tenant is like a good customer, and it may be appropriate to bend the rules now and then. That's not discrimination; that's good business sense.

Give them a gift. A gift card to a local store at lease renewal time, or a card on their birthday will make a tenant feel appreciated, and build loyalty in the process.

This agreement is made between the Owner/Agent and the Tenant identified above.

1) Purpose of this Agreement: Both parties benefit from a smoke-free environment. The Owner/Agent expects lower maintenance and cleaning costs and a reduced likelihood of fire. The Tenant expects to be exposed to less smoke, including secondhand smoke.

2) Definitions: “Smoking” means inhaling, exhaling, breathing, carrying, or disposing of any lighted cigar, cigarette, or other tobacco or similar substance, including marijuana. 3) Agreement: Tenant agrees to prohibit smoking in the Tenant’s dwelling unit or, except as provided in Section 8 below, anywhere on the premises. Except as provided in Section 8 below, Owner/Agent agrees to prohibit smoking in the common areas, including the grounds.

4) Tenant’s duties: Tenant will inform household members and visitors of this No Smoking Policy. Tenant will enforce this policy in the Tenant’s residence and on household members and visitors elsewhere on the premises. Tenant will report to Owner/Agent in writing any incident of smoke migrating into Tenant’s residence or any observed violation of the No Smoking Policy. 5) Owner/Agent’s duties: Owner/Agent may post no-smoking signs around the premises so that residents, guests, and visitors will be warned that smoking is prohibited on the premises. 6) No warranty: Owner/Agent does not warrant the premises will be free of smoke or second-hand smoke. Owner/Agent does not warrant that air quality in the dwelling unit will be higher than in any other rental property.
