Help Your Process Server to Save Time in Your Eviction. One of the longest delays in processing evictions occurs when not all occupants are served personally (hand to hand) with the unlawful detainer summons and complaint. More often than not, the occupants know they must be legally served in order for the court to award a judgment for possession of the subject property. If they are sophisticated, they know that they can delay the time for the eviction by two to three weeks if they successfully avoid the process server. If the unlawful detainer is not served in person, it can be served on another person who resides at the property or on the person in charge of the place of employment of the occupant, so long as they are of sound mind and at least 18 years of age. If no one can be found to substitute serve, then the court will allow the process server to post the unlawful detainer on the front door of the subject property and mail a copy by certified mail, but only after the court has signed an order allowing for this method of service. Most courts also require process servers to attempt to serve the unlawful detainer personally for three consecutive days, with both morning and afternoon/evening attempts before the suit can be served by substituted service. Once served by substitution, the occupant has a total of 15 days to file responsive papers in court instead of the normal five days following a personal service. Therefore it is crucial that the process server is able to serve each occupant personally (hand to hand) to avoid a two to three week delay in your case. The more information provided to the process server, the more likely he/she will be able to quickly serve all occupants personally with the unlawful detainer action. We recently polled our process servers to find out what is most helpful to them in serving all occupants personally with the unlawful detainer. Below are some of the most helpful ways you can assist your process server in achieving a personal serve on all occupants.

Help Your Process Server to Save Time in Your Eviction. (Cont.) Places of Employment It is much easier to avoid a process server at home, rather at the occupant's place of employment. To avoid the process server at home, they simply don't answer the door. Therefore, it is important to include the occupant's verified place of employment to improve your chances of a personal serve. Description of Occupant's Vehicle and Parking Space Number It is easy for the process server to tell if the occupants are home by checking their parking space and/or description of their car with license plate. If a stake out is necessary, it is also a good place to wait until the occupant wants to leave in their vehicle. Best Time to Find Home It is helpful to know the best time to find the occupant at home. Occupants who work a late shift versus someone who is unemployed makes a big difference as to the best time the process server can expect to find the occupants at home. Security Codes or Keys Many times our process servers have to wait for someone to enter or exit the property before they can even get to the occupant's door. It is very helpful to give the process server the gate code or keys so they can gain entry. Every process server we use is licensed and bonded. Dangerous Animals or Conditions It is important to keep the process servers aware of any dangerous conditions or animals on the property so they can take necessary precautions.

If there are several buildings, describe the building where the subject property is located so the correct unit is easy to identify. An important part of our unlawful detainer practice is to ensure the process server assigned to your case has all of the information necessary to serve each occupant in person. Ask Kenny! Question: Under House Bill 2639 (aka. The Section 8 Bill), there is an established landlord mitigation fund that provides for reimbursement of damages should a Housing Choice Voucher (Section 8) recipient damage a unit. If I become aware of damages to my unit, how do I file a claim for reimbursement?

Answer: To be eligible for the Landlord Mitigation Fund, landlords must have leased to tenants through the HUD Housing Choice Voucher Program, also known as Section 8. The damages to the residence must exceed normal wear and tear, and must have occurred after July 1, 2014. To qualify for program assistance, a landlord must first obtain a judgment against a tenant from a court in an Oregon county, in which either the tenant or the property is located. (a) The judgment must be from a circuit court, a small claims department of a circuit court, or a justice court; (b) The time frame for appeal of the judgment must have expired without appeal or the judgment must otherwise not be subject to further judicial review. Program assistance is limited to reimbursement for those amounts covered in a final judgment. Claim reimbursements may include expenses related to property damage, unpaid rent, or other damages satisfactorily described and documented in a claim from the landlord to OHCS. Property damage claims must include the following: a) Property damage incurred after July 1, 2014; b) Property damage was caused as a result of a tenant's occupancy, pursuant to a rental agreement under the Housing Choice Voucher Program at the time the damage was incurred; c) Damage to property exceeds normal wear and tear; and d) Expenses for repairs are in excess of $500, but not more than $5,000 per tenancy. Types of Program Assistance: (a) Partial Reimbursements: Program assistance may be available for damages in amounts less than $500 when a partial amount is still owed on a judgment that is in excess of $500. For example, if a landlord received a payment of $400 on a $700 judgment on qualifying damages, the landlord may seek reimbursement for the remaining $300 owed to them under the judgment. (b) Reimbursements up to $5,000: Program assistance for damages up to $5,000 may be provided on a judgment that is in excess of $5,000. For example, if a landlord has a judgment for $7,000 for qualifying damages, the landlord may see reimbursement for up to $5,000 of the qualifying damages. Qualifying damages include: a) Attorney fees, court costs, and interest; b) Loss of rental income during the time required for repairs to with respect to qualifying property damage; c) Lease-break fees; d) Pre-judgment and/or post-judgment interest; e) Other costs related to lease violations by a tenant such as repair labor, materials, disposal fees, etc.


A landlord may not seek, accept or retain program assistance from the department for amounts already paid for qualifying damages by the tenant or by a third party. If, after submitting a claim for program assistance, a landlord receives payment for any claimed damages from a tenant or a third party, the landlord must notify the department within ten (10) days of such payment. A landlord must provide restitution to the department for overpaid program assistance within forty-five (45) days. The department will maintain a record of program assistance provided to a landlord to assist in determining if there has been an over-payment of program assistance. Program Delivery A landlord must submit a claim for program assistance to the Department within one year of obtaining a judgment against a qualified tenant. The time frame for appeal of the judgment must have expired without appeal or the judgment must otherwise not be subject to further judicial review. The application is available online at: http://www.oregon.gov/ohcs/Pages/css_housing_choice_landlord_guarantee_assistance.aspx After submission of the application, OHCS will notify applicants if the application is incomplete within ten (10) days. OHCS will process applications and payments to landlords within forty-five (45) days. After receiving assistance, a landlord must file a satisfaction of judgment within thirty (30) days in the amount of any program assistance received from the department in the court from which the judgment against the tenant was obtained. A copy of this filed satisfaction of judgment must be delivered to the department within forty (40) days of the landlord's receipt of the program assistance. Tenants whose landlords have received a judgment against them and submitted claims for assistance will be requested to repay the assistance. OHCS will contact tenants to request repayment, and will assist in creating reasonable repayment plans. OHCS may waive or suspend debt owed by tenants as circumstances dictate. OHCS may also send the debt to the Department of Revenue for collection.

FORM OF THE MONTH - FORM #35 Warning Notice Non-compliance Fees & Your Tenant Most rental owners/managers have experienced the irritation and frustration of a tenant not going by the rules; all too common are unauthorized pets, trash left in the yard or cars parked on the lawn. A polite but firm, "Please address this problem immediately", didn't get the desired effect. What's your next step? Form # 35 Warning Notice was designed just for this situation. This notice puts some teeth behind your request for the tenant to adhere to the rental agreement they signed. A written warning notice serves several purposes. It starts a paper trail, it says you're serious, & it makes it possible for you to collect non-compliance fees. Remember, the law changed & you must serve this warning notice once, on the next violation you can charge $50 & for every subsequent violation of the same type you can collect $50 plus 5% of the monthly rent. Form # 35 can be served with a 30 Day With Cause Notice to Vacate Form # 38. If served together, for instance for an unauthorized pet, this notice sets the stage for an eviction if they remove the pet - but brings it back anytime within the next 6 months. Ignoring behavior that is prohibited, like an unauthorized pet could create a waiver, you could end up in a situation where you must accept the pet. A paper trail is your proof that you said NO & you mean it. When you ignore behavior the message your tenant receives is that this isn't really important. Serving a Warning Notice says, "Stop now or pay the price." Frustrated that your tenant isn't taking you serious? Feel like you have no power to change their behavior? Form # 35 Warning Notice is the first step to start the paper trail of your tenant's bad behavior & to being able to collect non-compliance fees.
