As New York Moves to Become First Age-Friendly State, Livability Experts Convene in Albany AARP’s “Leading on Livability” Summit Offers Best Practices to Make NY a Great Place to Grow Old

AARP New York hosted its first “Leading on Livability” conference in Albany to identify and prioritize action steps as Gov. Andrew Cuomo moves to make New York the nation’s first agefriendly state. The age-friendly movement promotes welldesigned, livable communities that help people stay active and healthy and sustain economic growth. AARP is the World Health Organization’s American affiliate to help communities achieve age-friendly certification. The WHO designation would certify the commitment of the state’s government to actively make age-friendly improvements throughout its work. To date, 163 localities nationally and 16 New York locations have attained certification, including New York City, Westchester County, Albany County, Ithaca, Elmira and Erie County. AARP says the movement can stem the tide of retirees leaving the state for more livable and affordable locales. “New Yorkers 50 and over contribute nearly $600 billion to the state economy—what we call the longevity economy,” said AARP State Director Beth Finkel. “But in recent decades, we’ve seen a dramatic migration out of the state, creating an economic and intellectual loss. AARP convened this summit to look at the statewide and local approaches that will make New York better for people of all ages.” The two-day conference attracted more than 100 academics, government officials, urban planners and nonprofit leaders to discuss ways the state and its communities can improve their livability. In her keynote speech, Dr. Jo Ivey Boufford, President of the New York Academy of Medicine, said the focus on age-friendly policies can benefit the overall society. She noted that many livability policies are a result of feedback from older adults.

“Changing the environment is more effective than changing behavior,” she said. In New York City, for example, Boufford said bus shelters were redesigned to include benches and lighting, countdown clocks and restricted car turns were added at pedestrian crossings to improve safety, and senior hours were created at public pools to encourage physical activity and socialization. Age-Friendly initiatives can encourage seniors to age in place, speakers said, but failure to adopt these policies could negatively impact the state and localities for years to come. Today, 20 percent of public retirement checks are mailed out of New York State, according to the State Comptroller’s Office. Assemblywoman Donna Lupardo, Chair of the Assembly Aging Committee, told participants that “aging in place” should be thought of in a different way: “And that’s aging in style,” she said. “We who grew up in the hippie generation, we intend to live well to the very end.” AARP’s Finkel added that failure to accommodate an aging population also would result in greater use of nursing homes, which are largely funded by taxpayers through the state’s Medicaid program. “The big argument for aging in place is you live longer and you live better, but you also stay out of institutions. That’s incredibly important for our state budget,” she said. In a series of keynotes and panel discussions, summit participants highlighted the eight livability domains recognized by the WHO: outdoor spaces and buildings, transportation, housing, social participation, respect and social inclusion, civic participation and employment, communication and information, and community and health services. A session on down revitalization shared the successes of Capital Region to actively create agefriendly communities. Albany Mayor Kathy Sheehan, describing the redesign of Madison Avenue in Albany, said it involved considering the views of not only motorists, but also pedestrians, cyclists and retailers. “We all got together and reached a consensus through compromise—everyone had to give up something,” she said. Many conference participants were intrigued by the concept of “tactical urbanism,” which advocates low-cost, neighborhood-driven and often temporary changes in the built environment to improve neighborhood livability. Street Plans Collaborative, cited the Bloomberg administration’s plan to close off Times Square to cars, which was initially opposed by local businesses. However, a Memorial Day weekend test run showed retailers benefitted from the increased foot traffic. With the backing of the local Business Improvement District, the closure was made permanent and extended along Broadway. Age-friendly design can also extend beyond large-scale infrastructure to the design of buildings and other parts of the physical environment that can enhance the way residents age and improve health outcomes. Esther Greenhouse, an environmental gerontologist, said builders are often oblivious to design ideas that would enhance the livability of new buildings as residents age. “New buildings are dinosaurs,” she said. “We need to put in features so can be used across life spans. We don’t have housing that enables people to age in place.” She said she was also leery of using the term “universal design” because it often becomes equated with design for the frail or disabled. “I prefer the term ‘enabling design,’ ” she said. “That puts the focus on the purpose, which is to build environments that enable people to thrive.” Building on the summit, AARP will release a white paper this year focused on learnings that can support the governor’s application to the WHO for New York to become the first certified age-friendly state. “It has to be a community-government partnership,” said AARP Livable Communities Advisor Bill Armbruster. “You want to go from a great place to grow up to a great place to grow up and grow old.”

Congress passed a budget last week that will keep the federal government running through September. While President Donald Trump fell short on some of his top priorities, including a wall on the U.S.-Mexico border, others were pleased with the outcome. New York City, for example, dodged deep cuts to housing programs. The president called for slashing the U.S. Department of Housing and Urban Development’s budget by $6 billion, but even the Community Development Block Grant program, which Trump wanted to eliminate, maintained its funding level at $3 billion. Housing will likely be targeted again in the next round of budget talks. And federal cuts would be just the latest housing challenge in the city, where officials have struggled with homelessness and a rental market that prices out many residents. DOES TRUMPCARE FOR NEW YORK? The American Health Care Act made it through the U.S. House, spurring widespread Democratic attacks. Gov. Andrew Cuomo called the plan “a targeted assault against our values” that would shift Medicaid funding from New York counties to the state, thanks to a deal brokered by upstate Reps. Chris Collins and John Faso. Staten Island Rep. Dan Donovan and Central New York Rep. John Katko were among the 20 Republicans who voted “no,” citing the financial burden to constituents. MILLIKEN SAFE … FOR NOW “I wouldn’t make any long-term plans for a future in New York,” is what a top bochinchero told B&B in a breakfast after we reported in our April 8 issue that a search was on for CUNY Chancellor James Milliken’s replacement. Out of eight CUNY insiders who reacted to the buzz about Milliken’s potential ouster, only this bochinchero said, “There is no active search for a new chancellor.” The bochinchero understood why there were rumors about Milliken’s job security. However, Milliken’s cancer treatment – he announced on March 31 that he had recently been diagnosed with throat cancer – has been taken into account. So, the CUNY chancellor’s trabajo is secure for now.

Assemblyman Luis Sepúlveda has been heard belting out the chorus line from the ’70s hit “Quitate tu, pa’ ponerme yo” (Take yourself out, so I can step in), by the Fania All Stars featured in the 1972 film “Our Latin Thing.” A bochinchero from the Bronx told us, “Sepúlveda is set to go as soon as the Rev. (Rubén Díaz Sr.) wins the council race.” Díaz is running for the 18th City Council District seat currently held by Annabel Palma, who is term-limited. The bochinchero says that Sepúlveda doesn’t yet have a deal with Díaz. “He’s endorsed the senator and is expecting him to reciprocate.” Hmm, I hope Sepúlveda doesn’t sit on ice waiting for that to happen. Given the tangled web in Bronx County, he could wind up with a wet culo (ass).

The latest buzz in Queens is that Assemblyman Francisco Moya is preparing – and being encouraged – to challenge state Sen. José Peralta in a primary next year. According to a well-versed Queens bochinchero, the Democratic county organization is so “freaking pissed off at Peralta’s IDC move” that they’ve talked with Moya to go after the “treacherous Peralta.” Hmm, Moya was supposed to challenge Julissa FerrerasCopeland for her New York City Council seat, but that didn’t go beyond the bochinche stage. “They’re counting on Hiram (Monserrate) to make Julissa lose sleep.” And that may be good enough for county insiders who don’t trust or like Ferreras-Copeland, the City Council’s Finance Committee chairwoman, and hate Monserrate. “Let them beat each other up,” is what one bochinchero tells me they’re praying for.

Republican bochincheros are telling B&B that there is growing restlessness with state Senate Majority Leader John Flanagan’s continued relationship with the Independent Democratic Conference. “Seeing (IDC Leader Jeffrey) Klein’s recent presser with labor leaders really pissed them off.” While acknowledging that the Republican conference in the state Senate has benefited from the power-sharing arrangement, “it’s time to start letting loose.” One bochinchero did concede that the only real ally that they have across the aisle is Simcha Felder. “Most of the time we know what Simcha wants and he knows what we need.” They don’t trust Klein or the IDC and Republican dissenters say, “Flanagan has to start cutting ties.” And if he doesn’t? A few of the bochincheros that we spoke to separately think that Flanagan’s days as leader are numbered. Sounds like a wolf ticket to me.

Why wait 10 years to fix the Rikers problem? By NICK MALINOWSKI SEVERAL WEEKS AGO, New York City Mayor Bill de Blasio, after a concerted push from grass-roots activists, finally threw his support behind an idea that was decades in the making: shutting down the troubled jail complex at Rikers Island, which has become synonymous with human rights carnage, corruption, violence and racism, and represented a concrete, undeniable barrier to the

city positioning itself as a progressive national idea. The mayor’s announcement coincided with the formal release of the final report of the Independent Commission on New York City Criminal Justice and Incarceration Reform – also known as the Lippman Commission – which unequivocally called for the city to close Rikers Island.

The idea of closing the 10 jails on Rikers has widespread popular support, with a large number of community groups and everyday New Yorkers in favor of the plan. Several New York City Council members have said they would welcome new jails in their neighborhoods if that’s what it took to get “torture island” shut down. Correction officers and the New York Post editorial board appear to be the loudest opponents.

Nevertheless, a variety of pundits have splashed cold water on the proposal, citing the tortuous Uniform Land Use Review Procedure and persistent NIMBYism to suggest that closing Rikers, no matter the value to public safety and the overall public good, will be difficult, or perhaps impossible. But these issues are, in large part, a distraction that lets elected officials off the hook from the immediate actions they can take today to improve the system. Closing Rikers is not, for most of us, the endgame; rather, the real goal is the development of a smaller, fairer, more humane, less racially discriminatory system of pretrial process and reinvest-

It is a well-held empirical truth that the rate at which U.S. cities toss people in jail has no relation to crime; a simple scan of national jail populations will show the eccentric, irrational nature of this phenomenon. Racial disparities are the only constant. Indeed, even in New York City, while both crime and the jail population have declined since the early 1990s – primarily a result of community organizing and advocacy – the jail reductions have come more slowly, decreasing by 53 percent as major crime declined by 76 percent. Had the jail rate dropped in unison with the crime rate, we would have already reached de Blasio’s arbitrary benchmark of reducing the city jail population to 7,000, which would be the first step in the process of removing people from Rikers Island for good. Ninety percent of defendants are held in city jails on a misdemeanor charge, and 78 percent of those held on a felony charge pose only a minimal to moderate risk of rearrest on a violent felony,

according to a study by the Center for Court Innovation. This means there is no public safety justification for holding most of the people on Rikers Island in jail while they wait for their cases to be adjudicated. While the mayor suggested winding down the jail system over 10 years – as the Lippman report did – this is an arbitrary timeline. In California, unconstitutional conditions required a sudden, dramatic reduction of the number of imprisoned people – with positive results. New Orleans experienced similar results after the city’s jails were partly destroyed during Hurricane Katrina. And there is precedent for expedited prison shrinkage in New York City: In 1983, the city immediately released 423 people from Rikers Island under a federal court order to address unconstitutional overcrowding. There are people throwing up their hands and saying, “What are you going to do? Just release people out into the street, with no supervision, no job, no housing?” We must recognize that this is happening right now with approximately half of the city jail population turning over each week and 90 percent of the population returning directly from Rikers to communities in our city within a year. As the Lippman report said: “Individuals who go into jail with problems – substance abuse, mental health disorders, lack of education, etc. – tend to come out with those problems exacerbated.” Despite the well-documented horrors of the jails on Rikers Island and elsewhere throughout the city, the political realities of New York City are such that we unfortunately cannot rely on elected officials to take this type of principled approach to swift and sudden decarceration; and yet every delay comes at an enormous expense to our communities and for those that will go through the jails as we muddle toward reforms. Here are some immediate steps the city can take: • De Blasio must immediately commit to abandoning proposals to build a new jail on Rikers Island and should reinvest this money in a combination of deeply affordable housing units and supportive housing for the hundreds of people who currently cycle repeatedly through city jails on low-level charges. He should also address the front end of the system by ending arrests for fare evasion, marijuana possession and other so-called “bro-

ken windows” charges, while increasing transparency and accountability for police officers. He should act on the Lippman Commission recommendation to divert as many as 113,000 criminal cases away from criminal court to ease court congestion. • Gov. Andrew Cuomo, who has also publicly supported the closure of Rikers Island, should stop vetoing bills (like the recent gravity knife legislation) that would reduce the number of people needlessly caught up in the criminal justice system. He must start showing leadership on fundamental system reforms that require state legislation like changes to speedy trial rules and discovery reform. He should crack down on corruption in the commercial bail bond industry, which causes people who have posted bond to spend extra days needlessly on Rikers Island, while siphoning millions of dollars each year from communities that can least afford it. • District attorneys argue in court every day to send people to Rikers Island on bail amounts they cannot afford, and argue to keep people there who have shown repeatedly that they are unable to pay the bail amount set by a judge. They should stop asking for bail in almost all cases and should start stipulating a release from jail for people who have been jailed solely because they could not afford to buy their way out. They should follow the lead of Cook County State’s Attorney Kim Foxx in Chicago who is simply releasing people from jail who are being held on low bail they cannot afford. District attorneys must also immediately provide defendants and their attorneys with all evidence. We recently learned about Antoine Morris, who spent months at Rikers Island before having his case dismissed, all because his defense attorney never received relevant 911 calls, one of the most basic pieces of evidence. He should never have spent a day in jail. The broad political support to shut down the 10 jails on Rikers Island is indeed a welcomed victory, but really, we are just getting started.

Today’s rising tide of homelessness is strikingly similar to the Koch and Dinkins years. But can de Blasio succeed where they failed? By NICK POWELL

A

FTER POURING MORE than a billion dollars into a series of piecemeal initiatives that failed to stem the tide of homelessness, New York City Mayor Bill de Blasio made a major policy pivot. With a record 62,435 people living in city shelters as of February, the mayor announced his administration would open 90 new homeless shelters, expand 30 existing shelters and phase out the use of 360 hotels and privately-owned cluster apartment sites that house homeless families. But when it comes to solving the puzzle of homelessness in New York City, the more things change, the more they appear to stay the same.

The contours of de Blasio’s plan is strikingly similar to the shelter siting plan that former Mayor Ed Koch started in the midto-late 1980s, and that his successor David Dinkins tried but failed to execute – an effort to reshape the footprint of the shelter system by building 20 to 30 new facilities and phasing out welfare hotels. The current initiative is on a much larger scale, and is ambitious enough to reset the city’s entire approach to housing the homeless and to homeless prevention. The current administration will also try to thread a tricky needle by keeping homeless people in the communities where they lived before entering the shelter system while also distributing shelters proportionally across the city – perhaps the most striking departure from the Dinkins and Koch plans.

At the center of the debate, once again, is Steven Banks. As the social services commissioner, Banks is tasked with carrying out the city’s new policy. Previously one of the city’s foremost homeless advocates, he has seen every administration since Koch’s fail to get a solid handle on the city’s homeless problem. As the homeless population mushroomed under Koch, Banks became a vocal critic of the administration’s slapdash creation of the city’s shelter system – a response to the landmark 1981 Callahan v. Carey consent decree that initially enshrined the right to shelter. The court case forced the city to scramble to find shelter sites, such as cityand state-owned armories and buildings – often with little or no community notice – and worry about implementation later.

Koch launched his landmark affordable housing program in 1986, resulting in significant reductions in New York City’s homeless population and creating 15,000 housing units for homeless people. But Banks continued to rail against the administration for cramming homeless individuals in barracks-style shelters or welfare hotels with substandard living conditions. David Dinkins’ election in 1989 gave advocates like Banks hope that a new mayor would provide a fresh perspective to the homelessness conundrum – fairly similar to when de Blasio succeeded Michael Bloomberg. As a mayoral candidate, Dinkins slammed the Koch administration’s handling of the homelessness boom, rejecting Koch’s plan to build new shelters in favor

of rehabilitating vacant apartments for homeless families – seemingly a direct response to Banks’ continuous push for permanent housing solutions. But within months of taking office, Dinkins was forced to confront a homelessness crisis that had grown unwieldy. In the summer of 1990, a deluge of families entered the system, attributed to the city’s policy under the Callahan ruling of giving homeless people in welfare hotels priority for new apartments. By September 1991, the city was providing shelter for an average of 23,000 homeless people every night, leading Dinkins to tap Andrew Cuomo, a wunderkind nonprofit affordable housing developer, to head a commission tasked with developing broad solutions to solving homelessness.

But toward the end of 1992, the crisis was so bad that hundreds of homeless families were sleeping in overcrowded city intake offices waiting for shelter, leading a state Supreme Court judge to hold four city officials in contempt of court. Meanwhile, Banks was in the midst of his own legal battle against the Dinkins administration – the McCain v. Koch case – on behalf of families for whom the city had provided insufficient shelter. The case would, in many ways, shape Banks’ guiding philosophy as one of the chief architects of de Blasio’s homelessness policy. While cross-examining Jeffrey Carples, chief of staff to Cesar Perales, Dinkins’ deputy mayor for health and human services, Banks asked what it would take for New York City to comply with the city’s right to shelter mandate.

– NANCY WACKSTEIN, former director of the Mayor’s Office on Homelessness “(Carples) said, ‘A combination of prevention services, decent shelter and permanent housing,’” Banks recalled in a recent interview. “I asked him to explain his answer, and he said, ‘Well you need enough resources to prevent people coming into the system wherever possible, you need to have shelter that’s decent, and you need to have enough permanent housing so that there’s a flow in and out of the system.’ “Over the sweep of almost 40 years that I’ve been representing homeless people, first as a Legal Aid (Society) lawyer and now as commissioner of social services, the (shelter) system was built up in a very haphazard way,” Banks continued. “And unlike what Jeff Carples said so many years

ago, the provision of ‘high-quality’ shelter didn’t have a guiding principle. That guiding principle now is community.”

F THIS TALE of the Dinkins administration’s struggle managing the homelessness problem sounds familiar, it’s largely because de Blasio and Banks are still fighting similar battles – cleaning up the messes left behind by previous administrations while attempting to steer the city on a course to reduce the homeless population. Banks believes that the administration’s new policy sets the

city on a course to correct Koch’s initial mistakes in setting up the shelter system – namely, not establishing a paradigm for what constitutes a quality shelter. “When I was a Legal Aid scholar back in 1981, my first clients that I represented were people who had become homeless in Staten Island and placed in the Bronx or homeless in the Bronx and placed in Staten Island,” Banks said. “And there was no guiding principle as the shelter system developed to address that problem. We’re all people that live with anchors in our lives – schools, employment, health care, houses of worship, family – and if we want to effectively give people a helping hand to get back on their feet and return

to the community, either through permanent housing or reuniting with family or friends, then we have to have a guiding principle.” The scaling back of goals in combating homelessness is a marked shift in approach for an administration that frequently sets lofty policy goals. Even de Blasio, prone to hyperbole and occasionally unrealistic ambition, was notably circumspect in evaluating his administration’s handling of the homeless problem and its modest goal to reduce the number of people living in the city’s shelter system. The city is aiming to reduce that population by 2,500 people over five years – a mere 4 percent reduction.

When de Blasio rolled out his new plan in February, he said, “Is it everything we want it to be? No. It’s the honest goal. This is what we can tell the people of New York City can be done and can be sustained.” Much in the same way that Dinkins was a champion of homeless rights as Manhattan borough president and criticized the Koch administration’s policies, de Blasio was a fervent critic of Bloomberg’s approach to homelessness, first as a city councilman and chairman of the New York City Council’s General Welfare Committee, and later as public advocate. He notably took Bloomberg to task for his vow in 2004 to cut the city’s homeless population – at the time, roughly 38,000 – by two-thirds over five years, arguing that the mayor had failed to even acknowledge falling well short of that goal. And while Dinkins had to deal with the shelter system mess that Koch created, with thousands of homeless families crammed in barracks-style shelters and ramshackle welfare hotels, de Blasio inherited a homeless population that had exploded under Bloomberg – 53,615 people at the time of his January 2014 inauguration. In hindsight, Bloomberg’s promise to reduce the number of homeless people living in the city was, at best, misguided, but also a victim of an unforeseen financial crisis that led the state to cut key funding for Advantage – the city’s signature rental subsidy housing program for homeless families – and subsequently forced the city to end the program entirely. But similar to the early years of Dinkins’ mayoralty – in which the city was slow to develop a comprehensive plan to combat homelessness – de Blasio moved lethargically in confronting the crisis. His deputy mayor for health and human services, Lilliam Barrios-Paoli, resigned less than two years into the job and later criticized de Blasio for not having a long-term solution. Dinkins also lost a top deputy early on when Nancy Wackstein, the director of the Mayor’s Office on Homelessness, resigned in 1991. “We were under similar pressure (as the de Blasio administration), and we did a pretty good job of getting out of the hotels for families, opened up more NYCHA units for families, but then (the homeless population) began to creep up again,” Wackstein recalled in a recent interview. “Homelessness is a symptom of poverty. I understand that you don’t want to be in hotels and cluster sites; I think that’s right. But I don’t think even if you got 90 shelters, you’re gonna get the (homeless) number down. We thought the crisis was terri-

ble at 20,000 people. What’s an acceptable size for the shelter system today?” Banks, however, noted that the complexity and scope of the current homelessness crisis is far greater than anything Dinkins and Koch faced. For one thing, the face of homelessness has changed. In the ’80s and early ’90s, single adults populated many of the beds of the city’s shelter system. Currently, 70 percent of the city’s shelter system is made up of families, while 34 percent of families in the shelter system with children are headed by an adult in the workforce – a reflection of the city’s increasingly unaffordable housing stock and a local economy with a yawning equality gap. In another departure from the Dinkins and Koch era, the city has largely turned over the shelter system to nonprofit providers who, homeless advocates agree, generally do a much better job of upkeep and management. Banks also points out that, under Koch and Dinkins, the city largely ignored homeless prevention services – an area where the de Blasio administration has increased funding by 25 percent. Previous administrations would also routinely close shelters with poor conditions without an adequate alternative in place, a policy that the de Blasio administration changed by requiring replacement capacity for any cluster site or hotel that’s closed. Of course, that’s where the 90 new shelters come in. Perhaps the most foreboding aspect to the de Blasio administration’s new approach remains community opposition to homeless shelters – very similar to the dreaded NIMBYism that torpedoed the Koch/Dinkins plan to build 20 to 30 new shelters across the city. Before the city announced its latest policy shift, the administration had already run into a massive public outcry over plans for a new shelter site that would house about 250 homeless people in Maspeth, Queens. The string of protests culminated in an astonishing display in front of Banks’ Brooklyn home, where hundreds of protesters chanted, “Banks has gotta go!” and he was forced to call the police. Even in the wake of that unseemly episode and a steady pattern over the past 30 years of community resistance to shelters, Banks remains undaunted. He remembers his days as an advocate, when previous administrations opened shelters on an emergency basis in the middle of the night with no community notice. Under de Blasio, the city still will not be asking for permission from neighborhoods to host shelters, but those communities will receive 30 days’ notice and can submit public comments during that period.

“De Blasio and Dinkins made a big point of being community-based, while Koch, Giuliani and Bloomberg never sold themselves as pro-community, so nobody expected to be consulted by them,” said Thomas Main, a professor at Baruch College’s School of Public Affairs and an expert on social welfare policy. “I think a certain amount of Machiavellianism is necessary here in getting these shelters sited. The big danger is de Blasio will run into the same problems Dinkins did.” So far, the advance notice has done little to placate communities targeted for new shelters. A men’s shelter slated to open in Crown Heights was met with a lawsuit against the city, and a Brooklyn judge recently blocked its opening to allow time for a possible compromise. If the shelter were allowed to proceed, it would be the second to open in Crown Heights, with a third set to open soon. The cluster of shelters in a single Brooklyn community begs the question of how the city will satisfy the “fair siting” aspect of its plan. Banks believes that as long as the city holds up its end of the bargain in keeping these facilities secure and seamlessly integrating them into the fabric of community, they can overcome NIMBYism. In keeping with the commitment to high-quali-

ty shelters, Banks cited a desire for new shelters to provide enough programming during the day to keep homeless men and women off the street. “We were able to communicate to the community about things we were proposing to do that we thought would address long-standing problems there: Community outreach workers to address concerns around the shelter, enhanced NYPD presence in the area around the shelter, and, more importantly, enhanced programming within the shelter,” Banks said. “Recreational programs, counseling programs, employment-related programs that we think will help address the needs.” Still, skeptics say that if de Blasio and Banks were truly committed to fair siting, the city’s affluent communities should also have some stake in reducing the homeless population. Others point out the inextricable link between the city’s lack of affordable housing and the boom in homelessness, and the startling absence of addressing homelessness within de Blasio’s plan to build 200,000 units of affordable housing over 10 years. “I understand the notion of community ties and children being closer to their schools, but if you’re going to build shel-

ters in the neighborhoods from which homeless people come, what about Park Slope or the Upper West Side?” Wackstein said, suggesting that the city’s affluent neighborhoods bear some of the shelter siting burden. “If we are really one city, this may perpetuate the ‘Tale of Two Cities.’ Neighborhoods all over the city need to help solve this problem; it shouldn’t just be Brownsville and East New York and Mott Haven. The data has not changed over the years, in terms of where homeless families come from.” There is also a sense that the city is fighting the homeless crisis with one hand tied behind its back, as it pertains to lobbying the state for assistance. Under every previous administration dating back to Dinkins, the city could count on the renewal of the NY/NY agreement, which provides a steady stream of state funding to create supportive housing for the homeless that provide on-site mental health and job training services. Yet de Blasio and Gov. Andrew Cuomo have been unable to come to an agreement on renewing the program. Instead, the de Blasio administration has committed to building 15,000 supportive housing units over the next 15 years on its own – about half the amount advocates say are needed.

Meanwhile, in the recently finalized state budget, Cuomo and the state Legislature agreed to release $2.5 billion in funds that will help fund 6,000 units of supportive housing units throughout the state. It’s unclear how many of those units will be built in New York City. “I was surprised when de Blasio put out his plan that it didn’t mention NY/NY,” said Norman Steisel, first deputy mayor in the Dinkins administration who helped negotiate the original NY/NY agreement between Dinkins and Cuomo’s father, former Gov. Mario Cuomo. “I couldn’t believe that.” Banks countered that the absence of a NY/NY agreement would not hamper the city’s efforts, and that the city had to move swiftly in order to start construction on the new supportive housing units. “We can’t wait. We’re going to announce our 15,000 units, and in fact, we have our first 550 units opening this year and then we’re on a trajectory to keep opening units as we proceed over the course of the plan.”

T’S EASY TO look at where other city administrations failed

to contain homelessness and conclude that a similar fate awaits de Blasio and Banks. Koch and Dinkins’ best laid plans were hampered by a crippled economy and community backlash. Former Mayor Rudy Giuliani brought a paternalistic, “get tough” philosophy, including work requirements for shelter stays, that failed to appreciably bring the homeless population down. Bloomberg was deluded by unsustainable goals and another brutal recession. And with de Blasio announcing his homeless policy pivot in the months leading up to his re-election campaign – while also setting his sights on growing the city’s economy, keeping crime low and achieving his affordable housing goals – it’s clear the onus will fall on Banks to make sure the groundwork is laid for a possible second term to set the city on the right track. While social welfare experts like Thomas Main assert that “nobody on the planet knows homeless policy like Steve Banks,” the former advocate now has to deal with a potential political cost to his boss and his own sterling reputation. “There are costs that have to be

weighed in light of all the priorities in terms of what a mayor needs to tackle,” Steisel said. “In some ways advocates like Banks are all the same; political cost is rarely an issue to them. He was strong in what he did (on homelessness), taking us to court on several occasions. But despite this history and his attitude and philosophy, he’s also got to deal with this very complicated balancing act, because now he’s the guy in charge.” Still, even in the face of a seemingly unsolvable crisis, Banks is unflinching in his determination to learn from his experience as an advocate, including applying some of the lessons he learned from grilling former Dinkins administration officials during heated litigation. “In the major areas that Jeff Carples talked about – prevention, decent shelter and permanent housing – the lessons of those periods are reflected in a very different approach,” Banks said. “All of the things I thought were important, I’m now getting an opportunity under a mayor who actually believes in these things, to implement the very programs that I brought lawsuits to try to require the government to put in place.”

AFFORDABLE HOUSING IN BOTH THE CITY and the state, elected officials say they’re taking steps to combat homelessness by creating more housing that lowand middle-income New Yorkers can actually afford. Gov. Andrew Cuomo touted a new Affordable New York Housing Program included in the state budget. Similar to the 421-a tax abatement that it replaces, the program offers incentives aimed at generating more affordable housing. The governor also praised the allocation of $2.5 billion for a wide range of projects, including public housing, the preservation of multifamily housing and new supportive housing, which includes medical and other services on-site. The five-year plan is projected to result in 100,000 affordable housing units and 6,000 supportive housing units.

Similarly, New York City Mayor Bill de Blasio ran on a pledge of creating or preserving 200,000 units of affordable housing in the decade after he took office. This year, his administration cited figures showing that it’s on track to hit that target, with more than 20,000 units added in 2016. But that’s not the whole story. The lapsed 421-a program was in limbo for months, with Cuomo and de Blasio disagreeing on the benefits for construction workers and real estate developers. Advocates argued the controversial tax abatement was a giveaway to luxury developers that should not have been renewed. Meanwhile, as the homelessness crisis worsened, state funding for supportive housing and other initiatives was put on hold. In this special section on affordable housing, City & State takes a closer look at these efforts and hears from top housing officials.

EW YORK CITY Councilman Rafael Espinal marveled at signs the city has started spending more than $250 million to improve East New York and Cypress Hills since he and his colleagues voted to rezone the area. On a tour of his district in late April, Espinal hardly let more than five blocks pass before pointing out another benefit of the money: A new Workforce Career Center has opened, where people can learn about job openings and get resume, interview and other career advice. In another part of his district, the NYPD will create a community center with programming for people of all ages inside a 1920s-era courthouse that has mostly been used for NYPD administrative work in recent years. A burnt out funeral home is slated to become a child care center. And atop a planned affordable housing development and new 1,000-seat school, Espinal hopes greenhouse roofs will rise, creating an “urban gardening district.” A year after revamped land use rules were implemented in East New York, the community’s housing stock has not yet dramatically changed. But Espinal is so pleased with the progress that he suggested he was open to revamping land use rules in Bushwick, another part of his district where New York City Mayor Bill de Blasio’s administration is weighing a rezoning. “My whole district may be rezoned,” Espinal said. “We were all yelling at the top of our lungs, and nobody was listening. But (the rezoning) process actually gave us a voice.” How the area develops will be closely watched because it was the first community rezoned under de Blasio, who has announced City Hall will consider rezoning 15 neighborhoods as it looks to increase the city’s residential housing stock. Last April’s vote also made East New York the first neighborhood to adopt Mandatory Inclusionary Housing, a new zoning code that allows for larger residential development, but requires that a portion of the

new housing be affordable. Espinal said the below-market-rate housing and new tools to prevent residents from being forced out of their neighborhood will help families that have been struggling to keep up with the gentrification sweeping across Brooklyn. But some do not see the rezoning as a remedy for displacement, but rather the root of it. “We’re assisting folks in court because of the harassment they’re experiencing from their landlord,” said Renata Pumarol, deputy director of New York Communities for Change, a group that works to support low-income families. Pumarol added that landlords in East New York seem to believe they can replace their current tenants with people who can afford higher rents. “Landlords are trying to push folks out,” she said. “Rents are rising. And the rezoning hasn’t even happened yet.” SO FAR, THERE ARE NO signs a private housing construction boom has begun, as some feared. No projects that depend on Mandatory Inclusionary Housing, or MIH, have advanced except for two ventures lawmakers were already aware of when they voted to pass the rezoning. Before that vote, the nonprofit Phipps Housing firm agreed to build about 1,000 below-market-rate homes and incorporate some retail space where a food processing plant once operated, at 3301 Atlantic Ave. Espinal’s office said the first phase of Phipps’ project will create 403 homes, with 121 units reserved for families earning up to 30 percent of the metro area median income, and the other 282 apartments set aside for those making up to 60 percent of AMI. Phipps’ plans may change slightly before it signs a regulatory agreement with the city Department of Housing Preservation and Development, but any adjusted targets will not exceed 60 percent of AMI, according to Espinal’s office. The second project is slated for cityowned land at the corner of Chestnut Street and Dinsmore Place. City Hall outlined broad plans for 200 units of affordable housing on that property during the rezoning process, and months after the matter passed, in December 2016, the city requested that companies submit proposals to build a mixed-use development. Their request asked developers to earmark at least 15 percent of the homes for families earning up to 30 percent of AMI, but allows firms to reserve units for those earning up to 90 percent of AMI as well. “The rezoning is only here to try to slow down gentrification,” Espinal said. “People

will argue that it will accelerate gentrification, but being pushed out of your home two years from now or being pushed out of your home five years from now, I believe, has the same consequence. And we have to make sure that there’s a plan to retain you in your community.” BUT THAT PLAN does not have seem to be providing protection to everyone, according to Cea Weaver, the research director at New York Communities for Change. East New York has relatively few rent-regulated homes, Weaver said, and lawyers have a much harder time keeping tenants in homes that are not rent-regulated, which means the legal assistance offered by the city is not widely effective. There also seems to be a communication gap preventing tenants from learning about various benefits and protections they are entitled to when a landlord uses city financing to rehab a building, she said. A series of flipped homes have also stirred worries, said Bill Wilkins, who helped steer a coalition formed when East New York residents were pushing for various changes to the rezoning proposal. Wilkins said 225 homes were flipped in East New York ZIP codes between 2014 and 2015 as word of the proposal spread. Wilkins said he considered a home flipped if someone bought it and resold it within a year. Wilkins said he did not think the flips were widespread enough to impact the area’s strong sense of community. But he said the rapid turnover can be problematic as longtime homeowners are exploited when they do not know how much their homes are worth. “It’s upsetting – a home was sold for $113,000 and then 148 days later, it was sold for $675,000 – that’s a $562,000 difference,” Wilkins said, suggesting the city undertake a public outreach campaign to inform homeowners about how they can find an accurate assessment of their home’s value. “Other than that, I would give the administration, I would give them a B or a B+. There’s nothing I can say that they promised us that they didn’t do.” What’s more, many East New York families earn less than the income levels targeted by the two projects in the works, which means they cannot be assured they will be considered for units in either development. More than one-third of families in the rezoned area earn less than 30 percent of AMI, the lowest income level developers must house in the two projects. East New York’s median household income of $34,512 is far lower than the metro AMI, which was

$63,500 for a single person in 2016. While highlighting this, the city comptroller estimated an early version of the rezoning plan could put 50,000 people at risk of being priced out of their neighborhood. Still, Espinal pointed out the city typically offers local residents first access to half of government-sponsored housing in their community, which is expected to place East New York residents in half of the more than 6,000 homes the city expects the rezoning to generate over the next decade. As part of his negotiations over the rezoning, Espinal got the city to extend the length of time it plans to provide legal representation to tenants in New York City Housing Court and to launch the East New York Homeowner Help Desk, which offers advice on home repairs, preventing foreclosures, avoiding scams and utilizing weatherization loan programs. The councilman said the initiative would help homeowners navigate the shifting neighborhood, but contends the administration should do more outreach to ensure that East New York residents know about the resource. But longtime East New York resident Brother Paul Muhammad said the sky-

rocketing home prices are cause for serious concern. He argued the community will be destabilized if East New York’s younger generations, such as his daughter, cannot afford the mortgages on their family homes. He viewed the rezoning as a veiled plot to remove a community of predominately black and Latino homeowners to make space for wealthier, whiter people priced out of Manhattan. “It’s racist to the core because you couldn’t go into any other neighborhood to take over the land like that,” he said. “They’re not going to Coney Island and Bay Ridge and talking, do you want to build towers over there? There needs to be a federal investigation into are the people of East New York’s civil rights being violated?” City Hall declined to comment on the allegation, but Espinal disputed the idea that the city had skirted federal fair housing rules during the East New York rezoning. “The only thing the (East New York) rezoning discriminates against are the forces of displacement, which are clearly spreading throughout the entire city,” he said in a statement. “This seems entirely consistent with (the U.S. Department of Housing and Urban Development’s) framework for (furthering fair housing).”

Still, there are legitimate questions about whether the city fulfilled its duties under the federal Fair Housing Act, according to Gregory Louis, deputy program director of the Group Housing Representation Unit at Brooklyn Legal Services Corporation A, a firm that successfully blocked another city rezoning on the grounds that it did not abide by the act. Louis said the federal Fair Housing Act requires cities to scrutinize, among several things, whether their housing policies have any discriminatory racial impact. But Louis said there is no clear path for recourse because of timing quirks: New federal rules were not phased in soon enough to impact the city during the rezoning. And under the state regulatory framework, the period for challenging the city’s analysis of how the zoning may impact “vulnerable populations,” or in this case low-income black and Latino families, has elapsed. “The study in that case,” Louis said of the city’s analysis of the East New York rezoning, “doesn’t take a very serious look at the reality or the economic reality of the very vulnerable population the city thinks would benefit from MIH but can’t.”

Gov. Andrew Cuomo won passage of some key housing initiatives in the recently approved state budget – although critics say the measures should have gotten done months ago. Here are the highlights.

AFFORDABLE NEW YORK HOUSING PROGRAM

The controversial 421-a tax abatement program was renewed and renamed the Affordable New York Housing Program. Under the program, developers of new residential projects with at least 300 units of affordable housing in certain areas of Manhattan, Brooklyn and Queens that meet construction wage requirements and maintain a set number of affordable rental units for 40 years would qualify for a full property tax abatement for 35 years. For other developments, eligibility will be tied to the number of affordable units. The administration estimates it will create 2,500 affordable units each year.

C&S: The budget included a new deal on the 421-a tax abatement program. What are your thoughts on the final deal? BL: In addition to increased resources, a sound affordable housing plan also needed to take into consideration how taxes and fees increase the cost of development and impact affordability. With that in mind, the budget also revived a tax exemption that had been in place since 1971 to encourage the development of affordable housing in eligible areas of New York City. The Affordable New York Housing Program provides a tax exemption for building multifamily residential housing that sets aside 25-30 percent of the units as affordable hous-

ing. The program extends the benefit period to 35 years, which stabilizes housing affordability for 40 years. This will encourage the development of much-needed affordable housing for residents and stabilize communities.

C&S: The budget included a new deal on the 421-a tax abatement program. What are your thoughts on the final deal and who do you believe ultimately benefited the most from the agreement? SC: I’m pleased that the issue of 421-a has finally been resolved and that the program is available to those who believe that it is key to the development of affordable housing in New York City. In uncertain times, the return of the 421-a program provides a degree of certainty that otherwise may not have existed, that affordable housing units will continue to be built throughout New York City. The significant need for affordable housing requires a

comprehensive approach to addressing the problem and the release of $2.5 billion in housing funds in this year’s budget will help address this need significantly. But it is important that we remain focused on this effort and on ensuring that New Yorkers of all income levels are covered in the development of this housing. The 421-a program is another tool for the development of affordable housing, adding to the toolkit of available options to create this valuable and necessary housing stock. I am pleased that we have moved away from previous versions of the 421-a program, a program that did not always require the construction of affordable units, and that the

C&S: With the 421-a deal completed, what housing issues remain for the rest of the session? BL: In order to truly address housing affordability, we need to reduce the tax burden on New Yorkers. Earlier this session, the state Senate passed legislation to make the property tax cap permanent statewide, except in New York City where no cap is currently in place. I am sponsoring legislation to establish a commis-

sion to review and make recommendations to provide a more balanced real property tax system in New York City. This bill has already passed the Senate, and also awaits Assembly action. Homeownership is an important part of the state’s affordable housing landscape. The Senate’s one-house budget included creation of the New York State First Home savings program. Modeled after the 529 College Savings Program, it would provide a tax deduction for state residents that save toward the purchase of a first home. This measure was not included in the final budget, but I am sponsoring legislation to advance it as part of the regular legislative session.

As a remedy, he set out in 2014 to build or preserve 200,000 units of affordable housing over the next decade. C&S: It’s been a year since the Mandatory Inclusionary Housing, or MIH, was passed. You voted against it. How do you think it’s going? JW: I don’t think it’s succeeding in achieving the goals of providing the affordable housing for the people who need it the most and addressing homelessness. We have a tendency to talk about homelessness and housing separately. We have to talk about them together. There is a right to say it’s successful. It’s successful in the measures that were put forth (by the city), but those were the wrong measures to begin with. I believe there was a lot left on the table with MIH and now we’re starting to feel

the heat of it. And it was unnecessarily left on the table. There was no reason why we couldn’t mandate that a minimum amount of lower affordability was included in every one of the projects so that we can get to the lowest of the AMI’s. And we could have done that while still assisting some of the high-end market. C&S: How do you think the city’s doing overall with affordable housing? JW: There are two great things that have happened recently thanks to the City Council and the mayor. We got free legal aid for a much larger subset of the population. We have to preserve people who are in the housing to begin with, so that’s

C&S: Has the administration slowed down the pace of rezonings? JW: We’re voting out, it seems like every month, some kind of zoning project. I think the reason the public doesn’t see them is when it hits the media, it’s the big, huge ones that everybody talks about. C&S: Does the city have plans to fund of HPD’s most important work if there are federal budget cuts? MTS: It is true that HPD on the expense side is very reliant on the federal government. About 86 percent of our expense budget is federally funded to really cover some of our most basic services. Services that allow us to do code inspections, to prevent landlord harassment, to do emergency shelters, to hold landlords accountable, to fund supportive housing. So job one is to ensure that we are resisting those cuts. And I think we are in a good position to do that because affordable housing, making sure that people have decent, affordable homes, is a very bipartisan issue.

Of course, we are doing all of the necessary scenario planning in anticipation of having to cope with any changes, but we can’t let Washington, D.C., walk away from its obligations to residents of this city and so many other places across the country. C&S: The mayor’s executive budget just came out with an additional $1.9 billion for affordable housing. De Blasio says there’s a particular focus on housing for lower income levels. Is this a strategic shift, admitting there were some faults in the previous program? MTS: The Housing New York plan really represents the most ambitious municipal plan to create and preserve af-

fordable housing in the country. The addition of the $2 billion allows us to reach deeper affordability in the plan, but we already, in the first three years, aside from record-breaking success in general, in terms of the units that have been preserved and created, we also exceeded our targets for extremely low-income and very low-income families. The reality is that there is need across different income levels. And while the need for sure exists – which is why we added the additional $2 billion – for very low and extremely low-income families. For instance, a single mother who works full time at a $15-an-hour job with one child, that household is over 30 percent of AMI. That is a real need.

FACING A NEW DRUG THREAT, A DEBATE OVER HOW TO FIGHT BACK By JON LENTZ

IN RECENT WEEKS, the signs of a dangerous drug threat have popped up across the state. The acting Brooklyn district attorney indicted 34 people on narcotics charges involving the sale of a group of drugs that has driven city overdose deaths to record highs. The same drugs were cited as a driving factor behind a dramatic rise of opioid overdoses on Long Island, contributing to a record 493 opioid-related deaths in Suffolk and Nassau counties last year. And in the Southern Tier, where the drugs have also been making inroads, a state lawmaker cited the seizure of 500 pills containing the drug but stamped to look like Tylenol or codeine. The drug in question? Fentanyl, and synthetic variations of it, which is far more powerful and lethal than heroin or prescription drugs. Used as an anesthetic or for patients with terminal illnesses, the drug is so fast acting that it’s hard to counteract, even with naloxone, a widely distributed antidote that has proven effective in reversing other opioid overdoses. Even worse, fentanyl is often mislabeled, so users may not know what they’re taking. “We’re finding it mixed in with heroin, sometimes sold as heroin, sometimes mixed in with cocaine and sold as counterfeit Xanax pills as well – and it’s killing people,” Bridget Brennan, the New York City special narcotics prosecutor, said at City & State’s On Health Care conference last month. “The city Health Department has identified that as probably the single greatest contributor to the escalation of overdose deaths here in the city.”

More than 1,300 people in New York City died of a drug overdose in 2016, according to city figures released last month. Fentanyl cases have skyrocketed in the city, making up less than 5 percent of overdose deaths before 2015, and rising to account for nearly half of such deaths in the last six months of 2016. Making matters even more challenging, officials say, is that manufacturers in Mexico and China often exploit regulatory loopholes by producing versions of fentanyl that technically aren’t illegal. “One of the issues ... is that the state law and federal law defines any controlled substance or illegal substance by its chemical name, so what we see distributors of illegal drugs doing is just altering in a very minor way the chemical composition – we call it analogues – and so that those analogues will no longer fall under the umbrella of the current state law,” Brennan said. State Sen. Fred Akshar, a Southern Tier Republican and a co-chairman of the Joint Senate Task Force on Heroin and Opioid Addiction, said a package of legislation recently passed in the state Senate would close the loopholes. One bill adds variations of fentanyl to the state’s list of controlled substances while increasing penalties for selling them. Another prohibits any analogues of banned drugs. Akshar, who spent 15 years in county sheriff’s offices before his election in 2015, said he once believed law enforcement was the answer to the opioid epidemic. Now, he sees access to treatment as critical – but the state Senate Republican legislation is critical as well. “You know, unfortunately, not everyone

in the state Legislature believes that’s the way to go,” Akshar said at City & State’s conference. “So while we may pass a series of bills in the New York state Senate, it’s very difficult when you are creating a new crime or increasing the penalties, to get that done in the Assembly. I would respectfully offer that sometimes, with this particular issue, we have to make those tough decisions, to give law enforcement the tools they need.” Mike Whyland, a spokesman for the Assembly Democrats, called the measures “so-called solutions that don’t accomplish anything.” “Most drug crimes are based on aggregate weight so to the extent fentanyl is added to heroin it is already counted in the charge level,” Whyland wrote in an email. “Also, you should know that the Department of Health has broad regulatory authority to prohibit sale and possession of substances and create certain penalties while they are being reviewed by the federal government to be placed on the controlled substance list.” During the panel discussion, Brennan emphasized the need for a balanced and multipronged approach. She cited as a model New York City’s efforts to combat K2, a synthetic marijuana drug that came on the scene in recent years and spread rapidly. “The City Council devised an ordinance which prohibited the sale of it and allowed for certain enforcement actions,” she said. “Again, it was the blending of different enforcement tools, making sure that they were appropriately used and not penalizing an affected group too harshly, but allowing the tools to get the drug off the street.”

N LESS THAN two weeks, the New York City Department of Finance will bankrupt and destroy more than 300 nonprofit institutions, converting their properties into capital for private banks through tax lien sales – but city leaders still have a chance to save them. On May 12, the agency will wrongfully sell these properties and many others. The move will condemn their owners to crippling financial burdens and then to foreclosure by a private bank – even though state law exempts nonprofit organizations from property taxes in the first place. Also on the chopping block: 1,155 vacant lots, as of last week – spaces the city could develop into affordable housing, but will instead sell off for private development. The tax lien sale mechanism is complex, and its stakes are astronomical, but its solution is incredibly simple: the Department of Finance must immediately remove nonprofits and vacant lots from the tax lien sale.

The Department of Finance controls the tax lien sale and has the power to remove these properties, but has shown no inclination to do so. Without city leadership, many of these valuable community institutions will be uprooted, and their properties given over to the speculative capital market. This blunt policy instrument will pave the way for condos to replace hundreds of the churches, cemeteries, parsonages, food pantries, senior centers, charitable housing units, health centers, veteran centers, schools, community gardens and other vital building blocks of neighborhood strength and vitality. How did we get here? Every year the tax lien sale wrongfully shackles hundreds of nonprofits with huge debts and then lets a private bank leverage additional fees and foreclose upon their properties. Nonprofit organizations are permanently tax-exempt under state law, but since 2012 the city Department of Finance has required them to go through a byzantine annual process to maintain this status on their properties.

Many don’t know that they need to do this, or don’t have the capacity to follow through on it correctly. Debt and foreclosure by private banks often follows. The good news: A solution is clear, easy and implementable. The Department of Finance can remove nonprofits and vacant lots from the 2017 tax lien sale. This year, responding to advocacy from 596 Acres, Fordham Law School and the Community Development Project of the Urban Justice Center, the agency has, for the first time ever, generated lists of the nonprofit-owned properties and vacant lots that it will include in the tax lien sale. It now needs to use the lists to exclude these properties. The bad news: Instead, the Department of Finance expects each organization to contact them individually and navigate a labyrinthine negotiation. Many will fail to do this correctly or in time. The Community Development Project and 596 Acres have been leading the charge to guide each organization through the process.

It gets worse: The tax lien sale’s problems are actually much bigger than nonprofits and vacant lots. A growing body of research is exposing the tax lien sale as an exploitative piece of corporate-municipal machinery with racial biases. A class-action lawsuit filed just last week by the NAACP and other plaintiffs demonstrates that the city systematically levies higher property taxes on nonwhite, nonwealthy property owners in poorer neighborhoods than it does on white, wealthy property owners in more affluent neighborhoods. In other words, the tax lien sale affects those with the most to lose and the least ability to recover after the

sale inflates their debts. The system shackles residents into cycles of debt servitude in communities with the greatest need for social resiliency. We have a serious duty to combat it. While halting the tax lien sale is unlikely in 2017, the nonprofit properties and vacant lots up for sale can still be saved. The mayor and other city officials can direct the Department of Finance to remove nonprofits and vacant lots from the 2017 sale right now; some New York City Council members are already advocating for this change. We need city leadership to demand these changes or 2017 will go down as a banner year for the sale of vital public resources

to the speculative capital market – and the year when New York City sold off its last chance to permanently develop affordable housing on free, city-owned land. As the tax lien sale threatens to destroy so many cornerstones of neighborhood resiliency, the city has a critical opportunity to intervene and protect the institutions that give our communities continuity and hope.

HE NUMBER OF families in homeless shelters increased by one-third between fiscal years 2012 and 2015, according to a report released in April by the Institute for Children, Poverty and Homelessness. New York Nonprofit Media spoke with Ralph da Costa Nunez, the organization’s president and CEO as well as a veteran of city and state government, about the study. This interview has been edited for clarity and brevity. For the full interview, listen to the podcast on our website. NYN: What happens when you put data on homelessness on a map? RN: Some (City Council) districts in the city of New York have no shelters at all, yet every district in the city of New York has homeless children. Your typical homeless person in the city happens to be a 12-, 13-, 14-year-old kid. It’s not the adult you think.

NYN: The report seems to show homelessness continuing for more than one generation – what’s happening? RN: If you go to the shelter today, you’ll see kids who were children in the Dinkins and Koch administrations who now come with their own children and they’re homeless. So we have perpetuated a certain part of the population that this is the way they live, this is what they know. NYN: Can you talk about why shelters should be leveraged as community resource centers? RN: The mayor talks about building 90 new shelters. Well, when are we going to make some kind of a change here and decide that something different has to be done? What (New York City Mayor Bill) de Blasio should do is go a step further. Let’s leave Tier II housing, which he’s talking about building, and let’s go to a third tier. It’s not a shelter, but it’s a community residence with all of the services of day care, of after-school

programs. The main core are employment programs, educational programs for the parents, a health clinic and (then) open it to the community as well as the families residing there. Now you have a residential community resource center. Communities aren’t opposed to that.
