A NEW COMMON AREA THAT SPANS ALMOST AN ENTIRE FLOOR has been set up in the lower Manhattan building where City & State’s office is located. A property management worker told me the common area was an incentive for people to rent office space in the building, which still has vacancies that resulted when tenants left because of COVID-19. The space includes conference rooms, snack areas, couches and, to my surprise – phone booths for private cell phone conversations. And it looks like the concept is catching on with other commercial properties. A high-rise tower just a few blocks away from City & State’s office building also was adding a common area with similar amenities. James Whelan, president of the Real Estate Board of New York, said commercial buildings are “raising the bar” for office tenants. “It’s part of the reason why some of the world’s largest companies have maintained or expanded their presence in the city’s office market over the past year – and it’s why we continue to see a great deal of optimism from commercial brokers about where the market is headed this year.” These common areas also provide an overflow space in case too many workers show up to an office still enforcing pandemic precautions. The phone booths in the common area at our building are certainly a welcome amenity, providing both distance from others and privacy. It’s intriguing since phone booths are pretty much extinct. Who knew they would ever make a comeback?

MASK MANDATE LIFTED
With the number of COVID-19 cases dropping around the state as the omicron variant surge dies down, Gov. Kathy Hochul announced the end of the statewide mask or vax mandate that required people to wear masks in
public spaces where there was not a vaccine mandate enforced. Hochul put the mandate in place late last year and continued to extend it when its expiration drew near. But with a more positive outlook on the trajectory of the pandemic, and recent action by New Jersey
and other Democratic states to ease restrictions, Hochul said that New York could drop the mandate. However, the requirement for teachers and students to wear masks at school remains in place, with the governor saying she would reconsider that decision in early March. The statewide
COLD SHOULDER Public housing residents in New York City have long suffered from negligence by management and life-threatening conditions in their apartments, but a new report revealed the New York City Housing Authority has been leaving residents at one Rockaway building out in the cold for four months. New York politicians criticized NYCHA leaders for a hot water outage that has lasted since November, arguing residents should be entitled to free rent.

Local leaders from around the state made their budget demands before state lawmakers during the annual “tin cup day” as they testified at a joint legislative hearing. Up first, as always, was the New York City mayor, marking Eric Adams’ first time participating in his new role. He used the opportunity to once again demand changes to recent criminal justice reforms, most notably the bail law that eliminated pretrial detention for the vast majority of charged crimes. Adams requested state lawmakers get rid of cash bail completely, but allow judges the discretion to consider a defendant’s “dangerousness” to determine whether they should be jailed while awaiting trial. He also made the case to tweak “Raise the Age” in order to allow the state to try more teens as adults. Both legislative leaders in Albany have said they have no intention to revisit bail or make other criminal justice reform rollbacks.

CUOMO STILL MAKING HIS CASE
Ex-Gov. Andrew Cuomo’s attorney Rita Glavin once again took to the internet to assail the credibility of the women who said Cuomo sexually harassed them and to attempt to discredit the findings of the state attorney general report into those allegations. The latest press briefing came days after new reporting suggested Cuomo is considering a return to public life with a run for attorney general against Letitia James. Glavin didn’t speculate about her client’s political ambitions, but she did say he would file a complaint against James to the state Supreme Court Attorney Grievance Committee for her conduct in the sexual harassment investigation. The Sexual Harassment Working Group, which advocates for reforms to harassment laws, is filing a complaint with the same committee against Cuomo,

asking that he lose his law license.
JUMAANE WILLIAMS GETS A BOOST
New York City Public Advocate Jumaane Williams’ long shot bid for governor got a boost with the endorsement of the Working Families Party. Members of the left-wing party can’t vote in the Democratic primary, but they can help provide progressive candidates with support and resources to get ahead. Their success rate hasn’t been great recently in gubernatorial and other statewide elections, with WFP-endorsed candidates losing primaries the past two cycles. That included Williams himself when the party backed him for lieutenant governor in 2018. The WFP joined a coalition of progressive organizations that had already endorsed Williams for governor, one very similar to the list of supporters who backed him four years ago.
The Working Families Party is supporting Williams for governor, sticking with him after he lost the LG race in 2018.

Hochul’s LLC backers Gov. Kathy Hochul’s pledge to be “fully transparent” has become a target for her detractors seizing on a string of revelations about her fundraising practices – the latest of which found she didn’t adhere to the mantra when it came to recording some high-dollar donors. An investigation by New York Focus and The City revealed elected officials in New York have continued to collect money from nameless donors in violation of a 2019 law that required the disclosure of limited liability company owners who gave money to political campaigns. Hochul was among the biggest benefactors of LLC money in 2021, and did not meet the new requirements for a majority of the donations, the investigation found. Hochul raised a record-breaking $22 million for her reelection campaign in the five months after former Gov. Andrew Cuomo’s resignation. Nearly $400,000 of her fundraising total last year reportedly came from LLCs whose owners were not disclosed to the state Board of Elections by Hochul or the companies. At least some of the LLCs who donated to Hochul have benefited from her policies, including more than 60 LLCs affiliated with nursing homes and other health groups who had many of their demands met in Hochul’s state budget proposal, The New

State budget hearings are concluding and Albany Democrats are nearing the real budget talks before the April 1 deadline.
York Times reported. Gambling companies and the hotel industry were also among the major Hochul donors who were helped by the state budget plan. Hochul’s reported failure to meet the new requirements was revealed before she was set to host what was described as a “small, private” fundraising dinner on Feb. 10 with Lt. Gov. Brian Benjamin where guests paid up to $45,200 a ticket. Her campaign declined comment to New York Focus and The City. A 2019 disclosure law was intended to close what was referred to as the “LLC loophole,” which allowed companies to contribute up to $60,000 to candidates each year. Individuals could donate to multiple candidates multiple times by forming additional LLCs, which anyone can easily create. The reforms capped LLC donations to candidates at $5,000 and required companies to report the owners of the LLCs to the state Board of Elections, with donations attributed to ownership stake. Campaigns were also required to record the same information. But some of the people holding these offices have found some steadiness in their lives – with other political power players. Here are a few of New York’s new power couples that don’t just wake up with City & State’s First Read – they wake up together.
Gov. Now he is married to the governor. But Bill can’t talk to Kathy too much about work – she has recused herself from any dealings with the hospitality company he works for, which has state contracts.

What attracted you to Tech:NYC and led to you taking this job? I feel like we are at a flashpoint when we’re talking about technology and its relationship with New York City. If there’s one thing that we’ve seen over this past year during the pandemic, it is that the tech industry has really been doing a lot to bolster the economy and (making) sure that we have jobs and figuring out innovative solutions to issues we’ve been dealing with for a long time. Especially coming in at a time where we have Mayor Eric Adams, who has talked a lot about what
we can be able to do with technology, with a governor (like) Kathy Hochul who has also expressed an interest in really being able to reach the potential that we see for the tech industry – it just seems like an opportunity where we can really be able to have a meaningful impact. Is technology, or the issues facing technology companies, something you focused on in your previous jobs? Yeah, I have a little bit of a unique relationship when it comes to technology and getting to this point. Before
this, I had actually been a partner at a litigation firm called HamiltonClark, where some of the work that I did was assisting with making sure that tech startups in the criminal justice space were able to reach their strategic goals. Likewise, one of the things that had always been important to me was education and knowing how the education I got here in New York City helped be able to give me opportunities that, frankly, a lot of folks in Southeast Queens just didn’t have. To that end, we started a program called DREAMChasers,

which provides digital and virtual online learning to folks from low-income and underrepresented backgrounds so that they can be able to get into some of the top high schools and some of the specialized high schools here in the city. Tech:NYC’s work is pretty expansive – working with government leaders to bolster the sector, attracting new startups, advocating for tech-focused policies solutions as well as favorable regulations. Are you looking at any
particular areas as initial points of focus? I would definitely say workforce development. I want to make sure that we’re doing everything we can to build jobs out here. I want to make sure that the tech industry is something that’s accessible to all New Yorkers, regardless of your background. We need to do more to ensure that there are more entry points, so that folks can be able to have some of these software engineering jobs or have some of these IT jobs or be able to build the next startup out there. – Annie McDonough

Assembly Speaker Carl Heastie is one of the longest serving speakers in state history, and he’s still got his conference on his side.

O AN OUTSIDE observer, Assembly Speaker Carl Heastie can seem somewhat reserved. Publicly, he’s never been one for bouts of passion, generally opting to wait, listen and respond in due time, a calculated approach appropriate for a former accountant. His unassuming nature made his ultimate rise to power in the wake of former Speaker Sheldon Silver’s expulsion seem unexpected to some observers, though savvy politicos hadn’t forgotten Heastie’s successful bid to take control of the Bronx Democratic Party years earlier. It’s in this way that Heastie quietly made history as the first Black speaker of the Assembly, keeping his grasp on his conference for the past seven years during which Albany underwent monumental change. But Heastie is more than a reserved deal-maker who was likened to his predecessor when he took the position. He’s also a nerd with a love for the likes of Prince and “Star Trek.” His eyes lit up when I sat next to him at an airport while awaiting a
flight to a legislative conference in Puerto Rico and asked him about the finer points of redshirt mortality. Heastie had dressed up as Prince on numerous occasions, and he regularly wears the late great artist’s symbol around his neck when dressed casually. More than one Assembly member mentioned Heastie’s dance floor prowess when Jay-Z (his favorite rapper) comes on. “I tell him that sometimes I wish that he would exude more of that in his public image,” said former Bronx Borough President Rubén Díaz Jr., a longtime friend and former Assembly colleague of Heastie’s. This other side to Heastie in many ways reflects his current status in the Capitol. Once a young, progressive upstart, the speaker has now become an Albany veteran, a member of an old-school class of lawmakers. This is not dissimilar to the original “Star Trek,” the only version of the franchise Heastie thinks is worth watching. Once a bastion for progress when it aired in the ’60s, it now comes across as dated to younger audiences as standards have changed. Prince too once

pushed the boundaries on concepts like gender in ways that have become far more commonplace. The world advanced around these pop culture phenomena just as Albany has evolved around Heastie. His impressive staying power has made him the last of the “three men in a room” – the three state leaders who traditionally have made the most important legislative decisions and who, until just 2019, have always been men. Heastie now joins Gov. Kathy Hochul and state Senate Majority Leader Andrea Stewart-Cousins in that room. Beginning his eighth year as speaker, he’s already one of the longest serving Assembly

leaders in the chamber’s history. But interviews with over a dozen of his members from across the state and ideological spectrum painted the image of a well-respected leader doing an admirable job wrangling an enormous 107-member conference, currently only slightly smaller due to a handful of reliably Democratic vacancies. And despite the sea changes that have characterized the state Capitol the past several years, neither Heastie’s grip nor his member’s loyalty seem any weaker than when he first took on the role. In fact, after years of a Republican state Senate and an intransigent governor, he may just be hitting his stride.
W
HEN ASKED ABOUT Heastie’s leadership of the Democratic conference, most members who spoke to City & State were quick to praise his accessibility (perhaps unsurprising given the speaker’s immense power), especially those who previously served under Silver. Although not all were willing to directly
speak ill of the recently deceased Assembly giant, the consensus was clear: Heastie’s door is as open as Silver’s was shut. “I had the distinct opportunity of serving with the prior speaker and under the leadership of Carl Heastie, and it was totally different,” said Democratic Assembly Member Michaelle Solages of Long Island. “Now as members, we have an opportunity to have a dialogue, have an opportunity to shape and configure legislation.” She recalled that under Silver’s reign, she received a warning not to get pregnant because it would kill a woman’s career. “It’s quite the opposite
under the leadership of Carl Heastie.” A spokesperson for Heastie, who declined an interview for this piece, focused on the speaker’s dedication to his members during his years as leader and indicated that he doesn’t plan on going anywhere any time soon. “From day one he has been a consensus builder and is keenly aware of the needs of his conference,” Mike Whyland said in an email to City & State, attaching a list of accomplishments including landmark criminal justice reforms, the $15 minimum wage and fully funding foundation aid for schools. “There is much

members having different thoughts, different ways they represent their own district. … He does do his job gracefully, and it’s not an easy job.” That sentiment also came up many times among his members: a lack of envy for the task of controlling such a large body. “I was the minority leader of the Monroe County Legislature, so a similar position – albeit I only had to deal with 14 members of my conference,” Assembly Member Harry Bronson of Rochester said with a laugh. “It was a lot easier than dealing with the number of members in our conference, but this speaker does it.”
S more work to be done and the Speaker and his majority colleagues are looking forward to addressing these issues.” The Democratic conference under Heastie’s guidance since 2015 could be compared to a rambunctious family of strong personalities, each wanting to get talking time during dinner. Heastie invites that dynamic, allowing his members to discuss with each other and with him in order to find the best path forward. “(He’s) more determined to find consensus … open to the debate that gets you to that consensus,” said Assembly Member Jeffri-
on Aubry, the longtime speaker pro tempore who leads debate on the Assembly floor. “Shelly wasn’t so open – I think when he saw that kind of debate, he would turn his stone face on, as we used to say.” Where Silver led from the top down, Heastie’s members describe a much more collaborative approach to the conference. Members can access Heastie directly, each having his cell number to text or call him. “He does take the time to talk to all of his members when they have an issue,” said Assembly Member Maritza Davila of Brooklyn. “Imagine having all of these
OMETHING OF AN old-timer now – he was first elected to the Assembly over two decades ago – Heastie was once the fresh blood in the Bronx, joining with a group of like-minded Black young officials like former borough president Díaz to form the Rainbow Rebels in 2008. At the time, Heastie already occupied his seat in the Assembly and fended off an attempt by county leadership, then largely controlled by Latino politicos, to unseat him. As part of the rebellion, he took over the party from former leader José Rivera – who still serves under Heastie in the Assembly – ushering in a new era for the Bronx Democratic Party. Unlike other political machines in New York City, the one in the Bronx has managed to quietly continue operating and evolving in ways that once powerful operations like the Queens and Brooklyn Democratic parties haven’t. It’s now led by state Sen. Jamaal Bailey, a well-known progressive advocate for criminal justice reform. Managing competing Bronx interests in the diverse borough likely helped prepare Heastie for his eventual job as speaker of the Assembly. “You know the Frank Sinatra song ‘New York?’” Díaz asked before singing the famous chorus about making it in the Big Apple. “As it relates to politics, if you can make it in Bronx politics, you can deal with all kinds of personalities in the city of New York and throughout the state of New York.” According to his members, Heastie has consistently made it a point to ensure that each person, regardless of their ideology or geography, not only is heard, but feels listened to as sometimes debilitating divides like those between upstate and downstate constantly threaten conference harmony. One way that plays out is Heastie’s visits to member districts far from his own

home in the Bronx. Assembly Member Donna Lupardo described one time he visited her Southern Tier District, saying he generally liked to get out and about beyond official engagements. “I brought him to a Prince tribute concert and I brought him to a brewery that was serving ‘Purple Rain’ beer,” Lupardo said. “He really wants to see and experience the place that we represent … It’s kind of unusual to see him enjoying the activities we have going on.” Asked how often Silver visited her district, Lupardo answered quickly. “Never.” Even in times of turmoil, Heastie has managed to maintain a steady hand and keep both new and old members in line. Last year offered a good example as a new class of progressive insurgents took office during a pandemic that relegated nearly all interactions to Zoom. It was a recipe for misunderstandings, rising tensions and hot tempers that led to a number of public instances of disunity and discord. A heated conference exchange that involved swearing and middle fingers between freshman Bronx Assembly Member Amanda Septimo and Westchester Assembly Member Tom Abinanti wound up in the news. Septimo said the speaker called her after the incident, when she said he essentially talked her off the edge and calmed her down as she expressed her frustrations with what she considered a lack of respect for new members. “But then, I was really pleasantly surprised and grateful about that the next day … he started conference by saying, ‘You know guys, I know tensions run high, I know that things are crazy, I know we’re all stressed, but we all have to find a way to be in this space and be respectful,’” Septimo recalled, adding that Heastie’s sentiments to the conference helped the overall temperature. “I was surprised then, but I’m not surprised anymore.” In a somewhat similar situation, Westchester Assembly Member Amy Paulin said she felt supported by the speaker when she bore the brunt of attacks from fellow Democrats, including in her own conference, when she expressed some concerns during debate over the Excluded Workers Fund to give aid to unemployed immigrants who don’t have documentation. Protesters would call her out by name and criticize her for what they called xenophobic opposition to the fund. “There was a misunderstanding about my position on the issue of excluded workers and a couple of us were attacked,” Paulin said. “Carl was so supportive until those attacks ceased. So I continue to feel the support and the relation-
ship and I’m a big fan.” That’s not to say that members don’t have critiques of their speaker. After several leaks from the conference – including actual audio from a private meeting on impeachment that briefly halted voting on the chamber floor when it was reported – Heastie decided that he would temporarily split up the conference into multiple sections with different members. Newer and more progressive members got the short end of the stick with their group placed last in the order during which they met. The message was clear – the freshman and left-wing contingent of the conference got the blame even though, as Paulin would point out to Heastie in conference meetings, leaks are nothing new. Although some members felt Heastie handled the situation as best he could – including veteran Assembly Member Richard Gottfried – others thought a different route would have been more appropriate. “With that situation, I felt that it shouldn’t have gotten tighter, it shouldn’t have gotten more paranoid and kind of clamping down,” said Manhattan Assembly Member Yuh-Line Niou, who was part of that last group to meet when Heastie split up conference meetings. While she respects Heastie’s commitment to learning about the district-specific issues of his members, Niou felt he could have handled this situation differently. “There’s always been leaks, and it was like people were blaming the younger progressives, which I felt was silly.” Septimo offered similar frustrations about the situation. “It didn’t feel punitive, but it didn’t feel like the solution to the problem,” she said.

ACK IN THE pre-pandemic times, Assembly members had an informal basketball team that would play when they gathered in Albany. Aubry, the longtime speaker pro tempore, took over coaching when a heart attack prevented him from playing anymore. That meant he also coached Heastie. “I’ve had to bench the speaker on occasion,” Aubry joked. Heastie’s role on the court can be compared to his role as speaker – he served as the team’s point guard. But his participation in the recreational activity speaks to another part of his approach to governance that has made his leadership successful thus far. It offered an example of Heastie’s more personable side, one that members of the public don’t necessarily see as he checked his ego at the court and played a game with his fellow members. “I think a part of him feeling a part of us, is being a part
of us more than just being a leader or someone in charge.” This doesn’t just materialize through friendly ball games. “I’ve seen him when he’s line dancing with the members,” Brooklyn Assembly Member Rodneyse Bichotte Hermelyn said, recalling antics at the annual Black, Puerto Rican, Hispanic and Asian caucus weekend that Heastie attends. Bichotte Hermelyn offered a more sobering example of Heastie’s personal touch with members, speaking about his attendance at the funeral of fellow Brooklyn Assembly Member Phara Souffrant Forrest’s father. A freshman in the chamber, Souffrant Forrest ran an insurgent campaign against Walter Mosley, who Heastie worked to keep in his seat. “He waited,” Bichotte Hermelyn recalled. “I mean, we were like the first ones there.” Souffrant Forrest, who was not available for an interview, confirmed that Heastie did attend her father’s funeral last year. In a brief statement provided to City & State, she said the speaker works to communicate with members in order to build consensus. “Everyone can say that they’ve had a genuine personal conversation with him,” she added. Everyone, that is, except maybe Davila. “There’s never” – said with emphasis – “been any personal conversation between the speaker and I,” she said when asked about what he was like when the cameras weren’t rolling. “Ever.” No small talk, no questions about how the kids are doing. But Davila wouldn’t have it any other way. “I

don’t want to be friends with anybody,” she said of lawmakers in Albany, preferring to keep things strictly business to deliver for her constituents. The dichotomy between Heastie’s very different interactions with the two members offers insight into how he deals with lawmakers with different personalities and likely different expectations from him as a leader. It also illuminates a degree of adaptability to meet the specific needs of those under his leadership. That’s perhaps why, in his seven years as speaker, no challenge to his position has emerged, serious or otherwise. Some progressive freshmen indicated their support was not guaranteed after they won their primary elections. That included Souffrant Forrest. But when the time came, no viable alternative arose, and they voted for another two years of Heastie like the rest of the members. Those interviewed for this piece, old and new alike, recognized Heastie’s attempts to evolve with his conference as he welcomed an influx of new members.
H
EASTIE’S TENURE HAS certainly not been beyond reproach among members though, with tensions in 2021 – the most recent and obvious example. The speaker got a lot of heat for the Assembly’s decision not to impeach former Gov. Andrew Cuomo, a sign of a leader willing to take the brunt
of criticism for members of the Judiciary Committee to some, but a potentially damning decision to others. Septimo told City & State that if any consequences from that decision become apparent in the future, she would have to reevaluate her position on Heastie. She indicated that others who also thought the speaker erred may share her mindset. In that vein, freshman Queens Assembly Member Jessica González-Rojas – another who flirted with the idea of not supporting Heastie for speaker – offered overall positive sentiments on his job performance in a position she doesn’t envy, but that she continues to watch how he responds to new changes within the conference. Heastie also faced criticism for not strongly speaking out against the governor when the scandal around COVID19 deaths in nursing homes really broke open. He stayed quiet, and statements he did issue came off as weak compared to the fire lit within his chamber. That stayed true even when Queens Assembly Member Ron Kim publicly came under attack from Cuomo, with Niou telling City & State at the time that she felt Heastie didn’t adequately stand up for Kim in the face of attacks. Though even then, most members didn’t break ranks, declining to discuss their opinions on the speaker’s actions, or lack thereof, on the matter of rescinding Cuomo’s emergency powers.
Even if critiques or mistakes were to begin to add up in the minds of progressive members, a key ingredient remains missing for a theoretical uprising against Heastie: a challenger. None of the new members have expressed any interest in taking over the leadership position, and none of the veterans would name anyone specific when asked who could potentially replace him. Not that there is a desire on Heastie’s part to leave nor on members to see him go – many said that he offered no indication he planned to give up his post in the near future, and they said that they would attempt to convince him to stay should such a conversation take place. Also missing are the numbers required for any sort of rebellion. The new class of progressive Assembly members only began taking office a less than a decade ago, with the largest chunk elected just in 2020. “Culture shift takes time,” González-Rojas aptly pointed out, careful to add that she isn’t trying to say she’d like to see a new speaker. Each and every one could (in theory) want to see him gone and even find someone to run against him for speaker, but Heastie’s support among the vast majority of his 107-member conference likely won’t waver. “No matter who you are, first you’ve got to be able to count, as I always say to Carl,” Aubry said. “We have the votes. No matter what people say, we have the votes.”

HE MUCH-HYPED RETURN to in-person work office in New York City has not gone as planned. Despite high COVID-19 vaccination rates among adults in New York City and cases currently decreasing, the emergence of the delta and omicron variants postponed some companies’ timelines for returning to the office. Plus, some workers and companies aren’t sure if they’re ready to go back – or if they ever will be. The New York City comptroller’s office found in a recent report as of late January that time spent in workplaces was down 29% from pre-pandemic levels, according to Google mobility data. In midtown Manhattan, an area overwhelmingly reliant on commercial and tourist activity, it’s not just office buildings that have emptied out. A report last fall from the Real Estate Board of New York found that nearly 30% of storefronts in the office-dependent retail corridors of Midtown East and around Grand Central were unoccupied as of last summer. Before the pandemic, vacancy rates ranged from 10%-15%. “Pre-pandemic, they relied heavily on office workers and tourists, both of which have not returned in numbers close to the levels before COVID struck our city,” Andrew Rigie, executive director of the New York City Hospitality Alliance, said of restaurants in Midtown. “Now, nearly two years into the pandemic, the challenges continue to compound. And the uncertainty makes it very difficult to plan for the longevity of your business.” The challenges Midtown will likely confront in the coming years share some similarities with what lower Manhattan faced after 9/11 emptied out the then primarily commercial neighborhood in the early 2000s. Although the flight of workers from downtown office buildings didn’t last long, it helped to accelerate conversions of those commercial office buildings to residential buildings. Like the finance executives who the neighborhood had relied upon, lower Manhattan had to learn to diversify. With help from state and federal subsidy programs, those residential conversions ramped up. You started to see “strollers and dogs” on the streets of lower Manhattan, as Ross Moskowitz, a real estate partner at Stroock, put it. Those conversions were accompanied by efforts to sell lower Manhattan as a cultural and entertainment destination. Groups like Wall Street Rising, founded by now-City Council Member Julie Menin, promoted the neighborhood and its small businesses by hosting free art exhibitions and public concerts. Meanwhile, new kinds of commercial tenants in tech and media moved into the neighborhood’s gleaming new office towers. Though the pandemic still took a toll on lower Manhattan, that transformation arguably made the neighborhood more resilient. “Because lower Manhattan is more of a live-work-play neighborhood, you don’t see the same adverse impact on retail in lower Manhattan during the pandemic as you do in Midtown,” Basha Gerhards, senior vice president of planning at the Real Estate Board of New York, told the Commercial Observer. Some urban planning experts, real estate executives and local representatives agreed that lower Manhattan’s post-9/11 transformation holds lessons for how midtown Manhattan might reinvent itself when the city starts to emerge from the COVID-19 pandemic. “There’s not really a choice but to think about diversifying uses in Midtown, as we did in lower Manhattan after 9/11,” Kathryn Wylde, president and

CEO of the Partnership for New York City, told City & State. Menin, too, said that Midtown is in need of revitalization. “It was about reimagining and restamping lower Manhattan as a major place to work, live and visit,” Menin told City & State. “We now need to do the same thing for Midtown. If you go to Midtown, you can see block after block, street after street, so many small businesses have closed. They’ve closed because there simply isn’t the foot traffic from the commercial buildings.” The idea of turning Midtown into a socalled “live-work-play” neighborhood is one that makes sense on the surface. Residential neighborhoods already border the business district, and transit hubs and cultural centers like Broadway serve as local and international attractions. While some pointed to lower Manhattan’s transformation as a success story, there were key differences in the situation the neighborhood faced after 9/11 and the one facing Midtown now. If Midtown is going to reinvent itself, it might have to write its own playbook. The COVID-19 pandemic has not had the same effect on business districts that 9/11 had on lower Manhattan. While workers still haven’t returned to offices in pre-pandemic numbers, it remains to be seen whether that’s temporary and whether companies will move out of office buildings for good. “We’re still in a pandemic, things are still in flux,” Gerhards told City & State. Lower Manhattan, she said, had a sustained period of high vacancy in commercial buildings and concerns about filling that space predating 9/11. And in Midtown today, newer office buildings may be getting more attention than the more basic, often older buildings referred to as Class B and Class C buildings. “We see very healthy leasing activity in the Class A market,” Gerhards said. Wlyde added: “The old office buildings are the ones that are having trouble renting. The new buildings are doing great.” She mentioned projects like JPMorgan Chase & Co.’s new headquarters and RXR Realty and TF Cornerstone’s mixed-use tower – both supertalls going up on Park Avenue. Rezoning in Midtown East in 2017 laid the groundwork for the replacement of older office buildings with new commercial buildings, like One Vanderbilt, a skyscraper going up next to Grand Central Terminal. Gerhards said that it won’t be landmark buildings – either ones that have official landmark designation or ones that are
thought of as landmarks – that are targeted for conversions, but spaces that are considered “obsolete or less desirable.” Those are the Class B and Class C buildings. “You’re going to see the old office buildings, I think, come down for the most part, and you’ll see them replaced with residential or mixed residential and some kind of destination retail,” Wylde added. The work of replacing or converting those buildings, as Wylde and real estate experts acknowledged, won’t be cheap or straightforward. Older buildings with smaller amounts of leasable space can be easier to convert to residences because of the requirements for homes to have access to natural light and air. It was these older buildings in lower Manhattan that were ripe for conversion in the late 1990s and early 2000s. “In Midtown, we are talking about significantly larger floor plates and lot sizes, and there’s going to be constraints there in terms of what it means to bring light and air on the interior side of these buildings to any habitable dwelling units,” Gerhards said. Structurally speaking, converting hotels to residential buildings is perhaps easiest, and while the state established a program last year to encourage the conversions of hotels into supportive and affordable housing, regulatory and financial hurdles remain. Only one applicant applied to a fund set aside for the program so far. The high costs of potential office conversions inevitably leads to a conversation about incentives. The commercial to residential conversion wave that kicked off in lower Manhattan two decades ago was helped by a raft of federal, state and local policies. In the mid-1990s, the state established a now-expired tax exemption and abatement program, known as 421-g,
tailored to lower Manhattan. (Affordable housing requirements were not built into the state program, but the units were subject to rent stabilization.) Meanwhile, federal bonds incentivized commercial and residential development in the area. Conversions in Midtown today would have their own problems. Among other restrictions, local zoning does not allow buildings built after 1961 to be converted into residences. In her executive budget, Gov. Kathy Hochul proposed steps to make those conversions easier, including by allowing commercial to residential conversions in pre-1980 buildings, including in Midtown, through 2027. Five years, however, is a relatively short period for such conversions to get underway, especially amid an unpredictable pandemic. Some in and around the real estate industry argued that financial incentives for taking on the cost of converting unused office buildings into residences will be necessary to see conversions on a large scale. That’s especially true, they said, if affordable housing was required with these conversions. “I think if you’re going to add the element of affordability, you absolutely need a subsidy for that,” said Mary Ann Tighe, CEO of the New York Tri-State Region of CBRE, a real estate firm. Moskowitz, the real estate partner at Stroock, said that both financial relief and regulatory changes will be required to see conversions in Midtown. “You have to recognize that just because you’re offering incentives, you can’t overlook building code or multiple dwelling law, or other things that are related to the construction of any kind of housing,” he said. But an incentive program like 421-g might face more pushback today than it did in the ’90s. New York City Comptrol-

ler Brad Lander questioned whether incentives were necessary – especially if they’ll go primarily to the construction of market rate housing. “The track record of rapidly deployed tax breaks is one that makes you pause. And honestly, the post-9/11 housing subsidies are one of those cases,” Lander said, adding that the lower Manhattan conversions didn’t adequately incorporate affordable housing. “These are expensive conversions and giving billions of dollars for overwhelmingly market rate housing, I don’t think is the most efficient use of our subsidy dollars,” he said. An incentive program tailored to Midtown that prioritized “genuinely deeply” affordable housing is something Lander said he would consider. Samuel Stein, a housing policy analyst at the Community Service Society, suggested it wouldn’t be realistic to expect developers to undertake conversions that incorporate affordable units unless they’re given some financial motivation. “Without incentives, it would take a lot longer for the market to really bottom out and for the owners to come to the conclusion that it’s worth it,” he
said. Still, that doesn’t mean the state would have to – or should – pursue a new version of 421-g, he said, noting that a new program focused on Midtown could include stronger affordability requirements. (In her budget, Hochul proposed a newer – but not all that different – version of 421-a, a controversial tax program meant to incentivize the creation of affordable housing.) Some in the real estate industry were skeptical that a residential transformation of Midtown was even needed. “I don’t think Midtown is at the point yet where it has to think about converting most (commercial) real estate into more residential,” said Dan Biederman, president of the 34th Street Partnership and Bryant Park Corp. “The one exception is buildings that are so hard to convert to modern office use, that they’re better thought of as converting (to residential).” New York City Council Member Keith Powers, who represents Midtown, said it was too soon to predict the area’s real estate needs. Still, there’s value in diversifying. “Certainly, it makes sense to look at ways to loosen up and make Midtown more flexible in the way that we use it,” Powers said. “But I think we’re still trying to figure out what the future exactly holds.” Despite that uncertainty, it’s a safe bet to say that midtown Manhattan will likely have some surplus of unused office space coming out of the pandemic. New York City, in the midst of a housing crisis, has a deficit of affordable housing. Converting unused office space into homes seems like a straightforward idea. But it’s not the only way Midtown could be reimagined, Lander said. He pointed to the revitalization of the Brooklyn Navy Yard and Industry City as possible models for Midtown. More entertainment destinations, biotech companies and startups reliant on in-person work could be a part of Midtown’s future. “The more we can have the kind of activity that characterizes the Brooklyn Navy Yard or the more we can build on the cultural, creative tourist hub that is Broadway – that’s generating economic value in New York City that has benefits that just more luxury housing does not have,” Lander said. Shining supertall towers might define the city’s skyline, but Lander said he doubted it’s what attracts most people to New York: “It’s just hard for me to believe that kids out there in the rest of the country were like, ‘You know what I’m dreaming of? Going to work every day in a corporate office building.”

How can New Yorkers return to offices safely?
Workplace health and safety experts weigh in on the best practices for employers to follow to keep in-person employees safe. By Candace Pedraza and Annie McDonough

FTER TWO YEARS of predominantly remote work for office workers in New York, companies are starting to have their employees leave video conference calls behind and reopen their doors for in-person work. Some larger names operating out of New York City like CitiGroup asked their employees to come back to their offices on Wall Street as of Feb. 7, and both Gov. Kathy Hochul and New York City Mayor Eric Adams have made it clear that they want New Yorkers back to work in person as soon as possible. But, there are some major questions that employees will need to have answered before they feel comfortable with sitting down for hours on end in a confined space. Questions of sanitation protocols, flexibility in their work-life balance and how closely their offices will abide by mask and vaccine regulations will all be on the table. And, according to a study done by the Partnership for New York City, many employees simply prefer to be remote as it eliminates the possibility of an infection and aids them in being able to provide child care, among other personal reasons. City & State reached out to several experts to gauge what employees should keep an eye out for from their management, and how employers can strive to make their workspace as safe as possible amid the pandemic: Anna Bershteyn, an assistant professor of population health at NYU Grossman School of

Medicine; Denis Nash, professor of epidemiology at the CUNY Graduate School of Public Health and CEO of Epidemic Intelligence Service; and Nellie Brown, director and lead programs manager of workplace health and safety programs at the Institute of Labor Relations at Cornell University. These responses have been edited for length and clarity. What are precautions that office building owners, company management and administrators should take to protect themselves and workers during the transition back to in-person work? ANNA BERSHTEYN: Like schools and any other group settings, it’s best to have multiple layers of protection because none are perfect. Some layers, like reduced occupancy and mask requirements, can be dialed up and down depending on levels of transmission. Other layers are always good to have regardless of transmission, for example, making sure employees can stay home when sick. One of the best “always” layers is to increase the number of clean air exchanges in workspaces. This has upfront costs, but it pays back in many ways. It reduces COVID-19 risk without interfering with communication in the same way as masks or occupancy limits, it protects against other cold and flu viruses, and it prevents chronic illnesses linked to indoor air pollution. It also just feels nice to have clean air. All of this adds up to

DENIS NASH: I think it is important to understand that workers in the same organization may be in different places. Some feeling more comfortable with in-person work and others less so. To me, that means that it is important to be flexible with policies and procedures in ways that make sense to each environment. It is important for administrators to understand the landscape of comfort levels, and what steps they can take to help employees feel comfortable with how the organization is moving forward. NELLIE BROWN: Use your joint labor-management health and safety committee to develop or implement risk reduction policies and procedures. Make sure that employees know how to access benefits and support for grief, stress, fatigue, depression, work/family balance – put employee well-being into the workplace’s written policy. Be prepared to communicate a lot about new or changed policies and procedures with time and accessibility to respond to questions and concerns. Encourage keeping vaccinations up to date for SARS-CoV-2, influenza, etc. Even make vaccination for the pandemic a mandatory policy. If the workplace is covered by a collective bargaining agreement, then negotiate with the union.
ANNA BERSHTEYN: To reduce your COVID-19 risk and other risks, invest in your health. If you’ve gotten behind in health care, make sure you are up-to-date on vaccines including COVID-19 and flu, and book your physical, dental cleaning and any specialized care that you need. Be kind to your colleagues, and to yourself. You’ve all been through a lot. Before it’s time to head to the office, decide how low COVID-19 transmission would need to get for you to personally feel comfortable doing higher-risk things, like large group meetings or taking off your mask around others. If you’re older, high-risk, or live with someone at high risk of COVID-19, talk to management about possible accommodations like staggering meal breaks so you can avoid a crowded break room. DENIS NASH: In-person work, which is not a choice for many people at all, comes with a host of considerations beyond whether you feel comfortable about the safety of the workplace. It means considerations around the commute and it means considerations for those in the household, including those who may be medically vulnerable or unvaccinated or undervaccinated. In addition to getting boosted, use of higher grade masks in public places, including the workplace, are the best steps that an individual can take. Having some at-home tests in case symptoms develop or in the case of a workplace exposure is also a good idea if you can afford them. NELLIE BROWN: Be prepared for anxious feelings and for some changes in our social interactions. Maybe you won’t feel comfortable hugging or shaking hands with people – that’s a good defense mechanism that has served us well during this pandemic, and we will probably want to continue being choosy with our interactions for a while yet. Be willing to seek help if your emotions become too much to bear – we are all grieving the changes in our lives. Keep your vaccinations up-todate for SARS-CoV-2 and influenza to protect yourself and to protect others, especially the vulnerable among us. Practice good hand
hygiene and cough etiquette. Wear a good quality face mask or N95 respirator in indoor spaces other than a private office when you’re alone. If you feel sick, stay home or go home; test yourself or get tested, then isolate or quarantine as the CDC advises. Looking ahead, what changes do you see staying in the workplace even if current mask or vaccine restrictions are lifted across the state and in the city? ANNA BERSHTEYN: Some COVID-19 measures are a good idea even without a pandemic. Increasing clean air circulation in the workplace is great for general health. Making sure sick employees can stay home from work would help stop the spread of cold and flu. And even with offices open, remote work and virtual communication have many great uses and are sure to have a larger role than before the pandemic. DENIS NASH: I hope that there is more of a culture of workplace wellness. A culture of workplaces doing things to promote the health and safety of workers, including around infectious diseases like COVID-19 and flu. There are some times when people should just stay home, and they shouldn’t be penalized for doing so. It is actually helping to ensure continuity and minimize disruption in the workforce. NELLIE BROWN: Improvements to ventilation systems are probably here to stay. Professional societies involved in making ventilation recommendations have been advising that we rethink ventilation and building designs for airborne disease control. More provisions for outdoor dining and extending the seasons for outdoor dining will be here to stay. Mask-wearing will probably continue by individuals who are more vulnerable to infection, and maybe by people who have a cold as a courtesy to others. Cleaning and disinfection of commonly-touched surfaces will probably continue for a while. Flexible and hybrid work arrangements have proven so popular, as well as having no loss in productivity, that employers will probably continue a variety of arrangements. This means that some organizations will downsize their office space requirements accordingly.

A housing advocate who pushed for affordable housing in the SoHo rezoning, Jessica Katz was named to the newly created role of chief housing officer in New York City Mayor Eric Adams’ administration. Katz, who oversaw a budget of over $500 million at the Citizens Housing and Planning Council, will work with Adolfo Carrión Jr., a real estate executive who is taking the reins at the Department of Housing Preservation and Development despite a conflictof-interest case when he was Bronx borough president. Katz will oversee HPD as well as the New York City Housing Authority and the city Housing Development Corp., which is run by de Blasio administration holdover Eric Enderlin.

David Levinson and Robert Lapidus, who co-founded the firm in 2000,

ERIC ADAMS The New York City mayor received high voter approval ratings, praise for his public safety plan in Albany and a convenient distraction from a potentially damning story. Quinnipiac University released a survey that showed 64% of voters were optimistic about Adams. Moderate Democrats and Republicans in the state Legislature also lauded Adams’ agenda for addressing violent crime.

Former state Attorney General Eric Schneiderman really seemed to be (until now) privately trying to deal with the harm he caused, leading up to his resignation after being accused of physical and emotional abuse. Not everybody will like the steps he has taken – and the steps he hasn’t – but remember, it could be worse.
