Despite being an imperfect nation, founded by imperfect people, many of whom were lawyers themselves, our Constitution was written with the intention of being a foundation that should evolve with the times. The Constitution itself includes specific instructions on how it can be amended. The founders recognized that they did not have all the answers, neither to the questions they faced then nor the questions we as Americans would face hundreds of years later. This simple yet profound acknowledgement that our laws must reflect our values is core to NYSTLA’s mission as advocates for hardworking and vulnerable New Yorkers. Lawyers of all stripes believe in common decency and our shared American values—and it’s one of many reasons so many talented individuals find their calling in the law. As lawyers representing the very best of our profession, we must come together like never before, as our nation confronts systemic injustices, and we work to rebuild in the shadow of a global pandemic.

HERE AT CITY & STATE, our editorial team picked up on how Attorney General Letitia James is in the same position Andrew Cuomo was 13 years ago when he held the office and investigated then-Gov. Eliot Spitzer’s fall from grace. Now that Cuomo’s the one being investigated for alleged sexual misconduct in an independent probe overseen by James, we wondered if history will repeat itself. Will James follow the same path to the governor’s office? Some political experts say it’s a likely possibility, even though she hasn’t officially indicated any interest in running to be New York state’s top executive, writes Amanda Luz Henning Santiago in this week’s cover story. Meanwhile, others who have worked with James have insisted that she’s not trying to parlay the AG’s office into a run for governor, but just trying to do her job. Being attorney general does put James in charge of the biggest investigations in the state. Oftentimes, women of color, especially Black women, are seen as being criticized by the media for being ambitious, and that’s a major concern within the diverse communities City & State covers. Henning Santiago’s story illustrates that ambition is a core aspect of New York politics, and the ambition of white male politicians is sometimes viewed in a more positive light. We recognize that James has her work cut out for her at the moment with this investigation. The future will tell if City & State’s wonderings were right.

This is on top of the ongoing nursing home scandal, which is in part driving calls for Cuomo’s resignation and impeachment. In the latest development, the Cuomo administration reportedly tried to get details from the federal government about what numbers they would release about COVID-19 deaths in nursing homes, and whether they would differ from what the state publicly reported. At the time, the state was not including hospital deaths of nursing home residents.

Congress passed and Biden signed an enormous $1.9 trillion coronavirus relief package that’s set to deliver some $100 billion to New York state. In addition to money for struggling small businesses, schools, transit and other things, the stimulus includes direct and unrestricted funds sent to state and local governments. $15 billion Cuomo had been demanding for months, but still a huge sum that U.S. Senate Majority Leader Chuck Schumer’s spokesperson said was more than enough to cover the state’s budget deficit. The aid package was approved as budget negotiations begin to ramp up in Albany amid differing opinions about the actual state of New York’s finances. The governor’s office continues to paint a fairly grim picture, even with the cumulative aid that the state has received, while state Comptroller Thomas DiNapoli said that New York might actually be looking at budget surpluses this year and next, while still warning about a cloudy long-term outlook. New York City will also receive $6 billion, independent of the state’s funding.

Manhattan District Attorney Cyrus Vance Jr. recently announced he won’t run for a fourth term. Although this was the first confirmation he wasn’t running, his lack of fundraising and failure to participate in candidate forums indicated as much. Eight candidates are running in the Democratic primary to replace him, a race that was crowded long before it was clear that Vance wouldn’t run again. Whoever wins the primary is all but guaranteed to become the next district attorney and will likely inherit Vance’s investigations into former President Donald Trump. Those investigations have been gaining steam since Trump left office.

One might say that Corey Johnson already fell victim to the City Council speaker curse. After all, his run for mayor ended before it began, when he closed his fledgling campaign in September and became the latest speaker to unsuccessfully seek higher office after leading the city’s legislative body. Three of the four speakers before him ran for mayor and lost in the Democratic primary. The other, Melissa Mark-Viverito, ran for both public advocate, then Congress, and lost in both primaries. Now six months after opting out of the 2021 elections, Johnson is opting back in. He officially kicked off his campaign for New York City comptroller March 9 with a press conference in Manhattan’s Madison Square Park. And with that, he’ll get a second shot at becoming the first speaker in the modern era to extend his life in electoral politics. “Anyone who’s been speaker and run for citywide office, it’s clearly known it comes with difficulties,” said Camille Rivera, a political strategist who worked on Mark-Viverito’s 2020 congressional campaign. “You’re coming from a place where compromise is the name of the game. You’ve got 51 members … with different priorities.” With that comes difficult decisions under a spotlight that borough presidents or even the city comptroller rarely have to

deal with, like we saw in last year’s budget battle over reducing funding for the NYPD that was thought to have damaged Johnson politically. The job of speaker could also be deceptively powerful when it comes to electoral politics. “The reality is that the speaker position is not a citywide election position,” since they’re chosen by members, and not the public, Mark-Viverito told City & State. To win higher office, she said, “You have to be able to break beyond your district and make the pitch to a larger population in a multiracial, multilingual city.” But does Mark-Viverito believe the job is cursed? “I think that’s overstating it,” she said. Curse or not, Johnson seems to have a good chance at winning the race for comptroller. Other leading candidates like City Council Member Brad Lander, state Sen. Brian Benjamin and Assembly Member David Weprin have already accumulated a ton of endorsements and support before Johnson entered the race and have been actively campaigning for months. But Johnson should be able to catch up quickly. Thanks to the fundraising for his abandoned mayoral campaign, Johnson will actually enter the race having raised more private funds than any of his opponents. – Jeff Coltin

What was your childhood like growing up in New York City? It was the ’70s, so a very different New York than it is now. I grew up in Bushwick, we lived in Bushwick projects for a number of years. And then during the birth of Mitchell-Lama housing, we moved to Lindsay Park (a co-op in Williamsburg). I was explaining this summer to my children the many, many games that we played growing up in the city, from stickball to skelly. Just an amazing childhood.

After law school, you went to work for the Bronx district attorney, who was
Robert Johnson at the time. Interestingly, (Rep.) Jamie Raskin, who was the lead impeachment manager, was my professor in law school. And when I had three or four offers when I was coming out of law school, he was the person who said, “You really should go and be a prosecutor. Take the offer in the Bronx DA’s office. You’re not going to make as much money as maybe some of those other (offers), but that’s your strength, along with the fact that that skill set will be invaluable.” District attorneys’ offices are undergoing

major changes in New York City, as campaigns for those positions focus increasingly on criminal justice reform, racial inequities in the system and decarceration. What are your thoughts on that evolution? I think that it’s a really important discussion. One of the things I have to say that I noted about the Bronx DA’s office when I was there, was that a lot of the people that he hired were people from the neighborhood. It was a large number of minority hiring that was done, a large number of people of
color. And I think that that really had a great role in how we handled cases. What are your thoughts looking back on how the impeachment proceedings went, knowing that conviction was maybe not anticipated? People are always asking us, “Well, you guys didn’t think you were going to win?” I think we went in there with the hope that we would, and the belief that it was, in fact, possible. Would there be some watershed moment ... where Republican senators recognized that what had happened was so
profound that they would have to vote against their president? We believed that the evidence was so overwhelming, that that was, in fact, a possibility. I think what was disappointing was that partisan politics and power has so taken over that members were more interested in partisanship and in retaining their power and their seats than they were in voting to convict the president. Even though a number of them approached me and told me that they believe that we made the case. And these were Republican senators who did not vote to convict. – Annie McDonough

OV. ANDREW CUOMO’S star has fallen. The governor, who just last year stepped into the national spotlight for his handling of the COVID-19 crisis, is facing two major scandals: his administration’s reported cover-up of nursing home resident deaths caused by the coronavirus and a growing number of sexual harassment allegations being levied against him. While Cuomo will undoubtedly see his stature diminished by the controversies, even if he hangs on to complete his term and run for reelection, another statewide elected official will see her star rise: state Attorney General Letitia James. Although she had responsibility dropped in her lap for investigating both issues, technically at the governor’s request, James has already demonstrated independence by taking on the governor with a stinging report on nursing homes. Now, it’s possible James could follow Cuomo’s path to becoming New York’s top executive: a high-profile look into the governor’s alleged misdeeds. On Jan. 28, James published a report indicating that the number of nursing home deaths disclosed by the state may have undercounted by as much as 50%. Her findings ultimately led to the revelation that the Cuomo administration had
delayed releasing information about the actual death toll out of fear of politically motivated punishment from the Trump administration. In the wake of the nursing home scandal, James began overseeing an investigation into the sexual harassment allegations made against Cuomo, after the governor decided to cede control over the probe. He drew sharp criticism of his initial efforts to delegate authority to an ally, former U.S. District Judge Barbara Jones, instead of James. He also attempted to refer the investigation to both James and his appointee, Chief Judge Janet DiFiore, another bid for control that James rejected. On March 8, James announced she would be appointing Joon Kim, a former U.S. attorney for the Southern District of New York, and Anne Clark, an employment discrimination lawyer, to lead the investigation. While James has given no indication of any future ambitions for higher office, her recent investigations are reminiscent of her predecessors, Cuomo included, who used the attorney general’s office as a gubernatorial springboard. ary, James even joked that “AG” stands for “aspiring governor” during a press event – a joke well known to New York politicos. However, she also said that her office is “not focusing on the politics but focusing on the law,” during this time. James’ office declined to comment for this story. Political experts familiar with Albany politics also view the office as the go-to role for aspiring governors and say she’s in a position to make a name for herself. “She’s in a launchpad job, early innings, she would usually be expected to gather more experience before she was a competitive (contender) for governor,” Gerald Benjamin, a retired political science professor at SUNY New Paltz told City & State. “But it’s not only the job she’s in – she’s the direct player in the situation. So (her probe) does have a chance to build her a reputation.” However, those who have worked with James in the past say she isn’t positioning herself to run for governor, but just doing her job. It just so happens that the job has become one that places its incumbent at the center of the state’s biggest controversies. “I think it’s very interesting that there’s this expectation that Tish is just like the rest of (the former attorney generals), that Tish is just going to use this as some sort of path to something else,” Assembly Member Catalina Cruz, who has worked in the state attorney general’s office under Cuomo and has worked closely with James, told City & State. “I think people need to focus on the fact that we elected an extremely qualified attorney who just happens to be a Black woman,” Cruz continued. “If she were a white man no one would be ... thinking about what her ambitions are and what they’re not.” THE SHIFTING ROLE OF THE AG’S OFFICE The state attorney general’s office wasn’t always known for taking on high-profile cases, but since former Gov. Eliot Spitzer held the office between 1999 and 2007, taking on major power players has become expected of whoever serves in the role. New York’s constitution says little about what is expected of the role. Its power is mostly defined through state statutes. The governor can also imbue the attorney general with more power, as Cuomo did with former state Attorney General Eric Schneiderman. In 2016, Cuomo signed an executive order to give the attorney general prosecutorial power to investigate police misconduct. It was mainly through close examination of statutes that Spitzer was able to reshape the role of the attorney general. He used the Martin Act, a statute from 1921, which gives the attorney general the ability to prosecute financial crimes, to go after Wall Street. “He

identified some statutes about regulating economic activity and exploited – exploited sounds bad – but he used those powers fully to take on financial interests on Wall Street and became nationally recognized for that,” Benjamin said. During Spitzer’s two terms serving as attorney general, he became known as the “Sheriff of Wall Street,” who made a name for himself by aggressively investigating the state’s financial and securities industries. In 2002, Spitzer discovered conflicts of inter-
est involving stock analysts at Merrill Lynch, which led to his office charging the wealth management company a fine of $100 million. It also led to 10 of the biggest securities firms in the country collectively paying $1.4 billion in settlements over a conflict of interest case that was also launched by Spitzer. By 2004, Spitzer had become such a hero to liberals nationwide that Martin Peretz, then the editor-in-chief of The New Republic, suggested that then-U.S. Sen. John Kerry should choose Spitzer as his running mate on the Democratic presidential ticket. Following his second term as attorney general, Spitzer launched a successful campaign for governor and was elected to the office in 2006. However, halfway through his first term, he became embroiled in a scandal of his own, which led to his speedy resignation under threat of impeachment in 2008. Who was state attorney general under Spitzer? You guessed it: future Gov. Andrew Cuomo. Prior to Spitzer’s resignation, Cuomo launched a high profile and forceful investigation into Spitzer’s office’s use of state police for political purposes, in what was known as “Troopergate.” As a result of Cuomo’s investigation, four of Spitzer’s aides were charged with ethics violations. Cuomo then launched a successful campaign for governor in 2010

erful person or entity that she has positioned herself against throughout her relatively short time in the office. Since James was elected in 2018, her office has led investigations and filed suits against Amazon, Facebook, the National Rifle Association, the New York City Police Department and the Trump family. If Cuomo is impeached, resigns or doesn’t run for reelection, James would be well positioned to run for his office next year, especially if she is perceived as having demonstrated independence from him. “In terms of contenders to be governor of the state, attorney general is the best position you can have. At least in this modern era,” Robert Spitzer (no relation to the former governor), a political science professor at SUNY Cortland, told City & State. As the first Black woman to win statewide office, James’ journey to attorney general, however, has been much different than that of her predecessors. “James overcame racial and gender barriers in winning statewide elected office, a descendant of Southern sharecroppers and graduate of an HBCU (historically black college or university),” Luke Perry, a professor of government at Utica College, told City & State in an email. Some political analysts argue that the attorney-general-to-governor pipeline is a bad trend in New York politics, worrying that being a prosecutor isn’t the only, or even necessarily best, experience to train someone to do what the governor does: negotiate the budget with the Legislature, oversee bureaucratic agencies such as the Department of Transportation and grant the occasional commutation. “Please keep in mind that this investigation, whatever it finds, will be only one part of the record that would be the basis of her rationale for election,” Robert Bellafiore, a former Associated Press Capitol reporter and senior aide to former Gov. George Pataki, told City & State in an email. “New Yorkers already had one governor whose sole claim to fame was investigative chops and look how he turned out. To be a serious candidate for the highest office in this state, one should be able to demonstrate capacity to address a huge range of policy areas integral to New York’s future.” Eliot Spitzer and Andrew Cuomo each made big splashes in their stints as attorney general before becoming governor. Spitzer tackled corruption on Wall Street while Cuomo issued a key report on what became known as “Troopergate.”
and has remained in office since then. Schneiderman, who helmed the office from 2011 to 2018, until allegations of physical and sexual abuse of ex-girlfriends forced him to resign, had also built a strong reputation with the Democratic base. Schneiderman grew to prominence for suing Trump University, which led to further legal inquiries into Donald Trump’s business dealings after he was elected president. Schneiderman also put pressure on President Barack Obama’s administration to deal with Wall Street more forcefully following the financial crisis of 2008. Had Schneiderman not been accused of violence, he would have been the odds-on favorite to succeed Cuomo. Within just a couple of decades, the attorney general’s office has become the place to be if your goal is to rule the state. IS JAMES FOLLOWING IN HER PREDECESSORS’ FOOTSTEPS? James and Cuomo ran on a ticket together, after the governor endorsed the then-New York City public advocate for attorney general in 2018. While James’ nursing home report shocked some who were surprised to see her act as an adversary toward her former political ally, Cuomo is hardly the only pow-

James could still benefit from the investigation, even if Cuomo somehow manages to hang on and run for reelection in 2022, and she chooses not to challenge him. The attorney general’s enhanced stature could help her win a seat in the Senate for example – which is what Jacob Javits did – or she could land a job in a Democratic administration. James is carefully navigating the current probe, but it’s unclear if she’ll face sexist criticism as it plays out. For instance, New York Republicans, including state party Chair Nick Langworthy and Rep. Tom Reed, have attacked Lt. Gov. Kathy Hochul for not having publicly discussed whether she had known about Cuomo’s alleged behavior before it was reported. (Neither man lodged any criticism against former Vice President Mike Pence over allegations of sexual assault by President Donald Trump from 26 women.) Throughout her career, James has avoided the confrontational approach of some men in similar positions, such as Cuomo and Spitzer. “If she were to act like them and be that aggressive, then she’d be a ‘bitch’ right?” Lupe Todd-Medina, a political consultant and friend to James, told Politico. “So she’s not doing that and she’s soft? She’s damned if she do and she’s damned if she don’t. But what I will say: She’s always been driven, and I haven’t seen much difference from her (since becoming attorney general).” Cruz believes that James’ sole objective in overseeing the investigation into Cuomo’s allegations derives from her own interest in seeking the truth and providing it to the people who elected her to office. “I routinely say Tish can do this job and sit and think about the fact that she’s actually said, ‘Whether he stays in office or not, I’m still going to go get to the bottom of this, I’m going to continue my investigation and get to the bottom of this,’” she said. “She’s not saying, ‘If he steps down, this is going away.’ She’s saying, ‘The people deserve the truth and I’m going to find this for them.’” James has also stated many times that it is not her goal to replicate the models set forth by past attorneys general or dedicate her office to pursuing cases that are likely to gain statewide or national attention for her own personal advancement. “First and foremost, I’m a public servant. Less a politician, more of a public servant,” James told City & State in a 2019 interview. “I am an attorney. And I work with a talented pool of attorneys and nonattorneys, and we’re here to administer the law, and to protect the interest of New York state, a sovereign state. And so has the office changed? Has the direction changed? I would say no. We’re continuing to uphold the law and continuing to serve as the people’s lawyer.”

Much remains unknown about this year’s budget dealings, and not only because the state is in such unprecedented times. Neither chamber has even passed their one-house budgets, the nonbinding resolutions in which legislative leaders lay out their own priorities and the changes they want to see in the executive budget. And that’s where the negotiations among Senate Majority Leader Andrea Stewart-Cousins, Assembly Speaker Carl Heastie and the governor really begin. Until then, observers who are not in the room where it happens are really left to speculate. “We are in uncharted territory when it comes to negotiating the budget under these circumstances,” state Sen. Liz Krueger, chair of the powerful Finance Committee, said in a statement to City & State. “I’ve been around too long to think I can predict the future.” Some observers expect something of a change in dynamics between the Legislature and the executive branch. The budget is generally where the governor has the most control during the legislative year and where he attempts to pass his own biggest policy agenda items. But some on the left are hoping that the new supermajorities and the scandals will embolden legislative leaders during the budget process to pass priorities for the Democratic caucuses – which lean a bit to Cuomo’s left – including higher taxes on the rich and legal marijuana. “It seems that both Leader (Stewart-) Cousins and Speaker Heastie are kind of
comfortable going beyond what the governor has proposed,” said Charles Khan, organizing director for the Strong Economy for All Coalition, which advocates for new taxes on the wealthy. “They’re really leaning, in ways that they haven’t before, into their own leadership.” Khan referred specifically to Stewart-Cousins’ call for Cuomo to resign, and Heastie’s statement soon after that echoed her sentiments, although he did not explicitly call for resignation. And before that, they reached an agreement – albeit one that was still viewed as a compromise between different factions of their chambers – to curtail some of Cuomo’s expanded pandemic authority. Now Khan is hoping legislative leaders will push the governor on some of the new taxes, including a wealth tax and a tax on second homes, as part of the budget. “Cuomo is in his weakest bargaining position that we’ve ever seen him in – kind of unimaginable the way it looked a couple months ago,” Khan added. Melissa Moore, state director at the Drug Policy Alliance, is hopeful that Cuomo’s vulnerability will help get the Legislature’s version of marijuana legalization passed, which still remains quite different than the governor’s version on issues of social and racial justice. The governor for the first time this year committed to using a portion of tax revenue to reinvest in communities harmed by prohibition, a significant shift on his part, but legalization advocates have said his proposal still
falls short. “It seems as though there is a shift in the tenor and in the dynamics from where we generally would be,” Moore said. “I think the next few weeks are going to be wildly interesting.” Assembly Majority Leader Crystal Peoples-Stokes, who sponsors the bill to legalize marijuana, recently suggested that it could get passed before the budget. “That’s how close we are to completing a deal” with the governor, she told The Buffalo News. For his part, Cuomo is insisting that the recent allegations of sexual harassment and the nursing home scandal will not affect his work on the budget. When asked about whether the scandals weaken Cuo-

mo’s negotiating position, a spokesperson for the state Division of Budget referred to comments the governor made at a March 3 press conference. “I’m going to cooperate with the attorney general’s investigation and do the budget,” Cuomo said at the press conference. “Remember, we did a budget last year in the spring in the heat of COVID, where it was the most intense period of my life, of this government’s life, of this state’s life, and we did both, and we’ll do both here.” Camille Rivera, partner at the progressive political consulting group New Deal Strategies, said that it’s hard to deny that the governor’s position this budget season
has been weakened. “It’s pretty clear that the dynamics have changed and are going to change within the budget negotiations,” Rivera said. “Whether or not the governor seems to want to admit that is entirely up to him, but you’re going to see a stronger and bolder Legislature.” Before the COVID-19 nursing home death scandal really broke open, and before multiple women accused the governor of sexual harassment, there was already evidence of Cuomo at least nominally caving to legislative pressure. Since last year, both Stewart-Cousins and Heastie said they supported increasing taxes on New York’s wealthiest residents to raise money to ad-
dress the coronavirus crisis and the revenue shortfall resulting from it. Throughout most of the pandemic, and the rest of his time as governor, Cuomo has resisted any increase in the state income tax and the slew of other taxes on the rich that some lawmakers are proposing. He changed his tune when he presented his executive budget in January, which included a proposal to raise taxes on those who make over $5 million. It would raise $1.5 billion annually, less than any of the taxes proposed as part of the Invest in Our New York Act supported by progressives. He still expressed reluctance about the idea, but proposing it at all represented a pivot.

In January, Cuomo said that if the state got its full $15 billion request for unrestricted federal aid, then the tax hikes wouldn’t be necessary, even as legislative leaders doubled down on commitments to pass new taxes on the wealthy regardless of federal aid. Initially, he presented a budget that assumed just $6 billion in federal aid split over two years. Now, with the state set to receive about $12.6 billion, Cuomo still said that tax increases are “on the table.” E.J. McMahon, founder of the conservative think tank the Empire Center for Public Policy, said that now that the governor has proposed the tax hikes, and did not remove them when he submitted his 30-day amendments, they’re all but guaranteed to remain. “He proposed it as a tactic to basically – he did that as a favor to the leaders, in effect,” McMahon said. McMahon suggested that better than projected tax receipts in the past year and other federal dollars would have allowed Cuomo to present a balanced budget without any tax increases at all, even with a lowball estimate of unrestricted funds. Earlier this month, a report from state Comptroller Thomas DiNapoli suggested the state could even end the current fiscal year on March 31 with a $1.6 billion surplus. One longtime Albany insider suggested that regardless of the more recent scandals, Cuomo was always going to budge on some big-ticket progressive items, like having some sort of new millionaires tax, coming around to where legislators stand on marijuana legalization or breaking his own 2% cap on yearly budget increases. But for all the talk of supermajorities and scandals, New York’s constitution still gives the governor the bulk of the negotiating power when it comes to the budget. “Regardless of all this stuff, the governor still maintains extraordinary authority in terms of the budget process,” Democratic consultant Jake Dilemani said. Even with everything happening, that doesn’t change. Unlike normal legislation, budget bills are written and introduced by the governor, without legislative sponsors, putting Cuomo in a position of control from the very beginning. Legislators have little recourse when it comes to changing spending bills – they can’t amend any of the language and can only add spending through individual line item additions, which are subject to the governor’s approval. And spending bills make up half the budget, with the other half, called language bills, used to make any statutory changes necessary to enact the budget. Since he’s been governor, Cuomo has used these to introduce and pass any number of high-profile pieces of his policy agenda. While lawmakers theoretically have more control over these language bills, Cuomo’s control over the actual appropriations gives him an ad-

vantage in negotiations. Even if lawmakers tried to push through policy changes that Cuomo doesn’t support, they would need to override his veto of the language bills. Moderate Democrats aren’t likely to want to do that, and there is no indication that the Legislature has reached the point of attempting to cut Cuomo out of the process. And no one wants to be blamed for a late budget if politics gets in the way of timely passage. “I think everyone in state government is keenly aware of the fact that they want to pass a budget, and they want to do it as on time as possible, given the situation that

we’re in,” Dilemani said. Spokespeople for Heastie and Stewart-Cousins did not return a request for comment for this story. Dilemani suggested that the scandals could prove to be something of a distraction for lawmakers, eating up limited bandwidth during budget crunch time, and that some lower-tier priorities, or complex policy that doesn’t directly relate to the actual budget, could fall out of the bill as a result. That could include marijuana legalization, which has been dropped from the budget the past two years due to negotiations that couldn’t be resolved. But if issues shift away from the budget to the regular legis-
lative process, legislators might again have the advantage of addressing them on their own. For example, both chambers have passed bills to increase oversight of nursing homes in the wake of the pandemic, something that Cuomo has also proposed getting done as part of the budget. Another factor to consider is that Cuomo is a masterful negotiator, and, according to McMahon, Cuomo had already begun planting seeds for greater leverage even before his scandals emerged. He pointed to a provision buried in one of this year’s spending bills. Based on existing language in Cuomo’s proposed budget, the state can only spend $6 billion in unrestricted federal aid. That amount is the estimate from the state of the minimal amount of money it would get from Washington. Cuomo balanced his budget proposal based on that worst-case assumption, but he was asking the federal government for more to reduce the use of cuts and tax hikes. The proposed budget language has a provision to appropriate an additional $9 billion, but only if the state receives $15 billion or more in unrestricted funds from the federal government. McMahon interprets that to mean that, even with the state set to receive $12.6 billion in unrestricted aid, the Legislature can’t spend a cent more than $6 billion without the governor agreeing to resubmit the bill with updated language. Power over use of that money alone puts Cuomo in a strong negotiating position. “He’s totally in the driver’s seat,” McMahon said. “He’s controlled the narrative from the start.” When asked about the appropriations budget provision, as well as the inclusion of tax hikes even with greater than projected federal aid, Division of the Budget spokesperson Freeman Klopott said in a statement: “The Governor made very clear the state … needs $15 billion from Washington. The federal legislation provides approximately $12.6 billion to the state, however we are evaluating the bill and seeking further guidance from the federal government to better understand how this funding can be used.” He added the funds are nonrecurring, and the executive branch will work with the Legislature to find solutions for the current future projected budget gaps. The combined budget hole for the current fiscal year and the upcoming one is estimated at $15 billion by the state, although other estimates are lower. The budget negotiation is always an opaque process, and often observers don’t know how negotiations play out until the day the budget is passed. With everything happening in Albany right now, the state budget might get less attention from outsider observers than it usually does, but for the very same reasons, it may be an especially interesting budget season to watch.

district attorneys are among the most powerful elected officials in the five boroughs, with wide latitude to decide which types of crimes to pursue – and which to avoid. In the Bronx, the establishment-backed prosecutor Darcel Clark is currently serving a second term after running unopposed in 2019. She dismissed hundreds of curfew summonses from a night of protesting the police killing of George Floyd, but more than 50 prosecutors in her office responded with a call for her to do more to combat police violence. She has also taken recent steps to diversify her staff. Brooklyn District Attorney Eric Gonzalez, who is now running unopposed for a second four-year term, has

a reputation as a reformer. After adjusting his office to the pandemic last year, in the first month of 2021 he released his plan to vacate over 200 warrants related to prostitution and co-hosted a gun buyback event that got 48 firearms off the street. In the summer of last year, he published a report on wrongful convictions in Brooklyn. In Queens, Melinda Katz is the first new district attorney in nearly 30 years. She took office last year after a hard-fought primary battle with newcomer Tiffany Cabán, stepping into a role that has a history of overlooked and covered-up misconduct. While making adjustments due to the pandemic, Katz focused on investigating potential wrongful convictions and reducing prosecution of low-level, nonviolent offenses. On Staten Island, the for-
mer New York City council member and U.S. representative Michael McMahon has served as district attorney since his election in 2016. Recognizing that Staten Island is the epicenter of the heroin and prescription drug crisis in New York City, he made the crisis a central focus for his administration. In 2019, he expanded his HOPE program, which focuses on getting low-level drug offenders into treatment instead of jail. In Manhattan, the home of what is traditionally the most high-profile prosecutor’s office, Cy Vance is in a unique
position. He is not running for reelection this year, but his investigation of former President Donald Trump’s business dealings is moving along. Last year, Vance won a landmark ruling affirming that presidents are not immune from the criminal process. Vance issued subpoenas and questioned witnesses in regard to Trump’s business dealings and The Trump Organization, and in February the U.S. Supreme Court sided with Vance: The tax returns and other documents he sought were finally turned over.

DUCATION IS A huge part of New York’s budget, accounting for around a quarter of the state’s expenditures in normal years. Since the onset of the COVID‑19 pandemic, however, the state has used an influx of federal dollars to supplant a portion of its aid to local school districts. Last March, the CARES Act allocated $1.2 billion toward education, and the December stimulus bill included nearly $4 billion. But the March package offset nearly one‑to‑one reductions in the state’s own aid – with total education spending remaining flat – and approximately half of the December assistance supplanted education spending in the executive budget proposal for the coming fiscal year. Though the remainder of the Decem‑ ber aid does represent a supplemental investment of approximately $2 bil‑ lion, advocates claim that the federal assistance was not intended to replace the state’s own education spending. “The federal package did not in‑ clude any aid for state and local gov‑ ernments, so even though schools were getting a boost, there was no money for Gov. Andrew Cuomo to use just to close the state budget gap,” said Jas‑ mine Gripper, executive director of the Alliance for Quality Education. Critics of the state’s management of the federal aid argue that the addition‑ al funding was needed to keep schools running during the pandemic. Michael Mulgrew, president of the United Fed‑ eration of Teachers, told City & State the federal aid was needed for personal pro‑ tective equipment, ventilation upgrades and nightly cleaning, in addition to the costs associated with remote learning. “Whenever we fight for aid, we hate when anything gets supplanted,” he said. A spokesperson for Cuomo did not respond to a request for comment on the state’s use of the federal aid. New York is currently facing a project‑ ed budget deficit of $60 billion over the next four years. The $2 billion supplemen‑ tal portion of the December aid is slated
to drive a 7.1% increase in total educa‑ tion spending in the proposed 2021‑2022 budget – versus a typical annual increase of around 3% to 4% – which raises the possibility of a fiscal cliff once emergen‑ cy assistance from Washington dries up. In his executive budget for the coming year, Cuomo proposed two recurring ac‑ tions that would result in aggregate reduc‑ tions in education spending. The so‑called Local District Funding Adjustment would reduce school aid by about $1.3 billion annually, and the Services Aid consolida‑ tion – which combines 11 expense‑based aid categories into one – would yield around $700 million in recurring savings. Under the proposed Local Dis‑ trict Funding Adjustment, school dis‑ tricts that receive more funding from the state through the School Tax Relief, or STAR, program – which per capi‑ ta tend to be wealthier districts – would see the steepest reduction in aid. Nev‑ ertheless, education equity advocates argue that the state has been underfund‑ ing public schools since the 2007 en‑ actment of the Foundation Aid formula, following the landmark 2006 Campaign for Fiscal Equity ruling that found that New York was underfunding schools. “Cuomo is choosing to balance the budget on the backs of Black, brown and low‑income students by reducing the state’s commitment to education instead of what he should be doing, which is asking the ultrarich and New York’s billionaires to pay a little bit more,” Gripper said. Given the particularly hard toll the pandemic has taken on New York’s business districts and retail sector, coupled with the explosion of remote work, it may take a while for property taxes – which constitute the city’s larg‑ est tax revenue stream – to rebound. “The city is going to be facing this multi‑ year revenue hit on the property tax, which it has not had during prior recessions, and so its ability to fill in if state aid is lower – which is what they have usually done with their own resources – is going to be more constrained,” said Ana Champeny, direc‑ tor of city studies at the Citizens Budget Commission, a nonpartisan fiscal monitor. As a fiscal crisis looms in New York, the Biden administration just final‑ ized another round of stimulus funding. The bill includes $130 billion in edu‑ cation aid for schools to reopen. With students having to make up for learning loss and, in some cases, suffering from emotional trauma, Mulgrew said the city would need the additional federal aid. “Smaller class sizes definitely are going to have to be in place, and how do we start to help children who have been great‑ ly harmed because of the pandemic?” he said. “It wasn’t fair, and the teach‑ ers are ready for that challenge, but you can’t tell us to take on this challenge with our hands tied behind our backs.”

couple of years on the job. “You can be a master of your content, but if you don’t have that presence in the classroom – that extra spice – you’re doomed,” said a teacher at a Queens public school who asked to remain anonymous due to not being authorized to speak to the media. New teachers often misjudge the rigors of classroom management, and many are unaware of how many nights and weekends they will end up devoting to the academic and administrative demands of the job. Just as inexperience can be a liability in the classroom, so too can a lack of familiarity with the local community.
According to the comptroller’s report, in the 2017-18 school year approximately 60% of New York teachers were white, while the city’s student body was 41% Hispanic, 26% African American, 16% Asian and 15% white. The report highlighted the need to ramp up recruitment of teachers of color. “We need to really diversify our teaching corps as our population is diversifying and look at how we can be more intentional about ensuring that our teacher population really mirrors that of our student population,” said Kenya Bradshaw, vice president of policy and community coalitions at TNTP,

VER THE PAST YEAR, the coronavirus pandemic has exposed disparities in education, like the health crisis did across so many sectors of society. When schools were forced to go remote a year ago, some students from low-income households struggled with online classes due to not having a computer, highspeed internet or a quiet workspace. Teachers also had added pandemic burdens: adapting lesson plans, attendance and progress reports to the unprecedented demands of remote learning, as well as dealing with elevated levels of anxiety among students and parents. Schools are not insulated from the socioeconomic circumstances of their communities, and those located in underserved areas experience higher rates of teacher turnover. A 2019 report from the New York City Comptroller’s office found that turnover was “concentrated in higher-need school districts, where the surrounding community is often lower-income and where the majority of students are children of color.” Attrition costs to the public school system are substantial, the report found. But teacher churn, experts say, also imposes a cost on the culture of a school and can be a contributing factor to less stable learning environments. Many new teachers underestimate what it’s like to teach in a New York City public school. It is common for new teachers to struggle with classroom management, and they may only last a

a nonprofit that helps urban school districts recruit and train new teachers. Bradshaw said school districts need to be more innovative in building pipeline programs to ensure that local teachers have “the community and cultural context of their students.” “When I first started working at the high school, most of the staffers were Caucasian and they didn’t really understand the culture,” said a Hispanic former dean of a public school in Upper Manhattan, who asked not to be identified in order to speak candidly about his former workplace. “I remember the school officials even decided to do a trip out to the
Dominican Republic so the teachers could learn a little more about the students.” Since boys tend to be more disruptive in class, the former dean said that male teachers from the community could help struggling students. “Schools need more male role models that the students can identify with and whom they can relate to,” he said. Classroom management skills come more naturally for some people than others, but good training can help novice teachers make it past the first couple of years on the job. A teacher, for instance, is more likely to remain in control of their classroom if they
can handle disruptions on their own without calling on outside help. A model championed by New Vision for Public Schools, a nonprofit that runs a charter school network and teacher prep program, places teacher apprentices alongside experienced educators before they receive their own full-time classroom assignment. “These types of programs are difficult to scale because they require a larger upfront investment in the training,” said Mark Dunetz, the organization’s president. “But they pay for themselves later because you have less teacher turnover and the

teachers tend to be more effective than those trained in traditional models.” Measures that have been shown to reduce teacher attrition often do require substantial investments. Smaller classes can ease teaching loads, but require building or acquiring more classroom space in addition to hiring more teachers. “The research is crystal clear that all students benefit from smaller classes, but low-income students receive twice the benefit in terms of test scores, grades, disciplinary referrals, livelihood, graduating from high school on time and going to college, and graduating with a STEM degree,” said Leonie Haimson, executive director of the nonprofit Class Size Matters. In any profession higher pay can help attract and retain talent, but there are also smaller ways to improve teacher morale. For example, in some schools, teachers feel that principals place them under a microscope, such as requiring them to drop off lesson plans every day. In other schools, teachers feel that they lack the support system to deal with difficult working conditions. But school administrators in low-
income neighborhoods can also become overwhelmed. Administrators often have to make sure that students’ basic needs are met – such as housing and food – before they can turn their attention to academic matters. “Sometimes it feels as though the school’s run like a factory,” the Queens public school teacher said. “I know
disproportionately affected low-income communities have been well documented. With in-person instruction returning in New York City, the city could invest more in the mental health resources that many experts and educators have argued is long overdue. There is a push underway by the United Federation of Teachers, the union that represents New York City teachers, to create smaller class sizes to make up for the learning loss and academic regression that has occurred over the past year. The UFT had been lobbying for President Joe Biden’s American Rescue Plan, which was recently signed into law, that includes $130 billion to help K-12 schools reopen. A day after the cuts, the MTA announced they would return to a full schedule.
