HOW TIMES CHANGE. City & State featured Melissa DeRosa in a 2017 cover story about New York women serving in government. Now, because of recent events involving her boss Andrew Cuomo, the secretary to the governor of New York is once again the focus of a cover story. This second time around, City & State chose an illustration of DeRosa by Philip Burke that depicts her on her cellphone texting from within the halls of the state Capitol to defend the state’s top executive. This is a reference to the harsh and profane text messages written by DeRosa to state Sen. Alessandra Biaggi, a former gubernatorial staffer turned vocal critic of the governor, that were first made public by New York magazine. It was an example of how DeRosa’s protected Cuomo as part of her job, writes Zach Williams in this week’s cover story. That same job included overseeing a report that undercounted COVID-19 deaths among nursing home residents. DeRosa’s also been alleged to have contributed to an abusive culture that permeates the governor’s office. City & State recognizes, as former colleagues of DeRosa do in Williams’ story, that strong-willed men in politics are treated differently than women, who are often portrayed as nasty divas. That’s a stereotype Williams avoids by going deep into DeRosa’s background and speaking to former colleagues who call out such a double standard. The end result is a comprehensive piece that shows the successes, failures and alleged extremes of a fierce Cuomo loyalist and the price she’s now paying.

Assembly Speaker Carl Heastie and Assembly Judiciary Committee Chair Charles Lavine announced they had hired a law firm to help with the chamber’s impeachment investigation. But their choice of Davis Polk & Wardwell was met with immediate backlash
because of its ties to a Cuomo ally. Dennis Glazer, who is married to Court of Appeals Chief Judge Janet DiFiore, was a partner at the firm for over 30 years. Debra Katz, the lawyer for Cuomo accuser Charlotte Bennett, called it “an unacceptable conflict of interest.” The announcement came after a contentious Assembly Democratic gathering about the
impeachment investigation was leaked. During the meeting, which took place shortly before the speaker announced the Assembly would launch an investigation rather than begin a formal impeachment inquiry, Heastie touted the importance of “due process” when defending the plan to move forward with an investigation. Some members said the move was just a stalling tactic to buy Cuomo time. Lindsey Boylan, the first former Cuomo staffer to accuse him of sexual harassment, said she would not cooperate with the Assembly investigation, calling it a “sham.” She is however participating with the state attorney general’s investigation and has spoken with investigators. Other accusers, including Charlotte Bennett and

ONE-HOUSE BUDGETS APPROVED
ONE AND DONE Facing the greatest controversies of his career, Gov. Andrew Cuomo received the Johnson & Johnson vaccine at a Baptist church in Harlem, surrounded by Black community leaders. Cuomo has called for greater vaccine availability in Black and Latino communities and said he wanted to dispel vaccine hesitancy with the visit, but the event struck some as an attempt by Cuomo to leverage his support among Black voters to distract from his political woes.

When he became aware of the leak, Heastie abruptly halted voting on the floor to gather his members into another closeddoor meeting, where he told them he would not hold any more virtual meetings with the whole conference, instead only planning to hold smaller group meetings. The Executive Chamber has hired lawyers to represent its staff in the ongoing investigations being conducted by the Assembly and the attorney general. Cuomo’s office is also conducting its own investigation into the groping allegations made against the governor by a staffer who remains anonymous.

The state Senate and the Assembly approved their one-house budget resolutions, offering competing visions for state spending. Both chambers proposed significant spending increases, bringing their proposed budgets to over $200 billion. The budgets included $8.2 billion in new taxes, far more than the $1.5 billion in temporary tax hikes that Cuomo had put forward but still falling well short of the $50 billion that progressives want. The proposals include higher income taxes for the wealthy,

a pied-à-terre tax on second homes, new capital gains tax and increasing the estate tax rate – although some differences exist between the two chambers’ proposals. Both chambers have also put forward far more education funding, both in Foundation Aid and in additional money to fulfill the 2006 Campaign for Fiscal Equity ruling, which has been an ongoing battle. Notably absent from the resolutions was legislation to legalize recreational marijuana. Lawmakers, including state Senate Majority Leader Andrea StewartCousins, say they’re close to a deal with the governor with a few sticking points including the number of plants a person can grow for their own use and how to deal with impaired driving. They expect legislation to pass before the budget.

Asian American lawmakers discuss recent hate crimes
SOLITARY CONFINEMENT BILL PASSES
A bill to end the use of long-term solitary confinement in New York passed both chambers of the state Legislature after years of advocacy. Criminal justice advocates have pushed for the Humane Alternatives to Long-Term Solitary Confinement Act that would stop the use of segregated confinement for more than 15 days. The United Nations says that confinement for longer than that constitutes torture. The legislation has been opposed by corrections officers, who argue that doing away with long-term solitary confinement puts them in danger and they don’t have faith in the alternatives that the bill would create. The legislation now awaits action from the governor.
New York has seen an increase in hate crimes and bias incidents targeting Asian Americans. Before the recent shootings in Atlanta, City & State spoke to Asian American lawmakers about their experiences during this crisis. Rep. Grace Meng, on what it feels like to be an Asian American elected official right now: Growing up as an Asian American, my experience – I don’t want to speak for everyone – but my experience was always to be encouraged to blend in, to fit in, and to be invisible. ... We were taught that if we fit in and stay quiet then we would be seen as “American enough.” Right now, ... we can finally say to ourselves: We don’t have to be silent. State Sen. Kevin Thomas: There’s been a lot of hateful rhetoric in politics in the past couple of years … it’s similar to after 9/11, when a lot of South Asians were targeted because they were brown and had a beard or wore a turban. ... It’s important as one of the very few Asian Americans in the state Legislature to have a voice, to uplift the community.

Right now, the state Legislature is considering relief for renters, landlords and homeowners. From your perspective, is the relief going to be enough, and how will it get to those who need it most? It is pretty much going to be on target for addressing rent arrears. There’s going to need to be a process to ensure this help gets to tenants and owners. We’re all in this: Tenants can’t pay their rent. Owners can’t pay their bills, taxes, mortgages, etc., right? So, it becomes a matter of having an orderly process that the money gets out
on a timely basis and in an accurate manner. You know that that’s going to take some time. We are in conversations with state officials about the most sensible way to get the rent relief out. How satisfied are you with the way New York’s lawmakers worked with the Biden administration to make this relief possible? You got to give a big shoutout to (U.S. Senate) Majority Leader (Chuck) Schumer and the congressional delegation because of the speed at which this moved through the process. I think

most folks would find it impressive and it was a comprehensive package as opposed to some of the pieces of stimulus in the past. There were multiple reports a year ago of New Yorkers leaving because of the coronavirus pandemic, and some proclaimed the city was dead. How would you respond to the fact that people have left? Let’s make sure we’re going to operate from the same factual premise, because people in some published reports are like, “Oh, we’re getting out of Florida. I’m coming
back.” So, we just have these anecdotal stories. There hasn’t been really hard (and) fast data yet. I mean it is of concern, but what’s interesting is that it was a concern prepandemic. The city lost population for years before the virus. That already wasn’t a good sign. Developers and policymakers are working on how to rebuild New York after the pandemic. What’s your vision? One of the things we like to remind folks is that on an annual basis, over 50% of the taxes the city collects comes from real estate
activity. We’re not going to get there overnight, but we need to pursue a set of policies that sends us in that direction and gets people back to work. It’s going to require innovative government programs and folks putting their ideologies aside to get that done. How long do you expect this period of rebuilding will last? It’s going to take a bit of work. Depending on the decisions made by city, state and federal officials, that will determine whether or not this is a turnaround that takes three to five years or takes 15 to 20. – Ralph Ortega

Cuomo sent Melissa DeRosa to put out his fires. Now she’s getting burned. By Zach Williams

DeRosa became a pandemic hero in the media last spring alongside her boss, Gov. Andrew Cuomo. They are now having a fall from grace in part because of a shared abrasive management style.
ILLIONS OF AMERICANS got to know Secretary to the Governor Melissa DeRosa over the past year. She appeared in nationally televised COVID-19 briefings and in glossy magazine profiles. She rallied celebrities on social media to combat the pandemic. Whenever Gov. Andrew Cuomo spoke to the public, DeRosa was seemingly always by his side, working her smartphone, shuffling paperwork and offering responses to just about any question reporters might ask about the greatest public health crisis to hit New York in a century. Like her boss, DeRosa developed a national reputation as an avatar of competence and calm, in stark contrast to the chaos emanating from the White House. “Their strategy is simple: Be as transparent as possible, even when the news is bad,” reads an April story in Elle, referring to Cuomo’s team. For better or worse, her time in the national spotlight was hardly over. As protests against systemic racism erupted last summer, causing other New York political figures such as New York City Mayor Bill de Blasio embarrassment over their reluctance to stand up to their own police, DeRosa continued to enjoy flattering coverage. “We flattened the curve, and we saved lives,” she told Harper’s Bazaar. “We now must use that same energy and unity and resolve to confront and beat back 400 years of systemic racism and discrimination.” The June issue of the fashion magazine featured DeRosa on one of six covers that also included a member of Congress, a widely respected epidemiologist and a six-time Olympic gold medalist. An advisory role to the transition team for President Joe Biden hinted at bigger things to come for the 38-year-old DeRosa. “Instead of working 24 hours a day, she’s been working 27 hours a day lately,” an anonymous source told the Daily News in January. Now, with Cuomo under scrutiny for his management of COVID-19 in nursing homes and a series of sexual harassment allegations, DeRosa’s public image is again following the governor’s trajectory, and this time it’s downward. Her role in overseeing a report that undercounted COVID-19 deaths among nursing home residents, as well as

her role in contributing to a reportedly abusive work environment in the governor’s office, is leading a growing group of former gubernatorial staffers (and some anonymous current ones), state lawmakers and political insiders to say she embodies much of what is wrong with Cuomo’s reportedly brutal management style. “The enforcer for all of this is Melissa DeRosa,” a former senior Cuomo staffer told City & State on condition of anonymity. “And the way she goes about it is often about tearing you down to build herself up, and it’s usually about making sure other people see her do that to you, so they know they are a target as well.” The Cuomo administration denies these charges. “Melissa is the exact same person behind the scenes as she is on camera – tough, hardworking, brilliant, meticulously prepared, and always fighting to improve the lives of New Yorkers,” Cuomo spokesperson Rich Azzopardi said in a statement. The governor is the indisputable head of his administration, but DeRosa (the first woman to ever be named to the top appointed position in the state) has an outsized influence in keeping staff in line. She entered the administration in 2013 as a spokesperson for the governor working under then-Secretary to the Governor Bill Mulrow, and moved up the ranks of Cuomo confidants as other aides left the administration. By the time Cuomo’s last reputed “enforcer” Joe Percoco went to federal prison in 2018 following a federal conviction for bribery, DeRosa had become one of the few people inside the governor’s innermost circle, after succeeding Mulrow in 2017. “DeRosa is definitely one of those people who, at the end of the day, their main goal is to make sure that he’s happy,” said a current gubernatorial staffer who requested anonymity to speak candidly. “His personality is always an element in everything.” Like Cuomo, DeRosa’s image took its first major recent hit on Jan. 28, when a report on nursing home deaths released by Attorney General Letitia James stated the administration had undercounted the official death toll by 3,800 people in a report that DeRosa oversaw. The present scandals afflicting the administration really began

accelerating after a Feb. 10 meeting between top administration officials and state lawmakers. The legislators were upset about months of delays in fulfilling their request to release data on exactly how many nursing home residents died of COVID-19 in hospitals. According to DeRosa’s comments in that meeting, the administration delayed releasing information to state lawmakers because the Department of Justice was also requesting similar information. “We froze,” she said. “We were in a position where we weren’t sure if what we were going to give to the Department of Justice, or what we give to you guys, what we started saying, was going to be used against us.” Those words were leaked to the New York Post. Cuomo then made a fateful telephone call, in which he allegedly threatened Assembly Member Ron Kim, demanding he disavow a statement on the brewing scandal or face retribution. Azzopardi told The New York Times that Cuomo had only asked Kim to clarify his remarks. The governor went on to criticize Kim in a press conference, making accusations of unethical fundraising practices. A full transcript of the Feb. 10 meeting was released on Feb. 17, and the scandal blew up from there. As The Wall Street Journal reported, DeRosa and other top gubernatorial advisers – including Health Department Commissioner Howard Zucker, Department of Financial Services Superintendent Linda Lacewell and SUNY Chancellor Jim Malatras – reviewed and requested changes to a July report by the state Department of Health that blamed unwitting nursing home staff for spreading the coronavirus in facilities across the state. An earlier version of the report included thousands of deaths among nursing home residents in hospitals, which did not appear in the final version after DeRosa and Lacewell saw the data, according to the Times. Cuomo administration officials said that was because they remained unsure at the time about the accuracy of the data. Another growing scandal meanwhile belied the political persona DeRosa, who declined to speak with City & State for this story, cultivated as a no-nonsense, cando professional. People who have worked under her supervision though told New

DeRosa became a calm, collected fixture at Cuomo’s widely viewed pandemic press conferences. Behind the scenes, staffers recount a different attitude.
York magazine that the Executive Chamber is not as efficient and competent as its reputation suggested. “There’s so much fear all the time,” former speechwriter Camonghne Felix told the magazine. “That’s bad because it stops not just progress; it stops government from efficient governing.” DeRosa has been known to shame colleagues with dismissive looks, profanity and insults, according to a former senior gubernatorial staffer. “One thing that’s noteworthy about Melissa is her penchant for impossible requests,” the former staffer told City & State, on the condition of anonymity to avoid reprisal from the administration. For example, a staffer might be ordered to get someone to change an already published statement and then be insulted if it didn’t happen. “It often can feel when you’re working for Melissa DeRosa like you are trapped and condemned to failure,” the former employee said. Staffers expend a lot of effort pleasing the governor. Longtime staffers advise young women to bring heels and skirts whenever Cuomo is around, the Times reported. Men supposedly had to keep their shoes shined or risk a displeased comment
from the boss, according to WNYC. “I got screamed at for a lot of bad photos,” one former staffer told New York, of selecting which gubernatorial photos to release to the public. A current staffer said DeRosa could leave underlings scrambling to get things done with little notice or issue a sudden request to track which cable news networks are featuring Cuomo for the longest time on screen. “This is obviously a hard charging environment that’s not for everyone but I’m not going to stand by and let her be maligned,” Azzopardi said in a statement to City & State, in response to those claims Cuomo critics have drawn a link between DeRosa’s managerial style and the numerous allegations of sexual harassment and assault against the governor. She has not been linked to any of the allegations, but she nonetheless faces her own allegations of abusive behavior. “When Melissa looked at me; I could not have felt like less of a human being,” one former staffer told New York. Screaming, cursing and crying were common sights when DeRosa dealt with subordinates, according to The New

gubernatorial fundraising during budget season the following year. The irony is that DeRosa herself has detailed her own experiences with workplace abuse in a state Capitol where sexual harassment remains a norm to this day. She too has had to endure salacious comments from powerful men who preach the virtues of equality in public. “I’m not sure which I find more offensive – the fact that this kind of behavior has been allowed to continue to go on as long as it has, or the idea that everyone is acting as if they are just now finding out about it,” she said at a 2017 keynote address at delivered
York Times. “We’ve promoted each other, and we’ve supported one another,” DeRosa told reporters after multiple women came forward with allegations of sexual misconduct. “And I don’t think that this diminishes any of that.” DeRosa defending Cuomo is nothing new, and obviously expected given her role, but her critics have said that she oversteps the line of civility. “You’re both full of shit and a pretty terrible person,” she told state Sen. Alessandra Biaggi, a former gubernatorial staffer who has become a vocal critic of the governor in office, in texts made public by New York. Biaggi didn’t respond in kind, but DeRosa went on to call her “a bad person” and “full of shit” again. That is not the first time that DeRosa, or people under her supervision, have gone after critics of the governor in starkly personal terms. DeRosa called former Democratic gubernatorial candidate Cynthia Nixon “unhinged” while she campaigned against Cuomo in the 2018 primary. Azzopardi called three female lawmakers “fucking idiots” after they held a press conference highlighting

at Berkeley College’s Women in Media conference. Yet, her ongoing efforts to defend Cuomo strike some as holding up the type of social progress that DeRosa, the chair of the New York State Council on Women and Girls, has supposedly championed for years. That does not make her immune to criticism, according to Erica Vladimer, a former legislative staffer and co-founder of the Sexual Harassment Working Group. “Anybody, regardless of their sex or their gender or their gender identity, can be an enabler, a power abuser or a gatekeeper, and that includes Melissa DeRosa,” Vladimer said in an interview with City & State. Getting called an enabler of an alleged sexual harasser and abusive boss inserts elements of tragedy into the ongoing saga of DeRosa. Exposed to politics at an early

age, she has risen through the ranks of state government as a staffer to former Attorney General Eric Schneiderman and the governor. She has played a key role in Cuomo administration accomplishments like expanding the minimum wage, paid family leave and tuition assistance programs for public college students. She has helped normalize fertility treatments for women by going public with her own personal struggles. She also had a key role in helping New Yorkers survive COVID-19 at a time when leadership from the federal government was conspicuously absent. It is not as if other opportunities do not exist for DeRosa in Albany either. Several members of her family are in the lobbying business, including her father Giorgio DeRosa, who is among the most highly paid lobbyists in the state. Melissa DeRosa, though, has remained in public service. Some past colleagues say that DeRosa faces a double standard. “Strong-willed men in politics are often portrayed as these like manic geniuses,” political consultant Lis Smith, who has worked with DeRosa in the past, said in an interview. “Strongwilled women in politics are somehow always just a mix of Miranda Priestly and Regina George,” she added, referring to the famously nasty, diva-ish antagonists of the films “The Devil Wears Prada” and “Mean Girls,” respectively. “That just doesn’t capture who Melissa is,” Smith said. While she too is facing calls for her resignation, some of her critics remain sympathetic to her plight, arguing that Cuomo’s top lieutenants are simply dishing out what their boss has served them. “His presence is always suffocating,” the current gubernatorial staffer said. Karen Hinton, one of the women alleging wrongdoing against Cuomo, told WNYC that DeRosa “has been abused as well.” Be that as it may, she remains ever-loyal, having stayed with the governor since 2013, while other gubernatorial confidants like former counsel Alphonso David have moved on. If the scandals engulfing Cuomo force him out of office or cost him reelection in 2022, it’s unclear where that will leave DeRosa. A few weeks ago her future opportunities appeared boundless. Much less so now, according to a longtime Albany insider. “She has a job with Andrew Cuomo for as long as he’s there and as long as she wants it,” one Democratic insider told City & State. “The problem is, her fate is tied to Andrew Cuomo.”

EW YORK CITY’S famously long ballot can leave many feeling a little overwhelmed. The top of the ticket gains the most attention with races for president, Congress and mayor. But the exceptions are oft-overlooked races for judges, whose high position on the ballot belies the generally low-information nature of the races. Even self-described politicos and civically engaged voters will admit when they head to the ballot box, they know very little, if anything, about the judicial contests. But often in New York City, these races are decided well before voters have a chance to weigh in. In a city where the once-powerful rule of party bosses has been steadily waning, judgeships remain one of the last strongholds where party leaders can flex their influence. Even today, to get on the bench, potential judges have to be willing to play the game. In Democratic-controlled New York City, judicial elections are like any other election in that they are pretty much decided in the primary, with the exception of perhaps Staten Island. But that’s where the similarities end. Judicial elections are even harder to run than your average City Council or state legislative race. Countywide judicial races are expensive, fundraising is more difficult due to ethics restrictions on political campaigning and candidates aren’t allowed to take political positions or make campaign promises that could

be seen as bias in future decision-making. “Judicial politics, and judicial campaigns, look nothing, nothing, nothing like normal campaigns,” said Assembly Member Robert Carroll, who has long pushed for judicial reform. But we have elective judges, so how do they win their races? The easiest way is to play politics. Long before candidates run to become judges, they have to attend the right political fundraisers and events hosted by Democratic clubs – schmoozing district leaders, party functionaries and other political leaders who can advocate to put them on the bench. For many of them, the ultimate goal is getting a Supreme Court spot. Now in New
York, Supreme Court isn’t the state’s top court – that’s the Court of Appeals – but it pays over $200,000 a year and the cases are important, like felony crimes and high-level civil cases. Plus, serving on Supreme Court is the only way to get appointed to the influential Appellate Division. Getting there takes a lot of time and planning, and it’s a heck of a lot easier by playing the game. “It is 100% politics, it is 0% merit and democracy,” Brandon West, former president of the reform-minded New Kings Democrats, said of the party’s nomination process. He recalled a friend from law school who attended a meeting to help those interested in becoming judges. “They essentially spent
the whole time saying, join a political club, figure out who the political leadership is, talk to those folks,” said West, who is currently running for City Council. “That was the most important thing in terms of the process of becoming a judge, because all these decisions are done behind closed doors.” A New York Focus report from late last year shed light on the donations that Supreme Court justices had given to local political leaders and the party over the years before becoming Supreme Court justices. It ranged from a few thousand dollars to over $20,000. But many of those interviewed for this piece said that the donations themselves aren’t what get potential judges noticed,
they’re more of an entry fee to even be considered for a judgeship. Those who don’t pay the fee often don’t even get considered, so those who don’t have the money, time or desire to get involved in politics traditionally don’t get considered. “Democratic clubs survive off of these fundraisers from judges,” Manhattan district leader and City Council candidate Corey Ortega said of his borough. “It doesn’t get you any more access, but if you don’t show up and if you don’t pay, you will not get any access.” Although judicial candidates are restricted in how much money they can give in political donations, no such restrictions exist for attorneys before they declare, which is why the

N QUEENS, Rep. Gregory Meeks, the party boss, still has a lot of say over who gets the party’s support. While he listens to different groups for recommendations, those groups have to make sure that they’re in good with the party. “I have to say that I have a really good relationship with the county leadership,” said Ali Najmi, vice president of the South Asian and Indo-Caribbean Bar Association of Queens. He noted that several of their members have been considered for judgeships, including the first South Asian judge elected to the Supreme
City & State New York
Court in Queens, and that the county party made it happen. This year, a Guyuanse American member of his bar association was nominated by the Queens Democratic Party for a Civil Court judgeship. Najmi said there still exists a need to join groups, get politically involved and receive the party’s blessing. “Should it be necessary? Probably not,” Najmi said. “But then there’s the reality of our politics. And a lot of great judges have been selected and elected through the current process.” Thomas Oliva, president of the Latino Lawyers Association of Queens County, said that his organization every year speaks with Meeks and makes recommendations about who the county should back to become judges. Sometimes, those recommendations are taken, sometimes they’re not. “I’d like to think that based on our past history with Congressman Meeks, that you know, there will be openings going forward,” Oliva said of this year’s Civil Court endorsements, which did not include any of his members. He said that anyone is free to run in a primary, but said it “sounds about right” that many people, essentially, wait their turn for an endorsement from the county party. “Can someone still run and challenge the Democratic nomination? Hell yeah,” Ortega said of Manhattan. “Is it frowned upon? Yes.” He said the borough has “unspoken rules” about the timing of judicial runs, and the expectation is that candidates generally wait their turn if they’ve got the right relationships and have been deemed qualified by the party’s independent screening panel. One of the main exceptions, Ortega said, is if a candidate is able to raise a lot of money on their own. This hasn’t stopped candidates from running ei-
ther municipal or countywide primaries against the party backed candidate, particularly in Brooklyn. Judges Elena Baron, Rachel Freier and Odessa Kennedy are just a few examples of candidates who won without the support of the Brooklyn Democratic Party in recent years. But having the strong backing of the local county party, through relationships forged through years of political engagement, provides certain advantages. The party and local Democratic clubs can help with petitioning, fundraising and will include judges on their flyers alongside more well-known candidates, which is important given how little is known about most judges on the ballot.

HE MOST criticized part of New York City’s judicial election process is judicial conventions to nominate candidates for Supreme Court. Instead of running candidates in a primary, Democrats vote for judicial delegates who then attend a convention to nominate the actual candidates for the general election. Usually, delegates are party insiders – members of Democratic clubs, district leaders, committee members and even elected officials. Without a normal party primary, these judicial delegates – who often just rubber-stamp the will of party leaders – nominally vote on who is put on the ballot for Supreme Court. By the time the general election comes around, these Supreme Court candidates often don’t have Republicans running against them. Sometimes, the Democrats even appear on the Republican line too, meaning voters have little to no real input on who is elected. The judicial convention process has been widely criticized for well over a decade.

“We have among the worst, if not the worst, state judicial selection system in the United States,” said one litigator who asked for anonymity to speak freely about politics in the court system. It’s so bad, the attorney said, that even when the U.S. Supreme Court upheld the convention system in 2008, one concurrent decision included this quote from Thurgood Marshall: “The Constitution does not prohibit legislatures from enacting stupid laws.” The case was brought by Judge Margarita Lopez-Torres, who currently serves on Surrogate’s Court. After becoming a Civil Court judge in the ’90s, she fell out of favor with the Brooklyn Democratic Party. She claimed party leaders blocked her nomination to Supreme Court judicial conventions. She sued on the grounds that the system violated her First Amendment rights because of the inordinate power held by the Democratic Party. In New York, some judges are elected and others are appointed, but Assembly Member Carroll said that the judicial convention system represents the worst of both systems. “It’s basically a set of people choosing … but you don’t even know who the people are choosing,” Carroll said, describing his experience in Brooklyn’s conventions. Former Brooklyn District Leader Nick Rizzo recalled when he started in the position in 2014, he was met with a “backlog” of judges he was expected to help elevate to the Brooklyn Supreme Court before he and other reform-minded district leaders could begin considering others. Julia Forman, now a candidate for City Council, was a judicial delegate from Queens last year. She contacted the Queens Democratic Party multiple times before the convention to learn about the potential nominees, but wound up finding out their names from a news re-

A guide to New York’s convoluted court structure New York’s court structure is a little bit ... wonky. Without living and breathing the court system, it’s easy to get a little lost in the court bureaucracy. It’s one of reasons that judicial reformers have talked for years about modernizing and consolidating the state’s trial court system. But doing so would require a constitutional amendment, and considerable political clout. The most recent proposal to consolidate the courts came from Chief Judge Janet DiFiore, and while there seemed to be some momentum behind her plan, the pandemic put it on the back burner. For now, this is how the courts are set up.

man said that the time frame between learning she would be a delegate and the convention was so short, she had no time to vet candidates and build support. Meeks also said that he always tries to be open and available to people looking for

COURT OF APPEALS: The highest court in the state, the Court of Appeals only hears a handful of cases, much like the U.S. Supreme Court. Cases from the County Court are appealed to the Court of Appeals. It otherwise hears any case appealed from the Appellate Divisions, and criminal cases appealed from the Appellate Terms. APPELLATE TERMS OF THE SUPREME COURT (FIRST AND SECOND DEPARTMENTS): The Appellate Division of the Supreme Court is split up into four departments. The first two departments cover New York City, Long Island and the city’s northern suburbs. The Appellate Terms hear appeals from their City, District, Criminal and Civil Courts as well as nonfelony appeals from County Courts. The chief administrative judge appoints Supreme Court justices to serve in this court. APPELLATE DIVISIONS OF THE SUPREME COURT: This court is split up into four departments. It hears appeals from the Court of Claims, Surrogate’s Court, Supreme Court, Family Court and County Court. It’s also the next appeals court for civil cases appealed to the Appellate Terms. The governor elevates judges to this court from the Supreme Court.
City & State New York
COURT OF CLAIMS: This court handles civil cases against the state of New York and other state agencies or state-related entities. Judges are appointed by the governor. SURROGATE’S COURT: There is one Surrogate’s Court in each county, except in Manhattan and Brooklyn, which each have two. They handle cases about estates and wills, and the judges are elected. SUPREME COURT: The Supreme Court in New York is a trial court, not the state’s top court. It has 13 districts, with one district per borough in New York City. It has near-universal jurisdiction, although it tends to hear cases not already handled by other courts. Outside New York City, it generally hears higher-level civil cases. In the city, it hears civil cases and tries felony criminal offenses. Judicial candidates are selected at judicial conventions by the parties and then elected. FAMILY COURT: These courts handle child custody, domestic violence, adoptions and foster care cases, but not divorces. Judges are elected except in New York City, where they are appointed by the mayor. COUNTY COURTS: These trial courts also serve as an intermediate appellate court for City Courts and Justice Courts in parts of the state.
The Queens Democratic Party came under fire in 2019 after insurgent candidate Lumarie Maldonado Cruz defeated party-backed Wyatt Gibbons in a rare Civil Court primary loss for the party. Less than two months later,
JUSTICE COURTS: These are the roughly 1,300 town and village courts outside of New York City, where judges don’t have to be lawyers and are elected. They can handle cases like traffic violations, evictions, low-level criminal offenses and civil claims up to $3,000. CITY COURTS: There are 61 City Courts run by elected judges in cities outside New York City. They handle misdemeanors, civil cases up to $15,000 and sometimes deal with small claims and housing cases. DISTRICT COURT: These are only in Nassau County and western Suffolk County on Long Island. They handle lower-level offenses and civil cases up to $15,000, and have elected judges. COUNTY COURT: There is one County Court in each county outside of New York City, and they handle felony offenses and some civil cases up to $25,000. NYC CIVIL COURT: They handle lower-level civil cases up to $25,000, with a small claims part of up to $10,000. Judges are elected. The housing part handles evictions and other tenant matters, and the judges are appointed by the deputy chief administrative judge of New York City. NYC CRIMINAL COURT: This court hears misdemeanor and low-level criminal cases, and judges are appointed by the mayor.
the party nominated Gibbons for Supreme Court at the judicial nominating convention. “You’ll have to speak to (the) county, they took care of me,” Gibbons told Gothamist when asked about his nomination. Meeks at the time said Gibbons
was elevated “because of his skills, his ability, his quality.” But the political maneuvering was considered to be a rebuke of the voters who had just rejected Gibbons at the ballot box. Paul Newell, a district leader from Manhattan, was

shocked when he heard about Gibbons, who was elevated to Supreme Court without first being a judge. “That’s outrageous,” Newell said. Ortega, who is also a former judicial delegate, said politics still play a heavy role in who gets nominated for Supreme Court in Manhattan, but said the process allows for input from more people than in other boroughs. Democratic clubs interview potential nominees as the candidates figure out if they have enough delegate support to win – although it’s still a highly political process that doesn’t involve the voters directly. But even in Manhattan, judges have to be willing to do a lot of political jockeying to become a Supreme Court justice. And it’s not for everyone. Newell said he knows a Civil Court judge currently serving as an acting Supreme Court justice who said he had no interest in making his position official by running. “‘I don’t want to spend another three years dealing with panels and Democratic Party clubs and, you know, kissing rings, so I’m not doing it,’” Newell said this judge told him. “And I was like, ‘That’s a perfectly reasonable thing that you just said, you sound like a sane person who should be a judge.’”

HE PROBLEM is that the process, both for Civil Court and Supreme Court, is not transparent and reeks of undemocratic politicking. “There are great judges who have come through the judicial convention. There are terrible judges,” Carroll said. “But it’s a bad system. And we should change it.” He proposed a 13-member independent panel that screens potential Supreme Court nominees, providing a list to the governor who appoints from that list with the consent and approval of the

state Legislature. The likelihood of making those changes, which would require a constitutional amendment, is slim. In the meantime, the current system of elections continues to exist largely outside the control of the voters who ostensibly are meant to choose their own judges. “We all understand that the elective system is here to stay,” said Stephen Younger, a board member of the nonpartisan court reform group Fund for Modern Courts who prefers a system of judicial appointments. “Given that, my focus has been around bringing more transparency to all of the processes for selecting judges in our state.” Younger encouraged anyone involved with the legal community, and even people who aren’t lawyers, to find ways to get involved in their local screening panels. “And you can have a direct impact on who the next generation of judges is,” Younger said. Political consultant Gary Tilzer, who does not support screening panels for judicial candidates, went about transparency a different way. “I wanted to show what was really going on,” Tilzer told The Village Voice in 2017, when he ran an entire slate of candidates against party-backed judicial candidates in Brooklyn. “I wanted to show how the county organization just picks judges and how the public doesn’t have any say. I figured this is the way to do it.” And to a degree, he had a point – the voters are meant to have a choice in these elections, and he sought to provide them one. But just as getting support from the county organization doesn’t inherently mean a candidate would be a good or bad judge, nor does claiming independence. “Outside of this whole little conversation is actually a legitimate conversation about who actually should be a judge,” West said of the politics. “And, you know, that kind of gets lost in

how this process plays out.” While many people may be qualified, the process may make it so certain people aren’t considered and others with privilege may be able to bypass the system. Newell and Ortega both mentioned a woman who ran for Civil Court in Manhattan several years ago and defeated the party-backed candidate because she had the money to spend to run a competitive race. And the New York Focus story on judicial donations pointed out that district leader Rory Lancman’s wife was elevated to Supreme Court without making the same donations as other candidates. “For elections, you need money to run, and you also need backing,” said Leah Goodridge, managing attorney for housing policy in Mobilization for Justice’s housing practice. “I don’t think that it’s as black and white as everyone has the same opportunity, you just run people (and) the voters
get to know who you are, and then they make a decision.” This plays into not just racial diversity on the bench, but also with ideological diversity. “Diversity in thinking, in order to move the needle, is very important,” Goodridge said. Because becoming a judge is an arduous process, that can limit who is able to run. As it stands, judicial diversity on the bench is an issue – a 2020 report found that racism is still ingrained in the court culture. The report found that elected judges are actually more diverse than appointed judges, and in New York City at least, those involved in judicial nominations said they try to keep diversity in mind. “I believe in the process, I think it’s a great process,” Keith Wright, chair of the Manhattan Democratic Party, told City & State. “And I will tell you this, it helps to add diversity to the process.” Newell and Ortega generally agreed with
the sentiment, in part because a variety of different voices tend to weigh in on endorsements. Meeks too said he takes diversity into account, and both Oliva and Najmi noted that diversity among party-backed judicial candidates has improved in recent years. And certainly, compared to 30 years ago, the diversity of the bench has improved, according to the 2020 report, although white judges still are overrepresented in New York City and the state as a whole. In Queens, the disparities remain stark – Latinos make up nearly 30% of the borough but less than 10% of judges. White residents, on the other hand, make up about 25% of Queens’ population, but more than 61% of judges are white. And the process of diversifying the courts has been long and slow. It often takes political pressure for those not represented on the bench to start seeing judges that look like

A Bronx insider noted that the first Dominican judge was elected in the borough with the party’s backing only after the growing community gained enough political clout to make noise about their lack of representation. According to the 2020 report, Latinos make up over 45% of the borough’s residents, but just under 24% of its judges. In Brooklyn, Rizzo said for a long time that judges were split mainly among Black judges and white judges, and it’s still taking time for the bench to be more representative of the community. For example, Asian Americans make up more than 11% of Brooklyn, but only 4% of Brooklyn’s judges. Part of the problem is that judges serve long terms – 10 years on Civil Court and 14 years on Supreme Court – and the seats don’t open up too often. And strictly focusing on racial diversity is not enough either. “It’s not just about having the faces,” Goodridge said.
She equated it to a major corporation appointing a woman as CEO to address gender inequity in leadership positions, but then that woman not supporting maternity leave. “A lot of the ways that discrimination often tends to be addressed is, well, let’s just go and get the most conservative-minded, marginalized group, and so it doesn’t actually do a lot of change.” Najmi, who ran an unsuccessful campaign for judicial delegate last year, said it’s important to get a more open and transparent judicial convention system to improve the quality and diversity of judges who get elevated – not just racial diversity, but a diversity of backgrounds as well. “We need more judges who have practiced and represented poor people. We need more judges who’ve seen the system fail. We need civil rights attorneys, criminal defense attorneys,” Najmi said. “And so I think we need to have
more people be delegates for that to happen.” With all the politics in judicial elections, is there a better way? It’s a source of constant debate. “I don’t know if electing judges is the best way,” West said. Some, like West and Younger, argue that an appointment system that relies on an independent and transparent screening commission to recommend appointments to an executive, who would need approval from a legislative body, is the gold standard. Those interested in serving on the Court of Appeals, for example, submit applications to judicial screening panels set up by the state, with appointments from the governor, the chief judge and the majority and minority leaders of the state Legislature. Those found to be most qualified are recommended to the governor, who appoints judges with the approval of the state Senate. Gov. Andrew Cuomo set up similar commissions for other

appointed positions, such as the Court of Claims and the Appellate Division. And appointments are certainly not without politics either. The people who make up these commissions can serve as barriers, especially if the screening panels themselves are not representative of the diverse populations they serve or draw heavily from people with similar backgrounds. And appointments can serve political ends too – a candidate for Supreme Court in Westchester County recently was appointed to the Court of Claims by Cuomo. Reportedly, this was done to clear the way for the daughter of Court of Appeals Chief Judge Janet DiFiore, a Cuomo ally, to get the Supreme Court seat. All parties involved denied that politics played a role, but at the very least, the optics appeared to be questionable. Others like Najmi and Carroll say it’s important to keep judicial elections – at least to some extent – so that people have the right to choose their judges. “I think the Civil Court races and the Surrogate’s Court races, though imperfect, also allow for a safety valve to give people some representation,” Carroll said. It improves the system to have more people interested and involved, which is one of the reasons Najmi ran to become a judicial delegate. This of course also relies on voters to learn about judicial candidates, which is not always easy to do, though more transparency would certainly help with education. What everyone seems to agree on is that no matter how you cut it, the courts will never be completely apolitical. But that’s true of any position in government – there’s no guarantee that the person elected or appointed is best suited for the role until they have a chance to prove themselves. And the more people are informed along the way, hopefully the better the outcome.

The industry leaders navigating the coronavirus pandemic.
T
HE CORONAVIRUS PANDEMIC has hammered the real estate industry. In a matter of days, offices, restaurants and shopping centers went dark. In Manhattan, asking rents in major retail corridors fell by as much as 25% year over year. Filings to construct new buildings across New York City fell 22%, and at the end of 2020, just 10% of the one million office workers in Manhattan were working in their offices. A revolving door of tenants, both commercial and residential, are at risk of not being able to pay their rent. Everyone in the real estate industry had to come up with solutions, fast. Landlords have been devising ways to convert
empty office buildings into apartments, or working with tenants to avoid letting their properties go vacant. Some developers have weathered the storm, while others are barely holding on. Activists have demanded protections for hard-hit tenants, and the state Legislature responded with a moratorium on evictions that will remain in place at least until May 1. Related Cos. Just a year after megadeveloper Related opened the doors of its $25 billion Hudson Yards luxury development, the coronavirus pandemic hit. The public health crisis stymied big plans for Hudson Yards to transform the West Side of Manhattan. The development’s luxury mall emptied out, hundreds of condos went unsold and its anchor tenant, Neiman Marcus, was forced to close its Hudson Yards location after it filed for bankruptcy. But the company maintains that it has been collecting all of its commercial rents and said, as of late January, that 93% of its office space has been leased. And experts will look to Hudson Yards’ ability to weather the storm as an indication of whether the city as a whole can rebound from the crisis. Despite setbacks from the pandemic, Stephen Ross is betting big on New York City’s
economic recovery, standing ready to influence the 2021 races for mayor and City Council. Though he has not endorsed any candidate, early on, Ross flirted with the idea of raising $100 million for a candidate he supported, and he recently set aside $1 million for a super PAC. Jeff Blau and his wife, Lisa Blau, have also been working to influence the mayoral race. Lisa Blau has been leading a multimillion-dollar campaign called Be Counted NYC, which has been trying to persuade Republicans and independent voters to reenroll as Democrats to vote in the upcoming Democratic primary for mayor, a race that will likely determine who the next mayor is, given that Democrats significantly outnumber Republicans in the city. Meanwhile, Jeff Blau has been urging New Yorkers on his
own to register as Democrats ahead of the June primary. He recently joined more than 150 powerful CEOs in signing a letter calling on Congress to pass President Joe Biden’s $1.9 trillion coronavirus stimulus package.

Kavanagh was one of the first lawmakers to call for an eviction moratorium and sponsored legislation that led to the current moratorium on evictions. He is reviewing Gov. Andrew Cuomo’s proposal to make it easier to convert offices and hotels into housing and rallying behind a five-year capital plan for housing.

Under Oakley’s leadership, her team was able to negotiate savings and work with partners to finance more than 29,000 affordable housing units in 2020.

He was one of the point people on Google’s decision to buy Chelsea Market for $2.4 billion. Before that, Paul Darrah led the real estate team at Bloomberg LP that oversaw the construction of the company’s headquarters at 731 Lexington Avenue. He also worked on Google’s future 370,000 square foot offices on the Hudson River at Pier 57.
Carlos Menchaca, a Democratic candidate for mayor, was one of the first elected officials to oppose the massive Industry City rezoning. The project would have created thousands of new jobs, but Menchaca argued that the developers had not included community feedback in the plan. Industry City CEO Andrew Kimball decided to pull the plug on the development, citing the “political environment.” Menchaca hailed the outcome as a “showcase (of) community power” that “confronted a multibillion dollar corporation, and they withdrew.”

Both the Assembly and state Senate have now passed the bill limiting its use, aptly named the HALT Solitary Confinement Act. But the real win won’t come for its sponsors, Assembly Member Jeffrion Aubry and state Sen. Julia Salazar, until the governor signs off on it.

Gov. Andrew Cuomo sure wants to hang with his friends nowadays – and no one else apparently – since reporters haven’t been allowed at his recent press conferences. Some leading figures in the Black community have been willing to stand by Cuomo as he touted just how great things are going at several events. While getting vaccinated against COVID-19 is undoubtedly a good thing, the press-ducking big man is hardly the only person who needs a shot of something else this week. Cheers!
