CITY & STATE senior reporter Jeff Coltin met Andrew Yang on a basketball court to interview the New York City mayoral candidate for this week’s cover story. It was a fun way to get to know Yang, especially when Coltin did a layup. Yang couldn’t block the shot, but he’s still on a roll, getting a second chance to run for office after his unsuccessful campaign for president. He tells Coltin that he’s moved up from “scrappy underdog” to front-runner. If Yang wins, he would be the first Asian American mayor of New York City. So besides enjoying his top ranking in most polls, he’s got a shot at making history. His timing also coincides with the alarming recent rise in hate crimes against Asian Americans. Coltin gets into “Yang’s formula” in an examination of whether it will be enough to win over voters. It will be interesting to see – for a man who hasn’t voted in local elections or held public office. How might Yang do if elected? Annie McDonough looks at Yang’s past job history in the latest entry in City & State’s “For the Record” series. Former co-workers, business partners and fellows at his nonprofit, Venture for America, recalled Yang’s self-deprecating humor and drive for progress, but also said they felt he might have a little problem with being engaged when it comes to urban affairs, writes McDonough. If Yang makes it to City Hall, he’ll have a chance to prove how engaged he can be.

After years of advocacy and several deals that fell apart in 2019 and 2020, New York has legalized recreational marjuana. Although retail sales are still a year or more away, many aspects of the bill took effect immediately, including making the possession of small amounts of marijuana

legal. Automatic expungement for past marijuana-related offenses that are no longer crimes also began immediately. Among the last sticking points in the negotiations were over impaired driving. The final deal involved extra money for police departments to train and hire drug recognition experts, and setting up a study that would examine devices to

detect marijuana impairment on the road. Currently, no technology has been approved to perform fast and accurate tests, like a Breathalyzer, to determine whether someone is impaired. Under the new law, people cannot smoke and drive, and it’s illegal to drive after having ingested marijuana. But Republicans said the legislation did not adequately address their concerns around impaired driving, which they cited when voting “no” on the legalization. Road safety considerations were also brought up by a handful of Democrats who voted against the measure.

CUOMO’S BOOK DEAL AND A NEW ACCUSER The bad press just doesn’t stop for Gov. Andrew Cuomo. It

Kikuo Johnson depicted the sense of fear and unease in the wake of these attacks on the cover of the New Yorker, showing a woman and girl waiting for a train on a subway platform, in a stance Johnson said he wanted to look “somewhere between vigilant and fearful.”

started off with yet another woman accusing him of inappropriate behavior. Sherry Vill said she met the governor when he visited the Rochester area in 2017 to inspect local flooding. One of the houses that he visited was hers. Vill accused Cuomo of two unwanted kisses on the cheek, one of which was caught in a video, that left her feeling uncomfortable. New information also emerged about Cuomo’s controversial book about his leadership during the coronavirus pandemic. According to The New York Times, Cuomo got a book deal that exceeded $4 million. Aides to the governor assisted him in writing the book, which may have been a violation of state ethics laws, including Secretary to the Governor Melissa DeRosa helping edit one of the drafts and lowlevel staffers delivering printed pages to the Executive Mansion. The governor’s office said any staffers who worked on the book volunteered. The state ethics commission approved Cuomo to write the book, but said that no state resources could be used in the writing or promotion of the book. He seemed to violate this and other parts of the approval.

that was part of last year’s budget that provided immunity to nursing homes and hospitals related to the care of patients with COVID-19. Although some of those protections were partially repealed last year, this legislation would fully eliminate the legal protections that were previously established. The measure unanimously passed the state Senate after already passing the Assembly. The bill now awaits a signature from Cuomo, who has not signaled what he will do.

A LATE STATE BUDGET

The end of New York’s fiscal year came and went without a new budget getting passed. Lawmakers had an April 1 deadline to get the budget done, but

only passed one of the 10 budget bills by that date. Only three of the bills were even introduced before April 1. Late budgets are nothing new in New York – years ago they wouldn’t pass until well into the summer. Cuomo prides himself on passing on-time budgets, but they are sometimes approved a couple days late. Several sticking points exist in negotiations between Cuomo and legislative leaders, including a fund for workers who have not been eligible for COVID-19 aid, new taxes on the wealthy and school funding. Recent reporting revealed that Cuomo wants $1.3 billion in bonds for his controversial redevelopment plan of Penn Station and the surrounding area.

In NYC mayoral race, progressives remain divided Less than three months before the New York City mayoral primary, the city’s progressive left has not coalesced behind a single contender. Some of the most influential organizations, like the Working Families Party, haven’t endorsed yet, and some of the biggest individual players, like Rep. Alexandria OcasioCortez, might not endorse at all. But looking at the endorsements that have come so far, three candidates have emerged as progressive favorites: New York City Comptroller Scott Stringer, former nonprofit leader Dianne Morales, and a former counsel to Mayor Bill de Blasio, Maya Wiley. And movement leaders are putting their faith into ranked-choice voting, hoping the divided support actually becomes an asset. The progressive movement in New York can be loosely defined as the individuals and organizations that supported Cynthia Nixon over Gov. Andrew Cuomo in the 2018 primary. While labor unions are often allies, their role and influence in the mayoral race is driven by different motivations than a typical ideologically driven political organization. Stringer, Morales and Wiley are most aligned with the group on policies like defunding the police, increasing taxes on the wealthy and forgiving unpaid rent accrued during the

But there are enough policy disagreements among them, that choosing who to support is a hot topic of debate. “Our membership were kind of evenly split between who their favorite progressive was,” said George Albro, co-chair of the New York Progressive Action Network. “And rather than be a divisive choice, we thought we’d unify the progressives in the race by doing a dual endorsement (of Morales and Wiley).” But one person’s unity is another’s division, and Stringer was the one left out. “I’m not into identity politics per se, but we’ve never had a woman mayor of New York City, and we’ve gone 28 straight years with a white male mayor,” Albro said. Stringer spokesperson Tyrone Stevens insists that consolidation is already on track. “We’re building the progressive multiracial intergenerational coalition we need to win this race,” he said. But many organizations and figures have yet to endorse. Jumaane Williams, another sought-after endorsement, hasn’t formally backed a candidate yet. Same goes for his 2018 running mate Cynthia Nixon and major groups like Make the Road Action. If they all back Stringer, it would be a strong case for consolidation, but if not, then the left will remain split in the mayoral race. – Jeff Coltin

You’ve got a nearly 17 percentage point lead, but you didn’t officially declare victory. Why not? I’ve spent a lot of time over the last couple years as Democratic district leader advocating for more early voting sites and the expansion of mail-in voting. I think that every vote needs to be counted. Until all the votes are counted, I’m not going to declare victory.

Two of your opponents formed an alliance and said they’d rank each other second. You avoided that. What was your thinking there? I was running because

Political dynasties are nothing new in New York, did your father or both your parents get to work on the campaign? Were they active in the infrastructure there?

They both helped out in different ways in the campaign. My father was very, very good about providing advice and insight, and also very good about being hands off. This was my race to run. And he did not overstep whatsoever. The Regional Plan Association has specifically targeted Riverdale as a lowdensity neighborhood with good transit access that could be upzoned. Would you generally support increasing housing density in Riverdale?

I would respectfully disagree with the “good transit access.” If you’re in Riverdale, (the) bus is really your main mode of travel to get to and from anywhere. But we have problems with bus service up here. And so it’s extremely problematic when the MTA comes to the district and says they want to cut express bus service when it’s already hard enough to get around the Bronx and get to other places in the city. Not to mention that there’s no subway in Riverdale. There’s a subway in Kingsbridge with the No. 1 train. So I respectfully disagree

he Marijuana Regulation and Taxation Act (MRTA) has become law, and it’s a success all New Yorkers can be proud of. The law, legalizing adult use cannabis in New York, puts fairness at its center; communities of color, workers and entrepreneurs are prioritized in this program. The final law reflects the longstanding efforts of worker and community activists to create legislation that will lift up all of our communities. RWDSU Local 338 represents nearly 500 workers in New York’s medical cannabis industry, and now, with the legalization of adult use cannabis, we have an opportunity to create more quality jobs. We’ve already seen in New York the difference unions can make in the cannabis industry. In 2014, RWDSU Local 338 fought for the passage of the Compassionate Care Act, which legalized medical marijuana, to ensure the industry created good union careers for the workforce. As a result, workers in cannabis cultivation, production, distribution, and retail in New York won RWDSU membership, and in turn, negotiated strong union contracts.

With RWDSU Local 338, workers have won guarantees of full-time hours, significant wage increases, generous paid time off, quality health coverage for themselves and their families at no cost, retirement savings benefits, and other crucial workplace protections including on-the-job training. The only way to guarantee these benefits are provided to workers is through a union. The best way to ensure a union exists in the workplace is through mandatory labor standards in the law. Unions have made a difference for these workers, and now the goal is to ensure that the same benefits – and the protections of a union voice – are available to workers in the new adult use cannabis industry.

A Diverse Industry to Build Stronger Communities

Legalization provides an excellent starting point for reversing the discriminatory cost the decades-long “war on drugs” has had on communities of color. As a union that organizes workers in several low-wage industries including retail, the majority of our mem-

We all have a stake in ensuring the adult use cannabis industry not only creates good jobs, but also provides true entrepreneurial opportunities for our membership and their communities. That is why it’s crucial that cannabis industry ownership, management, and workforce reflects the diversity that makes New York great. The RWDSU and our allies also support the resentencing provisions for those who are behind bars for cannabis-related crimes, and expunging and sealing criminal records of those who went to jail for cannabis-related offenses. As the city, state, and country move forward toward cannabis legalization, it’s important those who have been prosecuted for cannabis-related offenses – disproportionately people of color – are allowed to move forward with their lives free of outdated legal repercussions and the stigma that accompanies them. Legalizing cannabis for adult use opens New York State to an incredible new avenue for job growth, criminal justice reform, and economic opportunities for small and medium-sized businesses, as well as increased revenue to fund important public services. By making sure that the industry is created responsibly, we can make sure that as the industry flourishes, our communities and working families flourish as well.

Labor hasn’t found its mayoral candidate, but don’t count out these traditional kingmakers. By Gabe Ponce de León

N THE CROWDED New York City Democratic mayoral primary, with the odds stacked against a Republican capturing City Hall, organized labor could have a large say in determining who will lead the city’s post-pandemic recovery. The last time there was a competitive Democratic primary, health care workers union 1199SEIU helped propel then-candidate Bill de Blasio to a general election victory. That year, the city’s “Big 4” unions – 1199SEIU, the United Federation of Teachers, District Council 37 and 32BJ SEIU – split their support evenly among the four leading Democratic contenders. This year, the largest unions to endorse thus far have backed three candidates: New York City Comptroller Scott Stringer, Brooklyn Borough President Eric Adams and Maya Wiley, who used to serve as a counsel to de Blasio. Yet it’s former presidential candidate Andrew Yang, a newcomer to city politics, who has jumped out to an early lead in the polls. Organized labor is far from a monolithic constituency. Unions run the political

gamut from the more conservative police unions to generally pro-development trade unions to unions like 32BJ SEIU that are closely aligned with the progressive movement. As such, their priorities often diverge when it comes to deciding which candidates to support. “Organizations like unions that can mobilize their base, and instruct their base, will have a lot of impact,” said Joshua Freeman, a labor historian at Queens College. “Labor is certainly a player here, but the fact that they are all over the map in terms of who they are supporting dilutes their power.” Public sector unions are unique in that they have a say in electing their ultimate employer, and in this election cycle municipal labor leaders have an eye on the upcoming round of collective bargaining. Whoever New York’s next chief executive is, addressing the fiscal crisis will be at the forefront of their agenda, and union leaders are already making it clear that they want the sacrifices that the city’s essential workers made during the pandemic to be recognized by the next administration. “One of the concerns that we have is that, similar to what we saw after Sept. 11 with the economic downturn, there was an inclination to try to protect businesses and business interests above people,” said Henry Garrido, the executive director of District Council 37, the largest municipal workers union in New York City. Garrido, who has endorsed Eric Adams, said that “austerity budgets” following previous tragedies increased economic inequality, and he wants the next mayor to protect “the lives and the well-being of essential workers, rather than sacrificing them for the sake of keeping the business community happy.” Private and public sector unions often

have differing views on tax policy, economic growth and development. Trade unions, for instance, keep close tabs on how economic policies could impact the construction industry, and their political agenda skews toward spurring development. “Our priorities are a lot of times around job creation because we work our way out of a job every day unlike a public sector employee who has an office to go back to five days a week, year after year,” said Mike McGuire, political director of the Mason Tenders’ District Council. McGuire has endorsed Scott Stringer, saying that his experience as comptroller best qualifies him to steer the city through the coming fiscal crisis. In addition to concerns around policy, existing relationships frequently factor into who unions endorse. Maya Wiley, who counts Patrick Gaspard, a former 1199SEIU political director, as a close ally, received that union’s coveted endorsement in February. Katie Moore, Eric Adams’ campaign manager, previously worked as the political director of the New York Hotel and Motel Trades Council, which has backed the borough president. The Uniformed Sanitationmen’s Association has backed former New York City Sanitation Department Commissioner Kathryn Garcia, and a number of trade unions have endorsed Scott Stringer, who as comptroller regulates the prevailing wage schedule. progressive movement was when Amazon pulled out of a deal to locate a headquarters in Queens in February 2019. For starters, there were unions entrenched on both sides of the fight. But there were additional fissures that were laid bare among organized labor and the Democratic Socialists of America, which opposed the Amazon deal. In August 2019, a leaked DSA memo detailed the organization’s plans to infiltrate city unions, which triggered sharp responses from labor leaders. Despite that past friction, there is also ideological convergence between the DSA and many labor unions, which have rallied together around many causes. “The relationship status is: ‘It’s complicated,’” said Evan Stavisky, a partner at The Parkside Group, a political consulting firm that works with labor clients. Over the past few years, the DSA has eclipsed the Working Families Party, which for years joined progressive activists and labor unions under a single banner. The WFP began to lose clout in 2018, when several unions withdrew from the party following a dispute over whether to endorse Gov. Andrew Cuomo. “The party was always a little bit tough to hold togeth-

er because you had different constituencies within it,” said Steven Malanga, a fellow at the Manhattan Institute, a conservative think tank. “I think right now the DSA is kind of a purer form that is starting to supersede the Working Families Party.” The DSA has indeed raised its profile with recent wins – most notably Rep. Alexandria Ocasio-Cortez’s seismic 2018 congressional campaign and the 2020 state legislative races – and they will face a major test in the 2021 New York City elections. The large unions, on the other hand, have a long track record of playing kingmaker in New York City, but early primary polls show them struggling to move the needle against an outside mayoral candidate who has not wooed organized labor as aggressively as many other candidates. “I think Andrew Yang has complicated the calculus for a lot of these unions, and I think there is probably a recognition on the part of organized labor that as Yang begins to consolidate in both perception and reality somewhat of a front-runner status, their collective ability to help one candidate is much stronger than if they were divided up,” said Neal Kwatra, the founder of Metropolitan Public Strategies and former po-

litical director of the Hotel Trades Council. Last month, DC 37 and 32BJ SEIU rolled out their endorsements of Eric Adams on consecutive days. And a few influential unions – the UFT, Transport Workers Union and the New York State Nurses Association – haven’t endorsed a candidate yet. Harry Nespoli, chair of the Municipal Labor Committee, told City & State that his organization, which represents around 100 municipal unions, plans on hosting Zoom calls with the remaining candidates this month. “Who knows which candidates are going to be there in April?” Nespoli said. “You always have other people that you know that you are looking to support if the candidate you are saying you want to go out for and you want to help become mayor isn’t there.” There are still months to go before the June primary, and even though a candidate new to the city’s political scene has taken the lead, the race is still fluid. Stavisky said: “If you’re running for office in New York City, you have to be a schmuck not to realize that this is a union town, and you’re better off having labor endorsements than not.”

CRISIS CONTRACTS

NYC’s labor agreements are set to expire as the city faces a looming fiscal disaster.

HEN NEW YORK CITY Mayor Bill de Blasio took office in 2014, every municipal collective bargaining agreement had expired, and union leaders were demanding $7 billion in retroactive pay. Though only one municipal union had endorsed him during the primary, de Blasio was seen as a friend of organized labor and, five months after taking office, the mayor reached a nine-year, $5.5 billion contract with the United Federation of Teachers, which set the pattern for pay raises for all of the city’s 300,000 workers. As de Blasio’s second term winds down, the most recent round of contracts negotiated under his administration is set to expire at a moment when the city is facing its worst fiscal crisis in years. Since personnel costs account for more than half of the budget, the outcome of the next round of collective bargaining will have a considerable impact on New York’s finances in the coming years. When the next round of bargaining begins, and which union sets the pattern for the others, will come down to strategic decisions on the part of both the unions and the city – either the current administration or the one that succeeds it. In 2014, the UFT set the pattern and, in 2018, it was District Council 37, the largest municipal workers union, which settled with the city first. DC 37’s contract expires in mid-May, while the UFT contract does not expire until next September. “We are the first one in line in terms of expiration of the contract, so yes, we have an expectation that we probably would be one of the likely candidates to set the pattern,” said Henry Garrido, executive director of DC 37. Garrido told City & State that he did not want to “negotiate on a back heel” and would probably seek to initiate negotiations before the expiration of his contract, but after the state completes its budget. “Even if we don’t get to sign a contract with this administration, we could start getting the groundwork going,” he said. Garrido added that many factors are in play, including that the union has around 10,000 workers without a contract whose negotiations the city put on hold due to “COVID and economic conditions.” But not everybody is sure that the city will be willing to engage in negotiations over the next round of contracts. “Some unions would love to start now, but I don’t

think this administration is ready to sit down and discuss that right now,” said Harry Nespoli, chair of the Municipal Labor Committee, a group representing municipal unions. Nespoli criticized the de Blasio administration for not moving to settle with unions that are ready to accept the current round’s pattern, claiming the city didn’t “want to wrap it up.” Nespoli said he believed that the next round of bargaining would fall to the administration that comes into office in 2022. “It’s not that DC 37 can’t start talking with somebody, but who are they going

to talk with?” he said. “I don’t think this administration is going to be sitting down with them to discuss the next round.” The deputy press secretary for de Blasio, Laura Feyer, told City & State in an email that the administration had settled “virtually 100% of contracts in the first round of bargaining” in 2014 and 84% in the second in 2018. “This has resulted in settled contracts spanning for over 10 years for most city employees,” she said. “We will continue to work with unions on the best path forward in light of the changing fiscal picture.” The Police Benevolent Association, one of the unions with an unsettled contract right now, is currently in arbitration, and some other uniformed unions – including the Uniformed Firefighters Association and the Detectives Endowment Association – are awaiting the outcome of that proceeding. In response to the fiscal strain brought on by the pandemic, the city emptied most of its labor reserve, which now has just enough to fund the current pattern for the still-unsettled contracts. There is no money available for raises beyond this current round, and the city’s 2021 adopted budget, moreover, included $1 billion in unspecified labor savings. “I don’t know where they’re going to find it,” Nespoli said.

Nespoli, who is president of the Uniformed Sanitationmen’s Association, said that he was always discussing ways to lower costs with the city, and pointed to health care savings that the Municipal Labor Committee negotiated during previous rounds of collective bargaining. “Two contracts ago, we saved $2.5 billion for the city of New York, and the last contract, we saved two-point-something billion dollars, and then got sick, and died, and everything,” he said. “Whoever takes over this administration has to recognize what the city workers have done.” The Citizens Budget Commission, a nonpartisan fiscal monitor, has put out recommendations, including standardizing work rules and creating more flexibility with job assignments, which could generate savings for the city. According to its President Andrew Rein, the city should be looking to increase the efficiency of government in light of the fiscal stress it is under. “Therein lies the potential winwin here, which is that when you change work rules and increase productivity you can actually save the city money, be more efficient and, to some degree, self-fund raises for workers,” he said. According to the Citizens Budget Commission, health insurance premium costs grew at an annual average rate of 7% between 2009-2019, and 95% of New York City employees choose health plans with no contribution, which means that one avenue to generate savings could be through new premium-sharing arrangements. Garrido said DC 37 had been working with the MLC and the de Blasio administration on achieving savings through changes to prescription drug and health care benefits, as well as the actuarial assumptions of pensions. “We’re working on that billion-dollar hole,” he said. DC 37 would also be seeking new work rules around telecommuting, Garrido said, as well as health and safety provisions related to the pandemic, which could include hazard pay. March’s $1.9 trillion federal stimulus bill included more than $5 billion in unrestricted aid that New York City can use to fill budget gaps, which raises the possibility that unions could ask for a portion of that sum to fund salary raises. usual campaign attire – slacks, a light blue button-down with an open neck (never a tie, even on the presidential debate stage) and his now iconic blue and orange striped scarf and black dress shoes. Yang was a committed intramural basketball player in high school and in college at Brown, and he had a weekly pickup game for years, so he is still pretty good at 46, and he made short work of a much younger reporter playing “horse.” “I think there should be an outdoor basketball court at Gracie Mansion,” Yang said. Growing up in Westchester County, Yang rooted for the Knicks, but he couldn’t forgive their 2012 failure to re-sign Jeremy Lin, the league’s first Taiwanese American player who was just coming off his breakout year, was too much for the Taiwanese American Yang. “I was so heartbroken at that, I was like, ‘I cannot root for this team.’” Luckily, the Nets had just moved to Brooklyn and their signing of Lin in 2016 cemented Yang’s new loyalty. Every candidate for mayor this year is running, in their own way, against New York City Mayor Bill de Blasio. The term-limited incumbent won’t literally be on the ballot, but his 7 1/2-year reign over the city will be. Yang’s skills on the basketball court would certainly contrast with the current mayor, who, despite being 6’5”, is a notoriously unimpressive hoops player, once nicknamed “the cactus” for the way he held his arms at a 90-degree angle. But the substantive difference is Yang’s willingness to let loose with a reporter. De Blasio isn’t known for that, and Yang is presenting an alternative. “The fact is, a lot of New Yorkers right now are looking for a light at the end of the tunnel, like a source of optimism and confidence and even joy,” Yang said. “And New York City is an incredibly exciting and joyous place in the good times. I don’t see why the mayor can’t project that kind of energy, because I think people would welcome it.” Some who know de Blasio are quick to agree that he and Yang have differences, but they don’t necessarily see that as an asset for the neophyte, who hasn’t even voted in previous mayoral elections. De Blasio served in the City Council and as public advocate before becoming mayor. Personality and professional resume is not the only way Yang’s approach contrasts with de Blasio’s: While de Blasio ran as the most aggressive progressive, Yang seems to be leaving the left-most lane to his competitors, emphasizing ideas for economic growth, rather than lamenting inequality. The question Yang still must answer is whether this opposite approach to the incumbent’s will get him to City Hall and leave him prepared once he’s there. “They couldn’t be more different person-

ality-wise, that’s for fucking sure,” said Olivia Lapeyrolerie, a political strategist with SKDK who was de Blasio’s first deputy press secretary. As Lapeyrolerie looked to a city beset by the coronavirus pandemic and its economic fallout, she wasn’t sure Yang was the antidote. “I think the challenges that we face are so serious, that the priority is who’s going to be able to actually manage the city, to steer the ship out of this crisis,” she said. “I care less who I want to have a beer with.”

UT OF THE EIGHT serious contenders for the Democratic nomination, Yang seems to be uniquely inexperienced in the city’s political and civic life. On one end of the spectrum is New York City Comptroller Scott Stringer, who has held elected office for nearly 30 years, and Adams, who’s

been in office for nearly 15. Others have extensive government experience. Shaun Donovan was housing commissioner under Mayor Michael Bloomberg, and a Cabinet secretary under President Barack Obama. Kathryn Garcia was de Blasio’s sanitation commissioner, as well as his go-to crisis manager. Maya Wiley was de Blasio’s chief counsel for 2 1/2 years, and chaired the Civilian Complaint Review Board for a year after that. And Dianne Morales worked for the New York City Department of Education before leading prominent local nonprofits and becoming an outspoken voice in the nonprofit sector on the Human Services Council. Ray McGuire, the former Citigroup vice chair, is the most similar to Yang, as he has no direct experience in government, but he served on the boards of some of the city’s most prominent institutions, including NewYork-Presbyterian

Hospital and the Studio Museum in Harlem. Yang, though he’s lived in Manhattan since 1996, has shown little interest in the city’s civic life. Even the nonprofit he led was focused on driving talented college graduates away from New York to work in smaller cities. This lack of direct experience is one of the most frequently raised concerns about Yang, especially among the segment of New Yorkers who are extremely engaged in politics. Yang has held a comfortable lead over all his opponents in each of the public polls released so far, but his endorsement list – despite a few high-profile backers such as Rep. Ritchie Torres from the Bronx – is remarkably sparse for a front-runner, with far fewer elected officials, political clubs or labor unions than Stringer, Adams or Wiley. comer to the race. Most of his opponents have been laying the groundwork for their mayoral campaigns for years – Adams and Stringer, more than a decade. Yang says he didn’t even think about it until he suspended his presidential campaign in February 2020, and even then not “particularly” until after Election Day in November. “That’s when I got really excited about running,” he said. “And like, I’m pumped to be here.” Projecting enthusiasm isn’t a problem for Yang’s campaign, but demonstrating knowledge of the relevant issues is. Although Yang has been coming out with fewer eyebrow-raising policy proposals as a serious mayoral contender than he did when he was a longer than long shot presidential candidate, he has made some gaffes born of inexperience. In January, Yang proposed putting a casino on Governors Island to revive New York City’s post-pandemic economy. He was apparently unaware that casinos are legally prohibited on Governors Island under a federal deed restriction, and his casino gambling economic revitalization strategy drew criticism from the Daily News editorial board for being a shallow gimmick. In late March, Yang assailed de Blasio for supposedly plotting to use all of the recently passed federal coronavirus relief funds in the next year, something de Blasio noted is not possible under the federal law. Yang also has been mocked for sounding like an out-of-touch celebrity: In February, he defended his decision to flee New York City for his upstate country house during the early months of the COVID-19 pandemic by saying, “We live in a two-bedroom apartment in Manhattan. And so, like, can you imagine trying to have two kids in virtual school in a two-bedroom apartment, and then trying to do work yourself?” Plenty of New Yorkers don’t have to imagine that because they have been living it for the past year. More recently, Yang – a former CNN contributor – argued that his relationship with Gov. Andrew Cuomo would be better than de Blasio’s because he is friends with the governor’s brother, CNN host Chris Cuomo. Yang told City & State that anyone who thinks he is an unprepared dilettante just needs to get to know him better. “I have

to say that this concern genuinely mistakes who I am,” he said. “If you look at my background, I graduated from Columbia Law School. I was an editor of the law review. I passed the bar. I worked as an attorney. So it’s not like I’m not mindful of the way both bureaucracies and policies function.” Yang worked at a law firm for half a year in 1999, focusing on business law. He also pointed to his record running a series of businesses, and then a national nonprofit organization, saying he knows how to build a team, and work in a variety of contexts. As mayor, Yang said he would surround himself “with people who are deeply experienced in city government and the operations of specific agencies.” Yang’s allies also like to talk about the person he is. “You can go back and forth and in a perfect world you can play mix and match with people’s best qualities, but I think for me, what’s important is whether you actually care about our most vulnerable members,” said Assembly Member Ron Kim of Queens, who has endorsed Yang’s campaign. “Andrew genuinely cares.”

While Yang was known in the presidential race for his universal basic income proposal, he hasn’t introduced a similar plan in his run for New York City mayor. His scaledback cash assistance proposal would provide an average of $2,000 per year to 500,000 New Yorkers in need.

HE BIG IDEA that attracted many dedicated fans to his presidential campaign is gone. A universal basic income on the scale Yang imagines would have been politically difficult for the federal government to implement. It would be nearly impossible for a city government to pull off, given the cost. So he dropped his signature proposal in favor of, essentially, tweaking and expanding the city’s existing direct cash assistance program targeted at low-income households. And his techno-futurist proposals, such as allowing people to vote on their smartphones, have gone unmentioned on the mayoral campaign trail. While Yang’s presidential campaign wasn’t clearly identified with either the centrist or left wings of the Democratic

Party, his current campaign strategy seems to include running toward the center of New York City’s Democratic field. Before entering the race, he commissioned a poll exploring whether he could win as an independent. His campaign co-manager Chris Coffey used to represent the Police Benevolent Association, the largest New York City police union, and its polarizing President Pat Lynch. The PBA and Lynch are widely despised among police reformers for their hard-line opposition to even the most modest efforts at increasing accountability and transparency for police brutality. The candidate’s campaign platform is

also on the right of the current crop of contenders. Yang generally opposes raising taxes on the wealthy and he hasn’t committed to decreasing the NYPD’s budget – and he has called for bolstering police funding and staffing levels in certain situations. He also drew the ire of alternative transportation advocates by suggesting that bus-only lanes should be reopened to private cars at certain times. Perhaps Yang is looking to build a coalition of more conservative constituencies: Yang is currently in contention for the endorsement of ultra-Orthodox Jewish religious leaders, thanks in part to his recent

comments in favor of allowing yeshivas to continue neglecting to provide a secular education to their students. curriculum unless that curriculum can be demonstrated to have improved impact on people’s career trajectories and prospects.” (Some former Hasidic Jews say their job prospects have been severely limited by their lack of necessary education.) Yang’s casual charm has helped to make him popular among the broad Democratic electorate thus far, but progressive insiders like Allen Roskoff, who leads the Jim Owles Liberal Democratic Club, said that will fade when voters start taking Yang more seriously. “Yang has inconsistent positions with that of progressive New York and no history of working with groups or issues he is tak-

ing positions on,” Roskoff said. He added, “I do not know a single person, gay or straight, who’s left of center supporting him or giving him further consideration.” When asked, Yang’s campaign doesn’t deny that he appeals to more moderate voters – but insists that his focus on a basic income is a mark of true progressivism. “Yang is the one who put the idea at the national level that we need to redistribute dollars in a broken economy to everyday people who have been hurt the most. I’m really proud that the first thing that we rolled out in this campaign was cash relief for the poorest New Yorkers,” Yang’s campaign co-manager Sasha Ahuja told City & State. “I very much so believe that Andrew must be included in that field of candidates who are part of the left.” There are some progressives, such as Kim, who are supporting Yang. Kim argues that Yang is malleable, praising the candidate’s “passion to find solutions.” “I don’t agree with everything, with all the policies that are coming out of his shop, but he’s always open to collaborating,” Kim said.

NE CONSTITUENCY THAT may back Yang while spanning the ideological spectrum is Asian Americans, who comprise 14% of New York City’s population. A WPIX-TV/ NewsNation/Emerson College poll taken in early March showed Yang with the support of 60% of Asian American likely Democratic voters, compared to 50% among white voters, 31% among Black voters and 26% of Hispanic voters. The enthusiasm for Yang’s candidacy from an underrepresented community comes as no surprise: Yang would be the first Asian American mayor of New York City, and he is running during an alarming surge in anti-Asian hate crimes. Yang has spoken about the harm of such bigotry in personal and political terms. He noted that a 65-year-old Asian American woman who was recently attacked in his own neighborhood of Hell’s Kitchen “could easily have been my mother.” But Yang’s presidential candidacy was not greeted with universal enthusiasm among Asian Americans. Many were critical of his habit of making jokes playing on ethnic stereotypes. During one debate, he cracked “Now, I am Asian, so I know a lot of doctors,” and in another he said, “The opposite of Donald Trump is an Asian man who likes math.” While Yang still likes to have fun on the campaign trail, he has ditched those kinds of lines this year. Some of his attempts at lightheartedness have prompted online rebukes from people who say he demonstrates

a lack of New York authenticity, such as the scolds who thought he mischaracterized a deli as a bodega. To many, these attacks on Yang reek of anti-Asian bias and the racist trope of the “perpetual foreigner,” written about by activist Nina Luo in the New York Daily News. Jokes about Asians and math are not the only time Yang has tested the limits of political correctness: His rise to national prominence was powered in part by appearances on programs with right-wing hosts such as Ben Shapiro’s radio show and Tucker Carlson’s Fox News program. In one appearance, he said, “There are many elements of Trump voters that I completely get and empathize with,” and in another he opined that the Democratic Party, “needs to try and gravitate away from identity politics.” Female employees of his presidential campaign, the test prep company he led and the nonprofit he founded have also complained of male-dominated office “bro culture.” Some have alleged gender discrimination, which Yang and other former colleagues have denied. In a March conversation with supporters on the audio chat room app Clubhouse, Yang sounded extremely confident, when asked about his chances. He raised a lot of money quickly, and “85% of New Yorkers have heard of me, and 65% have a favorable impression,” he said. “So right now, I am the candidate to beat, and I don’t see that dynamic changing, as long as we keep running our race.” Walking through Times Square with Yang, the breadth of his recognition and support is readily apparent. He’s there to meet with homeless outreach workers and their clients, but he has to take a couple breaks to indulge a diverse array of fans who approach: a white teen in a lacrosse sweatshirt who said his grandma voted for Trump, but she’s voting for Yang too; a West African immigrant who works for a tour bus company and asked if Yang has any Africans on his campaign team; an Orthodox Jewish couple with a baby who wanted a selfie with Yang; and a younger Asian American man who just wanted to tell Yang he’s a fan. Yang may not have a traditional winning coalition in a New York City primary, but everyone knows him. That includes Times Square’s famous Naked Cowboy, the attention-grabbing Trump supporter who attended the Jan. 6 rally in Washington, D.C., that preceded the deadly siege of the U.S. Capitol. The cowboy approached Yang, and the candidate gamely posed with him before the cameras. Asked if he knew about the performer’s political leaning, Yang laughed in disbelief. “Really? Our Naked Cowboy? What is he doing?!” he exclaimed. “Agh. I had no idea.”

somewhat ambivalent about being known as the “tech guy.” Once a presidential long shot and now the front-runner in the Democratic primary for mayor of New York City, Yang has spent his short political career being characterized as a tech entrepreneur or the “Silicon Valley candidate.” This characterization stems from the fact that Yang founded a short-lived tech startup in the early 2000s and then a nonprofit that sent hundreds of college graduates to work at tech startups around the country. His interest in the labor market problems potentially posed by automation and artificial intelligence also help explain the label. But Yang is not actually a product of Silicon Valley, nor is he someone whose career is defined by the creation of a successful app or website. A good chunk of Yang’s professional life was spent leading a test prep company that he said tried to use technology in an innovative way, but was an educational company at heart. “I get characterized as a tech guy in a way that probably is something of an oversimplification of my background,” Yang told City & State. Yang’s background is the subject of intense focus as he continues to lead polls in the crowded mayoral primary despite never having worked in local politics, policy or social services in any capacity. Though he’s lived in New York City for over two decades, he hasn’t voted in any of the past four mayoral elections. So what does his professional record consist of, and how would it prepare him for City Hall? In interviews with over a dozen of Yang’s former coworkers, business partners and fellows at his nonprofit, Venture for America, nearly all praised Yang’s plainspokenness, self-deprecating humor and impassioned talk about creating a better future. But while many agreed that Yang the candidate is a lot like Yang the CEO, and some said that positioned him well to lead New York City, several of the

people City & State spoke to suggested that echoes of some of the criticisms Yang has received during the mayoral campaign – including that he’s taken a hands-off approach to getting involved in city politics – can be found in the work he did before he set his sights on elected office. Two former fellows with Venture for America said that while the nonprofit under Yang’s leadership was well intentioned and provided them with valuable experiences in startups, it was not always an organization that had equity or the most vulnerable people in mind. Founded by Yang in 2011, Venture for America is a nonprofit organization that re-

Getting to know the city council and attending community meetings, for example, were

What did he do before running for president? He certainly wasn’t spending much time in New York City politics. The nonprofit raises money from rich donors including Uber CEO Dara Khosrowshahi and other companies and foundations, which fund a startup accelerator and investment fund to help those fellows start their own companies. At its outset, part of Venture for America’s mission was to “revitalize” those struggling cities by sending them graduates of elite colleges and universities. But with largely white and male classes in its early years and little importance placed on fellows becoming civically engaged, some said the organization parachuted in to create companies

not activities that were emphasized, the former fellow said. However, that fellow and others complimented the nonprofit for moving beyond that mission in recent years and focusing on diversifying its classes; more than half of the 2020 fellow class identified as a racial or ethnic minority. Spokespeople for Yang did not respond directly to the claim that the nonprofit was not closely involved in the cities it operated in. “Andrew built VFA from the ground up by investing in American entrepreneurs from every corner of the country to build businesses in cities eager for innovation and investment,” said Alex Sommer, a vice president at Tusk Strategies, which is working on Yang’s

campaign. “Since Andrew founded the organization, VFA has welcomed over 1,000 fellows who have helped generate $115 million in investment capital, and created jobs and developed companies in cities across America.” Venture for America did not immediately respond to a request for comment on this or other criticisms of the nonprofit under Yang’s leadership. Venture for America is an important part of Yang’s story to consider in judging his mayoral run. But Yang’s story starts with a far more conventional job: as an associate at a big Manhattan law firm. After graduating from Columbia Law School in 1999, Yang followed the Big Law pipeline to Davis Polk & Wardwell, an international firm with nearly 1,000 attorneys today. Yang lasted five months before quitting out of boredom. A self-described “serial entrepreneur,” Yang headed for riskier pastures, founding a startup in 2000 called Stargiving, a website that allowed fans to donate to the charitable causes championed by their favorite celebrities. Brian Yang (no relation), one of Stargiving’s first employees, said that many of the strengths the candidate exhibits on the campaign trail – fundraising, galvanizing audiences and being both a big thinker and effective at working out the minutiae – were on display at his first business venture. But Stargiving failed to catch on and folded amid the dot-com bubble burst in 2002. Today, Yang takes a more positive view of his first startup failure, which is something like a rite

After a starting class of just a few dozen fellows, Venture for America has grown into an organization that sends classes of over 100 fellows to 13 cities across the country every year. College graduates selected to participate attend about a monthlong training camp with Venture for America staff, where they bond with their classes and attend lectures with guest speakers, business leaders and Yang himself. Then, they set off for their cities, where they’ve lined up – either on their own or with the organization’s help – a full-time job at a company. While many of the fellows City & State spoke to said that the organization has had a positive impact on their own life and career, the nonprofit’s effect on the communities it works in is less clear. Initially, Yang set a goal of creating 100,000 jobs through the program by 2025, but as the technology outlet Recode reported during the presidential race, the organization has claimed credit for creating only a few thousand jobs in its cities, generously measuring their impact by the number of jobs a company creates after employing a Venture for America fellow. Yang has said more recently that the goal was unrealistic. “In order for organizations to have a very high ceiling, you need to set the goal very, very aggressively,” he told Recode in 2019. Recode reported that as of 2019, 52% of fellows remained in the cities they’d worked in during the program. An organization’s impact can’t be measured in statistics alone, of course. Many of the former fellows City & State spoke to praise the nonprofit for creating a stable on-ramp to the volatile world of startups and entrepreneurship. “Startups are very risky, and I don’t come from a family with a wealthy background,” said Chisom Uche, a fellow from 2014 to 2016 who worked in St. Louis. A two-year program that gave fellows built-in networks in their cities and offered some support in finding a new job if a fellow’s company were to fold took some of that risk away, Uche said.

“If he was someone who did believe that constant active civic engagement was really critical, and that those things are part of the fabric of the city, then the structure of ‘revitalization’ would probably have looked different.” – an anonymous former Venture for America fellow

Former employees at Venture for America said that Yang led the organization with the same kind of charisma and passion that won him supporters on the campaign trail. “He went out there and basically went door-to-door at colleges and universities, doing all the recruiting, all the conversations, all the pitching himself,” said Mike Tarullo, the former senior vice president of corporate development at Venture for America, of Yang’s work in the early days of the nonprofit. Former fellows – even those with criticism of Yang’s lead-

ership – praised Venture for America today for evolving to have more diverse classes of fellows, by race, gender and socioeconomic background, and for focusing more on creating a path to entrepreneurship for communities historically excluded from the startup world, including women and people of color. Venture for America now hires community directors in each of its cities in an effort to have an on-the-ground presence and help fellows become more engaged with the communities they’re joining. But some fellows said that

of passage in tech, after all. “I think most anyone with any common sense would think that if you start a business and it doesn’t work out … that’s the kind of experience that would really help inform you about both success and failure, and how tough it is for small businesses,” he told City & State. Following Stargiving, Yang worked in executive roles at a content management company and a medical records software company, but his next big job was at Manhattan Prep, then a startup known as Manhattan GMAT. Yang joined in 2006 and quickly took over as chief executive officer. Under his leadership, the company expanded to offer not just preparation for the business school admissions standardized test, but courses for other tests as well. In 2009, the company was acquired by the test prep giant Kaplan – a sign of the success Yang had turned the company into. One former employee said that in addition to a hands-on approach and inspiring employees to be invested in the company’s success – Yang also took on an open-minded approach to hiring at a time when the company was growing, taking chances on candidates who resumes may not have lined up perfectly with the job but who were smart and showed promise. It was in 2011, after Kaplan’s acquisition of Manhattan Prep, that Yang launched Venture for America. Yang first conceived of it as a way to direct top-tier talent from colleges and universities to cities like Detroit rather than San Francisco. While Venture for America was headquartered in New York City, the nonprofit didn’t send fellows there. In his 2018 book, “The War on Normal People,” Yang describes thinking up Venture for America as an engine of job creation in cities that needed economic stimulus. “I arrived at a vision, an army of smart, enterprising graduates building businesses in Detroit, New Orleans, Providence, Baltimore, Cleveland, St. Louis, and other communities that could use a boost,” he writes.

those changes only started happening after Yang left in 2017. Two former fellows said that during their time at Venture for America, Yang expressed an interest in increasing diversity but said that he didn’t want to lower the organization’s standards, suggesting it couldn’t have one without the other. Spokespeople for Yang did not comment on whether these changes started happening after he stepped down, or on whether Yang remembered ever saying or suggesting this. Even fellows who had overwhelmingly positive things to

say about Yang and their time at Venture for America said that diversity was an issue. “VFA wasn’t a very diverse organization back when I was doing it,” Uche said. But Uche said that the organization took some steps right away to address critiques about diversity when he started as a fellow in 2014, when Yang still led the nonprofit, suggesting that it was an issue that Yang took seriously then. Uche started an affinity group with several other fellows to offer support to people of color, primarily African American fellows. “VFA, they took that very seriously

the first time we approached them with it, and gave us the resources that we needed to put together a group. They let us go out to events like Black Tech Week in Florida and they subsidized that trip,” Uche said. Yang has acknowledged that in the early years of the program, the classes of fellows were predominantly white and male. “I was one of the first people to say that we needed to broaden the types of graduates we were recruiting in multiple ways,” Yang told City & State. “So if someone looks at our early years and says, ‘Hey,

we should head in this direction,’ like, I would agree with you. And I agreed at the time.” Criticisms of Yang’s lack of a local voting record in New York City prior to his political career are not unrelated to the issues that some fellows raised with Yang’s leadership of Venture for America and the nonprofit’s original mission of revitalizing struggling cities. Comments that recently surfaced in which Yang said he wasn’t involved in New York City politics because it was “so blue that there isn’t that much to be engaged with, politically,” made their way around group chats with fellows. “It strikes me as typically Andrew, where he has an idea as to how to help and support a place, but he doesn’t do that with any on-the-ground understanding of that place,” said one former fellow, who asked not to be named in order to speak candidly about their experience. “He was structuring VFA where you have fellows across 11 different cities, and each of those cities is notably different geographically, economically, in terms of the diversity of the city – so many things – and he was doing that without any on-the-ground knowledge of what each community or place was actually like. So it was an incredibly hands-off, dismissive approach.” Spokespeople for Yang did not respond with a comment on this claim. Three months away from the primary election that will in all likelihood decide the next mayor of New York City, Yang does not hesitate to acknowledge that despite living in New York for over two decades, he has not often been politically or civically engaged in the city. “I’d be the first to admit that I was not as heavily involved in local politics, the last number of years, as I could have been,” he said, before adding that there are different ways that people can contribute to a community, citing his work founding Venture for America. The nonprofit may not have had the impact on cities that Yang once envisioned, but that may not matter to voters enamored with a political outsider with big ideas and a can-do attitude.

A member of the House Rural Broadband Task Force, which aims to deliver high-speed internet to every American by 2025, Delgado backs the Accessible, Affordable Internet for All Act.

There was no one person who single-handedly made it legal to light up in the Empire State, but the tireless work of Kassandra Frederique certainly stands out.
