THE EVIDENCE FOR HOW HARD IT’S BEEN FOR SMALL BUSINESSES during the coronavirus pandemic can be seen among empty storefronts throughout New York City, and the expectation that these enterprises will return to their brick-and-mortar locations may not be realistic. But the struggles to stay afloat for many business owners had already been in play before COVID-19. Among them is Felix Loo, the owner of Discorama Overstock, an online music store that for 41 years had five locations at different times in Manhattan. Discorama’s last store closed on West Eighth Street in May 2017, a casualty of the once-busy commercial corridor. By contrast, Record Mart, operating what was Manhattan’s oldest record store out of the Times Square subway station, was thriving. New Yorkers and tourists passing through the station could easily duck into Record Mart to browse the LP and CD racks. That was until the business that was started by Jesse Moskowitz and Bob Stack in 1958 opted instead to continue as an online hi-fi equipment seller because of the pandemic. I texted Loo, who I had worked for while I was in high school, to suggest opening a Discorama in the Times Square location. “Retired from brick and mortar retail,” he texted back, noting online sales were up 30% during the worst of the pandemic and that “we are still busy.” There was no argument that Discorama’s business model had changed for good, and it underscored the urgency to find tenants for vacant stores who actually want to operate out of a brick-and-mortar environment again. This is what’s happened to the old Record Mart location in the subway. Sadly, that new tenant is a COVID-19 testing site.

Lt. Gov. Brian Benjamin has expertly avoided the press since news first broke of subpoenas he faces relating to his 2021 campaign for New York City comptroller and his awarding of state grants while he served in the state

Senate. But after a week of radio silence and no public schedules, Benjamin offered his first on-therecord comments about the reporting after getting caught in a hallway in the Capitol. Reading from a prewritten statement he was carrying, Benjamin admitted that he did not inform Gov. Kathy Hochul

of the investigation into his comptroller campaign, despite knowing about it when she recruited him to serve with her. However, he denied any wrongdoing and said he has been cooperating with investigators.

As a court case to determine the legality of New York’s newly drawn district lines continues to play out, the deadline for candidates running for statewide and legislative positions to file petitions has come and gone. On the Democratic side in the race for governor, New York City Public Advocate Jumaane Williams said he and his running mate Ana Maria Archila delivered 40,000 signatures to get onto the ballot in June. Rep. Tom Suozzi, who is running with former New York City Council Member Diana Reyna, reported filing over 40,000 signatures as well. Notably, former Gov. Andrew Cuomo did not file petitions, so he officially won’t appear in the Democratic primary. Hochul and Benjamin already had the Democratic designations and did not need to petition their way onto the ballot. On the Republican side of the gubernatorial race, former New York City Mayor Andrew Giuliani, Rob Astorino and Harry Wilson each filed enough signatures to get on the ballot and challenge Rep. Lee Zeldin, who received the GOP designation, in June.

legality under the state Constitution. An appellate judge on Friday extended a lower court’s stay on a decision from a Steuben County judge who ruled that new lines approved by Albany Democrats weeks ago violated a state Constitution provision against gerrymandering. State lawmakers would have had to draw new maps with just weeks to go until the June primaries had the stay not remained in place. Wannabe legislators at the state and federal levels can now rejoice that they have some certainty about where they need to campaign while Democrats got one more reason to hope that they can flip a few GOP congressional seats this fall as part of their wider efforts to retain control of the House in what will likely be a tough election cycle for Team Blue.

The Big Apple ain’t shining like she used to, and the grass is looking greener elsewhere as far as 6 in 10 residents of the five boroughs are concerned, according to a new poll. Rising crime appears to be playing a role following years of record lows, and some recent data suggests the situation might be getting even worse. The New York City Police Department claims repeat offenders are the people driving a 44% increase in crime during the first few months of 2022 compared to a year ago. Murders are down by 9%, which hardly matches the picture of crime run amok as portrayed by the political right. New York City Mayor Eric Adams is promising to do something about these disturbing trends.

NY Dems’ party chair wants to create … a new party Third-party discourse has officially entered the chat for the 2022 statewide election cycle. And like always, it’s messy. State Democratic Party Chair Jay Jacobs is looking to create a new third party to help give Gov. Kathy Hochul – and reportedly some vulnerable incumbents – an extra boost in November. Thanks to New York’s somewhat archaic fusion voting laws, candidates can run on multiple party lines in a single election, allowing their name to appear more than once on the same ballot. Republicans have reliably depended on the Conservative Party to offer its line to GOP candidates, and this year is no different. In the gubernatorial race, the Conservative Party has already designated Rep. Lee Zeldin, the presumptive GOP nominee, as its candidate. If Zeldin wins the Republican primary, he will appear at least twice on the ballot. Right now, Hochul is guaranteed only one party line if she wins the Democratic primary because the Working Families Party is backing New York City Public Advocate Jumaane Williams. As of now, if Williams loses the primary, he still has a spot on the ballot on the WFP line, though that line has traditionally been offered to whoever wins the Democratic primary. “It is only smart tactically for us to

consider using an Independent Nominating Committee to ensure that the governor’s position on the ballot matches her Republican opponent,” Jacobs said in a statement. Jacobs told City & State that the idea has support from some county leaders, but the idea has not been well received by some Democrats. “I put that in the category of shenanigans,” state Senate Deputy Majority Leader Michael Gianaris told reporters. “People know who the Democratic candidates are, people know who the Republican candidates are, and they’re going to vote accordingly.” He called it “peculiar” that the leader of one party would suggest creating a new one. But at least one of Jacobs’ predecessors said he could see himself taking similar action if he had found himself in a comparable political situation. “Just in case there were people who are of a mind not to want to vote on the Democratic line, that you open up a separate line for them, I guess that’s OK,” former Gov. David Paterson, who chaired the state party for a year, told City & State. “In a similar situation, yes, I could have seen myself doing that.” Paterson said that he doesn’t consider providing a Democrat with another line to be “wrong or unethical” as it would ultimately serve to help the party. – Rebecca C. Trashed treasures

N

EW YORK CITY WORKERS have been throwing out homeless people’s personal belongings in the latest round of sweeps, advocates for unhoused people said – despite New York City Mayor Eric Adams and city Sanitation Department officials’ assurances that they weren’t doing that. Adams announced the city was sweeping homeless encampments in March as part of an effort to clean up the streets and get people moved into shelters. Adams touted the addition of 350 new “safe haven” beds in congregate settings, but as of April 6 just five people had accepted a bed out of more than 200 encampments targeted. Videos recently emerged of sanitation trucks at these sweeps, and footage shot by photojournalist Karla Cote showed sanitation workers crushing mattresses and wooden furniture in the back of trucks while workers picked up what appeared to be tennis rackets and a picture frame. There was also a tweeted complaint about a boombox, a speaker and a gold watch belonging to homeless individuals being thrown out in a sweep. The mayor said parts of built-up shelters were getting tossed in the trash, but that personal items were being saved for later retrieval. “If something simple as they have a bag full of bottles that they collect and they’re getting five cents each from them, we’re not going to discard that. … That’s their property,” Adams said. A mayoral spokesperson clarified that some items were taken to police precincts for storage, and the owners were given a voucher – like a coat check ticket – to pick it up when they’re ready. But advocates said city workers weren’t being as judicious as Adams claimed. “We routinely see them throwing out

people’s belongings,” said Helen Strom, benefits and homeless advocacy director at the Safety Net Project, a direct services provider where employees have observed many sweeps firsthand. “That’s certainly what we’ve seen for the past several years, and that’s the same thing we’ve seen in the past couple of weeks.” In March, Strom said city workers in Queens trashed the table that a homeless street vendor used for work and said the belongings of people who were sleeping under the Brooklyn-Queens Expressway were crushed in a sanitation truck without their permission. And the idea of vouchers? Strom said that only happens when the NYPD also arrests a homeless individual. “Apart from that, every other time we’ve seen them do this, they do not voucher and hold people’s stuff,” she said. Asked about the vouchers, the Sanitation Department referred City & State to the mayor’s office, where a spokesperson said it was happening. Asked for more details, the NYPD press office just sent a link to procedure 218-01 in the patrol guide, outlining the process for invoicing property. Whether it’s smaller belongings or tents and blankets, city workers shouldn’t be throwing out anything, said Jacquelyn Simone, policy director at Coalition for the Homeless. “The larger issue is sending police and sanitation workers to break up what little protection people often have from the elements and what little safety they might have is not the right policy,” she said, adding that the city should be providing more safe shelter options with private rooms and housing instead. The city has been trashing people’s belongings in sweeps long before Adams took office. “New York City has a big reputation of throwing out everybody’s personal

stuff like birth certificates, Social Security cards,” said Marcus Moore, an activist with homeless advocacy group Picture the Homeless in a video posted to Twitter. “A lot of people right now that’s on the street, the only thing they have right now is their personal possessions.” In 2017, Picture the Homeless and the New York Civil Liberties Union reached a legal settlement with the NYPD after city workers kicked three homeless New Yorkers to wake them up and threw their belongings in a trash compactor. In 2020, NY1 reported that sanitation workers tossed out someone’s walker. Some New York City Council members were concerned about this practice continuing even before the Adams administration started its sweeps. At a March 4 preliminary budget hearing, Council Member Nantasha Williams of Queens asked Sanitation Department leaders about discarding homeless New Yorkers’ belongings, and Commissioner Edward Grayson said it can be “very ambiguous at times” determining what should be thrown out and what should not be. “It is the complete epitome of the adage ‘one man’s trash is another man’s treasure,’” Grayson said. “Where the passersby, and the residents of the impacted areas, they’re complaining about what looks to be garbage to them. And yet when you get to the location, someone is standing there saying ‘that’s mine. That’s my whole life.’” He tried to emphasize that sanitation workers were being deliberate about what got thrown out. “We don’t go in like stormtroopers and just take stuff,” Grayson said. But he admitted that often, things do get thrown out. “It’s never intentional when we take someone’s belongings. Unless of course they’re there and it has been determined that that is actually garbage, or un-

safe, etc.,” he said. Where’s the line between garbage and personal belongings? A mayoral spokesperson said sanitation workers follow city Sanitation Code, and Adams provided a shorthand at a press conference. “If you have something that’s soiled with human waste, something that is rubbish, (sanitation workers are) making the right decision,” he said. “Let’s be clear here. You have a right to sleep on the street. You don’t have the right to build a miniature house.” The law is with the mayor – but Christopher Dunn, legal director of the NYCLU, said city workers shouldn’t be throwing out tents and mattresses, even if staying in them on the street breaks the law. “The fact that it’s soiled or not is irrelevant,” he told City & State. City workers can take tents away, “but they can’t throw (them) away. That’s property they would have to

voucher and allow you to retrieve.” Adams and leaders in his administration have insisted the homeless sweeps were a humanitarian measure, “giving people the dignity they deserve,” by encouraging them to sleep in city shelters, rather than on the street. But Strom, from the Safety Net Project, wasn’t buying it. Throwing out people’s possessions makes it harder for city outreach workers to build trust with people living on the street. And if they don’t immediately accept shelter – like the vast majority of New Yorkers targeted in homeless sweeps – then they’re put in an even more dangerous situation. “If someone is surviving in the elements and you’re getting rid of their blankets and their tent and you already know they don’t feel safe in the shelter,” she said, “getting rid of their tents and their blankets is getting rid of their ability to survive.”

New governor, same opaque budget process Kathy Hochul fell short on her commitments to transparency, but did she have an alternative?

D

ESPITE PROMISES of greater transparency from Gov. Kathy Hochul’s office, the recently concluded budget process was conducted in notable secrecy, even by Albany standards. “This has been among the most secretive budgets I’ve ever seen, where they did the barest minimum to let the public know what’s going on,” Blair Horner, executive director of the government watchdog nonprofit New York Public Interest Research Group, told City & State. The budget was the culmination of months of, admittedly smaller, transparency issues. Hochul benefitted from a honeymoon period after she became the state’s first female governor in late August. But almost from Day One, she deflected questions from reporters under the guise of collaboration with lawmakers. Almost any time a reporter asked her about a high-profile bill that had yet to pass in the Legislature or a controversial issue like bail, Hochul would generally give some version of the same response: She’ll review it if the Legislature approves it, or she’s open to working with the Legislature on (insert topic here). Asked about the Climate and Community Investment Act and the prospect of imple-

menting a gas tax last year, Hochul avoided a direct answer and said she would support “anything that’s going to get us to a better place.” The bill hasn’t passed, and Hochul’s position on implementing the corporate gas tax, a popular idea among progressives that has faced strong resistance from business groups, remains unknown. In Albany – and for anyone who has spent more than five minutes with a politician – this behavior is par for the course to a degree. One could argue Hochul simply acted like a savvy political operator by carefully managing her public image as she privately made decisions about where she stood on big issues. “I expected her to take it slowly, to push back when need be right and to stand firm,” political consultant Camille Rivera, who publicly spoke out against former Gov. Andrew Cuomo’s governing style last year and has years of experience dealing with Albany politics, told City & State. She added that she gave the governor “an immense amount of grace” in those first few months as the state’s first woman in the governor’s mansion. And certainly, Hochul has made strides toward creating a more open government compared to some of her predecessors. She has posted her recusals online and released a conflicts of interest policy with regards to

her husband’s work with the company Delaware North, which does business with the state. Hochul has also touted the clearance of a backlog of Freedom of Information Law requests as part of her administration’s ongoing efforts to streamline the process of getting those requests fulfilled – the state has traditionally had infamously long wait times. The good government group Reinvent Albany – whose executive director has been open about his criticism of the secretive budget process – released a report last month evaluating the transparency plans that Hochul required state agencies to submit, praising her for the step while offering recommendations to further strengthen government transparency. But dodging questions from the press is not the only criticism Hochul has faced. She received blowback over delays in releasing detailed public schedules, the first batch of which came after reporters had filed Freedom of Information Law requests already. When Hochul’s administration made those schedules public, they included a large number of “private events” as the governor broke fundraising records. Her administration offered no additional insight about those political events, who attended them or even their nature. Hochul also made question-

able use of state travel resources that necessitated her campaign reimbursing taxpayer dollars when her government and political work mixed. It offered more than enough reason for one to least raise an eyebrow given her Day One promise about greater transparency. “Gov. Hochul is committed to transparency, accountability and the highest ethical standards,” spokesperson Hazel Crampton-Hays said in a statement. “Since taking office, Gov. Hochul has taken numerous actions to change the culture in Albany and restore trust in government, and we continue to take steps to deliver the government New Yorkers deserve – including with a bold, fiscally responsible $220 billion budget.” She also reaffirmed that Hochul would release detailed schedules on a quarterly basis. Then came the budget, and Hochul seemed to shed any veneer of transparency. “I’m not negotiating in the press” became a common refrain from the governor when asked about any issue not explicitly included in her executive budget released in January. Though she claimed the position was meant to allow greater collaboration with lawmakers, it effectively translated to a lockbox on where she stood on any number of contentious issues. Her eventual op-ed on bail reform came only after weeks of questions about where she stood, as well as after her administration’s public safety plan had already been leaked in the press.

Horner, of the good government watchdog group, said he was judging the budget process as a whole, using measures like how many bills required messages of necessity in order to pass and the number of nonpublic conference meetings with lawmakers as benchmarks. On the governor’s side, she notably went 10 days without speaking to capitol reporters even as the budget was late, the second longest amount of time a New York governor has gone without addressing a late budget since the 1920s. Although Horner said that Hochul’s secretiveness doesn’t necessarily rise to a level beyond any of her predecessors, he added, “In terms of openness, this ain’t it.” The most prominent example came on

After her 10-point public safety plan leaked to the press before legislative leaders could even review it – something she denied her administration had any part in – Hochul still wouldn’t answer questions on the topic of bail reform. “New Yorkers are most interested in results,” Hochul said in March when asked about her lack of transparency around bail. “That’s why we’re working with my team and working with the legislators to craft a position ... I will strike the right balance in what we’re doing here.” Soon after, Lt. Gov. Brian Benjamin was caught on camera fleeing into an elevator rather than responding to reporter questions on bail reform. The billion-dollar deal to build the Buf-

falo Bills a new stadium did little to improve Hochul’s image on transparency. She announced the deal shortly before the budget deadline without first giving legislative leaders prior warning, throwing another wrench in the already tense negotiations. Editorial boards almost universally panned the deal – with the exception being The Buffalo News – in part for the secrecy around the deal and the lack of scrutiny the timing of the announcement afforded. “I am pretty sure that she has utilized the back room and secrecy as a way to get things done,” Rivera said, taking particular umbrage at the amount of time the governor went without talking to reporters. “And that is not how we should govern, and it’s a direct opposite of what she was pushing

forward.” Hochul has defended both the deal and how she announced it, saying the timing lined up with a meeting among NFL officials and the stadium project would lead to economic development opportunities. In some ways, the system had set Hochul up for failure on transparency from the state. “Every governor comes in saying they’re going to be an open government,” Horner said. “And they all fail – and it’s not entirely their fault.” Negotiating sensitive matters with other state officials generally lends itself to secrecy so as to maintain leverage. “That being said, yes, the reality has not come close to the promise,” Horner said of Hochul’s early pledge for a more open government. One Albany strategist, who requested anonymity to speak candidly about the governor, suggested a more mundane reason for some of the biggest apparent budget blunders from Hochul. “It just seemed a little sloppy,” the strategist said. “So my gut tells me the level of secretiveness … that has enveloped the budget process and her is … more a function of, this is their first go around here and they don’t really know what they’re doing.” Hochul addressed that very critique after announcing a tentative budget deal, telling reporters, “We’re not inexperienced. We know we know how to get things done.” However, the Albany strategist noted the innately secretive nature of maintaining power and influence in Albany that makes Hochul’s promises about a more transparent government hard to make good on. “Structurally, this just shows you that no matter who was in that chair, there is a level of behind-closed-door deal making that’s always going to happen,” the strategist said.

makers slated to debate them into the night. Three had passed both chambers. Lawmakers had to completely pass the budget by Monday, April 11, to avoid interruptions to payroll for state employees. Bail reform was a key sticking point, but it was hardly the only controversial proposal included in the budget deal struck by Hochul, Assembly Speaker Carl Heastie and state Senate Majority Leader Andrea Stewart-Cousins. Other key items were money for a new stadium for the Buffalo Bills, an expansion of health care for undocumented people and ethics reform. Nothing is certain in Albany until it is official, official, but substantial changes to a budget agreement appear unlikely despite some dissatisfaction among some legislators about how things shaped up in the end.

A proposed mandate that all new buildings be gasfree by 2027 fell out of budget negotiations, much to the disappointment of environmentalists. They are vowing to push for a gas hookup ban in the remainder of the legislative session that concludes June 2, along with a counter proposal to what Hochul wanted to do in the budget about making plastics manufacturers more responsible for the disposal of certain packing materials. Downstate casinos The New York City area is poised to get three new casinos as part of a deal that would grant three licenses downstate, but a key sticking point was how much influence local officials would have on their eventual locations. A twothirds vote by a new six-member panel – that would include the New York City mayor and governor, the local state senator, Assembly member, City Council member and the borough president – would be needed to greenlight a proposed location.

MAZON WORKERS MADE history on Staten Island on April 1 as they voted to create the company’s first unionized warehouse after a series of failed organizing attempts at the behemoth employer’s facilities across the country. According to the final tally announced by the National Labor Relations Board, workers at Amazon’s JFK8 fulfillment center on Staten Island voted 2654 to 2131 in favor of joining the Amazon Labor Union – an upstart union led by Chris Smalls, who was fired from the facility during the COVID-19 pandemic after raising concerns about health and safety conditions, and Derrick Palmer, a current JFK8 employee. The NLRB said that the facility had roughly 8,000 eligible voters and counted over 4,700 ballots cast in the election – marking a relatively high turnout. Only 67 ballots were contested, far too few to compromise the union’s 523 vote lead. “We @amazonlabor has just (become) the first

union for @amazon in The United States of America!” Palmer tweeted after the final tally was announced. On the afternoon of March 31, when the union’s lead was still growing, Smalls told a reporter that he thought the Amazon lawyers watching the vote count were getting nervous. “I love watching them squirm. They’re drinking mad water,” he told Vice’s Lauren Kaori Gurley. “We’re disappointed with the outcome of the election in Staten Island because we believe having a direct relationship with the company is best for our employees,” Amazon said in a statement on April 1. “We’re evaluating our options, including filing objections based on the inappropriate and undue influence by the NLRB that we and others (including the National Retail Federation and U.S. Chamber of Commerce) witnessed in this election.” It’s unclear exactly how Amazon is suggesting that the NLRB exerted undue influence, but the statement links to an article on the U.S. Chamber of Commerce’s website noting that the NLRB filed a court injunction to reinstate a fired union activist at the JFK8 warehouse. New York lawmakers congratulated the union for its historic win. “Truly a David vs Goliath moment and I am so friggin proud of these guys! And to think it happened on Staten Island!” state Sen. Diane Savino wrote on Twitter. “Felicidades to @amazonlabor for building real worker power & winning where it was supposed to be impossible. Welcome to our labor family!” State Sen. an investigation into the company’s labor practices in April 2020. In February 2021, James sued Amazon alleging that it failed to protect warehouse workers at its facilities in Queens and Staten Island during the pandemic and retaliated against employees who spoke up about working conditions. Amazon sued James just days before that in an attempt to preempt her from bringing those charges and argued that the claims she eventually made didn’t represent an accurate picture of the company’s pandemic response. Despite not working at the facility for two years, Smalls founded the Amazon Labor Union and has worked with current and former employees to rally support among the thousands who shuffle in and out of JFK8 and the neighboring warehouses every day. At a company meeting attended by Bezos, an Amazon attorney insulted Smalls’ intelligence as he emerged as a leading critical voice, according to a leaked memo obtained by Vice in the spring of 2020. “He’s not smart, or articulate, and to the extent the press wants to focus on us versus him, we will be in a much stronger PR position than simply explaining for the umpteenth time how we’re trying to protect workers,” Amazon General Counsel David Zapolsky wrote, according to notes from the meeting. Smalls didn’t let that go unnoticed in declaring victory on Friday. “@amazon wanted to make me the face of the whole unionizing efforts against them…. welp there you go!” Smalls tweeted. While pro-union workers on Staten Island won their vote, workers voting in a separate union election at an Amazon warehouse in Bessemer, Alabama, appear to have narrowly voted against joining RWDSU, but a final result in both elections may come down to challenged ballots. This is RWDSU’s second union vote at the Bessemer warehouse; the union lost by a wide margin in a 2021 vote but successfully argued to the National Labor Relations Board that Amazon improperly interfered in the vote and secured a second election. The Staten Island warehouse workers’ victory could open the floodgates for more organizing at Amazon facilities across the country. Already, at a separate Amazon warehouse on Staten Island – known as LDJ5 – employees organizing with the Amazon Labor Union have secured an election and are set to start voting in late April.

N THE WINTER of 2021, Chris Smalls took a trip down to Bessemer, Alabama, to lend his support to workers at an Amazon warehouse who were voting on whether or not to unionize with the Retail, Wholesale and Department Store Union. Smalls had been fired as an employee at Amazon’s massive warehouse on Staten Island – known as JFK8 – a year prior, after protesting COVID-19 health precautions at the facility, and was emerging as a leading critic of the company’s warehouse conditions. At the time, Smalls said he hoped to take the organizing energy in Alabama with him. “That’s my plan, to bring it back up here to New York, and try to organize even my former facility,” Smalls told City & State that February. But the RWDSU drive in Alabama failed in 2021, and a redo of the vote is still too close to call, with votes in favor of

It’s been a few days since your historic win. What has it been like for you? Definitely a whirlwind. I’m just consistently doing a lot of interviews. I was able to sneak away to get back to the Amazon building a few times. I was able to go out and rejoice in celebration with the workers in front of the building. Right now, we’re gearing up for our second election, and I think we’re all excited to get back on the campaign trail. What’s the vibe on the Staten Island campus – and what are current workers telling you about what it’s been like to return to work since the win? My organizers are now being treated like little celebrities in the building. They walk in there, people are cheering, people are happy, people are crying, people are rejoicing. It’s beautiful, it’s a great feeling. I’ve still got organizers who haven’t been to work yet, so they’re eager, they’re ready to go back so they can see their co-workers who they helped sign up, because they all made history. I heard that when we won, in both buildings, workers inside were cheering and clapping. I still haven’t seen a lot of the people that I helped sign up, so I can’t wait to go back out there later today. Are you expecting a similar result in the union election later this month at the LDJ5 facility? Are there any major differences between the two warehouses that change your approach to the organizing process? There might be some dif-

unionizing trailing votes against, and a large number of contested ballots still left to litigate. While RWDSU spent the past year securing a second election in Bessemer and organizing workers there, Smalls has been busy taking his own approach in New York. In the past year, Smalls officially formed his own independent union – the Amazon Labor Union – successfully petitioned for a union election, and last week won that election, making JFK8 the first unionized Amazon warehouse in the country. Smalls may have picked up some lessons from his trip to Alabama in 2021, but his own effort was unique – not backed by an established union, but independently organized, funded by donations on GoFundMe and driven by current and former employees at the warehouse. Smalls hasn’t had much time to catch his breath since the win. He’s been celebrating the ALU’s historic victory with his fellow organizers and the 2,654 JFK8 employees who voted to join the union last week. Much of his attention is now devoted to a union election at a second Staten Island Amazon warehouse – known as LDJ5 – happening later this month. And he’s aware that Amazon is likely to put up a fight as it reels from the result the company spent millions to prevent. Smalls spoke with City & State about the next steps for the Amazon Labor Union and why grassroots organizing was key to their success. This interview has been edited for length and clarity.

ferences, for sure. We’re not going to get overly confident, we know that (Amazon is) still union busting every day. So we’re just staying grounded, and we’re going to continue to build this union. We are planning our blitz – what we like to call a blitz – within the last two weeks. I think my team is prepared and we’re ready, and we’re hoping that we’ll be successful again. You did this as an independent union, and there were doubts expressed about whether you could do this independently, without the help of a major established union. But obviously you did what those major unions have failed to do before. To what extent was the independent aspect of your approach actually a strength? It worked because we are the actual workers of the company, who know the ins and outs of the company. We live the reality of these grievances that people hear about in the media. We are the workers that come from the community that we had to help educate about unions. Hearing information about unions from a co-worker that’s been there – for example, some of my lead organizers that have been there, like Derrick Palmer, he’s a six-year vet – just sounds way more convincing than having an established

union where they don’t know what Amazon is. They have to learn what Amazon is, how it operates, what’s the language, the culture. They have to learn so much to even step foot into the realm of trying to organize the co-worker. Compared to us, you know, we are the ones who invested our lives into this company for several years. So it’s just a different relationship that we have when it comes to organizing our co-workers. It just worked for us. The independent route, it has no history that Amazon can use against us – no reputation, no bad contracts, they can’t use anybody’s salary. They can’t use a lot of different propaganda that they would use on traditional unions against their own workforce. You said on Twitter that you have heard from workers at 50 different Amazon buildings across the country about organizing since your win. Do you hope to expand ALU’s reach to other states, maybe help people set up their own local ALUs? Yeah, absolutely, that’s the plan. We definitely heard from workers, and they’re saying directly that they want to unionize their building. They’re saying that we inspired them. I got emails saying that I lit a fuse under them, I lit a fire. Workers are paying attention now, which is beautiful. And we absolutely want to

How are you feeling about the collective bargaining process that still lies ahead now that you’ve won the union vote for JFK8? Are you predicting a long and strenuous process of negotiating a contract based on what we’ve seen in Amazon’s resistance to this and other unions? We don’t expect Amazon to sit down at the table, especially with somebody like me and the ALU. They’re not gonna want to negotiate with us right off the bat. We’re walking and chewing bubble gum at the same time. Of course, we’re working on our contract proposal right now, but we’re also still just focusing on the next two and a half weeks. We’ve got to win this second election, because we want to show workers that it wasn’t a fluke the first time around. We want to make sure that they understand that this union is powerful, and it’s going to continue to grow. Once this election is over, we’re going to jump right into forming our negotiating team and bringing in more legal representation. We’re in the process of interviewing different lawyers and different people who we want to make sure have the workers’ best interest. That’s what we’re doing right now in the short term, and then obviously, we’re gonna jump right into it. We’ve seen some actions from Amazon since the

help them. As soon as we can finish up here in New York, especially with the second election, we’ll have a little bit more leeway to start to branch out. We’ve got people right here in the tri state – New York, New Jersey and Connecticut – that want to start ALU chapters. So we absolutely are going to help people out as much as we can. We hope that this will be nationwide.

4 TIMES NEW YORK AND AMAZON HAVE RECENTLY CLASHED vote – they have suggested that they could try to contest the outcome and companywide, they’re talking about banning words like “union” from an internal messaging app. What do you think about some of these responses? This company is the ultimate anti-union machine. They’re going to spend millions of dollars no matter what. And that’s expected. So I just don’t get caught up in it. I know that we won undisputedly, I don’t know how they’re going to contest that. The challenge that they’re planning on presenting to the (National Labor Relations Board) doesn’t even make sense. They’re trying to say the board cheated in this election, it’s ridiculous. The election was run completely fairly. And of course, there are some things on our end that we can challenge as well, but we won, so there’s no need to. We’re just hoping that the board will make the right decision and dismiss it. But we know – and everybody watching it live knows – that we undisputedly beat Amazon by over 500 ballots. You’ve had a lot of doubters throughout this process. Do you have any message to them about the win last week and what lies ahead? My only message is they underestimated who we are and who I am as a person, what I was to this company. I invested almost five years of my life, I was a well-respected supervisor, I opened up three facilities. Sometimes you can’t just prejudge the situation. A lot of people counted us out, and we knew that. It’s unfortunate that people counted us out, but I’m just happy now that we’re able to prove a lot of people wrong. And prove that we can accomplish anything when we come together.

NOW THAT THE Amazon Labor Union was victorious in its efforts to unionize Amazon’s JFK8 on Staten Island, it is setting its sights on another Staten Island warehouse, and union President Chris Smalls said he had been contacted by 50 other warehouses since their win. The equally contentious history between the e-commerce giant and New York City and state extends further back than this unionization vote. Here are four times that Amazon and New York lawmakers and workers had public conflicts. AMAZON FAILED TO GET A HEADQUARTERS IN QUEENS In 2018, Amazon announced that HQ2, its second headquarters, was planned to be split between two locations: Arlington, Virginia, and Long Island City, Queens. Soon after the announcement from then-CEO Jeff Bezos, many New York politicians and unions opposed the deal because of poor working conditions at Amazon warehouses, the tax breaks offered and the threat of displacement. Between pressure from progressive lawmakers, including Rep. Alexandria Ocasio-Cortez, state Sen. Michael Gianaris and the Retail, Wholesale and Department Store Union, it was too much to overcome, and Amazon pulled their plans to build HQ2 at the Anable Basin site in favor of just developing in Virginia. UNIONIZATION STARTED SOON AFTER JFK8 OPENED JFK8, the warehouse on Staten Island, was already starting the process of forming Amazon’s JFK8 warehouse on Staten Island

a union prior to the announcement of HQ2 in Long Island City. In 2018, the Retail, Wholesale and Department Store Union was in talks with some workers who were organizing at the facility. But with the massive amount of media attention that came with the HQ2 announcement, the union’s effort fizzled. AG INVESTIGATED FIRING OF CHRIS SMALLS Chris Smalls was fired in 2020 for protesting Amazon’s policies and working conditions at the outset of the pandemic. The company said he violated its COVID-19 policy. He said he was just one of many reports of employees facing retaliation from the company for protesting the company’s health policies. His firing sparked an investigation from state Attorney General Letitia James, who began interviewing workers at centers across the state to try and look into complaints of retaliation. James was interested in learning about the company’s allegedly relaxed social distancing policies that were endangering employees like Smalls while they worked in close proximity to one another in an enclosed warehouse. JAMES’ INVESTIGATION LED TO LAWSUITS New York state sued Amazon in February 2021 for allegedly providing substandard safety protections against the coronavirus and its spread in the company’s New York warehouses. But, before James filed the suit, Amazon preemptively filed its own, arguing that workplace safety and conditions were not a matter of state law but rather federal, attempting to render James’ forthcoming lawsuit moot. Amazon tried moving the case to a Brooklyn federal court, but a judge rejected that maneuver. James would be able to bring the case back to a New York state court. – Candace Pedraza

ON A RECENT FRIDAY morning, following his 5 a.m. exercise regimen, New York City schools Chancellor David Banks was traveling across the Verrazzano Bridge from Staten Island, where he had just met with students and staffers at Bridge Preparatory Charter School. The visit held special significance for the chancellor and the man who appointed him, New York City Mayor Eric Adams, because the unique school is set up for students in grades one through five with the learning disability dyslexia. Universal screening for dyslexia was among several new initiatives promised by Adams – who was an undiagnosed dyslexic student. As the head of the city Department of Education, Banks said he wanted to learn more about “the issues of literacy and dyslexia at the early ages.” The next stop on the chancellor’s schedule was in Manhattan for the launch of the

Smith Mobile Prostate Cancer Screening Unit, which will help address the extremely high incidence of prostate cancer in Black communities. “It’s not a K-12 issue,” Banks said of the initiative supported by Black billionaire venture capitalist Robert Smith of Vista Equity Partners. But the chancellor said instilling in children – particularly children of color – the importance of health and doctors visits was an important message for the city’s public school students. While traveling to his next appointment, also in Manhattan, Banks revealed the reason why his schedule has been packed with events, appearances and chances to meet students, parents and staff since he took office on Jan. 1: accountability. “A lot of parents just don’t trust the DOE, and they’re very upset with things that happened during the prior administration,” he told City & State. “I real-

ly want to hold the mayor and (myself) to account for engaging them, authentically,” he added. “The parents don’t want to be sidelined; they want to have a seat at the table – and they should!” Banks has vowed to fight bureaucracy in the public schools, noting that for far too long, the system has failed to help enough of its students, parents and teachers. The 62-year-old Brooklyn native said his plan is to transform the department so that it works for everyone, something that his predecessors have also tried – with mixed or no results. The difference is that Banks has taken on that charge as a graduate of the public school system and as a former teacher. Plus, he brings years of experience from leading The Eagle Academy Foundation, a network of all-boys schools in New York City and Newark, New Jersey, that provides a private school experience in a public school setting. What he’s facing now is a city public school system that spent $38 billion on the current school year and continues to struggle with long-standing inequities for a student population that dipped to 870,000 students – a 10% drop since 2019. The school system also remains heavily segregated – an ongoing issue former schools Chancellor Richard Carranza unsuccessfully tried to fix before stepping down last year. Plus, there remains the issue of the gifted and talented program, which has been criticized for excluding students from communities of color and which then-Mayor Bill de Blasio’s administration had intended to phase out. Cory Booker of New Jersey on educational matters – has consulted with Adams and studied the city schools’ issues for the past eight years while the mayor was Brooklyn borough president. There were other contenders for the chancellor’s position, but Adams called his contacts and consultations with Banks “an eight-year interview process.” Banks also has ties to other Adams administration appointees. Former United Way of New York City President and CEO Sheena Wright, who is now deputy mayor of strategic initiatives, is Banks’ domestic partner. The chancellor’s brother – former NYPD Chief of Department Philip Banks III – also serves as deputy mayor for public safety. Despite mayoral control likely being

ousted from the final state budget, Banks said he still hoped Adams would continue in that role, long enough to implement their new outlook for the system. “I refer to it, and the mayor refers to it, as ‘mayoral accountability.’ I think language matters. Nobody wants to feel controlled. I avoid the use of the term mayoral control,” he told City & State. “That’s the way it’s written up in the law, so people still refer to it that way.” “Essentially what we’re saying is that in a system this large, somebody ultimately has to be held accountable for performance and what’s happening to our kids,” said Banks, adding that part of the reason why people have pushed back against mayoral control is because families are not being engaged by the department. “I surely expect, once we finish here with the work we’re doing, you won’t hear people screaming about this because we’re engaging everybody – elected officials, parent groups, (Community Education Councils), activists. We’re talking (about) everybody. I think people feel like, finally, they are being fully engaged, and that’s a big part of how we move.” Before becoming chancellor, Banks was a founding principal of The Eagle Academy Foundation in 2004 and later would become CEO and president of the school network. While Banks still notes recent Eagle Academy graduation and college acceptance rates on his LinkedIn page – the chancellor has also made it a priority to promote the talents of New York City public school students as part of his accountability and engagement strategy. “I have worked in this system for over 30 years. I know that every young person who attends our schools, across the city, is filled with brilliance, potential, promise and gifts,” Banks said at a December press conference outside his elementary school alma mater, P.S. 161, in Crown Heights, Brooklyn. “And I also know something else – that they exist in a school system which is fundamentally flawed,” he said. “I’m not talking about the teachers,” he added very quickly. “I’m not talking about the principals. I’m talking about the very architecture of the way that we do school in the first place,” said Banks, vowing that “change is coming” to the country’s largest public school system. Banks unveiled four “pillars” of his anticipated changes at a press gathering at the department’s headquarters in the Tweed

Courthouse in Manhattan last month. The planned changes include reimagining the student experience to prepare them for job opportunities. “What are we doing if we’re not producing young people who can take some of these new jobs, (for example in the) fintech (or) biotech industry?” asked the chancellor, adding that educational support is needed for teachers as well. Banks is also focused on “scaling, sustaining and restoring what works.” This was the rationale, he said, behind eliminating the system’s nine executive superintendents, while assessing the current superintendents in the system and providing them with more resources and responsibilities. Banks voiced support for innovative and successful programs working “in spite of” DOE bureaucracy and said “we’re going to celebrate our teachers, our principals, (and) the great work that’s been going on in our schools like you have never seen before.” Banks mentioned his desire to restore the Learning Partners and Showcase Schools programs. Started by then-schools Chancellor Carmen Fariña, both programs highlighted successful initiatives of individual public schools and shared them throughout the system. “We need to do a much better job of tell-

ing the public about the great work that is actually going on in our public schools, so that they will continue to build a deeper level of trust with us,” said Banks, adding that schools can get better by hearing of the progress at other schools. He also wants to prioritize wellness and its link to students’ success. This priority included maintaining safe schools, increasing the number of school safety agents, getting access to green spaces, taking cultural and scientific field trips, providing high-quality nutrition and conducting comprehensive support for students’ needs. One example, based on a concept Adams has described as going from “pregnancy to profession,” is the start of a citywide doula program, with experts providing support to pregnant women. Banks said the last part of his plan focused on making parents and families “true partners” and building their trust. “I want to make sure that our parents are part of this process of reform and moving forward, and not (just) a photo op after the decisions have already been made,” he said at the Tweed Courthouse. United Federation of Teachers President Michael Mulgrew, while noting the frustrations of working with the education department’s bureaucracy, said the union

remained open to Banks’ plan. “Deeper involvement of parents, and better preparing students for further education and the workforce, are long-term goals of the UFT,” Mulgrew said in a statement after the chancellor’s Tweed Courthouse speech. “But as we have often found, change comes slowly to the city’s Department of Education. It’s going to take a con-

certed effort to meet these ambitious goals, but we look forward to being part of the team to make this happen.” Mark Cannizzaro, president of the Council of School Supervisors & Administrators, told City & State that Banks has provided a “promising vision” in his first three months. “The biggest challenge, as always, will be putting the right people in place in order to effectively and efficiently implement that vision,” Cannizzaro said in an emailed statement. To help enact his plan, Banks selected Kenita Lloyd, the former chief operations officer at The Eagle Academy Foundation, to serve as his deputy chancellor of family and community engagement and external affairs. He said Lloyd will help “to fully transform the work of engaging our parents and families in this process.” A PERSISTENT BUREAUCRACY The city’s educational system has weathered criticisms for years, even after the former Board of Education shed its name to become the Department of Education under Mike Bloomberg’s administration and relocated its headquarters from Brooklyn to the Tweed Courthouse in 2002. Despite the move, which ushered in the era of mayoral

control, dysfunction still followed. Bureaucracy has long been associated with the schools. In a 1990 New York Times article titled, “In School Bureaucracy, Despair at the System,” Joseph Berger wrote that Board of Education workers seemed “trapped in the same bureaucratic labyrinth they are often accused of creating.” In the 2003 New York Times article, “So Long, School Bureaucrats: 110 Livingston Is Being Sold,” about the sale of the former Board of Education building in Brooklyn, Michael Cooper wrote that the old headquarters was “more than a location or a shorthand name for the institution it housed, the city’s Board of Education. It symbolized a state of mind, a failed system that was at once imperious and impervious.” In the same article, Cooper quoted Bloomberg as saying the city’s public school system was defective. “This sale will redefine the address 110 Livingston, which was for too long synonymous with a dysfunctional bureaucracy that served itself instead of our children,” Bloomberg said. Despite the change of venue and aspirations of the Bloomberg administration, the new department still came along with its “bureaucratic labyrinth” and has remained traditionally dysfunctional and resistant to change, at least according to critics. A CHANCELLOR’S FOUNDATION AND TRANSFORMATION Meanwhile, Banks’ time in the bureaucracy – as a student, teacher and administrator – was not always unfortunate. Banks said his “foundation” started at P.S. 161, before his family moved to Southeast Queens, where he would graduate from Hillcrest High School. Banks recalled the teachers at P.S. 161 who made lifelong, positive impressions on him during the December press conference at the school. “I remember every teacher that I had in this school. But there was a teacher who I had in the fourth and the fifth grade who transformed my life,” said Banks, referring to P.S. 161 teacher Mildred Scott. “I have a picture of Mrs. Scott,” proudly hoisting the framed photo and pivoting it for all members of the crowd to see. In addition to normal school work, Banks recalled Scott making extra effort to teach the fullness of history to her students, which included the countless, oftentimes overlooked, important contributions of Black people. Disruptive students who were removed from Scott’s classes would also get a dose

of Black history, as remembered by her daughter Cheryl. “If any of her students ever acted bad in the class, she would put a desk outside of the classroom and she would give them a book on Frederick Douglass or Harriet Tubman, and that’s how they learned part of their Black history,” she said, adding that “they weren’t (formally) teaching it in the schools back then.” For Banks, Scott’s teachings were vital, lasting gifts that went beyond history lessons. “It was in this building that Mildred Scott taught me Black history – not just reading, writing and arithmetic, which are critically important. And you need that,” he said. “But she taught me who I was. And she taught about the people who fought, bled, died and sacrificed for me to have the opportunity to be all that I wanted to be and the responsibility to my community.” Banks recalled later in an interview with City & State that Scott took him and other classmates to speak before NAACP and Congress of Racial Equality community meetings with hundreds of people in attendance. Community responsibility became elementary for the chancellor, first instilled by his parents – his mother was a secretary and his father a city police officer – and reinforced by Scott and his later studies at Brooklyn’s I.S. 320. It was the sort of student engagement that stood out for Banks, and it would last a lifetime. Years later, Scott would speak at the wedding for Banks’ first marriage. He recalled that she was “the highlight of the whole ceremony.” Scott’s daughter added that Banks stayed in contact with her mother years after her retirement, until her death. Most weekday mornings for the past 10 years, Bill Gunlocke has been holding a sign on the sidewalk in front of Tweed Courthouse that reads, “Why Not Teach Every School Kid to Read Well.” After a decade of trying to get some traction for his pro-reading message, Banks on a recent morning was the first city schools chancellor to stop and have a conversation with him. “I love the new chancellor, but he’s going to have to bust a move here, you know what I mean?” said Gunlocke, a former Cleveland school teacher who noted the school bureaucracy has prevented change. “It just can’t be business as usual,” he said. “Because business as usual is not getting it done.”

DARIUS DORSETT Firefighter Corey Boykins sued the FDNY, New York City and Darius Dorsett alleging he was harassed and discriminated against because he is gay. Boykins claimed in the lawsuit that his colleagues directed homophobic slurs at him. When he took his concerns to Dorsett, thenchief diversity and inclusion officer, he allegedly encouraged Boykins to sleep with women. Dorsett has been removed from the role. Finally, a win against bad landlords. Moshe Piller was hit with a lawsuit from New York City regarding nearly 2,000 violations across the almost 1,000 apartments under his purview. This isn’t Piller’s first rodeo; he had been sued before for rent overcharges.

CHRIS SMALLS Amazon should be careful what it wishes for. A year ago, a top lawyer at the company said in a leaked memo that making Chris Smalls – a fired supervisor at a Staten Island Amazon warehouse who had started to criticize the company – the face of the union movement would help Amazon, calling Smalls “not smart, or articulate.” Now, Smalls has helped form the first unionized Amazon warehouse in the country.

Having a Manhattan dinner together was so good the first time, New York City Mayor Eric Adams and former Gov. Andrew Cuomo decided to do it again. Cuomo this time joined the mayor at Daniel Boulud’s Le Pavillon near Grand Central Terminal. Not a bad follow up to their two-hour dinner at Midtown hotspot Osteria La Baia in February. Being seen with Adams may be part of Cuomo’s comeback strategy. One thing’s for sure, Cuomo may be out of a job, but he’s not going to be starving.
