LAST WEEK, a progressive political consultant, speaking on the condition of anonymity, commented about the recent allegations levied against New York City mayoral candidate Scott Stringer. “In 2021, straight white men are not trustworthy, and he’s only confirming the suspicion that everyone has about what happens when straight white men gain power.” Stringer responded to the accusations made against him by Jean Kim, a lobbyist and former volunteer on his unsuccessful 2001 campaign for New York City public advocate, who alleged that he subjected her to sexual harassment and abuse. Stringer has denied the allegations and said that he had a consensual relationship with Kim. Yet the allegations still threw his campaign off the rails. And the consultant’s observation brings to mind how other white men in power have been caught acting inappropriately with women. With Stringer, currently New York City’s comptroller, just being the latest white man accused of such behavior, one has to wonder if this crisis will ever stop. Accountability, for now, is the only answer, and it must start with the very people who are accused. They should acknowledge that such conduct is unacceptable and that every accuser must be heard, before launching into any kind of defense. Also, a politician or candidate for office who’s got one of these skeletons in their closet cannot just hope that it will never come out. It’s better that they spend their time addressing the issue and table their ambitions, rather than pretending that their past won’t come back to haunt them.

Rudy Giuliani has been in a reputational freefall for years, but last week marked yet another low point for the man once known as America’s Mayor. The FBI searched and seized items from the former New York City mayor’s apartment in its investigation into his Ukraine business dealings. Former President Donald Trump came to Giuliani’s defense, but unfortunately for Giuliani, support is just about all that Trump can offer him these days.

For the first time since the state Legislature rescinded Gov. Andrew Cuomo’s expanded pandemic powers, lawmakers voted to do away with several of his restrictions that were still in place. Chief among them was doing away with the requirement that one had to buy food with alcohol, which had given rise to “Cuomo chips” – the name that some bars gave to the food item they were required to sell in order to do business. In another victory for the restaurant industry, Cuomo also announced that he would revoke the curfew he had in place for bars and restaurants, meaning that they can once again remain open past midnight beginning in May for the first time since November.

city was still struggling through the beginning of the pandemic. Bolstered by some $13 billion in direct federal aid for schools and other purposes, plus over a billion more in FEMA reimbursements, de Blasio announced big new spending proposals for the city. But while he expressed confidence that going big is the best way to help the city recover and grow economically, his own budget projects multi-billion budget holes for the next several years that his successor will have to address. Plus, the next mayor will have to figure out $1 billion labor savings that were built into future budget projections without specification.

CUOMO WELCOMES BACK THE PRESS For the first time since December 2020, Cuomo held an outdoor press conference that reporters

were able to attend. The governor was facing ongoing questions about why he continued to hold only virtual press conferences where he had complete control. He has not held any outdoor events in Albany yet, the only kind that he said the press could attend, but a couple members of the Albany press corps gamely took the hourslong trip to Syracuse to question the governor in person again. At the same time, new reporting from The New York Times added fuel to the fire of the governor’s ongoing COVID-19 nursing home deaths scandal. The Times found that Cuomo’s aides went further than previously known to prevent data on those deaths from getting released, keeping the totals artificially low, and had on multiple occasions overruled Health Department officials to keep the numbers from getting out.

Prisoners now receiving COVID-19 vaccines Soon after prisoners in New York correctional facilities sued Gov. Andrew Cuomo and won, they began receiving hard-won COVID-19 vaccinations. The Department of Corrections and Community Supervision wrote in a statement to City & State that it began offering the Johnson & Johnson vaccine to all incarcerated individuals on April 6. As of mid-April, 894 incarcerated individuals and 23 staff members had been vaccinated through this effort. Getting shots in the arms of inmates to begin with, however, has been a battle. On March 30, a judge ordered the state to administer COVID-19 vaccines to prisoners after a lawsuit from a coalition of advocates argued that Cuomo and state Health Commissioner Howard Zucker had unfairly denied prisoners access to the vaccine. Meghna Philip, a staff attorney at the Neighborhood Defender Service of Harlem, one of the groups who brought the suit, was involved in every stage of the litigation and argued the case before the judge. Philip said that her organization had tried contacting the governor and his office and advocate “in any way we could.” But after receiving no response time and time again, they resorted to legal action. Philip said part of the suit cited the fact that people in every other kind of congregate setting were eligible for the vaccine and that the exclusion of incarcerated adults felt intentional. She found it mind-boggling that those in juvenile detention centers were even eligible, along with prison staff, but adults who were incarcerated (and didn’t have another qualifier for the vaccine) were not allowed to get the vaccine. The judge, in ruling with the coalition of advocates, agreed. She wrote that the state “irrationally distinguished between incarcerated people and people living in every other type of adult congregate facility, at great risk to incarcerated people’s lives during this pandemic.” In her decision, she said there was “no acceptable excuse for this deliberate exclusion as COVID19 does not discriminate between congregate settings.” In response, Philip said, “It’s worth noting that the judge’s decision really underscores the fact that the state was neglecting its duties to incarcerated people for several months. It is a reflection of, throughout this pandemic, the deprioritization of the lives and safety of incarcerated people.” – Nuha Dolby

A Q&A with former NYC 2020 census czar

After hearing that New York state would lose one congressional seat, but missed out on keeping it by 89 people, what was your initial reaction? Was it a victory that New York avoided the worst-case scenario of losing two seats or disappointment that we almost kept all our seats? It was absolutely a victory in the sense that we staved off the worst result, which had been feared. Every pundit, every observer two years ago felt that New York was going to lose two congressional seats, and I think it really was a testament to the

organized effort that we put in that we got to the point where we lost one. It’s never good to lose any, of course, but we lost one and we almost lost none. Since World War II, this is actually the best result on the census in terms of a loss of congressional representation, to lose just one seat. I will say, however, that it is beyond frustrating to know that we almost lost no seats. And certainly, if the Trump administration had not cut our work short by two weeks … in those two weeks, of course we could have counted those additional 89 people and then we would have lost no seats. So that is the

first frustration. And the second one would have to be the state and Gov. (Andrew) Cuomo because, at the end of the day, the city spent two years organizing. New York City beat almost every other city across the country on the census because we had a well-organized effort. … The governor refused to allocate funding until the census was well underway, and even at that only a fraction of what was needed. … We really were in a go-it-alone approach, unfortunately, with no partnership from the state. And if you look at the numbers upstate, downstate, you can really see that.

What do you think the state should have done and can you explain what difference it would have made if those funds had been released earlier? If you look at the state of California and what that state decided to do, in terms of allocating close to $180 million of funding. And then you look at what New York state did. They kept saying that they would allocate funding but they didn’t, and then the census was underway. If you contrast with the city of New York – I was appointed census director in January 2019. I then spent that time organizing a community grants

approach. That takes time to put in place because of government, distribution and procurement rules. … But the state, on the contrary, opted not to do that, and only reluctantly, after quite a bit of badgering, ended up allocating $20 million well after the census had already begun, and then COVID hit. … And not to mention the governor had the power of the bully pulpit, with the COVID briefings. Where was he in using the power of the bully pulpit to help our state? … We asked so many times for his briefings to include messaging on the census like we did at the city. - Kay Dervishi

up and said to Maya, ‘I want to be able to do this,’ she would help you kind of figure out how to best do that,” said Anthony Giancatarino, who joined the Center for Social Inclusion as a researcher in 2010. “And I found her someone who’s willing to listen, to challenge you.” “Visionary” was a word used to describe Wiley by multiple people who worked with her at the nonprofit, including Sargent. Although its roots are in New York City, the Center for Social Inclusion began work on racial inequality in the South and on issues including broadband access, transportation, food inequity and energy as its national work ramped up and Wiley expanded its reach. It’s hard to point to concrete victories that the Center for Social Inclusion achieved, or even a specific policy it helped to implement, but those who have worked for the organization have credited it with helping to shift policy conversations to be more explicitly race-centered under Wiley’s leadership. “Advocacy groups and policy groups all wanted to be race neutral – they just wanted to talk about class at that time,” said Dennis Chin, who joined the Center for Social Inclusion in 2011 and and still works for Race Forward. “Because of Maya’s visionary and principled leadership … and the partners that we’ve worked with across the country, it played a huge part in making sure that racial equity was central to policymaking.” Chin’s assessment is difficult to prove or quantify, but it’s clear that Wiley’s profile began to rise in the later years of her time as president and executive director of the nonprofit. She began appearing on MSNBC as a guest expert in the field of racial justice in the 2010s, long before she became a paid contributor to the cable network. Echoing both Chin and Sargent, Giancatarino considered Wiley “ahead of her time” when he worked with her in the way she centered racial equity in policy analysis. Wiley brought that mindset

with her into New York City Mayor Bill de Blasio’s administration when she joined in 2014 as the mayor’s counsel. “The influence that she had was really sort of bringing that social justice dimension to everything,” said Andrea Hagelgans, de Blasio’s former communications director and senior adviser for strategic planning. “She was always looking for opportunities to drive policy as well, and to think through the mayor’s agenda and how to use her role to reduce inequality in the city,” Hagelgans added, crediting Wiley for work to ensure that the administration enacted progressive policies including mandatory paid parental leave. While Wiley’s policy work has only been criticized for sometimes slow execution, according to Gotham Gazette, her role as the mayor’s lawyer has been more controversial. She offered advice on how to avoid conflicts of interest issues when fundraising for the nonprofit Campaign for One New York, defended de Blasio amid scrutiny of the nonprofit that led to multiple investigations and reportedly played a fairly significant role in vetting donors to that and another fund the mayor controlled. In a 2015 video, Wiley

said her job as counsel to de Blasio is to “keep him out of jail.” And she succeeded, after multiple investigations into the mayor’s fundraising practices did not result in criminal charges against him – although Manhattan District Attorney Cyrus Vance Jr. said de Blasio was not following “the intent and spirit” of the law. Wiley was even the first to coin

the now-infamous phrase “agents of the city” to refer to a group of informal outside advisers to the mayor as the administration fought for years to keep communications with them private. For her part, Wiley has said that she offered advice to de Blasio as his lawyer, but he didn’t always follow it. Wiley was not available for an interview for this piece and

her campaign did not respond to a detailed list of questions, but supporters and colleagues defended her. “We all have bosses we disagree with,” Blake said, pointing to the Department of Investigation probe that found that her advice was not always followed and that de Blasio had broken ethics rules. “The framing of ‘well she was there’ and therefore let’s hold that on

call,” Hagelgans said. “And I think she’s got tremendous judgment.” Wiley left the administration in 2016 and was appointed the chair of the Civilian Complaint Review Board, an oversight agency for the New York City Police Department. She often touts her role in this position when discussing police reform, and during her tenure the CCRB did investigate Pantaleo for Eric Garner’s death, substantiating the complaints and recommending his firing just days after she left the agency. But the one year that she was there was marked by complaints from police reform advocates over a lack of transparency and what some saw as a reluctance to confront the police department. “Over the last year, the CCRB has been disturbingly absent from the public debate about police misconduct and accountability,” Christopher Dunn, then the associate legal director for the New York Civil Liberties Union, Wiley is touting her civil rights record in her quest said when she left. to become the first woman to lead New York City. The advocate couldn’t think of any work from Wiley’s time at the Center for Social Inclusion that involved reforming the NYPD, the civil rights and racial justice issue at the heart of this year’s mayoral race. “I think she comes to the police reform work from a very grasstops place, as opposed to grassroots,” they said. One could presumably make the same argument about Wiley’s post-administration work as a professional pundit for MSNBC and a professor at The New School. But Sargent, who worked with Wiley in advocacy, disagreed with that assessment. “I’ve witnessed her work with grassroots organizing groups, community groups, to really raise their voices in, you know, traditional policymaking spaces,” Sargent said. “When I look back at her career, I see it all consistently building to what I think would be a really wonderful opportunity for the city of New York. It makes so much sense to me that she would be running for office.”

Quemuel Arroyo can envision a more inclusive transit system. It’ll take time for the MTA to see it too.

UEMUEL ARROYO IS attracted by transportation’s ability to close social inequities. That is a big part of what led him down the path he has taken, he said on an April morning in Battery Park, now serving as the first chief accessibility officer at the Metropolitan Transportation Authority. “I honestly believe that transportation has the power to drastically enhance a community and individuals’ lives,” he said, wearing a mask declaring “New York Tough,” “or if not done the right way, really create barriers that preclude someone from living their best life.” But the inequities he’s tasked with trying to overcome in New York’s transit system are enormous. That became clear as Arroyo, who uses a wheelchair after a spinal cord injury at 18, exited the park for a scheduled photo shoot in the nearby Bowling Green sta-

tion: The one elevator at the station was out of service. That occurrence is hardly a rarity in New York. While station elevators had overall availability of 96% in 2018, the advocacy group TransitCenter found that 84% of elevators reported at least a week’s worth of outages that year. That’s on top of the already dismal availability of elevators for people with disabilities, older adults and other New Yorkers. Just 25% of the 472 subway stations across the city have elevators. Arroyo said the closest subway station to his home in Harlem doesn’t have an elevator. And there are plenty of other challenges for improving accessibility across the MTA. For one, the paratransit service offered to New Yorkers with disabilities, Access-A-Ride, is often called “Stress-A-Ride” by users because of its inconvenience. While the creation of a new top level position at the MTA dedicated to accessibility has been celebrated by advocates for peo-

ple with disabilities, there is still lingering concern that the appointment won’t be enough to bring about big picture change. Some fear that Arroyo may not have enough power and influence within the MTA to bring a greater focus on accessibility. Some are worried that the position will be used as a public relations tool to make the MTA look as if it’s making progress while continuing business as usual. Given that Arroyo is still only about four months into the job, it remains to be seen if those concerns will be realized. For his own part, Arroyo is confident in his ability to bridge the gap between New Yorkers with disabilities and the MTA, despite a long, fraught history between the two. “I always say that my role is not to be where the buck ends, or to be the guy on accessibility,” Arroyo said. “I’m the guy who’s facilitating a conversation.”

RROYO’S FORAY INTO transit and accessibility led him to the New York City Department of Transportation in 2014, where he’d go on to become chief accessibility specialist. “When I first met with (then-Commissioner) Polly Trottenberg, I said to her, ‘I don’t see people with disabilities in the website, in your brochures, and I don’t hear that as an agenda item,’” Arroyo said. “That was our first conversation and she said, ‘Huh, funny enough, that’s one of the first things I noticed too. What are you going to do about it, like what’s your plan?’” During his five years at the city agency, the city built its first raised crosswalks which serve as speed bumps to slow drivers and allow older adults and people with disabilities to cross more easily. He also helped improve boarding on the Staten Island Ferry. “Most people don’t realize this, but tides change hourly, and if you are a person with a disability, your experience on and off a ferry could be quite different depending on the tide,” Arroyo said. The city went on to allow people to board ferries on the lower levels, which was previously prohibited for security reasons, to get around that barrier. Arroyo sees his role at the MTA as fairly similar to his role at the city Department of Transportation, except at a much, much larger scale. He’s tasked with bringing accessibility to the forefront throughout the MTA, which encompasses New York City Transit, the Long Island Railroad and Metro-North. “Weaving that narrative and that agenda throughout the entire organization is a pretty steep challenge because you’re dealing with very different organizations that have their own cultural identities, and now we’re bringing them together,

creating one identity,” he said. The MTA has historically been resistant to make changes that improve accessibility. The United Spinal Association, then known as the Eastern Paralyzed Veterans Association, was the first to take legal action against the MTA in 1979, arguing that the prevalence of inaccessible stations amounted to discrimination. The MTA argued in response that installing elevators in often old stations would be excessively expensive and difficult, and they would be used by few riders. But the lawsuit eventually led the transit authority to begin making improvements for passengers with disabilities. And with the passage of the Americans with Disabilities Act of 1990, those measures to improve accessibility became mandated by law. Thirty years later, significant swathes of the city’s subway system continue to fall short of the law’s requirements. Logistical challenges make it difficult to install elevators in old stations in a century-old subway system, and the installations continue to be expensive. According to the MTA’s latest capital plan, the cost of building new elevators in the city’s subway system averaged $78 million per station, far more than similar projects in cities such as Boston and Paris. Still, more efforts have been made in recent years to accelerate accessibility projects. Former New York City Transit President Andy Byford unveiled a plan in 2018 that aimed to make more stations ac-

cessible so that riders are never more than two stops away from a station with an elevator. He also hired Alex Elegudin to serve as senior adviser for systemwide accessibility, the first chief accessibility role at New York City Transit. Elegudin served as a predecessor to Arroyo. Most recently, the MTA’s 2020-2024 capital plan committed $5.5 billion to add elevators to 70 stations over five years. The COVID-19 pandemic and declining ridership devastated the MTA’s finances this past year, leaving those plans up in the air, though the MTA has continued some elevator installations throughout the past year. Advocates for people with disabilities are also concerned about how Access-ARide might be affected by financial woes related to the pandemic. The MTA has operated a popular pilot program to provide on-demand rides for $2.75 to about 1,200 Access-A-Ride users, which allowed passengers to bypass the inconvenience of scheduling rides a day in advance. The convenience has led users to take trips more frequently. The MTA proposed doubling the number of program participants in 2019, but while also capping monthly rides to 16 per user and capping the ride subsidy to $15 per trip, with the rest of the cost being paid out of pocket. That’ll get people less than four miles, according to estimates. That proposal frustrated some New Yorkers with disabilities who said the on-demand service was

a game-changer for them. “It would really not only hurt me personally but hurt my professional life if Access-A-Ride suddenly doesn’t work right or on-demand was suddenly gone,” said Eman Rimawi, an organizer at New York Lawyers for the Public Interest advocating to improve Access-ARide. “Because when I started at (New York Lawyers for the Public Interest) four years ago, on-demand wasn’t in place yet and I was taking traditional Access-A-Ride, and I was late the majority of the time.” Those changes were put off because of the pandemic, and Arroyo emphasized the pilot program will continue until the health emergency ends. But some changes to the pilot program will likely be coming in the future. “We can never deliver it to every Access-A-Ride member out there, I mean we have over 160,000 people that are part of the Access-A-Ride community and eligible for those rides,” Arroyo said, adding that making mass transit as accessible as possible instead remained a bigger priority. He suggested, as MTA officials have in the past, that New York City pay up a greater share of its paratransit costs. The MTA’s financial woes have improved in recent months, given that it has received more than $6 billion through the federal American Rescue Plan that has helped it stave off some of the worst-case scenario cuts discussed months before. But it remains uncertain how proposed capital projects will be affected even with the

federal aid. State Comptroller Thomas DiNapoli issued a report in April saying that the MTA will fall short of its $54 billion capital plan by about $2.9 billion because of outstanding debt. The MTA has contested that description, arguing that the billions in debt don’t need to be repaid until 2023 and that it’s too early to tell whether loans will be needed to carry out their plans. Frustration with the pace of change throughout the years has led many advocates for people with disabilities to see litigation as the most effective strategy to ensure progress. The MTA is currently embroiled in three lawsuits over its inaccessible subway system. “The MTA has a history of leaving us at the altar,” said Susan Dooha, executive director Center for Independence of the Disabled, New York. Her organization is a lead plaintiff in a class action lawsuit arguing the MTA is in violation of both the Americans with Disabilities Act and the New York City Human Rights Law because its stations largely remain inaccessible. Ideally, she and other advocates want to see the MTA commit to an actual timeline for full, system-wide accessibility. “The MTA should settle those lawsuits and then get down to the business of actually making the system accessible,” said Joe Rappaport, who heads the Brooklyn Center for Independence of the Disabled, which is involved in the three lawsuits. Arroyo wouldn’t speak to the specifics of the lawsuits faced by the agency. “I am

actively involved with all stakeholders on this in those conversations, ensuring that the disability experience is understood, that that disability community is heard … but really ensuring that my family, my new family at the MTA feels like they are not over-promising, they’re not under-delivering, and then showing that they do provide the best possible plan to the litigants to our plaintiffs.”

HIS LONG EXISTING tension between the MTA and riders with disabilities put Arroyo in a difficult spot. Most transit activists and advocates for New Yorkers with disabilities expressed praise for Arroyo and his intentions in the new chief accessibility officer role. But reforming a transportation system that has been slow to change may be difficult for one person alone to accomplish. Even with a senior-level position, it remains to be seen whether Arroyo will have the power and influence to actually change the MTA. Some are skeptical about what it means given the MTA’s checkered history. “It has seemed to me that the MTA has looked at its disability hires as people to push out the MTA’s messages to the disability community, in a kind of a PR effort,” Dooha said. Ben Fried, a spokesperson for TransitCenter, said: “The ultimate expression of that agency’s commitment to accessibility will be expressed through the budget. And that’s how we’re going to know if this has made a difference.” Arroyo has laid out several priorities when it comes to accessibility initiatives. He joined other MTA officials in unveiling a new “Zoning for Accessibility” proposal this March, which would incentivize real estate developers to build and maintain elevators that are connected to their buildings at nearby stations outside of Manhattan. Similar collaborations with the private sector could be a good opportunity to circumvent the bureaucratic slowness of government. “We need to start trusting the private sector to deliver the changes that we want to see happen in the public realm, and to do that we need to engage them and have conversations with them,” Arroyo said. Using technology is also a priority, such as providing real-time data for elevator and escalator outages and visually displayed announcements for people who are deaf or hard of hearing. “Something that most people won’t say is that we share a lot of the goals that the advocates have, and that the public has, and we want those same enhancements that a lot of people shout and scream about,” he said. “However, we understand the resource constraints that we face.”

Advocates say Cuomo has ignored people living with disabilities too often.

UMOR AND Gov. Andrew Cuomo have not always gone well together in recent years. One incident of note was the way the governor talked about his brother, CNN host Chris Cuomo, to a group of state Democratic Party dignitaries in 2018. “It’s actually a funny story,” the governor said. “He was found at our front door in a basket and he was 16 years old. So he has certain development issues.” The governor has delivered high-profile policy victories for historically disadvantaged groups. His record includes the legalization of same-sex marriage, criminal justice reforms, expansions of the social safety net like paid family leave and a domestic terrorism law aimed at combating antisemitism. But advocates for people with disabilities offer mixed reviews about his record during three terms in office. “The past several years have been tough,” state Senate Disabilities Committee Chair John Mannion of Syracuse said in an interview. “As it relates to people with disabilities, they seem to be the first to get caught and the last to be invested in.” Cuomo’s record with people with disabilities belies the image he projects as a justice warrior. Their needs have gone missing in gubernatorial pet projects. Legislators and advocates warn state support for key programs has remained relatively flat in recent

years despite the growing need. And then there are the times when people with disabilities have faced the governor’s political wrath for seemingly no real reason. His once-celebrated COVID-19 briefings last year were a good example of this last point. “We are Americans at the end of the day,” he said on March 17, 2020, at the onset of the coronavirus pandemic. “That’s who we are and that’s who we are when we are at our best so this hypersensitivity about politics and reading every comment and wanting to pit one against the other – there is no time for this.” Yet, this message was not reaching deaf people because the Cuomo administration had not hired an American Sign language interpreter yet. “They didn’t want to extend the service,” Jessica Barlow, a senior staff attorney at Disability Rights New York, said in an interview. “He seems to be rather dismissive of the disabled community.” A lawsuit by the advocacy group eventually forced the governor to share the screen with a sign language interpreter. The episode highlights a disconnect between the rhetorical support that the governor offers people with disabilities and the concrete help that he delivers to people with physical or intellectual disabilities. “You can talk the talk, but walking the walk is where the money is,” Matthew Shapiro, associate director of public affairs at the National

Alliance on Mental Illness, said of the governor in an interview. The recently passed $212 billion state budget offers a few examples of how Cuomo has leveraged funding for programs benefiting people with disabilities to meet the greater political end of passing a budget to his liking. About 1 in 5 New Yorkers have some type of disability, according to the state Department of Health. Those numbers cover a range of conditions from blindness to mobility issues to autism spectrum disorder, but the people who arguably need the help of state government the most are the more than 100,000 New Yorkers who receive services from the state Office for People with Developmental Disabilities. “Every year, we have to fight to just maintain the budget,” Assembly Member Thomas Abinanti of Westchester County, who chairs the Committee on People with Disabilities, said in an interview. This included getting the governor to back down from a proposed $93 million reduction for the office’s services. Lawmakers and activists also had to push Cuomo to give up on deferring a costof-living adjustment for nonprofit workers who deliver services on behalf of the agency. The governor justified these proposed cuts because of the budget deficit that existed before billions of dollars arrived from the latest federal stimulus package and higher

taxes on wealthy New Yorkers. And once the money arrived, any increases for programs benefiting people with disabilities had to be balanced with restoring cuts to other government agencies while directing resources to the state’s recovery from the pandemic. Yet, hundreds of millions in federal stimulus funding for supportive services remain unused after state legislators made the governor give up control of it, according to Abinanti. “He made a big, big deal in his budget (proposal) about a crisis response program – didn’t fund it,” Abinanti added. “There was no money in the budget to fund it.” A provision in the state budget permits the state to direct more stimulus money toward programs benefiting people with disabilities once federal guidance is received, according to Department of the Budget spokesperson Freeman Klopott. “This administration cares deeply about supporting New Yorkers with developmental disabilities and their families,” he said in a statement. An 8% increase for the Office for People with Developmental Disabilities in the new state budget, and other increases for certain support services, are two demonstrations of the administration’s commitment, he added. This hardly means that the governor had done nothing for people with disabilities during his time in office. His early years included pushing for accessible New York City

taxis and updating the outdated “handicap” symbol created four decades ago. Cuomo established the Justice Center for the Protection of People with Special Needs in 2012 to monitor state agencies and nonprofit contractors for abuse. Despite some scandals, the state as a whole appears to be doing a lot better at taking care of people with disabilities compared to decades ago when it operated state institutions like Willowbrook on Staten Island. The recently passed budget for example increased the minimum wage for caregivers, which could reduce staff attrition rates. Ongoing efforts by the Cuomo administration include a $710 million investment in salaries since 2015 as well as ongoing expansions of programs promoting employment, independent living and community-based residential programs. Yet, advocates say the governor has ignored the needs of people with disabilities on gubernatorial pet projects like public transit. The governor has notoriously micromanaged projects down to the blue and yellow subway tiles used by the Metropolitan Transportation Authority, which Cuomo controls through his appointments to its board, and a subway tunnel repair project under the East River. Just a quarter of subway stations are currently accessible, with plans to make the transit system fully accessible by 2034.

Three lawsuits against the MTA by the Center for Independence of the Disabled New York remain ongoing because the governor will not work together with the advocacy group, according to Executive Director Susan Dooha. “We are disappointed with the governor,” she said in an interview. “We think that the governor and his appointees on the MTA board should instead be looking proactively how they can reach an agreement with the community.” Dooha added other sources of gubernatorial frustration. Cuomo’s self-imposed cap on Medicaid spending growth limits how much money the state spends on services for people with disabilities, like long-term care. Other policies have affected people with disabilities, such as the pace of distributing COVID-19 vaccines in prisons and jails whose populations have higher numbers of people with disabilities compared to the general population. The COVID-19 death toll in congregate facilities was made worse by a policy allowing patients discharged from hospitals to be sent to recover at congregate living facilities, similar to the governor’s controversial policy on nursing homes. This comes after the administration has blocked additional funding for oversight programs in past years, according to Dooha. People with disabilities and their advocates have plenty of fiscal grievances with the governor. They also lament how he has not applied his political talents to their various causes as much as they would like. Sometimes, they just want the governor to stop making jokes at their expense, like that time several years ago when dwarfs asked the governor to avoid “Mini Me” attacks on his political rivals moving forward. Longtime political insiders like Abinanti say gubernatorial recognition is evidently hard to come by for people with disabilities. “They’re not at the top of his list or at the bottom of his list,” Abinanti said. “He sees services for people with disabilities as a place to cut and save money.” Abinanti, who has a child who is autistic, was also frustrated with the governor’s track record of making jokes at the expense of people with disabilities. The governor never apologized to Abinanti when he demanded an apology after Cuomo joshed a crowd of political supporters about his brother’s purported “development issues.” Three years later, Abinanti is seeing a connection with how the governor is using his questionable sense of humor as a shield against allegations of sexual harassment from multiple women. “He never admits he is wrong,” Abinanti said. “He never apologizes. Just look at the ‘apology’ to the women who accused him of wrongdoing. Almost like it was their fault for taking his ‘humor’ the wrong way!”

HE PANDEMIC HAS taken a dis‑ proportionate toll on people of color across the board. Rates of COVID‑19 infection are higher, death rates are higher and vaccina‑ tions are rolling out more slowly in Black and Latino communities. The same can be said for the pandem‑ ic’s impact on New York’s small businesses. “We are mired, right now, in pandemics,” said Michael Garner, chief diversity offi‑ cer at the Metropolitan Transportation Au‑ thority, at City & State’s Diversity Summit in February. “A health pandemic, a fallout economically. When this country is in a re‑ cession, Black America is in a depression.” A report last summer found that na‑ tionally, 41% of Black‑owned businesses, 32% of Latino‑owned businesses and 26% of Asian‑owned businesses had closed ei‑ ther temporarily or permanently, com‑ pared to 17% of white‑owned businesses. And in New York, businesses owned by people of color have struggled to access funds from federal relief programs. A re‑ port by New York City Comptroller Scott Stringer last summer found that out of 500 minority‑ and women‑owned busi‑ ness enterprises surveyed, only 10 re‑ ceived coronavirus‑related government contracts from the city. That fact makes New York’s progress on its goals to utilize more minority‑ and women‑owned businesses in government contracts especially important this year. “I think overall, the movement towards the goal for both the city and state has been pro‑ gressing. It probably could have progressed a lot faster and it would have been higher, but since the pandemic, everything has taken a step back,” said Assembly Member Rodneyse Bichotte Hermelyn, who chairs the Assembly Subcommittee on Oversight of Minority‑ and Women‑Owned Busi‑ ness Enterprises. Andrew Cuomo and New York City Mayor Bill de Blasio have set ambitious targets for awarding government contracts to MWBEs. Cuomo has prioritized MWBE contracting since his first year in office, while de Blasio has recently demanded that each city agency appoint a chief diversity officer as soon as possible.

While sexism and racism continue to pose formidable hurdles for business owners who are not white men, policymakers have doubled down on their efforts to diversify the pool of city and state government contractors as one way to rectify historical inequities. 3 MICHAEL GARNER CHIEF DIVERSITY OFFICER Metropolitan Transportation Authority As the MTA’s chief diversity officer, Michael Garner has overseen significant growth in MWBE contracting. The transit authority, which has the state’s highest discretionary program threshold at $1 million and assists with lending, appropriated $722 million to MWBE firms in the 2019-2020 fiscal year, the largest amount of any New York agency, and is on track to hit Gov. Andrew Cuomo’s goal of utilizing MWBE firms for 30% of the state’s contracting. Garner previously worked at the New York City School Construction Authority, another agency leading the way on MWBE
