I RECALL A FEW YEARS AGO a friend visiting New York from Florida who was thrilled to stumble on the National Museum of the American Indian in lower Manhattan. Why? Because she was part Cherokee and had never known of the museum’s existence. Realizing that I know so little about New York’s Indigenous people, I decided to visit the museum last week. Tucked away inside New York’s historic Alexander Hamilton U.S. Custom House on Bowling Green, it’s easy to overlook the banner outside that advertises the institution, which is run by the Smithsonian. Ariana Pennick, a 30-year-old EMT from Albany, told me she stumbled on it by chance as she was walking by. “It’s not the Museum of Natural History,” she told me inside as we gazed upon a treasure trove of artifacts and art by Native Americans. “The paintings are really beautiful,” Pennick said. Not to disrespect anyone from other states, but the last time I checked, being from New York does get a certain notice. So why overlook the people who’ve called the state home longer than anyone else? The Cayuga, Oneida, Onondaga, Seneca, Tuscarora and Shinnecock Nations, along with the St. Regis Mohawk Tribe and the Tonawanda Seneca Nation all live within New York’s borders. A good start in getting to know New York’s Indigenous people is education. And a visit to the museum is easy. Admission is free.

A Buffalo Common Council member is suggesting that the city abolish the role of mayor and replace it with a city manager position chosen by the Common Council with input from the community. The Council will release a report on the prospect in a few months. Council Member Rasheed Wyatt, who proposed the idea, has been a frequent critic of Mayor Byron Brown, but said it was not an indictment of Brown. Instead, Wyatt said that the current system has not helped poor neighborhoods in the city, which he said have been divested from over the past several decades. However, a decision to eliminate the role of mayor would have a greater impact on India Walton, the democratic socialist who beat Brown in the Democratic primary and is expected to win the general election in November. INFRASTRUCTURE FUNDS COMING TO NEW YORK

The U.S. Senate finally reached a bipartisan deal to pass a $1.2 trillion infrastructure deal after weeks of negotiations. And New York is set to get a big chunk of cash. The MTA will get at least $10.7 billion from the package, which will be used for a number of major ongoing projects including the Gateway Project and the Second Avenue subway extension. The state’s airports are also in line to get $937 million in total.

splitting the roles of the Metropolitan Transportation Authority chair and CEO, Cuomo appointed the agency’s construction chief Janno Lieber as the acting head. Cuomo wanted to appoint Lieber to the role of CEO without state confirmation under his proposed new leadership structure, but time ran out before former MTA head Pat Foye left on July 30. Interim New York City Transit President Sarah Feinberg also stepped down from her role, citing a desire to spend more time with her young daughter. Cuomo had wanted Feinberg to serve as chair of the MTA – subject to state Senate approval – as part of his plan for the agency’s management structure. Although Feinberg is leaving, she said she would return if the Legislature ends up approving the bill and she gets nominated as chair.

What happened to all the pandemic dining rules? Today, nearly a year and a half since New York City shut down dining for the first time, delivery sales have skyrocketed and the streets are lined with elaborate outdoor dining structures. Although restaurants were able to return to 100% indoor capacity in late May, more than 1,000 restaurants in New York City have permanently closed their doors since March 2020, and it will likely take years to assess the full extent of the damage to the industry. With all of the change that occurred in the restaurant industry since then, City & State looked into the status of the dining measures that were introduced during the pandemic. At the beginning of the pandemic, third-party delivery services like Grubhub and UberEats charged fees to restaurants as high as 33%, which translated into a net loss for some restaurants. To address this, the City Council passed a temporary cap that prevented third-party delivery services from charging restaurants more than 15% per delivery order and 5% for marketing and nondelivery fees. The cap is set to expire on Aug. 17, but the City Council is considering legislation that would extend it. Outdoor dining allowed under the emergency Open

That requirement will extend to all city employees on Sept. 13 – the first day of public school.

New York City Hospitality Alliance Executive Director Andrew Rigie said outdoor dining helped save countless restaurants throughout the city and was responsible for hiring back about 100,000 workers. To-go cocktails, another popular pandemic-era dining measure, are no more and haven’t been for a little over a month now after Cuomo lifted the state of emergency on June 23. The measure, which allowed bars, restaurants and drink manufacturers to sell and deliver to-go alcohol, was so popular in the restaurant industry and with many members of the public that several New York lawmakers proposed bills during this year’s legislative session to extend to-go cocktails for one to two years. – Sahalie Donaldson

What work does the Downtown Alliance have moving forward? As much progress as we made at the World Trade Center site, we’re not done. Tower Two and Tower Five still have to be built. We’re very much looking forward to working with the community on both of those critical projects and seeing the performing arts center open its doors. We have to really over the next couple of years continue to nurture our small businesses. If they’ve made it through this pandemic, gosh, we really want them to make it through the long haul. That’s going

to be critical. And that will be helped by having office workers back in the buildings. So maybe this is a place where people want to come to work, whether it’s through performances or art, clean streets, public projects, things that make people say, “I want to go to the office today, and there’s a reason I’m in this neighborhood and contributing to our vibrancy.” What are the top policy concerns the Downtown Alliance wants the next mayoral administration to tackle in a postpandemic New York?

I think it became pretty clear this last mayoral campaign that public safety is clearly on everybody’s minds. We’ve seen an uptick and there are lots of reasons why we might be seeing an uptick in crime. That is clearly a very important priority, priority No. 1 for the next mayor. Related to that of course are the issues of homelessness, of quality of life, of garbage pickup. You want your city to be safe and you want it to be clean. I think there’s both a perception and a reality in certain places that we’ve fallen behind on those counts. So, I think those are the policy

priorities that were made pretty clear throughout the campaign. The other thing I would say is, I’m really excited for a cheerleader, for somebody who loves the job and loves the city and loves every neighborhood in this city, because that kind of leadership and that kind of optimism is really important. What other improvements to lower Manhattan are you looking forward to next? So the city’s finally, after 10 years, starting work on Water Street. We know that good things

take time. We’re looking forward to that. We have long advocated for redesigning the area around the New York Stock Exchange. We have a plan that’s up on our website that began with a steering committee a number of years ago that we think would enhance the pedestrian experience around one of the most visited corners of the city. So, we would love to work with the mayor on that and clearly resiliency and figuring out how we’re going to finish hardening our shore in lower Manhattan, which is of critical importance to us downtown. – Ralph R. Pot Initiative The state can’t get off its couch to develop pot regulations. So Native American tribes are taking the lead. By Rebecca C. Lewis

A

FTER THE STATE legalized recreational marijuana in March, the lawmakers and advocates who pushed for the law have been criticizing Gov. Andrew Cuomo for dragging his feet on setting up marijuana sales and cultivation regulations. While most of the state still needs to wait a year or more before sales can begin, some Native American tribes are already moving ahead with legal pot in their territories. Marijuana law, as it relates to sovereign Native American tribes, can be tricky because there aren’t set regulations. “Short answer, it’s complicated,” said Heather Trela, a fellow and the director of operations at the Rockefeller Institute of Government. But the most simple way to understand it is that sovereign tribes are free to legalize – or ban – marijuana within their territories, including its cultivation and sale, independent of the state. Still, it becomes much easier for tribes looking to enter the pot market to take action after surrounding states legalize the drug to avoid jurisdictional issues over drug-related crimes with the federal government. At the forefront of those efforts in New York is the St. Regis Mohawk Tribe, whose territory is at the northern edge of the state along the Canadian border. On June 28, it became the first tribe in the state to legal-

ize recreational marijuana. But the tribe had been working on regulations since December 2019 following a tribal referendum on the matter. When the state approved its marijuana legislation, the St. Regis Mohawk Tribe was ready to act. And it’s on pace to begin sales well before the state. In a unique setup, the St. Regis Mohawk Tribe has established an entire regulatory structure within its jurisdiction and will award licenses to tribal members and tribal businesses. This is different from the route many other tribes have taken, which often set up tribally owned and operated marijuana businesses. In an email, Brendan White, the tribe’s director of communications, wrote, “The adoption of the Tribe’s Adult Use Cannabis Ordinance is historic, as it represents the first adult use cannabis law adopted by a tribe in New York state and is the first in the country that licenses tribal members and tribal member-owned businesses.” The recently passed ordinance created the Tribal Cannabis Exchange to issue licenses and collect fees, and it includes a compliance office overseen by the Tribal Cannabis Board. It has already begun receiving license applications, and while the tribe has not provided a specific timetable, marijuana sales are expected to begin in the territory before the end of the year. And the new businesses could have big mon-

etary implications for the tribe. “It provides an opportunity to diversify our local economy, provide needed employment and remit licensing fees to financially support the ongoing provision of essential community programs and services,” White said. Not far behind is the Shinnecock Indian Nation on Long Island, which has broken ground on a medical marijuana cultivation facility and is building a dispensary and wellness center, with expectations that sales could start before the end of the year. Like with recreational marijuana, they are planning to own and operate a medical marijuana business outside of the state’s regulations within their territory. But now that the state has legalized recreational pot, tribal leaders have said they’re looking to establish regulations for that as well, if members agree to a framework. The managing director of the Shinnecock Indian Nation’s marijuana business, Little Beach Harvest, declined to comment for this story, citing internal work happening right now. While sales can only take place on tribal land, it can still have an impact on neighboring communities. Local governments in the region abandoned the idea of opting out of recreational sales since pot would be in the region anyway if the Shinnecock Nation moved forward with its own legalization. And given the slow pace at which the state is moving to set up its regulato-

ry structure, the St. Regis Mohawk Tribe and/or the Shinnecock Nation could be selling recreational pot for months or even longer without competition from state-regulated retail shops. Tribes, by setting their own tax rates, could also sell marijuana for cheaper than state-regulated shops that may operate nearby. It’s one of the incentives for states to enter into compacts with tribes, which generally result in similar tax structures and would allow tribes to operate outside of their territory, according to Trela. Those compacts, while not necessary, also help with jurisdictional issues at both the state and federal level. Many Indigenous casinos in New York operate under such compacts with the state, and tribes in other states have often reached a compact with state leaders when entering the pot business. The largest dispensary in Nevada is the result of a compact between the Las Vegas Paiute Tribe and the state government, and it has been a major boon for the tribe. Entering compacts is not always without controversy though. In California, tribes and the state government have been at odds over marijuana regulation. In order for tribes to enter the state market outside of their territories, California officials demanded that they give up their tribal sovereignty and submit to state regulations on their own land, something the tribes re-

fused to do. The issue arose because Proposition 64, which legalized recreational pot in the state, said nothing about how the state would interact with tribes. The law in New York legalizing recreational marijuana didn’t say much about marijuana on Indegenous lands. It did, however, give the Cannabis Control Board, which will oversee the industry and its regulations, the authority to “enter into tribal-state compacts with the New York state Indian nations and tribes … autho-

rizing such Indian nations or tribes to acquire, possess, manufacture, sell, deliver, transport, distribute or dispense adultuse cannabis and/or medical cannabis.” But with the Cannabis Control Board still not set up, it will likely take some time before such compacts are established. When asked whether the St. Regis Mohawk Tribe is interested in entering a compact with the state, White said such a decision “would need to be presented to tribal membership for approval.” But not all tribes are getting in the action. The Onondaga Nation near Syracuse is reportedly not planning to authorize pot businesses in its territory. And Western New York’s Seneca Nation of Indians has not publicly announced any plans, despite two years ago saying it was eagerly awaiting the state to legalize pot, “like a snake ready to strike.” In the meantime, both the St. Regis Mohawk Tribe and the Shinnecock Nation are moving ahead to get what could become an important industry up and running, even while the state is still figuring out its own business. They’ll likely attract shoppers from around their regions eager to purchase marijuana that’s now legal to possess. The success of their businesses may set an example for not just other tribes that are perhaps hesitant to enter the market, but for the state as well.

MONG THE MANY indelible images of life during the coronavirus pandemic, one was kids and teachers camped in school parking lots to attend remote classes, relying on the internet connection provided by schools and other places like libraries, school buses and even Taco Bell. Members of the Tonawanda Seneca Nation in Western New York were among those traveling to the parking lot of Akron Central Schools, which serves both the reservation and other surrounding communities, in the early days of remote learning last year. “It wasn’t 100%, far from it. But it worked,” Antoinette Abrams, who works as a Native American liaison at the school, said of the internet connection accessed from the school parking lot. Remote learning eventually got easier once the district provided Wi-Fi hot spots for students to use at home. While an improvement, the connection provided by those hot spots “wasn’t 100%” either, Abrams said. The need for cumbersome workarounds and imperfect connections provided by Wi-Fi hot spots comes from the lack of broadband connection in many rural areas in New York, including parts of the Indigenous territories. Reports by the Federal Communications Commission state that deployment of advanced telecommunications on tribal lands is behind deployment in nontribal areas. As of 2018, 27.7% of residents on tribal lands lacked access to fixed broadband at speeds of 25/3 Mbps – the FCC’s minimum benchmark speed – compared to 22.3% of residents in other rural areas and 1.5% of residents in urban areas. A report by the internet research group BroadbandNow suggests that among those who do have access to wired broadband on Indigenous lands, few have access to a plan below $60 per month. The barriers to accessing a high-speed fixed internet connection in Indigenous communities are similar to those faced by other rural areas across the country: a lack of internet providers willing to build the infrastructure to provide that connection. The investment to lay fiber in remote, less populated areas is often not seen as worth it by internet providers. “(T)he remote, isolated nature of these areas combined with challenging terrain and lower incomes increase the cost of network deployment and entry, thereby reducing the profitability of providing service,” the FCC’s 2020 Broadband Deployment Report states of tribal areas. As it did for many other rural and remote

parts of New York, the pandemic highlighted the lack of internet connections in some Indigenous communities. While both the state and federal government have undertaken coverage mandates and grant programs aimed at making broadband both more accessible and more affordable – including encouraging large internet service providers to build in remote areas – some tribes have taken matters into their own hands. The St. Regis Mohawk Tribe, whose land is adjacent to the U.S.-Canadian border in Franklin County, is one of several dozen tribes across the nation that own and run a broadband network. Mohawk Networks was launched with the help of a $15 million investment – some of that coming from federal grant money – to lay 68 miles of fiber in the area in 2015, and the company now functions as a tribally owned LLC, serving customers both inside and outside the territory. “We were one of those completely unserved communities,” said Allyson Mitchell, gen-

eral manager of Mohawk Networks. When the broadband project first started, Mitchell was working with the Saint Regis Mohawk Tribal Council. “Our leadership felt that it was imperative for us to be pushing a way to be able to connect our community, and to be able to have high-speed internet access for our community members – for education, for health care, for public safety,” Mitchell said. The network now serves about 1,600 homes as well as businesses within the community. According to the network’s website, the cost of an internet-only plan on the tribe’s land starts at around $60 per month. Mitchell added that the company works with low-income households to qualify for any subsidies. Prior to the tribe’s broadband investment, the community had been relying on dial-up and cellphones. “If it were not for our broadband infrastructure and our connected community as it is right now, I don’t know how that would have shaped our response to the pandemic,” Mitchell said.

Of course, communities across rural parts of New York – and even urban areas – were forced to weather the pandemic without high-speed broadband access, including the aforementioned Tonawanda Seneca Nation. Affordability can be another barrier, even when the infrastructure is there. This year, Gov. Andrew Cuomo signed into law a requirement that internet providers offer $15 per month plans for qualifying low-income residents. That mandate was held up over a court challenge by a lobbying group representing internet providers, however, and it appears the plan is on hold following a court order, though the state has said it reserves the right to appeal the decision. If the requirement were to move forward, it would extend to low-income people living on tribal lands. “If a company serves a tribal area and the consumer qualifies for the service, it applies equally whether the consumer lives on tribal land or not,” James Denn, a spokesperson for the state Public Service Commission,

tle noted that access to the internet can be a means of furthering sovereignty for Indigenous people. “Improving internet infrastructure has the opportunity to provide a new boost to local economic development initiatives,” Trostle wrote. “Owning and operating this infrastructure also supports Native Nations’ sovereignty by keeping power and data within the communities rather than relying on an external provider.” While Trostle said they were impressed with Mohawk Networks and referred to it as a model that other Indigenous nations could follow, there isn’t necessarily a one-size-fitsall approach to tribal broadband. “There’s a huge diversity in Indian country. There are more than 500 federally recognized tribes, and there are also state-recognized tribes, and each of them have been trying to tackle the digital divide in their own way,” said Trostle, who now works as a research professional at the American Indian Policy Institute at Arizona State University. That

By Annie McDonough includes Indigenous communities that partner with larger existing internet service providers to build out networks. The Seneca Nation of Indians is also working on a broadband project on its Cattaraugus Territory, an area that has not been served by private internet companies, despite nearby hookups. A grant from the U.S. Department of Agriculture and co-investment from the Seneca Nation is expected to facilitate the installation of fiber, but representatives from the Nation did not return a request for comment about how the service will work or how far the project has progressed. Although grant funding like the kind the St. Regis Mohawk Tribe used to help build their network is available through the federal government, it can take a lot of expertise and capital upfront to even pursue those grant opportunities. Not all tribes can invest several million dollars in this work. “Most grants are reimbursable, which means that you actually have to have all of the money upfront,” Mitchell said. “You have to be able to float the project until you meet the grant disbursement terms. That is typically something that’s only favorable for larger companies to be able to do.” And for Indigenous communities working in partnership with nontribal internet providers, there’s sometimes a learning curve for those providers. “Because Indian country has so many different types of tribal lands, it can make it difficult to figure out the best way to do easements and right of way, which slows down projects. Because this is federal land, it’s also subject to more environmental protections,” Trostle said. But there’s some hope that as the pandemic subsides, a greater amount of federal funding is becoming more readily available to fund broadband expansion projects in Indigenous communities, whether those become fully tribally owned or partnerships with other entities. Both Trostle and Mitchell pointed to new funding sources, including the federal Tribal Broadband Connectivity Program, devoting nearly $1 billion to expanding broadband on tribal lands. Mitchell said that grant application requirements for this program are not as strict as previous ones. “It’s something that I’m very glad to see now,” she said. “It’s a shame that it took the pandemic for us to be able to get to this point. But if tribes have the ability to be able to pull together a grant application, the deadline for application is Sept. 1. It’s a very tight window of time, but that’s something that is out there and available.”

Two projects honoring or benefiting New York’s Indigenous people were bungled or opposed by the state Department of Transportation.

T WAS LATE NOVEMBER 2020. The leafless trees blocked the salt-filled wind as best they could, but there was no denying it: Winter had finally come to the sliver of land now known as Long Island, and forever home to the Shinnecock Indian Nation, a Native American tribe. The cold snaked its way around your bones. At night, a combination of a heavy-duty sleeping bag, two thick jackets, hand warmers stuffed in my gloves and my boots did all they could to keep my body temperature just high enough and my blood flowing. To willingly sleep outside in these conditions for a single night, as I did, was a practice in endurance. But to do so for a full month, as a group of Shinnecock citizens did, was a measure of just how far people are willing to go when faced with a bully – be it a state agency, a neighboring town, or a heavy-handed governor. So often, over the course of New York’s history, the physical reminders of progress and societal advancement – dams, railroads, highways – end up representing something a little different to the Indigenous people who stewarded this continent without them for millenia: the manner in which colonizers continue to run roughshod, sometimes literally, over the land rights of North America’s original inhabitants. Two of the most visible tribe-related projects of the past decade have been either fought or delayed by the state Department of Transportation, often undercutting what the involved tribal nations say are good faith efforts to consult and negotiate with the agency. This isn’t an issue limited to infrastructure or the department: It reflects the state government’s insistence on standing alone atop the local political hierarchy. Also, to some, it demonstrates Gov. Andrew Cuomo’s apparent unwillingness to treat the tribal nations of this state as the sovereign entities that they are. It’s impossible, and unfair, to pin 400 years of bad faith deal-making and land dispossession on any single individual. But it’s fair to say that the Cuomo administration has not even tried to get along with New York’s first peoples.

Two billboards meant to support the Shinnecock Indian Nation have faced pushback from local agencies.


L

IVING AS A tribal citizen in the Northeast, by default, means accepting a certain degree of faux visibility. The land is littered with clear reminders of Native existence – most prominently in the names of parks, rivers, mountains, counties, cities and entire states – yet most people living in these areas never think about the nations who preceded the formation of the United States. For years, New York’s Department of Transportation has wanted to add a new exit ramp along I-87 near Albany International Airport. That dream took a step toward becoming a reality in 2014 when, in compliance with Section 106, the department and the Federal Highway Administration consulted with the St. Regis Mohawk and Delaware nations, and the Stockbridge-Munsee Band of Mohican Indians, a federally recognized sovereign nation now situated in northern Wisconsin after being displaced from north-central New York. The state agreed to survey the grounds for artifacts and considered installing a mural along the walls of Exit 3 depicting peoples from their communities – a physical, human reminder of who held the land before it was a highway. (According to Nathan Allison, the Stockbridge-Munsee’s tribal historic preservation officer, the state’s surveying efforts turned up tribal artifacts dating back as far as 10,000 years.) Allison told City & State that originally the Stockbridge-Munsee did not want to pursue development of the land at all, preferring instead to leave the grounds undisturbed. But, when that proved not to be a viable option for the state, the tribal nation agreed to compromise. In 2016, after the surveys were completed, the state sent a letter to all three tribal nations committing to “include the aesthetic treatment that will reference the Native-American heritage and culture” on the wing walls on either side of the overpass. “Projects like this, no matter how small or big they are, help bring awareness to the land that you’re on,” said Heather Bruegl, the Stockbridge-Munsee director of cultural affairs. “Indigenous

nations were and are still here. I’m a firm believer in the fact that you can’t even fully understand the history of the United States if you don’t first understand the history of its first people.” Everything seemed in order. The only thing left to do was build the ramp, install the mural and celebrate a newfound partnership. So, it seemed curious when the new Exit 3 ramp, a $50 million project, was deemed completed in November 2019 without the murals in place. The opening ceremony was marked by the attendance of Gov. Andrew Cuomo, who cut the ribbon and drove Franklin Roosevelt’s 1932 Packard across the new development. By that time, the murals had been commissioned – the selected image of Stockbridge-Munsee citizens was pulled from the tribe’s community newspaper – but they were nowhere to be found on the walls or in the governor’s photo op. Instead, according to Allison and Bruegl, the department assured the Federal Highway Administration and the tribes that a separate ceremony would be held in March 2020 to unveil the murals. Then March came and went; so did April, May and June. Still no murals.

Instead, in July, the department asked the tribal nations to consider moving the murals from the walls to a small park away from existing motorist and foot traffic. Allison and Bruegl were stunned. “No two agencies are created equal, and some do much better than others,” Allison said of the department’s refusal to adhere to its written agreement. “But that was just a real disservice to people involved in the collaboration and consultation that had gone on since 2014.” The tribe, forced into a corner, went public. A feature reported by the Rochester Democrat & Chronicle in December 2020 laid out the whole affair, putting pressure on the department to uphold its end of the deal. In January, after the tribes continued appealing to the federal government, the state Department of Transportation announced that the murals were going to be finally installed, which they subsequently were – nearly a year and a half after the Exit 3 ramp first opened. There was little fanfare because the installation was amid the COVID-19 pandemic fully gripping the nation. The governor did not drive by in FDR’s Packard, nor did he cut a ribbon and make a speech about the contributions that Indigenous peoples have made to the state and its lands. When Allison and Bruegl asked the department why this was dragged out for so long, “Our contacts with New York state DOT said, ‘I’m sorry, this is beyond our control; it’s political and above us and we don’t have an answer for you,’” Allison told City & State. In response to questions from City & State about the fractured

consultation process, Department of Transportation spokesperson Glenn Blain offered the following statement: “The New York State Department of Transportation values and respects our relationships with New York’s Native Nations and Tribe. We have honored our commitment by installing engraved murals on the Northway Exit 3 flyover northbound and southbound ramps which celebrate the Capital Region’s rich Native American culture and history.”

NLIKE THE STOCKBRIDGE-MUNSEE, the Shinnecock Indian Nation on Long Island’s South Fork – which is now called the Hamptons – were not forced westward, holding their ground at the eastern end of Long Island. Also, unlike the Stockbridge-Munsee, the Shinnecock were not surprised when the department came for them. The beef between Shinnecock and the state of New York extends much further than a single project. Dig through the archives of The New York Times and the stories start to blur together. In all of them, a Shinnecock citizen, or the nation’s tribal council, tries to establish some semblance of economic independence, only for the state to take the most aggressive action possible. In the 1980s, it was the Southampton police and the state Department of Taxation and Finance bringing the hammer down on Jonathan Smith’s cigarette stand. In 2000, it was state police violently disrupting a peaceful protest by Shinnecock citizens objecting to gaudy mansions being built atop the graves of their ancestors. This past spring, it was a District Court judge in Central Islip ruling against three Shinnecock citizens seeking to exercise their aboriginal fishing rights. The latest iteration of this centuries-old story involves a pair of 61-foot billboards – also referred to as monuments by the Shinnecock to signify “marking our land,” in the name of a tribal leader – developed and constructed by the Shinnecock along the

sides of Sunrise Highway, the state road that runs through the South Fork. The billboards were designed with one goal in mind: to provide a steady revenue stream to a tribal community with an inordinately high poverty rate. Advertisers, recognizing the rare opportunity to get their messages and products screened to carloads of the tribe’s well-to-do Hampton neighbors, quickly lined up. But the town of Southampton was not as keen on what its officials deemed a blight on their sleepy gateway community. The town first issued a stop-work order to the tribal nation in April 2019; when construction continued, the town raised the issue with the state, roping in the Department of Transportation. By June, the department filed a lawsuit against the Shinnecock’s seven “New York council members and the contractors hired could to complete construction, citing the lack of departmental permits. The camp stood both against the – Tela Troge, legal campaign mounted by the department Shinnecock tribal and in solidarity with the tribal nation’s attorney ongoing effort to build a steady, sustainable economic base. Troge described the department, in her experience, as acting “highly aggressive.” The latest example, in addition to the ongoing lawsuit over the billboards, arrived in early February. The department sent a letter to the Shinnecock tribal councilors informing them of the agency’s plan to begin fining the tribal nation $2,000 every day the billboards are kept operational. As of publication, the department hasn’t attempted to collect on the fines. According to Troge, the letter was written and delivered without having first been cleared by the department’s own attorneys. “For the DOT, without the advice of their legal counsel, to send us a letter saying they’re going to fine us $2,000 a day in the midst of a global pandemic and a community that’s suffering from poverty, horrible housing conditions and struggling to provide even the most of minimum resources of getting food to people – that’s really cruel,” Troge said. While the Shinnecock billboards and its proposed casino are contested by the state in court, Troge said that investors, particularly those at banks, are wary of directing their funds toward any current and future projects until they are fully adjudicated. Even though she and other Shinnecock citizens take umbrage with the department’s actions, she’s not concerned in the slightest about what the ultimate outcome will be in the courts. “You can quote me on this: New York state has zero chance of winning this case, and yet they just had the judge set a trial sched-

ule that goes to 2023,” Troge said. “When you look at what the United States is trying to do to improve the economy by 2024, (the state is) just like, ‘OK, well, we’re going to keep the Shinnecock Nation under litigation until then.’” Speaking for the department, Blain offered the following statement: “The department cannot comment on the ongoing legal issues with the Shinnecock Nation as it is a matter of continuing litigation.”

UOMO HAS REFUSED to meet directly with Seneca Nation tribal leaders, while antagonizing them over casino fees and road repair work on I-90, which cuts through (illegally, the tribe is currently arguing in court) the Seneca Nation’s Cattaraugus Reservation. While many observers have their theories, nobody truly knows why the department has been so heavy handed. Although it is technically the Department of Transportation Commissioner Marie Therese Dominguez’s sector currently feuding with the tribes, the agency’s and the wider state government’s troubled relationship with Indigenous New Yorkers long predates her appointment in 2019. Allison and Troge intimated, based on the conversations that they’ve had with department officials, that they suspected the department’s hardline positions are ultimately coming from the governor, but that is conjecture rather than fact. In response to multiple detailed inquiries for this article, the governor’s office sent the following statement from spokesperson Jordan Bennett: “The State generally has good relationships with nearby tribal nations. While occasional disputes and frustrations from both sides happen and are expected, they are always taken seriously and resolved in a way that works for all parties. The Governor has worked with tribal nations for decades including his days as HUD Secretary – where he was the first to go to an Indian nation and among other things unveiled an initiative that enabled tribal governments to benefit from more than $1 billion in annual assistance under several major HUD programs – to now. He believes in a continued partnership and respects their status.” Some tribal leaders in New York see it very differently. “New York could arguably be said to be one of the states with the worst overall historical record of its treatment of Indigenous people,” Troge said, reflecting on the centuries of dispossession and bad faith deal-making that have led us to this moment. But when it comes to the past decade of tribes having to battle state agencies to exercise tribal sovereignty and protect their citizens, the problem isn’t history or precedent, she said. “It’s the governor’s view of Indigenous people.”

Kallyope is a homegrown company illustrating how coordinated efforts to boost life sciences in New York can succeed. The biotech company was launched in 2016 with $44 million in financing from local investors like Lux Capital and Tony Evnin. It’s housed in Alexandria’s Manhattan center, and was co-founded by Tom Maniatis, a Columbia University biochemistry professor who now also leads the New York Genome Center. Merck veteran Nancy Thornberry is the founding CEO of Kallyope, which develops therapies based on the link between the gut and the brain.

This past year has been a significant one for the life sciences company Schrödinger. Under Ramy Farid’s leadership, the New York City-based company had its initial public offering last summer. Schrödinger ended 2020 with $108.1 million in revenue, an increase of 26% compared to the previous year. It goes to show how far the company – which has created computational platforms used for drug discovery and in materials science – has come since its founding in 1990.

WHY THE LIFE SCIENCES LEAVE PEOPLE OF COLOR BEHIND And how COVID-19 and the Black Lives Matter movement could mark a turning point.

A

S COVID-19 has rampaged across the country, it has laid bare the stark racial divides in American medical care. Black and Latino people are more likely to be infected with the coronavirus, are hospitalized with it at nearly three times the rate of white people, and have died of it twice as often, federal figures show. People of color have been more hesitant to get vaccinated, whether it’s due to a lack of access or distrust of a system with a history of misleading and mistreating Black patients. The medical establishment has been exposed for neglecting to invest in public health – and for failing to pay enough attention to poverty, pollution and other societal problems that disproportionately harm racial minorities. These divisions extend to the underlying biomedical sciences and the life sciences as a whole, which are dominated by white men. Fewer than 2% of senior investigators funded by the National Institutes of Health are Black, and just 4% of them are Hispanic. At biotech companies, Black people made up 7% of the workforce and 3% of management jobs, well below their 13% share of the U.S. population, a 2017 study by Nature Biotechnology found. The same study found that Hispanics – about 18% of the population – made up 6% of the workforce and 4% of management positions. Other studies have documented gender and racial disparities in the so-called STEM – science, technology, engineering and mathematics – fields and scant signs of progress over the years. “It’s not really just simple underrepresentation, but it’s actually a kind of historical exclusion and systematic

marginalization because of the impact of systemic racism,” said Raeka Aiyar, vice president of scientific outreach at the New York Stem Cell Foundation. “This pipeline is also a leaky pipeline. We’re losing not only ethnic minorities but also women at a disproportionate rate the higher you can climb up the ladder.” Even in such a racially diverse place as New York, where taxpayer dollars and investors have cultivated a thriving ecosystem of biotech startups, many top

executives in the sector are white men. For example, when Gov. Andrew Cuomo announced the creation of a 15-member Life Science Advisory Board in 2018, only two people of color were included, one a pharmaceutical CEO based in Boston, while 11 members were men. New York City Mayor Bill de Blasio named one person of color – a female Harvard Business School professor – to his 15-member Mayor’s Life Sciences Advisory Council in 2017. Yet scientists and researchers of color

say the attention that the Black Lives Matter movement and the COVID-19 pandemic have drawn to racial inequality in the U.S. may prove to be a turning point – and that long-sought changes could pave the way for better health care for people of color. “We were doing this work way before George Floyd’s murder. And many people of color were doing this work in the life sciences fields, in the midnight hour, on top of the work that they were already doing before,” said Emma K. T. Benn, a biostatistics professor and founding director of the Center for Scientific Diversity at the Icahn School of Medicine at Mount Sinai. “And so my hope is that we now have a bigger platform where we’re doing this work and people listen, people care, people want to support it. Institutions want to support it. And society believes that this work is important. The NIH believes that this work is important. We are still going to be pushing. We’re going to be pushing for more.” Benn and like-minded colleagues face plenty of structural challenges. Some experts point to a lack of exposure to science education in elementary school in low-income neighborhoods as a barrier for many children of color. Choosing to pursue careers in science and technology often depends on early and frequent exposure in the classroom, said Yvonne Thevenot, the founder and executive director of the nonprofit STEM Kids NYC and a research assistant at Columbia University’s Teachers College. “All over New York City neighborhoods, both in lower economic and upper echelons, there are pockets of schools and there are pockets within communities where there are STEM programs,” Thevenot said. “It doesn’t really put a dent in it, because there are just so many more people who aren’t being exposed.” For students of color who do make it into graduate school or land a job in the life sciences, other obstacles arise. Women and people of color are less likely to complete postdoctoral research in the biomedical sciences than their male and white classmates. Black researchers remain significantly less likely to secure NIH research funding. That funding gap has been attributed to a greater focus on community health and health disparities by Black scientists, which has not been a high priority for federal investment. One 2020 study concluded that demographically underrepresented students tend to produce more innovative scientific research – but their work isn’t cited as often by peers and often doesn’t advance their careers. People of color in the biomedical sciences say they contend with bias from

their colleagues in the workplace as well. Last year, two Icahn School of Medicine at Mount Sinai professors surveyed their peers on instances of racial bias. “Blacks have lower IQs than whites,” one scientist reported being told. “You’re not really Black because you are good,” another was told. “We used to sell your people,” another colleague noted, unprompted. Boosting diversity in the life sciences is about more than diversity, these scientists say. It’s about improving the research and achieving better outcomes. Some diseases that disproportionately impact racial minorities garner less attention. The COVID-19 pandemic has underscored the need to devote more study into societal and environmental effects on health. There’s also evidence that more diverse research teams produce better results. “If we have a scientific population that represents a singularity of thought and experience, we will never be able to address the multiplicity of scientific problems that we face,” said Uraina Clark, one of the Icahn School of Medicine at Mount Sinai researchers who documented examples of racial bias in her field. There are signs these arguments are gaining traction. In March, NIH Director Francis Collins issued an apology to those “individuals in the biomedical research enterprise who have endured

disadvantages due to structural racism.” In June, the NIH announced a plan to close the racial gap in research grants and put renewed focus on health disparities. The Biden administration is targeting racial inequality too, with major funding proposals for everything from Black maternal health to universal preschool to the country’s historically Black colleges and universities. According to Benn, the relatively few individuals of color in the life sciences have been tasked with carrying out changes. “We’re being tasked to fix the problems, and the problems are bigger than us,” she said. “I’m optimistic that we will make progress. But I do think it requires more: more resources, more people, bigger platforms. It requires more – and it has to be sustained.”

35 MATTHEW DELISA DIRECTOR Cornell Institute of Biotechnology Matthew DeLisa has led the Cornell Institute of Biotechnology since 2019, overseeing its research and entrepreneurial work in the life sciences field. He has teamed up with other experts at Cornell to develop a universal seasonal flu vaccine that could be longer lasting and more effective than the ones that are currently available. The effort is now progressing toward human trials. DeLisa also co-founded the biomanufacturing company SwiftScale Biologics in 2019 alongside Michael Jewett, a professor at Northwestern University, which uses cellfree protein synthesis to drive forward drug programs.
