I LOVE WHEN I tell people that my mother was from Chile and my father was from Cuba. It often catches some people, mostly Latinos, off guard. While both are Latin American nations, their cultures and customs are quite distinct. Even the accents are different. When I go to Cuba, folks say I sound Chilean. And when I go to Chile, I’m often told I sound like a Cuban. There was a lot to know about my parents and where they came from while I was growing up. It’s the same when it comes to learning who New Yorkers are, and it shows why heritage months are worth celebrating. Hispanic Heritage Month kicked off Sept. 15 and began on this date to coincide with the national independence days of Guatemala, Honduras, El Salvador, Nicaragua and Costa Rica. Mexico’s followed on Sept. 16, Chile’s on Sept. 18 and Belize’s on Sept. 21. Cuba will be the last, with its independence day on Oct. 10. I actually didn’t know of all those dates until GovExec, the company that owns City & State, mentioned them in planning our first Hispanic Employee Resource Group. I’ve always identified as a Hispanic journalist. I speak Spanish fluently thanks to my parents speaking so much of it at home that I almost was an English as a second language student. Fellow Hispanic journalists have become close friends over the years. My mentor, former Daily News columnist Albor Ruiz, who passed away in January, was also from Cuba. This monthlong celebration brought back memories of people, my roots and culture that I haven’t thought of in a while with the ongoing pandemic being a distraction. It brings me and others pride that we’re happy to share over 30 days once a year.

After weeks of speculation about the fate of state Health Commissioner Howard Zucker – amid calls for him to be fired – New York’s top doctor offered up his letter of resignation to Gov. Kathy Hochul. It came not long

before Hochul hit the 45-day mark of her time in office, a grace period she had given herself to set up her own administration and figure out what to do with holdovers from former Gov. Andrew Cuomo. Zucker faced intense scrutiny for his role in concealing data about COVID-19 deaths

The situation at the Rikers Island jail complex did not improve in the short time between lawmakers’ high-profile visit on Sept. 13 and now. Since that visit occurred, two more people incarcerated in New York City jails have died, bringing the total death toll there to 12 for the year. This comes after Hochul signed the Less is More Act in response to the deteriorating situation at the Rikers jail complex and released nearly 200 people immediately who would have been eligible under the law, which takes

HOT STREAK Gov. Kathy Hochul was always going to have a honeymoon period after taking over from disgraced former Gov. Andrew Cuomo. After a month on the job, she continues to garner praise. It’s not just New Yorkers who are embracing the new governor. Last week, Hochul appeared with President Joe Biden yet again and later toured One World Observatory with Prince Harry and Meghan Markle.

Alexandria Ocasio-Cortez, wrote a letter demanding that every person at Rikers be released immediately, a prospect that Mayor Bill de Blasio dismissed out of hand. Members of Congress later appealed to President Joe Biden to step in to help the troubled jail complex, while the federal monitor overseeing Rikers has asked for outside security assistance for the island.

VACCINE MANDATE BRINGS STAFFING PROBLEMS

Monday brings the official start to a vaccine mandate for all health care workers in the state with no option for testing, and with it brings concerns over staffing levels as a significant portion remain unvaccinated. As of Sept. 22, 84% of hospital workers had gotten the shot, which means the state was poised to lose 16% of its hospital staff at a time when cases from the delta variant are creeping up. Long-term care workers had better numbers with a 90% vaccination rate, but that still leaves a not insignificant portion of the workforce that may soon be gone. Hochul said that she was working on a plan to address staff shortages in the event that those numbers don’t improve, like bringing in foreign nurses to help fill the gaps. She said that she has been

in conversations with the Department of State about getting temporary work visas to people for this purpose. A state court case about the mandate still has to be decided as well, which may offer a reprieve for health care workers refusing to get vaccinated for now. A state judge has extended a temporary restraining order on the state’s ability to enforce the ban until Oct. 12.

DEPARTMENTAL CHARGES FOR ONE OFFICER INVOLVED IN THE DEATH OF DANIEL PRUDE Over a year and a half after Daniel Prude died at the hands of police in Rochester, only one of the seven officers involved in the incident is facing internal departmental charges. The Rochester Police Department did not specify what the charges against Mark Vaughn are, nor did it say what punishment he will face

or whether he is still an officer on the force. None of the officers are facing criminal charges, a decision announced earlier this year.

NEW YORK CITY APPROVES LANDMARK PROTECTIONS FOR DELIVERY WORKERS

New York City is set to become the first city in the nation to set minimum protections for delivery workers after the City Council passed a package of bills to do just that. The legislation would ensure that delivery workers have access to bathrooms, mandate that they receive all the tips that they earn and set a minimum payment per delivery. De Blasio is expected to sign the measures into law, but it may face legal challenges from major players like DoorDash and Uber.

New York City became the first city in the nation to pass protections for delivery workers, including minimum pay and bathroom access.

Assembly members in the dark on Cuomo impeachment report The Assembly has committed to releasing its much-anticipated report into alleged wrongdoing by former Gov. Andrew Cuomo sometime in the coming weeks, though no one appears to know for sure exactly when. “It’s really hard to pinpoint a day,” Assembly Speaker Carl Heastie of the Bronx told reporters in Buffalo on Sept. 21. “I just know that they’re getting towards the end.” The release of a final report would mark the end of a six-month impeachment investigation that began after multiple women accused the former governor of sexual misconduct, eventually resulting in the governor’s resignation. But the report might be disappointing to those hoping for new information. City & State reached out to all 21 members of the Judiciary Committee and heard back from six of them or their spokespeople. The consensus among those members was that the report was coming, though they were in the dark when Assembly leaders would want to release it – or what it would look like. “I have no idea sadly,” Assembly Member Marcela Mitaynes of Brooklyn said in a text. A spokesperson for Republican Assembly Member Mary Beth Walsh of the Capital Region said she is “hopeful” for an update from investiga-

tors in the upcoming week. Democratic Judiciary Committee Chair Charles Lavine said the report would be out “very soon.” A spokesperson for Heastie declined to comment. The Assembly is no longer pursuing impeachment after Cuomo resigned, but Heastie agreed under pressure to release the findings from their impeachment investigation into a range of scandals that erupted earlier this year. They included accusations of unwanted touching, a cover-up of data showing the true extent of COVID-19 deaths in nursing homes, an abusive work environment and safety concerns at the Gov. Mario M. Cuomo Bridge crossing the Hudson River. The report by Assembly investigators from the law firm Davis Polk appears increasingly unlikely to satisfy a wide range of critics. Allies of the former governor say they have been deprived of due process. Their political opponents say Assembly leaders are not doing enough to hold Cuomo accountable. Witnesses both friendly and unfriendly to the former governor have refused to cooperate with the impeachment probe, further limiting the facts a final report might bring to light in the coming weeks. – Zach Williams

Scoring lawmakers on the environment Which state lawmakers rank best on climate and conservation? By Zach Williams TEAM CAPTAINS

Assembly Speaker CARL HEASTIE and state Senate Majority Leader ANDREA STEWART-COUSINS The legislative leaders are the people who typically get to say what will and will not pass their chambers. A 90% score for Heastie suggests he is doing all that with the interests of environmentalists in mind, but that is only good enough for second place compared to the 97% score that StewartCousins got.

CLIMATE CHANGE IS no game, but environmentalists have figured out a way to score state lawmakers on their performance on the biggest environmental bills of the past year. New York League of Conservation Voters, a nonpartisan advocacy group, graded lawmakers based on their positions on more than a dozen bills before the state Senate and Assembly in the 2021 State Environmental Scorecard released on Sept. 21. Legislation promoting electric vehicles,

lead-free drinking water and even low emissions concrete were all in the mix. A 100% score reflects an ideal environmental record over the past year – at least as far as the NYLCV is concerned. There are 63 seats in the state Senate and 150 in the Assembly. Just a single Republican received a perfect score as well as more than 100 Democrats and one independent. Here is a rundown of who stuck out from the crowd for better or worse.

What have you been doing in office in relation to students going back to school? We have been getting backpacks for kids, as well as school supplies. We’ve actually been giving out huge hospital-grade disinfectant wipes as well as children’s masks. We want to make sure that kids have well-fitting masks that they can wear to school and that are comfortable and that they can wear all day. We’ve partnered with Montefiore Hospital in order to do that and give masks to the community children. We are also having conversations with parents about children who are eligible for the vaccine,

who are over 12 years old, and answering their questions and concerns. What legislative or organizing efforts have you been a part of outside of back-toschool efforts? State Sen. (Michael) Gianaris and I were the lead sponsors of the NY Hero Act to create health and safety standards for the private sector because we want to make sure that workers are protected but businesses stay open as well. We want to make sure that the Department of Health and the Department of Labor are giving the appropriate guidance to businesses

in order to keep people safe and the surrounding community safe. That was signed by then-Gov. (Andrew) Cuomo, passing through the Legislature. In order for it to take effect, the Department of Health needed to make a declaration that COVID-19 was a highly contagious communicable disease that presented a serious risk of harm to the public health, and that without that designation, the legislation wouldn’t take effect. The Department of Health was still unable to enforce health and safety standards, and we know that without enforcement, the policies have no teeth. We sent the letter

to Gov. (Kathy) Hochul, well then-Lt. Gov. Hochul as she was preparing to ascend office, telling her that it was important for the state of New York and the Department of Health to make this declaration so the NY Hero Act could take its full effect. She did that recently. What else has your office been working on lately? We would like the Department of Health to submit a state plan amendment to modernize the state plan for Medicaid. That would allow for us to tap into federal funds and be able to bill the Centers for Medicare

& Medicaid Services for services rendered in schools for children that don’t have individualized education programs (IEPs). Currently, the Department of Education and the Department of Health can only bill Medicaid for services that they provide to children that have IEPs. But in many of our communities, parents may not see IEPs because they’re kind of taboo, and parents don’t want their child labeled. I think at a time where we’re going to see an increase in mental health disturbances for children, we should be working on ways to expand clinical services for all students. – Jasmine Sheena

IKE MANY SORDID STORIES, it all started with a beer. Three 24-year-old New Yorkers walked into an East Village bar. It was another beautiful New York City evening, the kind where you wouldn’t think twice about taking a sip out of your friend’s glass. We were all vaccinated and full of optimism. The delta variant had other plans. The next morning, I was at Jacob Riis beach when I got a text from a friend I’d been with the night before saying she had just tested positive for COVID-19. The next day, I suddenly felt congested and had trouble getting out of bed. I decided to get tested and try to isolate as much as I could right away. Upon receiving my positive test, I was scared. I live with two roommates in a small space, and I wasn’t sure how I could keep them safe until I remembered that my friend had stayed in an isolation hotel when he had COVID-19. I found a phone number online and called it. A hospital employee answered, and then I answered a series of questions that took about 30 minutes. Yes, I had headaches, yes, I had shortness of breath, yes, I was exhausted. After that phone call, they told me I’d hear from them within 24 hours,

and I received another call 15 minutes later letting me know where I would be staying: the LaGuardia Plaza Hotel.

FTER WARNING MY roommates that I would need to come back in to pack, I rushed into my room and did my best to pack 10 days worth of lounge clothes and entertainment in as little time as possible. Sidenote – packing five books for 10 days was not necessary, COVID-19 left me with the mental capacity of a goldfish. Feeling like the Eloise of airport hotels, I got in the cab called for me by the city and headed into 10 days of isolation. New York City Health + Hospitals partnered with Curb, the taxi-hailing app, to inform the drivers of who they are picking up so that the cars are properly equipped with plastic screens between the infected person and the driver. Arriving at the LaGuardia Plaza Hotel, I somehow felt underdressed in a marble space that is normally populated by professionals spending a night there on business in the city but is now entirely staffed by hospital personnel. It felt almost apocalyptic to walk into the cavernous entryway and be greeted by a nurse in head-to-toe personal protective equipment. My bags were searched, and then I was taken to my room. Room 473, which also became my name for the next 10 days, was equipped with two full beds, a TV, a desk, a

They do not allow any alcohol, cigarettes or marijuana in the rooms, and later in my stay, I overheard other guests joking that this felt like being in “the program.” The irony of catching COVID-19 from sharing a beer and then being forced into sobriety for 10 days was not lost on me. Guests who smoke cigarettes or weed are allowed to smoke during the three 15-minute breaks when we were taken outside every day. The nurses held on to all the contraband at all other times.

HE WORST PART of my quarantine was the very beginning when I was the most sick, and I realized I would be stuck inside the same hotel room for 10 days without any in-person contact with my loved ones. It also caused me to panic, knowing that I wouldn’t have control over when I got to go outside. The outdoor breaks were at 10 a.m., 3 p.m. and 10 p.m. If you missed the knock on your door, you missed the outdoor break altogether. My first full day, I slept through the afternoon outdoor break and panicked realizing that I wouldn’t be able to go outside for seven more hours. The first several days passed in a bit of a haze. COVID-19 exhausted me, and I had trouble staying awake for very long or focusing on anything. I was coughing a lot and was extremely congested. Both symptoms subsided after a day or two, but after that, I lost the ability to taste and smell. The tight schedule the nurses kept

was not as bad as you might think. I honestly think I might buy pudding and Jell-O every time I go grocery shopping from now on. The meals were filling, and while I couldn’t taste for half of my time there, I had no complaints.

I helped me to not completely lose my mind. Every day started at 7 a.m. when nurses would knock on the door to deliver breakfast. Breakfast usually consisted of a croissant, orange juice, a piece of fruit and coffee which I always let go cold because I went back to sleep. Being woken up at 7 a.m. when inflicted with a disease that causes exhaustion was not ideal, but the nurses were unfailingly kind. We then had our vitals checked at 9 a.m. and were taken outside at 10 a.m. At around noon, lunch was delivered, and we were left alone until 3 p.m. when the second outdoor break came around. Dinner was at 6 p.m., and my vitals were checked again at 9 p.m. before the last outdoor break at 10 p.m. After a 10-day stay there, I can safely say that I have broken the Guinness World Record for the number of laps walked around a hotel roundabout. We were also checked on at 1 a.m. and 5 a.m. while we were asleep. The locks on the doors to the rooms had been removed,

which originally freaked me out. Everyone could be checked on, and if there was an emergency, a key didn’t have to be procured before entering the room. Hallways were staffed by nurses 24/7, and nobody was ever roaming in them without the nurses’ knowledge or permission. The outdoor breaks were the only time I saw other hotel guests. According to the nurse I asked, the 383-room hotel was nearly full of patients, but the nurses ran such a tight ship that the hallways were always practically empty except for breaks. We were brought down for breaks by floor. After spending 10 days gathering at the floor elevator together, going down the elevator in groups of three and being paraded outside all together by a nurse, our floor started to feel like our team. Go fourth floor! Everyone had a sense of humor about the fact that we all had the coronavirus, and elevator rides consisted of chatter about whether we could smell or taste that day. Speaking of taste, the hospital-style food

T PAINS ME to admit that I spent every night in quarantine watching Harry Potter on FaceTime with my friend who had contracted COVID-19 at the same time as me. But hey, you’ve got to do what you’ve got to do. It only took a day or so to adapt to the hotel schedule, and between working, napping, doing puzzles and watching TV, it wasn’t so hard to pass the time. The day before I left, I got a call from an in-building psychiatrist. She asked about whether I had enjoyed my stay, whether I had felt safe and whether the nurses had been professional throughout. To all of which I emphatically answered “yes.” On my last day, I was oddly a little sad to leave my COVID-19 den but also thrilled to pick out my free Coach purse given to patients at the end of their stay (the brand donated bags to the hospital.) I feel lucky to have been taken care of for free during what could have been a very scary time by a kind and helpful nursing staff. I know that many people have not had the relatively easy battle with the coronavirus that I did, and I hope all New Yorkers that need it can take advantage of the isolation hotel program.

Antonio Delgado flipped the Hudson Valley blue in 2018. Staying out of the limelight might be the only way he’ll hang on to his seat.

2018 WAS a good year for New York Democrats in congressional races. They flipped three Republican seats as part of the “blue wave” that swept both the state and the country. Anthony Brindisi took down Claudia Tenney in the relatively conservative 22nd Congressional District. Max Rose upset Dan Donovan in Staten Island’s 11th District. And Antonio Delgado beat John Faso in the 19th District, which encompasses the rural Hudson Valley region between Poughkeepsie and Albany. All three challengers had national support from the Democratic Congressional Campaign Committee and benefited in their swing districts from a backlash among voters against then-President Donald Trump. However, that favorable atmosphere for Democrats no longer existed in 2020. Tenney made a resurgent comeback in a hotly contested race, ultimately winning back her seat by 109 votes in her conservative firebrand fashion. Rose suffered because he attended a Black Lives Matter protest, losing to then-Assembly Member Nicole Malliotakis who ran on a “law and order” platform. By comparison, Delgado’s reelection was surprisingly uneventful, and he won by a comfortable 11 percentage points. His challenger Kyle Van De Water, an Army veteran, was a relative political unknown, as opposed to Tenney and Malliotakis. And Delgado benefited from a slight Democratic voter enrollment advantage that Brindisi did not have. Now, only Delgado remains from that group of challengers. After the contentious campaign in 2018 where Republicans sought to paint him as a New York City progressive who doesn’t fit in the rural district, Delgado, who is Afro-Latino, has maintained a pretty low profile. He has focused on attending events in his district, passing bipartisan legislation and avoiding national hot-button issues. And so far, it has worked. But Delgado’s deftness at walking this ideological tightrope will be put to the test next year when he faces a strong Republican challenger. CONSIDERING DELGADO FLIPPED a swing district that voted overwhelmingly for Trump in 2016 and only narrowly for President Joe Biden last year, it makes sense that he would seek common ground with Republicans and avoid making waves. “That is politically wise and helpful, but Brindisi did the same thing,” said Utica College political science professor Luke Perry. “The difference was that Brindisi’s impeachment vote and the rise of national scrutiny of policing helped mobilize conservatives in a Republican district, defeating a moderate and relatively popular Democrat.” Perry also pointed out the slight Democratic voter enrollment advantage in the district was helpful when flashpoint national issues came knocking, like Delgado’s decision to vote to impeach Trump, and he was able to weather them better than Brindisi. Delgado has so far persevered, but he’s in a somewhat precarious situation, even with the voter enrollment advantage, to maintain his bipartisanship. He consistently works with members from across the aisle to pass legislation and get critical funding for his district. He worked with Rep. Lee Zeldin, a staunch Trump supporter and now GOP gubernatorial front-runner, to get the Direct Support for Communities Act included in the American Rescue Plan that resulted in $400 million for the 19th District alone. He recently reintroduced his Small Farms to School Act to help farmers by incentivizing schools to source from them with bipartisan support from a Michigan Republican. And Delgado appears alongside Republican officials at press conferences to announce new accomplishments or to discuss pressing issues like access to broadband in rural communities, with all sides speaking highly of the bipartisan cooperation on display. “The priority is to get stuff done,” Delgado bluntly told City & State. “That’s the priority. That’s it. Get stuff done.” That pragmatism has gained him praise from local Republicans. “I have a lot of respect for him,” said Assembly Member Chris Tague, who represents Schoharie County, the smallest county in Delgado’s district, and also serves as its Republican Party chair. “I joke with him all the time and tell him that I carry a change of registration in my car for him.” He said that he has an excellent working relationship with Delgado, and that they largely avoid conversations about issues where they differ in favor of focusing on areas of common ground to help the district. “I guess it’s a unique relationship, but, you know, personally, I like Antonio a lot,” Tague said. His stance is even more interesting given the fact that he is supporting Marc Molinaro, Delgado’s newly announced Republican opponent in 2022. Tague spoke with City & State on his

way to introduce Molinaro at his campaign kickoff. “There are two what I consider to be good public servants that are going to be running for this office,” Tague said, explaining that ultimately he aligns more with Molinaro as a fellow Republican. Other Republican local leaders have spoken of their positive experiences working with Delgado. “Days like this should make you smile,” said Sullivan County Legislature Chair Rob Doherty at an August event announcing a $1.1 million investment for a rail trail in the county. “It’s when the government works the way it’s supposed to work.” Assembly Member Jake Ashby told The New York Times in 2019, at the height of partisan divisiveness amid impeachment discussions, that “he’s been good to work with.” Even such small gestures of interparty goodwill are becoming increasingly uncommon. IN THE NEARLY three years since Delgado took office, he has focused on two main goals. “The first is to really connect with my constituents, really connect with folks on the ground, the communities I represent, and do that in a very intentional way,” Delgado said in an interview. He goes about that in large part through town halls, a point of pride for him. At the end of his inaugural term in Congress in 2019, Delgado said in a brief floor speech at the end of session that town halls were “a true highlight” of his first term. He held 33 in 2019, one in each of the 11 counties that make up his 8,000-squaremile district – bigger than Connecticut and Rhode Island combined, he pointed out. Now, that number is up to 63 town halls, the most recent one was held in Schoharie County a few weeks ago. It started, as they always do, with the Pledge of Allegiance, an update on his work and the ground rules – questions only, no monologues. Delgado’s social media feeds show that town halls aren’t the only times he pops up around his large district. Judging by the photos and videos he posts, he makes sure to get out to local Democratic Party events to mingle with candidates, county fairs and to hold additional forums on issues outside of his many town halls. He even posts videos detailing how he traversed around the district that day or week. “It’s been a long day and it’s still going,” Delgado said in a video on Aug. 31. “Started the day off in Delaware County and ended the day in Schoharie, where I held my 63rd town hall.” Even as impeachment took over the news cycle in December 2019, Delgado was traveling nearly 200 miles around his district for various local events, focusing on legislation he wanted to

pass before the end of the session rather than new evidence on Trump coming to light. But Delgado denied that he goes to such lengths because of the criticism he faced in 2018. “What informs my approach is, this is to me what good governance and representative governance entails,” he said. All this to better inform the second goal of his time in office: to pass and introduce legislation to help his constituents. While this may be a given for any lawmaker, actually getting bills signed into law is difficult, especially for newer members of Congress. Take Rep. Alexandria Ocasio-Cortez, undoubtedly a national figure and progressive leader – she has so far had no standalone bills of her own signed into law. Delgado so far has two standalone bills signed into law, and 10 more that became law as part of omnibus legislation or through an amendment, according to his office. The two standalones were signed by Trump, including the Family Farmer Relief Act of 2019, a highlight of Delgado’s tenure so far that helps economically distressed farmers reorganize their debt. “What I tried to do from the very beginning is figure out where there’s potential for common ground, and where I can seek out bipartisan opportunities,” Delgado said. Delgado doesn’t take as many rhetorical stances as some of his downstate colleagues on hot-button issues, nor has he insert-

ed himself into national discussions like his next-door district neighbor and fellow moderate Rep. Sean Patrick Maloney, who heads the Democratic Congressional Campaign Committee. That’s not to say that he remains completely silent – he applauded extensions of the eviction moratorium and denounced the new Texas law that banned abortions after a fetal heartbeat was detected. But he doesn’t back the idea of expanding the U.S. Supreme Court, a resurgent issue in the wake of the court’s decision to allow the Texas law to stand. Delgado was an early supporter of police reform bills in 2020 – potentially risky for a Democrat representing a swing district – but he was careful to distance himself from the movement to defund the police. “There is nothing in the bill that zeroes out police budgets,” he told MSNBC at the time. “Let’s not focus on the noise.” More recently, when confronted about election integrity at a July town hall in the vein of Trump’s attempt to overturn the 2020 election results through baseless claims of voter fraud, Delgado chose not to rail against Republicans. Instead, he spoke about protection from foreign influences and said that while election integrity is important, the data does not support any evidence of widespread voter fraud. This applies as well to signing on to bellwether legislation like the Green New Deal

Staying on message, Delgado said that he is hyperfocused on his district. “For me, it’s about making sure that I introduce bills that are going to address the needs and concerns of folks that I interact with on a consistent basis,” he said.

Instead, he introduced his own bills – one to create a public health insurance option and the Green Jobs and Opportunity Act to help the nation reach its climate goals while stimulating job growth. “My focus is on my legislation,” Delgado said when asked why he isn’t also supporting the bills backed

AFTER A QUIET reelection campaign in 2020, Delgado faces a tough challenge from Marc Molinaro in 2022. The Dutchess County executive and former gubernatorial candidate comes in with an extensive government track record, name recognition and a reputation as a pragmatic moderate, much like Delgado. Although it’s unlikely to be as brutal as the 2018 race that featured attacks on Delgado’s rap career from well over a decade ago, the national Republican Party will surely get involved again. Press releases from the National Republican Campaign Committee for the Northeast region have often featured Delgado over the past three years, generally trying to tie him to controversial positions held by the likes of Ocasio-Cortez and other progressives. “As New York’s crime rate skyrockets, Antonio Delgado’s campaign donor Alexandria Ocasio-Cortez is calling for the abolition of prisons” read one release from July, seemingly equating a $5,000 donation from her to Delgado as him taking a stance on a controversial issue he has rarely, if ever, directly spoken about. “Delgado and AOC: Team Abolish Prison” the subject line of the email read, despite the pair rarely working, or even appearing, together. There was a point when the pair might have actually seen eye-to-eye on some things. In 2006, Delgado – a Rhodes scholar and Harvard educated lawyer – released his only rap album, the source of most Republican attacks against him. While the majority of those attacks were racist, lyrics like, “I wanna see a righteous capitalist, if it’s possible for one to exist,” and “Dead presidents can’t represent me, not when most of them believe in white supremacy,” sound as if they could be taken straight from Ocasio-Cortez. Far from distancing himself from his past musical endeavours, Delgado had some of his lyrics framed and placed in his office, and he quoted them during a 2019 commencement speech. He defended his music and has asserted that he still holds the same beliefs about racial equity and economic justice that he did then. But he has certainly shied away from the

most radical parts of his rhetoric as he keeps a healthy distance between himself and the progressive wing of his party. Delgado told City & State that he has “long believed, and still believe(s)” that income inequality in the country must be corrected, though he did not directly criticize capitalism. And while he has spoken about racism in the country and that he has faced – he represents a district that is 90% white and is the first person of African American or Hispanic descent to represent any part of upstate New York in Congress – the issue of whether he considers former presidents to be white supremacists is not a topic that has come up at his town halls. So the tightrope walk continues. For his part, Molinaro, who did not return a request for an interview about his campaign, indicated that he did not have any personal malice toward Delgado when he launched his campaign. “The truth is, I don’t dislike our member of Congress, I don’t,” he told supporters who attended the event in Rhinebeck – which also happens to be where Delgado lives. “I just don’t think he’s interested in taking up this most historic challenge.” But it didn’t stop him from attempting to tie Delgado to disgraced former Gov. Andrew Cuomo, saying he is more interested in raising millions of dollars from “the billionaires and the special interests” like Cuomo, rather than doing work to improve the district. It’s an attack that seems to be at odds with how other Republicans have described Delgado but a far cry from linking him with the most controversial of left-wing opinions. Delgado’s campaign pointed to his many town halls, bills he has had signed into law and funding he has gotten for the district in response. Delgado himself had separately mentioned his refusal of corporate PAC money and his firm belief in overturning the Citizens United ruling. The biggest unknown going into 2022 is how redistricting will change Delgado’s district and its dynamics. The state Independent Redistricting Commission recently released two draft plans for congressional districts – one supported by Democrats and the other by Republicans – that offer very different visions for this region of New York. Whether Delgado benefits by gaining a greater Democratic enrollment advantage, has the misfortune of losing the advantage he has now or finds himself in the unenviable position of ending up in someone else’s district, it’s impossible to guess what the 2022 election cycle might hold for the vulnerable Democrat. Wherever those district lines are drawn, he’ll probably be in every corner, hosting a town hall.

ATINOS ARE A RISING FORCE in U.S. politics. The growing demographic makes up nearly a fifth of the population both in the country as a whole and in New York, while constituting 30% of New York City’s residents. Although New York has yet to elect a Hispanic governor, mayor or U.S. senator, one of the state’s most prominent politicians is Rep. Alexandria Ocasio-Cortez, a Latina, and she has been floated as a candidate for all three posts. Of course, Latinos are not a monolith. While President Joe Biden won the Hispanic vote, much has been made of the small but significant gains made by former President Donald Trump in the 2020 election. Even in New York City, Rep. Nicole Malliotakis, a Staten Islander of Cuban and Greek heritage,

acts as a counterweight to progressives like Ocasio-Cortez. And while Puerto Ricans and Dominican Americans are the largest nationalities in New York City’s Latino population, New Yorkers hail from many other Latin American countries as well. To mark Hispanic Heritage Month, City & State is publishing its latest Power of Diversity: Latino 100. The list, compiled in partnership with journalist Gabriel Arana, highlights the most influential Latinos who are serving in public office, running businesses, leading nonprofits and advocating for policy changes in New York. Roughly half of the list is made up of those with Puerto Rican heritage, and around a quarter are Dominican American, with at least a handful of individuals from Cuba and Colombia and nearly a dozen other countries of origin represented as well.

7 JESSICA RAMOS STATE SENATOR State Sen. Jessica Ramos has used her position as chair of the state Senate Labor Committee to fight for the rights of workers. She led the charge to create New York’s $2.1 billion Excluded Workers Fund, which will provide payments to undocumented workers excluded from unemployment insurance and stimulus payments. Ramos

also sponsored the Child Poverty Reduction Act, which passed in June, and legislation to curb wage theft among construction workers.

Former New York City Council Member Ritchie Torres made history last year by becoming one of Congress’ first two openly gay, Black representatives. The Afro Latino lawmaker has pledged to preserve and expand public housing, having grown up in public housing across a Trump-owned golf course, as well as making the child tax credit permanent. As a member of the House's Financial Services Committee, Torres is among a cadre of lawmakers calling for rental vouchers to be included in the Democrats’ infrastructure spending bill.

8 ERIC GONZALEZ BROOKLYN DISTRICT ATTORNEY Amid calls for criminal justice reform in the wake of George Floyd’s death, Eric Gonzalez has doubled down on his reputation as one of the nation’s leading progressive prosecutors. Gonzalez is the first Latino district attorney elected in New York and notably stopped prosecuting low-level pot offenses and prostitution charges. He also backed reforming discovery rules to grant defendants better access to evidence and supported granting parole to those who have pleaded guilty and served a minimum

As chair of the Hospitals Committee, Rivera was a key voice on the city’s COVID-19 response. The Lower East Side lawmaker was also instrumental in setting up a $250,000 abortion fund for women whose care is not covered by insurance or Medicaid as well as passing legislation requiring city-run health clinics to provide longacting contraceptives.

Vincent Alvarez has been effective at coordinating the efforts of public and private sector unions across the five boroughs. As a champion of the NY Hero Act, a coronavirus-era worker protection measure, Alvarez was also appointed to a committee advising the state on erecting a monument to essential workers during the pandemic.

13 GUSTAVO RIVERA STATE SENATOR As the coronavirus pandemic brought inequities in health care to the forefront of New York politics, state Sen. Gustavo Rivera’s voice as an advocate for progressive reform has gotten louder. Along with Assembly Member Richard Gottfried, Rivera has been the main advocate for the New York Health Act, which would bring singlepayer health care to the state. He was an outspoken critic of then-Gov. Andrew Cuomo’s policies around COVID-19 and nursing homes – which included undercounting the number of deaths in these facilities.

As a lawyer who put herself through school working 50-plus hours a week, Cruz now advocates for countless other immigrants. In addition to pledging to build a immigrant welcome center in Queens, she advocated for the Green Light Law, which allows undocumented New Yorkers to obtain driver’s licenses. Last month, she and other lawmakers called on the Biden administration to resettle Afghan refugees in New York.

20 MARCELA MITAYNES ASSEMBLY MEMBER A tenant organizer who ran with the backing of the Democratic Socialists of America, Marcela Mitaynes became an Assembly member this year after beating decadeslong incumbent Félix Ortiz in the Democratic primary to represent District 51. The Brooklyn lawmaker began her career in advocacy after being evicted from her rent-stabilized apartment of 30 years. The Syracuse City School District recently secured $128 million in federal funds to help address learning loss. Alicea started in SCSD 38 years ago as a teaching assistant in a kindergarten class. He then rose through the ranks to become chief operations officer of the district before assuming his current role.

76: THE RISE OF LATINOS IN THE NEW YORK CITY COUNCIL New members would bring it more in line with the city’s population.

T

HE NEW YORK CITY COUNCIL, which currently has 11 members who are Latino, could see that number rise to 15 at the start of next year. That would mean an increase from slightly more than a fifth of the seats that Latinos now hold in the 51-member body to well over a quarter – while also matching the 29% share of the New York City population that identifies as Hispanic or Latino. Of the 11 Latinos serving in the City Council, six are on their way out, while five – Carlina Rivera, Diana Ayala, Oswald Feliz, Rafael Salamanca Jr. and Francisco Moya – are on track to win reelection after winning their primaries in June. Their ranks will be bolstered by most if not all of a contingent of 10 Latino candidates who won their primaries for the first time this summer, assuming they avoid any unexpected upsets in the November general election. Perhaps the most prominent among these newcomers is Tiffany Cabán, who first made a name for herself by nearly defeating the establishmentbacked Melinda Katz in the Queens district attorney race in 2019. She’s a member of the LGBTQ community, and the

former public defender ran on a platform of radical criminal justice reform, describing herself as a “police abolitionist” and staunchly supporting the defund the police movement. After a stint working for the Working Families Party, she handily won the Democratic primary for Queens District 22, where she and other leftist members of the City Council stand to be a major foil to Brooklyn Borough President Eric Adams, who won the pivotal Democratic mayoral primary by distinguishing himself as a law-and-order candidate. Assembly Member Carmen De La Rosa, who won the Democratic primary for the Northern Manhattan seat being vacated by the termlimited City Council Member Ydanis Rodriguez, will enter the council with significant legislative experience and something akin to seniority among the incoming members, having spent nearly five years in the state Legislature. De La Rosa, a Dominican immigrant, was also the lead sponsor of the 2019 state DREAM Act. The legislation made young undocumented immigrants eligible for financial aid to attend college in New York, as well as this year’s $2.1 billion

Velázquez, a community board member with a background in corporate finance and accounting, came a few percentage points short of beating New York City Council Member Mark Gjonaj in 2017, which appears to have factored into the incumbent’s decision not to run again this year. Farías, an Afro-Latina who worked in the City Council for nearly five years, lost her bid against the party-backed Rubén Díaz Sr. four years ago, but just like Gjonaj, the embattled Díaz opted to stay on the sidelines in 2021. With significant support from elected officials and unions, both candidates broke through. Christopher Marte, a community activist, fared better this year as well without having to try to topple an incumbent. In 2017, Marte mounted an unsuccessful challenge against New York City Council Member Margaret Chin in lower Manhattan. Term limits kept Chin off the ballot this cycle, and Marte notched an impressive primary win against rival Jenny Low, who had garnered major support from a long list of elected officials and unions.

Sandy Nurse is also seeking a council seat for a second time, although this year is the first time she actually made it onto the ballot. Last year, Nurse was stymied by the cancellation of a special election for former City Council Member Rafael Espinal Jr.’s old Brooklyn seat in Bushwick due to COVID-19 and a failure to qualify for the primary thanks to shifting petition requirements. This year, she got a chance to run against last year’s winner, Darma Diaz, and won. The other four Latinos who won their primaries were

first-time candidates who overcame crowded fields for seats that opened up due to term limits. Shaun Abreu, a tenant attorney with the New York Legal Assistance Group, won the primary in New York City Council Member Mark Levine’s Northern Manhattan district. Alexa Avilés, a community organizer and program director for the Scherman Foundation, came out ahead this summer and will succeed New York City Council Member Carlos Menchaca in Sunset Park, Brooklyn. Jennifer Gutiérrez served as chief of staff to Council

Member Antonio Reynoso and easily won the race to replace her boss – who’s moving up to be the next Brooklyn borough president – in a district spanning portions of Bushwick, Ridgewood and Williamsburg. Pierina Sanchez, who has held positions at City Hall, the Regional Plan Association and the Pratt Institute, will succeed New York City Council Member Fernando Cabrera in a Bronx district that includes parts of Morris Heights, University Heights, Fordham and Kingsbridge. For all the gains, however, the sheer numbers may not end up being the full story in reflecting the rise of Latino power in the New York City Council. With two Black men and a white man set to hold the three citywide offices filled by voters starting next year, a Latina may end up serving as the next council speaker. Carlina Rivera, Diana Ayala and possibly even Tiffany Cabán are in the running for the key leadership post, and one of them could be well positioned to secure enough votes from colleagues old and new by the end of the year.

ALICKA AMPRY-SAMUEL Losing reelection did not spell the end for New York City Council Member Alicka Ampry-Samuel, who has failed upward to become regional administrator for the U.S. Department of Housing and Urban Development. It also doesn’t hurt to know Chuck Schumer, who gave the council member his seal of approval. A former NYCHA official, Ampry-Samuel has more relevant experience than her Trump predecessor.

Bill de Blasio made time to talk with the ex-Duke and Duchess of Sussex, Harry and Meghan. He was also joined by Gov. Kathy Hochul, his wife Chirlane McCray and their son Dante. Imagine being a fly on the wall during that meet and greet! We can only assume that Harry and Hochul bonded over roasting the men who kept them in their shadows for years, while Bill asked Meghan for advice on how to get a Netflix deal.
