THE DEATHS OF George Floyd, Breonna Taylor and Daniel Prude – just to name a few of the many Black Americans killed by police – have brought about a reckoning. In New York, lawmakers responded by stripping hundreds of millions of dollars in funding from the New York City Police Department, banning chokeholds and opening up the disciplinary records of officers in an attempt to expose cops who break the rules. And while the pace of reforms has slowed since this summer, broader societal efforts to confront institutional racism are ongoing. One stubborn issue, however, is the lack of Black people in positions of power. Yet in New York’s political sphere, there have been promising developments in recent years. Assembly Speaker Carl Heastie and state Senate Majority Leader Andrea Stewart-Cousins are both Black, as is state Attorney General Letitia James. Brooklyn Borough President Eric Adams is a frontrunner to be the next mayor of New York City. And congressional candidates Ritchie Torres, Jamaal Bowman and Mondaire Jones are all set to head to Washington next year, and Jackie Gordon, the Democratic nominee seeking to succeed Rep. Pete King, may join them. In this week’s magazine, we highlight these individuals – and many more – on our latest Black 100 list, assess whether Gordon can win over Long Island voters, and preview what’s next for the Black Lives Matter movement in New York.

Now we all know that President Donald Trump, a billionaire, pays just $750 in federal income taxes – and that’s in a good year. That’s just one of the revelations in the September surprise from The New York Times tax team, which made the front page last week – gilded golf clubs and all – after more than five years of Trump refusing to release his tax returns.

the Suffolk County district attorney’s office. At the heart of the scandal was James Cahill, the politically connected president of the New York State Building and Construction Trades Council with ties to Cuomo. Prosecutors said Cahill and other union leaders, all current or former members of Steamfitters Local 638 on Long Island, took bribes to corrupt the construction industry “at the expense of labor unions.”
TRUMP TESTS POSITIVE FOR THE CORONAVIRUS
President Donald Trump said that he and his wife, Melania, tested positive for the coronavirus and will quarantine for two weeks. The announcement came just a month before the election, throwing the future of his campaign into doubt. Trump may not be able to campaign for the next two weeks, and he may not be able to attend the next presidential debate on Oct. 15. Trump’s diagnosis caps off a roller coaster week for the president, which

LOVELY WARREN INDICTED
A grand jury has indicted Rochester Mayor Lovely Warren on two felony campaign finance charges related to her 2017 mayoral reelection campaign. The first is for a scheme to defraud and the second is an election law violation. Warren denies any wrongdoing. If convicted, she would be removed from office and lose her pension. She could also face up to four years in prison, although the likelihood that she would actually serve time behind bars is low. The indictment comes at a turbulent time for Warren as she faces ongoing scrutiny over the police killing of Daniel Prude and the alleged cover-up of Prude’s death.

Can the NYC Board of Elections be reformed? It seems with each election year, the New York City Board of Elections fails in a new, previously unimaginable way. After the board admitted that a vendor error left up to 100,000 people with the wrong absentee ballot envelopes, renewed calls have emerged to reform the agency. And now that Democrats control both chambers of the Legislature, it may actually be possible. City Council Member Carlina Rivera was one the people who called to replace the board’s Executive Director Michael Ryan following the June primary, when thousands of people didn’t get their absentee ballots in time to vote. “Every election, we continue to be disappointed, so there has to be a reckoning at the top,” Rivera told City & State. In a July op-ed, she laid out several shortterm reforms to help the general election run more smoothly than the primary. Most were policies specifically aimed at the upcoming election such as sending absentee ballot applications to all voters. Some needed state approval, like creating drop boxes for absentee ballots. Others, like properly vetting all vendor contracts, did not. Rivera noted that the board evidently ignored her recommendation about vendors. In the Brooklyn ballots case, the city board awarded the vendor Phoenix Graphics a $4.6 million no-bid contract in May, meaning the upstate firm didn’t have to compete with other bidders. “There’s a systemic problem,” Council Member Antonio

Reynoso told City & State. He recently delayed the appointment of the Brooklyn Democratic commissioner whom the county party tried to rush through, to better vet the nominee. Reynoso said the first thing he asked her was if she would make political hires based on party leader recommendations, or hire truly qualified people. He said she committed not to make political hires, which he said was important to him, but that this alone doesn’t change the structural problems. Rebuilding the state and New York City BOEs from the ground up would require a state constitutional amendment. A proposed amendment must pass two consecutive Legislatures before going to the voters as a ballot referendum. The process would take a minimum of three years if lawmakers passed something in 2021. The process also might be slowed down by reticence from the governor. While Cuomo is not against reforming the Board of Elections, he hasn’t indicated he’ll be putting his political muscle behind the effort. But Reynoso, at least, predicts that Cuomo and other state leaders will take the initiative soon. “Give it a couple of months,” Reynoso said. “After this election, Gov. Party bosses get a lot of influence, but also a lot of criticism from those who feel like the county party is too insular. Why do you want this job? To lead the borough that’s given me so much, it’s an honor. Perception is one thing, reality is another. We can bring people together. We can bring the bright, emerging bench together with folks who are more seasoned in government. We’ve brought on individuals from a variety of ethnic backgrounds to truly reflect what the borough of the Bronx is about. There’s way more than Black and Latino – there’s
Asian, there’s South Asian. We have a significant West African population. Folks from Bangladesh. We are a significant melting pot. When we’re together, we’re going to be able to do something really great for this borough. The Democratic county leaders of the Bronx, Brooklyn, Queens and Manhattan are all Black. What does that say about the state of the party in the city? Leadership matters. Representation matters in leadership. We have diverse leadership leading counties. It’s a good role to be in.

I’m also married to a Puerto Rican woman. My children are Afro-Latina, my wife is an AfroLatina. While yes, I’m an African-American, there is consideration for many other views and many other cultures specifically within my own household. So I’m proud to be Black. I think being a Black county leader is critical in the day and age of Black Lives Matter. But it’s important to make sure that we are leading for all people. You came into politics working for Heastie. And for your reelection this year you were en-
dorsed by the Working Families Party and Rep. Alexandria Ocasio-Cortez. How do you define yourself politically? There are certain things that people would see that they may not think I’m progressive on – I don’t know what those things are. But I’m huge in the criminal justice space. I’m huge with worker-owned businesses and worker cooperatives. It’s funny, Phil Boyle just texted me congratulations, a Republican state Senator, to say, ‘Congratulations, Mr. Chairman, I hope you still have time for basketball.’ When you
treat people like people and you’re not locked into partisanship for the sake of being partisan, you get a lot more out of people. There haven’t been as many women elected in the Bronx as in other boroughs. Is it the county committee’s role to help elect women? Yes, we could be doing a lot more to elect women in our borough, without a doubt. We have to ensure that we are looking at the right candidate in any race and choosing anybody for the sake of just choosing them is a disservice to anyone. Should we be electing more women to office in the Bronx? Yes.

FTER YEARS OF public pressure and litigation to get President Donald Trump to release his tax returns, some details about those records have finally emerged thanks to a bombshell report from The New York Times. The article revealed countless lurid details about the president’s finances and his businesses, though to protect its sources the Times did not share copies of the tax records. The reporting reveals how Trump paid little in federal taxes, despite his supposed wealth, using potentially suspicious practices to minimize his tax liability. This could trigger investigations by the New York attorney general and Manhattan district attorney, since the Trump Organization is based in New York and Trump lived there during the years in question. Trump paid only $750 in federal income taxes in 2017, while serving as president, and he didn’t pay any federal income taxes at all in 11 of the 18 years that the Times examined. He also designated plenty of seemingly personal spending as business expenses, such as more than $70,000 for hairstyling while starring on NBC’s “The Apprentice.” His daughter Ivanka Trump appears to have received payments set aside as “consulting fees” that helped

questions there,” said Rebecca Roiphe, a professor at New York Law School. “So it doesn’t really answer questions, it raises questions.” It’s unclear how the new information will affect existing investigations into the president, especially since some of this information may already be known to prosecutors. “The (New York) investigation remains almost entirely secret, apart from hints dropped in various court filings,” Andy Grewal, a tax law expert at the University of Iowa College of Law wrote in an email to City & State. But experts say several points raised about Trump’s taxes look like possible red flags. One is to look into the legitimacy of the millions of dollars in business losses

Trump reported, which reduced his overall taxes. “What we don’t have from the Times story is we don’t have the documents that back up these numbers,” said Bennett Gershman, a professor at Elisabeth Haub School of Law at Pace University and former prosecutor with the Manhattan district attorney’s office. “That’s going to be what’s going to determine whether or not he’s guilty of criminal conduct because, right now, on the surface, we can’t say whether or not he’s cheated on his taxes or whether he has just behaved like an aggressive businessman.” The consultant fees and business expense deductions covering what look like personal expenditures could also draw interest from prosecutors. In addition, the Times shares details about Trump’s Seven Springs estate in Westchester County. While Trump and his family members seem to refer to the property as a retreat, it is classified as an investment property rather than a personal residence, which has allowed him to write off $2.2 million in property taxes over the past six years. He has also claimed a $21.1 million charitable tax deduction on the estate after signing a deal in 2015 with a land conservancy to not develop most of the property. The state attorney general’s office is looking into whether the president inflated the value of the property at that time. “There are all these possible red flags, and you could dig underneath them and find nothing, or you could find something but something that’s not provable,” Roiphe said. “Or an investigator could dig through this and find lots of illegal activity.” Roiphe said the report is likely not going to have much of an effect on Vance’s ongoing push to get Trump to release his tax records, but having this information in the public record could bolster his case that his motivations aren’t politically motivated. A lot hinges on investigators getting these documents. Gershman said that it’s only a matter of time before they succeed. “All of this information is out there and is going to be obtained by the prosecutors and by the attorney general,” he said. “Nothing is going to be withheld anymore. Vance has already been stuck in a legal battle to access Trump’s tax returns, as part of a criminal investigation into the president’s business, while the attorney general has been investigating the president and the Trump Organization for possible fraud by lying about the value of his assets. “If I were any investigator, I would want to follow up on a million and one different

Congressional candidate Jackie Gordon is an immigrant and a military veteran. Can she make history in the home of Trump boat parades?

ABYLON, ON THE South Shore of Long Island, is dotted with patriotic – sometimes nationalist – symbols, such as the weather-worn signs on an auto body shop outside of the Amityville station on the Long Island Rail Road, that say, “God Bless America,” “Support Our Troops,” and “Get the U.S. out of the U.N.” That may make it look like Trump Country, but Babylon accounts for a significant portion of New York’s 2nd Congressional District, home to one of the most hotly contested House of Representatives races this year. Jackie Gordon, the Democratic nominee to replace longtime Republican Rep. Pete King, served on the Babylon Town Council for 12 years before stepping down to run for Congress. She will partly rely on Babylon, where she’s well known and has won numerous elections, to swing the election in her favor. If she succeeds, it would be historic: Gordon would become the first Black woman elected to Congress from a New York district outside of New York City. Her main selling points in the swing district are that she’s a veteran of both Iraq wars and mainstream Democratic politics. But to flip King’s seat in November, Gordon will have to court swing voters without alienating those who voted for Trump. The president carried this district by 9 percentage points. That would pose a challenge for any Democrat. But for a Black woman facing a suburban constituency that could be susceptible to Trump’s racist fearmongering, it will be a balancing act. The child of Jamaican immigrants, Gordon, 55, lives in a white-shingled house in Copiague, an unincorporated hamlet within Babylon, a few minutes away from a residents-only beach at Tanner Park. On a windy morning in September, Gordon met me there, across from the Great South Bay, to discuss her candidacy. Gordon was characteristically buoyant as she greeted me from the boardwalk. “You look 12!” she said, before suggesting

we sit under a gazebo near the fishing pier. The small white structure was dedicated in memory of Eagle Scout Joseph Ferriso, who died in a car accident in 2015. Ferriso had been in Gordon’s son’s Boy Scout troop, and Gordon spoke at the gazebo’s dedication ceremony. Gordon spoke loudly during our interview, to project her voice – thin, musical and inflected with a West Indian lilt – over the motor of a nearby lawnmower. The district, which King has held for 14 terms, is made up of large townships, small villages and salty waterfronts in the farther suburbs of New York City. A generation ago, it was mainly white and Republican. The district is now more evenly divided between the parties. But it didn’t swing so much as it evolved, for primarily the same reason that a lot of other suburban communities have: Over the years, newcomers, many of whom are people of color, have arrived from the city as well as other countries, and they have brought their Democratic alignment with them. In 2018, King was challenged by Liuba Grechen Shirley, a political novice who only lost by 6 points. King, who had long been thought unbeatable, looked vulnerable in 2020. At age 75, he decided not to run for reelection. With the seat now open, this race would likely be a toss-up, almost regardless of whom the parties nominated. But Democrats made an interesting choice to coalesce around Gordon. She has the benefit of the Democratic organization in Babylon, which is the home of the powerful Suffolk County Democratic leader, Rich Schaffer. She also has a chance to inspire a higher than normal percentage of nonwhite voters to come to the polls, outside of the Obama years. And she could peel away a significant segment of white moderates, who are alienated by the divisiveness and intolerance of President Donald Trump and his Republican Party. Part of the legacy that King will leave behind is stoking the flames of the immigration issue, which has resonated with some white residents opposed to the growing Latino population. In 2018, King attended a forum alongside Trump in Bethpage, where the president railed against the “menace” of the Salvadoran gang MS-13 in Long Island and called for tougher immigration laws. The issue of immigration is personal for Gordon. Her family arrived in New York in the 1970s, in search of something better. She relayed the story with pride, difficulty, and, at times, intense emotion. She also talks about being an immigrant in her campaign commer-

cials. “I understand the complexities of immigration,” she said in one ad, “because I am an immigrant.” When asked whether her family ultimately found what they were looking for in the United States, Gordon appeared slightly taken aback by the question. “I’m talking to you as a candidate for Congress,” she said. “What do you think?”
T
HE DISTRICT GORDON is vying for has a Cook Political Report partisan index score of R+3, which means that in the 2012 and 2016 presidential elections, the district performed an average of 3 percentage points more Republican than the nation did as a whole. In November, Gordon will face Republican Assembly Member Andrew Garbarino, who represents the 7th Assembly District, which covers part of Suffolk County on the South Shore, including a slice of the towns of Brookhaven and Islip, along with Fire Island, Bay Shore, Bohemia and Patchogue. Garbarino has endorsements from King and the U.S. Chamber of Commerce, the benefit of historical precedent, and he’s white in a district where that could matter. Asked if she thinks her race might negatively affect her chances, Gordon avoids implicating any potential voters. Instead, she focuses on the voters who might be energized by her identity. “I think it matters to some voters in the district. There is about a 9%, 10% Black population,” Gordon said. “There’s about a 22% Latinx population. Those people have never seen representation ever in the history of this seat. So yes, it would definitely matter to them.” Gordon’s estimates are close, but it’s worth noting that newer immigrant groups will be underrepresented among the electorate, as many aren’t citizens. The 2nd Congressional District has a 9% Black population and a 8% Black voting age population. While the Latino population is 24%, the Latino voting age population is only about 17%. Gordon’s platform is moderate, and in her campaign, which has endorsements from former President Barack Obama and Democratic vice presidential nominee U.S. Sen. Kamala Harris, she has leaned heav-

ily on her military background. On Long Island, which has the largest concentration of veterans in the state, this could be the most essential factor of her identity that resonates at the polls. “She brings a lot to the table that blows up whatever myths or biases that people might have about officials and candidates of color,” said Lawrence Levy, the executive dean of the National Center for Suburban Studies at Hofstra University. “She is not anyone who can be accurately characterized as a full-throated left-winger. She has been able to get votes across party lines and in neighborhoods where Democrats don’t always do so well, certainly not in national elections.” But on Long Island, which is also one of the most segregated regions in the country, “You always have to wonder how much race will play,” Levy said. “Is there a silent racist majority out there that we sometimes see pop up when developers propose affordable housing projects? We’re already seeing some advertising coming from Republicans that put her picture in ads, where that’s not normally the case, as if they want to remind voters that we’re talking about a Black person.” That’s an old part of the Republican playbook, a way to play to suburban racial anxieties. “It has worked less and less as our communities have become more and more diverse, but the gambit here is that it will resonate with just enough (white) voters to get them out to the polls, or not to consider a Democrat,” Levy said. Newsday published an investigation last year that uncovered widespread evidence of unequal treatment by Long Island real estate agents on the basis of race. The three-year investigation revealed that agents frequently steered white potential homebuyers toward areas with the highest representations of white residents and minorities to integrated areas, contributing to racial segregation in the region. Trump’s rhetoric has played into these racist fears with his constant attacks on the 2015 Affirmatively Furthering Fair Housing rule, which required local governments that receive federal aid to study and find solutions to unfair and discriminatory housing practices in their communities. Development Secretary Ben Carson eliminated the rule in July. However, there is also evidence that racially coded attacks won’t work against Black candidates in suburban and rural New York anymore. Republicans ran dog whistle attack ads against congressional candidate Antonio Delgado in the Catskills in 2018, based on his rap career, and Delgado still won. And in two much more Democratic, largely suburban New York congressional districts, Jamaal Bowman and Mondaire Jones will likely cruise to victory. It’s also worth noting, residents on Long Island have been active participants in the summer of social unrest wrought by the police killing of George Floyd in Minneapolis, indicating an interest in racial justice that would have seemed very unlikely just a generation ago – though some of those marches against racism and police brutality have been met with counterprotests. So, whether racism will hurt Gordon in

men or some other local elected official,” Gordon said. “I thought to myself, if I did more than just vote every year, I would be able to impact who sits in the office, who would then make wiser decisions, because I didn’t believe the president not listening to his advisers was a good decision.” So, she came home and became more involved in the local Democratic Party. Where exactly Gordon stands on hot-button national security and foreign policy issues is less clear, although it’s probably fair to place her within the multilateralist center-left. I asked about the sign outside of Amityville station that encouraged the U.S. to pull out of the United Nations. Gordon said she believes the U.S. has a responsibility to position itself at the forefront of relationships with allies and with countries throughout the world. “I think we have to continue to do that. It’s a role that we have taken on,” she said. “It’s kind of like when you’re the firstborn

this district is unclear. But if she wins, it will break new ground on Long Island.

ORDON’S FIRST CAREER was as an Army reservist. She enlisted in college as a private first class, before switching over to the Reserve Officers’ Training Corps. She commissioned after completing her degree in health education at Hunter College and went on to serve for 29 years. During that time, she also obtained a master’s degree in counseling and educational leadership from Queens College. Gordon’s status as a veteran is what drove her into politics. As a reservist, Gordon was activated for duty in 2003 and deployed to Iraq. “President (George W.) Bush made a unilateral decision to go into Iraq, against his advisers. They wanted him to wait. Because of that decision, the reserves were called up, so I was called up,” Gordon said. The Army deployed Gordon in January 2003, and she returned home in March 2004. “My daughter’s birthday is in February, so I missed the entire 14th year of my daughter’s life,” she said. Gordon wanted a more participatory role in setting public policy. “Pre-Trump, presidents usually came up through the political system, whether they were governors or senators or congress-
child. You’re just a big brother, you have no choice. It’s where we are – we are a foremost leader in the world, and that’s the role we take.” It’s a view that would have once been mainstream in both parties but is at odds with both increasingly isolationist Republicans on the right and anti-imperialist sentiment on the ascendant left. Another potential cause for left-wing Democrats to distrust Gordon: She did a tour at the Guantanamo Bay detention camp in Cuba, where terrorism suspects could be detained without due process and subjected to torture. In 2016, Obama announced a plan to close Guantanamo and worked to reduce the prison population there up to his final weeks in office. Asked if her views on Guantanamo today mirror her views on the war in Iraq – mainly, that it shouldn’t have happened – Gordon said, “I think that we have a mission as service members. As long as we’re meeting the Geneva Convention principles, we follow our mission. That’s what I did. I am not in total agreement with what’s happening in Guantanamo Bay, and I do agree with President Obama’s efforts to reduce our presence with having prisoners there.” In terms of her military background, Gordon’s candidate profile is similar to that of Democrat Rep. Max Rose from Staten Island – a veteran running as a moderate
while also emphasizing his service – who flipped a district carried by Trump. On Election Day, Trump voters could perhaps split the ticket and also vote for Gordon based on their respect and reverence for U.S. military veterans. Levy said a certain kind of voter in the district might think, “‘I normally wouldn’t vote for a Democrat, or I wouldn’t vote for a woman – if that’s how they think – or I wouldn’t vote for a Black person, but I like the fact that she served just like my brother or sister did, or just like I did.’”

ORDON’S POLITICAL LIFE began at the dinner table. As a child, her father, Winston, who was a railroad worker in Jamaica before he immigrated to the United States, wanted passionately for “regular people” to rise up. He discussed this daily over meals and initiated conversations about current affairs, both American and Jamaican. His politics were family values, equal rights and a living wage. He owned a collection of Martin Luther King Jr.’s speeches on vinyl and a copy of “The Autobiography of Malcolm X,” which was required reading for Gordon, her older brother and sister. Gordon’s parents set out for Queens in 1972, when she was 7. It had been exactly 10 years since the United Kingdom granted Jamaica’s independence. During that decade, politics on the island were polarized, taxes and poverty were high, and political violence had become commonplace. The Gordons were homeowners in St. Catherine, Jamaica, and they employed a housekeeper. But, like many other young Jamaican families in the ’70s, America held the promise, to them, of something more. Gordon’s father landed a union job as a shop steward at a plastics factory in Long Island City, Queens, and her mother, Phyllis, became a secretary in the business affairs department of the news division of CBS. They both pursued advanced degrees later in life, and her father is now an attorney. Gordon moved to Long Island in 1993. She is unmarried and has two adult children. No matter what someone is doing in their country or the particular circumstances of their situation, the perception they have, Gordon said, is that if you come to the U.S. it will be better. “Whether or not that’s true,” she added, “doesn’t really matter.” But it is true, she believes. When Gordon recalled the story of her family’s immigration, a wave of sadness washed over her. Being left in Jamaica while her parents laid plans in New York was traumatic. “Imagine your parents gone for six months,” she said. “I remember I cried a long time when my mother first left. I don’t know how long, but for a long time I would just cry.” She became silent and looked past me,

out at the grassy beach. Then, under the gazebo, she began to cry. Her campaign manager, seated across from us, handed her a napkin. I asked what particular thought was making her tearful. “It’s hard to hear people talk about immigrants,” Gordon said. “You don’t realize how difficult it is for immigrants to pick up everything and come here – how really difficult that is.” Gordon is noticeably reluctant to use her experience as an immigrant to directly critique the Trump administration on immigration policy. He is a major reason she decided to run, but, like Rose, she tries to present herself as a voice of common sense combating extremists on both sides. “I saw the craziness in Washington, and I knew, in order to change government, you have to change those who govern,” Gordon said. “I think Trump has – I think it’s become really divisive. Almost any time anyone speaks, I hear the far right, the radical left,

jeopardy. But it’s not about being reelected. You’re not supposed to be in this job to be reelected. You’re supposed to be in this job to serve people, and that’s clear to me.”

And I work with Republicans, and I’ve worked with Democrats,’” O’Handley said. “And yes, some other people say that also, but there’s something so genuine about Jackie that I believe her.” Republicans are counting on King’s legacy as well as the history of Long Island to keep the traditionally Republican seat

just this divisiveness. We definitely have a two-party system, but the two parties have to come together because we’re one body.” Pushed to speak further about Trump’s immigration policies, Gordon said, “I think a lot of those decisions are being made by people who have no idea about the immigrant experience. That’s why representation matters. Even degrees of knowledge. You may not be an immigrant yourself, or a first- or second-generation immigrant. … I think the president has painted a picture of immigrants that’s not factual and not true.” Gordon added, “We need the women, the badass women, as I love to call them, which is who they are. When I saw those women write that letter, I knew that’s what we need more of.” She is referring to Reps. Elissa Slotkin of Michigan, Chrissy Houlahan of Pennsylvania, Mikie Sherrill of New Jersey, and Elaine Luria and Abigail Spanberger of Virginia. Those moderate Democrats, who flipped Republican seats in conservative districts, initially opposed impeachment and became leaders in the process after penning an op-ed, along with two male members of Congress, in The Washington Post. Gordon views the group’s move as highly principled. “I believe four of the five of them, writing that letter would have put them in, or may put them in, (electoral)
from tipping into Democratic hands. “We are no stranger to hotly contested races here in Suffolk County, and we have had a successful track record in that – whether you look at our state Senate races or whether you look at our congressional races with Lee Zeldin and, of course, Peter King in 2018,” said Jesse Garcia, chair of the Suffolk County Republican Party. “So, hotly contested races are nothing new to this county organization, and our record is second to none in that matter.” It’s worth noting that before 2018, King routinely posted double-digit victories. His 6-point win two years ago paled in comparison. However, Garcia rejects the idea that King’s influence was in decline. “The 2018 midterms are exactly what midterms are all about,” he said. “The party in power typically faces significant contests for their incumbents, and they face losses in both chambers, especially when you control the White House. We saw a ‘blue wave’ attempted to cross Long Island, and we were able to successfully push off that ‘blue wave.’ This year we have the advantage of having our base energized for a variety of reasons, including the fact that the president is on the ballot.” The Garbarino campaign declined to make the Republican nominee available for an interview but provided a statement at-

tributed to him: “With more than 64 local endorsements from local elected officials, the support of Congressman King, law enforcement and labor unions, as well as the confidence of so many working class Long Island families, I look forward to working hard over the next couple of months, taking nothing for granted, to earn the opportunity to serve New York’s 2nd Congressional District.” The 2nd Congressional District is an area that is very much in flux politically, swinging back and forth from race to race and from county to county. Trump carried Suffolk County in 2016, while Hillary Clinton carried Nassau County to the west, in which part of the district lies. How this all plays out for Gordon and Garbarino in November is up in the air. For her part, Gordon has raised $1.8 million and has $1.1 million in cash on hand. Garbarino has raised a fraction of that: $488,562 total, $104,101 on hand. But in a slightly Republican-leaning area – and in a presidential election year with a Republican at the top of the ticket – Garbarino could still have the upper hand.

N ADDITION TO her military service, Gordon spent nearly three decades working in public schools. She started as a teacher at P.S. 109 in Brooklyn before becoming a guidance counselor at Wilson Technology Center, which offers tech programs for teens in Long Island. Gordon was a guidance counselor to O’Handley’s daughter, Catherine, in 2018. Thanks to the way Gordon helped her daughter and her family during Catherine’s education, O’Handley considers herself one of Gordon’s most enthusiastic supporters. Last year, she spotted Gordon in the Veterans Day parade in Babylon Village. She jumped from her seat, and yelled, “Ms. Gordon! Ms. Gordon!” Gordon broke free of the parade, ran across Deer Park Avenue, up the lawn, and onto O’Handley’s front porch. Gordon said, “How are you, Ms. O’Handley, and how is Caroline? Please tell her I said, ‘Hello.’” And before she trotted off, back to the parade, she said, “And by the way, I’m running for Congress.” O’Handley responded: “You got my vote.” Many people have a story like that about Gordon, where she really seemed to see them – to pick them out of the crowd. “People remember,” Levy said. “People reward local politicians who really pay attention to detail and serve them in what they see as a nonpartisan way.” While we sat under the gazebo, overlooking the Great South Bay, residents stopped to greet Gordon frequently. I suggested that the commercials were working. “I’ve been around,” she politely corrected me. “This is my home.”

The protests have subsided, but police reform activists are gearing up for their next big fights.
S
INCE JULY, the intensity and volume of protests against police brutality in New York City have decreased, and the protesters who occupied City Hall Park demanding cuts of at least $1 billion to the New York City Police Department budget have gone home. But both criminal justice advocates and sympathetic lawmakers are confident that the summer’s energy is merely hibernating and they are planning their next moves. Activists are educating the public about police reform and preparing for the 2021 New York City Council elections, while lawmakers refocus on reforms that have not yet passed. The June protests in New York and nationwide outrage over George Floyd’s death at the hands of Minneapolis police caught the attention of lawmakers. The state Legislature reconvened to pass a landmark package of bills that included repealing the controversial 50-a law, which kept police disciplinary records secret, and enacting a statewide ban on the police use of chokeholds. New York City passed its own laws, including one criminalizing the use
of chokeholds by police. Protesters even managed to influence the city budget, which shifted some funds away from the NYPD, although most police reform activists agreed the cuts did not go far enough and did not actually hit the minimal goal of $1 billion. Some left-wing activists urged Council members to vote no on the budget until it included greater and more substantive cuts, but only a handful voted no on those grounds. The fight over defunding the NYPD is far from over, but with no budget to negotiate in the immediate future, noise around the issue has been more of a low drone than the loud roar it was over the summer. The weather is getting colder, kids are heading back to school and a variety of other issues – especially those related to the coronavirus pandemic – have begun to take precedence for now. Protests arose in September in the wake of the police killing of Daniel Prude in Rochester and again following a grand jury decision not to indict Louisville police officers for killing Breonna Taylor, but neither instance hit critical mass the way June’s protests across New York City
and the state did. “Some of the momentum has died down, but it seems that it’s died down more so just because there has been an ever-changing response to COVID,” London Arnold, an organizer with the anti-police violence community group Justice Committee, told City & State. But she considers this more of a pause than complete dissipation. “Even if the momentum dies down, I’m doubtful the movement will die down.” Arnold added that New Yorkers’ struggles related to the pandemic illustrate the need to defund the police in order to better fund social services. Abolition Park community members, who in part organized the City Hall Park occupation, have been working in the weeks since their encampment was disbanded to show what a shift in investments could look like. They have been continuing on-the-ground mutual aid work that evolved out of the original direct action prior to the budget vote, connecting New Yorkers in need with resources and housing. “What we are more focused on is actually just providing the resources that we would have been able to (have) had the

The fight over reducing funding for the NYPD is far from over, but with no budget to negotiate, concerns about rising coronavirus rates have in some ways overtaken the political conversation in New York City.
police been defunded,” Tameer, an Abolition Park community member who only gave his first name, told City & State. “We want to show the world that it’s possible to live in a society without cops by providing these resources.” Abolition Park does not currently have any plans for their next direct action. Public education work has also been a key part of what Communities United for Police Reform, a coalition of advocacy and community groups, has been doing both over the summer and more recently. “The public is the people we’re really trying to influence, because we want Council members to listen to the public,” Anthonine Pierre, deputy director of the community group Brooklyn Movement Center and a spokesperson for Communities United for Police Reform, told City & State. The coalition has been advocating for what it calls budget justice since well before the recent national calls to defund the police, and advocated for the repeal of 50-a and other police reform legislation that passed in June. Pierre said that Communities United for Police Reform has helped lay the ground-
work for the kind of reform movement seen over the summer, and that its members are gearing up for the next phase of the campaign. “We’re quiet, but we’re not asleep,” Pierre said. The fiscal year 2022 budget is due June 30, 2021, which means negotiations would take place around the same time as the June 2021 Democratic primaries that will effectively determine who wins most of the seats in the City Council. With that convergence in mind, Pierre said that “it would be hard for us to not engage in the election.” Pierre said that her group Brooklyn Movement Center, which is based in Central Brooklyn, would help community members organize in order to pressure Council candidates in that area to back police reform and cuts to the NYPD. “I can’t say that we have all of our plans laid out, but three Council members that represent Central Brooklyn voted yes for that budget despite our membership and our base being really energized to move money into social services,” Pierre said, referring to Council Members Laurie Cumbo, Robert Cornegy
Jr. and Alicka Ampry-Samuels. Only Ampry-Samuels is up for reelection. Cornegy is running for Brooklyn borough president. The New York City Chapter of the Democratic Socialists of America, which helped propel to victory its entire slate of state legislative candidates in June, plans on making defunding the NYPD their number one issue for the 2021 City Council elections. Sumathy Kumar, a co-chair of the DSA-NYC, called a commitment to defund “the most important issue” for the upcoming campaigns, and expects it to play a major factor in deciding who the group endorses. The DSA is gearing up to have a serious impact on the makeup of the next City Council, the majority of which will consist of freshmen, thanks to term limits. Kumar said that it’s too early in the process to say whom the group might endorse, but issued something of a warning to lawmakers who voted to approve what DSA members considered insufficient cuts to the NYPD. “I think anyone who voted yes on this budget should be nervous either about returning to the City Council, or the rest of their political careers,” Kumar said. But those elections are still a long way off, as is the next budget battle. A lot can change in nine months, and keeping control of the narrative can be difficult. A recent spike in gun violence has already given opponents ammunition to reshape the public conversation, sowing fear about public safety and the impacts of reducing police presence on the streets. Other parts of the country have seen similar spikes in crime, and progressives have attributed it in part to record unemployment and financial insecurity caused by the pandemic. But the surge has given Republicans a law-andorder platform to run on and police unions a justification for doubling down on their anti-defund and anti-reform rhetoric. Arnold admitted that rising crime has made educating people about the benefits of divesting from police a little more chal-

lenging. “(Police presence) may be making them feel safer, even though that may not be what in reality is bringing safety,” Arnold said. “The defund movement can be hard to understand for people, if they haven’t imagined a world without police.” Continued support from lawmakers, despite the spike in shootings potentially causing a shift in Key officeholders say they are still committed to continuing the work that started in June. City Council Member Donovan Richards, chair of the Committee on Public Safety and one of nine to vote down the 2021 budget on the grounds it didn’t go far enough to cut police funding, said he’s hoping he can continue steering the City Council towards greater reforms before he leaves the body. He’s all but assured to become the next Queens borough president next year – he won the Democratic nomination earlier this year and will presumably win the general election in the heavily Democratic borough in November – so he only has until January. Richards has a package of legislation he’s working on that he hopes the City Council will consider before he leaves. The top priority for him is reforming the NYPD’s controversial DNA database, which he says has been used to unjustly collect the DNA from minors and people of color who have never even been accused of crimes. Richards acknowledged that the spike in shootings will create a “tricky balance” between public safety and reform for Council members as the data influences public opinion. But he said it’ll be up to leaders in the movement to continue pushing back against anti-reform narratives. “Even as there’s pushback on reform, the public is

still largely demanding safer and fairer policing,” Richards said. “And I don’t think that will fizzle out.” Richards has received criticism from criminal justice reform advocates for what they see as his attempt to roll back the recent chokehold criminalization law. He introduced a bill softening the language in the portion of the law about compressing someone’s diaphragm by sitting or kneeling on someone’s back, raising the threshold for criminality. Although in past interviews he referenced an alleged police slowdown in protest of the new law as his reason, Richards told City & State his amendment is not a rollback, but is instead meant to avoid potential legal challenges that could overturn the entire law. State Sen. Jamaal Bailey also told City & State that he’s continuing to push for reforms at the state level to continue to build on the historic legislation passed earlier this year. “However historic the package was, it’s something we can’t rest on our laurels with,” Bailey said. Specifically, he’s
focused on bills to ensure that minors always have the right to counsel when they are interrogated, ending qualified immunity and making it harder for officers with misconduct complaints to simply be transferred to new agencies. Bailey said he feels confident that his fellow members will still have a drive for reform when a new session that will have many new members begins in January. “The knee on the neck of George Floyd was a knee on the collective neck of Black and brown America, and it has woken people up who are not part of Black and brown America,” Bailey said. Pierre, Arnold, Tameer and Kumar did not offer any specific legislative goals for their respective groups for the immediate future in terms of bills they would like to see passed. Arnold added that June’s landmark achievements still resonate and that maintaining them in the face of potential challenges takes precedent. However, Communities United for Police Reform still lists other bills beyond those that passed as part of its overarching Safer NY Act, including legalizing marijuana and reducing arrests for ticketable offenses. Black Lives Matter of Greater New York, which did not return requests for comment, also has a long list of legislative demands, many of which have not been met yet. They include the establishment of an elected civilian complaint review board in New York City to investigate police misconduct, disbanding police unions and ending qualified immunity, a legal doctrine that makes it difficult to hold police liable for misconduct in civil court. But much of this is reliant on the reform movement’s continued energy. The work of activists between now and the next budget fight will be crucial to ensure that lawmakers remain committed to reform. “I think folks have really hit a breaking point in this point in time,” Arnold said. “As long as people that are at the forefront of the movement continue… to advocate on behalf of the things that we know are necessary and make these demands, there may be moments that the momentum fluctuates, but I am very skeptical (that) it would die down.”

THE BLACK LIVES MATTER movement first arose in the aftermath of the shooting death of 17-year-old Trayvon Martin and the acquittal of George Zimmerman, the neighborhood watch volunteer who killed him in 2012. This year, the movement grew to involve people in every city in the country, fueled by the furor over the police killing of George Floyd in Minneapolis. Of course, the fight for equal rights and treatment for Black Americans has been waged for centuries, and today’s activists are building on the accomplishments of countless civil
rights leaders of past generations. Then and now, New York has been home to many of the most prominent Black individuals who have taken up the cause. City & State’s Black 100 list, created in partnership with Stephon Johnson of the New York Amsterdam News, recognizes many of the Black New Yorkers who are making a difference in politics – legislators championing criminal justice reforms, groundbreaking candidates for elected office, advocates evening the playing field, and, of course, the activists who have taken to the streets to stand up for their rights.

During his fourth term as mayor of Buffalo, Byron Brown has faced criticism from many directions. On one side, the Buffalo Police Department’s Emergency Response Team resigned en masse after an officer was suspended for pushing an elderly man to the ground during a protest. On the other side, protesters signed a petition calling for his resignation, claiming he isn’t holding officers accountable for their misconduct.

Terrence Melvin is second in command at the New York State AFL-CIO, the umbrella group representing millions of public and private sector union members statewide. Melvin is also an ordained minister and an outspoken advocate on political issues. In May, in his role as president of the Coalition of Black Trade Unionists, he endorsed Joe Biden for president, arguing that a President Donald Trump victory “could push America to the point of no return.”
Michael Garner has touted the MTA’s leadership in securing new contracts with businesses owned by minorities and women since the pandemic hit New York, saying those contracts account for 32% of the agency’s procurement contract funds going toward the virus response. Garner previously held positions at the New York City Housing Authority and the New York City School Construction Authority.
