EDITOR’S NOTE DEAR CITY & STATE READERS, My name is Ralph Ortega, and I am City & State’s interim editor-in-chief. I’m excited to join this publication during a time of change as it commits to providing more inclusive coverage of New York local and state politics. This also means being attuned to the feedback City & State has received in recent weeks and taking action so that our reporting reflects greater diversity and understanding of the people we write about and serve. I’ve admired City & State for its reporting, analysis, research and lists of the most influential and powerful people in New York politics. I’ve been a journalist for almost 30 years, speak fluent Spanish and have written about diverse communities in New York, New Jersey and Florida. I was born and raised in New York and am the proud son of immigrants from Cuba and Chile. I attended NYU and did reporting stints in Florida and New Jersey before I landed at the Daily News for almost eight years. I left the News for the Star-Ledger in Newark, New Jersey, where I got to cover City Hall and then-Mayor Cory Booker. I most recently have worked as an adjunct at the Craig Newmark School of Journalism and for DocumentedNY, an immigration news site. This week’s magazine features Zach Williams’ cover story about the state Senate races that could result in legislative supermajorities that would be able to override Gov. Andrew Cuomo’s veto power. COVID-19 LOCKDOWNS BEGIN TO EASE

About two weeks after announcing new lockdowns in parts of New York City experiencing spikes in coronavirus cases, Gov. Andrew Cuomo announced that some of the restrictions would be relaxed. However, the neighborhoods at the heart of the outbreaks would continue to

be subject to the strictest public health requirements. Cuomo unveiled a new fourtiered system, each with its own benchmarks for infection rates, that would determine the levels for a lockdown. The changes allowed thousands of students to head back to school in areas where classrooms had been temporarily shuttered, including all previously closed schools in Queens and many in

Brooklyn. Meanwhile, Cuomo also announced that he would not add New York’s neighbors – New Jersey, Connecticut and Pennsylvania – to the travel quarantine list, even though each state had hit an infection rate that should trigger such restrictions. The governor said that the amount of interstate travel, especially with Connecticut and New Jersey, would make the quarantine requirement too hard to enforce.

BIKE BOOM New York City’s cycling enthusiasts have long been a vocal contingent, but now The New Yorker is getting in on the push too. Last week’s cover shows masked New Yorkers biking over the Williamsburg Bridge. But some groups, like the Regional Plan Association, took issue with the empty subway car below the cyclists, and went as far as to produce their own version of the cover, complete with masked straphangers.

Cuomo and New York City Mayor Bill de Blasio sparred over coronavirus responses again, this time relating to a vaccine distribution plan. Cuomo unveiled his five-phase plan that prioritizes frontline health care workers, along with those in nursing homes, while de Blasio announced a two-phase plan that prioritizes frontline and essential workers, and people in vulnerable groups. The governor indirectly chastised the mayor, saying that the city doesn’t have the authority to make COVID-19 policy or implement its own vaccine strategies.

WFP ENTERS HIGH GEAR

The Working Families Party has revved up its campaign to get New York voters to cast their ballots for Joe Biden and Kamala Harris on the WFP line. The party faces new, tougher requirements to keep its ballot line this year – the party must receive either 130,000 votes or 2% of the vote for president, whichever is higher. They’ll have to meet that requirement every two years in each presidential and gubernatorial race. Previously, third parties needed only 50,000 votes every four years. The WFP recently launched an $800,000 ad buy in order to encourage people to vote WFP, including mailers featuring Rep. Alexandria Ocasio-Cortez and U.S. Sen. Elizabeth Warren. Lawmakers and candidates from across the state have also been encouraging

their constituents to vote for president on the WFP line.

21 IN ’21 ENDORSEMENTS ANNOUNCED

Nearly four years after it was first founded, the 21 in ’21 initiative has rolled out its endorsements for the 2021 New York City Council races as it seeks to get 21 women elected to the council. Right now, there are only 12 women in the 51-seat legislative body, a decrease from the 18 that were serving in 2011. Six of those women currently in the council are leaving next year due to term limits. With 35 open council races, the group endorsed 33 women as their first-choice candidates as well as many others as second and third choices, a nod to the ranked-

The crowded field of New York City mayoral hopefuls has gotten even bigger. New York City Council Member Carlos Menchaca of Brooklyn confirmed his intent to run as a progressive. Military veteran Zach Iscol, who helped lead the coronavirus response efforts at the Javits Center temporary hospital, also announced his candidacy. And earlier, investment banker, Wall Street giant and Democratic donor Ray McGuire made his run official as well.

Voters are generally asked to leave political attire at home before they vote – wearing a Joe Biden shirt or a MAGA hat could cause minor issues at polling places. But poll workers cannot turn voters away for any other political messaging, from Black Lives Matter banners to Second Amendment pins. If it’s not on the ballot, you’re free to wear what you want. State election law states that electioneering is not allowed inside polling places, or within a 100-foot radius. That means that “no political banner, button, poster or placard shall be allowed.” While the law is really meant to prevent campaigns from harassing voters trying to cast their ballots, it also applies to individual voters. The BOE did not return a request for comment about this story. The law seems overly broad as to what counts as a “political banner, button, poster or placard.” Does this apply to pro-choice pins, or a shirt with Supreme Court nominee Amy Coney Barrett on it? In reality, any political message is not considered electioneering, and so poll workers cannot ask anyone to change or remove something like a Black Lives Matter shirt before being allowed to vote. In fact, the 2018 Supreme Court case Minnesota Voters Alliance v. Mansky found that a law preventing “political apparel” of any kind at or around polling places violated voters’ First

Amendment rights. In response to the ruling, the state Board of Elections issued bipartisan guidance obtained by City & State. The board said the ruling did not impact the state law on electioneering at polling places. The guidance narrowly defined electioneering as “statements for, or against, a candidate or referendum on the ballot,” and applied that narrow interpretation to acceptable apparel as well. “Persons wearing clothing or donning buttons that include political viewpoints – i.e. support of the Second Amendment, Marriage Equality, Environmental Sustainability, Immigration Reform, Support for Voter ID Laws – do not violate New York’s electioneering prohibition unless the issue itself is unambiguously on the ballot in the form of a ballot proposal,” the guidance reads. Since Black Lives Matter protests and gun rights, among other subjects, are not being voted on directly on the ballot as referendums in New York, wearing political apparel related to these issues is a constitutionally protected right. And a poll worker who asks anyone to remove such attire before voting is violating both state law. With all that being said, however, voting rights advocates still recommend leaving any political messaging at home, regardless of its legality, to avoid any potential disruptions at the polls. – Rebecca C. THE QUEST TO CLOSE ABYTIMELINE OF THE LONG, SLOW PROCESS TO SHUT DOWN THE JAIL COMPLEX KIMBERLY GONZALEZ FOLLOWING longtime calls for its closure, Rikers Island was set to be shut down by 2026. Now, New York City has delayed its death sentence to 2027. The infamous jail complex, which opened in 1932, has a history of abuse and negligence toward its inmates, which has left adolescent boys physically and mentally harmed. Eventually, New York City Mayor Bill de Blasio came around to support the closure of the island. The process to get there, however, has not been without its share of complications. Here is a brief timeline of the recent calls to close the jail complex and the steps taken so far.

The U.S. Justice Department released a report after an investigation of Rikers Island found “a pattern and practice of conduct at Rikers that violates the constitutional rights of adolescent inmates.â€? The department learned there was a “deep-seated culture of violenceâ€? that was pervasive among adolescent youth and that staffers frequently used force “not as a last resort, but ‌ as a means to control.â€?

Following increased calls for action, Mayor Bill de Blasio and thencity Correction Commissioner Joseph Ponte announced a 14-point plan to create a safe environment for inmates on Rikers Island.

New York City Comptroller Scott Stringer announced his support to close Rikers Island.

De Blasio pledged to shut down Rikers Island alongside Mark-Viverito in an announcement at City Hall.

In her State of the City address, then-New York City Council Speaker Melissa MarkViverito called for reforms to reduce the inmate population at Rikers Island and, ultimately, to shut down the island. Mark-Viverito’s call for the island’s closure gained support from Gov. Andrew Cuomo, while de Blasio shot down the proposal.

De Blasio released a roadmap for the jail complex’s closure, including safety protocols, reduced capacity and reduced isolation for inmates.

Alongside New York City Council Speaker Corey Johnson, de Blasio announced four boroughbased jails in every borough except Staten Island to replace Rikers Island and introduce fairer and smaller criminal justice system.

De Blasio and Johnson agreed to close the jail complex by 2026 and open four new jails at a total cost of $8.7 billion. A week later, the City Council approved the deal.

Gothamist acquired planning documents that showed delays would stretch the closing of Rikers Island well into 2027.

The city officially delayed the plan to close Rikers Island and build new jails until 2027.

New York City is expected to shut down the Manhattan Detention Complex, commonly known as “The Tombs,� in Lower Manhattan and the Otis Bantum Correctional Center on Rikers Island.

No one is expecting that Joe Biden and Kamala Harris are going to go as far as many of us believe is necessary. But what they will do is open the conversation.

What’s next for the Black Lives Matter movement? We’ve got to focus on federal, state and local legislation to really address what is a national problem of lack of accountability, lack of transparency with respect to policing and criminal justice writ large. What we saw in Kentucky was an egregious abortion of justice, with the attorney general misleading and misguiding a jury, and then the jury themselves wanting to bring to light the grand jury proceeding, and then having the attorney general fight that. It shows that

there are deep-rooted, systemic obstructions to transparency. So we’ve got to have a holistic approach, and a fully integrated strategy for accountability. We need police departments around the country to institute systems of accountability and transparency. We need to have sunshine laws put in place that will both protect the integrity of a grand jury but also assert the right of the public to be able to hold attorneys general accountable, to hold prosecutors accountable for how they execute and manage the grand jury process. We need to see a return to

the Obama-era policies of the dismantling of private prisons. We need to see a ban on the use of certain tactics by police to subdue and take individuals into custody. We need to see national standards for training for use of force. We need to see national standards for accountability for police off icers. We need to prevent what we have been seeing across the country, which is bad cops hopping from department to department. Police department hopping by bad cops has got to be one of the issues that is dealt with on the national level.

There’s an election in several weeks, and the implication of having a president who on the one hand espouses that rhetoric of the ultraright, which reflects disdain for constitutional protections, and on the other hand a candidate who has put forth a plan to address many – not all – but many of the institutional policies and practices. Joe Biden and Kamala Harris have been criticized by some reformers for their records. If elected, would they go as far as you want them to? Will they be a panacea? Absolutely not. Will it be

a required and necessary step to change the trajectory of the nation, especially with regards to criminal justice reform and policing? Absolutely. No one is expecting that Joe Biden, who wrote the crime bill, and Kamala Harris, who was a district attorney and then an attorney general, are going to go as far as many of us believe is necessary to restructure policing in America. But what they will do is open the conversation, change the rhetoric, and provide leadership that says the Constitution is supreme and everyone needs and is entitled to equal protection under law.

CUOMO? T The state Senate is on the cusp of being able to override the governor’s veto – and force New York leftward next year.

HE EMPIRE STATE is on course to move even more to the political left just two years after Democrats won control of both houses of the state Legislature for the first time in a decade. The 40-member Democratic conference only needs to flip two Republican-held seats in the 63-member state Senate to achieve a two-thirds supermajority to accompany their existing one in the Assembly. No party has done that for at least a century. If it happens in 2020, New York could join California, Rhode Island and Hawaii as one of the states where Democrats have a governor in office and two-thirds of the seats in both houses of the state Legislature. A state Senate supermajority for Democrats would certainly change the political landscape of Albany. Republicans would be more irrelevant in state politics than ever if they lose key races this year in Western New York, Long Island and the Hudson Valley. There would also be implications for the balance of power between the state Legislature and Gov. Andrew Cuomo, since a supermajority can override a governor’s veto. Democrats would also control legislative redistricting because the current system allows a two-thirds majority of the state Legislature to have final approval of any redistricting plans created by a 10-person bipartisan commission. “I think it will make a huge difference,� said Democratic state Senate nominee Jabari Brisport, a democratic socialist from Brooklyn. “Then we don’t need to worry about

We have an absolute opportunity to completely change New York and make New York a progressive beacon across the entire country.” Yet Democratic lawmakers are roughly divided into two factions that will limit how state Senate Majority Leader Andrea Stewart-Cousins and Assembly Speaker Carl Heastie can directly challenge the governor, according to Lawrence Levy, executive dean of the National Center for Suburban Studies at Hofstra University. “Can they now run roughshod over the governor?” he said of Democratic supermajorities. “The answer is probably not – in part because of Cuomo‘s political skills and in part because a lot of the more moderate suburban or upstate senators are just not going to go along with as progressive an agenda as some of the (New York City) senators might like.” The effects of a supermajority may turn out to be more limited for other reasons as well. In the past two years, Cuomo has vetoed plenty of bills that passed the state Legislature by margins larger than the twothirds needed to override a veto, but neither Stewart-Cousins nor Heastie ever rallied their chambers to deploy that power. And Democratic state lawmakers might not need supermajorities to control redistricting. Democrats have already passed a constitutional amendment this year that would lower the legislative threshold to 60% votes of the state Legislature – margins they already have in both chambers – for approving redistricting plans. If simple majorities pass it again next year, and voters approve it in November, it could take effect before the redistricting process begins in 2022. Nonetheless, a few extra votes for the political left in the state Senate could break longtime legislative logjams on high-profile issues like increasing taxes on the wealthy, single-payer health care and the legalization of recreational marijuana. Swing-district lawmakers could vote no on controversial proposals to avoid angering their colleagues or constituents, while Democrats still find the simple majority needed to pass the bill. There will also be issues where the political left and right could unite against the governor. Progressives and moderates appear to be forming a united front to raise some taxes in order to avoid deep cuts in state support to public schools and local governments as the state grapples with a $14 billion deficit caused by the pandemic.

While the governor has been generally opposed to tax increases, he has shown a willingness in the past two years to go along with Democratic lawmakers on hot-button legislative proposals such as driver’s licenses for undocumented immigrants and tenant-friendly changes to state rent laws when the political left has had the votes to pass them. for example, has nearly twice as much money to spend in the final month compared to GOP candidate Richard Amedure in her race to replace retiring GOP state Sen. George Amedore in a district representing part of the Catskills and the Hudson Valley. She is one of four Democrats running for open seats who have at least twice as much money as the Republican candidate, according to financial disclosures filed with the state Board of Elections. Former Peace Corps volunteer Samra Brouk has also raised more than $150,000 for her race in the Rochester area against winemaker Chris Missick, who is self-funding his campaign. Public polling is nonexistent for state legislative races, but Republican congressional candidates are struggling even in some areas of the state that President Donald Trump won in 2016. National polling suggests Trump’s poor handling of the coronavirus pandemic is also weighing much more on the minds of swing voters than the “law and order” message that Republicans are emphasizing. When several Long Island GOP candidates tried to obtain an additional ballot line under the banner of “Secure Our Communities,” they could not even garner the 2,100 signatures required to get it done. One vulnerable Democratic incumbent, state Sen. John Brooks, is a lock for reelection after the Republican candidate got kicked off the ballot for refusing to resign as a county elections commissioner, an obvious conflict of interest. GOP legislative candidates are not raising money or getting endorsements like they used to from longtime political allies like the real estate industry, who are either keeping a low profile in legislative races or trying to ingratiate themselves with the party in power. “The Long Island Six have made sure that our views are heard,” Mitchell Pally, CEO of the trade group Long Island Builders Institute, told City & State of Democratic suburban senators from the area. “That’s really what we asked for.” Despite the lack of Republican sway in

the Legislature, some supporters are sticking with them in hopes that things will somehow turn around in November. Police unions have been a big source of support for GOP candidates across the state this year. A conservative super PAC is spending millions to turn things around by targeting Democratic incumbents in swing districts that the party flipped two years ago. “We’re confident that we will not only hold our seats, but grow our conference,” said Candice Giove, a spokesperson for the 20-member Republican minority. There are currently three vacant seats representing districts won by the GOP in 2018. With just a few weeks to go before Election Day, an outcome with few Republican pickups isn’t utterly impossible, but Democratic supermajorities appear much more likely. And while there are plenty of signs that the governor will still have the upper hand against legislators, that does not mean it is just going to be business as usual in Albany once the new year begins.

WO GROUPS OF Democratic lawmakers are likely to expand their influence within the state Legislature next year. The first is an upstate Democratic state Senate contingent that could add as many as five new members from the Syracuse, Rochester and Buffalo areas to the current two Democratic senators from west of the Capital Region. Representing more upstate urban areas could demonstrate growing strength outside of New York City for the political left on issues like health care, housing and funding for education. “People have often said that what’s been missing is that strong progressive delegation from upstate to kind of balance things out,” said Ravi Mangla, a progressive activist in the Rochester area who is supporting the Democratic candidates in Western New York. Past election results like the 2016 presidential race suggest that urban turnout will be key for Democrats to win in competitive districts representing parts of Rochester, Syracuse and Buffalo that also include significant rural and suburban areas. At least three prospective Democratic senators running in such districts appear to be to the left of downstate suburban moderates on a few key issues. Brouk and Jeremy Cooney, a former chief of staff for Rochester Mayor Lovely Warren, are running in districts that include parts of the city on

platforms that embrace single-payer health care. John Mannion of the Syracuse area, who lost a 2018 race for the seat by a few thousand votes, has also expressed support for the idea. Brouk has attended Black Lives Matter protests, and Cooney has said he supports the bail reforms Democrats made in 2019. Brouk (whose father is originally from Ethiopia) and the Indian-born Cooney (who was adopted by an American family when he was young) would also be the only state senators of color representing any district north of New York City. Other Democratic candidates for Western New York seats like Sean Ryan (an Assembly member running to replace Republican U.S. Rep. Chris Jacobs in a Buffalo area state Senate seat) and Amherst Town Board Member Jacqualine Berger (who is running to replace the retiring Michael Ranzenhofer in a sprawling Senate district between Buffalo and Rochester) seem to be more aligned with the centrist wing of the Democratic Party. Ryan has a campaign website touting his bipartisan bonafides and has not joined dozens of his more liberal colleagues in signing on to bills to legalize recreational marijuana or establish a state level single-payer health care system. Such positions dovetail nicely with moderate voters and labor groups like New York State United Teachers that have opposed such ideas in the past. Like Ryan, Berger is emphasizing longtime liberal priorities like increasing state funding for schools and public colleges. Neither candidate responded to a request for comment. While Brouk, Cooney and Mannion lean left, they too put a local spin on issues such as mitigating climate change, by emphasizing local impacts. Cooney lost a 2018 race against retiring GOP state Sen. Joseph Robach by 11 points. With a week to go before Election Day this year, he has twice as much money to spend to convince voters that he is no left-wing radical. “I’m not looking to go to Albany and burn everything down,” said Cooney. “That’s not my attitude. My attitude is, I’m looking to pull a seat up to the table for Rochester.” That appears to be fine with organized labor and the progressive Working Families Party, which have both lined up behind all five of the Democratic candidates in Western New York. “The key question is how these new senators vote,” said Levy of the National Center for Suburban Studies. “There will be regional differences. There will be ideolog-

ical and there will be shifting alliances that you don’t normally see around a specific piece of legislation.” Any progressive efforts in the state Senate will certainly have some support in the Assembly, considering the new wave of insurgent candidates who look likely to win election this November. Housing activists Phara Souffrant Forrest and Marcela Mitaynes, who were both backed by the New York City chapter of the Democratic Socialists of America, defeated incumbent Assembly Member Walter Mosley and Assistant Speaker Félix Ortiz, respectively, in the June 23 primary. Other progressive insurgents including local community board member Emily Gallagher, activist Jessica González-Rojas, activist Zohran Mamdani and attorney Jenifer Rajkumar are expected to win in their historically Democratic Assembly districts in New York City. This influx of left-wing women and people of color could shake up the center-left status quo in the state Legislature, according to observers. “We’ve seen that in the most recent class of newly elected women,” said Democratic consultant Alexis Grenell, referring to state Senate Labor Committee Chair Jessica Ramos, Ethics Committee Chair Alessandra Biaggi and state Sen. Julia Salazar, all of whom were elected in 2018. The three lawmakers were only part of a larger Democratic effort to pass a litany of high-profile legislation in the past two years that reformed voting, policing and other policy areas. But the newcomers had an outsized effect on extending collective bargaining rights to farmworkers, reforming state laws on sexual harassment and pushing the chamber in a more progressive direction on expanding rent protections.

for tax increases to help plug the $14 billion budget hole caused by the pandemic, which Cuomo has resisted. Even if there were enough votes to pass proposals that increase taxes on millionaires, stock transfers and part-time residences this year, Cuomo could still veto them and then demand political concessions in order to strike a new deal with lawmakers, similar to what he has done over the past year on contentious issues like increasing worker pay protections, legalizing e-bikes and collecting more specific demographic information about Asian Americans to address disparities. A potential veto kept new limits on solitary confinement from even coming up for a vote. The only way to even out the balance of power is through the state constitutional amendment process, which requires two successive legislatures to pass a bill by a simple majority before it goes before voters as a ballot initiative. Such a proposal could have

HE POWER OF the governor has grown enormously in the past 20 years, which means legislative supermajorities can only do so much – no matter how many votes Heastie and Stewart-Cousins can muster on one issue or another. The 2004 state Court of Appeals decision in Silver v. Pataki gives the governor much more influence over the state budget than most of his counterparts in other states. The details of the court decision are complicated. They effectively mean that lawmakers can haggle over funding levels but otherwise have to vote up or down on a governor’s proposed budget. If they fail to do that before the state budget deadline, then the governor could resort to keeping the government open through temporary budget extenders until lawmakers grant concessions. More progressives in the Assembly, and more Democratic senators in general, mean Heastie and Stewart-Cousins could face more pressure to force the governor leftward. Both legislative leaders are pushing

taken effect by 2022 if Heastie and Stewart-Cousins had brought it up for a vote this year. Spokespeople for the legislative leaders did not respond to a request for comment, though some political insiders privately suspect they refrained from moving a proposed amendment with budget reforms forward this year to placate the governor. “I haven’t seen any real signs that the speaker and the leader are seriously interested in crossing the governor,” said one activist involved in state politics who wished to remain anonymous to speak frankly about the situation. Democrats did not vote to override vetoes issued by Cuomo over the past year, even though many of the bills passed the state Legislature nearly unanimously. There is more than simple math that legislative leaders have to factor into the political equation. Representatives of the legislative leaders did not respond to a request for comment, but the Cuomo administration is downplaying the

potential for conflict next year. “I can’t think of anything the Legislature would pass that we wouldn’t sign,” Secretary to the Governor Melissa DeRosa tweeted on Sept. 22. “Gov. Cuomo fought hard to elect a Democratic majority and looks forward to growing the conference.” A veto-proof majority would still leave the governor with his formidable powers over the budget, but cooperation rather than confrontation is the goal, according to Cuomo spokesperson Rich Azzopardi. “As history has demonstrated, we work with any legislature the voters give us,” he said in a statement. “We will continue to do so.” The governor has some informal ways to keep the Legislature in line. For starters, the regional and ideological divisions among Democrats make it hard for the legislative leaders to mobilize supermajorities on controversial issues like raising taxes on millionaires, single-payer health care and the legalization of recreational marijuana. This will allow the governor to continue benefiting from the political divisions among state lawmakers moving forward as he has done in the past with suburban Democrats and his reported efforts in his first years in office to help the GOP keep control of the state Senate as a counterbalance to the New York City liberals who dominate the Assembly. The governor can also reward or punish legislators through appointments to public authorities like the Dormitory Authority of the State of New York, the Metropolitan Transportation Authority and the New York Power Authority. Decisions made by those agencies have real effects on any lawmakers’ constituents. Heastie and Stewart-Cousins scored their biggest legislative wins of the past two years with simple majorities that passed strengthened rent regulations and legislation allowing undocumented immigrants to get driver’s licenses. While that suggested that state lawmakers were breaking new ground in 2019 in evening the balance of power with the governor, divisions between moderates and progressives have demonstrated the limits of lawmakers’ abilities to take the lead on other controversial issues. “You know they don’t have the votes because they did not pass a bill,” Cuomo said in 2019 of the failure to legalize recreational marijuana. With Democrats poised to win more seats in November, it could become increasingly difficult to say whether the governor is leading the state Legislature or the other way around, according to Christina Greer, an associate professor of political science at Fordham University. Either way, things are going to only get more blue in Albany in 2021 no matter what happens with the presidential election and U.S. Supreme Court in the coming weeks. “I would see the governor more likely siding with the supermajority, so it looks like he’s the one who’s helping this Democratic initiative get passed,” she said. “He likes to win.”

HANGING IN THE BALANCE A supermajority could jumpstart these 5 issues IF DEMOCRATS WIN a supermajority in the state Senate this November, it could upend the current balance between suburban moderates and left-leaning lawmakers from New York City, which suggests some action is coming on a few top issues. And if Democrats don’t make big gains in November, these are a few major legislative debates to expect in 2021.

SINGLE-PAYER HEALTH CARE Neither the state Senate or the Assembly passed the New York Health Act this past year, which would set up a state single-pay-

er health care system. That could change if President Donald Trump wins reelection and continues to try to dismantle the Affordable Care Act. If former Vice President Joe Biden wins and is able to work a Democratic controlled U.S. Senate to expand access to health care, on the other hand, there may be less of an impetus for further action at the state level. Biden has said he opposes single payer at the national level, but it’s inconceivable that he would try to stop New York from enacting its own system. If Trump wins though, he could withhold billions in federal subsidies for any states that try to set up their own single-payer systems.

RECREATIONAL MARIJUANA Democrats got really close to legalizing recreational marijuana last year. Gov. Andrew Cuomo was even going to tour cannabis-friendly states before the pandemic began. It all came down to some bad timing and a few uncertain votes in the state Senate. Some of the outstanding issues include how future tax revenues would be used, how legalization would compensate communities or

individuals harmed by the war on drugs and whether enterprising New Yorkers would be able to grow their own green at home. With the state desperate for money, it only seems natural that the governor and state lawmakers would like to try this out again in the upcoming year.

CRIMINAL JUSTICE REFORMS No issue has demonstrated the political leverage of suburban moderates more than eliminating cash bail. The 40-seat Democratic majority in the state Senate hinges on controlling six swing districts on Long Island and a few more in the Hudson Valley. Any Republican victories in recapturing suburban seats they lost in 2018 would decrease the number of moderates in the Democratic conference, whereas new upstate Democrats might add numbers to either the progressive or moderate factions, depending on who gets elected in the Buffalo and Rochester areas. New limits on cash bail remain controversial, but they could be strengthened once more if the left does well enough in the November elections.

The pandemic has ripped a $14 billion hole in the state budget approved in April. Cuomo and other Democrats are keeping their fingers crossed that Biden wins and billions in new federal funding will begin coming down the federal pipeline in early 2021. But even that will likely not solve all the state’s fiscal problems. Both Assembly Speaker Carl Heastie and state Senate Majority Leader Andrea Stewart-Cousins have said that they are OK with raising taxes on the wealthy to close the budget gap, but the governor is still holding out.

SOLITARY CONFINEMENT Activists were hopeful at the beginning of 2020 that state lawmakers would finally pass a bill that would place new limits on the number of days that incarcerated people can be held in isolation. There appeared to be plenty of support for the effort in both the state Senate and Assembly. Yet, legislative leaders have not moved the bill at all since they reportedly struck a deal with the governor to make administrative changes instead. One year later, nothing really has changed in terms of solitary confinement in correctional facilities across the state. A new wave of incoming progressive lawmakers are likely to make some noise again.

KELLY CLARKE HOPES that the focus on physical health throughout the coronavirus pandemic is accompanied by a greater attention to mental health, especially when the pandemic fades. As director of New York City’s mental health help line, she understands the mental toll of isolation, economic insecurity, uncertainty and grief in New York City. During the pandemic, NYC Well, the city’s 24-hour resource for mental and behavioral health, has seen a spike in contacts – and many people are choosing to text rather than call. Clarke says that’s probably because people are under more stress while also having less privacy than usual, with entire families stuck inside all day. “It really has been quite diverse in terms of who has been reaching out, including front-line providers,� she says. The program was well positioned for a city shutdown because it was already a telehealth service, but it had to be retooled so that the program’s 230 staff members could also work remotely. With a huge effort and collaboration, they were able to complete the transition in about a week without service disruptions. Clarke says one of the biggest difficulties has been supporting staffers who are experiencing the hardships of the coronavirus while trying to help others. The service reaches between 1,000 and 1,200 people on a standard day, but on many days of the pandemic, the volume was much higher, with many people

seeking services for the first time. “This was one of those circumstances where the cause of (the clients’) distress was also one that was impacting our staff,� Clarke says. “So they’re trying to do this while they’re also worried about their family members and loved ones.� Clarke is Australian and previously worked in the United Kingdom. Having been around the world, she says New York City is unique. “It comes with such diversity, and you really have some of the highest highs but also some of the lowest lows,� she says. “It’s a city of such a striking contrast, at times, and that’s really interesting to explore all the different ends of that and the gray in between as well.�

were felt immediately. “We knew the next day. Hotels are not like office buildings,� he says. “The order was coming in. The next day we knew that there was no business.� The Hotel Association of New York City lobbied aggressively for the state to allow hotels to remain open throughout the crisis, and it collaborated with the city to provide desperately needed housing. Hotels are essential infrastructure, according to Dandapani, who leads the association representing nearly 300 hotels. They provide crucial tax revenue to New York City and tens of thousands of jobs to its residents. During the pandemic, hotels faced an existential threat as the tourism industry sunk, international travel all but halted and corporate conferences were canceled. The 14day quarantine requirement for visitors from most other states further discouraged visitors. “It really is completely almost life-altering for anyone associated with the hotel industry,� he says, “because jobs have

gone, incomes gone and many hotels are in danger of just closing down permanently.� But as hotels continue to face a crisis that Dandapani says has no clear end, they have also had the opportunity to help give safe shelter to homeless residents in the city. For the hotels Dandapani represents, accepting that challenge was a no-brainer. “Hotels have been providing space, more or less at cost,� Dandapani says. “Obviously hotels were very keen on doing so because there was no business.� His organization was tasked with quickly facilitating agreements and processing payments from the city to 64 participating hotel association businesses. Working from the organization’s deserted offices in an empty Midtown, he also helped respond when residents of an Upper West Side neighborhood demanded that the homeless men staying at the Lucerne Hotel be moved. Dandapani’s organization is now preparing to collaborate with the city to house medical workers in the event of a second wave of the coronavirus. Dandapani has lived

in Manhattan for 30 years, raising his two children in the borough – and he sees his work as integral to its future.

INES DE LA NUEZ knows that

older adults in New York City experience food insecurity in normal times. But during the coronavirus pandemic, demand for services from her organization, which usually provides meals and activities to seniors at its community center on the Lower East Side, skyrocketed. The organization typically serves 150 to 200 seniors per day and operates a food pantry that was previously open once per month. When the pandemic intensified in April, De La Nuez worked with partners at City Harvest to open the food pantry once or twice per week. Working extremely long days, De La Nuez also arranged and coordinated home food deliveries for older adults who were unable to leave their apartments, collaborating with the New York City Housing Au-

thority and other city departments. Face masks and hand sanitizer were also included in the care packages, and De La Nuez says they tried to educate isolated seniors about the dangers of COVID-19 and how to keep themselves safe. From the outset, De La Nuez leveraged existing relationships with seniors formed over 15 years with Grand St. Settlement. “Community organizations are extremely important to these emergencies because they know the communities,� she says. “They’re putting a familiar face to those services. ... (Seniors are) more likely to open those doors, to pick up the phone and reach out.� De La Nuez says many seniors, including her own parents living in Washington Heights, continue to experience anxiety about how to stay safe when they leave their homes. Many struggled to stay connected using new technology. “For them, trying to do everything virtually is hard,� she says. For those who lost loved ones, not being able to participate in traditional grieving rituals also took a toll. But she also saw outpourings of support. The organization received thank-you cards from strangers and encouraging notes to pass on to seniors. People wanted to volunteer and contribute resources for food distribution. Despite all the hardship, De La Nuez says she will remember the people who

did something to help. “I think in difficult times,� she says, “the best of people come out.�

FRANK DEPAOLO BEGAN his career with the New York City Office of Chief Medical Examiner in the shadow of one of the city’s biggest disasters, as an investigator assigned to recovery efforts at Ground Zero immediately after the 9/11 attacks – “to help identify people,� he says. Earlier this year, as the death toll from COVID19 began to mount in the city, he led the chief medical examiner’s forensic operations team through another catastrophe. “We serve as the city’s mortuary,� DePaolo explains. “What that means is that if the hospitals were to see a surge in deaths, it would be our office’s responsibility to assist them with the storage of those decedents.� In April, the city’s health department set the official death toll from COVID-19 at over 10,000. To meet the needs of the city’s hospitals, the chief medical examiner’s office rapidly implemented its disaster response plan – requesting a team of mortuary affairs personnel from the

Department of Health and Human Services and several hundred National Guard troops, as well as coordinating with other city agencies to request additional vehicles and support personnel. The office established four portable morgues throughout the city, beginning with a first location on 30th Street in Manhattan. “We saw a 100-fold increase in the number of calls coming into our office that we had to figure out how to manage,� DePaolo says. “We had a lot of people dying at home. We just just had an overwhelming number of deaths that we had to deal with.� DePaolo, who oversees a team of nearly 300, says many people misunderstand what his office does on a day-to-day basis. When people think of the medical examiner’s office, they mostly picture the type of work they’ve seen on television shows like “CSI� or “Law & Order.� But the work is much more nuanced, ranging from forensic work to counseling

families about genetic conditions to planning for funerals. “We are meeting with families at the worst time of their lives, helping them understand what happened to their loved ones,� he says. “Our role is for the families, for the living.�

agnosed with cancer, spurring him to dedicate himself to oncology, gaining recognition for using gene editing to help create viable alternatives to chemotherapy in research at the Sloan Kettering Institute. For someone undaunted by the prospect of curing cancer, COVID-19 was an appropriate next target for the Penn State medical student. Many of his friends and colleagues in the medical field were infected, and he was mindful that everyone close to him was at risk. “Recalling the fact that I was born in a pandemic, lived about the first five years of my life with Chernobyl, I promised myself that I would not let another pandemic occur under my watch without contributing in some way, shape or form,� he says. As a medical student, he was unable to care for COVID-19 patients directly, so he threw himself into researching the disease. He meets weekly with an international group of researchers, all part of the joint task force between the American

College of Academic International Academic Medicine and the World Academic Council of Emergency Medicine, to exchange ideas and updates about how the virus is being treated and spreading around the world. With that group, Leyfman created a cohesive model of the virus that demonstrated how it interacts with other cells. Leyfman has advocated for stem cell therapy to treat COVID-19 and warned of the dual threat posed by the coronavirus and the flu, always with the goal of being proactive about the disease. “If there’s anything that Chernobyl has taught me, it is pandemics are opportunities for hope,� he says. “They’re opportunities for innovation and opportunities to make a positive difference in the world.�

IN THE SPRING and summer,

when most New Yorkers were isolating in their homes, Jessi-

na Carroll Wachtelhausen and three medical workers on her team were working in Harlem testing neighbors for COVID19. A resident of Upper Manhattan for more than 15 years, Carroll Wachtelhausen responded enthusiastically when Gov. Andrew Cuomo put out a call for organizations to launch and run testing sites in March. She didn’t want to compel any of her staff to put themselves at risk to work at the site, so she called for volunteers, and three staff members quickly responded. “At the core of nursing is that we will go to the front lines when we’re needed,� Carroll Wachtelhausen says. While Carroll Wachtelhausen was still supervising the community health care provider’s multiple other sites in Manhattan, she oversaw the setup of the testing site in just three weeks. With help from the U.S. Department of Homeland Security, they trained staff about using personal protective equipment correctly and retrofitted the offices at Frederick Douglass Boulevard and West 127th Street to mini-

mize risk. Wachtelhausen says over 3,000 tests were administered at the Harlem site. While traveling around the borough to check in on Ryan Health’s sites, she also spent much of her time scouring the internet for personal protective equipment for her staff, realizing early on that she could stock up on full-body hazmat suits on Amazon when isolation gowns became scarce. Now, she continues to strategically stockpile equipment to prepare for a looming second wave. When it came time to close the temporary testing site in August to allow the organization to expand and reopen its primary care offices, she says the nursing staff were sad to leave the work behind. They had gotten to know the working people who came in for regular coronavirus testing, from hairdressers to home health workers. “We developed great relationships, so they were sad, and we were sad, but ultimately, we needed to get back to primary care,� Carroll Wachtelhausen says. “We got to know really everyone on the block.�

The organization was founded more than 50 years ago as a volunteer group of medical workers who recognized that LGBTQ patients weren’t receiving adequate care due to stigma. Now, Callen-Lorde operates a network of clinics across three boroughs, serving anyone who is seeking trauma-informed health care, and Santos Ramos focuses on building strategic partnerships and on initiatives that span across the organization’s sites. But when the coronavirus pandemic hit, he switched gears, focusing on the immediate. “Everything for the last six months or so has been what feels like minute by minute,� he says. He focused on Callen-Lorde’s finances, figuring out how to stave off disaster for the health centers that provide important care to thousands of LGBTQ New Yorkers in the middle of a crisis. First on

the list of priorities was rapidly cutting costs wherever possible, and Santos Ramos completed an exhaustive analysis of the organization’s vendor list to find areas to save money and as many jobs as possible. He also helped manage Callen-Lorde’s transition as it concentrated all sites to a main location on West 18th Street, redistributing supplies and staff accordingly and pivoting some services to telehealth. For the first time, Callen-Lorde partnered with the city Department of Homeless Services to run two isolation hotel shelters in Manhattan and Long Island City, Queens – one for youth and one for adults. Santos Ramos, who also serves on the board of the National Health Care for the Homeless Council and the Brooklyn Community Pride Center, provided administrative support for the partnership with the city, finding funding and supplies, and fielding donations. He made supply runs in his car and picked up shifts at the hotels. “It was really this amazing sort of jelling of the team,� he says, “with the sole mission of making sure that the folks who were being transferred to our hotel base were getting the best care that we were able to provide.�

TECHNOLOGY AND THE in-

ternet have become even more important as the COVID-19 pandemic has forced people to work from home, attend classes online and stay connected to loved ones from afar. And James Solis has dedicated his time to making sure that access to highspeed internet stays strong throughout lower Manhattan. His work hasn’t just landed him at residential buildings or businesses. Solis oversaw a team that played a critical role preparing for the arrival of the Navy ship the USNS Comfort, which came to New York City in late March to offer more hospital beds to COVID-19 patients and others in need of medical help. A team has access to Spectrum’s network in most neighborhoods when it’s connecting a building to service. But the USNS Comfort was docked at Pier 90 on the west side of Manhattan, where that access was nonexistent. Solis

and his workers had to survey the area and build their own infrastructure in advance of the ship’s arrival in order to provide internet connection across 12th Avenue and the West Side Highway. “A project like that would take at least a week,� he says. “We did that project in two and a half days.� The company also brought in more than 250 televisions to the 500-bed hospital ship to help patients and crew. Solis oversaw efforts to bolster the city’s critical pandemic emergency response beyond the USNS Comfort. After the ship left Manhattan at the end of April, he and his team continued to provide support to other entities located in the area including the Red Cross and the Federal Emergency Management Agency. He managed similar initiatives to provide service at other emergency hospital sites such as the one at the Jacob K. Javits Convention Center. “It was a great feeling because every time we rolled out the truck, we were out in the field, people would come out and thank us,� he says. “It was great to see the appreciation from people that you don’t see

accepted her dream job leading the nonprofit Getting Out and Staying Out – which helps formerly incarcerated men find jobs – she never anticipated that her first year would be spent combating unemployment in the middle of a global pandemic. GOSO quickly focused its attention on providing resources to participants despite closed offices and limited in-person interaction as the city completely shut down to slow the spread of the coronavirus. “What I’m most proud of is that throughout the pandemic we never stopped serving our participants,� Rainey says. “Making sure that they could get their paychecks because we actually pay them for their internship program and just making sure that we were continuously having programming.� The nonprofit opened its doors back up the day New York City transitioned into

phase 2 with hybrid work days for the majority of staff. GOSO provides job readiness training, educational resources and emotional support for men around New York who have been through the criminal justice system. When COVID-19 hit, the organization secured grants to make its services accessible remotely. It provided laptops and cell phones to participants searching for work and access to GOSO’s therapists and social workers. With these resources and the continued dedication of the staff working remotely, the organization was able to find work positions for 44 participants and distribute PPE and food to communities hammered by the pandemic. Rainey first began her career in workforce development during her nine-year tenure working with the Brooklyn Navy Yard Development Corp. While she was in her position, the Navy Yard went from placing about 100 people in jobs a year to close to a 1,000 placements annually. Rainey says the experience deepened her passion for giving a chance to those who are often overlooked in the job market. “I want to believe that if we are able to work with people and help them to be connected to the labor market and education, that we’ll change

lives,� she says. “We’ll change the lives of their families and we’ll change the lives of the people in the communities where they live.�

THE COVID-19 PANDEMIC

has brought on a unique set of challenges for Michael Phillips, who serves as the chief epidemiologist at NYU Langone Health. Phillips is no stranger to responding to health crises. During his second year working in the New York City health department, he monitored injuries and illnesses reported by first responders and others in the aftermath of 9/11. He’s even worked on the city’s response to anthrax attacks. He and others at the health network began discussing the coronavirus in January, when the outbreak first devastated Wuhan, China. “Very early on, we knew we had to think very differently,� he said. The outbreak in Wuhan, which has a modern health care system, indicated that such a disaster could very well repeat itself in New York City. Reports of the virus’s high transmission rate and severe symptoms com-

pared with the flu also worried Phillips and his colleagues. Even before the coronavirus was confirmed in the United States, they were working to acquire personal protective equipment and figuring out how to extend the use of a limited supply of N95 masks. When facing a threat with so many unknowns, “we can’t wait for the science, we can’t wait for the papers,� he said. “We had to gather what data we could and enact our measures based on it.� Then, for much of the worst of the outbreak in New York, Phillips ended up providing hands-on support at one of NYU Langone’s hospitals in Brooklyn, which was short on infectious disease specialists. Now that cases have decreased, he and his colleagues have returned to planning for a second wave. They have been monitoring data on the recent hot spots that have popped up in New York City in order to predict where people are most likely to be getting sick and organize interventions based on that information. “You constantly need to be humble and realize that the things that you’re thinking right now might not necessarily be true,� he said. “You have to constantly be willing to reassess your assumptions, and I think we got better at that.�

LOSERS ALEXANDRIA OCASIO-CORTEZ Long gone are the days when politicians bad-mouthed the influence of video games on America’s youth. Rep. Alexandria Ocasio-Cortez recently hopped on to the streaming platform Twitch and broadcast herself playing the viral video game “Among Us” while encouraging viewers to get out the vote. Around 435,000 viewers watched the livestream at its peak, making it one of Twitch’s most-watched events ever.

DaBaron has become a leader in the fight of some 240 homeless men trying to stay at the Lucerne hotel on the Upper West Side. One of the residents, DaBaron sued on behalf of the men trying to stay put, and a judge ruled the residents don’t need to move for now.

Thanks to the city census director’s outreach, nearly 62% of New Yorkers filled out their forms, beating the bureau’s pre-pandemic projections. The city even managed to outpace other major metropolises like Los Angeles and Chicago.

The NYC Ferry service, managed by the city’s Economic Development Corporation under James Patchett, has long been plagued with controversy. But last week, the owner of the private pier serving the ferry in Greenpoint barred the city from using it – to the surprise of Brooklynites already waiting on the pier.
