MY FATHER TOOK ME TO RIDE THE SUBWAYS WHEN I WAS A KID growing up in New York City, giving me an early appreciation for how practical and useful this flawed, aging system has been throughout most of my life. My mother, on the other hand, was more of a bus rider, teaching me how with a free transfer I could get two rides out of one fare. When Citi Bike was introduced in 2013, New Yorkers had an inexpensive way to combine a bicycle rental network with public transportation to get literally anywhere in the city. It sure provided an alternative to more expensive cab rides and Ubers. Many New Yorkers have come to depend on these options to survive the rising costs of living in the city. That’s why Gov. Kathy Hochul’s decision not to raise fares at the Metropolitan Transportation Authority for at least six months was welcome news during these difficult economic times, especially for lower-income residents. The MTA isn’t promising it can hold the line on fares when it balances its budget through 2025 next year. And many New Yorkers will fight a fare increase, especially those struggling to make ends meet. Eventually, a fare hike will come. Whatever that increase is, let’s hope the price of public transportation stays within a reasonable range so that it still can be the most practical and affordable way to get around town – for the greatest number of people.

time, details about the investigation’s conclusions have come to light, even though the committee has not yet publicly released the report as of publication. report also reportedly concluded that Cuomo misused state resources in writing his memoir last year about his handling of the COVID-19 pandemic that earned him an over $5 million advance. It remains unknown when the Judiciary Committee will officially release the report and whether the Assembly will actually move ahead with impeachment as state law is not clear on whether former governors can be impeached.

CUOMO’S BOOK DEAL IN QUESTION

In addition to the reported findings of the impeachment report, Cuomo received another blow the past week after the state’s ethics watchdog voted to revoke the permission it had previously granted for the ex-governor’s lucrative book deal. It took several attempts by members of the state Joint Commission of Public Ethics to actually agree to the revocation. In a nearly unanimous vote, the commissioners rescinded the approval previously granted by commission staff over what they called “material omissions and misrepresentations” about the book deal at the time. The commission ruled that Cuomo utilized state employees and resources while writing his book, an ethical no-no. He has claimed that all work on the book by staff was done in a volunteer fashion off the clock. Next steps are potential consequences for Cuomo – he could face fines up to $10,000 and

may even have to return the $5.1 million advance he received from the publisher.

SEVERAL ELECTIONS FINALLY SETTLED

Weeks after Election Day, a handful of races that remained up in the air finally came to conclusions with the count of absentee ballots. After trailing slightly on election night, New York City Council Member Justin Brannan pulled ahead and won reelection after officials counted mail-in ballots, an outcome the Democrat and speaker candidate confidently expected for weeks. And with absentees counted, the legislature in Monroe County flipped from red to blue for the first time in 30 years after a few close races were decided. Other Democrats were not so lucky, including Tony Avella, who officially lost an open City Council seat in Queens to Republican Vickie Paladino once absentees were tallied. And Nassau County Executive Laura

Poughkeepsie passes good cause eviction

With the passage of the federal infrastructure bill, Gov. Kathy Hochul announced that money coming to the MTA will mean that New Yorkers won’t see a fare hike in the foreseeable future, nor will they experience service cuts. That came as welcome news to straphangers and commuters after doomsday projections about the Metropolitan Transportation Authority’s budget caused fear about big fare increases. MTA officials later specified that there wouldn’t be fare hikes for at least six months at their annual board meeting. However, they later seemed to walk that back, saying that increased commuting prices are in fact still on the table for next year despite the promise of a delay.

Poughkeepsie became the latest in a string of upstate cities to adopt a good cause eviction bill after the city’s Common Council approved legislation last week and sent it along to the mayor for approval. It’s part of a continual local march toward new landmark tenant protections as the state fight heats up. Although specifics can vary slightly, the idea behind good cause eviction legislation is to prevent evictions except under specific circumstances and to set limits on rent increases. The newly passed Poughkeepsie iteration permits evictions in 10 specific circumstances, including failure to pay rent. However, if the lack of payment is the result of an “unconscionable” rent increase, defined in most cases as more than 5% in one year, then eviction is not permitted. So if signed, the law would effectively cap rent increases even on market-rate apartments, with exceptions like if improvements were made or major market changes take place. Poughkeepsie is now on pace to join the likes of Newburgh, Albany and Hudson in enacting these tenant protections. All are small liberal cities moving forward on an issue that state lawmakers are still debating. “Individual municipalities who are dealing with a housing crisis have the responsibility to step up and deliver for their

residents,” said Poughkeepsie Common Council Member Evan Menist, a sponsor of the legislation. “And hopefully, over time, more communities will take the steps to protect their tenants.” Lawmakers in Ithaca and Kingston are also considering good cause eviction legislation, and they may be next in line to approve it. This is good news for statewide tenant organizers with the Housing Justice for All coalition, who held rallies across New York last week to announce their agenda for the upcoming legislative session in Albany. Good cause eviction is among them, along with the repeal of a controversial tax break for developers to build affordable housing, approving a housing voucher program and expanding a state program to convert commercial buildings into housing. “If we are serious about public safety, then we have to be serious about stopping the eviction crisis,” said Assembly Member Zohran Mamdani of Queens at a Hudson Yards rally in Manhattan, alluding to discussions about crime and safety that dominated recent elections. The good cause eviction bill pushed by advocates and lawmakers like Mamdani would go even further than the Poughkeepsie version, limiting rent increases to 3%. – Rebecca C. Lewis

What does filibuster reform look like to you, and why is it important? The filibuster should not exist. It is an antimajoritarian Jim Crow relic that has been and continues to be used for the purpose of blocking civil rights and economic legislation in the best interest of the American people. For me, as someone who understands that our democracy faces its greatest test since Jim Crow, filibuster reform has to at a minimum include making an exception to the filibuster for purposes of passing voting rights and other democracy reform legislation. So, not just the John Lewis Voting Rights Advancement Act, which as important as it is, would still not undo

the voter suppression that we’ve seen in places like Georgia and Florida and Texas, but also a bill called the Freedom to Vote Act, which is a revised version of the For the People Act, that even Joe Manchin is now a cosponsor of. Sen. Chuck Schumer recently said that due to partisanship and the filibuster, Congress won’t be able to pass student loan debt cancellation. What do the current efforts now look like for canceling student loan debt? I think the prospects look good because the president is implicitly acknowledging he has the authority under the Higher Education Act to cancel federally held student debt because

his administration keeps doing it in modest contexts, such as instances of fraud and things like that. You know, for a while this year, the president has said he was waiting for an opinion from his lawyers on whether he had the authority to cancel student debt, despite having run his presidential campaign in part on the promise that he would cancel up to $10,000 in student debt. But, the fact that it has not happened yet is a travesty. And with the filibuster blocking things like a $15 minimum wage and legislative reform around student

debt, we have to have a president who uses his executive authority to provide transformative relief for Americans. Speaking on local politics, I have to ask, how do you feel about the “red wave” that took over New York in this year’s general election? I don’t know what red wave people are talking about. We just saw that in Ulster County that Democrats actually expanded their representation in local government. And, we saw Democratic victories for district attorney and

Our Perspective No Room for Harassment and Violence in our Retail Stores

etail sales in the U.S. are already surging as holiday shoppers are checking their lists and buying their gifts for the 2021 holiday season. It’s important that consumers are returning to stores this holiday season; but we are also concerned about an alarming uptick in harassment and abuse directed at retail workers, especially this year. Retail workers in New York — including thousands of RWDSU members at stores including Macy’s, Bloomingdale’s, H&M, Zara, Guitar Center, and more — are eager to welcome customers back into stores this holiday season. However, workers are experiencing increased aggression and poor treatment from stressed out shoppers. It’s been a tough time for retail workers in the U.S. and across the globe. Besides the risks to the health of workers and their families that’s hung over retail during the entire pandemic,

violence, abuse, and harassment on the job skyrocketed. Tensions rose as stores and governments instituted mask, social distancing, and other COVID safety protocols, and retail workers bore the brunt of customers’ anger, often fueled by misinformation and extreme political rhetoric. Workers were yelled at, spat upon, coughed on, and worse. Some workers have even been shot at — and some murdered — by irrational customers over mask and COVID restrictions. This type of behavior toward retail workers needs to end, and can’t simply be shrugged off as “part of the job.” We owe it to these retail workers — who have courageously served us throughout the darkest days of the pandemic — to make this a stress-free holiday season. Even in the best of times, the holiday season is very stressful for workers at retail stores and supermarkets. Big crowds, irritable customers,

in other contexts. So, I appreciate the frustration that people feel over Terry McAuliffe losing the governor’s mansion in Virginia. But I don’t think that’s indicative of a red wave so much as it is the way that Terry ran his campaign. I mean, in Westchester, George Latimer won reelection after having governed as a progressive county executive for the last four years. And Democrats in the Westchester County Legislature still have a supermajority. Justin Brannan won his City Council reelection as well. People were saying that he would lose to a Republican. I think, you know, the reports of the demise of the Democratic Party in New York were greatly exaggerated. – Patricia Battle

hectic days and the need for workers themselves to take care of their own holiday obligations can all weigh heavily on workers’ shoulders this time of year. In 2021, however, with the pandemic still a part of our lives, this stress could be exponentially worse. All of this is aggravated by a shortage of goods caused by supply chain problems this holiday season. Retail workers can become the target of shoppers’ frustration when customers hear that coveted holiday items are stuck on shipping containers at sea and have been backordered for months; and especially if they’ve gone to multiple stores only to go home empty handed. This holiday season, we need to treat retail workers with dignity and respect, and we must understand that our own stress and the problems we are experiencing shouldn’t be placed on the shoulders of working people. Workers are not to blame. Stores should provide security, safety protocols and training to handle problems that may arise. It’s a time to come together this holiday season and do everything we can to reduce stress and anxiety for each other, and especially retail workers. A little extra kindness and understanding will go a very long way this holiday season.

GALE BREWER The outgoing Manhattan borough president hopes her wealth of experience will appeal to the new council. By Annie McDonough

Even though there isn’t one consensus front-runner, there are names that are brought up more often than others in discussions about who will be the next speaker, and Brewer is not among that top group right now. After being a “maybe” candidate in the race for months, some members are still waiting for Brewer to step into the race with more gusto. Despite confirming that she’s running and appearing at a couple forums, Brewer’s candidacy still seems to lack some resolve. Several incoming members said that in meetings with her, Brewer has hardly brought up the fact that she’s running for speaker. “I don’t know how for real she is,” said one incoming member who asked to remain anonymous because they haven’t endorsed a speaker candidate yet. “The sense that I get from her is that she’s kind of throwing her hat in

In the summer and early fall months during which other candidates for speaker were cozying up to and pitching likely new council members, labor leaders and other power brokers, Brewer was openly mulling a run but not quite committing to it. She’s unsure when asked to pinpoint when she officially decided to run. “It was when I started meeting with people some weeks ago, maybe a month ago,” said Brewer, the outgoing Manhattan borough president and former City Council member. At the Somos conference in Puerto Rico earlier this month, that work was on display, as Brewer hosted a string of meetings with members on the Royal Sonesta hotel’s sweeping patio. (Incoming Council Member Rita Joseph of Brooklyn was just one new member spotted meeting with Brewer.) While she started to pack in those meetings at Somos, some members and observers said that Brewer was still late to the game. Try to point out that she’s a little tardy and Brewer will deny it. “I think it’s a wide open race,” Brewer told City & State. And she may be right about that; the speaker race does not seem to have a

the ring. If it happens, it happens.” Still, if anyone could come from behind in this race, it might be Brewer. Before serving 12 years in the City Council from 2002 through 2013 – where she introduced the city’s initial paid sick leave bill – Brewer worked for then-Council Member Ruth Messinger in the ’80s, and for then-Mayor David Dinkins and then-Public Advocate Mark Green in the ’90s. Her local political ties run deep – including with Mayor-elect Eric Adams, her fellow borough president who has complimented her at length for her wisdom. That résumé has allowed her to be a contender, despite not currently serving in the council. All the other speaker candidates are entering their second terms, while she’s entering her first (for the second time). So while her soon-to-be colleagues in the council may be familiar with Brewer, the constituent advocate and fixture of the Upper West Side, that doesn’t mean that they’re well acquainted with Brewer, the City Council speaker candidate. “Obviously she’s got a ton of experience, and I’m sure to an extent could do the job with her eyes closed,” said another incoming council member who asked not to be named because they hadn’t made up their mind in the

Why isn’t it easier to donate a kidney in New York?

EVEN THOUSAND New Yorkers need a kidney. At current donation rates, just 1,500 are likely to receive one in the next year. Of the remaining 5,500, around 400 will die. Black New Yorkers, who constitute 18% of the state population, will make up 36% of these deaths. As a result of low rates of kidney donation, New York has the seventh highest kidney waitlist in the nation per capita. Two bills have been introduced in the state Senate to promote kidney donation: One would fully reimburse the costs of kidney donation, and a second would go a step further by offering kidney donors free lifetime health insurance. Yet despite broad support among New York lawmakers for these measures, proponents have struggled to make kidney donation a legislative priority. “I think kidney advocacy doesn’t garner as much attention as it could,” said Kim Constantinesco, a kidney donor and advocate from Brooklyn. “There isn’t a sense of urgency with kidneys compared to other organs.” In the meantime, the supply of available kidneys remains woefully insufficient to meet the demand. Those whose lives hang in the balance include Vito Ottomanelli, a Bronxville native currently on the waitlist. “My nephrologist tells me it’s a five- to seven-year wait time. I have to go by that. I don’t know what else to go by,” he said. Three times a week, four hours at a time, Vito leaves his part time job as an insurance salesman to go to a dialysis center where machines filter out waste products from his blood. The process is emotionally and physically exhausting. “I’m sitting here in limbo. When am I going to get a kidney?” Ottomanelli told City & State. Giving kidney donors free health care Other countries have taken bold steps to encourage kidney donation, and a proposed bill would allow New York to follow suit. In 2010, Israel began compensating kidney donors up to $10,000 to cover disability, life, and health insurance, as well as a paid weeklong recovery vacation after surgery. Donations increased by 64% the following year. Today, Israel leads the world

in living kidney donation, with a rate six times higher than New York. Death from kidney disease has decreased by 17%. James Skoufis, a Democratic state senator from the Hudson Valley, proposed legislation in 2019 that would move New York in a similar direction by offering free lifetime health insurance to all kidney donors. The bill is currently in the state Senate Health Committee. “This legislation would ensure that folks

A study by Firat Bilgel, an economist at Istanbul Okan University, and Brian Galle, a professor of law at Georgetown, found that tax legislation in 2006 to encourage kidney donation in New York increased living kidney donations by 52%. Bilgel said in an email that passing Skoufis’ bill would create “similar, even greater effects.” At current rates, that would amount to over 250 more kidney donations per year. Since donations from altruistic kidney donors often cause transplant “chains” in which an average of four to six people can get a kidney from one donation, that could mean well over 250 lives saved per year.

Living kidney donation is a safe procedure, with risks to the donor similar to an appendectomy. Donors have a marginally

higher rate of end-stage renal disease, but since healthier people tend to donate, kidney donors have a higher life expectancy than the average population. Ed Holowinko, who also donated his kidney to a stranger, has struggled with cataracts in his right eye for the past few years (unrelated to his donation). When asked if free health insurance would have helped him after donating his kidney in an interview, his response was immediate:

Reimbursing kidney donors The next legislative session will also include a bill that would fully reimburse New York kidney donors for the costs associated with surgery. The New York State Living Donor Support Act, sponsored by state Sen. Gustavo Rivera, would fully reimburse New Yorkers who donate their kidneys for all costs associated with donation, including lost wages, travel, child and elder care, and costs of medication. A 2018 study found that the median cost of surgery for kidney donors is $1,254 without reimbursement. Rivera’s bill is currently in the Finance Committee, where it is one of over 500 bills that need approval before heading to the full state Senate for a vote. But because the Finance Committee meets only weekly or biweekly while the state Senate is in session, Rivera’s bill faces significant competition for attention even if no one objects to it. “There is no opposition to the bill that I am aware of,” Rivera wrote in an email. “The main hurdle is making it a priority for the conference and the will to appropriate funds towards this goal of increasing living donations.” Rivera estimates that his bill would cost New York approximately $3 million each year, but says it would also save the state about $2 million per year by reducing Medicaid costs for dialysis. The

In 2016, legislation sponsored by former state Sen. Kemp Hannon authorized 16- and 17-year-olds to register as organ donors. The number of eligible donors subsequently increased by nearly 1 million registrants from 2015 (3.86 million) to 2017 (4.8 million). Last month, Gov. Kathy Hochul signed into law legislation that gives vehicles that transport organs the same traffic privileg-

es as ambulances. Previously, vehicles that transported the organs of accident victims and other recently deceased organ donors had to abide by all traffic laws, such as stopping at red lights. Traffic was sometimes so bad that organ procurers would take public transit instead. Similar legislation, sponsored by state Sen. Sue Serino, a Republican representing the Hudson Valley, promised to do the same but languished in the state Senate Transportation Committee for half a decade. “There was a concern about extra vehicles with lights and sirens,” Serino said in an interview about why the bill was never made a priority. “But lives are on the line. People spend years waiting for organs.” “The last thing in the world that New York needs is losing a kidney on the Long Island Expressway because they couldn’t get through traffic,” said Aisha Tator, executive director of Donate Life New York State, a nonprofit that manages New York’s kidney registry. Asked whether Hochul supports further

action to shrink the kidney waitlist, deputy press secretary Avi Small suggested the ball is in the Legislature’s court. “Governor Hochul was proud to sign legislation earlier this year that supported the heroic actions of organ donors, and will review all additional bills that reach her desk,” he said. Barriers to new legislation Despite a lack of opposition, even modest advancements to promote kidney donation have been hard-fought. Hannon was surprised at how difficult it was to push through legislation supporting donation. “If I knew why, I would tell you,” he said. “I was one of the most frustrated on the issue.” Advocates have cited a lack of attention for kidney donation, resistance to paying for donor reimbursement and worries that donation is controversial in some communities. “Unfortunately, many serious health issues that affect a smaller number of the population are not discussed in public as

federal government, which bears the most of the expenses of dialysis, would save even more. A 2019 executive order from then-President Donald Trump similarly aimed to make living kidney donation financially harmless; however, funding for donor reimbursement remains in limbo. As of 2020, only 8% of living donors received reimbursement, with the average grant being around half of the cost of the average kidney donation.

often as they should be,” Rivera wrote. “More education is needed so my colleagues – and the public – can better understand and contextualize the dire emergency thousands of our fellow New Yorkers are facing.” Skoufis cited similar concerns when asked about why his bill was not getting more traction despite a lack of clear resistance. “General awareness (and) familiarity is likely to blame,” he wrote in an email. “If legislators aren’t familiar with the scope of the issue and the dire need for donors, they’re less likely to prioritize moving this bill forward. We need more coverage of the issue.” Safiya Raheem, the director of community and government affairs for LiveOnNY, New York’s organ procurement organization, said another barrier to policy is tepid support for donation in certain communities, citing low organ donor rates in the state’s Orthodox Jewish and Asian American populations. Kidney donation raises issues of bodily autonomy,

acceptable levels of medical risk and informed consent. “Incentivizing organ donation is not without controversy,” Skoufis added. Yet politicians may perceive kidney donation as more divisive than it actually is. A 2019 poll from the Johns Hopkins Carey Business School found that the majority of Americans supported compensating kidney donors if it led to more lives saved. Keren Ladin, an assistant professor of public health and community medicine at Tufts University who has written on the ethics of kidney donations, also supports financial reimbursement and free health care for kidney donors. “Reducing disincentives would most benefit those who are structurally marginalized and those with financial barriers to access, but would not go so far as to coerce anyone to donate,” she wrote in an email. In the meantime, thousands of New Yorkers on dialysis will hope to receive a phone call that a kidney is ready for transplant. John Young, an instructor at Teachers College, Columbia University, spent two years on dialysis before learning that he’d receive a kidney from a colleague. “I was shocked, dumbfounded,” he recounted in an interview. “She wanted to give me the gift of an improved life, of a renewed life, and did not expect anything back from it, no matter how much I wanted to give back to her. She was extremely selfless. Forever, in my lifetime, I am grateful to her for doing this.”

N ELECTION DAY, a “red wave” swept over New York City’s suburbs on Long Island. Republicans won open seats and even defeated incumbent Democrats in what were expected to be uneventful reelections. The same could not be said of the suburbs to the north in Westchester County, where Democrats held on to both county executive and their supermajority in the county legislature. A voter enrollment advantage and the lack of a contentious district attorney race likely helped Westchester Democrats this election, but political observers said they should proceed with caution after the warning shot on Long Island. Despite often being grouped together as New York City’s suburbs, Westchester and the Long Island counties of Nassau and Suffolk have their differences, as the 2021 elections clearly demonstrated. On Long Island, Nassau County Executive Laura Curran lost her reelection bid to Republican Bruce Blakeman, while Republican Ray Tierney beat Suffolk County District Attorney Tim Sini in perhaps the two most high-profile and unexpected Democratic losses. Republican Anne Donnelly handily beat Democratic state Sen. Todd Kaminsky for the open district attorney seat in Nassau. And in the county legislatures, Republicans gained a supermajority in Nassau and flipped the chamber in Suffolk. Compared to that, Westchester Democrats came out almost entirely unscathed. County Executive George Latimer easily won reelection, and the county legislature maintained its Democratic supermajority, winning all but two seats in the 17-member body. “I think our numbers were terrific, and it was a solid result across the board,” Latimer said in an interview with City & State. He pointed out also that his county even approved three ballot proposals championed by Democrats relating to voting rights and redistricting when they failed statewide and in other suburbs like Long Island. “We have more Democrats in Westchester than any of those other jurisdictions,” Latimer said, referring not just to Long Island but other nearby counties in the Hudson Valley. “We are probably the most Democratic county outside of New York City, with the possible exception of Albany.” The number of Democrats registered in Westchester certainly cannot be discounted in its ability to withstand the red wave

in a way that Nassau and Suffolk could not. The northern suburb has about 2.5 times the number of Democrats as Republicans, a gap of about 200,000 voters. That’s a much better landscape than Nassau, where Democrats outnumber Republicans by less than 100,000 voters. And even that is better than Suffolk, where Democrats only have about a 40,000-person advantage. “While a lot of people assume that Westchester and Nassau are kissing cousins demographically, economically and politically, migrating at the same pace from red to purple to blue, it just isn’t so,” said Lawrence Levy, executive dean of the National Center for Suburban Studies at Hofstra University. That in part could have to do with Westchester’s relative density in the southern part of the county, with more urban areas

like Yonkers and Mount Vernon making up more of the political base in a way that favors Democrats. “You have more of an urbanization and diversification, which doesn’t automatically mean that someone is going to be an enrolled Democrat, but it’s more likely than not,” said Westchester political consultant Jeffrey Binder. This will likely only continue as more multifamily and transit-oriented housing comes to those neighborhoods, while single-family homes and an aversion to density remain much more the norm throughout most of Nassau and Suffolk. However, Westchester’s more favorable circumstances in this particular election should not be overlooked. Unlike on Long Island, which featured a heated race for an open district attorney seat, Westchester had only Latimer’s race at the top of the

Republicans focused on crime and their criticisms of a 2019 state bail reform law in the Nassau district attorney race, which then influenced the other elections across the island in a way that simply did not happen in Westchester. Those same issues came up in one Westchester County Board of Legislators race that Democrats lost this year, a seat that had previously been solidly red until it flipped two years ago, but the discussions didn’t seem to impact other races. Westchester also has more registered Democrats, so the party’s lower than expected turnout likely played more of a role in Curran’s Nassau County loss. There is also the matter of Latimer’s own election, which none expected to be competitive in the first place. The same could arguably have been said of Curran’s race in Nassau or Sini’s race in Suf-

folk, but Binder said Latimer’s race was always destined to have been more of a slam dunk. “There’s a certain amount of credibility there, notwithstanding the fact that he’s run a few times,” Binder said in reference to incoming Nassau County Executive Bruce Blakeman, a longtime GOP politician in the county who previously ran several unsuccessful campaigns for various offices. “But I think that in Westchester, the county executive candidate for the GOP was initially supposed to be a placeholder, and then became not a placeholder.” Despite a career in government, this was challenger Christine Sculti’s first run for office, and it was against a popular incumbent who had previously unseated his Republican predecessor. Binder said that such a situation was not uncommon, as it can be difficult to convince strong

contenders to take on the challenge. Although Long Island Democrats came out as the big losers of the past election, their neighbors to the north would be wise to take those defeats as a warning sign, even though they handily maintained control of Westchester this year. Although much of New York continues to trend blue, despite the recent results on Long Island and in other parts of the state, the suburbs remain a politically tricky area where small changes can lead to dramatic shifts in election results. “Given their performance, Westchester Democrats earned the right to at least appreciate their laurels,” Levy said. “But it would be a mistake to rest on them because the next big issue or scandal or other political development miles away from Westchester … could make their lives much harder than they were a few weeks ago.”

SSEMBLY MEMBER AMY Paulin of Westchester is what you might call a legislator, legislator. A recent arrival at JFK Airport shows what this means. Her baggage was nowhere to be found after a long flight from Israel (where she was visiting one of her three children) and the chair of the powerful Assembly Committee on Corporations, Authorities and Commissions was in a legislative state of mind. “I’m thinking to myself: ‘Let me see this process through without using any liaisons that I have or anything, just to see what happens with lost luggage,’” said Paulin, whose committee oversees airports like JFK. She learned of legal ambiguities surrounding whether the airline or the terminal were responsible for the misplaced luggage and confronted a helpline that was only available in Hebrew. “It’s just so bizarre,” she added. She may or may not ever introduce a bill to help others avoid similar situations in the future – that all depends on where, when and how she gets her baggage back – but it was just one of many examples of how Paulin approaches situations by considering their potential legislative consequences. Her legislative oeuvre includes at least 1,740 bills overall – some of which were repeated from one two-year term into the next – nearly 300 of which have been signed into law since she first got elected in 2000. Compare that to your typical member of the Assembly who might only sponsor and pass a few bills every year. “She’s a model legislator,” Assembly Member Jeffrey Dinowitz of the Bronx said in an interview. “Not only because she gets a very large number of bills passed (but also because) a lot of them are bills that deal with very weighty issues.” Reproductive health, gun control, animal rights, additional protections for survivors of domestic violence. Those are just a few of the causes Paulin has championed in the Legislature over the years. The Brooklyn native, who moved to Westchester from Kings County decades ago, has gotten more bills signed into law than anyone else in the Assembly for three years running. Victories this year alone include new restrictions on gerrymandering at the local level and the repeal of the socalled walking while trans law and more than two dozen other bills signed into law with the support of activists and fellow lawmakers. There is no big secret to her success, however. Many bills she gets through the state Legislature through persistence

and a willingness to compromise. “If she wants to engage on an issue, you better know what you’re talking about,” political consultant Evan Stavisky, who has worked with her in the past, said in an interview. “She will engage stakeholders in good faith and try to ensure that New York’s enacting the best possible policies, and that’s the hallmark of a great legislator.” Paulin first came to the state Capitol as a part time legislative staffer in the 1970s while she was an undergraduate and graduate student at the University at Albany – but her real education in the byzantine ways of Albany began after she got elected to the Assembly at the turn of the millennium. An eagerness about the legislative process attracted mentors like Assembly Health Committee Chair Richard Gottfried of Manhattan, who helped her get bills through both chambers during her first term in office. She recalled one bill aimed at allowing nurses and pharmacists to dispense emergency contraceptives. “Without his help, I could have never written something as complicated as that bill,” she said. “His pen was all over it.” Gov. George Pataki would end up vetoing that specific bill in 2005 for reasons that included a lack of age restrictions. Dozens of other bills she got signed into law, however, began mak-

ing her a name as one of the more productive members of the Assembly by the mid-2000s. The legislative process is simple enough in theory, but much more complicated in practice in the Assembly. Lawmakers typically have their bills written by attorneys at the Bill Drafting Commission, or like Paulin, by members of their own staff. These bills then have to get on a committee agenda. That often requires getting the backing of influential staff who work for Assembly leadership as well as powerful committee chairs. And even when a bill gets out of one committee, it might still have to go through another committee like Ways and Means, which oversees spending, before the bill has any chance of reaching the Assembly floor for a vote. Controversial bills need to have debate times scheduled. That can mean pestering the floor counsel in some instances or even going to Speaker Carl Heastie, who did not respond to a request for comment, on particularly tricky bills. Potential roadblocks are present each step of the way, but Paulin has developed a few insights over the years. Some committee chairs like Gottfried like to be involved in the nuances of writing a bill from the relative get-go while others want things cleared with central staff first, according to Paulin. Another important part of the unofficial lawmaker process is getting other lawmakers to add their names as co-sponsors. Listing key committee chairs’ names first never hurts, she learned over time, nor does calling up potential allies. “If they don’t call me back, I will make a meeting,” Paulin added. “I don’t let go.” There are hundreds of bills that reflect the Paulin way of getting things done, but arguably none more so than a piece of legislation she ranks as her greatest legislative triumph – a 2006 law that eliminated the statutes of limitations on cases of rape and other sexual offenses. Getting this bill passed was no easy task. Some of her Democratic colleagues had concerns about eliminating the statutes of limitations entirely, Paulin recalled 15 years later. So she and her allies distributed a fact sheet on the bill to colleagues before a meeting of the Democratic conference. “Silver says, ‘Well, we can do it this way and that way, and I remember getting up in conference and slamming my hands on the table and saying ‘No, we have to have a law,’” Paulin said. She also told colleagues about her own experience with sexual assault as a teenager. “It took a lot of guts to even bring it up –

these are not things that many people want to talk about, but she was so committed,” Dinowitz said in an interview. Then-Assembly Speaker Sheldon Silver co-sponsored the bill, and Republican state Senate Majority Leader Dean Skelos of Long Island, who sponsored the bill in his then-GOP-controlled chamber, was the first name listed on the bill that Pataki signed into law. The whole experience with that bill was key to Paulin’s refined approach to legislation in the subsequent years. “I learned that a combination of hard work, passion and bringing your colleagues along can make anything happen,” she said. Her legislative output grew to about 150 bills introduced each two-year term she served in the chamber, with about 15 of them getting signed into law each year. “She is without a doubt the most prolific member of the Assembly,” said Westchester County Executive George Latimer, a former Democratic member of both chambers of the state Legislature during an era when the GOP mostly controlled the state Senate. “No Democratic Assembly member was better than she was at identifying a Republican that would carry a particular bill and help get it through the process.” Many of the bills championed by Paulin – such as an implemented ban on circus elephants and a bill that she has not passed yet on medical marijuana for pets – concern animal welfare, no surprise for an avowed poodle lover. Many more address parochial concerns like local tax rates and services, niche issues like the prospective right of New Yorkers to become human compost or more controversial topics like gun control. An average member of the Assembly by comparison might get a few bills done while a dozen or so members in the 107-member Democratic majority account for a disproportionate number of the bills that pass the chamber and become law, according to a review of legislative records. There are many reasons for that, but an important one to keep in mind is how different legislators approach their job. Some pride themselves on helping their constituents navigate the state bureaucracy while others view themselves as activists who can use the bully pulpit of elected office. Paulin is one of those lawmakers who takes her job particularly literally, and she has acquired some advantages over time. She now chairs a committee overseeing important agencies like the Port Authority of New York and New Jersey.

Her relationships with Westchester leaders like state Senate Majority Leader Andrea Stewart-Cousins and Latimer go back to the 1990s when she was making a name for herself in local politics as a member of the League of Women Voters and her local town board. One Republican staffer said some GOP legislators actively seek out influential Democratic members like Paulin with their own legislative ideas. “That’s the way to get things passed; I don’t care,” Long Island Republican Assembly Member David McDonough said of giving Paulin the idea for legislation she introduced to license and regulate pet groomers.

IKE OTHER LONGTIME legislators, Paulin has seen the political landscape change around her in a Legislature that now includes a growing number of outspoken socialists. “When I first came in, I was considered a progressive, and now I’m considered more moderate,” she said. This dynamic has led to conflict between relative moderates like Paulin and colleagues in both chambers. One recent example was the debate surrounding a multibillion-dollar relief fund for undocumented workers who were ineligible for other COVID-19 relief funds. Paulin said she was among the legislators pushing to include a requirement that applicants show they were state residents throughout the pandemic. Some supporters of the fund saw such a provision as standing in the way of getting an Excluded Workers Fund approved in the state budget. “If you are willing to stand against what these folks have more than earned through the blood, sweat and tears that they put into our communities

every day,” state Senate Health Chair Gustavo Rivera said at the time at a demonstration on Empire State Plaza outside the state Capitol. “Then guess what. You don’t get to do legislation with me.” He even told City & State at that time that he would never back a Paulin bill again. Rivera later apologized, and a spokesperson told City & State “all is well” between the two lawmakers. Assembly Member Amanda Septimo, a first-term lawmaker from the Bronx who publicly clashed with Assembly Member Tom Abinanti of Westchester on the issue of the Excluded Workers Fund, said Paulin’s diplomatic approach went a long way toward showing her how to get big things done in office. “Amy and I don’t share all the same politics, but I certainly think that we’re friends,” Septimo said in an interview. “She’s just an exceptionally skilled communicator.” In a workplace where legislating is the nominal goal, Paulin evidently has many friends. Some of them are new while others are the longtime collaborators like Gottfriend and Dinowitz who make up a regular dinner group with Paulin, Assembly Member Linda Rosenthal of Manhattan and Assembly Member Sandy Galef of the Hudson Valley. Her ability to work with people with different ideologies has likely also helped her coast to reelection in a district that includes affluent Scarsdale as well as other areas of Westchester County that have become more racially and economically diverse during her time in the Assembly. While other longtime legislators have faced primary challenges in recent years, Paulin appears safe for now, especially considering that she has more than half a million dollars in her campaign account, according to her most recent filings with the state. She says she has no plans to run for higher office or to ever become speaker. She would rather spend her time focusing on all the bills she has yet to pass. She introduced a career-high 237 bills and added her name to nearly 300 more as a co-sponsor this year. A total of 28 of them were signed into law by publication time, but she is still hoping for more in the final weeks of the year when governors traditionally decide the fate of hundreds of pieces of outstanding legislation. Then a new year will begin and Paulin will be back at work. “On my tombstone it’ll say: ‘Best bill passer,’” Paulin said a friend recently quipped. “I was always a very hard worker and always someone who was determined to be the best.”

ESTCHESTER COUNTY HAS shifted blue over the past several years. While Republicans regained ground in the 2021 elections on nearby Long Island, Democrats have continued to hold strong in Westchester. What’s more, many of the region’s power players wield immense influence on the state and federal level. State Senate Majority Leader Andrea Stewart-Cousins played a critical role in former Gov. Andrew Cuomo’s ouster and continues to serve as one of Albany’s most powerful elected officials under the new Hochul administration. Some politicos had floated County Executive George Latimer as a possible gubernatorial candidate, but he squashed those rumors –

2 GEORGE LATIMER WESTCHESTER COUNTY EXECUTIVE While some suburban Democrats in New York struggled on this year’s Election Day, Westchester County Executive George Latimer coasted to reelection. The former state lawmaker has been an effective executive, finding ways to keep the county’s budgets balanced,

including cutting property taxes and securing a new deal with the operators of the Playland Amusement Park in Rye. He also serves as president of the Affiliated Police Associations

of Westchester, which more broadly fights on behalf of officers across the county.

Community organizer Diana Sanchez advocates on behalf of undocumented immigrants in Yonkers and across Westchester County. She co-founded the Yonkers Sanctuary Movement, a grassroots group that fights for immigrant rights, alongside other progressive organizations, and is also a board member at the Hudson Valley Community Coalition. Over the past year, Sanchez fought for the passage of the Excluded Workers Fund to provide aid to undocumented workers.

Under Cynthia Delfino’s leadership, the YMCA of Central Northern Westchester continued to provide Westchester youth with vital programs and services throughout the COVID-19 pandemic. The nonprofit raised $303,180 to provide families with financial assistance to cover the costs of summer camp and child care last year and served 600 children across locations in North Salem, Putnam Valley and White Plains. Delfino is now in her eighth year leading the organization.
