In 2011, Gov. Andrew Cuomo’s first year in office, the state had to cobble together $10 billion to balance the budget.

This year, there’s a $4.4 billion shortfall – although if spending growth remains capped at 2 percent, the gap is just $1.7 billion.

Nonetheless, the governor is taking every opportunity to portray the situation in ominous terms. Last week, as he rolled out his spending plan, Cuomo asserted that “this is going to be the most challenging budget that we’ve had to do.” Earlier this month, he told lawmakers during his State of the State address that “the job you’re going to have to do may be the hardest job done by any legislative body to sit in modern political history.”

Historians might disagree, pointing to, say, the passage of the 1964 Civil Rights Act, or even the 2010 Affordable Care Act, as tougher tasks than the one Cuomo now confronts.

But the governor has a point – especially when it comes to the adverse impact of sweeping federal tax changes that will disproportionately affect New York. And that could make next year’s state budget even harder than this one.

C&S: As the new chairman of the New York City Council’s Oversight and Investigations Committee, how will the committee’s role be different this year?

RT: It will have universal subpoena power and universal jurisdiction, and it’s not meant to supersede the conventional committee structure. The difference here is that I think the speaker intends for me to serve as the council’s archaeologist, to do a much deeper dig into some of the managerial and operational failures affecting city government. And it’s important to make a distinction between what we do and what the Department of Investigation does. The point of Oversight and Investigations is not to investigate violations of ethics. It’s about failures of operations. So our focus is going to be on mismanagement, not malfeasance. I think the mandate of Oversight and Investigations is to make government work.

C&S: The Daily News had a recent op-ed that New York City already has enough oversight bodies. What’s your response?

RT: I do believe there is something distinctive about the investigative role of the City Council.

We in the council are in a unique position to break down the silos in city government. We are in a unique position to align the auditing function of the comptroller with the oversight function of the City Council. Or align the investigative function of DOI with the oversight function of the City Council. We’re the only institution that not only can investigate but also can hold oversight hearings on our investigative findings, and then use those investigative findings to inform decisions about budgeting and policymaking and the full range of functions we perform at the City Council.

The details on congestion pricing from Cuomo’s Fix New York City panel are out. If the plan is approved, drivers would have to pay $11.52 to enter Manhattan below 60th Street, although that excludes FDR Drive north of the Brooklyn Bridge. In addition to the tolls, cabs and ride-hailing vehicles would add $2 to $5 surcharges for rides within the fare zone. New York City Mayor Bill de Blasio said he saw some good elements in the plan, a sharp contrast to his past criticisms of congestion pricing. Why New York won’t beat the new federal tax law in court – and why it shouldn’t even try

GOV. ANDREW CUOMO complained bitterly about the federal government’s recent capping of state and local tax deductions in his State of the State address this month.

“Washington has launched an all-out direct attack on New York state’s economic future by eliminating full deductibility of state and local taxes,” he said.

And he proposed a remedy. “We will challenge it in court as unconstitutional, the first federal double taxation in history, violative of states’ rights and the principle of equal protection.”

Previously unlimited, the so-called SALT deduction will be capped at $10,000 under the new federal tax law, resulting in a substantial federal tax hike for affluent families in high-tax states like New York. Cuomo was right to note that removing SALT deductibility is unprecedented in the 100-year history of the federal income tax, but legal challenges to capping the SALT deduction are highly unlikely to succeed.

A U.S. Supreme Court with a conservative majority is unlikely to be receptive to the claims of state governments led by Democrats. And, in this case, they would be right to reject New York’s claims.

Nothing in the Constitution requires the federal government to make state and local taxes deductible.

What is the basis of the lawsuits that will be brought by the attorneys general of New York and other states? Cuomo’s invocation of “states’ rights” and “equal protection” are vague, but there are a few potential arguments.

While the equal protection clause of the 14th Amendment applies to the treatment of individuals, not states, in the 2013 case Shelby County v. Holder – which ruled a crucial section of the Voting Rights Act of 1965 unconstitutional – the Supreme Court found an implicit principle of state equal sovereignty, or the idea that each state joined the country on equal footing as each other state. But in that case, the relevant section of the Voting Rights Act applied to some states and not others. The Republican tax law will be applied identically in all 50 states. It’s true that the law has a different impact in some states rather than others, but this is true of most of the U.S. Code. After all, the unlimited SALT exemption also impacts some states differently – which is why Cuomo supports it – but that doesn’t make it unconstitutional. “I don’t understand how capping SALT is much different than funding formulas for Medicaid or Medicare that differenti-

ate between low-density and high-density population regions,” said Leah Litman, a law professor at the University of California, Irvine and author of an article about the Shelby County case in the Michigan Law Review.

As Litman wrote, there’s another reason for liberals to resist using Shelby County to attack the capping of the SALT deduction: It’s a hopelessly incoherent holding with no clear basis in the text of the Constitution or in the precedents of the Supreme Court, which puts it among the worst decisions in the court’s history.

As the recently retired federal judge and conservative legal scholar Richard Posner said, “There is no doctrine of equal sovereignty. The opinion rests on air.” Reifying this novel doctrine, which was invented by the court’s conservative majority to empower Republican-leaning states to make it more difficult for racial minorities to vote, will harm liberal ends more than it will help them. For example, it could be used to stop efforts by a Democratic Congress to strengthen the Voting Rights Act. Liberals should not legitimize this weak and dangerous argument as part of what will be an almost certainly futile quest to win a relatively minor battle.

The challenges to the SALT cap may also invoke Comptroller v. Wynne, a 2015 case that did not allow residents of Maryland to fully deduct the income tax they paid in other states. Some observers have described this holding as a prohibition against “double taxation.” But Wynne’s holding is not obviously applicable here: Maryland’s tax was held to violate the so-called “dormant Commerce Clause,” which forbids state regulations and taxes

that interfere with the federal power to regulate interstate commerce. This doctrine prohibits states from discriminating against other states in their economic regulations. But this holding isn’t relevant to a federal law. Indeed, Congress can permit states to enact laws that would otherwise violate the dormant Commerce Clause, so it would be odd to see this case as limiting federal power. There is no constitutional principle against “double taxation” per se.

And this is a good thing, because this dubious concept is also frequently invoked by conservatives to oppose progressive taxes like the capital gains tax.

And then there’s the final resort of all dubious “states’ rights” arguments: the 10th Amendment, which reserves all powers not delegated to the federal government to the states or the people. But as former Supreme Court Justice Harlan Fiske Stone wrote, “The amendment states but a truism that all is retained which has not been surrendered.” It’s only relevant to cases where the federal government is acting outside its delegated powers. But the tax power is unquestionably a valid federal power, and nothing in any provision of the Constitution requires the federal government to deduct state and local taxes.

It’s understandable that a lot of taxpayers in states like New York don’t like this policy change, but the appropriate remedy is at the ballot box. Progressives should resist the temptation to invoke specious constitutional arguments that have historically been the source of some of the Supreme Court’s worst decisions.

1. The Empire State strikes back

Cuomo dedicated the beginning and end of his speech to laying out New York’s response to the new federal tax law that limits the state and local property and income tax deduction to $10,000, which could be damaging to high-tax states like New York.

Cuomo reiterated his proposal, unveiled during his State of the State address, to sue the federal government over the tax plan and fight for its repeal.

He also expanded upon his plan to restructure the state’s tax system by shifting from income taxes to payroll taxes, proposing the introduction of the New York State Taxpayer Protection Act. This would allow employers to pay a wage tax equal to an employee’s current income tax that would be fully deductible on a company’s federal tax bill.

State Budget Director Robert Mujica said in a subsequent briefing that switching to a payroll tax would be voluntary for businesses.

Cuomo also suggested introducing charitable contributions, which California is also considering, that would allow New Yorkers to give their state and local tax payments to a state-run charity and be able to deduct that contribution on their federal taxes.

“Washington hit a button, and launched an economic missile, and it says ‘New York’ on it, and it’s headed our way,” Cuomo said about the tax plan. His advice is to “get out of the way before it lands” by restructuring the state tax system.

Cuomo also mentioned the state Department of Taxation and Finance’s preliminary report that was released the following day with recommendations for responding to the new federal tax law.

WHEN GOV. ANDREW CUOMO presented his $168.2 billion budget for fiscal year 2019 last week, it was like a coach at halftime when his team’s outcome seems almost impossibly grim.

“This year is going to be challenging, my friends,” he told state lawmakers at the beginning of the address. “In many ways, this is going to be the most challenging budget that we’ve had to do.”

The challenge, Cuomo said, is not closing the state’s $4.4 billion deficit, which he called the “easy part”; it is adjusting to the federal tax overhaul signed by President Donald Trump in December.

Cuomo’s speech included some granular details, an accompanying slideshow presentation and, in what is also becoming something of a tradition, an outburst by firebrand Assemblyman Charles Barron.

Barron heckled Cuomo during the speech, charging that he was not spending enough for poor children.

“It’s never enough,” Cuomo retorted.

Here are the major takeaways from the governor’s budget address, as he tried to convince the rest of the legislators that balancing priorities and working together would, in fact, be enough for this year.

2. Ponying up for health care and education

Cuomo proposed $1 billion in revenue increases in lieu of the politically unpalatable alternatives of cutting health care and education funding. Half of the additional money would go to a health care shortfall fund, and half to education spending. Cuomo proposed a 3 percent increase in school aid, less than the 4.2 percent previously projected. He also proposed an additional $103 million for higher education, and called for implementing phase two of the Excelsior Scholarship, providing free tuition for students from families earning up to $110,000.

To generate all that revenue, Cuomo would tax health insurance companies, which get a 40 percent corporate tax cut under the new federal law; introducing a surcharge on opioid manufacturers; eliminating the carried interest loophole, with the cooperation of other states; and introducing a sales tax on internet retailers like Amazon.

3. Congestion pricing plan

Cuomo’s Fix New York City panel released its congestion pricing plan on Friday, and one-way trips into a congested area of Manhattan would cost $11.52. The plan would not toll the East River bridges, but instead would designate an area of Manhattan below 60th Street that would be tolled. While cars and trucks would be tolled at different rates, the panel recommended that taxis and ride-hailing vehicles be exempt from the zone charge, but pay a smaller fee per trip.

In his speech before the plan was released, the governor said it would use the same technology as the cashless tolling of bridges and tunnels.

He also took a jab at New York City Mayor Bill de Blasio by saying the city needed to pay half of the $836 million cost for immediate fixes to the New York City subway system, which de Blasio has adamantly refused to do.

“We have funded it 50 percent, New York City needs to fund it 50 percent,” he said.

4. Breezing through some details

Cuomo proposed several items that were not fully addressed in his budget speech, such as enacting a uniform statewide sexual harassment policy for all branches of state and local government. He deferred the issue of legalizing marijuana by instructing the state Health Department to study its potential impacts.

He noted the judiciary increased its budget request by 2.5 percent, after praising other state entities for limiting their requested increases to 2 percent or less. Cuomo said he supports the judiciary budget only if judges certify that the courts under their jurisdiction are operating properly, but did not go into how this would be enforced. (He also called for courts to be open from 9 a.m. to 5 p.m. every day.)

After going quickly through several budget proposals, Cuomo said lawmakers may not be happy with the balance of priorities presented by the budget, but as his slideshow noted, they must not “lose the forest for the trees” and get caught in the minutiae.

5. All in this together

As the governor repeatedly used the word “difficult” to describe the budget process, he also implored the state Legislature to work together in responding to the economic consequences of the federal tax plan.

He reminded legislators of what the state has accomplished in the seven years he has been in office, such as capping property tax growth at 2 percent and limiting state spending increases each year to 2 percent overall. Cuomo said that the response to the tax plan was not a partisan issue, but one that affected all New Yorkers and should be addressed by a unified state Legislature.

“At the end of the day, the history books are going to say about you, that you are the Legislature that actually performed,” he said, cheering on his team. “This is tough, but it’s doable, and we’re going to do it together and we’re going to do it on time.”

As he did in his State of the State, the governor laid out the case that New York is under attack from the new federal tax law, thanks to a controversial $10,000 cap on the state and local tax deduction that will hammer many high-income New Yorkers.

“Washington hit a button and launched an economic missile and it says ‘New York’ on it and it’s headed our way,” Cuomo said, advocating the state “get out of the way before it lands” by moving from an employee-paid income tax to an employer-paid payroll tax.

“It’s not just the budget this year, it’s an economic transformation of the climate this year,” Cuomo said during his fiscal rundown, which was relatively brief at just under 40 minutes.

Yet critics and budget experts alike noted that the governor still didn’t explain how he would carry out all of the goals laid out in his State of the State address earlier this month.

“Unfortunately, today’s Executive Budget presentation was long on fingerpointing, yet short on financial details,” Assembly Minority Leader Brian Kolb, a Republican who is seeking his party’s nomination to run against Cuomo this fall, said in a statement criticizing the address as little more than political positioning.

“We need more specifics on the governor’s spending plan for a complete assessment of its potential.”

Generally, fiscal policy experts agreed that the governor spent little time elaborating on exactly how he planned to raise and spend New Yorkers’ money during the budget address, leaving them to wonder how Cuomo’s raft of proposals would meet his stated goals, as they and the rest of Albany pored over the notoriously dense budget documents.

“An understandably undetailed budget presentation,” David Friedfel, the director of state studies at the Citizens Budget Commission, said shortly after the governor’s address. Friedfel also noted that the scandals surrounding state economic development investments and funding for the homeless were noticeably absent.

“The economic development funding is a concern. The state has continued to spend tremendous amounts of money with lackluster results,” Friedfel said, adding that he hoped the state would not end up increasing spending in that area.

“It’s money that could be much better directed elsewhere.”

Several experts also were surprised with the lack of information on the governor’s proposal on congestion pricing, which was released after the speech on Friday

by Cuomo’s Fix New York City panel after missing its December deadline.

“The congestion pricing piece is a little surprising. The federal tax reform happened relatively recently, but congestion pricing, those ideas have been around for a while,” Friedfel said. “This isn’t a new issue.”

To generate revenue for his $168.2 billion budget – and close the $4.4 billion budget gap – Cuomo did roll out several proposals to raise revenue, including a tax on health insurance companies, which get a 40 percent corporate tax cut under the new federal law; introducing a surcharge on opioid manufacturers; eliminating the carried interest loophole, with the cooperation of other states; and introducing a sales tax on internet retailers like Amazon.

But several experts cited Cuomo’s decision to transfer payroll mobility tax revenue to the Metropolitan Transportation Authority as an obvious tactic to simply make it appear as though state budget spending would stay within the administration’s long-term goal of only 2 percent growth by effectively shifting a major expense into another column.

“Essentially (it will) never hit the state’s books, so it won’t count as state revenue or state spending, which isn’t really a big deal from a budgetary perspective,” Friedfel said. “From an accounting perspective, it lets them say their spending declined by $1 billion, when it hasn’t. It’s just kind of changed pockets.”

For Ron Deutsch, executive director of the Fiscal Policy Institute, it appeared what was missing from Cuomo’s budget presentation was enough ways to raise the money needed to close the state’s $4.4 billion budget gap. “(Cuomo) comes up with a few solid mechanisms to basically generate some needed revenue,” Deutsch said. “We would suggest he actually needs to do more to raise revenue.”

Deutsch continued, “So one of the things we would be suggesting, and I think the governor may be alluding to this a bit, would be to develop a recapture tax where you try and recapture a substantial percentage of the federal tax cuts from both businesses and individuals who are going to be receiving a big windfall.”

He said a stock transfer tax, a mansion tax or a pied-à-terre tax could be used to make up the difference.

For others, what was missing from the governor’s budget was their slice of the pie.

“One item that was particularly concerning for us is that the executive budget eliminates all operating aid for the not-for-profit colleges,” said Mary Beth Labate, the governor’s former budget director who is now president of the Commission on Independent Colleges and Universities, which represents private, nonprofit colleges and universities on public policy issues. “That funding was zeroed out in the executive budget. It is used to provide financial aid for students.

We obviously are concerned about that.”

Labate said she plans to try to convince legislators and the governor’s office to reverse that decision in the coming weeks.

She will not be alone.

Blair Horner, executive director of the New York Public Interest Research Group, was similarly disappointed, but not surprised, that there was no mention of anti-corruption reforms in the governor’s address after they were hardly mentioned in the State of the State. At first glance, he said, it appears that the ethics and voting reforms are wrapped up in Article VII bills, which can be easily rejected by legislators. A cybersecurity measure, however, made it into an appropriations bill, which Horner said indicates it will likely pass.

What will follow in Albany is several weeks of legislative hearings on the executive budget proposals, as lawmakers, lobbyists and interest groups jockey for a better outcome and constituents can weigh in on how the proposals would affect them.

State Senate Deputy Majority Leader John DeFrancisco also noted an omission, of sorts. He sees the potential for a new hidden state tax hike in the governor’s proposal to dodge the fiscal impact of federal taxes.

“I’ll bet you 10-to-1 if this payroll tax comes into being, it will be as the governor calls ‘revenue enhancer,’” DeFrancisco said. “What I call an increase in taxes.”

LABOR ACTIVISTS ARE hailing this month’s successful organizing drive by the 400 staffers at Vox Media as a sign that digital journalists can unionize and attain the kind of job security that reporters took for granted a generation ago.

The Vox staff joins employees from a growing list of media companies – including Vice Media, HuffPost, The Intercept, Gizmodo Media Group, ThinkProgress and MTV News – that have secured representation with the Writers Guild of America East.

Of course, Vox’s unionization comes just a few months after the push to organize digital media companies was hit with a high-profile setback when billionaire businessman Joe Ricketts pulled the plug on DNAinfo and Gothamist after its employees voted to unionize.

But Lowell Peterson, the executive director of the Writers Guild of America East, said that instead of demoralizing the former DNAinfo and Gothamist staffers, the mass firing inspired them to double down on their labor activism.

“The journalists at DNAinfo and Gothamist that lost their jobs are out there right now organizing with us,” Peterson told City & State. “In fact, when we had the Vox Media victory party, there were a whole lot of DNAinfo/Gothamist former staffers in the audience fir-

ing people up saying congratulations.”

Peterson added, “The day they all lost their jobs they got on Twitter and said, we are not afraid, don’t be afraid, keep organizing. If we weren’t unionized, we wouldn’t have won severance pay and other protections and, in any event, you need to have a voice.” The 115 employees got three months of paid administrative leave plus four weeks of severance pay.

Ricketts is also barred from restarting the news sites, according to the union.

When Ricketts shut down the news outlets, he wrote, “DNAinfo is, at the end of the day, a business, and businesses need to be economically successful if they are to endure.” He closed by expressing hope “that in time, someone will crack the code on a business that can support exceptional neighborhood storytelling for I believe telling those stories remains essential.”

But Peterson said he sees Ricketts’ decision as an outlier in terms of how other owners and management have been responding to the guild’s organizing drives in digital news. Initially, he said, the situation was “horrific” because freelance writers and independent contractors were paid little, “and that was only if the company decided to run the piece – and if they did not run the piece you had just worked for free for three weeks.”

“What we have actually found is a pleasant surprise,” he said. “At least in the more economically stable websites and digital media companies, there is a move away from freelance work in favor of full-time staffing. I think that the conclusion that management has drawn is that if you want to have quality journalism, you have got to pay people. You have to make it a sustainable career and a purely freelance rip-off model is just not a sustainable model, which is not to say there still isn’t abuse, there certainly is.”

The guild represents 1,000 people in digital media, in addition to staffers at TV networks like ABC and CBS. “This is a good era for people who craft stories for a living,” Peterson said.

BUT THE SUCCESS of organizing at several digital media companies has to be seen in the broader context of the well-documented decline of local professional journalism both in New York City and across the country.

As Ross Barkan wrote for Columbia Journalism Review in November, the newspaper industry is in the midst of a “frightening decline” that “has hit all cities and towns hard.”

Barkan, who recently launched a run for state Senate, flagged the inability of digital advertising to “make up for what print

once paid for. Google and Facebook gobble up what little ad revenue exists in the digital space.” He cited federal statistics that showed “more than half the jobs in the news industry have disappeared” in the past 15 years, dropping from 411,800 to 173,709.

That’s an even steeper drop-off than the 39 percent decline in newsroom staffing that the Pew Research Center found between 1994 and 2014. No doubt, what’s going on is seismic.

Between 1981 and 2014, the nation went from 1,730 newspapers down to 1,331.

That decline continues, not just in terms of newspapers closing all together, but in reporters having their pay cut or being furloughed so their publisher can bring down labor costs.

Yet, the nation’s colleges and universities continue to churn out thousands of journalism majors. In 2015, there were more than 17,000 journalism degrees handed out, just a 1.4 percent decline from the previous year, according to Data USA. MATT TRACY, 27, who lives in Brooklyn and graduated from Ithaca College, has known he wanted to be a journalist since middle school. Even before he graduated from high school, he was contributing to a baseball magazine. Tracy also worked on a freelance basis as a sports clerk for his hometown newspaper.

He describes a predatory power imbalance between the folks with work to assign and the young people desperate to do it. “One of the biggest problems is getting paid,” Tracy said. “I have had to go to the (state) Department of Labor, and the enforcement there is not what it should be considering such a huge part of the journalism workforce consists of freelancers and part-timers who are also not getting any holidays, any vacation days and no health care from the employer.”

Tracy said he was encouraged last year when the Freelance Isn’t Free Act took effect in New York City, entitling freelancers to a binding contract for work worth at least $800. “I was a little disappointed that they set the minimum for the law at just $800, because getting stiffed for less than that still becomes a problem in terms of paying rent,” he said.

A 2015 report by the Freelancers Union found almost three-quarters of the more than 5,000 freelancers it surveyed had trouble getting paid at some point in their careers and more than a third of those who had reported encountering payment problems cited instances where they were not paid at all. The survey participants reported losing an average

of almost $6,000 in unpaid fees during 2014 alone.

In 2014, Tracy landed a full-time job at the Latin Post, an online publication where he first cultivated a relationship as a freelancer. It went out of business and he was back where he started: freelancing. He said his college did little to prepare him for the labor market he encountered.

“Absolutely, the most glaring problem is that they will prepare you for creating content and the job you might be doing, but they don’t prepare you for the job market and it feels like they almost deliberately withhold that from you because as a college they want to keep the major going,” he said.

Over the past few years, Tracy has seen his multiple freelance gigs pay off by expanding the range of subjects he writes about, beyond just sports and entertainment. He now covers politics for The National Memo.

He’s also had some success with his startup hyperlocal news website Coney Island News. “The whole reason I wanted to start that was because hyperlocal is just dwindling, especially in the city where there is such a concentration of people and such huge areas that are not

being covered at all,” he said. “So that was my goal in starting that – to be able to provide the local community with a sense of what was going on. … It is something I enjoy doing whether I make money or not.”

Tracy has had several stories that drew several thousand hits, including a scoop on billionaire John Catsimatidis’ plans for trolley service to connect one of his developments on the western end of Coney Island to a subway station. “And what was significant about that was Coney Island is known as one of those public transportation deserts without enough public transportation out there,” Tracy said. “That did resonate out there with people.”

Journalism’s contraction is not just a challenge for recent college graduates.

Lorraine Ash is an award-winning northern New Jersey news editor. The veteran journalist has been on both sides of the newspaper industry’s dramatic consolidation, both as a staffer and as a manager.

“As for journalists, they are left to find other arenas in which to ply their trade,” Ash said. “In my case, I’m ghostwriting books, an industry that is still robustly well and growing. Many of my colleagues across the state and the nation, however, are leaving the field entirely. I understand

why but it also pains me that we can find no place for so many journalists who are and always have been an essential part of our republic since it began.”

Ash warned that the decline of authentic local news and its replacement by aggregated free social media content is already having an impact. “When coverage is like Swiss cheese – a paucity of viewpoints and lots of stories that are simply missing – a vacuum is created,” she said. “That’s the space in which fake news and undisciplined, unresearched writing thrives. Unfortunately, that kind of writing erodes the public knowledge base instead of adding to it.”

Ash said she recently saw a fake news story posted by a Facebook user that “wildly speculated” about the political cause and motivation behind the house fire at Bill and Hillary Clinton’s home in Chappaqua.

“What it asserted about the fire itself also was wholly incorrect,” she said. “I posted that the story had been produced by a notorious fake news site. The user replied, ‘The point is it could be true, so no harm in posting.’ That’s dangerous.

What could be true is fiction. What is true is news. We want citizens acting – and voters voting – on the basis of what is true.”

Want to curb opioid deaths in New York?

Expand marijuana, experts say

PRESIDENT DONALD TRUMP has pledged to end the growing scourge of opioid abuse.

The president’s attorney general, Jeff Sessions, has paved the way for prosecuting the nascent marijuana industry legalized in a growing number of states.

But the dual federal efforts may be at odds with each other, experts said, citing evidence that expanding access to mari-

juana could actually help combat the opioid epidemic.

Dr. Julia Arnsten, a professor at the Albert Einstein College of Medicine, said at a recent Assembly hearing that states that have legalized medical marijuana average a lower rate of opioid-related deaths than states without such a program.

She pointed to one 2014 study by her colleague Dr. Marcus Bachhuber that showed

those states saw about 25 percent fewer deaths in comparison. Arnsten noted the states with medical marijuana programs still had rising deaths due to opioids, but they rose at a slower rate. She added that those findings have since been confirmed by two subsequent studies conducted by different researchers.

is available are opting to use that to relieve chronic or severe pain rather than relying on opioid painkillers.

“Avoiding opioid medication in favor of medical marijuana lowers the risk of opioid overdose either because individuals do not progress to opioid use disorder, or they do not accidentally overdose on the opioids prescribed to them,” Arnsten said at the Assembly hearing, which centered on whether to legalize recreational marijuana by passing the Marijuana Regulation and Taxation Act, which has been proposed in three straight legislative sessions.

New York already has a medical marijuana program, which was authorized in 2014. However, the law said marijuana can only be prescribed for a specific list of conditions. Assemblyman Richard Gottfried introduced legislation that would eliminate that list, but it has not advanced. Arnsten said that fully legalizing and regulating marijuana would expand access and lead to fewer opioid-related deaths.

New York ranked fifth in the nation in terms of opioid-related deaths in 2016, the most recent data available from the

U.S. Centers for Disease Control and Prevention. That’s more than 3,500 deaths, nearly 1,000 more deaths than in 2015. Erie County, an area hit particularly hard by the epidemic, also experienced its fourth-straight year of increasing opioid deaths.

“While further research is needed from states that have recently enacted legislation policies, there is reason to believe legalization and regulation of marijuana in New York will have a favorable impact on the opioid epidemic and on broader health outcomes,” Arnsten said.

Marijuana not only provides an alternative to opioid painkillers, it is also far safer than even alcohol, according to Dr. Julia Holland of the nonprofit group Doctors for Cannabis Regulation, who said 125,000 deaths per year are attributed to alcohol.

“Cannabis doesn’t kill,” Holland said at the Assembly hearing. “Unlike alcohol, which is neurotoxic, meaning it destroys brain matter over the long term, cannabis actually can protect against brain injury. … The vast majority of American adults are unharmed by the use of cannabis.”

Sheriff Barry Virts, the incoming president of the New York State Sheriffs’ Association and one of the few naysayers at the hearing, said he feared legalization would worsen the opioid epidemic. But Holland rejected that view of marijuana as a gateway drug, saying that the majority of people who use it do not go on to use other illicit drugs.

Dana Beal, a longtime marijuana advocate, said the drug can be used to treat substance abuse. He said marijuana is a “front-line detox” and works better than drugs like naloxone or methadone. However, Assemblyman Michael DenDekker said that currently he is not aware of any study that examines the efficacy of using medical marijuana as a treatment for substance abuse, adding that he would like documentation for people who just “don’t get it.”

New York decriminalized the possession of small amounts of marijuana in 1977. If the legislation debated at January’s hearing passes, New York would become the ninth state in the country to allow legal, regulated marijuana use for adults.

BROOKLYN From a rich history of factories and shipbuilding springs a new culture of small business innovation

Brooklyn of 100 years ago, home to nearly 2 million people, was a bustling manufacturing hub of more than 6,700 factories that employed more than 200,000 workers. But despite that prodigious capacity, Ralph Jonas, a local business leader, was reported to have said in the Brooklyn Eagle that the borough alone, among the big industrial centers, did not have a representative of its own interests in Washington, D.C. The Brooklyn Chamber of Commerce was founded on Feb. 6, 1918, just days before President Woodrow Wilson addressed a joint session of Congress to discuss his Fourteen Points peace plan at the end of World War I. “One of the highest patriotic duties is the formation of such bodies in every community in the country,” U.S. Secretary of War Newton Baker said at the time.

But the mission of the newly created body went well beyond the war effort.

“Brooklyn is full of splendid men who are never heard from,” Brooklyn Chamber of Commerce President James Sherlock Davis remarked at the chamber’s first annual dinner. “Many of them have things to say that we ought to hear.”

One thing that hasn’t changed in the past 100 years? “There’s no place on Earth as innovative as Kings County, Brooklyn, USA,” said Andrew Hoan, the chamber’s current president.

community was the Manufacturers Industrial Show of 1922, which showcased more than 200 local companies at the 23rd Regiment Armory in Crown Heights.

A decade after the armistice that ended World War I, the country was thrust into yet another crisis following the stock market crash of 1929, which led to the Great Depression. The chamber, which by then was the second-largest local chamber chapter in the country, launched the All Brooklyn Progress Movement to shore up local businesses and address unemployment, in part through education programs.

During World War II, the Brooklyn Navy Yard employed 70,000 people at its peak to become the largest shipbuilding facility in the country, but in the postwar years, the borough’s economic fortunes began to wane. The beloved Dodgers decamped for California; the Brooklyn Eagle ceased printing after 114 years. In 1966, the Brooklyn Navy Yard, which had been the borough’s largest employer, was decommissioned.

The next couple of decades were marked by economic stagnation and rising crime across New York City – and Brooklyn was not immune. The chamber responded with initiatives like the Livingston Street Committee, which facilitated cooperation between merchants and local police precincts in order to improve public safety, but it was not until last decade of the 20th century that the borough began to emerge from its slump.

Brooklyn had long been home to large manufacturers such as Pfizer – and popular brands such as Twizzlers and Sweet’N Low – but as those companies left in the latter half of the 20th century, the industrial parks and warehouse complexes they had vacated – such as Industry City , then PUBLISHER’S SECTION

called Bush Terminal, and the Brooklyn Navy Yard – were gradually repurposed.

“Brooklyn has always been an incubator for businesses,” said Peter Meyer, who served as the chamber’s chair from 2008 to 2012. “It has a great job market – a great supply of talent – and it’s a very innovative place. A lot of companies that started in Brooklyn and wound up elsewhere were replaced with new technologies and smaller manufacturers.”

Beginning in the 1990s, the chamber promoted emerging industries with a series of programs – Brooklyn Designs, Brooklyn Goes Global, Good Help and Brooklyn Eats – that helped elevate the borough’s profile as an international brand and hotbed for new trends and innovation.

“It was a new world,” recalled Carlo A. Scissura, who was chamber president and CEO from 2012 to 2016, of those heady days. Scissura oversaw the chamber’s continuing evolution from its traditional model to a direct service organization that also offered health care, financial, recruitment and legal services.

The chamber also introduced new programming for minority- and women-owned business enterprises, or MWBEs, and bolstered its small business services and outreach, with initiatives like Chamber on the Go, a mobile van that allows the organization to “engage small businesses that might be located in East New York or Brownsville, which can’t always come to attend a networking or educational event,” according to Denise Arbesu, the chamber’s chair and the first woman and Latina to hold that position.

It was also under Scissura that the organization, which now has a staff of more than 40 people along with more than 2,000 members, began sending a delegation on

a legislative trip to Washington, D.C. And in 2017, under the leadership of Scissura’s successor, Andrew Hoan, the chamber made its inaugural legislative visit to New York City Hall.

“The chamber now has an identity on the city, state and national level,” the former president said.

Hoan also continued expanding the reach of the organization within the borough while working to position Brooklyn as a national leader in the innovation economy. Moreover, Hoan has continued to ramp up the chamber’s economic development tools. Last year, he unveiled Brooklyn Alliance Capital Inc., a fund that provides loans to immigrant and minority businesses. (The chamber hopes it will be designated a Community Development Financial Institution this year.)

Hoan has also made business attraction a major focus of the chamber. “We can’t assume that the economy is always going to be strong and business always flourishing,” Hoan said. “Now we’re very active in saying, ‘Hey come to Brooklyn, open your business here.’”

When Amazon announced its national search for a second headquarters, Hoan joined forces with Brooklyn Borough President Eric Adams and local business leaders to pitch the internet retail giant on the advantages of Brooklyn. Hoan also played a key role in assembling a coalition of real estate leaders, elected officials, academic institutions and cultural and community organizations to support growth along Brooklyn’s “Innovation Coast.” National Grid, the multinational utility company, has aided those efforts with a grant for analytical research into assets, real estate and other economic opportunities along the borough’s rapidly redeveloping waterfront.

“The next time a big company like an Amazon says, ‘Hey, we’re looking for a home,’ we don’t have to scramble to submit a bid,” Hoan said. “We can just take this research off the shelf, put it on their desk and say: ‘Where else would you want to be but Brooklyn?’”

One of the chamber’s key partners in promoting the Innovation Coast has been the New York University Tandon School of Engineering, which along with CUNY’s New York City College of Technology forms the backbone of the Jay Street corridor that provides a steady infusion of new talent into the borough’s burgeoning workforce.

“New York state has been going through a boom in the innovation economy, with Brooklyn really leading the way, and so we wanted to figure out how do we fit in – how do we ensure that this bubble doesn’t burst and we can keep it going for a long time?” said Sayar Lonial, Tandon’s senior director of marketing and communications, on the decision to partner with the chamber.

“The Brooklyn Chamber of Commerce has been a valued partner for many years as our borough’s leading advocate for economic development,” Brooklyn Borough President Eric Adams said. “From collaboration on tourism promotion through Explore Brooklyn and work with our business improvement districts to forward-thinking planning on emerging industries such as craft brewing, urban agriculture and high-tech manufacturing, we stand shoulder to shoulder walking into a new century of opportunities that will grow all of our neighborhoods.”

The chamber has had its ups and downs over the past 100 years, same as the borough it serves, but the resiliency of both has produced results that are impossible to ignore. Brooklyn’s rate of job creation continues to outpace the rest of the city and state. In 2016, the borough added almost 26,000 new jobs with a growth rate of 4.6 percent, which is more than double the city’s growth rate of 1.9 percent. If current trends continue, Brooklyn could surpass Chicago as the country’s third largest city in the 2020 census.

Last year, the chamber helped enroll more than 1,000 people in health care plans, certified 280 products as “Brooklyn-Made” and helped 100 local businesses attain MWBE certification.

“It’s a special moment,” said Hoan, on celebrating the centennial at a time when his organization and the borough are more buoyant than ever. “If we continue to work hard, this chamber – and all of Brooklyn – will continue to thrive.”

A CONVERSATION WITH BROOKLYN CHAMBER OF COMMERCE PRESIDENT

Andrew Hoan joined the Brooklyn Chamber of Commerce in 2012, after serving as director of capital budgets and economic development for then-Brooklyn Borough President Marty Markowitz. He has served as president of the chamber since December 2016.

C&S: WHAT HAVE BEEN THE HIGHLIGHTS FROM YOUR FIVE YEARS AT THE CHAMBER? AH: Last year, we created of a new corporation that

is part of the Brooklyn Chamber, called Brooklyn Alliance Capital, which provides (loans) to immigrant and minority businesses. I think granting a loan to a company in a low- or moderate-income neighborhood that may need a few thousand dollars for paint supplies, or money for a new refrigerator if it’s a food establishment, is one of the more profound things that we do.

I joined the chamber the week after Superstorm Sandy, and one thing that we were able to do, along with TD Bank, was create the Five Borough Chamber Alliance with all the sister chambers (in Queens, Manhattan, Bronx and Staten Island).

The Alliance funded emergency response and provided assistance to those that had been impacted

by Sandy.

We provide technical assistance to commercial and retail strips around the borough, and help form business improvement districts. It may not be the flashiest thing, but you see how proud people are when we do tree lighting ceremonies and other marketing and promotion events.

We’ve been going to Albany for a long, long time, as well as D.C., but we had never done a legislative visit to City Hall until we added that to our calendar this past year. It completed the trifecta of government relations.

Finally, last year we were named the Chamber of Commerce of the Year in New York state.

C&S: HOW IS YOUR FIVE-YEAR STRATEGIC PLAN COMING ALONG? AH: We just entered our second year. One goal was

to have a successful centennial year, and the planning for the big celebration is well underway, and our party will be the party of the century. We have also prioritized creating strategic partnerships with other organizations so we’re not competing amongst ourselves, and we’ll be announcing the deepening of the relationship between the five chambers of New York City as part of our centennial work. Then there is the establishment of the permanent home for the chamber, which – more than just an office – will a home for small businesses, with meeting rooms and facilities, an educational center, an incubator. We are in the process of raising serious money and will either expand in our current location or find a new home to build for the next century.

C&S: YOU RECENTLY HELPED LEAD A CAMPAIGN TO BRING AMAZON’S SECOND HEADQUARTERS TO BROOKLYN. WHAT’S YOUR ELEVATOR PITCH TO A CEO THINKING ABOUT SETTING UP SHOP IN BROOKLYN? AH: It’s actually one word: workforce. If you go any

other place in America, you’ll scramble to identi-

fy the talent that a company like Amazon needs, and not just to do the work they’re doing today. A company like Amazon is only as good as its next initiative, its next technology, its next advertising campaign. It thrives only because it’s innovative, and there’s no place on Earth as innovative as Kings County, Brooklyn, USA. The people here are the most talented and diverse, linguistically and ethnically – they come from all over the world. So it’s the best place to put any business that requires a global customer base, because the globe is already here.

C&S: WHAT’S YOUR GO-TO BROOKLYN TOUR WHEN SOMEONE FROM OUT OF TOWN VISITS? AH: I belong to an association of chamber of com-

merce executives, and all the presidents from big cities get together twice a year in different cities, and it’s the responsibility of host chamber to show everyone around. So this past October, I had the pleasure of hosting my fellow presidents. We obviously welcomed them at our office in Downtown Brooklyn, so they could see the skyline, and then we walked to the Brooklyn Heights Promenade and went to a new farm-to-table restaurant, so they could get a taste of the new artisanal scene.

The next day we started the morning at Junior’s – because everyone should go to Junior’s – and then took a tour through downtown and Dumbo and got on the ferry to Williamsburg and Greenpoint … just rolling along the waterfront. After that we went to the Brooklyn Navy Yard to see all interesting things happening there, and then we got back on the ferry to Red Hook and visited the Red Hook Winery and the other businesses and manufacturers there, and then, that evening, we drove through Central Brooklyn, down Ocean Parkway, to see those diverse neighborhoods and we ended up in Coney Island, so they could see the Parachute Jump and boardwalk. For dinner, we went to Gargiulo’s and the owner sat with us, and we drank and ate more food than they’d ever seen in their lives. It was a real welcoming atmosphere, and that’s what Brooklyn is in a nutshell.

C&S: I UNDERSTAND YOU’RE AN AVID ROCK CLIMBER. HAVE YOU FOUND ANY PLACE TO CLIMB IN BROOKLYN? AH: I love climbing, and when I moved to New

York City I didn’t think there would be any rock climbing, but lucky for me there was a group of entrepreneurs that opened a rock climbing gym in Gowanus called Brooklyn Boulders. New York City Mayor Bill de Blasio’s monuments commission has decided to keep the statue of the Genoan explorer at Columbus Circle, despite criticisms that the city shouldn’t honor a brutal colonizer who exploited native populations. The city did make a small concession, with the commission deciding to add historical markers to “continue public discourse,” but Columbus is still riding high and lives to spark protests another day.

BILL DE BLASIO Bigger than Cuomo in stature, the New York City mayor will always be smaller than the governor in power. Last week alone, Cuomo screwed de Blasio out of designbuild authorization, put him on the hook for MTA funding and tipped off reporters that a NYCHA funding delay was the mayor’s fault. Unable to even assert his power over a former Nazi collaborator (the marker about Philippe Petain will stay), Hizzoner also went low by insulting a reporter about his hat.

IS THIS A JOKE? An editorial appearing in the New York Post on January 2nd reported that “State officials” reported confiscating 46,000 cartons of bootlegged, untaxed cigarettes during 2017: Self-importantly, stating that it was a record year. Seriously? The editorial goes on to say that according to The Tax Foundation, 57% of cigarettes consumed in New York are untaxed contraband. (It is 80% in New York City by industry calculations). But, if 57% are untaxed statewide, then 43% are taxed.

SIMPLE MATH New York State taxed approximately 22 million cartons during the past year, representing 43% of consumption. The 57% of untaxed cigarette consumption amounted to 29 millions of contraband cartons. The 46,000 cartons that were seized therefore, represent only one sixth of 1%! Is this disgrace worthy of praise?

Cigarette bootlegging has cost taxpayers $25 Billion since the Bloomberg NYC tax increase of 2002. And that is no joking matter. Nor is it a joke that our Government; our Tax Department; and our Governor lack the political will to enforce the law, protect the revenue for our public use, and in short, do their jobs!

WHAT IS REAL ENFORCEMENT? The State Association of Cigarette Tax Agents have repeatedly implored Albany to enforce our tax law, including giving advice from industry knowledge, with suggestions on sensible methods to greatly increase the effectiveness of tax enforcement. Those efforts have fell on deaf ears without exception - WHY? Billions of our needed tax revenue has been abrogated in favor of thieves and terrorist funding, while New York’s legitimate retailers and wholesalers go broke!

What perversion of politics or, acceptance of governmental insouciance has allowed New York to favor criminals over taxpayers; out of state ‘big tobacco’ over New York jobs and businesses; and inflated health costs as cheap cigarettes increase smoking.

Where is the outrage from our Health Officials, who watch the unabated flood of cheap cigarettes bootlegged into New York and instead lobby for higher cigarette excise taxes that without proper enforcement can only worsen health costs? $2.5 Billion dollars squandered each year, while our public officials brag of collecting $5 million!

What a Joke! What a disgrace!
