WHEN I APPLIED TO GO TO COLLEGE in the mid-1980s, I was encouraged by guidance counselors to pick the “Hispanic” box on admissions applications. I was the son of Cuban and Chilean parents, but wasn’t accustomed to the awkward need to identify my ethnicity. I was told affirmative action might increase my chances of getting accepted into college. So, I checked the box and wondered whether I was truly being considered on my merits. Gov. Kathy Hochul wanted to run with a person of color and picked Brian Benjamin to become the state’s second Black lieutenant governor. Now she has replaced Benjamin after his resignation with Rep. Antonio Delgado. “Delgado is Afro-Latino, the first person of color to represent Upstate New York in Congress and a member of both the Black and Hispanic Congressional Caucuses,” said her office when Delgado’s appointment was announced last week. Delgado has since defended his claim of being a Latino. “I am African American, and I am Cape Verdean,” he said at a press conference to clarify his background after suggesting he was Hispanic because Cape Verde was a former Portuguese colony. Critics didn’t see it that way. Hochul’s campaign later added that Delgado has a grandfather with roots in Mexico, Venezuela and Colombia. Personally, I found the debate over Delgado’s ethnicity offensive and insensitive. He should consider himself whatever he wants, and if he’s wrong about it, then that’s on him. Choosing Delgado to be lieutenant governor, that’s on Hochul. Criticism over her choice highlights the disappointment over Latino representation at the highest levels of local and state government. The solution for that may not best come from making appointments. Instead, a viable Latino candidate needs to run and win elections to ensure true representation.

Five months into his tenure, New York City Mayor Eric Adams has begun to disappoint New Yorkers, an inevitability for most mayors that the city loves to hate. A new Quinnipiac University
poll found that Adams’ rating on how he handles crime plummeted since February, dropping from 49% to 37%, ultimately leaving him with a negative approval rating there. His ratings across the board dropped to varying degrees, from his handling of the coronavirus
pandemic to his grasp on homelessness. On the latter, Adams also received a negative rating, with only 31% of New Yorkers feeling he has done well addressing homelessness. The poll came out shortly before new statistics on sweeps of homeless encampments ordered by

New Yorkers welcomed their third lieutenant governor in less than a year as Gov. Kathy Hochul announced that Rep. Antonio Delgado would serve out the rest of former Lt. Gov. Brian Benjamin’s term. Benjamin left the position vacant when he resigned amid an indictment on federal corruption charges. Delgado also replaced Benjamin on the June primary ballot, something made possible thanks to a bill the state Legislature passed. Introduced at the behest of the governor, the bill changed election law to permit a candidate to withdraw from the ballot if they get indicted, as Benjamin had, reopening a very narrow window of opportunity to remove someone from the ballot. It faced fierce opposition even among Democrats, who didn’t like the idea of changing the rules in the middle of an election cycle just to help Hochul get a new running mate, only narrowly passing the state Senate. Delgado’s impending appointment will necessitate his resignation from Congress, leading to a special election. Already, a few Democrats have

ABORTION RIGHTS ACTIVISTS TAKE TO THE STREETS
After a U.S. Supreme Court draft opinion overturning the landmark Roe v. Wade decision ensuring a person’s right to get an abortion, people turned out in support of abortion rights. Though only a draft opinion, it revealed that a majority of the court is prepared to eliminate a 50-year-old right and set a new judicial precedent with regards to reproductive rights, as well as the broader right to privacy. Hundreds gathered in Manhattan’s Foley Square, joined by prominent officials like state Attorney General Letitia James, who shared that she had an abortion and said it was a decision

she felt no shame about. In Albany, state lawmakers rallied with the governor, Planned Parenthood and activists in support of abortion rights.
RENT HIKES COMING TO AFFORDABLE UNITS After years of either small increases or complete freezes, the Rent Guidelines Board voted to allow up to a 6% rent hike for stabilized apartments. While landlord groups lobbied for the greater increase, arguing that years of largely flat rents did cover rising real estate costs, renters fearful that their rent will become financially unfeasible strongly protested against it. Renters and housing advocates said that steep rental increases for the over 2 million stabilized tenants could accelerate displacement and worsen the city’s homelessness crisis.

‘Springtime conservative prom’ There was an undeniably celebratory mood at the Manhattan Institute’s Alexander Hamilton Award Dinner on May 3 – dubbed “springtime conservative prom” by 2013 GOP New York City mayoral nominee Joe Lhota. The U.S. Supreme Court draft opinion overturning Roe v. Wade went unmentioned on stage, even though some of those in the room at Cipriani 42nd Street – including Rep. Andrew Garbarino, gubernatorial candidate Rob Astorino and honoree Wall Street Journal Editorial Page Editor Paul Gigot – may agree with the conservative majority on the court. That only made Democratic Rep. Tom Suozzi’s appearance at the gala more surprising, as many of his fellow Democrats were downtown at Foley Square, rallying against the draft opinion against legal abortion. “This was a pre-planned event for me to stop by, because the editor of the Wall Street Journal was being honored, and I wanted to say hello,” Suozzi explained to City & State the day after the dinner. But Suozzi insisted his attendance at the conservative think tank’s event didn’t send a conflicting message as he runs in the Democratic primary for

governor. “Lifelong Democrat. Solid, lifelong, Democratic record,” he said. There were differing politics on the stage, where one speaker after another eagerly predicted that the country and the city were on the cusp of a conservative revolution, as crime and inflation, among other factors, pushed voters to the right. Right now, New York’s conservative cabal is small. “The entire rightof-center population of the greatest city in the world is right here tonight,” Manhattan Institute Chair Paul Singer joked in his remarks. But it is growing. “We have new friends, refugees from the left, yearning to breathe free.” Others in attendance included NYPD Commissioner Keechant Sewell, and two of her predecessors, Dermot Shea and Ray Kelly. New York City Mayor Eric Adams himself was thousands of miles away in Los Angeles, ahead of his appearance at a conference for a different think tank, the Milken Institute. Despite his police commissioner’s presence, Adams wasn’t exactly discussed kindly – a Manhattan Institute video included the line: “In New York, we’re holding Mayor Adams accountable amid a surge in crime.” – Jeff Coltin

Please discuss the lack of broadband access in New York City and how your plan came about. This problem became really acute to me when I was running the census for the city, because a third of New Yorkers lack access to broadband. It was a real problem in terms of accessibility, reaching New Yorkers who did not have access to broadband. And when I first took office in January, the number of NYCHA residents in my district who told me that they did not have broadband because it was too expensive was shocking. It’s outrageous, and it’s unacceptable. If you don’t have access to broadband, you can be
shut out of trying to apply for a job or getting a fair wage. And you know, your resume for job interviews. If you have children, they are being left out of the process in terms of not having connectivity to Wi-Fi and the fact that a third of New Yorkers don’t have this, it is absolutely shocking. And so what this program seeks to do is to roll it out in NYCHA, and it’s something that 100% is scalable for the city of New York. So, I started working on this project over last summer and reached out to a not-for-profit based out of San Francisco called EducationSuperHighway, which has been doing free Wi-Fi in public schools

across the country. I brought them in to help advise on the project. And basically what we did was go to Spectrum and Verizon, and we got them to offer a truly lowcost plan, but one that is actually high quality. In the past, first of all, Verizon and Spectrum plans were oftentimes cost-prohibitive, and they didn’t really have the features that you need to have to have a true broadband package. So, we got them to agree to do this and certify all the residents of Isaacs Houses and Holmes Towers, which are two developments in the East Harlem part of my district. Federal Communications Commission provides a $30-a-month federal subsidy that NYCHA residents can qualify for, but that many are not aware of. We are pairing that federal subsidy with the new low-cost plan, and that is going to bring the residents’ cost to zero. How do you envision expanding this low-cost broadband to help all of NYCHA? So in order to do this, a couple of things had to happen. First, we got Verizon and Spectrum to reduce the cost and do a high-quality plan that didn’t exist before. Second, we paired it with the $30-a-month
subsidy, which is incredibly important. The guidelines for who’s eligible for it require basically that a household’s income is at or below 100% of the federal poverty guidelines. And that can be anyone who participates in the Supplemental Nutrition Assistance Program, Medicaid and who lives in public housing. This is why NYCHA residents automatically qualify for this $30-a-month subsidy. This is scalable. The city of New York has been grappling with how to provide free broadband. This is the way to do it. This is a way that does not cost any city funding to do this. This is absolutely doable. – Ralph R. Ortega

Swing and a miss Gov. Kathy Hochul may have doomed Democrats in a tossup House district by choosing Rep. Antonio Delgado as her No. 2. By Rebecca C. Lewis

OV. KATHY HOCHUL once again sent shockwaves through the New York political ecosystem with her choice of Rep. Antonio Delgado to replace former Lt. Gov. Brian Benjamin after he resigned following his indictment on federal corruption charges. The announcement ended weeks of speculation about who would serve out Benjamin’s term and, more recently, who would replace him on the ballot. Delgado shares Hochul’s moderate political ideology and provides her with a Black and Cape Verdean running mate to compete against two Latinas in the race for lieutenant governor.
But Hochul’s choice also leaves vacant a vulnerable seat in the mid-Hudson Valley. Delgado was expected to face a tough challenge from Dutchess County Executive Marc Molinaro in a year in which Democrats are trying to maintain a tenuous hold on the House. Now, Democrats’ control of the 19th Congressional District has become even more uncertain without an incumbent and as district lines remain in limbo. Delgado won a contentious race in 2018 against former Republican Rep. John Faso. In 2020, Delgado was the only Democrat out of the three to flip seats in 2018 to win reelection, with former Democratic Reps. Max Rose and Anthony Brindisi both los-

ing their seats after just one term. Delgado has walked a fine ideological line within his largely rural district, mostly steering clear of hot-button issues. But a strong challenge from Molinaro, who previously ran for governor, put his future in question. Democrats originally shored up Delgado’s district to make it more safely blue during the redistricting process, but those lines are being redrawn after a judge ruled the lines had been gerrymandered. The decision to remove a Democratic member of Congress from a swing district has at least some Democrats concerned. “You left an open seat in Congress,” Assembly Member Maritza Davila of Brooklyn told City & State. “This is what we’re

trying to avoid.” She said she felt confident that the seat will return to Republican hands now. “She has to live with her own choices,” Davila added. Longtime Democratic consultant Camille Rivera offered a similar opinion. “We need to stop with the win at all costs and think of consequences later,” Rivera said in a text to City & State. “We need better Democrats, not just any.” Democratic strategist Basil Smikle, who worked on getting Delgado elected in 2018 as the executive director of the state Democratic Party, said he had confidence that Delgado would be a good lieutenant governor. But he said that Hochul’s decision still stands to hurt the party overall in terms of keeping and winning seats in Congress. “Leaving that seat open leaves Democrats vulnerable this fall,” Smikle told City & State. He said Molinaro, who has prided himself on his ability to work across the aisle much like Delgado, represented a particularly tough opponent, especially without an incumbent running. “Taking (Delgado) off the table … could put that district back into Republican hands,” Smikle said. Molinaro told City & State that he felt “very good” about his race in the wake of Delgado’s exit. State Senate Majority Leader Andrea Stewart-Cousins distanced herself from Hochul when asked what she thought about the decision to leave a swing congressional seat open during a precarious election for Democrats at the federal level. “We have a governor who has made a decision based on her understanding of the race that she needs to run,” Stewart-Cousins told reporters. “We had nothing to do with her choice or why she made it.” She did not go so far as to say whether she felt that choice was right or wrong. But both Hochul and Delgado downplayed the risk to the seat and Democrats’ control of the House when asked about that concern during their first public appearance together in Albany. “We are going to work very hard to ensure the majority in the House of Representatives,” Hochul said. She did not directly address the question about the vulnerability that Delgado’s absence in the 2022 race for the 19th Congressional District may cause. Delgado similarly did not offer thoughts on the competitive special election that will take place to fill the vacancy and the potential

that his seat could turn red again. “I still represent my constituents in New York 19, I still am acting on their behalf as a statewide elected official,” Delgado said. Later, when asked what he could better accomplish for New York as lieutenant governor – a position with almost no institutional power – as opposed to as a member of Congress, Delgado could not offer concrete examples aside from expressing excitement at the opportunity to directly connect with local leaders on how to use resources secured at the federal level. “To be able to do that, on the ground, to me is tremendously exciting,” Delgado said. “And I think I can have a profound impact on demonstrating to people that government can work for the people and enable communities.” Other Democratic lawmakers offered more direct confidence that Delgado’s exit from Congress will not profoundly harm the party. “We have strong Democratic candidates, I’m sure, looking at that seat,” state Sen. Brad Hoylman of Manhattan told City & State. “I would expect a worthy successor in the Democratic nomination.” State Democratic Party Chair Jay Jacobs told City & State that the party already has potential candidates in mind for the seat, but declined to offer any names. But interested politicians have already begun to emerge, including Ulster County Executive Pat Ryan, who placed second to Delgado in the crowded Democratic primary for the seat in 2018. “I’m now seriously considering how best to continue serving my community and constituents,” Ryan said in a tweet as part of a thread about Delgado’s appointment as lieutenant governor. “So stay tuned.”

State lawmakers have a couple packages of abortion bills to protect women and providers. By Sara Dorn

EW YORK’S GUBERNATORIAL candidates adhered to party lines in the wake of the release of the U.S. Supreme Court’s draft decision that would overturn Roe v. Wade and eliminate federally mandated abortion rights. Gov. Kathy Hochul said she was “horrified” by the report. Republican candidate Rep. Lee Zeldin stuck to the narrative attacking the leaked report, while his primary opponent Andrew Giuliani expressed support for the expected ruling. “We have been fighting this battle for too long. I refuse to go backwards. I refuse to let my new granddaughter have to fight for the rights generations have fought for and won, rights that she should be guaranteed,” Hochul said in a statement. She vowed: “New York will always be a place where abortion rights are protected and where abortion is safe and accessible.” The draft decision, written by Justice Samuel Alito and first reported by Politico, would eliminate federally protected abortion rights established in the 1973 Roe v. Wade decision, putting the decision-mak-
ing in the hands of the state legislatures. In 2019, New York passed the Reproductive Health Act, which formally codified into state law the rights created by the Roe v. Wade ruling that established a woman’s right to an abortion past 24 weeks of pregnancy or when the woman’s health or life are at risk. “Let me be clear: We’re not playing defense; we’re playing offense. So my message to women all across this country is that New York, the state of New York, will always be there for anyone who needs reproductive health care, including an abortion,” Hochul said during a press conference. State lawmakers protested the forthcoming decision alongside advocates in Foley Square on May 3. Legislators also pushed for passage of new bills that would enhance abortion access in New York and implement safeguards for providers as well as women who travel here from other states to have the procedure. New York has one of the most progressive records on abortion rights. Three years before Roe v. Wade, New York decriminalized the procedure and in the years that followed became a destination for women from other

states who traveled here for abortions. If the Supreme Court decision is finalized, New York is expected to see a new influx of patients. In the wake of abortion restrictions established by other states in recent years, the portion of abortions performed in New York on out-of-state patients more than doubled from 2012 to 2019, Gothamist reported, citing data from the Centers for Disease Control and Prevention. Hochul reiterated a previously announced directive instructing the state Department of Health to issue “regulations to ensure that telemedicine abortion is available here.” In September, following the passage of anti-abortion laws in Texas, Hochul asked the agency to develop formal guidance for providers and patients on telehealth abortions. Patients who opt to use telemedicine abortion services can consult with a health care provider via phone or video conference and have abortion pills mailed to them. Currently, 19 states have effectively banned telehealth abortions by requiring the prescribing provider to be physically present when the medication is administered, according to the Guttmacher Insti-
tute, a pro-choice research organization. Among the pending bills to enhance abortion rights in New York is legislation that would establish an abortion access fund under New York tax law and allow taxpayers to make contributions to the fund via personal income tax returns. State Sen. Alessandra Biaggi and Assembly Member Karines Reyes introduced the bills last year, but they have not made their way out of committees. Currently, a nonprofit by the same name – the New York Abortion Access Fund – helps pay for abortions for women who need financial assistance. “Speaking of Democrats using their power, there are 15 days of legislative session left this year in New York. The Abortion Access Fund bill better be up for a vote,” Biaggi tweeted. A second package of bills, sponsored by Assembly Member Charles Lavine and state Sen. Liz Krueger, would prohibit law enforcement from assisting “any individual or out-of-state agency or department” seeking civil litigation or criminal prosecution against abortion providers in New York. The bills would also prevent the governor, courts and county clerks from issuing subpoenas
and extradition orders to abortion providers on behalf of out-of-state court proceedings. In the race for governor, abortion rights is likely to become a major talking point. Rep. Tom Suozzi was outspoken about his concerns regarding the draft opinion, but notably mentioned the leak, tweeting: “The Supreme Court’s leaked majority opinion to overturn Roe v Wade would have devastating consequences for women in this country. We must codify reproductive freedom and ensure that abortion remains safe, legal, and accessible.” Suozzi has faced criticism from abortion rights advocates in the past. In his 2006 campaign for governor, pro-choice advocates denounced Suozzi’s opposition to “partial-birth abortions,” The New York Times reported. However, the same group behind the criticism, NARAL Pro-Choice America, endorsed him a decade later in his 2016 campaign for Congress. New York City Public Advocate Jumaane Williams described the draft opinion as “callous and political,” while calling on state leaders not to “hesitate, before fighting to preserve this right,” he tweeted. Previously, Williams had made conflicting statements on his abortion views – a position that has dogged his progressive record for years. Speaking about his personal experience when a woman he was dating had an abortion, Williams in 2013 lamented what he said was a lack of fathers’ rights in making decisions about abortions: “After having the pregnancy terminated there is no space I think for fathers to express that kind of pain,” he said, according to Politico. At the same time, he said he opposed overturning Roe v. Wade. Zeldin, who had yet to make an official statement on the matter but is staunchly pro-life, subscribed to the emerging GOP narrative attacking the premature release of the opinion when asked by City & State for comment. “The unprecedented leak that came out of the U.S. Supreme Court is very concerning and needs to be investigated. Accountability must follow,” he said in a statement released by his campaign. Giuliani, meanwhile, tweeted: “Yesterday’s Supreme Court outcome, in overturning a fundamentally flawed case, was an important step in protecting our most vulnerable Americans.”

New York’s chief disability officer gets to work By Megan McGibney

RMED WITH FUNDING provided in Gov. Kathy Hochul’s $220 billion budget, the state’s first chief disability officer will begin addressing the most pressing needs of New Yorkers with disabilities. Advocates for people with disabilities said employment and housing issues in the aftermath of the pandemic would be the greatest priorities for Kimberly Hill, who has been serving as chief disability officer since she was appointed by Gov. Kathy Hochul in February. A report by state Comptroller Thomas DiNapoli last year found that unemployment rates for people with disabilities in New York between April 2020 and March 2021 rose more quickly and remained higher during the pandemic than the overall unemployment rate. “Historically, when there are economic and other types of crises, people with disabilities often are the first to be terminated, last to be rehired,” said Jan Fisher, executive director of Nonprofit Westchester. “Employment inclusion is probably one, if not the first, of the issues that the disability community, across disabilities, is concerned about.” Todd Vaarwerk – the chief policy director of Western New York Independent Living, a nonprofit that serves the Genesee Region – said transportation to work alone can be especially challenging, since a person with disabilities who lives in a less populated area may have fewer travel options for getting to a job. He said he would like for Hill to explore these types of granular employment issues before looking into the data of which companies hire people with disabilities. Emily Papperman, an advocacy specialist at the Finger Lakes Independence Center in Ithaca, said Hill also should focus on helping people with disabilities clear hurdles that prevent them from landing jobs that align with their interests. “Folks with disabilities should be able to find work that they enjoy,” she said. “(Hill) should really have conversations about what
those barriers to employment are, and what folks with disabilities want to do. Instead of going, ‘OK, here’s a bunch of people with disabilities. Let’s just put them in a certain place.’ They should be needed and valued because they have skills. They wouldn’t apply for a job if they didn’t think they can do it.” Papperman said she has had clients who are unable to focus on getting a job because they also are not in a stable living situation. Marlene Zarfes, executive director of Westchester Residential Opportunities, which helps clients find affordable and accessible housing, said a lack of inventory and discrimination were among the challenges people with disabilities faced. For example, some housing providers won’t allow pets, even for tenants relying on emotional support animals, provide parking spots close to residential buildings or incorporate structural accommodations such as wider doorways for wheelchairs or lower kitchen counters. “Often people with disabilities are much more likely to be lower income,” Zarfes said. “They may be living on (Supplemental Security Income). They’ve got less money to look for something and, unfortunately, too many housing providers are saying, ‘We’re not going to take your SSI as payment or we’re not going to take your housing choice voucher as payment.’” Discrimination also happens to those needing an assisted living situation at residential developments, said Donna Long, co-chair of the Staten Island Disability Development Council’s advocacy committee. Her 44-year-old daughter is on the autism spectrum, and as Long and her husband age, they are finding it difficult to look after her. But finding a community residence or even getting one built has been a bigger hurdle than expected, Long said. She recalled recently how advocacy committee members attended a meeting at a local civic association about building such a home. Attendees strongly opposed the idea by wondering aloud who would be on staff, whether there would be parking issues and made excuses for why people with developmental disabilities shouldn’t live in the neighborhood, according to Long. “For agencies to have to go through that,” she said, “it’s like asking for permission. When we all move into a home, we
Advocates called on Kimberly Hill to focus on employment and housing after her first few months in office. don’t get that interrogation.” Most advocates also noted that Hill should prioritize the enforcement of the Americans with Disabilities Act. Vaarwerk, however, warned that the needs of people with disabilities vary from region to region. “This is not one size fits all,” he said. “The more rural you go, the less services there are. Hill needs a whole state solution: urban, suburban and rural.” Hochul’s decision to appoint Hill filled the void advocates complained was left after the state Office of the Advocate for the Disabled folded in 2013. Aside from advocacy, that office was charged with implementing laws that prevented discrimination against people with disabilities. Its work was absorbed by the state Commission on Quality of Care and Advocacy for Persons with Disabilities

and later the Justice Center for the Protection of People with Special Needs, now known as The Justice Center. However, advocates still lobbied for the creation of a single state entity to centralize services that covered the needs of New Yorkers with disabilities and offered them protections. “Many advances in the services available for people with disabilities,” have been made over the years, Hochul’s office said, but agreed that a chief disability officer was needed to help navigate the complexities of serving people with disabilities. “It is critical to prioritize the needs of the entire disability community, which includes individuals with physical, sensory, mobility, intellectual, developmental and psychiatric disabilities, with a Chief Disability Officer who leads a well-resourced office,” Hochul’s office said in a statement. Hill told City & State she would deliver on the governor’s charge and work closely with New York’s community of people with disabilities. “I want to convey to everyone that it is the intention of this office to always consult with people with disabilities as we strive towards our goal of making New York a more integrated, inclusive and accessible place to live – and to always embrace the ‘nothing about us without us’ mentality,” she said in an emailed statement. On housing, she said changes were already being made: “The budget’s comprehensive $25 billion housing plan tackles
systemic inequities by creating and preserving 100,000 affordable homes, including 10,000 homes with support services for vulnerable populations.” As for employment, Hill said, “We are going to take a multilayered approach and create a coalition with all of the state agencies who assist in the employment of people with disabilities to make the hiring of people with disabilities in New York state the norm, rather than the exception.” Previously, Hill was the principal analyst for the Assembly People with Disabilities Committee. In that role, she worked on the passage of the Most Integrated Setting Coordinating Council, the Nursing Home Transition and Diversion Medicaid Waiver, and the state’s Medicaid Buy-In Program. She also previously served as director of the Assembly Task Force on People with Disabilities, which focused on people with sensory and physical disabilities. She began her career as a writer for the Assembly Communication and Information Services Department. A resident of Latham in the Capital Region, Hill earned a bachelor’s degree in science while attending what was then known as Utica College. So far, advocates have welcomed her appointment, but they said they had high expectations. “This is a new way for the state at large to recognize disability as an opportunity for people, and I believe Chief Disability Officer Kimberly Hill’s role is to ensure there are employment opportunities for people with disabilities, as well as recognition of the capability of a person with (a) disability to function and be independent,” said Tibisay Guzmán, executive director and CEO of The Arc Westchester, which works with clients with intellectual and developmental disabilities. Others expressed optimism that with Hill, greater advocacy will come for the state’s community of people with disabilities. “There was no voice or a coordinated voice for a bunch of years,” Vaarwerk said. “(But) I am excited that this (position) will resolve some of the problems.”

N APRIL 18, flight attendants across the country announced over loudspeakers midflight that a federal mask mandate on planes and public transit had ended, prompting loud celebrations from some, quiet alarm from others, and a reminder for all that Americans are still divided on their views about the pandemic and the receding mandates that had been lauded as important tools for fighting the spread of the virus. Roughly 36,000 feet below those cheers, New York City Department of Health and Mental Hygiene Commissioner Dr. Ashwin Vasan sat in a small, mostly empty conference room – vaccinated, boosted and masked –

and described the challenge of leading America’s largest city through the next phase of the pandemic. In an interview with City & State, Vasan said New York was in a tricky place. In many ways, the city was on solid footing; 87% of all eligible New Yorkers have received at least one dose of a COVID-19 vaccine, boosters are widely available, and antiviral treatments are available for free, same-day delivery (with priority given to high-risk patients). But the pandemic has thrown curveballs before – the delta and omicron variants, to name a couple – and epidemiologists continually warn that health care systems must be ready for the possibility that new variants and subvariants could be more transmissible, evade existing vaccines and cause more

instances of severe illness. Dealing with those potential problems might be easier if all New Yorkers were on the same page about how to manage the changing risks. “We’re still coming out of a very difficult period in New York’s history,” said Denis Nash, a professor of epidemiology at the City University of New York. “Many people are eager to move on. A lot of people have also been very traumatized and devastated by losses. And many people remain in fear because of what could happen.” Still, the new health commissioner spoke confidently about the city and his 6,000-person department facing that demanding task. “We’ve got more tools in our toolkit and more responses available to us, both as individuals as well as the city, than we’ve ever had,” Vasan said. Several health experts and lawmakers also expressed confidence in Vasan as a capable and qualified leader. Vasan officially stepped into the role in mid-March, but before that, he had been working with former Commissioner Dr. Dave Chokshi during a transition period. Vasan’s early career was spent in global health, taking him to Geneva, Uganda and Rwanda, among other places, where he worked on expanding access to HIV treatment. Starting in 2016, he spent a couple years at the city health department, leading an initiative to improve and expand primary care and social services to New Yorkers involved in the criminal justice system. And until January, Vasan led the mental health nonprofit Fountain House, which operates over 200 “clubhouses” across the country offering community, employment and education opportunities. Vasan also remains a practicing physician. But those experts and lawmakers didn’t sugarcoat the difficulty of Vasan’s job. “This is arguably the most complicated time to lead on COVID,” said Manhattan Borough President Mark Levine, who chaired the City Council Health Committee during much of the pandemic. “In the midst of a full-blown crisis, it’s easier to motivate the public and easier to message. Now that COVID has receded in many people’s minds as a threat, it’s harder to motivate the public.” A little over a month into the job, Vasan said he will focus on helping the city move forward in areas where it’s safe – the city dropped a requirement to show vaccination

proof at restaurants and other indoor venues just before he took over from Chokshi – while not leaving behind the communities hardest hit by the pandemic and those who remain at higher risk of getting very sick from COVID-19. Vasan acknowledged that those two goals were in tension, but didn’t explain how he’ll walk that tightrope. “I think we have to allow New Yorkers who can to move on with their lives, with the tools to keep themselves and others safe, which is why we’re recommending every New Yorker mask,” Vasan said. “Your choice to mask – it may mean nothing to you because you’re healthy and young, but it protects others too.” How Vasan manages those competing goals will be best judged by how the city responds to future surges or worrisome new variants. New York City experienced an uptick in positive cases recently with the
BA.2 subvariant of omicron, but experts have been encouraged by seeing that vaccines still offer strong protection from severe illness. And so far, the city isn’t jumping at reimplementing measures like mask mandates in schools that were dropped after the omicron wave started to subside earlier this year. The city also now has a color-coded alert level system to guide officials on when to consider – though not require – reimplementing mask, proof-of-vaccine and other mandates. When asked under what circumstances he would recommend reimplementing those kinds of mandates, Vasan didn’t offer any specifics. “Everything is on the table,” he said. “We do have to be adaptable because the virus is always adapting.” The toolbox of vaccines, testing and masking he said “puts us in a position to be able to tailor the response in a more
specific way, rather than necessarily onesize-fits-all policy responses.” If there’s hesitation on Vasan’s part about reimplementing those kinds of mandates, he might not be alone. “We have laws against jaywalking, but people jaywalk everyday,” said City Council Member Lynn Schulman, who chairs the Health Committee. “Early in the epidemic, when we had the mask mandates, it was easier. It’s much harder now, even if you had a mandate, to get people to conform.” UP EARLY WITH THE MAYOR Ultimately, the city’s response to future spikes or new variants will be determined by Mayor Eric Adams, and Vasan is just one of many voices whispering in his ear. Vasan has one thing going for him – daily COVID-19 briefings with Adams to go over the data, latest trends and how to

communicate the state of the pandemic to the public. “Every day, we start with the data, we start with the situational analysis, and that grounds our decision-making,” Vasan said of their 8:30 a.m. meetings. Adams’ messaging about the pandemic has focused on moving forward as hospitalizations and deaths have declined, and vaccines remain readily available. “It is time for us to enjoy our city again. All of these ‘nos, nos, nos.’ We’ve become a city of ‘nos.’ I want to become a city of excitement,” Adams said in early March, while announcing the end of a requirement to show proof of vaccination at indoor venues like restaurants and theaters. A few weeks later, Adams received criticisms for exempting New York-based professional athletes and performing artists from the COVID-19 vaccine mandate. Adams framed the decision as fixing a de Blasio-era rule that benched unvaccinated players on New York teams while allowing unvaccinated visiting athletes to play, as one example. But public health experts and elected officials, including City Council Speaker Adrienne Adams, said it set a worrisome precedent for unequally apply-

ing COVID-19 mandates. “I think vaccines have to remain the foundation of our way forward in confronting this pandemic,” said Dr. Wafaa El-Sadr, a professor at the Columbia University Mailman School of Public Health. “This should apply to everybody, irrespective of what they do and who they are. I think it increases the confidence amongst the population overall that the rules apply to everyone, and also reiterates the value and the importance of getting vaccinated and boosted.” In an interview with City & State, Vasan spoke in lockstep with Adams’ public health decisions, including the vaccine exemption for performers and artists. “The mayor took the decision to take a policy from the previous administration and change it to right a wrong, to redress something that wasn’t working,” Vasan said, when asked whether he agreed with the decision to exempt those groups. “He has to take in a lot of data to make decisions, and health is just one set of data he takes in to make those decisions.” The city’s current messaging about the pandemic has left some wanting, however. “I would like to see stronger messaging from
the city to remind people that this is still a time for caution,” Levine said, adding that he’d like to see a campaign to incentivize and encourage COVID-19 booster shots, noting that only 37% of eligible New Yorkers have received a booster. Though Levine said the health department has an important role to play in delivering that message to the city, it ultimately has to come from the mayor. “When the mayor speaks, people listen in a way that really they don’t to any other official in the city,” he said. Still, while it’s early in Adams and Vasan’s working relationship, health experts and lawmakers expressed confidence that Adams was listening to his top public health official and making decisions based on science. They hoped that Adams wouldn’t stifle and undermine his own health department, as critics said then-Mayor Bill de Blasio did early in the pandemic. Dr. Oxiris Barbot, who led New York City through the beginning of the pandemic, resigned as health commissioner in August 2020, arguing that the department’s health experts were marginalized in City Hall’s decision-making and pandemic response. “The health commis-

sioner, while he is a political appointee, has to be focused on rebuilding the independence and the role of the health department as one of the premier local health departments in the world, with some of the best subject matter experts in the world,” said Nash, the CUNY professor. Vasan has already had a preview of the resistance that can accompany public health decisions – and the importance of presenting a united message. In late March, Adams announced he would end the mask mandate for children under 5 years old, as long as cases remained low. While the city had already dropped the school mask mandate for older kids at that point, it remained in place for younger children who did not have access to an approved vaccine. But Adams’ announcement followed comments from Vasan days earlier that he viewed the mandate for young kids as “indefinite.” “I would love nothing more than to send my son to day care without a mask,” Vasan, who is a father of three young children, said at a March 18 press conference. “But as a scientist, and as a doctor, and an epidemiologist, I want to keep him safe.” Vasan later said he was on the same
page as Adams about lifting the mandate as long as cases remained low, but the city ultimately decided to keep the mandate in place, citing rising cases and the new threat of the BA.2 subvariant. Vasan did not go into detail about whether he had a role in changing Adams’ mind on the mandate but said the decision was an example of the city making choices informed by the latest data. “I don’t think anyone would agree that smart public health policy would be lifting restrictions at a time of rapidly rising cases,” Vasan said. “That’s the position we’re in. We’re looking for the first opportunity to lift the restriction for under 5 children.” BATTLING THE “SECOND PANDEMIC” Even if New York City had completely eradicated the threat of COVID-19, Vasan would still have a challenging task on his hands. The responsibilities of the city health department are wide-ranging. Vasan listed expanding overdose prevention centers and improving preventive care to combat diseases like diabetes as just a few of his goals that were not exclusively related to COVID-19. But Vasan put a particular focus on improving access to mental health care, referring to the lack of such access as a “second pandemic.” “I see this in my daily life, the impact of isolation and school closures, on my children’s well-being, but also on people who came into the pandemic with mental health challenges, people with serious mental illness and otherwise,” Vasan said. “Whenever we hit a post-COVID era, we’re going to be dealing with this for years to come.” Decades of underinvestment and a refusal to think of mental health as part of, and not separate to, public health, were just a few root causes identified by Vasan. While he said much of the responsibility for reform was with the state and federal government, there was a role for the city to play. “As far as where I think the city and the agency can do a lot of good is really focusing on youth,” Vasan said. He declined to point to any specific programs that he would like to see implemented in city schools, but he mentioned identifying signs of trauma early on, supporting school nurses and improving screenings and longterm care delivered by the city’s schoolbased health centers. Vasan spearheaded an expanded focus on

advocacy at Fountain House when he took over in 2019, according to Mary Crowley, who worked with him there as senior vice president and now serves as the nonprofit’s interim president and CEO. The organization advocated nationwide to get Medicare to pay for community-based mental health support programs, like Fountain House’s clubhouses. Fountain House is set to launch a 501(c)(4) political advocacy arm this year. At the city health department, where Vasan first worked from 2016 to 2019, he led and launched a new office now called the Bureau of Health Promotion for Justice-Involved Populations. Politico reported earlier this year that Vasan developed a reputation at the department for being a “bad boss,” and dismissive, particularly to female colleagues, according to three staffers. Crowley said she never witnessed or experienced anything like that working with Vasan at Fountain House. “I have always sought to be a leader who shows patience and empathy,” Vasan said in an emailed statement. “In this role I will work every day to model that kind of leadership.” Also, Vasan will be focusing on equity – a value that he said should be a foundation for the department, not a distinct goal. “We’re not going to improve things for the entire city unless we take a specific focus also – not only, but also – on the communities that have historically been left behind,” he said. “The pandemic has brought it to life in many ways.” Many of the neighborhoods that saw the most COVID-19 cases per capita also had the lowest median incomes, including in the South Bronx, and northern and Southeast Queens. The pandemic showed how the city could better serve those communities, he said, mentioning partnerships with community-based organizations in the neighborhoods hardest hit by COVID-19 to provide vaccine outreach, personal protective equipment and testing. “All of those are lessons learned,” he said. “We’re in a relatively privileged position in that, while we serve 8 million people, we’re a relatively well resourced and robust public health department. Public health as a field writ large is starved of resources. The New York City Health Department has always been a leader and innovator in this space and defining new models of public health, innovation and delivery. And we’re going to continue to do that and hopefully help bring the sector along as well.”

WHEN PAUL PLANTS and his business partner started their oil company in 1970, they never expected to profit from the fossil fuel industry’s decline. “It’s an industry that is – was – very important,” Plants said. “I’m very proud of our involvement in it.” ¶ Plants’ father had worked in oil, and Plants himself, now 84, started his own drilling company in New York and Pennsylvania, the historic centers of oil drilling in the U.S. ¶ Faced with both declining output and shifting opinions on oil and gas in New York roughly four decades later, Plants needed to pivot. Instead of drilling for oil, Plants & Goodwin began plugging abandoned oil wells throughout the Northeast. Plants’ son and grandson took over the business and continue that work today. Allegany County, the former seat of oil production in New York, now has more abandoned and unplugged wells than active wells. Left open and unchecked, the Environmental Defense Fund said unplugged wells can cause air pollution, contaminate groundwater and release greenhouse gases. Despite up to $70 million available to New York to plug abandoned wells from President Joe Biden’s 2021 infrastructure package, oil companies and environmental advocates said the state’s resources fall far short of the need. Though Texas, New Mexico and North Dakota are the modern hubs for U.S. domestic oil drilling, western New York is home to some of the country’s first oil wells. At its peak in 1882, New York state produced 6.7 million barrels of oil, more than 6 million of which came from a single county: Allegany. New York experienced an “oil rush” in the late 19th century. Small towns grew by the thousands, and oil quickly became the foundation of the local economy. Its run, however, was short-lived. Aside from an uptick in production during World War II – when Plants’ dad was drafted, but he was able to defer enlisting because his job in the domestic oil industry was deemed essential to the war effort – oil output in New York declined and thousands of wells, some over a century old, were left behind with no existing owner of record. In New York, the responsibility of plugging these “orphaned” wells fell to the state Department of Environmental Conservation. Since 2014, the department has plugged
about 360 abandoned and orphaned oil and gas wells. The state has records for roughly 7,300 orphaned wells. Of these, only 2,588 have been located by the department. As of a 2018 estimate, an additional 34,000 orphaned wells exist in the state that no one has been able to locate. These wells dot private properties, lurk in wetlands and hide beneath forest canopies, presenting potential environmental and safety risks for the state and the people who live nearby. Allegany and Cattaraugus counties account for 74% of the state’s documented abandoned and unplugged wells. While the infrastructure package should boost efforts to plug these wells in New York, the state won’t get everything it asked for, according to Adam Peltz, senior attorney for the Environmental Defense Fund. “There are so many problematic orphaned wells that existing funding will barely even cover those,” he said in March. In early 2021, the department announced plans to enlist drone and magnetic surveillance technology to spot undocumented abandoned wells – a project funded by $400,000 from the New York State Energy Research and Development Authority. The department said it hoped to be operating the technology this summer. The problem of abandoned oil and gas infrastructure is not unique to New York. While oil drilling in the U.S. began in the 19th century, regulations weren’t passed until the early to mid-20th century. There
are roughly 3.2 million abandoned oil and gas wells nationwide, many of which were left behind by drilling companies that have since gone out of business. “Many wells that are now orphaned were drilled before there was any regulatory oversight,” according to a 2019 report by the Interstate Oil and Gas Compact Commission. “Many of these pre-regulatory wells were abandoned without being plugged or were plugged inadequately.” That’s also true of western New York, where commercial oil drilling began in 1865 and took off in the late 19th century. According to the department, the state passed legislation requiring abandoned wells to be plugged “to prevent freshwater contamination by oil and gas” in 1879, but the legislation carried “no strong enforcement mechanism.” While the state has been concerned with the environmental consequences of drilling since the industry’s infancy, over a century of lax enforcement has modern-day consequences. An Environmental Protection Agency 2020 report said abandoned oil and gas wells across the country were responsible for 281 kilotons of methane emissions in 2018, the equivalent of the annual greenhouse emissions from more than 1.5 million cars. Catherine Dickert, director of the Department of Environmental Conservation’s Division of Mineral Resources, said: “Plugging abandoned wells is one of many actions New York state is taking to reduce methane emissions.” Unplugged wells are also known to leak oil, saline water and other fluids into the air, groundwater and surface water. According to a 2021 paper in Elementa: Science of the Anthropocene, leaks from abandoned wells can cause “air pollution, greenhouse gas emissions, groundwater contamination, soil degradation, damage to ecosystems, and risk of explosions, all of which pose threats to human health.”

In places like Bolivar that experienced an 1800s oil boom, the industry’s decline isn’t only seen in museums.
Plants & Goodwin. “So they force those fluids into the well bore. They come up the hole and … they can pollute large sections of freshwater aquifers. And then you’ve got methane leaking at (the) surface going into the atmosphere. And you’ve got crude oil or brine that’s getting on (the) surface and affecting surface waters and lands.” Nationwide, the average cost of plugging a well ranges from $2,400 to $227,000, but Steve Plants said it could be up to $500,000 – which is nearly five times the median price of a home in Allegany County. In 2018, the state spent $1.4 million to plug 45 abandoned wells, according to the Interstate Oil and Gas Compact Commission’s 2021 report. If the 2018 price per well remained constant and not accounting for inflation, $70 million in funding could plug up to 2,250 orphaned wells in New York. But at a pace of 45 wells per year, it would take the state 50 years to remediate them. Meanwhile, Ronald Bishop, an associate professor at SUNY Oneonta who has researched New York’s abandoned wells, found the number of inactive wells in the state goes up by about 250 wells per year. According to Bishop, the state Department of Environmental Conservation’s budget is too low to even allow the department to follow up with companies who have abandoned their wells, let alone plug them. When asked to estimate the total cost of locating and plugging all abandoned wells in New York – again, estimated at over 36,000 in 2022, but increasing each year – Bishop said: “I’m not convinced it can be done.” He added: “If our DEC had the means to catch up with the owners who were just walking away from their wells this year, they would.” Bishop presented his research to the department on its procedures for plugging wells in 2013. “These people care,” he said. “They’re not careless or callous, although their chronic underresourcing might make them seem that way.” While the state Department of Envi-
ronmental Conservation did not directly answer how much money would be needed to verify, survey and plug New York wells, it said it is investing in new technologies to help locate unknown wells, such as the drone program.

VEN WITH THE new support in the infrastructure package, western New York still faces challenges, as efforts to plug wells in Allegany County and around the Northeast are not always welcome by locals. In Allegany, nostalgia and pride in the industry remain steadfast, and some people hope for the long shot return of the oil industry that built some of these small towns. The website for Pioneer Oil Museum of New York in Bolivar, a town in Allegany County, reads: “The New York oil fields await new technology to recover the remaining substantial oil reserves.” The museum documents the oil industry’s influence on Bolivar, which the museum describes as the “heart of the old Allegany Oil Field.” There are enough wells in the area that the museum’s board president, Dan Davison, grew up searching for them in his hometown of Bolivar.
In the winter, former oil roads on his parents’ land became snowmobile tracks. In the summer, Davison would wander in search of signs of the former oil industry: open wells, wells with pumping equipment on them and old engines – all sites now defined as abandoned and unplugged oil wells by the Division of Mineral Resources, which is within the Department of Environmental Conservation and charged with regulating the plugging of oil and gas wells. “You don’t go very far without seeing remnants of the oil industry,” Davison said. “They’re not bad remnants, there’s just wells here or there.” Those remnants are not hard to find in Allegany County; derricks greet students at the entrance of Bolivar-Richburg Central School and welcome visitors on town signs. The wells that once spurred local economies and inspired entire communities lay dormant around the state, in forests, near homes and on farms, each at risk of leaking methane into the atmosphere or directly into homes. “You could be 18 to 20 inches away from an occupied residence while you’re (plugging a well),” Steve Plants said. Yet, according to the Division of Mineral Resources, anyone who stumbles across an abandoned well should remain a safe distance away: at least 35 feet. Experts who spoke with City & State all agreed that the ghost of the state’s oil boom must be addressed. Steve Plants characterized funding from the infrastructure package as a “once-in-a-lifetime opportunity to put a dent in the issue.” So far, the Department of Environmental Conservation identified 140 high-priority wells to plug with the new funding. “This problem is not going to go away,” Paul Plants said. “It should have been taken care of 50 years ago, and for every year that it waits now, a well that could have been plugged safely at a cheaper rate.”
