ANYONE NEW TO THE CONCEPT OF GERRYMANDERING knows how much of a dirty word it is in politics after what happened with redistricting and this year’s election process. Try now explaining that mess to a voter whose primary language isn’t English. Several Spanish speakers couldn’t even translate the word gerrymandering when asked by the Brennan Center for Justice. There’s a YouTube video showing several hilarious attempts. That’s basically how Brennan, a nonpartisan law and policy institute named after the late Supreme Court Justice William J. Brennan, introduced a new effort to provide its research and education materials in Spanish more consistently to Spanish-language media, as well as Spanish-speaking and bilingual voters. Brennan en Español notes that political experts providing information to voters primarily do so in English, not accounting for the 41.8 million Spanish speakers across the country who also may vote. Mireya Navarro, editor-in-chief at Brennan en Español, showed the video during a launch event in Manhattan last week to answer why translated research and analysis was needed to explain concepts like gerrymandering. “Because only those of us who speak two languages, who are constantly being asked to translate not just words, but ideas for our family and friends, understand how complex the process is,” she said. “Ideas don’t translate perfectly. The needs and backgrounds and interests of different communities don’t translate perfectly. To communicate with Spanish speakers, we have to do it in their language and with them in mind.” Navarro’s comments align with calls for more voter education in the aftermath of redistricting, showing that true empowerment of the electorate comes when all potential voters understand the process – not just gerrymandering politicians trying to rig the system.

Gov. Kathy Hochul announced a new $35 million fund to help abortion services providers increase access to the procedure in the wake of a leaked draft U.S. Supreme Court decision overturning Roe v. Wade.

Of that cash, $25 million is for the providers to help them expand their operations and cover costs for those lacking insurance. The rest will go toward increasing and improving security at those facilities with an anticipation that they may become greater targets for anti-abortion protesters.

The announcement from the governor came just a day after state Attorney General Letitia James offered her support for legislation that would create a similar program to help provide additional funding to abortion providers meant to also help people coming from out of state seeking

OUT OF CONTROL A dozen people died in traffic crashes in the past week, a stark example of the toll that New York City’s rising traffic deaths – at their highest point in eight years – takes on a daily basis. The city launched a new safety campaign to discourage speeding, but advocates said it will need to do more than that – including lobbying Albany for local control of speed limits – to make a real difference.

Although many New Yorkers still don’t know what districts they will vote in for congressional and state Senate primaries, confusion over redistricting and election dates is finally beginning to get cleared up. A federal judge officially gave permission to the state Board of Elections to move the primaries for Congress to Aug. 23, providing a waiver in this instance for a previous ruling that required New York to hold those primaries in June. Not long after that, a state Supreme Court judge upheld the Assembly district lines in the face of two new challenges, citing the lateness in bringing the challenges as the primary reason that the lines, as well as the June 28 primary day, will remain in place. So, the two election days and the contests taking place on them have been all but settled – and candidates now even have a new schedule for petitioning to get on the ballot for the later date. Luckily for those the state Board of Elections already certified, candidates who already petitioned and received approval don’t have to do it all over again.

In a surprising move, Rep. Tom Reed resigned from his position to accept a private sector job. He had already announced that he would not seek reelection in November following allegations of sexual misconduct. But his early exit creates a vacancy that will require a special election to fill. Joe Sempolinski, a former staffer and chair of the Steuben County GOP, immediately announced his intent to run in that special election. He had already been running in the race to replace Reed in November. Former state Sen. Catharine Young’s name has also been in the mix to potentially run in the special election.

against ghost guns as crime in the city continues to go up. He called on the federal government to do more to crack down on the untraceable weapons that people can assemble at home, while at the same time offering up a defense of city cops as they tackle issues of gun violence. That defense came about the same time that the Civilian Complaint Review Board announced that it had substantiated over 100 more claims of police misconduct during the summer 2020 protests against police brutality. Adams maintained that final disciplinary decisions should remain in the hands of the police commissioner or the mayor. On the issue of ghost guns, Adams also specifically called out the company Polymer80, which manufactures ghost guns and makes the majority of those that police in the city have found at crime scenes.

The state Senate advanced landmark voting rights legislation last week that would, among other things, create a statewide election information database and expand language access at the polls. The Elections Committee’s action represented the first time the John R. Lewis Voting Rights Act of New York had come up for any kind of vote in the state Legislature. Meant in part to complement the pending federal legislation of the same name, state lawmakers introduced the New York Voting Rights Act in 2020. But its inception goes back to 2013, when the U.S. Supreme Court struck down a key measure of the federal Voting Rights Act of 1965 that required states with a history of discriminatory voting laws to get federal approval before changing their election procedures. “This is, again, an attempt for New York to lead the way, for us to stand up and say that the right to vote is sacred and that those who have historically been marginalized in this space deserve protection,” state Sen. Zellnor Myrie, the bill’s sponsor and chair of the Elections Committee, said at the committee meeting. “I look forward to the bill’s ultimate passage in our house.” Perry Grossman, a voting rights attorney with the New York Civil Liberties Union, pointed to the provision that

would give marginalized groups the ability to bring civil lawsuits at the state level in cases of voter suppression or dilution. He said voter suppression or dilution often happens at the hyperlocal levels of government that provide primary services like education and public safety that New Yorkers directly interact with daily. “I think the causes of action … are going to give both voters and jurisdictions a real opportunity to root out discrimination in local elections,” Grossman said in an interview with City & State. On a different note, Grossman said the creation of a unified election and voting database with information from election bodies across the state would improve voting access and election administration overall. Traditionally, the state’s disjointed web of election management has made it difficult to aggregate data from different boards of elections, school districts and the like. “Having that data means that we have the ability to understand our shortcomings better and remedy them,” Grossman said. Language to create the database exists in both the New York Voting Rights Act and a separate bill, which also moved out of the Elections Committee last week. – Rebecca C. Lewis

A Q&A with former New York City Department of Correction Commissioner

When you left the department, which of the problems facing Rikers were you most concerned about? What was the biggest challenge Commissioner Louis Molina faced at the beginning of his tenure? I want to emphasize that this has been decades in the making. It’s nothing that particularly Commissioner Molina or Mayor Adams has done. But for a long time, there have been very generous contracts and laws passed that benefit correctional officers – many of which I agree with, by the way. They should have good working conditions. They should have decent pay. They should even

have generous sick leave. But over time, it’s just accumulated, both in terms of what is legally required and also what has become tradition – and therefore precedent – in a way that makes the place fairly ungoverned. Because of that, many of the things that reporters have reported on flow from the absence of sufficient staff coming to work – or when they come to work, (not) doing their job. It sounds like you’re saying that a lot of the problems at Rikers comes from the culture in which correction officers operate? There’s a temptation to just pin it on correctional

officers, but I also think it’s the body politic – our elected officials who signed contracts, who passed laws that say you can’t hire any supervisors outside the New York City Department of Correction. Yes, staff take advantage of that. But it shouldn’t be available to be taken advantage of. You give people unlimited sick leave and then wag your finger at them because they’re taking unlimited sick leave? You’re at least partly to blame for that. Why is a federal receivership the solution that’s needed right now? Having laid out that problem – the maze of laws and contracts and

precedents – federal receivers don’t have to obey those. They don’t have to obey the contract, they don’t have to obey the laws, they don’t have to obey the precedents – if it can be shown that those laws and precedents and contracts are obstructing the ability to run (a) constitutional jail, which is what the essence of a consent decree is. The (receiver) can’t just run wild. They have to show that a particular law or a particular contract they’re about to abrogate is directly impacting the running of a safe facility. But the groundwork has been pretty well laid for that. Molina is trying to

make the case that a receivership isn’t needed yet, and he said that other commissioners have “not had the will to really use the full power of the office.” Do you know what he’s referring to? There’s always more. If Commissioner Molina can do it, more power to him. When I was there, I wanted the standard to be, if my son or daughter were incarcerated here, or my son or daughter worked here, what would I want done? If my son or daughter were incarcerated or worked at Rikers Island, I’d want a receivership. – Annie McDonough

But it wasn’t clear how the transition committee determined whose money got spent and whose money got returned. For example, Mets owner Steve Cohen and his wife Alex Cohen each donated $5,100 to the transition committee on the same day, Nov. 23. But the transition committee only reported processing a refund for Steve Cohen. Hedge fund manager Paul Tudor Jones also wasn’t so lucky – his $5,100 donation got spent, rather than returned. (Though he, too, had already given $600,000 to a pro-Adams super PAC.) A spokesperson with the mayor’s office could not explain how

those refund determinations were made. Vito Pitta, co-managing partner of Pitta LLP, which does campaign fundraising compliance work for Adams, told City & State in an emailed statement that the committee raised more funds than were needed for the costs of the transition. “All unspent funds were returned to donors appropriately and in accordance with CFB rule §13-03(c)(ii),” Pitta wrote. However, that rule merely states that unspent funds should be returned to donors and does not provide any further guidance. That means that, unlike with other campaign committees, Adams could not legally transfer money raised for the transition committee to another account. He had to use it or lose it.

New York City Mayor Eric Adams didn’t have an inauguration and had to refund $800,000 to his big-time donors.

EW YORK CITY Mayor Eric Adams’ transition committee returned more than $800,000 to donors after he canceled plans for a formal inauguration ceremony earlier this year due to the continued spread of COVID-19. Adams raised more than $1.9 million in two months for his transition and spent roughly $1.2 million of that in the months following his November election. Financial disclosure data posted on the New York City Campaign Finance Board’s website showed the mayor’s team returned the remaining money to donors – $800,236 of it – to 246 people. Some prominent New Yorkers will be getting their money back, including former American Express Chair and CEO Kenneth Chenault and his wife Kathryn, who each gave the limit of $5,100. Ditto for Daniel and Margaret Loeb – though it’s not much compared to the $1 million the prominent hedge fund manager gave during the primary to a super PAC that supported Adams. Loeb is now courting the mayor to show more support for charter schools, CNBC reported. Others getting their $5,100 back included 2017 mayoral candidate and Rao’s dining buddy

While a lot of money is being returned, even more was already spent. The biggest recipient of transition committee funds was iDEKO Productions, an event production company that got nearly $389,000. A City Hall spokesperson told City & State that was to put on the executive budget address at the Kings Theatre in Brooklyn on April 26. The event also served as a pseudo-inauguration, with much of the city’s political community gathered to see the mayor on stage. Adams, along with New York City Comptroller Brad Lander and Public Advocate Jumaane Williams, initially planned to have an inauguration event at the Kings Theatre but postponed it indefinitely amid rising COVID-19 case counts at the end of 2021. In January, the city Campaign Finance Board

gave Adams until April 30 to hold an inauguration, or find another way to spend down his transition and inauguration committee’s money. Much of the committee’s spending went to staff salaries for those who were helping Adams screen and hire people for his administration before taking office on Jan. 1. The executive director of the transition, Katie Moore, was paid a total of $28,000. Red Horse Strategies, the political consulting firm where Moore now works as a partner, was paid a little over $20,000. Abrams Fensterman, the influential law firm where Adams’ chief of staff Frank Carone previously worked, was paid a total of $6,678. Of that, two payments of $561.09 and $317.16 respectively were labeled as “office space.” Politico pre-

viously reported that Adams’ campaign rented space at Abrams Fensterman’s office at MetroTech in Downtown Brooklyn. However, the politically connected firm apparently did not bill the campaign for the use of the space until Politico began reporting, and when it did, charged an extremely low rate – as little as $1.80 per hour. A receptionist at Abrams Fensterman told City & State that the office manager was not available for comment on the arrangement with the transition committee. Other expenses raised some questions. The committee reported a $50,000 expenditure to Kitamba Management for a “program” on Jan. 31, 2022. Kitamba is a public education consulting firm, and it isn’t clear what service they would provide to the Adams transi-

tion. Kitamba did not respond to a request for comment. Officially known as a Transition and Inauguration Entity, the transition committee’s final financial disclosure filing was due on May 6 and was posted online on the morning of May 9. It is expected to be spent down and closed out soon. Adams has already opened a fundraising committee for his 2025 reelection campaign and is thought to have been raising money on recent trips to Chicago and Los Angeles. Onetime campaign spokesperson Evan Thies declined to comment on the mayor’s fundraising activities, but more information should be available in July, when the first disclosure statement is due.

Black and Latino nonunion flaggers on public construction projects report being paid just a third of wages they’re legally entitled to.

ICTOR BALLAST WAS looking for a job. It was January 2018, he had four children and a wife to support, and he’d had trouble finding work since moving back to the Bronx from Florida. A friend suggested he look into becoming a flagger, a worker who helps keep construction highway projects safe by directing traffic around work sites. Another friend said he was making $42 an hour as a flagger and was in a union. Ballast enrolled in a flagger certification course and jumped into the industry with both feet. Ballast started working on Con Edison construction sites for the Manhattan-based Griffin Industries LLC. At just $13.50 an hour, the pay was far lower than he’d expected, and he received no benefits. But he had ambitions to grow with the company. He completed two courses for construction workers adding up to 46 hours of training and set his sights on joining a union. “My thing was to make it to the union. My thing was not to sit at $13 or $15 an hour,” he said. But Ballast’s enthusiasm for the job soon faded as he came to realize that higher pay was nearly impossible to secure, and he says he – like thousands of nonunion construction workers around the state, including many flaggers – was a victim of wage theft. Although he didn’t know it at the time, state labor regulations require flaggers working on government projects in New York City to be paid at least three times what he was making. Until June 2018, Ballast said, he would often work 12 hours a day, six days a week, often without any breaks or overtime, standing in traffic to direct pedestrians and cars away from active construction sites. “You know how New York is, so imagine in the winter cold, you got to tell someone that they have to wait to go down a block, cursing you out, taking trash from people. Rain, sleet, or snow, you’re the only one who got to stand there,” he said.

Since flaggers work at the edges of construction sites near traffic, it is one of the most dangerous jobs in the country, with death rates 10 times higher than the national average.

UNION AND NONUNION: A TWO-TIER SYSTEM Flagging is one of the most dangerous jobs in the country, with an on-the-job death rate more than 10 times higher than the national average. “You in charge of everybody’s safety, so the responsibility and the risk you’re taking don’t even match up with what you’re making,” Ballast said. He would spend up to two additional hours a day, for which he was not paid, driving between the Griffin office and job sites to pick up and return his timesheet and equipment, he said. The pay was so low, he said, that he could not make his rent, was evicted from his apartment and was forced to live in a family homeless shelter for a time. At the job site, Ballast, who is Dominican, began to notice a two-tier system. All the flaggers he worked with were Black or Latino – and nonunion. The other construction workers on the site seemed to be mostly white and all part of a union. “(Unionized workers) can go to lunch, they could leave, they could stay in their cars. And the flaggers got to be out there until the hole is closed,” he said. Unionized construction workers make 22% more than nonunion workers. While construction unions have become far more diverse in recent decades, a recent analysis of the New York City construction industry found that non-Hispanic white people still accounted for 45% of unionized workers and only 25% of nonunionized workers. There are two ways to join a union: organize a nonunionized workplace, or get into a union apprenticeship program. Originally conceived in the 1990s to help unions boost diversity, apprenticeships can offer marginalized workers a pathway to good-paying jobs. But the slots are limited. The state Department of Labor regulates the number of new apprentices that can join construction unions, and union hopefuls have to enter competitive lotteries. As a result, many subcontractors actively recruit new workers like Ballast, who can’t afford to wait around to win a lottery. When Ballast told a few of the union workers – who, unlike him, were employed by Con Edison directly – how much he made, he said they laughed in disbelief and told him he was getting ripped off. Confused, he did some digging and learned about something called a “prevailing wage.” New York law requires that construction workers working on public or government-funded projects be paid a prevailing wage rate, which is usually sig-

nificantly higher than minimum wage and mirrors what a union worker would make. The state Department of Labor sets the prevailing wage schedule, which Ballast learned entitled most flaggers in New York City to $42 an hour. He was furious. “I’m telling my coworkers when I’m at Griffin, ‘Yo, they robbing us man,’” he said. “Ain’t no way that we here working with Con Edison workers and construction union workers and we making this money. This ain’t right.” MILLIONS IN LOST WAGES Ballast figured it was time to seek representation. In July of 2020, Ballast and several of his co-workers, represented by attorney Brent Pelton, filed a class action suit against Griffin and Con Edison to recover unpaid prevailing wages, daily overtime and supplemental benefits. Pelton’s firm is currently engaged in several active lawsuits against companies hiring flaggers, including Griffin and Con Edison, that are subcontracted by city and state agencies. A Con Edison spokesperson said the company does not comment on ongoing litigation. An attorney for Griffin, Michael DiChiara, declined to comment. In legal filings, both companies have both denied all allegations. Similar suits have been successful: In 2016, after a lengthy investigation by the U.S. Department of Labor of wage theft at a federally funded construction site in lower Manhattan, 63 flaggers were awarded about $1.2 million in back wages. In April, in a class-action case that Pelton has been involved in for five years, a judge found that although the

same contractor – Judlau Contracting Inc. – had been classifying the workers as “pedestrian crossing guards” rather than flaggers, the nature of the work that they performed required payment of prevailing wages. Judlau declined to comment for this piece. According to recent data compiled by the U.S. Bureau of Labor Statistics, there are currently 10,040 New Yorkers working as crossing guards or flaggers – more than in any other state. Many make under $40,000 a year. Meanwhile, subcontractors are raking in millions from taxpayer-funded projects. At Griffin, Ballast was not the only worker to feel he was being exploited. For years, Luis Simone, a 54-year-old Cuban man from the South Bronx, had run a van service driving women to upstate prisons to see their loved ones. He couldn’t afford to repair the van when it broke down, and so transitioned to work as a flagger in 2018. At Griffin, he was paid just $13 an hour, he said. He knew the pay was low, but he was married and had two kids to support, so he kept his head down. “It’s very difficult, he said. “You have to deal with traffic. When bulldozers come, you have to guide these trucks, flagging, making sure nobody is crossing the street and no cars are passing by. It was really dangerous.” Simone began to feel the company was taking advantage of him. “Sometimes you have to stand up and eat your lunch,” he said. “Sometimes you by yourself flagging, and the other person got to take lunch, and mind, you got to flag a two-way street. It was really difficult and it just wasn’t fair.” And like Ballast, he began to notice the racial disparity at the job site. “A lot of the flaggers are Black and Latino,” he

led the Manhattan district attorney’s Construction Fraud Task Force until 2020, said that far too little is being done to rein it in. “Wage theft is not a crime of necessity, it’s a crime of opportunity. And frankly, the government is complicit in allowing it to flourish,” she said. “There is an enforcement gap, and so unscrupulous companies make a business decision that they say, ‘Why would I pay a prevailing wage … when no one is checking?’” Pervasive wage theft among flaggers in the construction industry goes back at least a decade, workers say. said. “The majority of Con Edison workers were blanquito, having a great job with the union, getting paid good.” Eventually, Simone and Ballast quit Griffin. “I left them because I knew I was getting ripped off,” Simone said. “I’m not going to stay for no $15 an hour, that doesn’t pay nothing. Plus I had to pay for my own gas to travel. Are you kidding me? I wasn’t making no money.” In 2019 and 2020, both Simone and Ballast said they bounced around several flagging companies, including Out-Look Safety, CE Solutions, Vali Industries Inc, and WorkForce 7 Inc, hoping to find a workplace that was not exploitative. Each company paid them minimum wage or just a few dollars above the minimum wage; not a single company paid the prevailing wage, they said. (None of the companies responded to requests for comment.) At one company, CE Solutions, Ballast tried to respond by unionizing his co-workers. He said he collected 400 signatures from co-workers who expressed interest in joining a union and contacted Laborers’ Local 1010. A strike seemed like the only way to get the company to pay fair wages: “If we don’t go to work, things will change. They need us, they can’t start working without us there,” he said. But many of his co-workers weren’t willing to risk losing their jobs, and the union effort ultimately sputtered. CE Solutions declined to comment for this story. ‘WHY WOULD I PAY A PREVAILING WAGE … WHEN NO ONE IS CHECKING?’ Wage theft is rampant in the construction industry as a whole. Diana Florence, who

York, worked as a flagger for MECC Contracting Inc. and Rojac Watchman in 2012 and 2013. He was 22, and it was his first real job as an adult. MECC was the contractor for several Con Edison worksites, and in turn subcontracted flagging jobs out to Rojac Watchman, which paid Hemans $12 an hour, he said. (Chains of subcontractors can enable construction industry employers to hide wage theft in jobs beyond flagging.) Hemans never sued. Rojac Watchman could not be reached for comment. In 2017, Pelton’s firm brought a class action lawsuit against MECC for failing to pay workers prevailing wages on Con Edison sites. MECC settled the suit in 2019 for $825,000, denying all allegations of wrongdoing. Last year, another wage theft suit was brought against MECC seeking to recover allegedly unpaid prevailing wages, overtime, premium time and supplemental benefits. MECC has denied all allegations in court filings, and the case is still ongoing. Hemans routinely worked between eight and 16 hours a day and barely received meal

breaks, he said. When he got home from work, his clothes would be covered in sweat and his muscles would often be so sore he could barely move. On the job, his foreman told him he was making three times as much as Hemans’ salary. “I said, ‘How could you be making so much?’” Hemans recounted. “And he said it was because he was in the union.” After a year, he quit to pursue a career with Local 79 as a general laborer, where he now makes a comfortable living wage. He said his advice for flaggers would be to organize for better pay: “If the flaggers were some type of organization, I think they will be paid a lot better,” he said. “They would have a better future, something to build on rather than living day by day.” Lowell Barton, union organizing director with Laborers’ Local 1010, said the exploitation of nonunion flaggers brings down the wages of unionized flaggers as well. Unions lose their negotiating leverage if contractors are able to pay workers below prevailing wages without repercussions. Barton faults city agencies like the Department of Design and Construction, which did not respond to questions for this article, for failing to adequately regulate the industry. “If you’re able to go rogue on prevailing wage jobs, why should they (contractors) negotiate with a union?” he said. “That’s the problem, DDC is allowing contractors to go rogue when it comes to people of color and women, who traditionally do the flagging jobs because there is a prevailing wage and it should be paid according to the task that they are doing.” Ballast, for his part, moved to Rhode Island and now drives a truck for a living. Since filing his lawsuit against Griffin, he has filed others against Out Look Safety, Vali Industries, Inc. and WorkForce7, which are all still pending. In court filings, the latter two companies denied the allegations. Ballast hopes his efforts will inspire other flaggers to realize they deserve more. “They would work like 100 hours a week, and at the end of the week, they would get $1,300. They were happy with it, but they were not even counting the hours they were spending at the job,” he said. “A good job is when you work less than 40 hours and you could go home and take care of your family.”

Queens District Attorney MELINDA KATZ barely won her seat, and she’ll be damned if she doesn’t leave her mark on the office.

Q

UEENS DISTRICT ATTORNEY Melinda Katz took office at one hell of a moment for criminal justice in New York City. Much-lauded changes limiting when judges can ask for bail took effect on Jan. 1, 2020 – Katz’s first day on the job, after being elected in 2019. Less than three months later, the COVID-19 pandemic hit. The number of reported crimes cratered, and court went virtual. Then, Black Lives Matter marches responding to the murder of George Floyd in Minnesota, leading to renewed scrutiny of police and prosecutors. Just six months into Katz’s tenure, further adjustments to bail, discovery and speedy trial laws took effect. Now, more than two years in, the number of reported crimes is rising in Queens to rates that ha-

UNSTEADY TIMES ven’t been seen in more than a decade. That’s led by increases in felony assault and grand larceny, while the most extreme crimes, including murder, rape and shootings have held steady, comparable to historic levels. Katz took over the office after the late Richard Brown, who was Queens district attorney for 28 years. Brown started in the “Tough on Crime” 1990s, and he earned a reputation for maintaining that mindset – sending more misdemeanor defendants to Rikers Island than any other prosecutor in the city. And he was anything but a reformer, opposing the creation of a commission on prosecutorial misconduct, as well as the plan to close Rikers Island. Katz promised a less carceral approach and reorganized the structure of the office.

She got rid of the “extremely unfair” and “horrible” policy, “that if you didn’t waive your rights to a grand jury, you got nothing but a top count.” She also fulfilled a campaign pledge to create – for the first time in Queens – a Conviction Integrity Unit. She said it has vacated 72 convictions so far, including 60 in one fell swoop that relied on testimony from cops who had been convicted of crimes themselves, including lying on the stand. “If your conviction is based on a cop who later on was convicted of perjury or falsifying documents, I think that they should be vacated,” Katz said. It’s not just cops. Katz’s Homicide Bureau Chief Brad Leventhal left the office last year after a judge ruled that he had deliberately withheld evidence in a 1996 murder trial he worked on as an assistant


district attorney. Now, her commitment to clean prosecution may be getting tested once again. Katz is retrying Prakash Churaman for a murder he allegedly committed at age 15, after his original conviction was overturned on appeal. But the online outlet Hell Gate reported in May that two NYPD detectives who led the investigation were parties in a $2 million settlement after allegedly ignoring exonerating evidence in a separate 2015 murder investigation. Katz’s office declined to comment on the ongoing case. Asked to reflect on her tenure so far, she looked back to her 2019 election, where Katz, then the Queens borough president, defeated democratic socialist public defender Tiffany Cabán in the primary by just 60 votes out of more than 90,000 cast. She’d been a politician most of her career, and wasn’t in the courtroom as a prosecutor or a defense attorney. Katz declared that she was able to roll with

the punches “because there were very few habits that I had … being able to be flexible, being able to respond to changes in the world, being able to make changes when it comes to criminal justice reforms, when it comes to laws being changed, is key. It’s a brave type of justice, and it’s a steady hand during very turbulent times.” City & State sat down with Katz in May in her office inside Queens County Criminal Court. Sitting on the coffee table was that day’s New York Post, with a front page focused on the murder of Zhiwen Yan, the food delivery worker who was shot in Forest Hills – a reminder of the cases Katz’s office deals with. Katz talked about giving the governor feedback on bail laws, whether she’s listening to New York City Mayor Eric Adams’ requests and her concerns about the new jail in Queens. This interview has been edited for length and clarity.

It was reported that the governor sought your advice specifically when making adjustments to the bail laws in the budget this year. What did you think of the final compromise? So the first thing to note is that the bail law changes of 2020 were desperately needed. We needed to make a more fair and equitable way of holding people before they have a trial. So making misdemeanors nonqualifying, I think, was a good first step. We’ve also learned that the Legislature saw that things needed to be changed, and they did those changes. And it wasn’t only the bail laws. It was discovery laws, it was gun laws. And I think that they were desperately needed. I think the last changes that went through the system were a great start. Being able to arrest people for hate crimes instead of giving them (desk appearance tickets) is, I believe, important for the safety of the community. Being able to put peo-

ple, sometimes, (in jail) on a second open DAT-able offense, which is some misdemeanors, I think are important as well, to be able to look back on whether someone should be held. But I think they kept the basic bones of the original law, which was changed for a reason. You’ve previously endorsed ending all cash bail and just giving judges discretion – I still do. But of course, your office is still, in many cases, asking for cash bail. What do you think needs to change? What’s stopping you from simply ending the practice of cash bail in the borough of Queens? I am an incredible advocate of a no cash bail system. I’ve been very open and honest about that. We have written op-ed pieces on it with

the other DAs. The problem we have here, and one of the discussions that we do have with the Legislature quite a bit, is that bail is still one of the few tools that we have. We don’t have community safety in the law yet. I do think we should. You can’t get to no cash bail until we can make an honest assessment of whether someone poses a risk of flight and a risk of community safety. I think those are two extremely important conversations to have, in conjunction with having the conversation of no cash bail. I’ve been working with the mayor’s office in better pretrial services. So as we have someone who is being arraigned and trial is not yet happening. Why can’t we send them to mental rehabilitation? Why can’t we send them to drug rehab? Why can’t we put them in a workforce development program? Why can’t I give them a mentorship program? Instead of asking for cash bail? We don’t really do that yet. And it’s not a tool available to us yet. But we are working to make sure that, soon, I would hope, that those tools would be available. Speaking of the mayor’s office, Eric Adams has been saying that he wants to see prosecution of turnstile jumping and other low-level crimes like public urination. Is your office choosing to prosecute those charges when they come before you? Honestly, I don’t think we’ve had those cases yet. If there’s a warrant out for someone’s arrest, we would deal with the underlying charge. I know that the mayor has just formed a task force. I’m hoping to be part of that task force actually, to be able to figure out what to do. I think there has to be some equity and fairness. Right, people are paying their toll and the person next to them is jumping the turnstile. So I do think we need to do something about it. Part of my interpretation of why the mayor is calling for this prosecution is he’s looking for a reason why crime is up. He’s looking to explain it. The seven major crimes are up this year. Murders are little down, but still high. Felony assaults are spiking. There are more shooting victims so far this year than any year since 2012. Why do you think that is? It’s important to remember that the mayor and the speaker of the City Council, Adrienne Adams, also talked about the fact that we need to work on the economics and the

reason that crime is up. You cannot prosecute your way out of any of the crime that is going on right now. You have to look at the economics, training, what communities are getting, how the schools are working, all of that – but you can do both at the same time. As you talk about economics – do you blame the crime spike on the economic situation caused by COVID-19 and other factors? The crimes that are happening are because people are choosing to pick up a gun and use it or rob people. But the issue is, why are they doing that? And if you want to put food on the table for your family, we need to make sure that there are services available so that you’re trained, and so that you can get the services that you need for your family and for your kids. But I think you have to address it both ways. We can’t assume that if we try to make everything perfect, that we’re also not going to prosecute. The drivers of crime (who) need to understand the accountability for their actions are going to be prosecuted. When is the last time you visited a jail? I don’t know, two months ago, I guess? A month ago. I’ve been to Sing Sing recently, and I’ve been to Rikers recently, within the last two months. It’s not actually working cases, right? You’re just seeing the situation? With Sing Sing, I toured it with the warden, I learned about the programs that they give to people that are serving time there. I learned about the schedule that they have. We saw the different areas of the prison. At Rikers, a lot of the discussion was focused on the problems with the health care issues and whether or not we could see a different answer. New York City is the best city in the world. I can’t imagine that we can’t have a first class detention center for those that are sent there. Whether you believe that people should ever be at Rikers or not, there should be a first-class system in place. Given the acute violence crisis at Rikers now and the spread of COVID19 over the past two years, what’s your responsibility? Do you feel like you need to be second-guessing decisions to send anybody there? The minute COVID hit and we were asked by the administration – and on our own,

we did – review the pretrial cases that we had there. We looked at the requests of leniency to let people out of Rikers. We were involved with several of those, we didn’t oppose a lot more. So that’s number one. Ever since I’ve been here, we are looking at almost every single case. And we’ve set new policies on when to ask for bail or when to ask for (release on recognizance), or when to ask for supervised release. We look at electronic monitoring. We look at how we can do that on a citywide basis as opposed to a home basis. So I think that we, just by virtue of who I am, have been taking a second look and look at every single case with scrutiny as to whether or not there should be pretrial detention at all. Do you track how many people are going to jail, supervised release, etc., compared to the Brown era? The law has changed drastically. It’s hard to compare from the old days of what judges gave, because you could actually ask for bail on misdemeanors, on nonviolent crimes. There was a whole qualifying aspect for bail asks that don’t exist since my administration started on January 1. I can only tell you that out of about the 6,500 people, last I checked, that were at Rikers, we had, I believe, about 600 (Katz’s office followed up to say that as of May 12, of the 5,483 people incarcerated in city jails, 632 were sent from Queens). And I will tell you that the largest percentage, I think it’s 80 to 90% of them, are there because of a violent crime. If I’m not mistaken, about half of them are remanded. Instead of asking for $500,000 bail, where in the old days, people would be kept in, we ask for remand. It’s more intellectually honest. I believe it’s more honest. The Queens jail is being rebuilt right outside your office here. How do you feel about the plan to close Rikers and build four new jails? So as the borough president, I voted against the project here because I thought it was too big. There was, I believe, at the time, 1,500 or something beds. They’re talking about putting in a few hundred beds here (886 beds, per latest documents). Which is great if crime is low. I do worry about the ability to expand if we had to. But I think it is a good mission, to be able to get a lower

amount of people into the criminal justice system. And I think with that mission in mind, it’s an interesting idea to keep people close to their loved ones. I worry a little bit about all the women being here, and in the same facility as the men. We’re now in the middle of discussions about how that looks and what’s going to happen on that. Putting on your political hat now – I’m thinking about how the Democratic candidate lost the race for Nassau County DA last year. And all over the state it seems that Democrats are worried they’re going to be blamed for crime and lose seats. Do you feel political pressure to change how you do this job? To what seems like a public desire to be tougher on crime? I look at my job as being the steady hand. I try not to waver from that, because that defeats the definition of a steady hand. We have prosecuted drivers of crime from the minute I got in here. We have made a priority: gun violence, traffickers, ghost guns – the polymer pipeline, which I think is one of the most critical things to attack as a prosecutor. At the same time, from the moment I got here, we’ve not prosecuted sex workers, we didn’t prosecute for low level amounts of marijuana. I chose not to prosecute, during the executive order, for curfew violations or social distancing because I knew in my heart that it was an excuse for stop and frisk, and I wasn’t going to do it. We have vacated thousands of outstanding warrants for sex work, prostitution and walking while trans. We have vacated warrants for marijuana, those that were from 2 to 3 ounces. So from my point of view, I have to do my job. We get people that call here and talk to me about either defendants or victims. And I make it clear, today they’re talking for the victim, tomorrow they may be talking for the defendant or vice versa. I have to keep my eye steady. I need to make sure that it is consistent. And that means that you don’t act like the wind. You made quite a case here. You almost sound like you’re part of the progressive prosecutor movement. Do you take on that title? Do you consider yourself to be a progressive prosecutor? I consider myself to be a fair and progressive prosecutor, yes. But I think that we can’t

forget that people have a right to fair trials. But they also have a right to walk their children to the school playground. They also have a right to make sure that their parents are safe when they want to go to a senior center. They have a right to go walk their dog without getting shot. So I think that there’s a way to be a progressive prosecutor and still hold people accountable. But one of my jobs is to get guns off the street. One of my jobs is to make sure that you can go to a mosque, or a gurdwara or a synagogue and not have to worry about your safety. You mentioned marijuana before. We’re in the middle of a transition where it’s decriminalized, there’s people selling it

openly. What’s been your approach in this in-between? Have you prosecuted any cases of unlawful sale? Or is it like, hands off, let’s wait till it’s legalized? Selling is still illegal. And, usually, not always, leads to other things. The smoking of marijuana, we have not prosecuted for (possession) under 2 ounces. I will tell you my biggest concern with marijuana is driving while high. We have this test of whether or not you have marijuana in the mouth, but I do hope very quickly that modern technology catches up with being able to do a true test of whether or not someone is high on marijuana while driving. That concerns me greatly. Judgment while driving has to be impeccable. We have taken a very, very

stringent view of drunk drivers and intoxicated drivers in any way. And we’ll continue to do that. There’s a supervised injection site open in Manhattan now. The mayor wants to expand them. Would you like to see them in Queens? I’d like to see them wherever it’s appropriate. I think that they’re needed. I think that we need to create safe spaces for people to get services to be able to do what they do and safety at injection sites. And I wrote a letter on that with other DAs. Broadly, what is New York’s biggest challenge when it

comes to crime and justice? If we want to have lower crime rates, you cannot prosecute your way out of it. And the mayor and the speaker of the council have been very vocal on this as well. I put out a $2 million RFP for youth wraparound services, because I believe that the youth need hope. I go out in the community, I’ll go to basketball games, I’ll go to food giveaways. I had one coach of a team ask me, why are you here? You’re the district attorney. Why here at this basketball game in the community? And I said, because the first time the youth see me should not be when I’m coming to get them. The first time they see me should be when I’m trying to keep them out of the courtroom to begin with.

While the era of machine politics is fading, Meeks’ power play shows that the clout he retains as head of the Queens County Democratic Party to influence politics in the borough and the city. State Sen. Jessica Ramos entered 2022 with a host of legislative priorities. The lawmaker, who represents Jackson Heights, Corona and other portions of Queens, had made access to universal child care a primary focus, along with replenishing funding for the Excluded Workers Fund. Ramos was also an outspoken opponent of the LaGuardia AirTrain project and has monitored other alternate proposals to increase transit access to LaGuardia Airport, calling for community input on them.

The lawmaker, who represents portions of the Bronx and Queens, has joined other elected officials in opposing the creation of natural gas facilities in Astoria and in demanding insight into the bail practices of the city’s district attorneys.

8 DONOVAN RICHARDS QUEENS BOROUGH PRESIDENT Queens Borough President Donovan Richards successfully staved off a tough challenge during last year’s Democratic primary. Now, Richards is focused on pressing issues in the borough, recently backing a proposal to extend ferry service to LaGuardia Airport and the Interborough Express rapid transit project that would connect Brooklyn

As chair of the New York City Education Committee in the state Senate, John Liu has plenty of sway crafting education policy affecting students in the five boroughs. More recently, Liu has been exploring possible alternatives to mayoral control of the city’s public school system. The state lawmaker, who was the first Asian American New York City Council member, has also been pushing for greater state funding to support the Asian American and Pacific Islander community.

The legislator, who represents Corona, Elmhurst and Jackson Heights, has backed efforts to deliver aid to undocumented immigrants who dealt with flooding after the remnants of Hurricane Ida struck New York last year. Cruz is also one of the sponsors for the state’s Clean Slate bill, which would automatically seal conviction records for certain New Yorkers.

40 ZOHRAN MAMDANI ASSEMBLY MEMBER Assembly Member Zohran Mamdani made waves when he knocked a fellow Democrat

out of office in 2020, a notable success for the only Queens Assembly candidate backed by the Democratic Socialists of America at the time. He has since become an active voice among the state Legislature’s left-wing, fighting greater eviction protections for tenants and opposing the 421a program. Just like that, the Assembly candidate got some muscle in the upcoming special election with a key endorsement from the Zeus of the Big Apple, Mayor Eric Adams.
