AMONG THE RACES TO WATCH THIS ELECTION CYCLE, the Democratic primary race for lieutenant governor has turned out to be one of the hottest. That’s why City & State New York and PIX11 have invited Lt. Gov. Antonio Delgado to face off with his Democratic primary opponents Ana María Archila and Diana Reyna for a debate on June 1. Following a horrific mass shooting at a Texas elementary school that left 19 children and two teachers dead, Gov. Kathy Hochul said she would work with the state
Legislature to approve legislation to raise the age to purchase an AR-15. Currently, a buyer only needs to be 18 years old, but Hochul wants to raise it to 21. But she will likely face an uphill challenge considering that California’s semiautomatic weapons ban for people
under the age of 21 was recently struck down by a federal appeals court. New York did, however, gain a victory on its gun laws. A federal judge upheld a state law that makes it easier to sue gun manufacturers when violence is committed with their weapons.
ANOTHER LG IS ON THE JOB The job of lieutenant governor may not have much weight or responsibility, but it’s far from a political dead-end job, as Govs. Kathy Hochul and David Paterson would tell you. But as Antonio Delgado gave up his seat in Congress to be sworn in as New York’s next second-in-command last week, he likely had one thing on his mind. To use the position as a political springboard, Delgado first has to win the Democratic primary next month and the general election in November.

After commissions and lawsuits and so many draft maps, New York finally has new district lines for the state Senate and Congress. The lines came after a long process that saw the maps drawn by Democrats in the state Legislature thrown out by a judge – the congressional lines were tossed due to gerrymandering and the state Senate lines on procedural grounds. So the process went to a court-appointed special master to draw new maps, the final versions of which came out after he heard from New Yorkers about his original drafts. The new districts will shake up a number of races, including by pitting Reps. Jerry Nadler and Carolyn Maloney against each other and creating a new open seat in lower Manhattan and parts of Brooklyn. That 10th District race has already attracted some high-profile candidates, including Rep. Mondaire Jones from the Hudson Valley, former New York City Mayor Bill de Blasio and Assembly Member Yuh-Line Niou. In the state Senate, a number of incumbents found themselves drawn out of their districts, with several already announcing their plans to move to a nearby district without an incumbent to avoid primarying their colleagues.

ASSEMBLY RACE A BLOW TO ADAMS
A special election to fill the former seat of N. Nick Perry, who left the Assembly to serve as the U.S. ambassador to Jamaica, ended with the loss of New York City Mayor Eric Adams’ preferred candidate Hercules Reid, whom Adams endorsed over the choice of the Brooklyn Democratic Party, Monique Chandler-Waterman. She handily won the seat by over 60 percentage points. Chandler-Waterman and Reid will face off again in the June 28 Democratic primary.

RIKERS GETS A REPRIEVE
New York City officials got a little more time to come up with a plan to solve the myriad problems at the Rikers Island jail complex, long plagued by violence and now exasperated by staffing shortages. A judge granted Adams and his Correction Department commissioner two more weeks to figure out how they will address the issues at Rikers before the federal government potentially takes away control of the jails. The prospect was raised several weeks ago because violence at Rikers has increased in recent months, despite years of attempts to solve the issues. If the city can’t quickly show that it has a workable plan, a federal monitor will take control of the jails away from city officials.
New York City has two more weeks to work on a plan that demonstrates it can solve the violence on Rikers Island, or else the federal government is going to take it over.

NYC to Albany: We’re ready for 24/7 speed cameras
one-year lookback window for people who experienced abuse as adults to bring civil lawsuits against their alleged abusers.
Much like a driver speeding through a yellow light, the New York City Council called an emergency meeting on May 26 and passed a “home rule message” requesting that state legislators pass a bill that would expand the use of automated speed cameras in the five boroughs. That law would repeal time limits on when the speed cameras can operate, letting them catch fast drivers 24/7. Currently cameras don’t give out speeding tickets on weekends, or on weekdays between 10 p.m. and 6 a.m. – the hours when most fatal car crashes happen. The City Council’s SLR 0006-2022 gives the state Legislature the go-ahead to pass S5602B/A10438, which also extends the speed camera program until July 1, 2025. It’s currently set to expire in a month. New York City Mayor Eric Adams’ Albany agenda has been marred by missteps, but this bill would represent a minor victory. Getting more control of speed cameras has been one of Adams’ top priorities this legislative session. But the language in the bill – which lawmakers are expected to pass ahead of the last day of the legislative session on June 2 – wouldn’t go as

And stricter provisions in the original bill, including higher fines on repeat offenders, were stripped out, in order to win the council’s approval. As Streetsblog NYC reported, many city lawmakers had concerns about speed cameras, and council leaders were addressing them up until the last minute. The bill passed 43-7, with most of the opposition coming from conservative members such as Council Member David Carr, who said the speed camera program was “more about revenue than traffic or pedestrian safety.” While the speed camera extension was the highest profile bill, the council voted on seven other state legislation resolutions to be sent to the state Capitol. In a shocking turn, one of them failed. SLR 0008-2022, which would support a pension sweetener that would incentivize New York City Police Department officers to stay on the job longer failed to get the necessary two-thirds majority, after many progressive members either voted against it or abstained from voting. – Jeff Coltin

It looks like midtown Manhattan, especially Times Square, is definitely on a comeback by the crowds visible on the street. How’s the recovery going? I think Times Square is doing well. (The week of May 9), we had more than 2.2 million people walk through Times Square, and two of the seven days exceeded 2019 numbers. We’ve got 35 Broadway shows open. We’re seeing an uptick in domestic visitors. We’re seeing a lot of New Yorkers rediscovering Times Square as well.

Contrast it to when COVID-19 impacted
this area. Midtown was slightly unique in the pandemic. Everyone went home, and there aren’t many residents in Midtown, particularly in the Time Square area. South of 54th Street there’s not that many residents, at least in what we consider Times Square. We saw Broadway close when the pandemic hit. We saw visitors stop coming. And at the same time we saw the city, for all the right reasons, take residents that were in congregate shelters and move them into hotels. So Midtown saw a huge amount of people who were in congregate shelters put into those hotels. Unfortunately, those people came, but
a lot of the services that they were provided with previously, didn’t come with them. That added challenges to the street. Areas outside of Midtown didn’t seem to suffer to the same extent as this part of the city. The Midtown BID Coalition’s creation in late April signaled that the area was taking steps to work with government on the area’s recovery. What led to the decision to create this coalition? We saw the polarization that exists in our society now existing in public space and public safety. We had people on one extreme saying, “Take

everyone out of jail – that’s a good thing – and just provide services,” and then we had folks on the other side saying, “No, no, no. What worked before is what’s going to work again. We need to put everyone in jail.” The Midtown BID Coalition was formed by looking at this and saying it’s not either one or the other. It’s both. We need to provide support for those people who are in need on our streets, and at the same time we need to give law enforcement and judges the tools that are necessary to do their work effectively. Our fivepoint plan was born from that, and it was basically to increase proactive resources and support
for people who sleep on the street, and proactive outreach for people with mental health issues. How have Gov. Kathy Hochul and Mayor Eric Adams both responded to the coalition? Both the governor and mayor have been extremely responsive. They are really trying to do the right thing. We as citizens need to support them, and need to say we will not have the disorder that we have on our streets. Right now, there’s a tug of war over how much disorder we’re accepting. We need 2022 solutions for the challenges that we see on our streets. – Ralph R. Ortega

EW YORK IS continuing to expand broadband internet access statewide through a new initiative called ConnectALL. A replacement for former Gov. Andrew Cuomo’s New NY Broadband Program, the ConnectALL initiative is a $1.4 billion program that will use $300 million of state money and $1.1 billion from the federal government. Of the federal money, $800 million comes from the Infrastructure Investment and Jobs Act and $345 million from the American Rescue Plan. The money will allow the state to provide faster internet speeds to areas that are below the recommended speed of 100 Mbps, give a $30 per month internet subsidy for low-income households and provide grants to assist with construction projects to lay fiber optic cables. Gov. Kathy Hochul also revoked the state Department of Transportation’s PERM 75 permitting program – known as the Fiber Tax – that allowed the department to impose a fiber optic fee, charging internet service providers thousands of dollars per mile on fiber installations in the state’s right of way. In 2015, when Cuomo started the New NY Broadband Program, 7 million New Yorkers and 113,000 businesses did not have internet access at 100 Mbps speeds, including more than 70% of upstate New York. About 256,000 locations, homes, businesses and community centers were connected to broadband right before the COVID-19 pandemic hit. This helped many people get through the pandemic while working or attending school remotely. Despite that leap, there are still New Yorkers who lack broadband access, particularly those in rural areas. “It was a longtime goal of ours to remove barriers to the rural parts of the state,” said Scott Rasmussen, the acting director of ConnectALL. “Gov. Hochul recognizes that we’re not out of the woods yet. The next phase will see a more comprehensive way in terms of competition, equity and digital literacy.” Kristin Devoe, an Empire State Development spokesperson, said what was
left behind by the previous initiative was “very, very expensive” and there is much to be covered, especially in the hardestto-reach rural areas. According to state Comptroller Thomas DiNapoli as of September 2021, more than 1 million New York households do not have broadband connection. Most of these places are in the North Country, Mohawk Valley and Central New York. Another underserved place was the Southern Tier region. Steve Manning, the CEO of the telecommunications nonprofit Southern Tier Network, said between 15,000 and 22,000 households have been defined as underserved for not having 100 Mbps broadband access. Yates and Schuyler counties, the thirdand second-least-populated counties in New York, are setting up their own broadband projects to solve this issue. Yates County Administrator Winona Flynn came up with the Yates County ReConnect Project, which aims to provide broadband access to the 26% of households still using DSL or dial-up internet. It is being funded by the U.S. Department of Agriculture’s ReConnect grant, and it is a public-private partnership with an internet service provider. Flynn said the Fiber Tax would have cost the county about $20,000 a year, since Yates will be owning the installed fiber and share revenue with the provider. Fonda Chronis, the county administrator for Schuyler County, which has a population of 18,000 people, said eliminating the Fiber Tax will provide a significant savings for its own broadband projects. “We would have to pay to connect onto those lines,” he said. “Anything that raises the costs of these efforts takes away from our ability to run fiber. Anytime the state can take away a regulation and some costs, that’s completely beneficial to the overall project to getting broadband out to everyone that we can.” Marian Walrath, the project manager of the Yates County ReConnect Project, also pointed out that private internet providers cannot afford to install fiber themselves in rural areas, and therefore, choose not to install them. “They don’t make enough money to build to those locations,” Walrath said. “They’ll build in areas where we have a high-density location of properties. But where we have
The state is trying to connect the hardest-toreach places with broadband internet. all the farms and the houses that are a half a mile off the road, it then becomes for every mile that the internet service provider has to build, they’re not going to build down that road if all they’re going to get is that one person to sign up. City & State asked Charter Communications about its Spectrum internet service and the obstacles preventing it from providing broadband in rural New York. Lara Pritchard, a company spokesperson, said that while the costs of building a cable system should be the same statewide, fewer homes meant fewer chances in acquiring customers, and therefore, more money. There is also an issue with the telephone poles.
“Poles are typically owned by telephone or electric utilities, not cable providers,” Pritchard said. “When attaching to poles owned by those utilities, we need their permission. Many older poles in rural areas lack modernization and investment, and with the need to attach to more poles to get to potential customers in these areas, it often requires more pole replacements.

Without equitable rules, broadband providers are forced to pay all of these costs, even though they do not own the poles.” Rural New York is not the only place struggling to pay for internet service. According to Steve Myrthil, the vice president of information technology for the housing development and social services nonprofit Westhab, some people in Yonkers can only access the internet via their cellphones and others struggle to pay for internet service. According to the Census Bureau, 16.2% of Yonkers households do not have a broadband internet subscription. Westhab works on renovating vacant buildings to create affordable housing with
in-house social services in Westchester County and New York City. It has been working to bring free Wi-Fi to its Westchester locations, including in Yonkers. Early last year, a $250,000 grant from Cisco allowed Westhab to provide stateof-the-art technology for one of its housing campuses in Yonkers’ Nodine Hill neighborhood. Myrthil’s next project is to oversee the Y-Zone program, which will partner with Yonkers and several organizations so that households in Yonkers’ underserved areas would have free Wi-Fi access. Myrthil said many landlords cannot afford to hire internet companies to install Wi-Fi in their own buildings. “There’s drilling holes and actual hardware,” Myrthil said. “There’s also standard government bureaucracy, like paperwork and getting permits, and that can take weeks.” Despite all the financial obstacles standing in the way all over the state, there are projects being developed. Schuyler County has turned to the ConnectALL program to develop a map that will pinpoint which parts of the county are in need of better service so it can move forward on broadband projects. The map is expected to be ready by early June. But, Chronis said the map could uncover some surprises on where service is not up to par. He also expects intensive planning and much funding will happen next, and the county will need to create a coalition of in-
ternet service providers and regional leaders. “The challenge is localized,” he said. “But still very important.” Walrath thinks so, but added it was an item on Yates County’s longer-term strategic plan that needs to be addressed. “My understanding is that utilities like gas, heat and electric are regulated largely due to the significant infrastructure investment required,” she said. “While broadband does require infrastructure investment, there are so many varied technologies out there and they are changing so fast. So personally I believe that maybe competition (among providers) is the best nonregulated way to manage broadband.” Even Rasmussen would like to see competition between internet service providers, though he said the state Legislature would have to work on that. He added that developing broadband projects for ConnectALL’s next phase helps empower local residents. “The local communities are in the best position to solve local problems,” Rasmussen said. “Access issues are different in urban, suburban and rural areas. It’s a big challenge, but we’re really approaching this not as rural versus urban, but to get everyone on board. This (phase) is set up to exceed the first time around.”

Walking backward on gun control The U.S. Supreme Court could soon gut New York’s concealed carry law. Here’s how the state could respond.
O
NE DAY AFTER a man in Texas gunned down 19 school children and two adults, a week and a half after 10 people were shot and killed in a grocery story in a Black neighborhood in Buffalo, and six weeks after New Yorkers’ morning commute was interrupted by a mass shooting on the subway, New York City Mayor Eric Adams pleaded with the U.S. Supreme Court not to roll back one of the state’s major gun control laws. “I’m hoping the Supreme Court re-deliberates, thinks differently,” Adams said at a press conference on May 25, referring to the state law that maintains a strict standard for who can carry a concealed firearm in public. But some legal experts said that even in the wake of these and other deadly shootings, it’s likely that the Supreme Court’s conservative majority will claw back all or parts of the New York law, leading to more people walking around with concealed weapons. “We’re now in an age in which the court is heavily polarized along party lines. Thirty years ago, this kind of event could have made a difference,” said Scott Lemieux, a political science professor at the University of Washington, of the mass
shooting at a Texas elementary school. “The reality is that there is pretty strong opposition among Republican elites to gun control. If Sandy Hook didn’t change that, if the Orlando shooting didn’t change that, it just seems unlikely that this is going to do it.” The case in question is New York State Rifle & Pistol Association v. Bruen, which the Supreme Court is expected to hand down a decision on by the end of June. At the center of the case is New York state’s century-old law requiring that anyone wishing to carry a firearm in public must obtain a license to do so and demonstrate “proper cause” to carry the weapon. A court later defined “proper cause” as a heightened need for self-protection. The case involves two Rensselaer County residents who applied for unrestricted licenses to carry handguns for self-defense, but who were only granted restricted licenses to carry them in specific settings, including hunting and target shooting. The residents, backed by the New York State Rifle & Pistol Association – an affiliate of the National Rifle Association – are seeking to overturn the “proper cause” requirement, arguing that it’s unconstitutional under the Second and 14th Amendments.
Questions from Supreme Court justices during oral arguments made in the case in November left some observers doubtful that New York’s law would survive, at least in its current form. “It seems like there’s a majority of the Supreme Court who is skeptical about the constitutionality of New York’s restriction,” said Eric Ruben, an assistant professor at Southern Methodist University’s Dedman School of Law and a fellow at the Brennan Center for Justice. Chief Justice John Roberts compared the Second Amendment to the protections in the First Amendment. “You don’t have to say, when you’re looking for a permit to speak on a street corner or whatever, that, you know, your speech is particularly important,” Roberts said in November. “So why do you have to show in this case, convince somebody, that you’re entitled to exercise your Second Amendment right?” Though New York is preparing for the law to be overturned, legal experts said there may be steps the state can take to maintain some restrictions on who can carry a weapon in public. to rewrite the licensing law. In a broader ruling, the court could declare any kind of licensing regime unconstitutional. Experts were hesitant to speculate about the ruling, but some were skeptical that it would be so broad. “I would be surprised if the court ruled that licensing regimes are per se unconstitutional,” said Joseph Blocher, a professor at Duke Law School. “That would be an enormous change from both the tradition and even the current practice across the country.” Blocher said it was possible that short of declaring all licensing regimes unconstitutional, a majority could find that the state has too much discretion in issuing licenses, and rules that “may issue” regimes like New York’s are unconstitutional. An alternative could be what’s called a “shall issue” permitting system, in which New York – and other states with similar licensing laws on the books – would have to issue licenses as long as applicants met a certain set of qualifications. Depending on the scope of the ruling, there may be other options for restricting how and where guns are carried that New York and other affected states – even if the “proper cause” standard is struck down. During oral arguments in November,

some of the justices expressed some receptiveness to the idea of banning concealed carry in certain sensitive settings, such as college campuses and populated settings like Times Square on New Year’s Eve. “I’d expect a focus on trying to closely look at where the security needs are heightened, whether it’s the subway or highly populated tourist areas in New York City, or other places, and to be clear about where the state is forbidding license holders to carry their guns,” Ruben said, if it came to that. New York lawmakers were bracing for the ruling to go against the state. “I’m not expecting any great news from this Supreme Court,” state Sen. Michael Gianaris told NY1 earlier this month. “We’re not going to just sit back at a time of increasing gun violence and not react when the Supreme Court puts us in greater danger than we’re already in. So you can rest assured that the Legislature will move very quickly.” Meanwhile, other gun control measures were being discussed in the wake of the mass school shooting in Texas and the Buffalo mass shooting. Gov. Kathy Hochul said on May 25 that she wanted to raise the age to purchase AR-15-style assault rifles from 18 to 21 years old.

F YOU’VE SPENT any time in New York City, there are a few pieces of knowledge you pick up quickly: Steer clear of Times Square, jaywalking is a way of life and the East Side/West Side rivalry in Manhattan is as real as any sports beef. For the past hundred years, Manhattan has been split down the middle in Congress, with the two sides having their own representatives as residents debate the merits of Zabar’s and Eli’s Bread. But that’s all about to change thanks to the redistricting expert who decided that it would make more sense to create a pan-Central Park 12th Congressional District spanning the entire island going all the way down through Midtown to Chelsea and Union Square. And it means that two titans in their respective sides of Manhattan will go head-to-head in August to determine who will stay in Congress – and who will see their long career probably end in defeat. Rep. Jerry Nadler, an Upper West Side champion, and Rep. Carolyn Maloney, representing the Upper East Side, find themselves at the heart of a longtime geographic rivalry that will play out on the campaign trail. Despite what they might say, Nadler and Maloney both have as much claim to the new district as the other, despite Maloney technically representing the 12th District right now. In redistricting, Nadler lost the lower Manhattan and Brooklyn portions of his district, while Maloney lost the portions of her district that were in Queens and Brooklyn. Both veteran lawmakers live in the new district and currently represent roughly half of its constituents. The campaign will likely come down to who can rally their base more ahead of the Aug. 23 primary. “Their voters have been dedicated supporters for a really long time, and I don’t see there being a ton of swing between those two bases,” The Parkside Group Vice President Tess McRae said. “We’re assuming that it’s going to be a low turnout primary, so it’s going to be about talking to the most number of voters possible.”

In interviews with City & State, Maloney and Nadler offered very similar campaign strategies on how they plan to reach out to voters outside their base: highlight their long records of progressive accomplishments from 30 years in Congress and emphasize where the other fell short. Both plan to speak about the enormous number of bills they have passed and the billions they have secured for their districts. And both currently chair powerful House committees – the Judiciary Committee for Nadler and the Oversight and Reform Committee for Maloney. Differentiating themselves sufficiently to the voters will likely require some finesse. Maloney talked about her tireless work around benefits for 9/11 first responders and their families, and her history of championing women’s rights. The latter will likely be a boon for her campaign given the political zeitgeist around abortion rights that emerged following a leaked U.S. Supreme Court draft decision that would overturn Roe v. Wade. “People always describe me as being persistent,” Maloney said, citing good-government groups that have ranked her among the most effective members of Congress. She also spoke about the importance of having women in leadership positions in government right now, something Nadler obviously wouldn’t provide. “I know firsthand from experience that the issues which are addressed and prioritized by our elected officials change when women have a seat at the table,” she said. Nadler said he would run as a defender of democracy, pointing to his role in then-President Donald Trump’s two impeachments as chair of the Judiciary Committee, and he planned to highlight the tough votes he was willing to take over the years. For example, he voted against the Iraq War and the Patriot Act, adding that Maloney voted for both. He said he will run in part on his identity as the last Jewish congressional member from New York City. “People will make what they want of that, but I think I’ve been highly effective as the chairman of the unofficial Jewish caucus in the House,” Nadler said. Tensions between the two longtime colleagues have already emerged, with Maloney’s campaign announcement saying that she would not stand aside for the ego of a man. Though she didn’t mention Nadler, her implication was clear: He was

only running for the seat because of his ego. Maloney told City & State that Nadler asked her to “step aside” and run in the newly drawn 10th Congressional District, despite the fact that he currently represents far more of that new district than she does. Still, she didn’t outright call Nadler egotistical. “I don’t see this as being about one man’s actions,” Maloney said. “I felt strongly that I had to say something, because this is about a system and a pattern that women face.” Nadler painted a slightly different picture, saying that he spoke with Maloney on the floor of the House when he saw the original draft lines. He said he did suggest that she run in the 10th District when he told her of his intent to run in the 12th District, a prospect she “categorically rejected.” But then she asked him if he would run for the new district in lower Manhattan and Brooklyn, which he rejected in turn. “So that was that,” Nadler said. With so few political differences between them, the race may turn personal. “It certainly could get nasty, it wouldn’t surprise
me,” Red Horse Strategies Founding Partner Doug Forand said. “Neither of them want to end their career as a loser. … You want to go out on your own terms, and one of them won’t have the option to do that.” However, Forand said that while he would understand the impulse, he wouldn’t advise either candidate to go negative if he worked for their campaigns. Factors outside of the personalities or politics at play may wind up having a significant impact on this race. On the Upper West Side, a newly drawn open state Senate seat will likely feature a primary between state Sen. Brad Hoylman and former New York City Comptroller Scott Stringer. While congressional races tend to help boost turnout for down-ballot races, a contentious primary for a new seat may have an opposite effect, potentially drawing more West Side voters to vote for state Senate as well. As for Maloney, she will likely benefit from staving off strong primary challenges the past two election cycles from Suraj Patel, allowing her to build up her cam-

paign apparatus in preparation for this year. Nadler, by comparison, has faced few serious challenges during his time in Congress, though he said that Lindsey Boylan was a strong challenger in 2020. Patel is running again for the 12th Congressional District this year, and while most political observers expect the primary to come down to the two sitting members, the degree to which he could cut into Maloney’s votes could be another potential wild card. Despite the initial backlash to combining the East and West Sides of Manhattan, the new 12th District makes sense. Although the two neighborhoods were very different from each other at one point in time, they have since become more similar politically and demographically – both are white, affluent and progressive. “It’s not like you’re going to make a strong voting rights argument that you’re diminishing communities of color or something like that, you’re not,” Forand said. From a strictly political sense, he said, “It’s not an irrational district.” And while Maloney agreed that the East and West Sides have evolved over the
decades to share many common interests, Nadler maintained that the district overhaul made little sense even if the communities are similar. Ultimately, Nadler and Maloney have only state lawmakers from their own party to blame for their current predicament. The lines approved by the state Legislature drew near-universal criticism from across the political spectrum for being extremely gerrymandered. And if they want to go back even further, blame state lawmakers and former Gov. Andrew Cuomo for poorly rewriting the state constitution and establishing an independent redistricting commission that was doomed to fail. Still, the final lines came down to the work of just one man, and despite his extensive explanations for various districts, his reason to draw the 12th District the way he did largely remains a mystery. “It really is as though the special master wanted a primary,” McRae said. “And unfortunately, the loser is going to be all of New York. At the end of this, we’re going to lose at least one full committee chair.”

UST DAYS AFTER New York’s congressional districts were finalized, the 10th District race in Manhattan and Brooklyn has emerged as one of the most interesting in the state. Drawn by an independent redistricting expert, the district is no longer a gerrymandered mess stretching from the Upper West Side down to lower Manhattan through a thin stretch of Red Hook back up to the New York City Transit Museum and then down through Prospect Park into Borough Park. The district is basically all of lower Manhattan below 14th Street and a big swath of Brooklyn from Dumbo down through Red Hook and Park Slope and into Sunset Park and Borough Park. The new district is very liberal, voting 77% for President Joe Biden, and it is 49% white, 22% Asian, 19% Hispanic and 6% Black. Following the release of special master Jonathan Cervas’ draft maps on May 16, current Rep. Jerry Nadler announced he planned to run for the 12th District instead, creating an open seat. A flurry of candidates with name recognition have since jumped in to compete for the Democratic primary, including former New York City Mayor Bill de Blasio, Assembly Member Yuh-Line Niou and Rep. Mondaire Jones, who currently represents the 17th District in Rockland and Westchester counties. New York City Council Member Carlina Rivera, state Sen. Simcha Felder, former New York City Council Member David Yassky, former New York City public advocate candidate Dawn Smalls, former New York City Comptroller Elizabeth Holtzman, former impeachment lawyer Dan Goldman, Elizabeth Kim and Assembly Member Jo Anne Simon, have also reportedly expressed interest.

City & State reached out to a range of experts to ask for their early thoughts on the city’s hottest race. Their responses have been edited for length and clarity. GEORGE ARZT, president and CEO of George Arzt Communications De Blasio’s strength is his name recognition. His weakness is that he’s got name recognition. People had de Blasio fatigue after eight years. I think that’s going to impact him. Mondaire Jones, a lot of people like him, but he’s coming way south from his old district. However, this is a brand-new district. YuhLine is a progressive, like Mondaire and like de Blasio, so they’ll split some of that vote ideologically. Crime is the No. 1 issue. Homelessness is an issue, so is the need for affordable housing. Part of the district is a transportation desert, and there’s a need for more buses and trains. De Blasio has had eight years of trying to do something and all he can point to really is universal pre-K, so on the critical issues of crime, homelessness, and housing – he’ll say he made progress, but progress is in the eyes of the beholder, and people in that part of Brooklyn and parts of lower Manhattan will not see that. CHRISTINA GREER, associate professor of political science at Fordham University and cohost of “FAQ NYC” podcast Anytime someone’s a sitting elected, they’ve got a bit of an advantage, largely because they have this built-in base. So Mondaire and Yuh-Line are already in the game, because their fundraising and organizational campaign efforts are still fresh. The last time Bill de Blasio ran in New York City was 2017. We’re not going to talk about all the other runs that he had. Even though he ran citywide and was successful in a very crowded race, we still have to recognize that the city has changed quite substantially since he last mobilized a real campaign. Bill de Blasio still has a fundraising apparatus. Obviously the real estate world still believes in Bill de Blasio. I still don’t know who his base is and who would be interested in having Bill de Blasio as a member of Congress, but then again, we know that the big donor class oftentimes has other reasons as to why they are interested in someone being elected. So I wouldn’t discount someone who’s been the 109th mayor of New York City for two terms. I would not

turn my back on him. He’s also a white male, and I know that a lot of folks are saying, “We’re not necessarily in the moment where we’re interested in this kind of cis white male leadership.” However, we do know that still has a cachet and is still pretty powerful when it comes to fundraising and the polls. Mondaire has been progressive – a pragmatic progressive. The way the district is redrawn and cut up, even though it doesn’t necessarily have a very large African American population, it has a population that is interested in what he’s selling. Yuh-Line, she too has progressive bona fides. She has shown that she can lose a race and then come back and fundraise to win a race. She’s got her New York squad equivalent that can do a lot of heavy lifting and groundwork for her. Those are the three that I’m paying attention to, but I’m still keeping my eye on Carlina and Dawn, especially as women of color. Carlina Rivera is a sitting elected, so she has a base. And also, we keep having conversations in New York about the lack of Latinx representation on local, state and federal levels. So that could be of interest to quite a few people who want to see more Latina representation. There’s also Dawn Smalls, who’s run before and wasn’t successful, but if you look at the numbers, she knows how to raise money. She’s also a Black woman, and when you look at where she was able to get money from, I
think that makes her someone who’s of interest in this race. TONY MELONE, New Kings Democrats communications director We’re not going to say anything in support of any candidate at this point in this race. In terms of what happened in the redistricting process, there are a cascade of failures that got us to this point. First of all, it was the Cuomo administration’s flawed redistricting plan. And then our own state party’s failure to support and pass ballot measures last November that would have fixed some of the problems with the law. And then, the conservative Cuomo appointees on the Court of Appeals threw out the maps the Legislature drew. So we’re left with a situation that is very confusing for voters. And the way the party is behaving on all levels – it’s not what we’re looking for from our party. We’re looking for a party that is transparent and accountable, and that is more interested in serving the voters than in protecting incumbents. It looks like there’s a lot of incumbent protection going on. I don’t want to criticize any particular candidate, but it feels like, in many cases, incumbents are more interested in making sure they win reelection than making sure the principles voters are concerned about are being carried out. caused another candidate to run for a district far from where he’s represented. HUNTER RABINOWITZ, Brooklyn Young Democrats president This is going to be a really exciting race. The way that Manhattan and Brooklyn are split this time around are really important and really interesting. A large majority is in the 52nd Assembly District, which is the highest turnout voting district in all of New York state, and that is a really significant fact about the way this race is going to shape up. Obviously you have Bill de Blasio who appears to be the only official Brooklyn candidate to announce and you have Yuh-Line Niou, who is the only official Manhattan candidate to announce. So I think what you’re really going to see is a play out between Brooklyn and Manhattan candidates. When push comes to shove, Mondaire Jones obviously has a lot of money in his bank, and it’s going to help him, but I think what you’re seeing here is a matter of disconnect between party politics and actual, on-the-ground politics here. What I mean by that is, obviously a lot of this has come from Sean Patrick Maloney announcing he is going to continue to run in what is now Mondaire Jones’ district. Given his status in the larger Democratic Party, it’s clear that this is a shift that was done, whether officially or unofficially, by larger party politics. As much as I understand that plan, I do think
that Mondaire Jones has been quite a great legislator. He definitely has a lot of money, but he’s also not even from New York City. There are still more players to come out here, but I do think that you’re going to see how strong party politics is compared to community politics in this race. FRANK SEDDIO, former Brooklyn Democratic Party chair Anyone can run. I hear Mickey Mouse is coming up from Orlando to run in District 10. To be honest with you, I’m giving some consideration to running myself. Mondaire Jones, the interloper, have the balls to run where your home is. I think what happened is, he decided, because “I’m God’s gift to Congress, I should be able to run any place I want.” We have enough candidates in Brooklyn. We have the whole world in Brooklyn. We don’t need him. Stay where you are. Even the guys at the Alamo knew they were going to lose, but they stayed. Democrats eat their own. That’s what we’re doing here. The only good thing here is it will be a Democrat, whichever one survives this whole mess. ERIC SOUFER, Tusk Strategies Crypto + FinTech practice group leader It’s pretty much a toss-up right now. I’m not someone who’s going to totally discount Bill de Blasio. I don’t think he’s as popular as he wants people to think he is with the voters
that he’s been representing since he was in the City Council. I think a lot of those voters are some of the people who are most sick of him, according to polls. At the same time, you can’t beat someone with no one, and it’s not that there’s nobody running against him, but there are people who haven’t spent much time in the Brooklyn part of the district at all. Mondaire Jones has a great personal story, and he’s got a record to pull from as an incumbent member of Congress, albeit from a different district. But he’s likely to be seen as what the facts tell you, which is that he is a suburban member of Congress going into a very civically engaged, city-proud district that he will now have to move into in order to represent long-term. I think Mondaire could build a positive profile very fast, he’s just got to get to doing it. And he’s going to have to become highly adept in the New York City media market, which is something that’s really hard to learn really fast. He’s fortunate he’s going against Bill de Blasio, who was probably the most disliked person in the New York City political press. A fair share of Yuh-Line’s Assembly district is in District 10. So that gives her an immediate base of support. The challenge there is, can she really go beyond her base? And has she alienated parts of her base over time because she represents a district that can be rather conservative on some major issues like crime? Yuh-Line has staked out much more progressive positions on those hot-button issues, like bail reform and crime reduction. I think she could be a fit for hardcore progressives and brownstone Brooklyn. But as we saw with the mayor’s race, a lot of these same voters didn’t choose the most quote-unquote, progressive or leftist candidate. They chose Kathryn Garcia. There was definitely Maya Wiley support as well, so that is reason for optimism for Yuh-Line. JOE VITERITTI, professor of public policy at Hunter College, and author of “The Pragmatist: Bill de Blasio’s Quest to Save the Soul of New York” With no incumbent, theoretically, the race is wide open. However, with no incumbent, it really turns on name recognition. And de Blasio delivers that. He’s not really just a Brooklyn candidate. He was mayor. People in Manhattan voted for him. I think Bill de Blasio kind of has a natural advantage here as a more progressive type who could appeal to lower Manhattan in that whole corridor of brownstone Brooklyn.

WHY IS THE LATINO POLITICAL MOVEMENT IN NEW YORK SO WEAK? Disjointed leadership and politicians with ‘Bill de Blasio syndrome’ have left a void for Latinos in the highest levels of state government. By Felipe De La Hoz

S BLACK New Yorkers have crossed milestone after milestone in political representation, longtime allies in the Latino community – who had often worked to help build the Black political movement – rejoiced alongside them. For the first time since David Dinkins’ single term ended in 1993 after a defeat at the hands of Rudy Giuliani’s campaign of barely concealed racial resentments, New York City has a Black mayor in Eric Adams. Already in office were state Attorney General Letitia James, state Senate Majority Leader Andrea Stewart-Cousins and Assembly Speaker Carl Heastie. Adrienne Adams would follow the mayor to become the speaker of the City Council, and then came former Lt. Gov. Brian
Benjamin, whose brief stint in office ended with his resignation in April on federal charges for wire fraud and bribery. His replacement, former Rep. Antonio Delgado, who was sworn in as the new lieutenant governor last week, identifies as Afro Latino. There has been cause for celebration, and yet, Latino advocates and politicians across the state have celebrated with some unease. Some observers pointed to the lack of Latinas among Eric Adams’ deputy mayor appointments, breaking an unofficial tradition upheld by several of his predecessors. The council speakership had seemed like it might go to a Latino member, but Adrienne Adams was elected to the position. And there remains the fact that a Latino has never been elected to citywide or statewide office. No matter the steady population gains over the past few de-

cades – with a population that has now eclipsed the Black population statewide – Hispanic political power seemed stunted. Even with Gov. Kathy Hochul’s selection of Delgado to succeed Benjamin, activists were quick to question whether he actually had Latino heritage. Things had clearly gone wrong at some point, but where? And what can be done about it? A PROPPED UP, JOINT IDENTITY SHOWS ITS CRACKS There are a number of lessons that the political communications and media apparatuses seem to have to learn periodically, and one of the simplest is that Latinos are not a monolith – and never have been. Not only from the obvious standpoint of national origin, but not culturally and certainly not ideologically,
with communities having migrated at different times and for different reasons. Finding themselves generally disregarded and excluded in the same ways by a power structure that certainly didn’t bother to make those distinctions, a sense of convenience and mutual benefit led them to prop up a joint identity. It’s not that there aren’t clear commonalities – there are, among them an immigration experience often in search of economic opportunity and a number of cultural throughlines – but the rifts go almost unacknowledged. Bringing up the brittle nature of a unified Latino identity is a touchy subject within the community itself, which fears that any crack in the façade will just further kneecap its political and civic power, yet it’s also true that a refusal to acknowledge the underlying fractures keeps
them fixed in place rather than give civic and political leaders a chance to address them. “No one likes to talk about (the brittle nature of Latino identity) because people want to romanticize about ‘Latinos,’ but I don’t think that you can do that really when people’s identities are really primarily through nationality as opposed to some pan-Latin identity, although that’s certainly reality as well,” said Laird Bergad, founder of the CUNY Center for Latin American, Caribbean and Latino Studies and director of its Latino Data Project. “I have a lot of people saying ‘this guy’s a gringo with an attitude, what does he know, blah blah blah.’ Well, I just read the numbers,” which to him indicate that Dominicans, the largest Latino demographic in the city, will be mainly energized to vote in favor of other Dominicans, and Mex-
YOUNG, DISILLUSIONED LATINOS CONTRIBUTE TO LOW LATINO VOTER REGISTRATION AND TURNOUT This dynamic still only partially explains one of the primary obstacles to Latino political power, which is relatively low voter registration and turnout. According to data provided by Bergad, Latinos in New York state had significantly lower rates of both registration and voting than non-Hispanic white and Black voters, continuing a historical trend. Bergad attributed some of this to Latinos’ relative youth, with the community skewing younger nationally, and younger voters having lower turnout across the board. It might also be a manifestation of what Assembly Member Catalina Cruz, a Colombian immigrant who represents Corona, Elmhurst and Jackson Heights, termed as a kind of immigrant community disillusionment. “Many of these people end up immigrating to another country, and you have this sense of ‘screw politics. Back home, it didn’t work for me, why would I engage in it here?’ Add to that the sentiment that many immigrants have of, ‘I’m going back home anyways.’” One wild card is the incoming arrival of noncitizen municipal voting in New York. The policy, passed late last year, would in theory allow some 900,000 noncitizens with work authorization – mostly legal permanent residents but also some work visa holders and students – to vote in elections for mayor, comptroller, public advocate and City Council. Many of them would be Dominican immigrants, who make up a large percentage of the city’s

Many a consultant might be licking their chops at the prospect of providing convoluted advice to cash-rich state and local Democratic establishments floundering and desperate to animate Latino voters ahead of what are already expected to be tough midterms, but some proven Hispanic electoral victors contend that the formula isn’t as complicated as some might want to make it. “Republicans, they show up to the opening up of a refrigerator door,” Cruz said. “I follow some of my Republican colleagues on social media and you see them show up to everything. A 90-yearold lady in their senior center had a birthday? They showed up. The renaming of a street? They showed up. There was a blood drive? They showed up.” Cruz criticized what she viewed as a careerist approach by some Latinos who do make it to electoral office coasting in part on their community ties only to concern themselves mainly with their own ascent.
“They’re much more interested in having their own name in the headline, creating a splash, but not in creating real change,” she said. “It’s what I would call the ‘Bill de Blasio syndrome.’ The amazing headline with zero follow-through.” Not that she viewed the somewhat stunted New York Latino political movement as a purely self-inflicted phenomenon. “Jay Jacobs, and you can quote me on this, has not prioritized the Latino vote in the way that he should be. It is embarrassing. And I think that he has been given plenty of opportunities to prioritize the Latino vote, and we haven’t felt it,” she said, in reference to the longtime state Democratic Party chair. In particular, she highlighted a tendency to see the community as essentially single-issue voters on immigration, with officials forgetting that Latino voters are immensely concerned with housing affordability, community policing, garbage pickup and all the other issues that make up long-term quality of life. While ignoring the fissures between different groups of Latino voters allows them to persist, acknowledging them and coalition-building could create a true bloc that would wield outsized power. The alternative is to keep ceding ground: “If you want to continue to lose more Latino votes to the Republicans, you can keep doing exactly what you’re doing,” Cruz said. The state Democratic Party didn’t respond directly to these criticisms of Jacobs, but in-
stead a spokesperson pointed to a newly announced plan known as the Nueva York Initiative, a project helmed by former Democratic National Committee Finance Chair Henry R. Muñoz III, which will be dedicated to Latino coalition-building, registration and mobilization via a “ multi-year, six-figure investment.” The initiative is billed as “the largest ever investment in Latino voter outreach in New York State history.” GOP’S ‘BOOTS ON THE GROUND’ APPROACH TO VOTER ENGAGEMENT AND THE ALLURE OF DONALD TRUMP The Republicans are certainly listening, and see an opportunity for inroads as Democrats chase their tails. “I think that there are individuals that are really taking public service and making it about the public, and to do that, you need to have boots on the ground, you need to be in the community, and you need to understand the needs and realize that our communities are changing,” said Anthony D’Esposito, a former New York City Police Department detective and Republican member of the Hempstead Town Council, who’s now running for Congress. The son of a Puerto Rican mother, D’Esposito was enthusiastic both about the state GOP’s embrace of changing demographics (an enthusiasm not quite shared by the party’s contemporaries in other states), such as the recent elec-

tion of Ethiopian Israeli Nassau County Legislator Mazi Melesa Pilip, and what he viewed as the community’s focus on bread-and-butter issues. “Island Park is not the Island Park that it was 50 years ago, and that’s not bad, it’s good. But we need to recognize that. So I think we have the ability to recognize that and understand that many of the Latino voters have the same concerns, the same interests and they want exactly the same things for their family,” he said. Latinos around New York do and have historically voted overwhelmingly for Democrats, but it’s a mistake to think this is some inviolable rule of politics. As the political discourse writ large becomes more and more about adherence to ideological social tenets and contesting cultural grievances, Democrats often seem to either forget or willfully disregard the fact that large swaths of Latino voters are at least culturally Catholic and often socially conservative. Much ado was made about the uptick in vote share for Donald Trump in 2020 versus

permanent resident population and could, if properly energized, become a very significant political bloc. That’s far from guaranteed, though. If parties have failed to activate citizen voters of a particular demographic, there’s no reason to think there’ll be a difference with noncitizen ones. As George Leventhal, the Maryland legislator who led a campaign to pass one of the nation’s first noncitizen voting bills in Takoma Park in 1991, memorably told me: “I would love to romanticize it and say it led to some utopia of inclusivity, but no.”

2016 among Latino-heavy precincts in New York City. He still lost, but Republicans won huge in Long Island in 2021, where the Latino population has been skyrocketing, partly on the strength of an intense focus on the supposed failures of state Democratic lawmakers’ 2019 bail reform. “Let’s be honest, that entire race was about public safety, whether it’s the actual act of public safety, or the way people felt about public safety,” D’Esposito said. Republicans have figured out a winning strategy of seizing on emotional issues not necessarily related to the community’s own identity to drive turnout. GOING OUTSIDE THE POLITICAL BOX TO BUILDING A LATINO POLITICAL PIPELINE Still, it’s difficult to imagine the New York GOP making such significant gains that they will be electing statewide leaders or retaking legislative chambers anytime soon, which leaves the Democrats as the best hope for Latino political representation. On that front, Cruz’s diagnosis – an indiffer-
ent and unresponsive political power structure paired with Latino elected officials failing to assert their community’s needs out of timidity, self-interest or apathy – was echoed by former New York City Council Speaker Melissa Mark-Viverito, one of the city’s most successful Latina elected officials. “(Party officials) come around to our communities during election time. They don’t build a consistent relationship with the community,” she said. “At the same time, we do have Latino electeds that need to utilize the platform to not allow some actions to go unchallenged or unchecked.” In her estimation, these actions included the failure to include Hispanic speakers in February’s state Democratic nominating convention and the fact that former City Council Member Laurie Cumbo, who claimed that the noncitizen voting proposal would dilute Black voting power before voting against it, was appointed as Mayor Eric Adams’ commissioner for cultural affairs. In response to Mark-Viverito’s criticism, Adams said in
a statement, “Laurie Cumbo brings a breadth of experience in the arts, community advocacy, and city government to her role as commissioner.” On the broader point of Latino representation and the lack of a Hispanic deputy mayor, City Hall spokesperson Fabien Levy wrote that the mayor “committed to building a team that looks like New York City, and that’s exactly what he’s doing,” pointing to Latino appointments to lead various municipal departments and offices, including Transportation Commissioner Ydanis Rodriguez, Department of Correction Commissioner Louis Molina, Consumer and Workforce Protection Commissioner Vilda Vera Mayuga and Sheriff Anthony Miranda. “(Mayor Adams) looks forward to ensuring all New Yorkers are represented in the administration as he continues to build out his team, and will have more to announce in the days and weeks ahead.” Among the ways to build a political pipeline is to understand that it doesn’t have to be wholly contained with-
in politics and in fact is tied to a cyclical failure to include Latinos in the types of institutions that can cross-pollinate with and build power outside of standard electoral politics: prominent nonprofits, consultancies, academia and the arts. “Public, private, academic and cultural sectors feel that it is OK to run institutions without recognizing that Latinos make 27% of the New York City population, and that it should be reflected in their leaderships,” said an official within the Adams administration who was not authorized to discuss the issue publicly. Mark-Viverito has now been on two sides of this equation, as a popular elected official herself and as a strategist for Latino political participation during her post-speakership stint as president of Latino Victory, a national organization dedicated to increasing Latino political representation and civic participation. Yet, when asked what exactly has gone wrong, her tone is one of sharp exasperation. “I don’t know what it is. I’m hoping that we can overcome it. I think at some point, it has to be some sort of a convening, where we come together and have this conversation,” she said. In the meantime, the political representative future of a disjointed community of millions seems rather adrift.

New York’s last governor dominated state politics for over a decade, exploiting the levers of power with unparalleled efficacy and bludgeoning enemies and allies alike to align with his objectives. When Gov. Kathy Hochul ascended to office, her friendlier demeanor seemed to many like a breath of fresh air. Now, former Gov. Andrew Cuomo and many members of his old inner circle are gone, opening up high-ranking posts that have been filled by Hochul’s appointees.
Of course, some things never seem to change in the state capital. Brian Benjamin’s tenure as Hochul’s lieutenant governor was unexpectedly short-lived thanks to a fundraising scandal, while many experienced advocates for various causes remain as entrenched as ever, transitioning nimbly from one governorship to the next. 1 KATHY HOCHUL GOVERNOR Gov. Kathy Hochul had high hopes and lofty approval ratings when she was sworn into office in August. But she frustrated some fellow Democrats with a partial rollback of bail reform laws and an $850 million giveaway for a new Buffalo Bills stadium in her record $220 billion budget. Primary voter support eroded too, and Hochul only led former Gov. Andrew Cuomo by 8 points in a March poll taken before her lieutenant governor, Brian Benjamin, resigned after being indicted for corruption. Yet lawmakers agreed to change state law to remove Benjamin from the ballot, making it more likely that she’ll have her preferred running mate, Antonio Delgado, in November.

ANDREA STEWART-COUSINS STATE SENATE MAJORITY LEADER Although some members of her conference weren’t happy with the way budget negotiations played out, and state Senate Majority Leader Andrea StewartCousins herself said she was blindsided by Gov. Kathy Hochul’s $850 million
line to appease his diverse Democratic conference. The Bronx legislative leader received pushback from members when he suspended Andrew Cuomo’s impeachment as governor last summer and pivoted to issuing a report instead. Progressives weren’t happy that he allowed changes to be made in the budget to bail reform legislation and accused him of not fighting for a proposal to ban gas hookups in new buildings. But with such a large and diverse membership making up his unsurmountable majority, that’s just part of the job for Heastie.

Keogh helped put Hochul’s administration together and played a role in the second search for a lieutenant governor,
bringing in Antonio Delgado for the position following Brian Benjamin’s ignominious exit.

He also teamed up with state Attorney General Letitia James to demand better working conditions and lower staffto-resident ratios at nursing homes in the aftermath of thousands of COVID-19 deaths.

City Mayor Eric Adams and Gov. Kathy Hochul seem to work well together. Adams welcomed the governor to his election night victory party and introduced the Buffalo politician to city business leaders. In the state budget, he got some of what he wanted, including tweaks of the state’s bail reform and ”Raise the Age” legislation as well as an expanded earned income tax credit. But Adams couldn’t get mayoral control of schools extended or a $19 billion boost in borrowing authority, and he still wants a further rollback of state criminal justice reforms.
12 KENNETH RASKE PRESIDENT Greater New York Hospital Association Hospitals have borne the brunt of the health care costs of the COVID-19 pandemic. So it was a relief to the industry when it secured $20 billion in health care investments,
including new funding for medical facilities that suffered financial distress during the pandemic, a move Kenneth Raske supported. Raske has also encouraged the state to rethink booster requirements, in which he acknowledged the concern of the possible mandate contributing to staffing shortages, although he supported the original vaccine mandate last fall.

The everadaptable Mujica, who possesses an intimate understanding of how to craft multibillion-dollar spending plans for the state, had spent years drafting budget proposals for state Senate Republicans before he joined the Cuomo administration. For Hochul, he helped his new boss deliver a record $220 billion budget, thanks to an influx of federal funds and overflowing state coffers.
MICHAEL DOWLING PRESIDENT AND CEO Northwell Health After curbing COVID-19 during last fall’s delta variant surge, Michael Dowling, who leads Northwell Health, predicted his New York hospitals would withstand the omicron variant’s wrath over the holidays. Northwell fended off the viral onslaught, but other medical centers were pushed to the brink, with full emergency rooms and staff shortages. Dowling is also managing Lenox Hill Hospital’s 10-year, $2.5 billion master expansion plan and working to eliminate maternal mortality

16 MARY BASSETT COMMISSIONER State Health Department Last fall, Gov. Kathy Hochul lured Dr. Mary Bassett from Harvard to run the state’s beleaguered health department amid the delta variant surge. His biggest responsibility has been shaping legislative maps after the 2020 census, but the state Court of Appeals struck down the Democrats’ maps as unconstitutional, resulting in a special master drawing new maps.

17 MICHAEL MULGREW PRESIDENT United Federation of Teachers Michael Mulgrew tamed a challenge to his leadership at the United Federation of Teachers in November, then faced down members who wanted to close schools during New York City’s omicron surge in January. The teachers union president said schools had enough rapid tests to keep operating and would not pivot to remote learning despite staffing shortages. Mulgrew’s patience paid off, and city schools scored a 4% increase in state aid from the budget. Now, he’s advocating for changes to the Panel for Educational Policy before mayoral control faces renewal this spring.

His office successfully prosecuted Ghislaine Maxwell, who was found guilty of sex trafficking in December, and continues to investigate Rudy Giuliani’s overseas business activities.

The esteemed education leader put her reputation on the line to save then-SUNY Chancellor Jim Malatras’ job after Malatras disparaged a former Cuomo aide who accused the former governor of harassment. Malatras ultimately resigned in December, and Merryl Tisch replaced him with then-SUNY Oswego President Deborah Stanley while launching a search for a permanent chancellor. In the meantime, Tisch has helped SUNY secure $1.2 billion in capital funds for SUNY campuses and a $255 million increase in operating support in the state budget.
Hope Knight was confirmed in May as president and CEO of Empire State Development Corp., following Gov. Kathy Hochul’s appointment of Knight to the economic development post last fall. Knight, who previously led the Greater Jamaica Development Corp. in Queens, had already been busy running ESD in an acting capacity, helping the governor to launch a state Office of Strategic Workforce Development and to dole out funds for the manufacturing and life sciences sectors.
JANET DIFIORE CHIEF JUDGE State Court of Appeals The state’s chief judge lost her top political ally when Andrew Cuomo resigned as governor, but she maintained her position. Since then, Janet DiFiore has proposed a court reorganization plan and contended with a situation in which more than 150 court employees and a Court of Appeals judge refused to get vaccinated and some lost their jobs. DiFiore also weighed in on the bail reform debate, arguing that judges should have more leeway in setting bail. Gov. Kathy Hochul and state lawmakers largely agreed with her and revised the law.

The state gave CUNY $53 million to hire more faculty, $69 million in tuition assistance and $965 million for capital projects, which Matos Rodríguez, who picked up an honorary degree from New York University this spring, called a “transformative spending plan” for public higher education.

32 GARY LABARBERA PRESIDENT Building and Construction Trades Council of Greater New York The state budget was a mixed bag for the construction trades. On one hand, Gary LaBarbera was pleased the state authorized nearly $1 billion in financing for a new Buffalo Bills stadium with a prevailing wage provision. On the other, lawmakers excluded a tax abatement that real
estate leaders say would have spurred affordable housing construction; LaBarbera is working to revive that provision before it expires in June. He has also pushed for better safety protocols at union worksites, which led to a decline in construction accidents.

State Department of Financial Services The state Department of Financial Services likely experienced a culture shock when Gov. Kathy Hochul replaced a longtime Cuomo acolyte with a businessfriendly former Obama administration treasury aide. Hochul tasked Adrienne Harris, the first Black woman to lead the agency, with protecting consumers and ensuring the state’s equitable recovery from the pandemic. Harris has also become the top regulator of the state’s burgeoning cryptocurrency industry. She has a reputation for being friendly to digital currencies but is already requiring companies to pay annual assessment fees.
35 AMY PAULIN ASSEMBLY MEMBER Assembly Member Amy Paulin is nothing if not prolific. The Westchester lawmaker, who came into office in 2001, has had around 300 bills signed into law. And she often is the
lead sponsor on headlinegrabbing legislation, whether it’s a measure to allow indicted or convicted candidates – like a certain former lieutenant governor – to get off the ballot or proposed bills to combat gun violence. She’s also sponsoring legislation to reduce the high rate of cesarean sections, criminalize cyberflashing and allow human composting.
36 JESSICA RAMOS STATE SENATOR State Sen. Jessica Ramos has quickly become one of the leading young progressive voices in Albany. When the budget was proposed, Ramos pushed successfully for funding to subsidize expanded child care – although the measure did not cover all undocumented New Yorkers – and sought a minimum wage for day care workers. She got a tax program to offset farm overtime costs included and opposed a proposed

Evan Stavisky has been on a hot streak that has helped expand gaming in New York. His firm helped convince lawmakers last year to legalize online and mobile sports betting, which went live in January. So far this year, New York topped all states with $2 billion in sports wagers, collecting about $80 million in tax revenue. Stavisky, whose mother, state Sen. Toby Stavisky, has also helped Democrats win enough seats in recent years to consolidate control in the upper house.
COVID-19 raged. Pallotta has stood by members who have been threatened for enforcing mask mandates while asserting teachers should be in classrooms. He estimates the state will need 180,000 teachers over the next decade and was instrumental in getting $31.5 billion in school aid into the state budget, including initiatives to attract new and retired teachers and to speed up the certification process.

The Queens lawmaker had criticized the Cuomo administration for withholding data on COVID-19 in nursing homes, which led to a seething late-night phone call from the governor. And Cuomo’s resignation hasn’t stopped Kim from demanding answers or accountability for how the state handled deaths in nursing homes. His bill reviewing the state’s pandemic policies is advancing in the state Capitol.

In August, Resorts World welcomed a Hyatt Regency hotel next door in South Ozone Park, Queens. Now, Resorts World will look to upgrade its Aqueduct facility to include table games in its bid to the state gaming commission after investing $1.1 billion into its site over the past decade.

Gustavo Rivera is an outspoken Latino from the Bronx, and Assembly Member Richard Gottfried is a wonkish septuagenarian from midtown Manhattan, but apart from those superficial differences, the pair of lawmakers has plenty in common. As chairs of the health committees in their respective houses, both have pushed to expand and improve medical care in New York and have championed the New York Health Act, a single-payer bill that hasn’t advanced. Washington County District Attorney J. Anthony Jordan played a key role in the criminal justice lobbying effort, which got the governor on board and resulted in a rollback of bail reform legislation in the state budget. Hochul touted that the measure would prevent repeat
offenders from being released without bail but, as they say, the jury is still out.

When Gov. Kathy Hochul proposed a $33 billion transportation capital plan to upgrade infrastructure earlier this year, Mike Elmendorf warned state leaders not to lose sight of basic maintenance work like paving and road resurfacing. Hochul upped her allocation to $38 billion, with $1 billion alone spent on fixing potholes over the next five years – but Elmendorf cautioned even that may not be enough. Elmendorf’s lobbying for more speed cameras in work zones following 200 crashes on sites last year has started producing results statewide.

Wright, who chairs the state’s Cannabis Control Board, and Chris Alexander, who leads the state Office of Cannabis Management, were confirmed in September, before any other Gov. Kathy Hochul appointees, emphasizing the importance of expediting the marijuana rollout under the current administration.
Camille Joseph-Goldman has helped Charter Communications, the parent company of Spectrum NY1, navigate difficult headwinds as the state’s population declined while more customers cut their cords. But you’ll never catch Joseph-Goldman bemoaning the state of the telecommunications industry. She has stayed engaged with the state’s power brokers and was recently honored by National Action Network, where she is a board member, at its annual convention.
63 JABARI BRISPORT STATE SENATOR The Brooklyn democratic socialist lawmaker was so dismayed with the state budget that he called the deal a “moral travesty.” State Sen. Jabari Brisport voted no, in part because Gov. Hochul refused to consider raising taxes on the wealthy and funded two stadiums instead, and he sharply criticized the governor’s rollbacks of bail reform measures that the state Legislature had previously passed. Now, Brisport will
