Pathways To Apprenticeship Building Careers & Community to Last a Lifetime
As non-profits and concerned members of society working to facilitate the successful re-entry process for people returning from periods of incarceration, we are dismayed to learn of the recent turn of events in the labor struggle between the Building Trades and Related (Related) Companies playing-out at the Hudson Yards, and how that struggle has impacted formerly incarcerated laborers. In a June 2nd New York Post article, Related called out the Building Trades for providing a job with a livable wage to a man who is also a father, grandfather and community member. They disparaged the 50 year old man and labeled him “a $40 an hour coffee boy”, which has historical connotations that are rooted in racism, and slavery, and completely diminishes his job, while showing a lack of understanding and empathy of the working conditions on a high-rise construction site. Pouring concrete fifty stories above ground is a tedious and time sensitive job, which requires the undivided attention of as many as fifty skilled workers. Working under weather conditions that include brutal heat and intense sun, only adds to the task at hand. Keeping the work crew sufficiently hydrated and safe is no small task. That is why one worker is assigned the task of making sure that the workers are kept hydrated and safe. The alternative would be to stop the concrete pour and allow 50 construction workers to return to the ground level to receive fluids. The loss of time and money in that situation would be prohibitive. Assigning one or two workers the task is clearly the most cost efficient and responsible way to address the issue. Mr. Smokes (who continues to challenge his conviction and maintains his innocence) is an example of how the Building Trades are providing livable wage jobs and union collective bargaining protections, which can be the key to a person’s successful re-entry and healthy living. Having completed an apprenticeship program, and since then having performed dangerous and back-breaking work as a Local 20 Concrete Laborer, he receives a fair day’s pay, for a fair day’s work. Related’s 21st century vision of urban life should not include singling out and public shaming of a worker who remade his life after incarceration. When people pay their debts to society and return to establish careers, families, and other strong ties to community, we should be encouraging the creation of more such paths—not complaining that the jobs are better than such people deserve. Mr. Smokes’ story is one that is reflective of New York City values. Second chances, access to opportunities and fairness, are what this city has been, and continues to be built on. Related’s comments and deplorable singling out of an individual goes against every grain of those values and for that reason, we demand that they issue an apology to Mr. Smokes, other laborers with justice involvement and to the people of New York City. Late last week, Assembly Speaker Carl Heastie all but killed off any chance of passing a comprehensive sports betting bill this session. When the U.S. Supreme Court ruled that states could allow sports betting, some New York lawmakers were eager to move forward quickly. Such bets can already be made in New Jersey, which brought the Supreme Court case. New York has authorized sports betting at four casinos and industry interests have lobbied for opening up sports betting across the state. But Heastie cited concerns his Democratic members have with the proposal, which would allow people to place sports bets online. Other policy questions remain, including the cut sports leagues would get, with a short timeline to work through all the details. In this week’s magazine, we examine some of the unanswered questions – including whether the changes would require a constitutional amendment, which has been brushed off by lawmakers with little explanation. It’s likely there will be plenty of time for lawyers and legislative analysts to sort through these details in the months ahead. But Albany being Albany, in the last week of the session, there’s always a chance for a last-minute deal.

Latest THE BUDGET HANDSHAKE New York City Mayor Bill de Blasio and the City Council reached an $89.2 billion budget deal last Monday. It included $106 million for the Fair Fares initiative pushed by Council Speaker Corey Johnson to provide half-price MetroCards to low-income New Yorkers. De Blasio had initially resisted the proposal, but he and the council eventually came to an agreement. The budget also includes more than $400 million for the MTA’s Subway Action Plan, which de Blasio said will be a one-time payment.
UNDERWOOD SHOWS HER METTLE Despite Democrats’ fears that the state attorney general’s office would lose its bite without Eric Schneiderman, Attorney General Barbara Underwood has filed a lawsuit against the Donald J. Trump Foundation after a two-year investigation. Trump, along with his children Eric, Donald Jr. and Ivanka, are named in the suit, which seeks to bar them from ever serving on a nonprofit again, as well as recoup $2.8 million in restitution. The lawsuit accuses the foundation of campaign finance violations, self-dealing and coordinating with the Trump presidential campaign illegally. Trump immediately took to Twitter to dismiss the claims, and to say he wouldn’t settle.
After a lengthy investigation by the federal government, New York City agreed to a settlement over dilapidated conditions at the New York City Housing Authority. Federal prosecutors issued an 80-page civil complaint that accused NYCHA of systematic misconduct and deliberate lies, in particular regarding lead paint inspections. NYCHA acknowledging its faults in the consent decree, and the city agreed to spend at least an additional $1 billion to fix its public housing.
Back & Forth C&S: You have a background as a TV reporter. What do you bring from this experience to running for office? DR: Let’s be more honest about my background. It has been as an author, it has been as a film producer, it has been as an activist, and it’s been as an entrepreneur developing the solar-powered hydroponic greenhouses. I have indeed worked as a broadcaster as well, but the common thread through all of it has been a consistent effort to defend the vulnerable and to afflict the powerful.

C&S: You did not vote in the 2016 election because you did not like either of the choices for president. Do you think that Donald Trump was a better candidate than Hillary Clinton? DR: I think this is a silly conversation, with all

due respect. They’re both terrible candidates for different reasons. To compare them is a backward-looking view at a time when we desperately need to turn our attention to the future. C&S: You have not previously voted. DR: The thing that’s most striking to me is how aggressive people tend to be to try to shame people who are limited voters at a time when the country claims it wants more voter participation. (It’s) impossible to solicit more voter participation if every time someone comes out of the closet – as it were – as a limited voter, the way they’re treated is as a pariah instead of a savior or at least a welcome asset. And so, I’m here to represent all of the limited voters in this country, and I’m shocked that we’re not being more welcomed into the system considering how aggressive everybody is in trying to get people to vote.

CAN A CONVICTED FELON KNOCK A FELLOW REPUBLICAN OUT OF CONGRESS? By Grace Segers
“I’M A GRIMM MAN.” John Strand, a 67-year-old retiree who worked as a deckhand for the Staten Island Ferry for 36 years, didn’t hesitate when asked who he is supporting in the Republican primary in New York’s 11th Congressional District. He was sitting on the upper deck of the ferry en route to Manhattan, headed to an appointment with the U.S. Department of Veterans Affairs. “He’s a Marine, I’m a Marine. He’s the FBI man. I think he’s just a good person,” Strand said. The race between incumbent GOP Rep. Dan Donovan and former Rep. Michael Grimm has captured national attention, with many Republicans – including President Donald Trump – wary that Grimm, a convicted felon, would be more likely than Donovan to lose in the general election. Grimm’s insurgent candidacy
has inspired bemused profiles in major news outlets and is widely seen as the latest example of New York’s idiosyncratic politics. However, on Staten Island, which encompasses most of the district, Grimm has drawn more visible and enthusiastic support than Donovan and may pull off the remarkable feat of defeating an incumbent in a congressional primary. An NY1/Siena College poll on June 3 showed Grimm 10 points ahead of Donovan among likely Republican voters in the district, which also contains a small part of southern Brooklyn. Grimm, who was elected in 2010, resigned shortly after he was re-elected in 2014, pleading guilty to one felony charge of aiding in the filing of a false tax return for hiring undocumented workers and paying them under the table in a restaurant where he once held a part ownership stake. He served seven months in prison. Grimm’s criminal past doesn’t deter his supporters, even though being tough on illegal immigration is one of Trump’s signature issues. “I don’t have a bad word about him. In life, everybody makes mistakes,” Strand said about Grimm. Ella, a 47-year-old babysitter and Grimm supporter on the ferry who declined to give her last name, shrugged when asked about Grimm’s past. “It happens,” she said. Grimm’s exit allowed for Donovan, then Staten Island’s district attorney, to win a special election to fill the vacancy in early 2015. Now Grimm is seeking to take back his former seat, following in the American tradition of besmirched-but-charismatic public figures launching comeback bids. But while others in New York, including Anthony Weiner, Eliot Spitzer and Hiram Monserrate have failed,
ELGRIMM Grimm may well succeed. The mystery, in a district that has long favored staunch support for law enforcement, is why? For his part, Grimm does not seem surprised that he has widespread support on Staten Island. “Let’s just say I’m very appreciative that the people have remembered how hard I worked and how much I delivered,” he told City & State. More important to Grimm’s supporters than his crimes was his work in the aftermath of Superstorm Sandy, when he advocated for his constituents in Washington and co-sponsored legislation to prevent the Federal Emergency Management Agency from collecting overpaid funds given to homeowners with damaged property. Joe, a teacher at Staten Island Technical High School who did not give his last name, said he supports Grimm because the former congressman was “here with us through the hard time with Hurricane Sandy.” Grimm’s personality may seem abrasive to outsiders – he famously threatened to throw NY1 reporter Michael Scotto off a balcony – but to his supporters, it is an indication that he will fight for them.

RIMM’S PATH TO political redemption echoes that of Donald Trump, a thrice-married and six‑times-bankrupt businessman who blustered his way into the White House and won 56 percent of the vote on Staten Island. “Trump is really revered and loved by Staten Islanders,” said Assemblywoman Nicole Malliotakis, a
Donovan supporter whose district overlaps with Donovan’s, and who was the GOP candidate for New York City mayor last year. Grimm has a similarly brash style as the president. “Stylistically, Grimm connects more with the Trump voter,” said Richard Flanagan, a political science professor at the College of Staten Island. “Donovan’s a bit of an old-school gentleman and that doesn’t necessarily play well.” Another dynamic that may weirdly help Grimm is conservatives’ newfound mistrust of the U.S. Justice Department, and the unfounded claim by Grimm – like Trump, according to the president’s supporters – that he was the target of a politically motivated investigation. “There are those who believe he was taken down in a political witch hunt, and they’re angry about that,” Malliotakis said. There isn’t much distance between Donovan and Grimm on policy matters, although Grimm claims he is further to the right than Donovan on immigration. Both speak highly of Trump, despite their own relatively moderate voting records. Donovan has his own record of assisting Staten Island. He often speaks of his time as chief of staff to the borough president on Sept. 11, 2001, and he also served as deputy borough president. In Congress, he was a co-sponsor of the Zadroga Act, which provides health care for 9/11 first responders. In New Dorp, a neighborhood in the island’s midsection, a few ironworkers from Local 40, who were protesting a construction project that wasn’t using union workers, told City & State they were leaning toward Donovan because of his support for labor and the Zadroga Act. Donovan and Grimm are also following similar campaign strategies, aligning themselves with the president and painting each

other as Trump apostates – despite their own past deviations from the Republican Party line. “The reason I have been tying myself to the president is because I voted with him 85, 90 percent of the time,” Donovan said in an interview with City & State. According to an analysis by FiveThirtyEight, Donovan has voted in accordance with Trump’s priorities 86 percent of the time. Out of 235 House Republicans, Donovan has voted with the president the 210th most often, which is typical for a Republican from a moderate district. (Fellow downstate New York Republicans Pete King and Lee Zeldin have virtually identical percentages of votes cast with Trump.) Donovan said in April 2016 that he thought Ohio Gov. John Kasich “would have made a wonderful president,” but that he would support whoever was the Republican nominee. He supported Trump during the presidential election, although he called him “an imperfect choice,” and voted against the Republican tax overhaul that the president championed last year. Trump nonetheless endorsed Donovan. “There is no one better to represent the people of N.Y. and Staten Island (a place I know very well)” than Donovan, Trump tweeted. Grimm, on the other hand, has the endorsement of several familiar faces in Trump’s world, including short-lived White House communications director Anthony Scaramucci, who headlined a fundraiser for Grimm, and former senior adviser Steve Bannon. Despite Grimm’s embrace of Trump, he was one of the most liberal Republicans during his time in Congress. He bucked Republican leadership and voted against an amendment that would have deported children who were brought illegally into the United States, and was a member of the moderate Republican Main Street Partnership. As is often the case in close primaries with no major policy differences, the candidates have focused on personal attacks. Donovan has raised significantly more money than Grimm, and has been emphasizing his opponent’s criminal past in commercials and with a website, GrimmReality.org. At their first debate on WABC, Grimm and Donovan spent the first 10 minutes talking over each other and accusing each other of telling falsehoods. Grimm, who rolled out his first attack ad on June 1, has labeled Donovan “Desperate Dan,” accused the congressman of “incompetence,” having an “anti-Trump voting record” and helping his girlfriend’s son get a drug charge reduced. (Donovan denies that last accusation.) Donovan argues that Grimm “abandoned” Staten Island by running for re-election in 2014 while he was being investigated. “I don’t think the people of Staten Island or Brooklyn should trust him to serve in Congress. He lied to us, he deceived us, he abandoned us,” Donovan told City & State. “He doesn’t deserve a chance. He betrayed us. People of Staten Island and South Brooklyn aren’t going to get fooled a second time.” Grimm responded that by running for re-election, he helped keep the seat in GOP hands. “I had to run and I went through great personal strife to win the election and save the seat for the Republican Party (so) that Dan could even have a chance of being congressman. Abandoning them would’ve been not running,” he said.
Most unusually, a Grimm staffer attempted to deny Donovan the Reform Party ballot line by tampering with Donovan’s petition signatures. Grimm, ever unrepentant, told Politico, “I’m glad they did it.” When asked by City & State if the staffer had been reprimanded, Grimm said the question was “beneath me,” and a spokesperson criticized the line of questioning.
W
HILE GRIMM AND DONOVAN may not differ much on substance, they are diametrically opposed in style, and that seems to be working to Grimm’s benefit. The NY1/Siena College poll found the two men had similar favorability ratings, but a plurality of voters believed that Grimm would be better at representing them in Congress, and a majority of likely voters, 54 percent, believed that Grimm would be better at working with Trump. “They think Grimm will do a better job of articulating and personifying Trumpism, even with the endorsement of Trump for Donovan,” said Flanagan. Like Trump, Grimm embodies an aggressive attitude that his supporters view as defiant and willing to upend the political status quo. Robert, a 45-year-old college philosophy professor and Staten Island resident who declined to give his last name, said he was undecided about his vote, and seemingly unaware of Trump’s endorsement of Donovan. “It seems like Grimm would probably be the more conservative candidate, which I’d lean towards,” Robert said.

up, you’ll see the Republican electeds – maybe not publicly – make calls and stir up their personal networks a little bit to not embarrass the party and to support Donovan,” Flanagan said. This year’s federal primary election is on June 26, a time which may depress turnout. “People just graduated, schools are out, maybe people are going for summer vacation,” Malliotakis said about the timing of the primary. “It’s going to come down to who gets their voters out on a summer day in June.”

Conservative may be shorthand for a staunch Trump supporter, as opposed to a traditional Republican. Flanagan noted that Staten Island Republicans aren’t just drawn to a more pugnacious style, but counterintuitively also to a more liberal interpretation of the government’s responsibilities. “There are a lot of public workers on the island who benefit from big government. So that Southern piece of the Republican Party, that libertarian piece of the Republican Party, doesn’t play well here at all,” Flanagan said. “That pugnacious, nativist piece on the Republican side – that plays really well.” “TO BE BLUNT, only you in the media, or those in the media, have seen me as an underdog,” Grimm told City & State. “I had the same support I always had. People recognized how hard I worked, and how much I delivered.” But those voters are at odds with not just Trump but local Republican elected officials, who are universally supporting Donovan. Months before Grimm officially declared that he was running for Congress, Republicans in the district, including Assemblyman Ron Castorina Jr., then-Staten Island GOP chairman; Borough President James Oddo; and state Sen. Andrew Lanza said they would endorse Donovan, pledging him “their unanimous support – including the winning infrastructure that comes with it.” The upcoming primary will be test that infrastructure’s strength. Flanagan suggested that the Donovan campaign and its supporters may be motivated by the recent poll to improve their get-out-the-vote effort. “I think in the two to three weeks lead-
ONOVAN’S PREDICAMENT IS not unique. Republican incumbents across the country are facing steep challenges from opponents who say they aren’t sufficiently supportive of Trump. In May, Rep. Robert Pittenger of North Carolina was defeated by an insurgent candidate from the right, Mark Harris, even though Pittenger outspent Harris 2-to-1. Rep. Martha Roby of Alabama, who had revoked her endorsement of Trump after the recording of him bragging about sexually assaulting women came out, now faces a runoff election with Bobby Bright, a primary challenger who accused her of turning “her back on President Trump.” Grimm’s stylistic echo of Trump extends to outsiders perplexed by his popularity. Frank Morano, a local radio host and chairman of the Staten Island Reform Party, argued that while people in the “punditocracy” saw Trump’s campaign as laughable, Staten Islanders immediately took him seriously. “Even some now-Trump-supporting politicians in private thought his candidacy was a joke. The people never thought that,” Morano said. While residents of the forgotten borough may have an anti-elite chip on their shoulder, the district is also filled with cops and the sort of white voters who reflexively side with law enforcement. Grimm himself won in the first place partly on the appeal of his experience as a former FBI agent. Now, he is asking them to vote for a felon as a proxy for a president under a collusion investigation. That’s why Malliotakis said that her constituents would be likely to vote for Donovan, a former prosecutor, because he is “Mr. Law and Order.” There is also the possibility that Republicans will vote strategically in the primary, since Grimm might be more likely to lose to a Democratic candidate in the general election. In the poll, 1 percent of Grimm voters said they would vote for a Democrat if Donovan won, while 14 percent of Donovan voters said they would vote for a Democrat if Grimm won. This could indicate that Grimm is less electable, an idea that Trump himself promoted when he tweeted that Donovan “will win for the Republicans in November…and his opponent will not.” However, while Democrats vote strategically, Flanagan said, Republicans are more likely to vote with their gut. Trump is now in the White House because primarily white and Republican voters liked him and believed he would advocate for their interests. Staten Islanders who went with their gut and voted for Trump saw how it all worked out – and so voting for Michael Grimm just might work out for them too.

Election season is well underway, and New York’s congressional primaries on June 26 are fast approaching. Every seat in the House of Representatives is up for election, and though not every race in the state will have a primary contest, many of them do. Several Democrats are facing challengers from the left, including Reps. Carolyn Maloney, Joseph Crowley and Eliot Engel, though their chances of being unseated remain slim. A handful of Republican incumbents in New York have been rated by the likes of The Cook Political Report, Sabato’s Crystal Ball and Inside Elections with Nathan L. Gonzales to be vulnerable, and
Democrats are targeting those seats in the hope that they can ride a “blue wave” and flip the House. In many of those districts, competitive Democratic primaries have emerged in races that may become critical to the party winning the House. Here’s a rundown of all the key races to watch.

Perry Gershon While Suffolk County is a stronghold for President Donald Trump, and Rep. Lee Zeldin is a loud Trump supporter, Democrats in New York are targeting his seat, which is seen by political experts as somewhat vulnerable. Five Democrats are vying for the party line in November. At the front of the pack in terms of fundraising is Perry Gershon, a wealthy businessman who has raised an impressive $2.1 million despite his status as a political newbie with little to no name recognition. However, that includes $900,000 in loans. He faces former Suffolk Legislators Kate Browning and Vivian Viloria-Fisher, who both have governing experience. Browning has raised $494,000, while Viloria-Fisher has brought in about $257,000. Browning also has the support of the Women’s Equality Party and New York’s highest-ranking Democratic House member, Rep. Joseph Crowley. Rounding out the race is former longtime New York City Council staffer David Pechefsky and physicist Elaine DiMasi. So far, the Suffolk County Democratic Committee has not endorsed any of the candidates despite Chairman Rich Schaffer’s wish to avoid a primary.

The Republican primary between Michael Grimm, the convicted felon who held the seat until he went to prison, and Rep. Dan Donovan is perhaps the most high-profile, and most contentious, primary in the state. In the most overt example of the race’s ugliness, Donovan accused Grimm of sabotaging his petitions to appear on the state Reform Party line. Grimm denied this and suggested Donovan was the one up to something shady. To win over voters in prime Trump country, Grimm and Donovan have been trying to prove which of them would be a better ally to the president. Grimm is well-liked in the
Max Rose district, despite his conviction, so when Trump decided to back Donovan, it was seen as a potential setback and a boon for the incumbent. However, a recent poll showed Grimm leading Donovan by 10 points, so the presidential endorsement may not have quite the impact that some may think. The Democratic primary in this district is also competitive. Six Democrats are vying for the seat, but all eyes are on military veteran Max Rose, who has raised more than $1.4 million. Rose is named on the Democratic Congressional Campaign Committee’s Red to Blue list, which identifies high-priority candidates and provides them with monetary and strategic support to try and flip Republican-held seats. Only two other New York Democratic candidates appear on the list. Rose has picked up a number of high-profile endorsements, including U.S. Sen. Kirsten Gillibrand, Rep. Joseph Crowley and several New York City Council members in his district. The other candidates, none of whom have come close to Rose in terms of fundraising, endorsements or media exposure, are Zach Emig, Omar Vaid, Radhakrishna Mohan, Michael DeVito Jr. and Paul Sperling.

The seat is held by Rep. John Faso, but the swing district is considered a toss-up in November and Faso has been a top target for Democrats. The Democratic primary has drawn a crowd of contenders, with seven candidates vying for a shot to unseat Faso. Among those candidates, Gareth Rhodes has garnered positive media attention and has tried to differentiate himself from his challengers as the only one with government experience, making his time with Gov. Andrew Cuomo’s administration a key part of his campaign. And although Cuomo has not gotten involved in Rhodes’ campaign, many people with ties to the governor have supported his candidacy. However, Rhodes is significantly behind some of the other candidates in terms in fundraising. Attorney Antonio Delgado has raised nearly
Antonio Delgado $2.3 million, tops among all candidates including Faso, and has the most cash on hand after the latest filing period. Activist and business owner Brian Flynn has raised about $1.4 million with $650,000 in loans and military veteran Pat Ryan has raised more than $1.6 million. Delgado also has a key endorsement from the Dutchess County Democratic Committee, the only candidate in the race to have a Democratic county committee behind them. Another candidate, former U.S. diplomat Jeff Beals, got a national endorsement from The People for Bernie Sanders. The lone woman in the race, Erin Collier, lags behind her competitors in terms in fundraising, having raised only about $159,000, but she has deep ties to the district and has enjoyed some national coverage from Teen Vogue and People magazine as well as the support of Emily’s List.

Tracy Mitrano Rep. Tom Reed is another target of Democrats in the state. Five Democrats will appear on the primary ballot in June, but as in the case with District 19, there is no clear front-runner. Tracy Mitrano comes in third in terms of fundraising among Reed’s challengers, with about $159,000 raised, but she has the backing of the Working Families Party and Women’s Equality Party, which might give her a leg up in the race. Retired cardiologist Linda Andrei leads the five Democrats in terms of fundraising, but even she has raised only $277,000, with $170,000 in loans, compared to Reed’s more than $2.3 million.

Small-business owner Ian Golden, who has raised about $115,000, has some progressive credentials with the backing of the national group Justice Democrats as well as the state group New York Progressive Action Network. Edward Sundquist has also picked up key endorsements from the Chautauqua County and Cattaraugus County Democratic committees and their chairmen. Military veteran Max Della Pia has also gotten the backing of the Steuben County Democratic Committee chairman. Despite Democrats’ desire to flip the seat and Reed’s perceived vulnerability, the primary has been relatively quiet, with little money being raised and spent.

Juanita Perez Williams The Democratic primary to take on Rep. John Katko in November has become more complex as the pick of the national Democratic Party, Juanita Perez Williams, faces off against the choice of local county leaders, Dana Balter. Balter has the support of all four of the Democratic county committees in the district, as well as the endorsement of the
grass-roots group Knit the 24th, a local chapter of the Indivisible organization that opposes the agenda of President Donald Trump. Balter also has the support of the Working Families Party, the Women’s Equality Party and New York Progressive Action Network, as well as the national groups Democracy for America and Progressive Change Campaign Committee. Despite the groundswell of local support and national recognition as a strong progressive candidate, Perez Williams, who last year ran unsuccessfully for Syracuse mayor and had previously supported Balter, decided to enter the race less than two weeks before ballot petitions were due, telling the Syracuse Post-Standard that she was disappointed Balter had not gained traction with the national party. Though the Democratic Congressional Campaign Committee denied recruiting her, it quickly added her to its coveted Red to Blue list. Local Democratic leaders were unhappy about Perez Williams’ candidacy, issuing a letter that accused the DCCC of meddling in local politics. Perez Williams barely got enough petition signatures after Balter’s supporters proved that nearly 2,000 of her signatures were invalid, but she made it on nonetheless for a June faceoff. Despite her late start and the petition challenge, a recent Siena College poll has Perez Williams leading Balter by 13 points.

OV. ANDREW CUOMO has said there isn’t enough time to get it done. The Democratic-controlled Assembly is divided on the matter. And while there’s bipartisan support in the state Senate, the closely divided chamber has been plagued by partisan gridlock in recent weeks, casting doubt on whether any major legislation will move forward. Yet as the final week of session gets underway in Albany, there’s still a
chance lawmakers will cut a last-minute deal on sports betting legislation. Of course, as the governor noted, it’s a “big issue” to tackle, with very little time to work through the many complicating factors. First off, the U.S. Supreme Court ruling that paved the way for sports betting was only a few weeks ago. While New York had already authorized its new commercial casinos to get in on the action, the state hasn’t even rolled out regulations for such on-site sports bets. If lawmakers want to let people place bets on sports contests online,

they must take further action. Some experts even say a constitutional amendment might be needed to let people make bets online. Complicating things further are the many players already in the space – the new commercial casinos, Native American-run casinos, off-track betting corporations, collegiate and professional sports leagues, daily fantasy sports platforms – and what role each of them may play going forward. State lawmakers confront legal complications in the rush to allow sports betting.

BY KAY DERVISHI AND MAX PARROTT HEN NEW YORK lawmakers expanded casino gambling in 2013, Assemblyman J. Gary Pretlow had a premonition. He snuck in an amendment to allow sports betting at casinos in the state if the federal ban on sports betting was ever lifted. So when the U.S. Supreme Court declared the federal ban unconstitutional earlier this year, he and other lawmakers rejoiced – but perhaps too soon. A bill pending in Albany to expand sports betting may face another constitutional challenge. “There are real issues as to whether or not under the existing constitution you can expand sports gambling to sites other than the physical locations of the casinos,” Bennett Liebman, a legal expert who previously served as the state deputy secretary for gaming and racing, told City & State. The state Senate version of the bill would add regulations and extend betting to off-track betting corpo-
rations and racetracks and allow casinos to host online betting apps. The state constitution only authorizes gambling on-site at the resort-style casinos allowed in the 2013 law, and has no provision allowing online gambling. State Sen. John Bonacic, the chairman of the Racing, Gaming and Wagering Committee and the bill’s sponsor, insisted that there was no constitutional conflict with his bill, which uses a combination of technology and branding to avoid issues with location restrictions on gambling. His bill would allow the state’s four upstate casinos to build branded kiosks that would offer sports betting at other sites, such as off-track betting parlors. “There’s no constitutional amendment needed to put a kiosk in an OTB and a racino because the brand name would be the casino’s name,” Bonacic told City & State. Passing a constitutional amendment would be a strenuous task, as it would need to be passed in consecutive state legislative sessions and then by a majority of voters in a ballot referendum. Although no legislator has introduced a bill for a constitutional amendment yet,

Assemblyman Joseph Lentol recently expressed confusion over the bill’s constitutionality even though he otherwise supports it. State Sen. Joseph Addabbo Jr. said the Senate’s legal team was going through the bill to prevent any constitutional conflicts. Bonacic’s bill also requires mobile servers for any betting apps to be placed in the casinos themselves, which could bypass the argument that someone using an app to place bets is doing so outside the casino. But Liebman said this argument was constitutionally questionable. Early on in the discussion of the bill, legislators considered having players sign up in person at casinos in order to use the app. However, the bill language currently would allow users to sign up online anywhere within the state. Pretlow, who is sponsoring the Assembly version of the bill, said that the 2013 constitutional amendment that restricted the number of casinos was not intended to be taken as a physical limitation on gambling. “The object (of the amendment) was not to localize it. That was the effect, but that wasn’t the object. The object was to make it legal in New York and, at the time, this was the best avenue to do that,” he said. He added that making sports betting accessible for New Yorkers is necessary because otherwise gambling enthusiasts are going to resort to illegal betting. “People aren’t going to drive 20 or 30 miles to bet on the Yankees if their sports bookie is across the street,” Pretlow said. “So we have to make this available to people on a statewide basis.” There are others who argue that a constitutional amendment should not be necessary because the question of sports betting is similar to that of daily fantasy sports, which were legalized in New York in 2016. The state Legislature designated daily fantasy sports as “games of skill,” which means the outcome is predominantly deter-
mined by the skill of the player rather than luck. Daily fantasy sports are therefore not considered gambling in New York. Michael Kane, the president and executive director of the New York Gaming Association, testified to the state Senate in January that the only difference between daily fantasy sports and sports betting is that the former is based on a make-believe team while the latter is based on real ones. However, sports betting is currently considered gambling, according to Liebman, and therefore not pro-

How would online betting work? Patrons would be able to sign up for online wagering platforms through casinos that offer the service. The betting would follow the online model that just became available in New Jersey. In order to register, users would have to enter per-
sonal information that would be run against known consumer databases in order to verify that they meet the legal age requirement and that they are a resident of New York state. A constitutional amendment that limits gambling to seven physical casino locations in the state means that sports betting services would be run exclusively by the four commercial casinos in upstate New York. What sports would I be able to bet on? With the exception of high school sports, bets could be placed on almost every type
of professional and collegiate sporting event. The types of bets would include straight bets, propositions, over-under bets, parlays, exchange wagers and in-game wagers. Horse racing wagers would not be allowed because they use a pari-mutuel betting model where all bets are placed together in a pool. What is stopping the players, referees or league officials from throwing games? The bill stipulates a “royalty fee” of one-quarter of one percent of the amount wagered on sporting events would go to the professional leagues. This fee would help pay for the leagues to take measures to prevent the wagering from affecting the games. Beyond that, it is left up to the leagues to create processes, hold trainings and

conduct internal investigations to ensure that their employees are not affecting the outcome of any games behind the scenes. Pretlow pointed out that professional leagues already practice many of these cautionary measures. “That’s already in place right now,” he said. “Sports betting is legal all over the world, even if it is not legal in 49 states.” Will I be able to place sports bets at the Native American casinos? Out of the three Native American tribes that operate gambling operations in the state – the Oneida Indian Nation, the St. Regis Mohawk Tribe and the Seneca Nation of Indians – the Oneidas are the only tribe to announce its intention to offer sports betting on its reservation.
So far, the Senecas and the Mohawks have not explicitly embraced a plan to pursue sports betting, but have both released statements that they are looking into the matter. Former state Deputy Secretary for Gaming and Racing Bennett Liebman said that he expects the other tribes to eventually offer sports betting. Liebman also saw a potential conflict between mobile sports betting and the tribes’ exclusivity compact with the state. As it stands now, the tribes have an arrangement in which they pay the state a fee in order to remain the exclusive gambling purveyors in their respective counties. It is unknown how the accessibility of a mobile gambling network would affect this agreement. – Max Parrott
The Assembly previously had trouble passing an online poker legalization bill. Why was that the case? The poker bill has its issues in this house. A lot of people think that it’s an expansion on gambling, but many people that oppose online poker are not opposing sports betting. I guess they’ve come to the realization that it is here, it has been happening and the state’s not regulating it. The state is not even benefiting from it. Why you don’t see sports betting as an expansion of gambling? Well, it’s different. Sports betting is something that most people have taken part of. Even unbeknownst to them when they bet in those March Madness pools and they pick a basketball team. Those same people would never go on a website and play poker for money, but they will bet on their favorite team. People just see it as different. You know, a lot of stuff is perception. Some people perceive gambling as good. Some people see gambling is bad. They just perceive it different ways. But it’s the exact same thing. Are we going to need a constitutional amendment later down the road for this legislation? Great legal minds have said it’s legal to do in the constitution, in the brick-and-mortar casinos, if we can set up kiosks and it will be deemed as though the wager was being done at that (casino). What about the idea of limiting sports betting to the casinos, instead of having online gambling throughout the state? The object (of the 2013 sports betting amendment) was not to localize it. While the sports betting bill has dominated the conversation in Albany, other issues are still waiting for action from lawmakers and the state Gaming Commission. Here are four gambling issues that players should keep their eyes on.
not considered gambling. Even so, daily fantasy sports companies are interested in the proposed sports betting bill, as it could allow them to contract with casinos to host mobile sports betting apps.
CASINO REVENUE The state’s four commercial casinos have yet to reach their ambitious financial projections, and thus are looking forward to a boost in revenue from sports betting. Sports betting is estimated to produce $1 billion in new revenue for New York’s casinos and generate more than $400 million in tax revenue for the state. However, casinos must wait until the Gaming Commission comes up with rules and regulations for sports betting before they can begin accepting wagers. The Gaming Commission had no comment on whether they’ve started work on regulations yet.
OFF-TRACK BETTING AND RACETRACKS Off-track betting corporations along with horse racing tracks and video lottery terminals would be allowed to contract with casinos to host kiosks with sports betting under the proposed bill. Off-track betting corporations, which have been under financial strain in recent years, and racetracks have been especially interested in the passage of this bill, which promises the potential for increased revenue. However, the question of mobile sports betting threatens their potential monetary gains, as it would mean people could avoid physically going to OTBs or racetracks in order to place bets. Early discussions of the bill included potentially having people sign up to use the mobile apps at a physical casino, OTB or racetrack before being able to use it. However, the bill currently would allow users to sign up online anywhere in the state.
DAILY FANTASY SPORTS The state Gaming Commission has yet to put in place regulations for daily fantasy sports companies, such as FanDuel and DraftKings, after a 2016 law legalized daily fantasy sports in New York. The commission had no comment on a timeline for the regulations. Daily fantasy sports are simulated sports contests in which players assemble a team of players from a sports league and make selections for games that play out that day, earning points based on the players’ performances. The 2016 state law designated daily fantasy sports as “games of skill,” which means that the outcome of matches were predominantly determined by the skill of the player, rather than luck. Thus, daily fantasy sports are
ONLINE POKER State Sen. John Bonacic introduced a bill last year to legalize online poker in New York. The bill’s fate remains unclear, however, as the session nears its final days and sports betting has taken the front seat. A previous version of the bill passed the state Senate in 2016, though it failed to pass the Assembly. The current bill has reached the Rules Committee in the Senate, but, as in the previous session, uncertainty remains around its chances in the Assembly. “Personally, I’m shocked our state hasn’t either done it already or that the conversation up here in Albany hasn’t been more intense,” said state Sen. Joseph Addabbo Jr., the ranking Democratic member of the state Senate Racing, Gaming and Wagering Committee.

How would mobile sports betting work? JOHN BONACIC CHAIRMAN, STATE SENATE RACING, GAMING AND WAGERING COMMITTEE Can you explain the basics of your sports betting bill? Well, you say the basics, it’s lengthy. It will allow the four casinos, once the Gaming Commission comes up with regulations, to be able to take bets in their lounge. In my legislation, racinos and (off-track betting parlors) can have kiosks in there if they become an affiliate with the casino. So at a kiosk, you can place a bet and you can get paid there. They would share in the money subject to a contract agreement as an affiliate. It’s estimated that the bill will allow mobile platforms and mobile sign-ups. It’s anticipated $10 million to $30 million will come to the state for education. The rate is 8.5 percent. There’s an integrity fee of a quarter of one percent with a 2 percent cap, which is estimated between $6 million to $8 million to be paid to the professional sports teams. So mobile sports betting is part of the bill? Yes, because if you don’t have mobile sports betting then the amount of money received at the casino for sports betting, we think, will be nominal. Could you explain a little bit more how mobile sports betting would work? The mobile platform server must be located at a casino. That’s No. 1. Just be located there. Then you could go online with your smartphone and you could sign up with that server at an 8.5 percent rate if any bets that had taken on the mobile phone. But you don’t have to physically go to the casino. That was the original legislation, but after talking to more of the pros, we put amendments in that will allow sign up by mobile. Would a constitutional amendment be necessary to pass parts of this bill? There’s no constitutional amendment needed to put a kiosk at an OTB and a racino because the brand name would be the casino’s name. It’ll be a casino kiosk.

If I was a betting person – and if we had sports betting in our state – I would say that we will pass the Senate version of the sports betting bill through Finance, through the Senate, but I’m unsure about the Assembly. Would you be able to sign up on the internet or would you have to register at a physical location to start betting? In the 2013 gaming bill that we did, that included sports betting, which was kind of vague, we did not include mobile use for sports betting. It was strictly brick-and-mortar casinos. … This Bonacic bill now expands the use of sports betting beyond casinos. It includes the (video lottery terminals), (off-track betting parlors) and also mobile.

What’s to stop somebody in New York from using New Jersey’s mobile sports betting apps? You can actually limit the mobile device to in-state only. You can, jurisdictionally. We need to not only limit it geographically to New York state but also to the age of 21. How would you confirm the age if you were applying online? There (are) ways, I mean, something more than just putting in your date of birth. That’s something we’re going to have to figure out. Some of the early discussions were that in order to use your phone for a mobile app, you would have to actually register in person at one of the facilities throughout the state. How does the issue of Native American gambling exclusivity factor in? Of course, they are a sovereign nation, and they are certainly separate and apart from what we do. They can do it. They have their own tribunal rules and regulations, so they may actually do it before the rest of the state does it. If they did start sports betting, would that affect any changes with the current bill? No, only because it’s such a big industry and, again, to do it right, there has to be a lot of work put in prior to being implemented. So even if Jersey gets a head start, or others get their head start, I’m not too concerned. I’m more concerned about getting it right.

And now it’s funded in the budget to the tune of $106 million. Unlike the mayor, Jones and Raskin knew a millionaires tax had a snowball’s chance in a summer subway tunnel and worked to earn the support of tons of advocacy groups – and 94 percent of the City Council.
