I’M NOSTALGIC FOR the old Pennsylvania Station, which was demolished before I could ever know it. So, like many New Yorkers, I have welcomed the recent work done to make this key regional transportation hub inviting again. But more immediate is the need to address the plight of homeless people who’ve sheltered themselves both in the underground concourses of the station, as well as around its entrances. The Metropolitan Transportation Authority acknowledged an increase in homeless people at Penn Station, which became noticeable in the first few months of the coronavirus pandemic. And while the city, law enforcement and social service agencies are working on ways to help this vulnerable population, measures are also being taken to cordon off entrances to prevent people who are homeless from entering the station. Moynihan Train Hall limits access by only offering a limited amount of seating for ticketed passengers. And there are more MTA and New York City Police Department cops patrolling the entryways. The latest and probably strangest move was to install bizarrely colored wooden pyramids on metal security bollards outside the new canopy entrance on 33rd Street so that no one rests on top of them. Some will argue these are necessary steps to protect commuters and help homeless people, but it also seems awfully unkind. A homeless man last week broke into tears after interrupting GOP mayoral candidate Curtis Sliwa during a press conference to respond to a recent rise in violence around the station. “It’s all right. We’ll take care of you,” the Guardian Angels founder told the man. Regardless of the opportunity Sliwa seized to plug his candidacy, it also was a reminder to be compassionate toward people who are homeless. Let’s hope that the statement holds true.

New York officially has a new governor after former Gov. Andrew Cuomo submitted his resignation and Gov. Kathy Hochul got sworn in. Hochul is the first woman to lead the state as governor, a historic moment for both her and New York, especially
after Cuomo left amid allegations he sexually harassed female staff. Hochul has promised to bring about a change to the culture in Albany and has pledged that her administration will be far more transparent than her predecessor’s. Early appearances and public addresses marked an immediate shift in

The selection balances out her ticket with a liberal, downstate person of color to contrast her as a moderate, white upstater.
SCHOOL PLANS COMING INTO FOCUS
With the school year fast approaching, plans for returning to the classroom are finally beginning to get rolled out. Hochul, in one of her first announcements as governor, said that she is instructing the state Department of Health to issue a mask mandate for schools that applies to anyone who enters the building. It comes after Cuomo resisted issuing such an edict. Hochul said that further state guidance would come soon, but said that she wants to work with local districts to put in place vaccine and testing mandates for teachers throughout New York. The city recently imposed such a mandate, except without the weekly testing option that is in place for other public employees. The decision sparked anger and protests among some teachers in the city. New York City Mayor Bill de

Blasio also finally laid out school safety protocols and plans for remote learning when students are forced to quarantine, questions that educators and parents alike had been seeking an answer to for weeks. The schools will randomly test 10% of unvaccinated students every two weeks, and only unvaccinated students with close contact to a positive COVID-19 case will have to quarantine for 10 days.
A CHAOTIC JCOPE MEETING
With Cuomo out, it seems that the state’s ethics watchdog, the Joint Commission on Public Ethics, is ready to get to work. In a chaotic and rebellious meeting, commissioners appointed by legislative leaders and Cuomo voted to make two referrals to the state attorney general’s office to investigate a 2019 leak. The leak revealed private information to Cuomo and the widely criticized inspector general

probe into it. At the time, Cuomo somehow found out how the commissioners voted in a private session on an investigation into his former top aide Joe Percoco, and expressed his displeasure at the actions of some appointees to Assembly Speaker Carl Heastie. The decision to refer that incident to the state attorney general came after a split body couldn’t go into executive session as several commissioners bemoaned the lack of transparency that has plagued the commission for years. The meeting also happened just one day after a lengthy state Senate hearing on ethics about the dysfunction that plagues JCOPE. Commissioners eventually did go into executive session, but at least part of it was captured on a hot mic, allowing those who tuned into the public portion of the meeting to hear parts of the private conversations, including about a potential investigation into the former governor.

Hochul the gerrymanderer? Gov. Kathy Hochul has talked a lot about how she wants to change the political tone in Albany. Partisan gerrymandering, however, appears to be fine by her. Just look at the answer she gave to The New York Times when asked whether she planned to use her sway as governor to help Democrats gain seats in the U.S. House through the ongoing redistricting process. “Yes,” said Hochul before digressing into how loyal of a “Biden Democrat” she really is. City & State reached out to a spokesperson, who reiterated the substance of her statement and did not deny this apparent embrace of partisan gerrymandering. “One would be naive to think there isn’t politics involved in the political process of redistricting but I was encouraged by Governor Hochul saying she wanted people to believe in their government again,” political consultant L. Joy Williams said in a text. “Part of that would be ensuring a fair and transparent redistricting process.” Hochul’s comments go against the values laid out through a yearslong redistricting reform effort that culminated in a state Constitutional amendment approved by voters in 2014. This is the first time that the state’s new Indepen-

dent Redistricting Commission has been tasked with the decennial process of drawing new legislative and congressional lines. “The purpose of creating the Commission is to make the process independent from the legislature in favor of an equally bipartisan body,” reads the commission website. “For the first time, both the majority and minority parties in the legislature will have an equal role in the process of drawing lines.” The details of the process are complicated, but what matters most is that any plans by the bipartisan Commission have to be approved by both chambers of the state Legislature – where Democrats hold supermajorities – and the governor, who has veto power over the process. If lawmakers reject lines proposed by the commission twice, then the Democratic supermajorities in both chambers could draw new maps as they please with a two-thirds vote in each chamber. This might not matter much when it comes to who controls the Assembly, which Democrats have dominated for decades, but partisan gerrymandering could determine whether they hold onto their supermajority in the state Senate – and even more importantly – whether they still control Congress next year. – Zach Williams

What concerns do you have about New York state’s and New York City’s vaccine passport apps? I think we’re wasting millions and millions of dollars on apps that at the end of the day are no better than the (Centers for Disease Control and Prevention) white card that we all get for free when we’re vaccinated. I want to emphasize that I want every New Yorker who can to get vaccinated, I want to make sure that we’re encouraging vaccination. But these apps, they’ve been a really poor way of promoting vaccinations. So Excelsior Pass, for
example, has been riddled with errors. There are numerous New Yorkers who want to register who have been vaccinated, but because of errors in the state database or because they’re vaccinated out of state, (they) are ineligible. On top of that, we see that the app actually is not very secure. Under the state’s contract, we’re paying IBM up to ($27 million) for this app. And when I tested it, I was able to forge a volunteer’s Excelsior Pass in just 11 minutes. You’ve also been able to demonstrate security flaws in New
York City’s vaccine passport app. When I downloaded the New York City app, I was astounded, because it’s not a vaccine app. It’s just a camera app dressed up as a health tool. And so I uploaded an image of Mickey Mouse as my vaccine card, my test results and my driver’s license, and all three were accepted. And part of what’s maddening about this is that the mayor was going on national TV to talk about how important this app was, and it’s no different from the camera app that people have been using to safeguard a copy of their vaccine card. It’s just a complete PR stunt.
What do you hope governments can learn and do better in the future when it comes to releasing these tools? I think that one thing we have to recognize is that the things that we allow for simply the duration of this emergency are likely to become a permanent feature of our lives. That’s the lesson of 9/11 and the counterterrorism measures that we said would just be here for a short time, but 20 years later are an inescapable part of how we’ve rebuilt our society. Another part of this is just that I wish that governments would actually talk to the skeptics, and not
just the salespeople who are selling these tools. Because there are a lot of valuable technologies that can be rolled out in response to the pandemic and novel threats – things like effective vaccine websites, testing portals, and all sorts of things that we’ve seen civic technologists do to improve health equity and access. But oftentimes, they get the pitch from these vendors, write a check and cross their fingers that it will actually make things better. But all too often, it just makes things worse. – Annie McDonough

S THE MORE infectious COVID-19 delta variant spreads throughout the state, questions have been raised about how it could complicate the start of the school year. In-person classes are coming back, COVID-19 cases are up and vaccines are still not authorized for children under the age of 12. With Gov. Kathy Hochul telling the state Health Department to implement a statewide mask mandate in schools on her first day in office, she set the tone for safety being a priority in the upcoming school year. Some school district leaders had previously been upset that the state had declined to set statewide policies and left it up to local districts to set the rules for themselves. New York City was among the few districts that were willing to run with that leeway. Mayor Bill de Blasio recently announced that all teachers and staff at the city’s schools will be required to receive at least one

dose of a COVID-19 vaccine before Sept. 27. So far, at least 63% of staffers in the city have been vaccinated. The directive went further than the requirement announced in late July for teachers to either be vaccinated or submit to weekly COVID-19 testing. On the same day the city’s vaccine mandate for school staff was announced, the Food and Drug Administration approved Pfizer’s COVID-19 vaccine. Pfizer, like the other two vaccines from Moderna and Johnson & Johnson, had previously only had emergency use authorization. With only a few weeks left before the start of school, it’s unclear how the mandate will be enforced and whether a court will block its implementation now that union leaders have said they’ll file a complaint. “While the city is asserting its legal authority to establish this mandate, there are many implementation details, including provisions for medical exceptions, that by law must be negotiated with the UFT and other unions, and if necessary, re-

solved by arbitration,” United Federation of Teachers President Michael Mulgrew said in a statement. The New York Times reported that the city is negotiating with the UFT and other unions over how consequences for those who refuse to get vaccinated will work. De Blasio has emphasized, however, that the mandate will go into effect on Sept. 27, whether or not the negotiations are completed in time. The UFT had previously praised the city’s vaccine or negative test requirement, emphasizing the importance of giving staff a choice of whether or not to get vaccinated. However, the leader of a national teachers union, American Federation of Teachers President Randi Weingarten, supported vaccine mandates for teachers. Parents sending their children back to class – some of them for the first time in a year and a half – will have varying levels of assurance of their kids’ safety based on where they go to school. tion systems in city schools have also been upgraded. It’s unclear how well the vaccine mandate will go down with teachers and other staff. New York City schools Chancellor Meisha Porter addressed concerns that the requirements could lead to teacher resignations in an already short-staffed school system, saying last week, “I do not expect a staffing shortage. I expect our staff members to get vaccinated.” New York City appears to be going farther than most districts in the state when it comes to various mandates. The Rochester City School District will require staff to be vaccinated or submit to weekly COVID-19 tests. Another district in Central New York will require teachers to show proof of vaccination or wear a mask. Hochul has already moved the ball forward for those in favor of mask mandates while

hour, some public health experts said these kinds of mandates were necessary to send kids back to school safely – especially children under 12 who can’t be vaccinated yet. “We need to kind of surround these children who cannot yet be vaccinated with a safety net of vaccinated adults,” said Wafaa El-Sadr, a professor of epidemiology at Columbia University’s Mailman School of Public Health. De Blasio announced on May 24 that city schools will be returning to in-person classes exclusively on Sept. 13, without the option to attend class remotely. The new vaccine mandate for city Education Department employees is one layer of the city’s measures to control the spread of COVID-19. Students and teachers will also be required to wear masks and will have to social distance from one another. Ventila-

Gov. Andrew Cuomo’s Education Department declined to set statewide requirements. Still, public health experts said the only way to fully ensure the safety of children not yet eligible to be inoculated against the virus was to have all adults or eligible older children fully vaccinated. “My big thing is that all the teachers and school personnel should all be vaccinated and that should be the policy because these children, anyone under the age of 12, is definitely vulnerable,” Donna Hallas, director of the pediatric nurse practitioner program at New York University’s Rory Meyers College of Nursing, told City & State. “If they’re not vaccinated, then they shouldn’t be in school.” De Blasio said that while the city is working to get kids 12 and older vaccinated, a mandate for students is
not on the table right now. El-Sadr, the Columbia professor, said that mandatory vaccinations for staff was one of several important steps schools should be taking now. Others included educating students and staff about the importance of not coming in while sick, updating ventilation systems, requiring masks indoors and holding lunch – when masks come off – outside as much as possible. At the onset of the pandemic, research indicated that children were not, for whatever reason, particularly vulnerable to contracting or transmitting the coronavirus. Now, however, more children are becoming infected with the delta variant. In states with low adult vaccination rates, such as Florida, Louisiana, Missouri and Arkansas, child COVID-19 cases are rising rapidly. “Everybody is a little bit nervous
about the possibility that the delta variant could in fact be, in some way, more dangerous in kids,” Dr. Richard Malley, a pediatric infectious disease specialist at Boston Children’s Hospital, told The New York Times. Children are the largest unvaccinated population, in part because there isn’t a vaccine available for children under the age of 12. The Food and Drug Administration has said it expects a vaccine to be available for children under 12 on a “fall or winter timeline.” In the absence of such a vaccine, efforts are being made across the country to encourage unvaccinated adults, particularly those with young children, to get the vaccine to prevent them from spreading the virus. “There is, with delta, we think, a reasonably high household attack rate, meaning that one person in the household gets sick and other people are at risk of getting sick,” Ashish Jha, dean of the Brown University School of Public Health, told The Atlantic. The New York City Health Department launched a $1.3 million ad campaign to encourage families to get vaccinated and will be contacting all families within the public school system to go over their vaccination options. The city also launched a referral program in June that provided $100 to anyone in a civic, faith or tenant group who was able to convince someone to get vaccinated ahead of the school year. “Vaccinations are our passport out of this pandemic, and we are getting the word out every way we can about the importance of getting eligible people and students vaccinated,” Nathaniel Styer, a spokesperson for the city Department of Education, told amNewYork. “We are alerting PA (and) PTA groups that they qualify under the city’s optional referral bonus program, and they can participate to receive $100 for every vaccinated person who names their PTA as the referring organization.”

Will the kids be all right? NYC hired an army of social workers, trained parents and prepared staff. It may not be enough.

VER A THOUSAND New York City public school kids while learning during the pandemic received personal phone calls wishing them a happy birthday, even during the summer. It was one of the projects that Keisha White, a school counselor at P.S. 117 in Queens, also known as the J. Keld/Briarwood School, came up with to keep connecting with her students as many opted to learn from home during the worst of COVID-19. Students also received an individual shoutout on the school news, accompanied by 240 other videos that White created daily, including fun facts of the day. But now the focus is shifting to a return to in-person learning, leaving many unknowns about how students will react when they come back to school. “We have no idea what we’re going to see. Do you know the amount of crying that happens after just one summer of a kindergarten or pre-K student coming to school on the first day? I’m trying to imagine after a year and a half. It’s going to be extra tough. I think that the children, the parents and the staff – they need stability. They don’t need all of this, ‘OK, we’re happy one day,’ and now everybody’s asked
to stay home the next,” White said. The New York City Department of Education, in anticipation of bringing students back to class, said it has expanded mental health resources available to them, beginning with the hiring of over 500 social workers. The department also said it expanded social-emotional screenings to all schools and offered mental health resource training to parents. Also, the Summer Rising school program this past summer combined academic support with social and emotional learning, along with enrichment programming to offer families child care services. “We know that students cannot fully engage in learning unless their social-emotional and mental health needs are being met,” a city Education Department spokesperson told City & State. All 1,800 public schools are set to open fully, with in-person instruction five days a week starting on Sept. 13. No remote learning option will be offered, despite the threat of the delta variant and mounting pressure from parents and teachers. Time will tell whether the expansion of mental health resources will provide enough of a safety net for the most vulnerable children upon their return.
Students in neighborhoods hit hardest by COVID-19 have already received additional support. Social workers in October were trained to become specialists in trauma-informed work to serve 350 schools identified as being in neighborhoods most affected by the pandemic. Federal funds were used to create 27 additional community schools in the impacted neighborhoods. Mental health and social service professionals have applauded the expansion of services. Cristina Harris, director of training at Vibrant Emotional Health who has worked in education, social work and social services for children and families for 20 years, said she believes that the efforts are well-rounded by the new hires and trauma-based training. “School is the place where all kids are going,” Harris said. “So making sure that those services are being beefed up within schools is really exciting.” However, there also are concerns over the effectiveness of the Education Department’s efforts. Rohini Singh, a senior staff attorney with Advocates for Children of New York, was unsure whether the addition of resources would mean greater accessibility to those resources. “While you look at a list of the programs on paper, it sounds really

robust and really supports students. What we find is that there’s a disconnect between actual direct provision of services for students and access for students,” Singh said. The additional personnel also might not be enough. City Limits reported that while the department said it maintains a ratio of one social worker and guidance counselor for every 215 students, which is lower than the recommended ratio by the American School Counselor Association’s recommendation as well as the national average, the calculation of the ratio has come into question. City Limits found the department calculated the ratio by combining the total number of social workers and guidance counselors to the total school population, even though the two positions have differing roles. Separating the two, City Limits found that there were 323 students for every guidance counselor, and 632 students for every social worker. Add the 150 social workers who were recently hired and 290 included in the executive budget on education and the ratio is 489 students for every social worker, according to City Limits. The news outlet did point out that the data doesn’t include other supports offered to students through community-based orga-
nizations and mental health clinics. The Education Department did not respond to an email requesting clarification on the numbers. Before the department announced the additional hires, the United Federation of Teachers released a five-point plan with suggestions on how to support students after the pandemic. Their initial point recommended creating teams of academic intervention specialists and social workers for each of the 1,800 public schools. The plan suggests that the average school would need about six to eight professionals, with numbers fluctuating based on school size. This would require the hiring of 10,000 new professionals and would cost approximately $1 billion. Though the department’s numbers fell quite short of the UFT’s, the union was pleased with how the city has responded to the needs of students. “The UFT and parents lobbied on the city, state and federal level, and the result was increased funding on all levels. As a result, (New York City) for the first time provided 100% fair student funding for every school. This increase gives principals the ability to hire additional counselors, mental health professionals and academic

support specialists for their school communities – a big win for students. In addition, the City Council allocated additional funds for counselors at schools that previously lacked them,” a UFT spokesperson told City & State. Funding also may prove to be a roadblock to cementing the longevity of the additional staffers who were already hired. As of now, federal pandemic relief money made several of these efforts possible, including the hiring of new social workers and the creation of new community schools. That funding will have to be used by 2024. Advocates said they were already prepared to fight for the continued funding of these programs – but that it will require evidence that the programs are working. Currently, data for some of these programs can be found using the Mayor’s Office of Community Mental Health’s data dashboard. “The way forward is to make sure that everyone who works with children, or has a family of their own, or cares about children and families, understands what this looks like,” Harris said. “It is great that this money has been infused. But we’re going to really have to fight and advocate for the continued funding of mental health in schools. “This is necessary foundationally to children and youth actually thriving in the world in educational outcomes and being able to then enter the workforce,” Harris added. While funding will continue to be a fight for child welfare advocates, the Education Department’s efforts will help make a difference for schools like the Thurgood Marshall Academy Lower School, which will be receiving the help of one of the 500 new hires. Principal Dawn Brooks DeCosta believes that having a social worker for the first time will help the staff and students continue to prioritize social-emotional learning. “So this will be the first time that we’ve had someone – our own social worker – and someone that can be very laser-focused and dedicated to making sure that kids are making this adjustment with a lot of support, any kind of trauma that students have experienced over the pandemic,” Brooks DeCosta said. “We’re just really happy to have someone that is going to be very focused on that, although we’ll all be involved. We want to make sure that that person is really available to all of our students and families. It’s a great benefit that we would otherwise not be able to afford on our own because of our small size.”

ECENTLY, GCOM CEO Kamal Bherwani sat down with City and State NY’s publisher Tom Allon to discuss his start in New York City government and how it led him to running one of the most innovative government modernization companies in the industry. Tom Allon: Tell us how you got involved in technology in the first place. Kamal Bherwani: It actually started way back in elementary school, when a friend of mine convinced me to loan him some money. A few months later, he told me he couldn’t pay me back, but he offered to give me a computer that his did had given him. I didn’t have much of a choice, but it kicked off my passion for technology. I taught myself everything I could. I started learning programming in the sixth grade, and by high school I was working in the evening as a programmer. I loved it from day one. I would have done it for free. My first real job was as a programmer in New York City government. At the time, the agency was called the Department of General Services. From there I went to HPD, Housing Preservation Development, and left in 1994 to work for a private equity investment banking organization. I came back as the first CIO for DDC, Department of Design and Construction, then from there returned to HPD as CIO. I left government for a while and did some tech investing, but then came back as the CIO for Health and Human Services. About half of my career has been in city government. Tom Allon: Why did you decide to become the CEO of GCOM? Kamal Bherwani: GCOM is all about delivering outcomes for state and local government. And I have a passion for that because I saw what you could do when
you were in city government. The kind of projects you could take on and the ways you can change people’s lives were pretty powerful. State and local governments are better positioned to create lasting change because improving wellbeing for residents is a longitudinal problem. It’s about diverting and shaping on a person-byperson basis to drive large-scale-change. Small deviations that occur when someone is young can have huge impacts later. Consider me being given that computer instead of being repaid that loan – that was a meaningless event for me at the time, but it shaped my entire life. The work done at GCOM focuses on using technology to improve outcomes. Each city has their own view of what they want those outcomes to be, because service delivery happens at a local level. You don’t call the federal government to pick up your garbage or when there’s a
problem with your child. You deal with the issue locally. I joined GCOM because I wanted to be involved in that type of change. Tom Allon: In which areas of government is technology-enabled change more ripe to occur? Kamal Bherwani: I think everyone can agree economic prosperity is directly tied to improving outcomes through technology, because incomes lead to outcomes. Then outcomes lead to incomes. It goes both ways. We can leverage technology to define outcomes and then agree on how to fund the outcomes that are the most important. Regardless of the area, whether it’s public safety or education or healthcare, we have to begin by using technology to measure the outcomes that are most important. That means going beyond

inequity and injustice in a number of ways. On the other hand, it’s accelerated the adoption of digital technology – technologies that allow working from home and hybrid work environments, something governments have never really allowed. It’s also accelerated the adoption of data analytics to enable better policies. The more data you have, the more transparency you can offer. Transparency leads to accountability, and accountability leads to change. There’s no doubt we’re seeing the acceleration of technology in the health and human services space. Take telehealth, for example. Telehealth did not really exist on a pervasive until the pandemic happened. Necessity became the mother of invention. Telehealth is one of the ways that government is making life for residents easier, more frictionless.
transactional metrics. This is a long-time challenge within government. You have lots of people trying to do their best, focusing on a specific transaction, like getting residents enrolled in a program, but those transactions can’t be connected to the ultimate outcomes. Instead of tracking, if and when, a resident was approved for a certain benefit or qualifies for a specific program, we must be measuring the impact of those programs. Tom Allon: Obviously, the pandemic has changed how government delivers services. Can you talk a little bit about that? How do you think this is going to impact what you do and what government does? Kamal Bherwani: I think when we look back on it, we’ll see that the pandemic has been an accelerator of both good things and bad things. For example, it exposed
Tom Allon: If you could look into your crystal ball, what can we expect over the next five years in terms of technology improving government? Kamal Bherwani: I think there will be a competition for taxpayers, and tech will play a big part in that. Its already started and it has accelerated as a result of the pandemic. People realize they can work from home, and that’s given them options about where they want to live. How can state and local governments now market to taxpayers and bring people in? The mayor of Miami is actively marketing residents in California. That’s never really happened before. We’ll also see governments trying to digitize and modernize as much as possible. New York City has done this in very strong ways. For example, we partnered with New York City Department of Health and Mental Hygiene (DOHMH) to create a digital birth and death certificate system. All birth and death certificates are electronically certified by a doctor on a mobile phone, in a hospital, a private hospital, in a private setting, 15,000 doctors. Conversely, when someone passes away, the permission to bury or cremate is issued electronically. Overall, I think we’ll see more of an investment in creating a frictionless experience for residents when they interact with government. More cities and states will focus on creating one-stopshops for residents to conduct all of their business with government, which is going to drive down operational costs. Tom Allon: Do you see anything happening on the federal level that gives you optimism that the federal government is starting to use digital technology to drive outcomes?
Kamal Bherwani: There’s been fits and starts. There’s been a lot of great work done in the Office of the Health IT Coordinator to reward people who are in federal programs, medical programs, for the right outcomes. And that’s been very powerful. Another initiative that’s outcomes-based is the Women, Infant, Children (WIC) Program. Tom Allon: What are your goals over the next five to 10 years for GCOM? Kamal Bherwani: I want GCOM to be known as the company that helps government create healthier and more prosperous communities. And for me, it’s all about delivering outcomes. A lot of technology providers will say “We completed a project on time on budget.” And they view that as a success. But my view of success is whether or not the government got the outcome it wanted for their residents when they created the program. And can we help them get there? That’s what we challenge all GCOMers to do. We’ve created a strategy called NextGen Government because we know that the pandemic and the investments coming in from the American Rescue Plan will be used to deliver better outcomes. And we want to be a partner with government in making sure those outcomes happen. Tom Allon:If you could wave your magic wand, what would be the best thing to happen over the next year, both in New York and for yourself personally? Kamal Bherwani: For New York, the best thing to happen would be people coming back. The people who left during the height of the pandemic coming back because they have faith in the city’s recovery. I’ve been in New York, pretty much my whole life with a few jaunts outside for work-related reasons, but New York’s been my home. So, if I could wave a magic wand, bringing those people back would be number one. Second would be the allocation of the stimulus dollars in a way that would maximize a return on investment and drive the outcomes we most need in the city. My view is that we should treat the stimulus as an investment, not as a subsidy. If we treat it as an investment, it will become part of that income-outcome cycle and we’ll see real change.

Defining ‘safety’ in schools

T WAS A CLOUDY morning in mid-August, as New York City student activists gathered in Carl Schurz Park near Gracie Mansion to call for something that has been hotly debated for years: police-free schools. They said they want an education system that prioritizes mental health care and restorative justice over punitive practices. Around 25 students, many of whom are organizers with the New York Civil Liber-

ties Union’s Teen Activist Project, shared experiences they’ve had with the school safety agents in their schools. Jonathan Rampagoa, a student at Bard High School Early College Queens, said he was questioned by school police a few years ago when he was in middle school. He had a pair of scissors in his bag he’d intended to use for an art project. After the scissors triggered the metal detector at the entrance of his middle school, Rampagoa said “a couple police officers put me in the corner and started questioning me with
the intention I was up to no good.” He said only after he was asked to call his art teacher to confirm the intended use of the scissors and answer the principal’s questions was he allowed to go to class – 30 minutes after first period started. Others talked about the role police have played in breaking up fights between students. “When fights break out in schools, police are the first called, but what about guidance counselors and social workers? What about

By Sahalie Donaldson restorative services instead?” said Benjamin Boateng, a student at Humanities Preparatory Academy, explaining that he was lucky enough to have access to restorative justice programming at his school when he was having issues with a fellow student. Restorative justice is an approach that focuses on reconciliation between the offender and the victim, rather than just punishment for the offender. “I am lucky enough to have the situation where I was not suspended, and there is no record of me that would impact how the world looks at me. While I am fortunate that I did not get suspended, however, my peers in other New York City schools are not given the same satisfaction.” The Department of Education and city officials have announced a number of measures in the past few years to expand restorative justice programs and other mental health services in New York City schools. This includes hiring an additional 500 social workers this fall, but some activists feel the measures don’t go far enough. School safety agents, while

they don’t carry guns, are currently part of the New York City Police Department. Every public school has at least one agent, and some schools have more than one. Their duties in schools include monitoring metal detectors at building entrances, responding to fights, checking in visitors as they enter schools, responding to student mental health crises and sometimes making arrests. There are currently 4,400 school safety agents – around 650 less than previous years, according to Phyllis Shafran, director of communica-
tions for Teamsters Local 237, which is the union currently representing the school safety agents. The starting salary for the job is $32,834, according to the NYPD. Approximately 70% of the school safety agents are women and 90% are people of color, Shafran said. Nathaniel Styer, deputy press secretary for the city Department of Education, said 250 new school safety agents will begin training immediately to address the current shortage which, according to him, was caused by attrition and retirements. While the number of arrests and summonses has declined over the years, racial disparities persist, and Black and Latino students disproportionately face higher rates of suspension, use of force and arrests. According to the New York Civil Liberties Union’s analysis of Student Safety Act data, Black and Latino students, while making up 66% of the student body, were the subject of 88.9% of police interventions during the 2018-2019 school year. The vast majority (80%) of arrests in schools are carried out by armed police officers, not school safety agents, as of 2019 data. Last summer, facing pressure during citywide and national protests against racism in policing, New York City Mayor Bill de Blasio agreed to transition control of the then approximately 5,000 school safety agents – which would rank as one of the largest police forces in the U.S. – from the NYPD back to the Department of Education by June 2022. This date will roll around six months after de Blasio leaves office. By then, Eric Adams, Brooklyn borough president and a former police captain, will almost certainly have taken his place as mayor. De Blasio had opposed such a transfer for a long time, citing a “huge safety challenge in our schools” and saying that school safety agents have done a lot to reduce crime and violence. After the policy change last summer, de Blasio said the Education Department should step in to train school safety agents on how to use less punitive discipline practices against students. “I think school safety will be more effective if it gets more deeply trained in those approaches and deepening the dialogue with young people and their families,” de Blasio said, according to Chalkbeat. Adams’ spokesperson did not respond to requests for comment about his thoughts on the transition, but while campaigning,
Adams said he wanted school safety agents to remain in schools with some changes to how they operate. He has emphasized that there should not be a “police culture” within schools, and in March he said he supports moving unnecessary funding from school safety agents into support services like counseling, though he didn’t specify what qualified as unnecessary funding. “Public safety is a prerequisite. I don’t want our young people to ever be in an environment that is unsafe not only from students in the school, but people who lurk around schools and attempt to harm students. … We need to make sure that the school buildings are safe but at the same time our focus should not be on heavy-handedness, it should be on making sure (students) have access to self care,” Adams said in response to a student question about policing in schools during a BRIC TV broadcast.

TYER OF THE Department of Education said the city is on track for transitioning the school safety agents to the Department of Education by June 2022. Doing so, he said, is “part of ensuring all of our students have a caring adult to go to when in crisis.” School safety agents began training with the Department of Education this spring in conflict resolution, mediation, restorative justice and implicit bias – something they will all go through to ensure they are aligned with their school’s social-emotional work and are integrated into the school community, Styer said. Additionally, four transition committees, co-led by the Department of Education and NYPD, met throughout the past school year to create policy recommendations for the transition. “Schools must be safe havens for learning, and school safety agents play a critical role in ensuring that every student feels both safe and welcomed in their building. As we transition (school safety agents) back to the Department of Education over the next year, we will work to deeply integrate them into our schools as partners in creating healing-centered schools,” Styer said in an email. Jake Martinez, the New York Civil Liberties Union’s director of youth programs, said he believes transitioning oversight of school safety agents to the Department of Education will further entrench policing in schools. “The students have made it very clear, and

advocates have as well what they need to feel safer in schools,” Martinez said, noting that there are currently more school safety agents in schools than there are guidance counselors and social workers. According to the Education Department, there are 4,332 full-time social workers and guidance counselors and 4,480 part-time social workers and counselors. When the 500 additional social workers begin work this fall, the full-time count will be about 4,832. “That is restorative justice practices, counseling, other services investing in training for our teachers, implementing more mental health professionals in our schools – after-school programs.”

Michael Simmon, a social studies teacher at IN-Tech Academy in the Bronx, attested to the power of positive reinforcement, such as students participating in sports teams and extracurriculars as opposed to harsh punishments and police involvement that leaves students with records. “There’s a gray area where having that safety in the school is good, but at the same time it could hurt the student that misbehaves in schools, so it doesn’t become a school problem, now it becomes a police problem,” Simmon told City & State. “Giving these students something to do and making them feel like they are part of the school starts to take away that negative behavior while now you have better classroom management, grades get better, there’s more spirit in the school so now you don’t need so much of a law enforcement presence to actually keep everything in line.” He said that at his school, the school safety agents are a positive presence where they
attend student sports games and dance with kids during back to school block parties, but he knows this isn’t reflective of the police’s presence in all schools. Diverging opinions on school safety agents aside, teachers, educators, activists, students and city officials all largely circle back to the same thing – the necessity of social-emotional support and robust mental health care for students. During the rally in August, Tania Hernandez, a student at University Heights High School in the South Bronx, recalled transitioning from a middle school where she saw students get knocked down to the ground by police to a school where she was pulled out of class by a guidance counselor after a teacher noted she was having a difficult time. “In middle school, the only time I would be pulled out of class would be if I had been in a fight or if I had witnessed a fight. Being pulled out of class by my guidance counselor just to chat helped me build an amazing relationship with her. Now I’m able to go to her whenever something is bothering me,” Hernandez said.

URVEYS OF ATTITUDES toward school safety agents show mixed feelings. According to a Chalkbeat analysis of Education Department survey data from 2019, at schools where less than 20% of students are Black, about 83% felt school safety agents “promote a safe and respectful environment.” That number was 76% at schools where more than 80% of students are Black. Another survey of 1,330 New York City youth ages 14-24 conducted by nonprofit Citizens’ Committee for Children of New York found that less than half agreed with the statement: “Having police officers in schools makes me feel safer.” Johanna Miller, director of the New York Civil Liberties Union’s Education Policy Center, said she’s deliberate in referring to the force as officers rather than school safety agents as many young people don’t realize that an agent in their school actually has the power to arrest them and use force. She said the NYPD has never disclosed how many school safety agents are assigned to each school or the way they are deployed, and that this is information the New York Civil Liberties Union has been trying to get for a long time. “The loose rule is that they have to have one officer for every entrance to the school, but we know that while that is the minimum, many high schools and middle schools have a dozen or more officers, and schools with metal detectors have the most officers,” Miller said. Styer said investments the city has made toward integrating school safety agents into the community appear to be working. Comparing the first three quarters of 2016-2017 with 2019-2020, arrests declined 60% and suspensions decreased 40%. The city intends to expand

On behalf of our clients, GT supported the MRTA’s robust social equity goals, overdue expansion of the state’s Medical Marijuana Program and thoughtful transition to adult-use. GT also served as Entergy’s counsel in the PSC (state Public Service Commission) proceeding to sell its retired nuclear generating facilities at the Indian Point site in Westchester County to a specialty decommissioning company. GT was a core part of a multiagency effort and was able to achieve a settlement agreement unanimously supported by all parties to the proceeding,
leading to the first-of-itskind in New York, prompt decommissioning plan for the site by the mid-2030s. The PSC chair lauded the settlement reached, stating he had never seen a better performance of a group of people in support of the public interest in his four decades of public service. Times Up leadership had some back and forth with Cuomo’s people over their response to sexual harassment allegations. Not a good look for an advocacy group dedicated to fighting wrongdoing by powerful men.

Hochul has effortlessly ascended to the governorship after the demise of the Cuomo dynasty, making history as the state’s first female governor. She is now building her staff with industry veterans as well as forming crucial partnerships with political players across the state like New York City Democratic mayoral nominee Eric Adams.

This should have been Bill de Blasio’s week – the apex of the Summer of Bill – as his nemesis ex-Gov. Andrew Cuomo officially fell from power, and the city completed its homecoming week with a Central Park bash. But in a way it’s not surprising that the universe rained on Bill’s parade, literally drenching the “We Love NYC” homecoming concert and sending attendees and performers home disappointed. The real loser here may have been Barry Manilow, whose set was interrupted by the abrupt cancellation.
