FOR PARENTS OF STUDENTS resuming classes this fall, the uncertainty has been deeply frustrating. Will lessons be conducted in school buildings, at home via remote learning or through some combination of the two? With the coronavirus risk especially high for large groups of people gathered inside for extended periods, will in-person learning be safe for students, not to mention teachers and other staffers? In the end, will teachers actually show up? And will school principals embrace outdoor learning – a last-minute option recently announced in New York City? In school districts where students are remaining at home for some or all of the week, working parents have also had to scramble to figure out how to care for their kids while continuing to do their jobs. While white-collar workers have to juggle schedules to muddle through, other employees who have to show up at their jobs in person – nurses, bus drivers, construction workers – have it even harder. In this week’s “Back to School” issue, Zach Williams takes a closer look at the challenges confronting working parents. The return to school during a pandemic is a fraught decision for families and school staff, so it doesn’t instill confidence that New York City left the task of checking school buildings’ ventilation until just two weeks before the planned start of classes. CITY COUNCIL REEXAMINES CHOKEHOLD LAW

Lawmakers in New York are considering amending a new law that criminalized the police use of chokeholds and made it illegal to compress someone’s diaphragm during the course of an arrest. The law was hailed by criminal justice reform advocates and was met with opposition from police officers. Although New York City Police Department officials have denied a work slowdown is taking place to protest this law and other perceived anti-police sentiment, data revealed cops were slower in getting to crime scenes and were making fewer arrests despite a sharp spike in shootings and violent crimes. It seems that the City Council members have noticed and plan to introduce legislation softening the law’s language, adding the word “recklessly” to the section about compressing someone’s diaphragm. It would also only make the act a crime if it causes “injury due to asphyxiation.” Mayor Bill de Blasio supported amending the law, while City Council Speaker Corey Johnson said the suggested

Riders now must complete a 21-question safety quiz and obtain a perfect score twice as well as watch a 30-minute training video before taking a scooter out for a spin. Revel will also continue to suspend service from midnight to 5 a.m. for another 60 days, though use during the rest of the day is once again permitted.

Why Reps. Stefanik and Zeldin spoke to the RNC In a largely virtual Republican National Convention that featured a number of high-profile Republicans and Trump loyalists, two New York Congress members took to the podium on the third night to praise the president. Reps. Elise Stefanik and Lee Zeldin represent a third of the GOP congressional delegation from a state that hasn’t voted for a Republican president since Ronald Reagan in 1984. President Donald Trump may be a resident of Florida now, but it’s clear he still has a soft spot for New York. While the latest poll shows Trump trails former Vice President Joe Biden by 31 points in New York, showcasing two rising stars from New York shows the Republican Party has support in even the most progressive states. And while Zeldin’s and Stefanik’s primetime speeches won’t flip the state, they may help rally Republicans in tough congressional races this year, like the challenge Zeldin himself is facing. 2020 is a sharp contrast to 2016, when many of New York’s prominent Republicans largely attempted to distance themselves from the man leading their ticket. But now New York Republicans – including relatively moderate ones like Stefanik – loudly and proudly support the president, appealing to bases in their districts that decisively backed Trump, often by double digits, in 2016.

The 2018 blue wave that flipped several congressional districts and the state Senate has left the state Republican Party bruised and on the defensive. Stefanik’s and Zeldin’s presence at the convention, speaking to an audience of millions, could help to rally that Trump-supporting base to turn out for down-ballot races in November. “I think seeing New York Republicans on a national stage would be a boost to the Republican Party in New York,” said Basil Smikle, a Democratic political consultant in New York. “I think it helps with the fundraising, I think it helps with their GOTV efforts.” However, Smikle doubted that their presence would have any lasting impacts on the party in the state. Republican consultant Bill O’Reilly said that, at this point, support for Trump won’t hurt any Republicans because it’s “already baked into the cake,” and that giving the two New York Republicans a national stage certainly serves as a reminder to their constituents that they have consequential elections coming up. Zeldin himself is facing a potentially tough challenge in November after winning by four points in 2018. His RNC speech seemed to reflect that, as he recounted how he spoke with Jared Kushner during the pandemic. “The very next day, President Donald Trump announced he was sending us 200,000 N95 masks.” – Rebecca C. A Q&A with Assembly Member

You’re running for Bronx borough president. How do you envision the role? To keep us united. The Bronx is in a place right now that looks like there is division. I’ve been one that has always – even before becoming an Assembly member – been able to communicate, relate and always find a solution together with any working partner. As an Assembly member I’ve done that, and in the time that the Bronx needs unifying leadership, I think I can be that person. If you won the race for borough president, you would be the first woman to hold the position.

How does that make you feel? For the Bronx, it would be the first time that a woman has had this office. For New York City, the first time that a Latina has held a borough-wide (position). I don’t want to say it’s overwhelming – it’s really exciting and an honor, you know, if I should win. And I believe I’ll win. We recently published a story about the many women currently running for public office in the Bronx and those who have won hardfought races against longtime incumbents. A lot of the women we spoke to mentioned that they did not feel

supported by the Bronx County’s Democratic Party. How has your experience been working with them? I would say I had a good relationship. If people know my history, they know that I was a staffer once for (City Council Member Mark) Gjonaj, and he was the insurgent. Really, my focus against all that was just doing the work that needed to be done. And that always came down to helping people. County has always been supportive of me and I think that’s because

they’ve always seen the good work that I’ve done. It’s been a good working relationship but there are times that I have disagreed with them. I know there’s always a discussion: “Are you with them or against them?” Like any working group, there are disagreements but we always reach a consensus and we’re always making a bridge. You mentioned Gjonaj, so I was curious as to how concerned you are that your ties to him and former IDC leader Jeff Klein may affect your

campaign, as candidates with less party affiliation continue to win more elections across the city? No, I don’t have any concern because I always push forward. I am my own candidate, I am my own person. I have my own views. I have my own goals. So, to tie me to those past things, I would say, look at my record, look at what I stood for and look at what I fought for. Look at me and know me as the worker that I am, the collaboration builder that I am, and take that into consideration when we look towards what the future of the Bronx needs and will be.

Part-time schooling. Jobs reopening. This year, child care gets even more absurd for working parents. By Zach Williams

UDY BECKFORD of Queens says parents are knocking at the door of Emmanuel Pentacostal Church every day looking for some salvation from a tricky child care situation. New York City is reopening schools part-time on Sept. 10, and more than a few working parents are hoping that the newly expanded child care program at the Central Brooklyn church will be able to watch their kids on the days when they are not going to school. “They’re essential workers,” Beckford said of the parents that are turning to the church for child care. “They’re home health aides. They work in nursing homes. They work in hospitals.” In other words, they have to go to work in-person, and that is making their stress levels skyrocket, according to Beckford, who volunteers at the church in Flatbush. Parents across the city do not even know yet when and where their children will attend classes. “They’re so anxious right now,” adds Beckford, who will also be keeping an eye this fall on two granddaughters as their mother heads to work as a medical assistant. “On a scale of 1 to 10, I can tell you, most parents are at a 9 to 11.” Reopening schools only part time, without federal aid, amid the ongoing dangers of the coronavirus is making some New York City parents tear their hair out. Fresh outbreaks have happened in areas of the country where schools reopened full time, such as school districts in Georgia and Missis-

sippi. Districts in other major cities, including Los Angeles and Chicago, have opted to start the year without in-person learning, but New York City Mayor Bill de Blasio and the city Department of Education are trying to find some middle ground by having kids return to classrooms half the time. The success of school reopening depends to a huge degree on parents’ ability to work around an academic schedule that has kids in schools on some days and learning at home on others. That is no easy task when many New Yorkers in essential jobs or blue-collar occupations that have gone back to work during reopening – waiters, sales clerks, construction workers – cannot stay home with their kids on their remote-learning days. The benefits of in-person learning are substantial compared to the online learning model quickly deployed during the early weeks of the pandemic. Research shows that children learn best in a classroom environment and that their social skills improve when they are around their peers. Schools also play a key role in the city network of social services that provide food assistance, mental health and child welfare services in a school system in which more than 70% of students qualify for free or reduced lunch, based on their family’s income. (New York City currently serves free lunch to all students regardless of need.) Many students could not access virtual learning this past semester because they lacked internet services or devices at home. “We have a choice, and the choice was: Do you have children in a school where they can get the support of educators? Where they can have a positive adult presence in their life, the mentorship, the tutoring, the guidance, the mental health support, the physical health support, the food?” de Blasio told reporters on Aug. 25. While teachers, elected officials and parents have criticized the city’s approach to reopening, hundreds of thousands of

families are nonetheless sending their kids back to school in mid-September. “I tell everybody: ‘Can we stop with the conversations about not opening the schools?’” said Adriana Aviles, a retired mother of three who serves as president of her local parent teacher association in Bayside, Queens. “The mayor is going to open them whether we like it or not, and I don't agree with it, but we have to get ready.” That is one reason why she has her three children wear masks for six hours every other day so that they know they can endure classrooms in the new normal where students will have to follow strict hygiene standards. The economy, like parenting, tends to thrive on consistency. Reopening schools, however, includes a litany of variables. Roughly 700,000 children are heading back into classrooms this month, according to the Department of Education. Another 300,000 are attending virtual classes full time. Any outbreaks of the coronavirus could quickly scramble the equation as more teachers and students head back home. Some already have, as organized labor continues to push for a delay to the beginning of the school year out of safety concerns. Union leaders have even threatened to strike, a violation of state law, unless the de Blasio administration agrees to meet their demands for expanded coronavirus testing in the school system. This leaves working parents’ own working plans on hold. While some have the flexibility to still work from home moving forward, that does not mean they can tend to their careers and oversee their children’s virtual learning at the same time. “I'm going to have to work my schedule around my children,” said Sonia Arora, who works as a reiki healer. “My husband also works, and he cannot help me with the child care, because there's no way that he can take the time off during his workday to help with the kids.” For parents who cannot stay at home, or lack a parent or friend who can watch their kids, their only choice is to find child care

services. Wealthier parents may hire tutors or nannies, assuming they aren’t afraid of exposure to the coronavirus. Many less affluent parents, however, are stuck improvising. With no family and a modest salary, social worker Carolyne Odada, who can work from home three days a week, says her daughter could have to spend two days per week at her side as she commutes from Harlem to Brooklyn to help manage a clinic for people living with H.I.V. Not only does that mean her daughter will be at greater risk of contracting the coronavirus, it is hardly the type of middle school experience she wanted for her daughter when she immigrated from Kenya five years ago. “It is never easy in New York City,” says Odada, who is hoping that some type of city-supported child care might come to her rescue as she waits for her daughter’s school to announce its schedule. The mayor has vowed to make 100,000 revolving slots available for the children of working parents at “learning labs” run by community-based organizations across the city. The idea is that students would go to these community centers run by nonprofits, which would provide supervision and assistance while students do their online learning on days when they are not in school. Many of these organizations already have experience providing child care on behalf of the city during the pandemic, through the city’s efforts to help essential workers in recent months. Yet, officials at some of these nonprofits say they have yet to receive the final details from the city about when and where Parents have to jump through hoops in Mayor Bill de Blasio and schools Chancellor Richard Carranza’s plan.

their services will be needed this fall. “We're trying to be very flexible with our families,” said Willing Chin-Ma, deputy executive director of the nonprofit Grand Street Settlement, which expects to serve more than 1,000 children in lower Manhattan this year. Organizations are also waiting for crucial guidance on staffing. Monthslong delays with background checks are another example of where city planning falls short of effective execution, according to Mary Cheng, the director of childhood development services of the Chinese American Planning Council, one of many nonprofits involved in the effort. “I do think it might work,” she said of learning labs. “You can't hire (staff) before those clearances come back because it's unsafe for the kids. But if you're not getting (background checks) back to us in a timely fashion, how do we run the program successfully?” Some parents, however, have children with unique health care challenges that require them to stay at home until the pandemic subsides. “I don't think that they have the capabilities of keeping the (school) environment as safe,” said Carmen Andino, a private school teacher and Little Neck, Queens resident, whose son has respiratory issues. “I'm going to be definitely depending on my mom to be stepping in – and being grandma and teacher – all at the same time.” She said she would also be able to use paid family leave to take some time off from her job at a reduced salary. Other parents could be in the same position if and when any positive cases of the coronavirus require individual classes, or

even schools, to quarantine for two weeks. Wider outbreaks could make schools do the same. A systemwide infection rate that exceeds 3% could end the whole reopening effort this year, and working parents across the city would have to once again figure out what to do about their kids. Compounding the worries for parents is how the coronavirus might spread through classrooms and day cares once school starts. One recent study suggests New York City has some of the lowest levels of transmission among children, the fastest growing demographic for cases nationwide, but some parents worry there will be slip-ups among students, teachers and staff with adhering to public health guidelines. That would be a worst case scenario under a city government that appears committed to continuing in-person learning at some level moving forward. “Even if it is two days a week, three days a week, even one day a week helps,” de Blasio told reporters at an Aug. 25 press conference. “Remote learning just can't do for a kid what in-person learning can do.” If the mayor and the city Education Department succeed in their effort to open schools and keep them open for the coming months, then New York City will become the largest U.S. city to successfully reopen schools in the pandemic. But if they fail, working parents could be left with the mess they leave behind – and that would mean New Yorkers’ nascent comeback from the pandemic will end before it even really gets started.

The rural school district in the North Country has proposed different approaches for students in various grades. Students in pre-K or kindergarten would come to school four days a week but only for half the day. Children between first and fifth would come in the same number of days but for the full class time. All other students in higher grades could participate in hybrid learning, with two consecutive days in person.

SYRACUSE CITY SCHOOL DISTRICT

Syracuse had planned to have students in eighth grade and under engaged in hybrid learning: two days in person and three days remote, with schools closed on Wednesdays to allow for “deep cleaning and sanitation.” But the district backpedaled on those plans and will go remote until October.

PLENTY OF FOCUS has been dedicated to plans for reopening schools safely in New York City, which operates the largest school system in the country. But school districts throughout the state have been faced with similar challenges and have proposed myriad approaches to education this year. Most of the plans are still being vetted by parents and officials, but here are some of the different suggestions districts throughout New York have put forward.

LAFAYETTE CENTRAL SCHOOL DISTRICT

BUFFALO CITY SCHOOL DISTRICT

Buffalo – home to the state’s second-largest school district – has decided to go remote for the start of the school year. It had initially proposed a hybrid learning model that would’ve had students attend in-person classes on Monday, Wednesday and Friday one week, and switch to classes on Tuesday and Thursday the next week. The state also rejected school officials’ request to delay the start of classes into October.

The smaller school district in Onondaga County had been aiming to have all students from pre-K through high school back for in-person learning, five days a week – depending on the availability of transportation and staffing. But it would start phasing students back in through a mixture of inperson and remote learning in September before considering that next step.

ROCHESTER CITY SCHOOL DISTRICT

After the Rochester Teachers Association pushed back against plans to implement hybrid learning, the school district will now go fully remote for at least the first 10 weeks of school. It had initially planned for a mix of in-person and remote learning for students in pre-K through fourth grade, while all older students would be remote.

NEW ROCHELLE CITY SCHOOL DISTRICT

All students enrolled in New Rochelle public schools will be attending remotely – at least through September, after which local school officials may reevaluate and consider a hybrid model. The district has committed to give Chromebooks to all students, and may offer exemptions for in-person learning for special education students, students learning English and families with child care issues.

THREE VILLAGE CENTRAL SCHOOL DISTRICT

School officials initially proposed in-person classes for students every day, and while masks were “strongly encouraged,” they were not required. Parents in the Suffolk County school district immediately pushed back over health concerns. Now, a remote learning option will be available and masks will be required.

OTHING ABOUT remote education during the pandemic has proven easy – for students, teachers or parents. But for New York City and state residents who lack reliable, accessible or affordable internet service, remote learning was incredibly difficult. Now, even as some school districts finalize plans to send students back to the classroom for at least part of the time, families are grappling with the fact that online classes will continue for many students this fall. While districts across the state have cobbled together short-term solutions to get all of their students connected to the internet, most of those plans fell short this spring, driving a wedge between the kids who had reliable access to a computer and high-speed internet, and those who did not. They may have had to share devices with their siblings, rely on a slower connection via Wi-Fi hot spots or cell service, or even receive instruction through paper packets distributed by the school. And though districts are still working to get devices like iPads or Wi-Fi hot spots in the hands of kids who need them, some parents and advocates have doubts that remote learning will run any smoother this fall. “We’re starting out no better off than we were last March, despite everybody talking about the problem, and the governor saying, ‘Well, we can do this now. We’ve shown that we can operate from home and we ought to be expanding that,’” said David Little, executive director of the Rural Schools Association of New York State. The state reported that 98% of residents and businesses in New York have broadband internet service, but high-speed internet access is harder to come by in rural parts of the state. The Federal Communications Commission reported that 87.1% of rural New York has broadband coverage –

though many take issue with that calculation because the commission counted a census block as “covered” if even just one household had broadband access. And while the existence of high-speed internet infrastructure isn’t lacking as much in New York City, high prices mean that roughly 1.5 million New Yorkers don’t have a home or mobile broadband connection. A 2019 report from New York City By Annie Comptroller McDonough Scott Stringer’s office found that about 44% of city residents in poverty lacked broadband access, and nearly one-third of Hispanic and Black New Yorkers lacked access, compared to about 20% of white residents. For the students who are more likely to lack access to the tools needed for remote learning – including Black and Hispanic students, low-income families and students in rural parts of the state – another year of at least partially remote learning means the risk of falling even further behind. Of the roughly 337,000 students in New York City who have opted for fulltime remote learning as of Aug. 24, about 37% are Hispanic, 20% are Black and 11% are white, though those numbers could change since students can opt for full-time remote learning at any point. Hispanic students make up roughly 41% of all public school students, Black students account for roughly 22% and white students account for 16%. As Chalkbeat New York reports, the data shows that New York City is mirroring a national trend of families of color being more skeptical of the return to the classroom. “We know from a poll that we just did that two-thirds of Black, Latinx and low-income families will likely rely on remote learning,” said Dia Bryant, deputy director at The Education Trust–New York, an advocacy group that focuses on low-income students and students of color. There were already achievement gaps in New York schools that leave students of color less likely to graduate from high school in four years. Only 73% of students of color who started high school in 2012 graduated in four years, compared to 89% of white students, according to the state Education Department. “Knowing the gaps that existed before the pandemic and thinking about that now, if we don’t have remote learning right … these children actually stand to lose

(the most),” Bryant said. Here’s the problem: Getting remote learning “right” means correcting the long-standing digital divide that exists in New York – and across America. That divide can’t be fully or equitably bridged by the short-term remote learning solutions that districts have come up with so far. As Little said, “Providing internet access is not the business of a school district. It’s not what they do.” That doesn’t mean those districts aren’t trying. The New York City Department of

net-enabled iPads with hot spots that allow up to five devices to connect to them, and accelerated broadband citywide,” Danielle Filson, a city Education Department spokesperson, wrote in an email. (The last example refers to a commitment by Mayor Bill de Blasio in July to extend free or lowcost broadband service to 600,000 New Yorkers over the next year and a half.) It took weeks for some students to initially get their hands on those devices in the spring. The department prioritized distribution for students in homeless shelters. Even though some lauded that effort – which cost the department more than $269 million – it failed to put all students on an even playing field. “We know that there’s been hiccups along the way, and we know that the city has done an enormous amount of work and effort to place equipment and technology in the hands of households and families that need it most,” said Raysa Rodriguez, associate executive director for policy and advocacy at the Citizens’ Committee for Children of New York, a child advocacy group. “But we also know that distance learning didn’t work equally for all.” Some students also lacked adequate cellular service to take advantage of the LTE internet connection on the iPads. “We heard about some students who were not able to connect at all and other students who were able to connect but the connection was very slow,” said Randi Levine, policy director at Advocates for Children of New York, an education advocacy group that works primarily with low-income families. “Unfortunately, if it takes you 20 minutes to download a three-minute video lesson, you might give up.” Rodriguez also said the primary way for parents to request a device in the spring was through an online survey on the department’s website – something that some families weren’t able to do if they lacked internet access or a connected device. “We rely too heavily on gathering information from families via surveys and other approaches that require equal access to the internet as well as the digital literacy skills to be able to engage in those approaches,” she said. There’s very little data available to determine just how many students remote learning failed to reach in the spring. The city reported that between April 6 and June 19, the daily average “interaction rate” for remote learning was 87%. But parents and teachers have criticized that statistic, noting that an interaction could be a student logging into a virtual classroom and walking away from the computer or even a parent sending an email to the teacher. Other school districts in the state have tried to connect students to the inter-

net, handing out school-owned devices or purchasing new ones for students to use at home. Some districts also sent out mobile Wi-Fi hot spots along with a tablet or Chromebook, so that the device could be connected to the internet. But because rural parts of the state lack not just affordable internet, but any internet connection at all, school districts sometimes had to get more creative. “What we saw a tremendous amount of during the winter and spring was hot spots – cars parked in school parking lots with parents and kids, so that the kids could access the school’s internet,” Little said. Hospitals were giving out their Wi-Fi passwords so students could sit in their parking lots too, he said. These solutions, of course, won’t work for everyone. Relying on Wi-Fi hot spots in hospital or other parking lots requires a student to drive or be driven to that lot by a parent. As one July New York Times editorial put it: “Doing schoolwork in the parking lot is not a solution.” Other times, a student might use his or her cellphone as a Wi-Fi hot spot, which can provide a much slower connection than high-speed broadband. When no tech solutions worked, school districts sent paper packets to students. Sometimes, the packets would be delivered on a bus, along with a student’s school lunch for the day. “The bus would drop off a meal and a packet of infor-

mation,” Little said. “We don’t have any long-term or even short-term data on the amount of learning loss that took place over that time period.” In these cases, students might not have any face-to-face contact with a teacher or peers during the day. Some students did benefit from free broadband service offers from providers that included Charter Communications, Verizon Communications and Altice USA. Those companies offered a few months of free service to families with K-12 or college students, giving high-speed internet to some families who otherwise wouldn’t have been able to afford it. But that fix was always going to be temporary. On this front, students may actually be worse off ahead of the fall semester than they were in the spring. Those companies have so far not extended their offers of free broadband service, despite pressure from public officials to do so, though some companies offer reduced rates for qualifying low-income families. “We need broadband companies to donate statewide and get out of the profit-making business during this period and make broadband free for every family that has distance learning and every school,” state Sen. Shelley Mayer, who chairs the Education Committee, said during a City & State webinar this month. “This idea that you’re going to charge now in the middle of this pandemic, even a re-

duced fee, is ridiculous. This is a moment to do the patriotic thing and ensure everyone has broadband.” After the hardship that students experienced in the spring, the same students will likely be facing the same challenges this fall, with little changing in what options students have to get connected. Like last year, New York City will loan students with internet-enabled iPads if they don’t already have internet access. De Blasio said he will accelerate his Internet Master Plan, a $2.1 billion program announced in January to achieve universal broadband access. In July, de Blasio said the city will accelerate that plan and spend $157 million to expand broadband internet access to 600,000 New Yorkers – including 200,000 public housing residents – over the next year and a half. But even if it is completed in that time, New Yorkers will be unlikely to see any results from those efforts this year. New York City also announced it will have the capacity to supervise 100,000 students this year at “learning labs,” a child care program that will supervise young children of working parents at places like libraries. The program would also have the added benefit of providing a place to work for students without internet access. Rodriguez said spots in the program should be prioritized for students living in homeless shelters or

temporary housing, but there are few details on how those learning labs will work or who will have access to them. City Hall did not respond to a request for comment about how the child care program will work. For school districts in the state that will be operating remotely at least part time this fall, little has changed for their disconnected students. For the most part, school districts will rely on the same short-term solutions – handing out Chromebooks and Wi-Fi hot spots, for example – that fell short for some students in the spring. Rochester City School District, which will be remote for the first 10 weeks of classes, will distribute laptops and personal Wi-Fi hot spots, but county legislators have objected to that solution, saying the connection offered by hot spots is too slow. At Yonkers Public Schools, which recently delayed plans for in-person instruction until October, officials have acknowledged that paper packets may need to be distributed to students who don’t have the necessary technology or internet access. The summer has afforded some schools more time to purchase devices for their students. Mark Davey, district superintendent at the Champlain Valley Board of Cooperative Educational Services, told City & State that North Country districts were able to purchase additional laptops and Chromebooks in preparation for the fall. New York state has largely left these decisions up to individual school districts. The state Education Department’s reopening guidance required individual districts to determine the level of internet access

that students and teachers have at home, and address that need “to the extent practicable” and provide information technology support to students, parents and staff. Little, the executive director of the Rural Schools Association of New York State, said that as schools face 20% cuts in state aid, the task of equipping all students with the means to access remote learning can’t fall on school districts alone. Gov. Andrew Cuomo convened a Reimagine Education Advisory Council in the spring to come up with innovative ways to incorporate technology in education, while the state Education Department’s reopening task force studied the issues posed by remote learning. “Everybody came to the same conclusion: ‘Damn, we better get some internet access out to kids that don’t have it,” Little said. “But it doesn’t happen overnight, and when the state doesn’t have any resources to put behind that effort, all they can really do is double down on the threats they’ve made to providers who have proven beyond a shadow of a doubt that this is no emergency for them.” Cuomo also recently approved $94 million in school technology upgrades through the Smart Schools Bond Act, a $2 billion initiative that was approved in 2014 to invest in classroom technology and broadband connectivity. But that program existed before the pandemic and doesn’t represent a new source of funding. There’s not much debate that in 2020 – and during the pandemic especially – internet access is a necessity. In part because of the challenges many students faced with remote learning, some state lawmakers said

they support regulating broadband like a public utility – a move that could hold internet providers accountable for expanding service to where it’s needed most. “I think broadband is going to remain a problem unless we find ways to significantly subsidize it, or make it a standard utility,” said Bryant, of The Education Trust–New York. State Sen. Jen Metzger and Assembly Member Sean Ryan – sponsors of a recently passed bill that would require the Public Service Commission to conduct a detailed study of broadband availability in the state – have both expressed interest in treating broadband like a public utility. Last year, Cuomo vetoed a bill that would have studied the feasibility of a stateowned and operated internet service in New York, saying that it was “well-intentioned” but too expensive to complete. In the meantime, state and local governments can subsidize the expansion of broadband service – as de Blasio plans to do – but the results of those efforts likely won’t offer immediate benefits to help students with online classes this year. Not to mention the fact that state and local governments, facing major budget deficits, will be unlikely to make a huge investment in that effort anytime soon. Bryant, however, remained hopeful that if lawmakers commit to creating equal access to education for students on the margins, universal internet access will eventually be a part of that solution. “I think that if students (from) Black, Latinx and low-income families become a priority in the way we’re thinking about policies, there’s no way that it can’t,” Bryant said. “To not give access is a disservice.”

Planning for school in a pandemic is hard, but mistakes with special education can have dire consequences. By Rebecca C. Lewis

CHOOL IN NEW YORK CITY is set to start on Sept. 10., but teachers and city officials are still feuding over reopening plans, and in-person learning arrangements are being determined in real time. And that’s just for students in general education classes. Accommodations for students with disabilities will be even more complicated, with even greater risk of educational loss. The switch to remote learning in the spring to stem the spread of the coronavirus had a particularly adverse impact on the city’s 200,000 special education students, whose related services and educational needs did not always translate well, or at all, to remote learning. As the school year fast approaches, figuring out how best to implement safe and effective education is paramount, but the need to get it right is even more dire for those receiving special education – and advocates say that the city could be doing more to ensure those kids are getting all the services they need. The state’s reopening guidelines require that local school districts take into account the individual and specific needs of special education students when coming up with their plans for the fall, whether in-person, online or both. When New York City released its plan for reopening, guidance on special education was slim. The plan provides for two additional potential schedules for District 75 schools – which exclusively serve special education students. Parents can choose to opt into those schedules instead of all-remote or blended options. One permits students to attend in-person class

five days a week every other week, while the other would allow certain qualifying students to attend in-person schooling completely full time, although this would not be an option for every special education student. But aside from those extra models, information about how services would be provided adequately and remotely lacked the specifics that many parents want. Danielle Filson, a spokesperson for the city Department of Education, said in a statement that the city would be “sharing additional special education guidance and safety protocols for the upcoming school year soon.” Maggie Moroff, the special education policy coordinator with the group Advocates for Children of New York, said that the city could be doing more. “It’s an outline of a plan,” Moroff said. “The concern is that there is just so much that nobody knows yet.” She said this is especially complicated for parents of special education students when it comes to scheduling services like occupational therapy. Her group recently released a series of recommendations, including a request for information about student transportation, multiple options for in-person related services, assurance that all students have the technology needed for remote learning and small-group support for students struggling to read on days they are remote. “That literacy part is really key,” Moroff said. “Especially for the kids that are in the emergent reading years, if they were already struggling to learn how to read, this has wreaked havoc on their lives.” The Department of Education says it is currently exploring ways to expand literacy programs, using teachers trained to

New York colleges have more out-ofstate students than anywhere. Will reopening be a disaster?

LENTY OF FACTORS drove Lucy Kuhn to return to Vassar College. Not going would have meant losing her work-study job on campus, which she could only offset by working at a grocery store or in retail in her home state of Kansas. As a chemistry major, in-person classes would be a major part of her education. And with cases on the rise in Kansas, New York generally seemed like a safer place to isolate, even with the influx of students coming to campus. She followed all of Vassar’s safety precautions. After testing negative before leaving home, she and her parents began driving to Poughkeepsie, New York, on Aug. 13 and arrived on campus two days later. She was tested again and settled into her on-campus apartment, where she was prepared to abide by New York’s mandated 14-day quarantine well before classes were set to begin at the end of August. Within a day, she found out she tested positive for COVID-19. “I think if any college can successfully be on campus, it’s Vassar,” Kuhn, who was staying in isolation housing without exhibiting symptoms, told City & State. “But I don’t necessarily know if any college is going to be successful on campus.” New York attracts more out-of-state college students than any other state. While usually a point of pride, that statistic now presents immense challenges for the colleges and universities that are attempting to bring students back to campus. Though

New York’s coronavirus infection rate has remained low, an influx of students from around the country could lead to a spike in cases. Outbreaks at the University of Notre Dame and the University of North Carolina at Chapel Hill – which have since canceled in-person classes – have prompted others to follow suit in transitioning to online classes. Ithaca College and Columbia University were among the New Yorkbased institutions that decided to cancel in-person learning in mid-August. The state mandated a 14-day quarantine for all travelers, including students, from a growing list of 31 states and U.S. territories to mitigate the spread of the virus. About 60,000 of the 140,000 out-of-state students that attend private colleges in New York would be subject to the quarantine according to an estimate by Mary Beth Labate, president of the Commission on Independent Colleges and Universities. It also presents logistical challenges for students and their families, who have to plan to come in earlier and pay for housing

to abide by the quarantine. Administrators are also trying to figure out how much financial support they should give students to help them quarantine. Cornell University, for example, initially planned to give students space to isolate and offer them meals. But as the list of quarantine states expanded, Cornell University President Martha Pollack told The Ithaca Voice in early August, it became clear they lacked the space to do so. “We would have ended up putting them in hotel rooms as far away as Syracuse and Binghamton, and that was not safe,” she told the news site. “I wasn’t going to put 17-year-olds away from home for the first time in a hotel room hours away.” Now, students who must quarantine have been scrambling to book hotel rooms and Airbnbs, or they are being pushed to learn remotely. The quarantine requirements also forced Ithaca College to initially require students from high-risk states to attend classes virtually.

AFTER TESTING NEGATIVE, SHE ARRIVED ON CAMPUS. … WITHIN A DAY, SHE FOUND OUT SHE TESTED POSITIVE FOR COVID-19. pus comes down to providing all students a rapid test every two to three days. “We acknowledge that regularly testing all students sets a very high bar – logistically, financially and behaviorally – and that that might be beyond the capacity of many universities and the students in their care,” the researchers wrote for CNN. “But in the absence of regular testing, the consequences of an outbreak might be deadly.”

Vassar College President Elizabeth Bradley has said frequent testing isn’t the only effective strategy to keep cases low. In addition to requiring testing upon arrival and a mandatory quarantine period for all students, Vassar is largely banning students from going off campus and preventing outsiders from entering. Access to dorms and academic buildings will be limited to students and employees. But otherwise, the policy relies on students to follow the rules. In a scenario where a student accrues multiple or serious violations, that person may be told to leave campus and continue the semester remotely. Bradley credited New York’s overall success in keeping cases down and the state’s policies for making reopening a safer process. “Lastly, we have some characteristics that we hope will help us manage the crisis,” she said in a statement. “For example, we are a 1,000-acre campus with only about 2,000 students on campus this semester. That alone puts us in a different position than other larger schools that are located in a more metropolitan setting.” Some students are certainly feeling apprehensive about the fall semester. Itamar Ben-Porath, a senior at Vassar, has already seen Facebook posts about students leaving campus and others with students not wearing masks. “My biggest source of hope – and it’s a grim one – is that they said they would close the school once case rates hit about 5% of the campus testing positive.”

“We had made the decision to not allow students from restricted states to come to campus, since we did not have the space or other resources to quarantine such a large number either on campus or off campus in the community,” Dave Maley, a spokesperson for Ithaca College, wrote in an email. “Of course, once we made the decision to go virtual that issue became moot.” Higher education institutions also have to grapple with how strictly they enforce the quarantine for students. “We don’t want to be so draconian that students will be tempted to break it,” Labate said, noting that the responsibility ultimately came down to students. The question of enforcement also applies to numerous other health and safety guidelines, such as wearing masks and preventing large gatherings. Parties on and off campus at various colleges have driven several outbreaks of coronavirus cases. Students at Syracuse University, a school with a reputation for partying, already began to break the school’s rules prohibiting large gatherings, congregating on the quad without wearing masks or abiding by guidance to maintain distance from each other. School officials ended up suspending 23 students before classes began for participating in the gathering. Even with the many plans colleges and universities have put forward, some research indicates it may not be enough. One study found that the way to manage the spread of the coronavirus on cam-

So instead of beer and grilling, the focus may actually be on labor, thanks to the threat of a wildcat strike by the United Federation of Teachers and the successful strikes by NBA players and other pro athletes.
