LAST MONTH, two top education officials were installed in New York. Betty Rosa, previously the state Board of Regents chancellor, was appointed state education commissioner. Days later, Jim Malatras, an ally of Gov. Andrew Cuomo, was named chancellor of the State University of New York, the state’s public university system. Neither Rosa nor Malatras were hired as the result of a nationwide search, with officials citing the need to fill the posts quickly due to the unprecedented challenges posed by the coronavirus pandemic. Yet unlike Rosa, Malatras’ hiring raised eyebrows. One factor was their differing qualifications – Rosa, 68, has advanced degrees in education administration, while the 42-year-old Malatras studied political science and has a more policy-oriented background. Another factor was race: Amid renewed attention to the lack of diversity in leadership positions, not least of all in academia, SUNY nonetheless elevated a white man without considering any candidates of color. And while Rosa is interim commissioner, there’s no such limitation on Malatras, who told City & State he hopes to run SUNY “for a long, long time.” Finally, Rosa has a history of opposing Cuomo on standardized testing and funding, while Malatras made his mark moving up in the governor’s orbit, raising questions as to whether he’ll fundamentally be serving the SUNY community – or the boss who handed him the role of a lifetime.

Protests have continued in Rochester after police body camera video was released of Daniel Prude’s arrest in March, which led to his death a week later. State Attorney General Letitia James announced that she will empanel a grand jury to consider evidence

in the case of Prude’s death after Rochester police for months treated it as a drug overdose rather than a homicide as the medical examiner determined. James’ office had already begun investigating the incident well before the grand jury announcement. Soon after that, Rochester Police Chief La’Ron Singletary and the rest of the command staff
announced they were retiring. Singletary denied any wrongdoing by the officers involved in Prude’s death, who have been suspended, and said he would not sit “idly” as people attempted to “destroy my character.” When she announced the retirements, Rochester Mayor Lovely Warren did not say whether she asked them to resign. Meanwhile, protesters have marched every night since Prude’s family released the body camera footage. Two protesters are now facing federal charges after being accused of attacking police officers.

AND COUNTING On May 24, The New York Times previewed a haunting benchmark in the coronavirus pandemic, filling the entire front page of its Sunday paper with short obituaries of some of the nearly 100,000 people killed by the virus in the U.S. Four months later, Time magazine tells the same devastating story on its cover, as the country passes 200,000 deaths from COVID-19. decided to relocate 300 homeless men from the Lucerne Hotel on West 79th Street to midtown Manhattan. The men had been moved to the hotel to help alleviate crowding at homeless shelters, where coronavirus outbreaks were a large concern, and provide the men with a safer alternative. Like many hotels that are being used to temporarily house homeless people, it was empty due to a lack of tourists during the pandemic. However, the decision to house the homeless men in the neighborhood led members of a neighborhood typically considered one of New York City’s most liberal to threaten to sue the city. Although de Blasio said conditions at the hotel were not up to snuff, advocates for homeless people and Upper West Side lawmakers lambasted the mayor for apparently giving in to NIMBYism.
2021 ELECTION MOVES
There’s still plenty of time before the 2021 New York City election cycle truly ramps up, but several candidates have begun making their moves. City Comptroller Scott Stringer made his run for mayor official, launching his campaign with a slew of support from lawmakers, including progressives like state Sen. Julia Salazar and Assembly Member Yuh-Line Niou. Stringer will try to establish

himself in the ever-growing pack of candidates as the progressive choice with a multiracial coalition behind him. City Sanitation Commissioner Kathryn Garcia, de Blasio’s go-to problem solver, announced she’s resigning from the administration. Although she said her decision was due to recent budget cuts, Garcia is also considering a run for mayor herself, so the resignation could be a sign that she’s getting more serious. Tiffany Cabán, who made headlines last year when she almost won the Queens district attorney race and has since become something of a progressive celebrity, also announced that she is running for City Council in Astoria, Queens.
INDOOR DINING TO RESUME IN NYC
At long last, struggling restaurateurs in New York City have been thrown a lifeline by Gov. Andrew Cuomo when he announced that he would allow eateries to reopen for indoor dining

on Sept. 30. Until now, Cuomo and New York City Mayor Bill de Blasio have resisted permitting indoor dining, even though it has been allowed in the rest of the state for weeks – if not months – without causing a spike in coronavirus cases. The city has long met the necessary criteria that theoretically should have allowed for limited indoor dining. Both officials argued that the city is different from other areas in New York, and therefore indoor dining posed a greater risk. Just the day before his announcement, Cuomo said it would be “negligent and reckless” to allow indoor dining in New York City before ensuring compliance mechanisms were in place. However, he posed a theoretical situation where city restaurants would be allowed to open with 25% capacity, half that of the rest of the state. The next day, that hypothetical became reality when he announced the city’s indoor dining plan.

Can NY learn from 9/11 on COVID-19 disability benefits? Four years after the terrorist attacks on Sept. 11, 2001, New York state finally passed legislation ensuring that first responders who developed certain illnesses were presumed to have contracted those illnesses on the job, and made those civil servants eligible for accidental disability retirement benefits. New York passed a similar bill this May, establishing a presumption that any public worker who died from the coronavirus was presumed to have contracted the virus on the job, and was made eligible for line-of-duty death benefits. But the state has yet to extend the same presumption for accidental disability benefits. As the coronavirus pandemic wears on, reports persist of COVID19 “long haulers” who experience life-altering symptoms for months after testing negative for the virus, including extreme fatigue, short-term memory loss and difficulty breathing. Now, some public sector union leaders are calling for legislation that will extend disability or workers compensation benefits to the essential workers who contracted COVID-19 on the job and may still be dealing with its devastating symptoms for months or years to come. “I’ve had some people that I’ve known that got COVID, and now they’re supposed to be over COVID, but you can tell

they’re still not fully over it,” said Shaun Francois, president of the city’s public sector employees union, District Council 37, and of the New York City Board of Education Employees Local 372. “Whatever they can do to start the process,” he said, of extending disability benefits, “I think the earlier the better.” State Sen. Andrew Gounardes and Assembly Member Peter Abbate, who sponsored May’s line-of-duty death benefits legislation, have both expressed interest in extending accidental disability benefits to public employees who contracted COVID-19, but neither was firm on how that would be done or what such a bill would look like. Abbate sponsored the 2005 legislation, but he noted that part of the reason it took so long for that to pass – and the reason it has been amended several times over the years – is because it took a while to understand the extent of illnesses that could be caused by exposure at the World Trade Center. “For years after, we had to add diseases to it, we had to add people to it,” Abbate said of the 2005 bill. With new and mysterious symptoms of COVID-19 seeming to crop up every day, Abbate said that he wanted to take time to get a coronavirus disability benefits bill right. “The idea is to get it right the first time.” – Annie McDonough

One local developer and reality TV star has been accused of sexual assault by more than 20 women. He was even recorded boasting about committing these crimes, but he still hasn’t faced charges.

A Q&A with New York City Council candidate

What inspired you to run for New York City Council? I’ve been contemplating running for a little while, but I think really what instilled a sense of urgency in me to announce and to run for this cycle in particular has been the pandemic and the Black Lives Matter protests. In particular, I lost a friend and mentor in Lorena Borjas. And she served as a major inspiration to me. She provided most of the clients that I represented in my legal work, and she was a real mother to the trans Latinx community. You’re running for the seat held by Laurie Cumbo, who was
integral to getting this year’s budget passed. She has been a vocal critic of the defund the police movement and the Democratic Socialists of America as not representing the desires of her constituents. How does that play into your race? She was elected with a ton of real estate money in 2013, and so it’s kind of hypocritical for her to say, well, these are gentrifiers when these are lifelong residents of New York City who have deeply held beliefs about how the police should be run and how they should be held accountable. My approach will be to welcome
community groups. I really want to keep my office door open for any groups that want to say their piece, rather than have an antagonistic relationship. I think that the ramifications of the budget vote where she got $16 million for her constituents and other City Council members who, like Carlos Menchaca, voted their conscience and really wanted to see meaningful reform, they got no money for their constituents. They were cut. I think that kind of hardball tactics, that’s the kind of dark side of politics that really needs to end.

You could become the first trans person, let alone trans person of color, to be elected to the City Council. What does that potentially historic aspect of your campaign mean to you? One of the things that I’ve experienced throughout my career and my life as being a trans Latina lawyer means being the first in a lot of things. I was the first openly trans community board member here in Brooklyn. But also just in my day-to-day work, it was not uncommon when I was working with my clients for them to tell me, “You’re the
first trans lawyer I’ve ever even met.” It’s always been important to me to keep that in mind. But at the end of the day, being the first in something isn’t the kind of end goal in and of itself. It’s to have meaningful representation and to also uplift the overall community. I don’t want to be known just as the trans candidate. But at the same time, this is the home of Stonewall. We’ve been here now 50-plus years, and we have never elected a trans person, let alone in New York City, but also New York state. And so I think that says something that it’s really time to elect a trans person.

Despite a seismic cultural shift, progressive rock stars aren’t abandoning the white guy running for mayor.
N THE SUMMER of 2019, two younger progressive legislators of color, state Sen. Jessica Ramos and Assembly Member Yuh-Line Niou, endorsed New York City Comptroller Scott Stringer for mayor in 2021. “He’s clearly walking the walk” on promoting racial and gender diversity, Niou told City & State at the time. Conversations around race, inclusion and political representation have only been elevated in the year since, thanks in part to the protests following the killing of George Floyd by Minneapolis police, and also a Democratic presidential primary that elevated a white, male political lifer in former Vice President Joe Biden out of a historically diverse field. So the big news at Stringer’s official campaign launch press conference on Sept. 8 wasn’t so much that Ramos, Niou, and other progressive political allies endorsed his run, but that so many of them are sticking with him, a 60-year-old white man, and endorsing early in the race, despite the political moment. “I’m willing to look past identity politics, in this moment,” said Amanda Septimo, who endorsed Stringer on Sept. 8 and is on her way to winning an Assembly seat. “I’m a young woman of color from the South Bronx,” Septimo, who is Dominican-American and Black, told City & State. And while Stringer’s demographic profile is different, “I recognized that we share the same values. And that’s rooted in the idea that it’s not fair that there are places in the

city that are consistently left behind.” Niou, who is Taiwanese, agreed, telling City & State that her endorsement is about Stringer’s consistent record. “This is somebody who has stood up on the right side of the issues for so long,” she said. That includes police brutality, which has been highlighted this summer by the widespread protests against systemic racism. “I’m going to go with the guy who literally went to jail, who got arrested alongside folks who got arrested protesting police brutality,” Niou said, referencing Stringer’s arrest during the 1999 protests following the NYPD’s killing of Amadou Diallo – something Stringer himself mentioned in his speech. “It doesn’t matter what your skin color is as long as you have somebody who is fighting for what you believe in,” Niou said. So far, the other two major potential candidates in the race include Brooklyn Borough President Eric Adams, who is Black but is a more moderate former police officer, and City Council Speaker Corey Johnson, who is white and would be the city’s first openly gay mayor, but has lately come under fire from progressives for failing to more substantially cut the budget of the New York City Police Department. Stringer is hoping that many New York City Democratic voters, who also surely care about racial and gender diversity, make the same calculus as the elected officials who backed him. Stringer’s campaign launch, held at Inwood Hill Park in Upper Manhattan, showed support of a

multiethnic coalition that included state Sens. Robert Jackson, Alessandra Biaggi, Julia Salazar and Brian Kavanagh, as well as Assembly Members Al Taylor, Catalina Cruz, Linda Rosenthal and Robert Carroll. Stringer went out on a limb to endorse a number of those now-elected officials when they were challenging incumbents, including Jackson, Biaggi, Salazar and Cruz – which distinguishes him not only from Adams, but also first-time candidates like former nonprofit executive Dianne Morales or Maya a former counsel to Jeff Coltin Wiley, Mayor Bill de Blasio, who didn’t endorse candidates in the 2018 primaries. But the story isn’t a simple quid pro quo. Septimo noted that Stringer stayed out of her race against incumbent Assembly Member Carmen Arroyo. Niou mentioned that Wiley endorsed her reelection campaign this year – one of Wiley’s very few public endorsements – but that she was still backing Stringer. Similarly, Johnson had backed Ramos, Jackson and Biaggi in their primary races, too. Asked on Sept. 8 what he’d say to New Yorkers who think it’s time for a mayor of color, Stringer gestured to the elected officials on his side. “I’ve assembled what I think is the beginning of a multiracial, intergenerational group of supporters,” he said. “I believe people will vote for the mayor who best represents the hopes and dreams of every diverse community.”

A
FEW THINGS made the 43-yearold Jim Malatras an unlikely choice to lead the State University of New York. There is his youth, for one, and the fact that he is the first SUNY graduate to ever become its leader – and then there is the way that he got the job. Past SUNY chancellors were typically hired through national searches for candidates with a diverse range of experiences as academic leaders, military officers and government officials. SUNY’s board of trustees, however, only considered Malatras as a potential replacement to former Chancellor Kristina Johnson, who is now the president of Ohio State University. What mattered most in the hiring of
Malatras appears to be his ties to Gov. Andrew Cuomo, who appointed 13 out of the 15 trustees. The appointment alarmed faculty and students for a few reasons. Giving a $450,000 executive job to a white man without considering other candidates was unethical, they said. Plus, the opaque hiring process set a precedent for excluding faculty and students in future decisions. The SUNY Student Assembly, the University Faculty Senate and the Faculty Council of Community Colleges all voted “no confidence” in the Aug. 24 decision to hire Malatras. Yet, the impending reopening of the 64-campus university system made some skeptics willing to give Malatras a chance. “We felt that the arrival of a chancellor
who would take charge immediately was an appropriate step,” United University Professions President Frederick Kowal, whose union represents SUNY faculty and staff, said in an interview. “The concern that many of us had is that the appointment of Dr. Malatras would mean that the governor would have total control over SUNY, but, having said that, he has a very unique background.” Malatras had spent the past year as the president of Empire State College, a SUNY school with a focus on virtual learning across 33 physical sites. Years ago, he spent a year as chief of staff to former SUNY Chancellor Nancy Zimpher. But the Catskills native – who received his bachelor’s, master’s and doctorate degrees

in political science from the University at Albany – isn’t known as an academic administrator. He made his name by rising through the ranks as a longtime policy adviser and state operations director for Cuomo. Though Malatras left the governor’s office nearly three years ago, his recurring appearances at the governor’s daily coronavirus briefings have demonstrated in recent months just how close the two men still remain. Now, Malatras, a longtime Albany insider, has to usher the sprawling university system through a deadly pandemic and fiscal uncertainty, while addressing concerns that he is just an extension of the governor.

UNY IS A vast academic ecosystem that in a normal year would serve more than 700,000 students at community colleges, four-year colleges and graduate universities. Like many public university systems, SUNY cultivates a reputation as a driver of the state economy as well as an academic ladder into the middle class for working-class New Yorkers at just a fraction of the cost of private schools. But the pandemic has already cost the university $400 million in revenue as of last June, SUNY Chief Operating Officer Robert Megna told state lawmakers in July. That revenue shortfall could grow to $1 billion by the end of the year. About 30% of its approximately $12 billion annual revenue comes from the state, but the coronavirus pandemic could mean a 25% cut in that support. Federal intervention would be needed in order to overcome the crisis, according to Megna, a former head of the state Division of the Budget under Cuomo. “The State – in fact no state – has these kinds of resources,” he added in his July statement to the Legislature. Billions in new federal aid appeared increasingly out of reach by the time that Malatras officially began his position on Aug. 31, meaning that – from a fiscal standpoint – reopening campuses has become more important than ever. Student tuition is the third biggest source of revenue for SUNY, after the state aid and university hospital revenues – and SUNY refunded millions of it when campuses shut down earlier in the year. Reviving tuition as a funding stream depends to a significant extent on resuming in-person education, especially in academic disciplines that require hands-on learning in settings like sciences labs. SUNY campuses planned for a hybrid model this fall that limits in-person classes while allowing campus life to continue with some restrictions. Private universities like Columbia University and New York University have also adopted this ap-

proach, as have public universities in Ohio and Minnesota. The 23-campus California State University is the only major state university system that is going fully remote this fall. The University of North Carolina, which shut down in-person classes at its Chapel Hill campus in August just a few days after reopening, is a cautionary tale of what can happen to schools that do not implement adequate public health controls as they reopen. Like other areas of the country, SUNY has struggled to control the spread of the coronavirus ever since students began returning to campuses in mid-August. As of September 9, an estimated 1,110 students had already contracted the coronavirus in
the past two weeks, according to SUNY data. At least one university employee has died and in-person classes at SUNY Oneonta have already been canceled for the year. The same could happen at other SUNY campuses at Buffalo, Oswego and Fredonia, which continue to see surges in reported cases. In some ways, Malatras’ approach one week into the job resembles the state response he helped form earlier in the year. This includes the new online database he announced with the governor that tracks university coronavirus infections. Then there are Malatras’ media appearances, in which he has echoed the governor, saying

that unless students stop partying “the beast that is COVID-19” cannot be beaten. Beyond the similarities of their leadership styles, is a general emphasis on boosting the testing, tracing and isolating of cases through pandemic-fighting high-tech gadgetry and partnerships among SUNY institutions, private industry and public agencies. Malatras’ new initiative to conduct at least 105,000 tests each week across the system is one example. Another is a newly-acquired machine that will allow health officials at SUNY Upstate Medical University to screen wastewater

from people at one of its residential facilities for the virus, an approach that helped the private Syracuse University identify a dorm-based viral cluster in early September. Malatras, like Cuomo, presents the pandemic as a referendum on the ability of public officials to get things done. “We want to make sure that the plans that people put on paper are being executed,” Malatras said in an interview one week into his new job. “You can’t have this get out of control ev-

erywhere, or you will lose the confidence of students and you will lose the confidence of the parents.” And, like for the governor – whose approval ratings have skyrocketed in the past six months – a public health emergency offers Malatras a way to build support among faculty, students and staff based on his experience in state government. “There’s no learning curve,” Kowal said of Malatras’ transition into leading the univer-

sity. Unlike former Chancellor Kristina Johnson, who Kowal described as unfamiliar in the ways of New York state government, the union leader was beginning to see how her successor would be better able to fight for policy priorities like restoring state funding cuts to university hospitals and securing more state aid overall. “I remain optimistic that we’re going to be able to develop the means by which we can fix or meet all of the challenges facing SUNY.”

One analysis by state Comptroller Thomas DiNapoli found that the state Economic Development Corporation failed to adequately oversee spending in the so-called “Buffalo Billion” project. “I will not have him embarrassed with this,” Malatras wrote in a 2015 email about the lack of progress on one project that the governor had announced earlier that year, alongside then-Vice President Joe Biden, The New York Times later reported. Alain Kaloyeros, the president of SUNY Polytechnic Institute at the time and the

governor’s upstate economic czar, would later go to federal prison in a related big-rigging scandal. Malatras has also been heavily involved in developing the Excelsior Scholarship program, another key pillar of Cuomo’s legacy. The three-year-old program offers free tuition to public university students who study full time, meet income requirements and agree to remain in the state for a limited time post-graduation. The only problem is that lower income students tend to have a harder time meeting those requirements. “There’s a lot of trapdoors,” Glick said of the program. A more established form of student aid like the Tuition Assistance Program that focuses on the most needy students, she argues, is a better use of limited funding.

ONTAINING THE coronavirus is one thing, but addressing the university’s fiscal problems by restoring the flow of tuition still leaves SUNY hundreds of millions of dollars short in its current fiscal year. The university began implementing a hiring freeze (Malatras being one notable exception) back in May, halted construction projects and otherwise tried to trim costs as the state faces a $14.5 billion revenue shortfall. Individual campuses are increasingly feeling the budget crunch. “It could become significantly worse,” Maurie McInnis, president of Stony Brook University, said of the university’s $110 million funding shortfall in a mid-August letter to faculty and staff first reported by Newsday. One unnamed university employee blamed the governor in a letter to a local media outlet in the Hudson Valley. “I fear SUNY New Paltz will not survive as the pillar of our community, as we all have come to know it,” the person wrote. “Cuomo needs to act now.” With political pressure on the governor building, advocates of more state support for public universities hope that Malatras can secure money from Cuomo more than competing agencies can. “He is a product of SUNY, and hopefully the old school ties will make him an advocate in a way that past chancellors have not been because they were not part of the governor’s inner circle,” said Assembly Member Deborah Glick, chair of the Assembly Committee on Higher Education. She added that the upcoming state budget process, details of which typically emerge after Thanksgiving each year, will offer the first real test of how Malatras’ close relationship with the governor affects the bottom line at SUNY. The three-term governor also has significant parts of his legacy already invested in the state university system. His upstate development plan has leaned

While the pandemic brings challenges, it also offers Cuomo and Malatras a chance for a reset on higher education policy. “We are working closely with some of our best academic institutions to develop strategies that will help make a cleaner, greener Empire State for all,” the governor said at a September announcement of a new SUNY-based program to promote recycling. The big question, though, is how more than five years in the Cuomo administration will affect Malatras’ thinking moving forward. “It’s hard to tell where a staff person’s role begins and ends on any particular issue – particularly in an administration where the governor has a tight circle of aides who are involved in everything,” said Blair Horner, executive director of the New York Public Interest Research Group, who first met

Malatras when they were both staffers for former Assembly Member Richard Brodsky. One possibility is that Malatras will follow the example of Benjamin Lawsky, who like Malatras and Horner, also worked for Cuomo during his time as state attorney general. The newly elected governor appointed Lawsky as the first superintendent of financial services in 2011. His tenure included building a new regulatory system for the multi-billion dollar insurance and financial sectors while also developing new state policies to emerging tech like Bitcoin – all of this with minimal political interference from Cuomo, said Horner. “I don’t think he was at odds with the administration,” he added. “But I think he was able to advance things that he was interested in, seemingly independent of the governor’s office.” If that happens with Malatras, then it could go a long way towards fulfilling hopes that putting a longtime Cuomo ally

in charge of SUNY was a good idea. Success in containing the spread of the coronavirus within the SUNY system would help restore confidence that the university can improve its bottom line while reopening, without fueling wider coronavirus outbreaks across the state. “I think it is going to be a turning point,” state Sen. Toby Ann Stavisky, chair of the Senate Committee on Higher Education, said of reopening SUNY campuses. “If there is a resurgence (of coronavirus cases), then all bets are off.” That all depends on whether Malatras succeeds in the coming months at curbing the spread of the coronavirus on campus and how he uses his gubernatorial pull to get more money for the university. Longevity in his current position is the longterm upside to winning the hearts and minds of the faculty, staff and students in the process, he said in an interview. “There’s so much potential possibility,” he said of reshaping his alma mater. “I could see myself being in this job, if they would have me, for a long, long time.”

Despite being one of the nation’s largest private universities, NYU has a smaller endowment than many of its similarly selective peers. Over the course of his tenure, Hamilton has managed to limit tuition increases while continuing to expand the university’s footprint in New York and globally.

Over the past decade, Satish Tripathi has been working hard to elevate the University at Buffalo into the highest echelons of American research institutions. The principal conductor of the American Symphony Orchestra in his spare time, Botstein is known as an ardent defender of open discourse on campus and of liberal arts. Under his watch, Bard has created the largest prison-education program in the country.

ANDREW RIGIE Following a push in recent weeks to end the ban on indoor dining, Andrew Rigie of the New York City Hospitality Alliance and the rest of the restaurant industry managed to convince Gov. Andrew Cuomo to allow the city to catch up to the rest of the state in allowing indoor service. Restaurants will be limited to 25% capacity, face masks required – and instead of hors d’oeuvres, expect pre-entrance temperature checks and contact information sharing. Bon appetit!
