New York City Council Speaker Corey Johnson announced he won’t be running for mayor in 2021.

LAST WEEK, as President Donald Trump sowed doubt about the integrity of the upcoming elections, he crossed a line with his assertion that he might not cede power peacefully should he lose his reelection battle. Some fellow Republicans responded by insisting that there would indeed be a peaceful transition of presidential power in January, though few called out their party leader by name. Other Trump allies defended the would-be dictator, playing up exaggerated claims about voter fraud while seeking to muddle the issue by equating his remarks with Hillary Clinton’s. (Clinton said Democrats should avail themselves of all legal options if the result is contested, but came nowhere near Trump’s extreme and alarming suggestion that a bedrock of American democracy should be tossed aside.) While Trump has no qualms about eroding democratic norms, he hasn’t acted alone. Many voters still support the president, perhaps because they don’t take seriously his threats to democracy. Republican lawmakers, fearful of angry tweets and eager to install another justice to tilt the U.S. Supreme Court further to the right, haven’t shown much spine in challenging the president. But perhaps Trump’s most important ally is U.S. Attorney General William Barr, who has helped the president bend the rules repeatedly since coming on last year. In this week’s magazine, City & State’s Ben Adler proposes a bold response: Impeach Bill Barr.

After weeks of speculation about the future of his 2021 mayoral campaign, New York City Council Speaker Corey Johnson ended his bid before it officially began. Johnson cited recent struggles with depression

as one of the reasons why he decided not to run. Johnson’s exit shook up the election landscape with a little less than a year before the election. A year ago, he seemed like the man to beat, an apparent front-runner who acted as shadow mayor and a loud cheerleader for the city.

Protests broke out across New York in the wake of the Kentucky attorney general’s announcement that no police officers were indicted for the killing of Breonna Taylor. A grand jury indicted one of the three officers on charges of wanton endangerment for shooting in a way that endangered neighbors, while none will go to trial for shooting and killing Taylor. Thousands of people took to the streets in Manhattan and Brooklyn to demand justice for Taylor on the night of the grand jury decision. No

HE DOES WHAT HE WANTS On the third anniversary of Hurricane Maria, Puerto Rican superstar Bad Bunny found a way to perform amid the pandemic, rapping and singing atop a truck designed to look like a subway car in a tribute to New York’s Latino communities. On Sept. 20, Bad Bunny began his route in the Bronx and performed his way through Washington Heights and Harlem, drawing exuberant jogging fans along the way.

arrests were reported from those protests, a sharp contrast from the prior weekend when the New York City Police Department violently cracked down on small demonstrations against U.S. Immigration and Customs Enforcement. Protesters were out in force in other parts of the state as well, including in Rochester, a city still reeling from the highprofile police killing of Daniel Prude. In Buffalo, the driver of a pickup truck struck a protester on a bicycle and left her with a fractured shoulder.

INDUSTRY CITY REZONING COLLAPSES

The developers behind a contentious rezoning in Brooklyn that was already on shaky legs after extensive community backlash decided to scrap the proposal. Industry City CEO Andrew Kimball made the announcement about a week after a marathon City Council hearing on the application included hundreds of people speaking for and against the rezoning, which would have expanded the Sunset Park commercial and industrial complex. Developers promised 20,000 new jobs would result from the project. Opponents, including local Council Member Carlos Menchaca, said that the rezoning would lead to gentrification in the largely working-class

neighborhood and decried what they considered to be empty promises about jobs and community benefits. Kimball, in a statement, cited a lack of political leadership as a key reason for pulling the application. While a major victory for city progressives, many in the business and pro-development community considered this a significant loss for the city akin to losing Amazon’s headquarters in Queens last year.

MORE NYC FURLOUGHS

In a bid to avoid permanent layoffs and address New York City’s looming budget deficit, Mayor Bill de Blasio announced the city would furlough 9,000 managerial and nonunion public employees for a week. The mayor said the move would save the city about $21 million and came a week after he announced that he and his senior City Hall staff would also take weeklong furloughs that would save $1 million. Included in this new round of furloughs were school superintendents and nonunion management

employees in the Department of Education, despite public schools being in the midst of reopening.

NYC IS NOW AN “ANARCHIST JURISDICTION”

U.S. Attorney General William Barr designated New York City as an “anarchist jurisdiction,” along with Seattle and Portland, Oregon. The decision came after President Donald Trump tasked Barr’s Justice Department to identify cities that have “permitted violence and destruction of property to persist and have refused to undertake reasonable measures to counteract criminal activities.” Trump threatened to withhold federal funding from such localities. For weeks, the president has been criticizing cities for allowing “lawless” protests and criticized his hometown for a recent spike in crime. New Yorkers, for their part, received the new anarchist label with a healthy dose of sarcasm, while Gov. Andrew Cuomo said the state would sue over a loss of federal funding.

Is NYC on the cusp of a second wave? Health experts have been warning of a second wave since March. Now, a resurgence of COVID-19 cases may actually be approaching. New York City’s former health commissioner Oxiris Barbot – who left her position due to ongoing issues with Mayor Bill de Blasio – told The Wall Street Journal that a resurgence of the virus over the next few months is likely. New clusters Clusters of COVID-19 cases have been identified in New York City’s Borough Park, Midwood, Bensonhurst, Williamsburg, Far Rockaway, Edgemere and Kew Gardens neighborhoods. In the first week of August, 2,414 new cases of the virus were found in these areas, which accounted for 20% of the city’s new positive cases. City officials were well aware of the threat that these new cases pose to the overall health of the city and have said they are dedicated to containing the clusters. “A number of community leaders are themselves sounding the alarm, because this uptick has come on very intensely,” de Blasio said. “And if some place has to be shut down, it will be.” Many of these areas are home to the city’s Orthodox Jewish community, where individuals have been gathering indoors for school and religious celebrations. Two yeshivas have already been shut down due to the detection of

NEW YORK CITY MAYOR Bill de Blasio drove parents into a frenzy when he announced at the last minute that the start of in-person classes at city public schools would be delayed yet again. But we should have seen it coming. This is the guy who shows up to everything late, whether it’s press briefings or a memorial service to honor the dead. Here are just a few examples of the mayor’s penchant for putting off the big decisions.

RUNNING FOR PRESIDENT

In May 2019, de Blasio became the 23rd Democrat to try to become the party’s presidential nominee. His ill-fated campaign inspired the creation of a button that said, “Make America Late Again.”

LAYING OFF WORKERS

Since early August, de Blasio has been warning that 22,000 city workers will need to be laid off to compensate for a $9 billion budget deficit. He says that federal aid or state approval to borrow more could help avoid mass layoffs. But Gov. Andrew Cuomo isn’t keen on giving NYC that power – and when was the last time Washington came to the city’s rescue?

SHUTTING DOWN THE CITY

At the onset of the coronavirus crisis, de Blasio ignored calls from public health experts to close down the city’s public schools, restaurants, bars and gyms. It wasn’t until some of the city’s top health officials threatened to resign that the mayor agreed to pull the emergency brake.

De Blasio stood by Shola Olatoye, his appointee running NYCHA, for months despite headlines about mismanagement and deteriorating living conditions. Same with former Department of Correction Commissioner Joseph Ponte, who vanished from the city for 90 days in a city vehicle during a crisis at Rikers. But Mark Peters, the watchdog who wrote them both up? Don’t worry, de Blasio fired him right away.

A Q&A with NYC Health Commissioner

We know what works (against the coronavirus). It’s not rocket science.

New York City has kept the COVID-19 infection rate low for months. But with schools reopening and limited indoor dining coming to the city, will there be an inevitable spike in cases? My starting point on this is that we know what works from our experience over the past several months here in New York City. As with many public health efforts, it’s not rocket science. It’s things that are tried and true with respect to interrupting transmission. It’s social distancing, making sure that people are washing their hands, making sure that when people are

feeling ill, they stay home – and then really importantly, wearing face coverings. We should make sure that we have learned those lessons, but also that we don’t become complacent about them as we head into the fall and the cooler months. What role did you play in New York City Mayor Bill de Blasio’s phasedin approach to school reopening? And does that pose an increased risk? What the mayor has been very clear about, and which I strongly agree with, is to think about those areas that have the greatest benefit for

the people of New York. I think about it from the health perspective, but we also have to think about the economic benefit as well, which ties into people’s health, frankly. School reopening is a particularly important example where we know there are so many health benefits for reopening schools for in-person instruction. We need to do it as safely as possible, but the health benefits that I keep in mind are the direct benefits of kids being able to learn, the social and emotional development that comes along with it, but also all

of the health services that are provided through schools, whether it’s making sure that people have meals so that they’re eating nutritiously, to the mental health services that are provided through schools, to ways of managing asthma in children. President Donald Trump contradicted the CDC director, who had said a vaccine would not be widely available until the middle of next year and that masks were perhaps more important than a vaccine. What’s your reaction? We should get away from the false dichotomies. We

need masks and we need a vaccine. That should be inarguable with respect to the direction we need to go as a country and as a city. I think what Dr. (Robert) Redfield was alluding to was the fact that we don’t have a vaccine today, but we do have masks today. We do have other efforts that we know have been effective to help control COVID-19. So let’s focus on those things today even as we plan and prepare for a reality which, just as much as the next person, I hope it will be a reality in our near future where we have a COVID-19 vaccine as well.

And it’s the best news Scott Stringer’s had all year.

OMEWHERE IN MANHATTAN, Scott Stringer is smiling. That’s because the New York City comptroller and 2021 mayoral candidate is perhaps best positioned to benefit from New York City Council Speaker Corey Johnson’s announcement that he wouldn’t be running for mayor after all. “Just as I was open about the fact that I was considering a run for Mayor, I now want to be open about the fact that I have made the difficult decision not to run,” Johnson said in a statement emailed to reporters on Sept. 24. The Stringer camp was undoubtedly ecstatic about the news, which now narrows the top tier of Democratic mayoral candidates to just Stringer and Brooklyn Borough President Eric Adams. And Johnson’s departure rids Stringer of his chief rival, who had a similar demographic and political profile. Both are white, male political insiders from the West Side of Manhattan who would run on progressive politics and a history of governmental competence. Johnson’s decision “makes it better for Scott,” said Patrick Jenkins, a veteran po-

litical consultant based in Queens. “It takes another West Side guy who’s a progressive off the chess board for him.” The introduction of ranked-choice voting to city elections in 2021 could dull the impact of Johnson’s exit somewhat, since candidates won’t need to be as concerned about running in “lanes.” But it won’t change the fact that many supporters and donors who were ready to back Johnson when he jumped in the race might now instead line up behind Stringer. Stringer was publicly humble on the day of the announcement, tweeting that Johnson “was a formidable candidate” and “a true public servant.” But there’s little doubt that Stringer’s campaign launch this month played a role in Johnson’s announcement. Stringer came out of the gate with endorsements from a racially diverse array of male and female elected officials – an important signal to voters who may be skeptical of supporting yet another straight, white man for mayor. Johnson may have taken notice, said Jake Dilemani, a political strategist with Mercury. “I think he looked at this field and doesn’t see a path forward,” Dilemani

said. “(Stringer) is owning the progressive lane, but can also appeal to the more moderate faction of the Democratic electorate.” That’s thanks in part to Stringer’s long history in government and his reluctance to fully embrace democratic socialism, despite aligning himself with members of the Democratic Socialists of America’s New York City branch and its causes. A number of political organizations and elected officials with close ties to both Stringer and Johnson were reluctant to take a side in the mayoral race. With Johnson dropping out, more Stringer endorsements are likely to start rolling in. Before Johnson officially announced he would drop out, a consultant working for a City Council member told City & State that “if Corey drops out, (the member) is going to call Scott.” Johnson’s decision was a major development, if somewhat expected. For months, the political world had been buzzing that Johnson, who was seen as a top-tier candidate, would not follow through on a bid for mayor. His enthusiasm for campaigning seemed to be flagging, and he had slowed fundraising, before halting it entirely during the coronavirus pandemic. And

after two and a half years of relative peace in City Hall, a contentious city budget battle enraged both those who wanted to drastically cut funding for the New York City Police Department and those who feared such cuts would hurt the same New Yorkers they aimed to help. That budget fight led to leftists protesting outside Johnson’s home as well as his boyfriend’s home, calling for more drastic action against the NYPD. The New York City DSA had previously planned another protest outside Johnson’s apartment for the afternoon of Sept. 24. To those reasons, Johnson added another: He was struggling with depression. “I believe it’s important to be open about this as well,” Johnson wrote. The Corey Johnson of today is on a very different political trajectory than the Corey Johnson of December 2018, when his friendliness, political acumen and ability to win over skeptics led City & State to ask, “Is Corey Johnson already mayor?” Such is electoral politics, and to be clear, Johnson is not retiring. He is staying on as speaker, a position where he’s term-limited at the end of 2021. And speculation among the political class continues regarding wheth-

er Johnson will seek another office instead, such as Manhattan borough president. Campaign spokesperson Jen Fermino did not respond when asked whether Johnson plans to run for a different office. Whether Johnson himself will endorse Stringer remains an open question. Johnson still has a lot of political power in the city, and his endorsement will be one of the most sought after in the race – along with Bronx Borough President Rubén Díaz Jr., who was also a top-tier mayoral candidate before he announced in January that he would not run. Jenkins speculated that Johnson may support Maya Wiley, former counsel to Mayor Bill de Blasio, instead, but cautioned that the field is far from set. “I still think it’s early,” he said. “The presidential race is going to factor into this, and people are going to make decisions based off that.” Adams once said – only partially in jest – that he would “out-white” Scott Stringer for white New Yorkers votes, even though Adams himself is Black. Adams will also try to capitalize on Johnson’s departure from the race, though his path to doing so isn’t as clear. Like Stringer, Adams publicly praised Johnson on Twitter and thanked him for his

openness regarding his mental health. With Adams courting a more moderate electorate than Stringer, it seems less likely that Johnson supporters would shift their money and support to the Brooklyn borough president. Other candidates expected to run in the June 2021 Democratic primary include Wiley; Shaun Donovan, former budget director to President Barack Obama and the former top housing official in New York; Dianne Morales, a former nonprofit CEO; Loree Sutton, the former city veterans affairs commissioner; and Kathryn Garcia, the former city sanitation commissioner. Any of them could become formidable candidates, but lack the money and campaign infrastructure of Stringer and Adams. Yet one consultant told City & State that Stringer’s departure could allow Adams to frame it as a two-person race for mayor. “The narrative is now going to be that there’s two top candidates. And then the also-rans.” Johnson, the consultant said, “was a good candidate for a positive time,” known for dancing and telling jokes. But when the coronavirus pandemic hit, bringing a massive budget crunch, “it all just fell apart.”

Remembering the Notorious RBG

N SEPT. 18, Supreme Court Justice and Brooklyn native Ruth Bader Ginsburg died, leaving behind an extraordinary legacy as a jurist and a New Yorker. Over that weekend, mourners set up various memorials outside her childhood home in Midwood and her nearby high school to honor the feminist trailblazer, who was a leading champion of women’s rights in the 1960s and 1970s before becoming the second female justice on the Supreme Court. Ginsburg also became a pop culture icon later in life, when a “Notorious R.B.G.” Tumblr page became extraordinarily popular. While the juxtaposition of a petite, elderly Supreme Court justice with the heavy-set rapper the Notorious B.I.G. may have seemed ironic, she deserved the moniker because she was the ultimate New Yorker. Like the hip-hop artist, who also hailed from Brooklyn, Ginsburg faced discrimination and spent her early life being repeatedly underestimated. Irin Carmon, co-author of The New York

Times bestseller “Notorious RBG: The Life and Times of Ruth Bader Ginsburg,” told City & State that Ginsburg’s middle-class Brooklyn experience was less challenging than the Notorious B.I.G.’s. But it’s Ginsburg’s early life in an area then referred to as Flatbush that really made her the archetypal New Yorker, in Carmon’s opinion – as well as her love of the famous Lower East Side lox emporium Russ & Daughters. “The happiest I can remember ever seeing her was when she spoke about her favorite sandwich from there,” Carmon recounted. Born to Jewish immigrants in Brooklyn, her mother, in particular, imbued Ginsburg with the notion that she needed to be able to rely on herself, rather than a husband, which was unusual advice at the time. Ginsburg attended Cornell University for her undergraduate studies before heading to law school at Harvard University. However, Ginsburg ended up transferring to Columbia University, where she received her degree, after her husband received a job offer in New York City. New York City is where her law career began, but most importantly it’s where Gingsburg became all too aware of city law firms’ uneasiness with her gender. Despite graduating at the top of her class at Columbia, Ginsburg had difficulty landing interviews, let alone jobs, unable to escape the prejudices against women that were prevalent at the time. But she was not discouraged. Ginsburg clerked for the U.S. District Judge Edmund L. Palmieri before teaching at Rutgers University Law School from 1963 to 1972. Ginsburg then went on to become the first female professor to ever receive tenure at Columbia, where she worked from 1972 to 1980. She also worked as a litigator and director of the Women’s Rights Project of the American Civil Liberties Union, based in Manhattan, during the 1970s. President Jimmy Carter appointed Ginsburg to the U.S. Court of Appeals for the District of Columbia in 1980, where she remained until she was selected by President Bill Clinton in 1993, to replace Justice Byron White. Throughout her storied career, combating discrimination remained a major focus for Ginsburg, whose liberal ideology can also be linked to her early life and career in the left-leaning Empire State. In her later years, Ginsburg’s reputation for assertiveness grew as she wrote famously scathing dissents from opinions by the Supreme Court’s conservative majority, even occasionally taking the unusual step of reading them aloud from the bench. She brought an aggressive New York attitude to the Supreme Court, much like her friend and fellow New York native Antonin Scalia. And if you don’t know, now you know.

RBG’s fellow feminists

ATE SUPREME COURT JUSTICE and Brooklyn native Ruth Bader Ginsburg, a pioneer of the women’s rights movement in the 1960s and 1970s, became the second female justice on the U.S. Supreme Court in 1993 and the first Jewish woman and first woman from New York to serve as a Supreme Court justice. Prior to her career as a jurist, Ginsburg got her start in New York City, which spawned the careers of many leading feminists of the late 20th century. Ginsburg worked with many of these women as she became the first female professor to receive tenure at Columbia University, where she worked from 1972 to 1980. Ginsburg also worked as a litigator and director of the Women’s Rights Project of the American Civil Liberties Union, which is also based in the city, during the 1970s. Ginsburg’s contemporaries who led the modern women’s rights movement included politicians, authors and activists. Here are some of the most important ones.

SHIRLEY CHISHOLM

Brooklyn native Shirley Chisholm became the first Black woman elected to Congress and the first Black woman to run for president. Prior to entering politics, Chisholm worked as a nursery school teacher and ran two day care centers. In 1959, she became the educational consultant for the city’s Division of Day Care. And in 1964 she was elected to the state Legislature before she was encouraged to run for Congress by her constituents in Brooklyn. Chisholm served in Congress for seven terms, from 1969 to 1983, and during that time developed her own catchphrase: “unbought and unbossed.” In Congress, Chisholm advocated for minimum annual incomes for families, extended day care hours and school lunch. She also criticized the Vietnam War, suggesting that the U.S. should focus on combating its own racism and poverty rather than engage in warfare abroad. In 1972, she launched her presidential campaign, which caused issues within the feminist community of that time, which was primarily dominated by white women. None of her contemporaries lent their support to her campaign. Despite losing her presidential campaign, her historic run inspired numerous women to run for office as did her ability to speak candidly about racism and sexism. In 2018, it was announced that a statue would be erected in Chisholm’s honor in Prospect Park. Unfortunately, the statue, which was expected to be installed in the park this year, has been held up due to the COVID-19 pandemic.

Famous for her big hats and booming voice, the native New Yorker who represented Manhattan in Congress was one of the most recognizable figures in the women’s rights movement during the 1970s. Before her election to the House of Representatives, Abzug worked as a civil rights attorney in Manhattan and at the ACLU. She was elected to Congress in 1970; her campaign slogan for the race had been, “This woman’s place is in the House – the House of Representatives.” Abzug served in Congress for three terms, where she spoke out against the Vietnam War, called for President Richard Nixon’s impeachment, championed women’s rights and introduced the first bill to protect civil rights for gay people. She left the House to run for the Senate against Daniel Patrick Moynihan in 1976 but lost the race. She ran for New York City mayor against Ed Koch in 1977 and lost.

Steinem still remains one of the most visible and recognizable feminist figures around, though her career in activism began a long time ago. She came to New York City in 1960 to become a journalist and in 1963, Steinem was launched into the national spotlight after she posed as a Playboy Bunny at the Playboy club in Manhattan to expose the rampant sexism there. In 1971, Steinem founded Ms. magazine, which became one of the first national magazines to address women’s issues and highlight feminist thought. Steinem has lived in the same Manhattan apartment for half a century, according to The New York Times.

Thought of as the “mother of women’s studies,” Florence Howe is often credited with expanding the focus on women’s literature and women’s studies in academia. While she was working at various universities teaching women’s studies in the 1950s, Howe realized that there was limited literature available on the subject she was teaching. But before jumping into the presidential race, Ferraro began her career as a criminal prosecutor in Queens. It wasn’t until her children were in school that Ferraro went to work in the Queens District Attorney’s office. Ferraro served as a congressional representative from Queens for three terms. During her time in Congress, she helped pass legislation that would make it easier to access spousal retirement benefits, which was a big concern for many women at the time. She also co-sponsored the Economic Equity Act, which sought to accomplish many of the same goals as the Equal Rights Amendment and supported federal funding for abortions.

RBG’s death puts pressure on the minority leader to do something – anything – to stop the Republicans

ITH THE DEATH of Supreme Court Justice Ruth Bader Ginsburg, a forceful, liberal feminist, Senate Democrats are the only thing standing between President Donald Trump and the appointment of a conservative justice to replace her – which could tip the balance on the court in favor of repealing the landmark abortion rights decision Roe v. Wade. This will put a spotlight on U.S. Sen. Charles Schumer – the Senate minority leader and, like Ginsburg, a native Brooklynite – who will presumably lead his party’s efforts to block Trump’s nominee. The situation is similar to when, in February 2016, Supreme Court Justice Antonin Scalia died. With 11 months until the next president would be inaugurated, U.S. Senate Majority Leader Mitch McConnell argued that it would be unfair to allow then-President Barack Obama to fill the empty seat with U.S. Court of Appeals Judge Merrick Garland so close to a presidential election. Now, with a presidential election just two months away, McConnell has changed

his stance from 2016 and made it clear that the same rules would not apply this time around – now that there is a member of his own party in the White House. Here is what Schumer could do to prevent the filling of the vacant seat by Republicans, or what he could do next year if he is unable to stop them now. Why is a Republican-seated justice so threatening now? Roe v. Wade, the Supreme Court case in 1973 which legalized abortion, has been undermined by several states with a Republican majority who have passed bills strictly limiting access to abortion, along with conservatives who have attempted to dismantle the case in court. With five conservative judges on the Supreme Court, adding a sixth would all but guarantee Roe could be overturned. Rep. Alexandria Ocasio-Cortez spoke at a press conference on Sept. 21, noting the “stakes of this vacancy” for women’s reproductive rights, labor laws and health care. Additionally, McConnell and other Republican senators have created a dangerous precedent in the nominations of Supreme Court justices by blocking the Garland seat and reversing themselves this election year.

General William Barr since June. Barr is said to have interfered with the legal investigation of foreign intervention during the 2016 presidential election and has undermined New York prosecutors. However, some legal experts find it unlikely that Barr can be impeached because not enough evidence has been shown to make a case against him. Rep. Hakeem Jeffries, chair of the House Democratic Caucus, who represents Brooklyn, said that he was focusing on the election, not the impeachment. “At the moment we’re looking forward toward the election,” Jeffries said. “And the American people will ultimately make the decision as to whether Trump and his corrupt administration should be held accountable.” On the other hand, House Speaker Nancy Pelosi stated, “we have our options” when asked about a possible impeachment to delay the nomination. Will the threat of the Democrats’ power next year be enough?

This could undermine the court’s legitimacy and create chaos in how Supreme Court seats are filled. Kristen Clarke, president and executive director of Lawyers’ Committee for Civil Rights Under Law, said the attempt at filling the vacant seat so close to an election is dangerous. “We are unaware of any moment in history in which Congress confirmed a nominee to the Supreme Court while voters were actively casting ballots in the general election,” Clarke said. “This is an unprecedented politicization of a court vacancy that stands to cause permanent damage to the integrity of the court.” Can Democrats filibuster the nomination? No. In 2017 McConnell abolished the filibuster for Supreme Court nominations, during the nomination of Supreme Court Justice Neil Gorsuch. Democrats stalled the vote for Gorsuch by prolonging the debate for his nomination with a filibuster and, in retaliation, McConnell made it a rule that only a simple majority is needed to end debate on a Supreme Court nomination. By doing this, McConnell made the confirmation of Supreme Court justices substantially easier.

How many Republicans does Schumer need to side with the Democrats? With just 47 Democrats in the Senate, Schumer would need four Republicans to vote against the nominee – assuming Schumer keeps all of his own members in line. Sens. Lisa Murkowski of Alaska and Susan Collins from Maine have both publicly announced that whoever is elected on Nov. 3 should fill the vacant seat. Democrats hoped to pick off Sens. Lamar Alexander from Tennessee and Chuck Grassley of Iowa, but both have decided to support a vote on Trump’s nominee. Sen. Mitt Romney, who voted for Trump’s impeachment, announced he is sticking with the Republicans as well. Other Republicans are waiting to announce their stance on the issue, but unless Schumer can get two additional Republicans on his side, there is little hope for the left. Could an impeachment of Attorney General William Barr be a possible stalling tactic? Democrats in Congress have been calling for an impeachment probe of U.S. Attorney

With the upcoming election, Democrats may gain control of the presidency and the Senate and retain their majority in the House of Representatives. With that power, Schumer has declared that “nothing is off the table” for next year, if Republicans were to go through with their nomination. Although he doesn’t have a vote, House Judiciary Committee Chair Jerry Nadler has considerable sway over the votes of senators. Nadler tweeted that if McConnell and the Republicans were to fill the seat, Nadler would support the addition of more justices to the Supreme Court. The removal of filibusters has also been widely discussed, which would allow Democrats to pass legislation with a simple majority. Another proposed tactic is the addition of the District of Columbia and Puerto Rico as states. This action would give the Democrats more senators, since largely left-leaning people reside in those locations. Some conservatives have already threatened the Democrats in return. Mark R. Levin, a conservative radio talk show host, tweeted that Republicans would seek their own revenge by using the Democrats’ new rules against them, threatening to add even more judges to the Supreme Court and add American Samoa as a state. Additionally, if Schumer can’t garner the support of his fellow Democrats, he can’t threaten any retribution. One prominent Democrat, Sen. Dianne Feinstein from California, has already said she would not be participating in the abolition of filibusters. “I don’t believe in doing that,” Feinstein said. “I think the filibuster serves a purpose. It is not often used, it’s often less used now than when I first came, and I think it’s part of the Senate that differentiates itself.”

BILL BARR IS THE ANARCHIST The case for impeaching the U.S. attorney general, who has undermined the rule of law in New York. By Ben Adler

RESIDENT DONALD TRUMP may not be right about most matters of fact, but he is onto something when he complains that law and order have been destroyed in New York City. Unfortunately, he’s right for the wrong reasons. Trump contends that a handful of broken store windows and an uptick in violent crime, which he claims are deliberately tolerated by Mayor Bill de Blasio, have rendered New York City an “anarchist jurisdiction.” This is false, as de Blasio and the rest of the city’s elected leadership have opposed violence and property damage by protesters. The mayor even instituted a curfew to quell the unrest in June and in the months since, the streets have been quiet. Rather, the rule of law in New York has been severely undermined by a different level of government: the Trump administration, especially U.S.

Attorney General William Barr. In an unprecedented break with ethical norms that have governed the Department of Justice, Barr has inserted himself into, and actively opposed, the work of prosecutors whenever their target has been a Trump associate. The nation’s highest-ranking legal officer has become nothing more than a henchman for a lawless president. With Trump’s recent refusal to promise to respect the results of the election, having Barr in charge at the DOJ threatens the stability of the republic. For this situation, the founders wrote a remedy into the Constitution: impeachment. In June, Rep. Steve Cohen of Tennessee introduced a bill to open an impeachment investigation of Barr, even before the attorney general’s most recent offenses. Three New Yorkers, Reps. Adriano Espaillat, Gregory Meeks and Nydia Velázquez, co-sponsored the measure, but

eventually organized together to oust him. But while New York conservatives may be marginalized at home, their angry, authoritarian brand has come to dominate the national GOP. And, like Trump, Barr seems determined to use his power not to serve the American people but to punish his native state and bend it to his will. Just consider some of Barr’s actions in New York.

Undermining the prosecution of Michael Cohen and other Trump allies

support for opening the investigation doesn’t necessarily imply support for any specific outcome. Judiciary Committee Chair and Manhattanite Rep. Jerry Nadler said Barr “certainly deserves” to be impeached and removed from office, but won’t be because Senate Republicans won’t vote to convict him. The House Democratic leadership has displayed little enthusiasm for impeachment. They may suspect, for good reason, that swing voters don’t care about such abstractions as the politicization of the Justice Department. Impeaching Barr could also inspire Trump voters to turn out in greater numbers in November. But now impeaching Barr is gaining some currency among Democrats as a diversion to delay Senate confirmation of a Supreme Court nominee to replace Ruth Bader Ginsburg – although it seems unlikely that Senate Majority Leader Mitch McConnell could be so

easily outmaneuvered. Is it politically wise for Democrats to impeach Barr? That’s a complicated question. But whether impeachment is warranted on the merits is a simple one. Trump was rightly impeached for abuse of power and obstruction of justice, and Barr has abused power and obstructed justice for Trump. Trump and Barr have a lot in common: Both grew up in New York City, emulating powerful, domineering fathers. Like Trump and former Mayor Rudy Giuliani, Barr is an uncommon political animal: a right-wing despot from a famously liberal city. Barr’s father Donald was the headmaster of the elite Dalton School on Manhattan’s Upper East Side. An autocrat who was accused of retaliating against students involved in anti-Vietnam War protests, Barr’s father was an uneasy fit at 1970s Dalton. It was then an artsy school with mostly liberal parents, and those parents

As The New York Times reported in July, “Shortly after he became attorney general last year, William P. Barr set out to challenge a signature criminal case that touched President Trump’s inner circle directly, and even the president’s own actions: the prosecution of Michael D. Cohen, Mr. Trump’s longtime fixer.” In what federal prosecutors in the Southern District of New York believed was an illegal in-kind donation to the Trump campaign, Cohen had paid porn star Stormy Daniels not to publicly allege that she had an affair with Trump. Barr tried to interfere with the prosecution, the Times reported, by repeatedly questioning the legal justification for the case and suggesting that campaign finance law enforcement should be left to the Federal Election Commission. “Mr. Barr’s maneuvering in the Cohen case was not his only attempt to insert himself in Southern District cases,” the Times also noted. “After Mr. Barr was sworn in, one of his first actions was to seek briefings on politically sensitive investigations in the office,” including the investigation into Giuliani associates Lev Parnas and Igor Fruman. Intervening to keep Trump’s tax returns secret The president’s business entanglements create myriad potential conflicts of interest, the vast majority of which remain unknown because he has broken with decades of tradition

and refused to release his tax returns. Meanwhile, the Manhattan district attorney is seeking those returns as part of an investigation into the Trump family’s decadeslong efforts to minimize their tax liability for gifts and assets through legally questionable tactics such as creating a shell company through which Trump and his siblings overcharged his father for nonexistent services. In October 2019, the DOJ filed a motion in support of Trump’s personal legal team asking a court in New York to block Manhattan District Attorney Cyrus Vance Jr.’s subpoena for eight years worth of Trump’s tax records. As Vice News observed at the time, “Trump’s lawyers made the unprecedented argument that as president, he should be totally immune from criminal investigation – a theory that has not been tested in the courts, and which former prosecutors called an outlandish expansion of executive immunity.” Ousting U.S. Attorney Geoffrey Berman In June, after the Trump administration had enough of the Southern District of New York’s investigation of alleged corruption by Trump’s cronies, Barr pressured Berman to resign, offering the prosecutor other jobs as an inducement and threatening that he would be fired if he didn’t comply. Berman refused, saying that his departure might derail sensitive ongoing investigations. The DOJ then announced – without Berman’s knowledge or permission – that Berman had resigned. Barr sought to replace Berman with Securities and Exchange Commission Chair Jay Clayton, a loyal Trump ally who lacked prosecutorial experience. After Berman reasserted that he hadn’t resigned, Trump fired him. “Firing Berman, who was investigating Trump’s allies and potential corruption of the president’s associates, is a perversion of the Justice Department’s independence for political purposes, and it is also potential obstruction of justice by Barr on behalf of the presi-

dent,” said Donald Sherman, deputy director of Citizens for Responsibility and Ethics in Washington, a nonpartisan government watchdog. Barr’s efforts to prevent Vance from obtaining Trump’s tax returns could also be obstruction of justice, according to Sherman. Intervening on Trump’s behalf in author E. Jean Carroll’s defamation case against the president Carroll has publicly accused Trump of raping her, and when asked about the accusation, Trump called her a “liar,” and said she is “not my type.” Carroll is now suing Trump for defamation over those statements. If that case went to trial, it could prove very personally embarrassing for the president. None of this has anything to

that Justice Department lawyers will be essentially aiding Trump’s defense, and taxpayers could be on the hook for any potential damages, if the U.S. government is allowed to stand in for Trump. Winning damages against the government, though, would be more unlikely than in a suit against Trump, as the notion of ‘sovereign immunity’ gives the government and its employees broad protection from lawsuits.” Declaring New York City an ‘anarchist jurisdiction’ In a functioning democratic republic, if the president wants to punish a city for its own policies on policing, that president asks Congress to pass legislation defining: which local policies will no longer be permissible; the process by which the federal

Nonetheless, earlier this month, the DOJ requested that a federal court “substitute the United States for President Trump as defendant.” As The Washington Post explained, this is all for Trump’s benefit, and to the citizenry’s detriment. “The maneuver removes the case – at least for now – from state court in New York, where a judge last month had rejected Trump’s bid for a delay and put Carroll’s team back on course to seek a DNA sample and an under-oath interview from the president,” the Post wrote. “It also means

government would determine whether jurisdictions are in violation of those new restrictions; and the specific funds that would be withheld as punishment. (The law would have to be forward-looking, rather than retroactive to past municipal actions like cutting the NYPD budget, because the U.S. Constitution forbids ex post facto laws.) Then, if the city violated those new regulations, it would be subject to the legal process of stripping its funding. In a dictatorship, on the other hand, the law is whatever the dictator says it is – going forward and backward – with violations and punishments determined ad hoc by him or his

minions. Trump prefers the dictatorial method, and now Barr is his enforcer. That’s why Trump has concocted the comically absurd category of “anarchist jurisdiction,” and Barr’s DOJ has placed New York City in that category on a totally arbitrary basis. Now, New York could lose billions of dollars in federal aid – not for anything it was given advance warning could trigger such a penalty, but for actions it has already taken: displeasing the president by passing modest policing reforms. Never mind that the finding that New York City is an anarchist jurisdiction is ridiculous; that Barr would even participate in the charade of “investigating” that accusation is an impeachable stain on the Justice Department. Barr has, of course, committed similar offenses in other jurisdictions, including overruling a Washington, D.C., prosecutor to make a much lighter sentencing recommendation for New York’s own political dirty trickster Roger Stone, who was convicted for lying to Congress. He also tear gassed peaceful protesters in the district’s Lafayette Square so that Trump could have a photo op, about which he then lied. This is not normal. Contrast it, for example, with the record of Berman’s predecessor, Preet Bharara. Bharara was appointed by then-President Barack Obama, a Democrat, and he aggressively went after corruption among New York Democrats and their donors without interference from Washington. Now, with a corrupt Republican in the White House and his flunkies interfering on Trump’s behalf in New York cases, the president’s favored allies have a free hand to violate federal laws here with impunity. A state without laws for some is a state without the rule of law. Impeachment is the mechanism by which the rule of law is reasserted.

WHAT DOES ‘ANARCHIST JURISDICTION’ EVEN MEAN? By Amanda Luz Henning Santiago and Kimberly Gonzalez THE U.S. DEPARTMENT OF JUSTICE classified New York City, along with Seattle and Portland, Oregon, as “anarchist jurisdictions.” While many initially found this news humorous, sharing placid photos from around the city online, the new classification could have serious negative impacts on the city, especially when it comes to receiving federal aid. The DOJ justified the city’s new classification by citing the increase in gun violence, budget cuts to its police department and several district attorneys in the city refusing to prosecute protest-related charges. City & State answered some of your biggest questions regarding the city’s new designation and what this may mean for its future. What is the definition of an “anarchist jurisdiction”? An “anarchist jurisdiction,” according to the DOJ, is a subdivision, like a city, that has “permitted violence and destruction of property to persist and (has) refused to undertake reasonable measures to counteract criminal activities.” President Donald Trump directed U.S. Attorney General William Barr and the DOJ to identify anarchist jurisdictions in a Sept. 2 memorandum. Why was NYC classified as an anarchist jurisdiction? New York City saw a rise in shootings and murders over the summer. From Jan. 1 through Sept. 13, the city had 321 murders, compared with 230 at this time last year. Due to heightened concerns

over police violence against Black people, the New York City Council, in collaboration with Mayor Bill de Blasio, cut $1 billion from the NYPD’s budget. The DOJ said the cuts will remove essential police functions, which it said was a reason to classify New York City as anarchistic. But the reality of the budget cuts was slightly more complicated. The department’s overtime budget was supposed to decline by $335 million, but the Independent Budget Office found that was unlikely to happen due, in part, to the recent protests against police brutality and systemic racism. Also, school safety agents and crossing guards were supposed to be moved out of the NYPD, but that hasn’t happened yet. Another reason cited by the DOJ for New York City’s classification was the refusal by Manhattan District Attorney Cyrus Vance Jr. and Queens District Attorney Melinda Katz to prosecute Black Lives Matter protest-related charges. Plus, de Blasio and Gov. Andrew Cuomo refused federal military support from Trump during the protests.

How could this affect the city’s federal funding?

What’s at stake if the city loses federal aid?

The new classification could prevent the city from receiving federal funding, according to Barr, who had threatened to do so if violent demonstrations did not stop. “We cannot allow federal tax dollars to be wasted when the safety of the citizenry hangs in the balance,” Barr said. “It is my hope that the cities identified by the Department of Justice today will reverse course and become serious about performing the basic function of government and start protecting their own citizens.” Barr also cited the Trump memorandum, which noted that the director of the Office of Management of Budget “shall issue guidance to the heads of agencies on restricting eligibility” of federal funds, as much as the law permits. In June, prior to the memorandum, Republican senators introduced a bill called the Ending Taxpayer Funding of Anarchy Act, which proposed the ineligibility of “federal financial assistance” to cities defined as an anarchist jurisdictions, beginning in the 2021 fiscal year.

According to a preliminary analysis by New York City Comptroller Scott Stringer’s office in 2016, the city received less than 9% of its budget from the federal government. However, that federal money did make up a sizable portion of the budgets for some city agencies, such as the Department of Housing Preservation and Development and the Administration for Children’s Services. If the cuts hit those agencies, it would place city programs in a dangerous position. The coronavirus has wreaked havoc on the finances of state and local governments, with a $14.5 billion state budget gap projected for the current fiscal year. The state is waiting on additional federal aid from Congress, so a drop in federal aid to the city could be another significant setback. Is there anything the city or state can do to stop this? Cuomo and state Attorney General Letitia James

threatened to sue the DOJ over the city’s new classification. Cuomo cited the 10th Amendment, which guarantees states’ rights, as an assurance that states and citizens have the control over that funding, not the president or attorney general. “The president should be prepared to defend this illegal order in court, which hypocritically lays the groundwork to defund New York and the very types of law enforcement President Trump pretends to care about,” James said. Is this part of Trump’s reelection strategy? Cuomo said the move to label cities as “anarchist jurisdictions” was made so that Trump could establish himself as the “law and order” candidate in the upcoming election. Trump has been similarly threatening to cut federal funding for “sanctuary cities” since 2017, but has yet to follow through due to a lengthy legal battle. So it’s entirely possible that this is another empty threat by the president.

EW YORK IS facing a $14.5 billion budget gap this fiscal year, federal relief dollars don’t appear to be forthcoming, and schools and local governments are facing deep budget cuts. The coronavirus pandemic – and the financial nightmare it created – prompted some progressive lawmakers and activists to double down on a question that New York has been weighing for years: Should we increase taxes on the state’s wealthiest residents? For left-wing activists and many Democratic state lawmakers, “tax the rich” has become a rallying cry over the past few months as the state waits on a federal stimulus package. They argue that rather than withholding billions in state aid to schools and localities, New York should pass a number of bills that would increase income taxes on millionaires, tax vacant second homes in New York City, or even reinstitute sales taxes on private jets and yachts. But Gov. Andrew Cuomo has made his resistance to increasing taxes on the wealthy well known, arguing that the proposals raised so far wouldn’t generate

enough revenue to fill the deficit, and on top of that, increasing the tax burden of New York’s wealthy residents could drive them out of the state. At a City & State webinar on Sept. 17, state Sen. Gustavo Rivera said just because these proposals wouldn’t entirely solve the state’s budget deficit, it doesn’t mean New York should turn up its nose at the additional revenue. “Even though we may not be able to ‘tax our way out of it,’ it lessens the hit,” Rivera said, adding that he wanted proposals that would raise taxes on the rich, such as the pied-à-terre tax or wealth tax, to be passed soon. Recently, Cuomo suggested he might consider raising taxes on the wealthy as part of the solution in a worst-case scenario where federal funding doesn’t come through. But he has maintained that a federal stimulus package remains critical to New York’s recovery. State Senate Majority Leader Andrea Stewart-Cousins and Assembly Speaker Carl Heastie, however, have released statements supporting raising taxes on the wealthy. But when it comes to the actual me-

chanics of increasing taxes on the rich, the state has a number of options. Of the more than a dozen bills already introduced in the Legislature that would raise different taxes on the rich, some advocates for taxing the wealthy said that six proposals should be prioritized in the state’s immediate response to the pandemic. “We had to give the Legislature something digestible, so what we wanted to focus in on were the six bills that raise the most money,” said Charles Khan, organizing director of the Strong Economy for All Coalition, a group of labor and community organizations advocating for policies that address economic inequality. “We just wanted to include a combination that a lot of different New Yorkers could get behind, that was really targeted at the very, very, very top of income earners in New York state. Because we know that regular people are struggling, but the really wealthy people are $77 billion richer since the pandemic,” Khan added, citing one recent analysis that showed how much New York’s billionaires had increased their wealth between March and June.

If New York really does want to “eat the rich,” here’s what’s on the menu.

RAISING INCOME TAXES ON MILLIONAIRES

One option for taxing the wealthy would be to increase the income tax on New York’s millionaires, adding higher income tax brackets for those making over $5 million, $10 million and $100 million annually. Currently, the highest state income tax rate is 8.82% for any individual making over $1 million. While several versions of this kind of proposal exist in the state Legislature, the most aggressive increases were included in a bill sponsored by state Sen. Robert Jackson and Assembly Member Linda Rosenthal. Under that legislation, people who make more than $100 million in taxable income would face an 11.82% income tax rate. Make Billionaires Pay, a progressive campaign urging the passage of this and other taxes on the rich, estimated that this tax increase would raise $2.5 billion to $4.5 billion annually. On Sept. 17, New Jersey officials announced that the state would pass a ver-

sion of a millionaires tax hike in response to widening economic inequality – causing some to put pressure on New York to reassess its own income tax brackets in the wake of the pandemic. Responding to those calls, state Budget Director Robert Mujica noted in a statement that the 12.6% combined city and state income tax rate in New York City – where he said most of the state’s billionaires live – is already higher than both New Jersey’s new tax rate and what state lawmakers including Jackson and Rosenthal proposed.

PIED-À-TERRE TAX

Another proposal that is hardly new to New York is the pied-à-terre tax – legislation that would tax the owners of vacant second homes in New York City worth at least $5 million. That legislation, sponsored by state Sen. Brad Hoylman and Assembly Member Deborah Glick, came relatively close to passing in the Legislature last year but was ultimately shelved in favor of a “mansion tax” on the sale of pricey homes that is expected to generate

$365 million annually. The pied-à-terre tax, however, was expected to generate $650 million per year. Khan suggested that the pied-à-terre tax, along with approving higher taxes on most millionaires, may be among the most likely bills in the package to pass the Legislature, in part because state lawmakers were already familiar with them. “I think those are the things that are the easiest. (State lawmakers) talk about them every year and say they’re so progressive, and they’re going to do them,” Khan said. “I would say those are the closest to being passed. They have a lot of widespread support across both houses.”

WEALTH TAX

While the term wealth tax is sometimes thrown around to refer to any tax hikes on the rich, there is a specific proposal in the state Legislature that is technically called a wealth tax. A bill from state Sen. Jessica Ramos and Assembly Member Carmen De La Rosa would create a “mark to market” tax on New Yorkers with more than

STOCK TRANSFER TAX

Similar to the stock buyback surcharge, a stock transfer tax is basically a tax on stock trades. While the tax exists in New York, it’s currently rebated to taxpayers. Legislation sponsored by state Sen. James Sanders Jr. and Assembly Member Phil Steck would repeal the rebate, allowing

the state to collect 100% of the tax on stock trades. But previous attempts at repealing the rebate haven’t been successful, with many roadblocks including strong opposition from Wall Street.

CORPORATE LANDLORD TAX

Finally, state lawmakers have proposed a corporate landlord tax that would tax real estate purchases by private equity firms and hedge funds, imposing the equivalent of a mortgage recording tax on those purchases. When a person buys a home in New York with a mortgage, they pay a tax “for the privilege of recording a mortgage.” But because purchases of investment real estate properties are often structured differently – not using a traditional mortgage – an equivalent recording tax does not exist when a private equity firm, for example, invests in real estate. Legislation sponsored by state Sen. Julia Salazar and Assembly Member Harvey Epstein would impose a fee on mezzanine debt and preferred equity – two types of financing used in these kinds of real estate purchases.

$1 billion in net assets. Currently, when the value of someone’s assets increases, they only face a capital gains tax when the asset is sold. This legislation, however, would tax unrealized capital gains, so that if an asset increases in value by $1 million, that $1 million is treated as taxable income even if the asset isn’t sold. The tax would bring in an estimated $5.5 billion per year, and the revenue would fund a worker bailout fund for people excluded from traditional unemployment benefits and wage protections.

Now if New York City Comptroller Scott Stringer were that type of person, he would be able to keep his knife in the sheath, since New York City Council Speaker Corey Johnson decided he won’t run for mayor after all, leaving Stringer as the leading white guy explaining why a white guy should be mayor.

The president’s son said he was willing to testify but only after the November election, for fear that his deposition may be politicized – which the judge found to be unpersuasive.
